THE FREEDOM GARNERS OVER $300,000

More than 600 people attended Feel the Freedom May 8 at Peter Fink’s American Muscle Car Museum, 5808 N. 90th St. The event raised over $300,000 to support Chariots4Hope’s mission of “demonstrating God’s love by removing transportation barriers.” Feel The Freedom is the organization’s largest fundraiser of the year. Co-founder Michelle Hurt said, “We’re so grateful to Peter and Carolyn Fink for hosting this yearly

event. It was a night filled with love, reflection, hope and inspirational stories.” Chariots4Hope is “a faith-based, nonprofit organization that supports low-income families and individuals to maintain self-sufficiency through reliable transportation and RIDE programs.” Founders Jason and Michelle Hurt started the organization after moving from New York to Omaha more than 10 years ago.

Choose Iowa Passport promotes agritourism

Iowa Secretary of Agriculture Mike Naig has launched the Choose Iowa Passport, a free, interactive digital platform designed to help Iowans and visitors find a variety of agricultural services, such as farms and farm stands, orchards, you-pick opportunities, farm-to-table dining and restaurants, farmers markets, and even boutique shops featuring locally-sourced Iowa products including Iowa-raised meats. This innovative marketing initiative is a collaboration between Choose Iowa and Travel Iowa, and promotes unique agritourism experiences and encourages visitors to enjoy Iowa-grown, -raised and -made food, beverages and agricultural products. Makers Street opens in Old Market District

A new destination for local shopping and artisan goods has officially opened its doors in Omaha’s iconic Old Market district. Makers Street is a collaborative retail space designed to spotlight small businesses and independent makers who create and sell their own handcrafted products.

Makers Street brings together a diverse group of entrepreneurs under one roof, offering a curated selection of high-quality, locally made items from home goods and art to skincare, apparel and specialty foods. Rural Mainstreet Index sinks

For the 20th time in the past 21 months, the overall Rural Mainstreet Index (RMI) sank below the 50.0 growth neutral reading in May, according to the monthly survey of bank CEOs in rural areas of a 10-state region dependent on agriculture and/or energy.

The region’s overall reading for May increased to 44.0 from April’s 40.0. The index ranges between 0 and 100, with a reading of 50.0 representing growth neutral.

“The economic outlook for 2025 farm income remains weak, according to bank CEOs. Almost one in four bankers rate tariff retaliation from trading partners as the top risk facing farmers in 2025 while 68% ranked lower farm commodity prices as the major risk factor for farmers,” said Ernie Goss, Ph.D., Jack A. MacAllister Chair in Regional Economics at Creighton University’s Heider College of Business.

Midlands African Chamber launches fifth annual event

The Midlands African Chamber, Inc. (MAC) held the Pitch Black 2025 Launch Party on May 17 at the Tri-Faith Initiative, 13136 Faith Plz. in Omaha. This event unveiled the five finalists selected to compete at the Pitch Black 2025 Conference and revealed the lineup of national, regional and local keynote speakers coming to offer insights on leadership and access to capital at the premier conference. The theme of the conference is Empowering Visions, Fueling Success.

The Pitch Black finalists were selected from over 36 applicants from six states. The Launch Party marked the opening of MAC and the Pitch Black Conference’s fifth anniversary. It served as an opportunity to highlight the leadership and innovation shaping the region’s Black and underserved business community.

inCOMMON Community Development celebrated the groundbreaking of The Poppleton May 14, an affordable housing development located in the heart of the Park Avenue neighborhood. The project marks the first phase of a 121-unit mixed-income, mixed-use development.

According to the 2021 Housing Affordability in the Omaha and Council Bluffs Area report, there is currently a shortage of 78,800 affordable housing units in the region, with the gap expected to grow to 104,000 units by 2040.

Recent redevelopment in the Park Avenue area has led to improvements and attracted middle-income residents, but it has also displaced low-income families.

Displacement means losing access to essential services such as transportation, health care, schools and local amenities, causing significant upheaval in families’ lives. The new affordable housing at The Poppleton will help mitigate this displacement and provide stability for residents.

The Warrior Within JAY MIRALLES LEADING EFFORTS TO SERVE FELLOW VETERANS

Jay Miralles felt the miles roll under his feet, an endless, unrelenting march, reminiscent of other missions in other lands. The late summer warmth from earlier had disintegrated into unseasonably cold temperatures by evening, yet he moved forward, undaunted. He’d volunteered for this one, leading five hardy souls in the process. Success was far from certain, except to the stouthearted cadre of walking warriors in the middle of it.

“One day I said to my friends, ‘I’m going to walk for my 50th birthday and we’re going to walk from Lincoln to Omaha to raise $2,500,’” Miralles remembered about that day in 2020. “My wife said, ‘You know, if you don’t raise that $2,500, you’ve gotta write the check yourself.’ I was like, ‘Yeah, I know that.’ Six of us showed up and we raised $25,000 in 48 hours.”

Miralles had no intention of what he called a “birthday publicity stunt” to raise some money and awareness of the plight of veterans to go any further than that, until people started reaching out asking when the next march was. Every military exercise starts with a single shot, and he had fired the first round of what would become the nonprofit 50 Mile March Foundation.

“For years I said, ‘God, I promise if you ever help me get on my feet, I’m going to do something good,’” said Miralles, the group’s co-founder. “It was an empty promise for almost 20 years. I volunteered here and there, you know, in the community. I’ve done my share of giving out turkeys, going to the homeless shelter food drive. Gave blood. But I never found anything that I was connected to, before this.”

Miralles came to Bellevue by way of the United State Air Force, which the native Californian joined right out of high school and to which he devoted 10 meaningful years.

“I thoroughly enjoyed my military career,” he said. “It was something that I needed because I lacked discipline as a child. I didn’t have good grades, I didn’t have good routines. I joined the military as an escape to find something that I was missing — belonging, like a tribe or a gang, or a community. I wanted to belong to something.”

Life as a U.S. serviceman taught him all those things and then some but didn’t prepare him for the shock of it ending.

“The hardest day for me was outprocessing,” he said. “I remember them saying to me, ‘Congratulations, this is the last day. You never have to wear the uniform again,’ as if that was a good thing. I remember my heart sank because I thought, ‘Wait a minute; I don’t get to put this on anymore.’

“That ended an era of predictability, belonging, purpose, mission. For the first time in my life, I had no one expecting me to be anywhere, no team environment, no directives, no checklist. There were so many things missing that I used to set my routine by. It was a very hard adjustment and I almost shut down.”

Few of Miralles’ acquaintances knew how he was struggling. He successfully landed a job at which he never missed a day and performed well. In fact, people marveled at how often he would stay late, they thought, as a sign of dedication. The truth was that following a bitter divorce he lacked a permanent address and lived out of his car for 10 months, sleeping in church parking lots or crashing at friends’ houses. The shame and despair he felt over his situation even drove him to attempt on his own life, twice.

“I never wanted to tell anybody because I was too ashamed. I told everyone ‘I don’t need help. I don’t have a problem.’ One of my friends finally said, ‘Hey, you need my help,’ and he told me I could live with him in his basement,” Miralles said of the turning point. “He also said, ‘You’re going to have to do chores around here. You’re going to have to mow my grass, help me bring my kids to school sometimes.’

“At first I was like, ‘I’m not going to be some houseboy or some cleaning company

or your assistant.’ But I remember the very first time he made me wash my car and it gave me purpose. God, it felt good.”

Miralles’ life looks much different today, as State Growth Consultant for Farm Bureau Financial Services and a successful Realtor for Better Homes and Gardens, The Good Life Group. He’s also remarried and father to four. Life isn’t a picnic, but it’s much better.

The march has grown to raise $1.5 million, lifetime, and hosted 148 walkers last year. This summer, he’s expecting 225 participants to take in $1 million. That, along with other events through the years, has helped the 50 Mile March Foundation expand its vision substantially. Last year, it purchased seven acres in Bellevue as home to the forthcoming Community of Hope campus to eventually serve veterans via a community center, transitional housing, access to mental health, addiction recovery and employment services, as well as programs focused on life skills and self-sufficiency.

All told, the community will require years and tens of millions of dollars to become reality, challenges that leave Miralles unfazed. He carries where he’s been like a ruck, to remind him of what his brothers and sisters in arms go through still, things the Community of Hope can help set straight. For that purpose, he’s bringing along anyone who wishes to be a part of the solution, whether they served or not.

“Here’s something I want the world to know,” he said. “We’re a mix of veterans and non-veterans. Sometimes people who are civilians have that look in their eye like they’re someone who’s not welcomed in what we’re doing. I want them to know; everyone has served in their own way. We needed people to come home to, we need people to love us here at home. That’s how we serve together now. I feel a purpose here, bigger than it was in the military.”

RETIRED OMAHA NEWSMAN JOHN KNICELY CARVED OUT LOCAL LEGACY

Longtime WOWT news anchorreporter John Knicely made a final sign-off March 12, emotionally recalling stories he filed on his father, Jack, and daughter, Krista. In the weeks leading-up to that goodbye the station’s news division, now branded First Alert 6, ran special segments detailing his career along with heartfelt testimonials from admirers. Thus concluded a 50-year broadcast career, 40 of those at WOWT.

“It was definitely touching,” said Knicely, who has since moved. “It just makes you so thankful they would go to that extent. I heard from so many people, including some I didn’t know and others I knew long ago and reconnected with. All of those things were just over-the-top good and it still is to this day. When I’m out in the community it’s, ‘Congrats on your retirement.’”

A recent visit back saw Knicely exchange hugs and handshakes with colleagues, a reminder of the camaraderie that came with the job. Retired KETV news director Rose Ann Shannon knows the measure of his impact.

“I worked with John as a trusted colleague at KETV (when he was sports director) and as a tough competitor after he moved over to WOWT,” she said. “John was part of a sort of golden age in Omaha television. His name and face will be remembered long after his last broadcast.”

During his career he also became an in-demand emcee for charitable events. Even though no longer on camera, he still answers the call from nonprofits.

“I think it’s very important,” he said. “It’s another way you’re active in the community, and it really does showcase very positive things going on. These events often recognize outstanding people in leadership you don’t hear about. It’s great to be part of efforts to recognize that.”

“It was just another way of participating in a story and to tell stories you wouldn’t hear otherwise,” he said. “I think it resonated for the viewer because it was giving a look behind the scenes to see how things get done.”

Knicely, a man of faith and family, is intentional about being productive in his golden years. He has more free time to pursue golf, and is even putting on a tournament.

“I love golf but there has to be more to life than that. I may be the master of my schedule now but I still need direction and purpose,” he said, adding he found both in his career but only after a spiritual catharsis as a young man.

“I’m appreciative of the grounding I had in my faith. I said way back then, ‘Lord, use me in the way you want to use me,’” he said. “I think he had a purpose for me. I’m seeing that now. What a wonderful reward that is.”

Participation journalism became Knicely’s hallmark. It started with “I Challenge John” sports pieces at KETV.

“It was an idea from the corporate office,” he said. “There was a sportscaster in one of their stations doing it and they suggested I give it a try, so I did. It was very popular.”

So was his “John at Work” series at WOWT.

His “Knicely Done” series, he said, featured everyday people “who just had a story to tell that was worth hearing and seeing.” He said he found satisfaction doing it all on that series.

“Boy, those stories were so fun and interesting for me to report on because I learned so much in the process,” he said. “Generally I shot ‘Knicely Done’ myself. Often it would be on a Saturday or Sunday morning when I couldn’t get a cameraperson. So it was much easier to just shoot it myself and then edit it.

“You visualized going into the interview or situation how it was going to be shot, then as it was happening you saw the video you needed to capture to put the story together. You’ve got all these elements and it’s a puzzle in some ways, to where this will fit perfectly with that. Many times the story was told with video and sound as opposed to an explanation from the narrator.”

His career trajectory — from sports at WOWT, then at KTVI in St. Louis and at KETV, to being a news anchor-reporter back at WOWT — was an unusual one. Once dominant in the market,

John was part of a sort of golden age in Omaha television.

WOWT struggled in the ratings when management chanced hiring “a sports guy” to replace Gary Kerr as co-anchor alongside Pat Persaud. Persaud and others questioned the move but once she got to know him, she said, ”Things changed and we just gelled … and the rest is history.”

WOWT surged to the top during the pair’s 13-year run. Persaud credits Knicely’s “team approach” with making it work, putting into practice his mantra, “We’re doing this together.”

Knicely adjusted to working on the news side, becoming with Persaud the face of the station. Engaging with viewers on-air and in the community became even more of a priority.

“I was confident I could do it. I think I was able to handle that transition well,” said Knicely, who was determined to be more than a talking head. “As an anchor you can be tied to the anchor desk but I made a point not to be. That’s why I did those stories from the field — to be actively reporting and not just sitting behind a teleprompter.

“It takes a lot more time if you’re out there doing the stories I did. It probably added another eight hours to the workweek but I needed that time to do it right. The editing process can be time-intensive.”

Another WOWT series he’s proud of found him and photographer Roger Hamer embed in the Hilltop Housing projects.

“We spent three days and two nights actually living there and doing stories. It had been kind of a hot (crime) area,” Knicely said. “We set the scene. The police knew we were going to do it. We had a contact in the community that was a big help. We did several stories from that. They were very positive. Mothers living there with kids really working hard and trying to better their situation and opportunities presented by businesses to help in those situations.

“That spawned the series ‘Listen to North O’ where we did stories highlighting people doing things in that community the media wasn’t telling.”

As a reporter, he had the distinction of accompanying his late father, a World War II combat pilot who flew “the hump” over the Himalayas, on an honor flight to Washington, D.C., and escorting daughter Krista, a Miss Nebraska winner, at the Miss America pageant in Atlantic City, N.J.

“That was such a privilege in both of those situations to be there, to be a part of it and report on it at the same time,” he said. “It was so special.”

Knicely considers the most significant story he did to be a profile on Robert Williams, a death row inmate who learned his last appeal was denied just before Knicely met with him at the Nebraska State Penitentiary. Knicely reported that, despite Williams committing horrible crimes that condemned him to death, he’d found peace inside, even forming a prison ministry. His born-again experience resonated with Knicely’s own years earlier.

“It was such a paradox,” Knicely said. “I had a great job and great friends but inside was an emptiness. There had to be more and I knew what it was. I got down on my knees on a Christmas Eve and I said, ‘Lord, I just give up, I don’t want to do this by myself anymore, I want to do what you want me to do, so take my life and use it.’ It was the most significant decision I ever made. It changed my life and it continues to this day.

“It’s kind of like what Robert Williams said at the end of the interview: ‘I hope this doesn’t offend anybody but this is what God has done in my life.’ When you have something so deep and meaningful and life-changing you’re certainly glad to share it or at least to live it every day and make it visible that way.”

For someone as affable as Knicely, it’s not surprising he gravitated to upbeat stories. “Often you hear, ‘Why is news so negative?’ It often comes across that way,” he said. “The

series I did presented the other side of things going on in our community about positive things happening. I think for the viewer, it’s encouraging and uplifting.”

He adapted to the digital revolution ushering in the 24/7 news cycle with its ever-greater mobility and immediacy to report breaking news.

“It’s been amazing seeing that develop,” he said. “We shot film when I started, then we went from that to videotape, then microwave and satellite trucks came along and we could be live from anywhere. Those were huge changes in the profession. Now, with my smartphone, I can livestream even as a citizen and get it out to the public. It’s just crazy how that’s all transformed.”

New tech has created ever more platforms where people source their news. One way network affiliates remain relevant is through hyperlocal reporting and community engagement. Stations and networks have had to adjust to match competitors’ on-demand services.

“What really is the issue now is that you can watch (news) whenever you have time or get a take on the same story via social media,” he said. “Stations have to stay relevant in that way, so there’s a lot of effort in all local news to be strong in those areas.”

He said news organizations that consistently prove reliable build trust with audiences and the worst thing a reporter or news service can do is to betray that trust. Like many of his generation he’s dismayed by how the lines have blurred between objectivity and subjectivity.

“Your opinion doesn’t matter, the story does,” he said. “It has to be presented that way, it can’t be slighted in any way, and you can’t exclude something just because you don’t agree with it. Unfortunately I think journalism, especially on a national scale, has deviated from that, and there’s a lot more opinion and bias that slips in.”

In retirement, he’s finding an old reporter’s instincts die hard.

“It’s funny, I’m retired but I’m still out in the community and I’ll see something interesting and think, ‘Gosh, this would be a good story,’” he said. MIDLANDS

FIFTH ANNUAL BIKE WITH MIKE HONORS LOVED ONE

May 2020 was a month Steve Kutilek, president and CEO of Customer Service Profiles, will never forget. He and his family — wife Anne, and sons Joe, Tom and Hank — had been watching Steve and Anne’s son, Mike, deal with schizophrenia for a few short months, and that month, Mike took his own life.

The tragedy made the Kutilek family determined to keep Mike’s memory alive while trying to help reduce stigmas around mental illness.

One of Mike’s favorite activities was riding the weekly “taco ride” on the Wabash Trace, which goes from Lewis Central Middle School in Council Bluffs to Tobey Jack’s Steak House in Mineola, Iowa, and back. That made for the perfect location for a fundraiser, aptly named Bike With Mike.

The event is now in its fifth year, and will be held June 7, starting at 9 a.m. with check-in, with a 10 a.m. ride start time. Those who don’t bicycle are welcome to come to the restaurant for this family-friendly fundraiser which includes tacos, kids’ activities and raffle prizes. A short program will be held.

Kutilek said that while Mike ultimately couldn’t be helped, there are resources for those in need.

“The first signs of mental illness or the first signs of anxiety or a little bit of depression, what we like to say is, if you’re not feeling OK, take immediate action whether it’s you yourself taking action or if you know a loved one that is struggling,” Kutilek said.

Aileen Brady, CEO of Community Alliance, said, “We saw this as an opportunity, that our community still needed to be educated about mental health services and that there was hope.

“I think that I’m most excited and proud that the awareness is being raised (among) this younger crowd that may not have thought much about themselves or their friends, how to check in with their friends and how important it is to check in and ask, ‘Are you OK?’”

The event has raised more than $200,000 per year during its short history and attracted up to 450 attendees annually. Among the attendees this year are presenting sponsors Emily Mayfield and her husband, Tampa Bay Buccaneers quarterback Baker Mayfield. Emily approached the Kutileks, whom she knew from attending school with Mike, about being part of the event.

“Bike With Mike is special to Baker and me for several reasons,” Emily said. “Mike was a dear friend of mine in grade school and it is a huge honor to help in a small way to carry on his legacy through Bike With Mike. I think mental health awareness is so important, and it deserves all the attention and support it can get.”

If the 2025 event follows suit, the event will surpass $1 million in net proceeds to Community Alliance of Omaha. Those funds have helped the organization increase its capacity to serve. The response time to those seeking help has gone from people needing to wait several weeks to being able to walk in and see someone.

“In our primary care clinic, we can do same day,” Brady said. “In our psychiatric service, it might be a few days but still, someone will see that person when they walk in.”

That increase in capacity and services is uplifting to Kutilek, who has seen his family’s tragedy become a source of inspiration in just a few years.

So, there are multiple efforts that are out there.”

When Cyrus Jaffery came to the United States from Afghanistan as a 14-year-old in 2002, he didn’t speak English. Today, he has overcome such challenges as a language barrier and has built a successful company.

Since 2013, Jaffery Insurance and Financial Services, an Omaha-based company, has opened offices in 30 states, representing more than 20 insurance companies. Having worked with a single insurance provider in the past, Jaffery believed he could offer clients better options while also enjoying life.

“I wanted to control my destiny,” Jaffery said. “I wanted to build a legacy for the kids and for the team, and I wanted to impact a lot more people. I think that was the biggest piece of it. We wanted to do things our own way. At the end of the day, we wanted to do what was right for the client, because I don’t believe any client fits into one box.”

Pandemic proved game changer

While the COVID-19 pandemic impacted companies differently, working virtually proved to be a game changer for the company, Jaffery said.

“Our model before was you (met) with three to four people a day, and that’s how you build a business,” he said. “You’re going to close one or two, but when COVID happened, nobody sat with us. Now you’re calling people. You’re doing Zoom calls and using technology, using all of those to your advantage. So you’re building a connection with the other person, but you cut down driving time, you cut down the fat, you cut down all the extra time that you were wasting. We went from one agent meeting three people a day, to now we can do 10 to 15.”

Recalling how the Omaha community helped his family when they immigrated from Afghanistan, Jaffery ensures the company supports its communities. Jaffery Insurance and

Financial Services supports local organizations such as the Omaha Home for Boys, as well as groups seeking to overcome cancer. Jaffery also assists Afghan immigrants relocating to Omaha.

Technology impacts sales

As outside influences impact a customer’s availability, Jaffery Insurance has used technology and innovation to improve customer service, he said. An agent only needs a customer’s name and address, which they can use to pull information such as birthdates and vehicle VINs.

“We’ll run it by 50 different companies, and we’ll give you the best option that works for you,” Jaffery said. “If it doesn’t work for you, stay where you are. I feel like making it easy for the consumer to do business with you is what we have done.”

All in all, branching out on his own ended up being the perfect move, he said.

“It reminds me of Amazon, with Jeff Bezos sitting in the basement of this office, where we’re like, ‘What are we doing? What did we just do?’” Jaffery said. “Looking back now, with 130 employees, our office has 10,000 square feet. Sometimes in life, you get these directions that, like, maybe God is leading you that way, or maybe somebody’s pushing you certain ways.”

Family importance

Family drives his success, not financial prowess, Jaffery said.

“I’m most proud of taking the time off to take my kids to school or go on a vacation if I want, or do certain things with family,” he said. “Also, the impact that we have made to a lot of people’s lives in our office. I get to work with three of my siblings.”

Jaffery wants his company to grow to 500 team members.

“My goal in life is to impact a million people,” he said. “I think the people you can impact the most are the people that are around you the most. The people you talk to every day, because then they can go impact people, and that’s how you change the world.”

Jaffery’s suggestion to his younger self, as well as others, would be to take chances in life.

“You know a lot of people have these ideas, these big things that they want to do, but they just never pull the trigger, because they’re scared about what if it doesn’t turn out?” Jaffery said. “I’ve made a lot of bad decisions in this business, but I’ve made some really good ones, too. I would have never made those good decisions if I hadn’t made those bad decisions, because I wouldn’t have pulled the trigger.”

Infotec 2025 Unleashes Potential

AI AT FOREFRONT OF AIM EVENT FOR BUSINESSES

A variety of professionals came together Monday, May 5, at Kiewit Luminarium for the Infotec Conference. AIM president and CEO Dala Alphonso said the event was curated to be relevant to businesspeople.

“This is geared for business, and how technology enables and intersects with innovation,” Alphonso said “It also focuses on things like workforce development. Today, if you look at some of the topics we’re talking about, we’re talking about things like improvement around things like automation and efficiencies and productivity.

The event garnered around 300 people in attendance, and Alphonso and his team put the event together in just under three months.

Nate Watson, CEO of Contemporary Analysis, has come to this event previously and said it was one of his favorite conferences to attend.

“It’s the right event for me, with the right people,” said Watson, who also moderated a panel. “Individuals who want to learn, who want to engage with tech in their community.”

The day started with keynote speaker Sam Sapp, founder and CEO of Lockbaud in

Kansas City, before moving to breakout sessions on topics ranging from “Nonprofit Innovation in the Age of AI” to “Data-Driven Decision Making.”

The day included several breaks to allow for collaboration and networking. Attendee Josh Sievers, solutions consultant with ProsperSpark, appreciated being able to connect with others.

“I enjoyed finding like-minded individuals,” Sievers said. “When you are behind a computer a lot, you don’t get to talk to many people.”

The event concluded with raffle prizes and a trivia contest. Alphonso said he hoped people came away knowing that technology can empower people in their businesses.

“Technology is an enabler. That is the biggest thing,” he said. “It’s actually meant to improve work. Know that innovation is possible, irrespective of the industry that one is in, and that innovation is actually accelerated through technology. Then thirdly, we want people to have the opportunity to network, to understand that they’re not in business in isolation, they’re not alone in their journey.”

Where do you get your entrepreneurial drive? Nobody wants to hire me as an employee, so I needed to create jobs for myself!

What advice do you have for aspiring entrepreneurs? Find your passion, learn everything you can about it, and don’t let anyone tell you no. When you are bursting at the seams with demands on your time, hire people to help you with the tasks you can outsource. This will keep you focused on your most productive and best use of time, enabling you to do the things where you shine.

The Illusion of Valuation Support

We’ve heard a lot of talk over the past year about how cheap small-cap stocks were. It was a trendy call for a number of market strategists. Relative to large caps, smaller companies were trading at valuation discounts that hadn’t been seen in over 20 years. Some even proclaimed that this part of the market had already priced in a recession. Meanwhile, not only did the S&P 500 carry a premium valuation but such strategists stated that much of its performance was narrowly driven by only a handful of firms. History proved that such concentration couldn’t last. Thus, small caps were poised to “breakout” as market performance broadened.

It was a classic “mean reversion” call: Select the optically cheap part of the market that has underperformed and wait for things to normalize. Even if it takes longer than expected, at least low valuations will provide downside protection since much of the bad news was “priced in.”

Except it wasn’t.

Some retail and professional investors alike continue to be misled by the allure of low valuation ratios.

The chart above is a case in point: Here, we compare the performance of an index of small cap stocks, the Russell 2000, to a large-cap index, the S&P 500, from late November 2024 to early April 2025. Despite having a lower price-toearnings (P/E) ratio, the Russell 2000 offered less downside protection than the S&P 500 during the recent market rout. Smaller firms tend to be more cyclical and sensitive to interest rates than larger ones. A trade war wasn’t going to help. Even now, the Russell 2000 is down over 6% year-to-date, compared to a slight gain for the S&P 500.

Our point is that leading with valuation without considering the underlying fundamentals can often lead investors astray. Perhaps there was a time in market history that “spotting” low P/E ratios was considered an investment

edge that produced positive results. That time has passed.

Cheap can always get cheaper without support from improving fundamentals. This is why HFS focuses on the longer-term prospects of business dynamics versus simplistic investment theses that lean heavily on valuation. Price matters, but it’s not the only thing.

Bio:

A 2010 political science graduate of Creighton University, Chris Eastwick earned his law degree from the University of Iowa College of Law in 2014 where he received the Boyd Service Award and was Note and Comment Editor for the Journal of Corporation Law. His legal specialties include mergers and acquisitions and private equity.

Eastwick is also a former president of the Urban League of Nebraska Board of Directors and was a member of the 2019 cohort of the Nebraska State Bar Association Leadership Academy.

Who or what inspired you to enter the legal profession?

Interestingly enough, I’ve wanted to be an attorney since the 5th grade. I’ve tried to trace it back to a specific experience, but I think it comes down to always having been a problem-solver and having a long-standing desire to help people.

What was the biggest wake-up call between law school and practicing in the “real world”?

My biggest wake-up call between law school and practicing law was realizing that law school teaches you how to understand and apply the law but does not teach you how to be an attorney. Watching knowledgeable, experienced attorneys represent real-world clients with real-world problems is how you learn to be an attorney.

I’ve been fortunate to have great mentors throughout my career who have been willing to invest time and effort in my professional development which has been instrumental in getting my practice to where it is today. In return, I try to pay it forward and mentor the next generation of up-and-coming attorneys.

What drew you to your legal specialty and what do you enjoy most about it?

This is probably an oversimplification, but it was really a process of elimination. Over the years, I’ve had the opportunity to practice in a number of different areas of the law and was able to figure out what I liked and didn’t like. Mergers and acquisitions, which in a nutshell is helping clients buy and sell businesses, is by far my favorite. It’s fast-paced, allows me to leverage my business background, and offers enough variety to keep me interested. The process for every transaction is the same but each business is different, and each transaction presents its own unique set of challenges.

M&A is like trying to solve a puzzle in a way that’s most advantageous to your client while up against a shot clock — the closing date! I also have the privilege of working with great clients and some of the best attorneys in the business at Koley Jessen.

What advice would you have for your 15-year-old self?

I’m an ambitious, goal-oriented person and at times I can get so laser-focused on accomplishing a specific goal that I forget to enjoy the small victories along the way. I would tell my 15-year-old

self to remember to enjoy the journey and personal connections made along the way. And buy Nvidia.

What nonprofits are close to your heart and why?

Community service has always been a key part of my definition of success. My passion is supporting organizations that provide opportunities for young people who may not otherwise receive them.

When I started my practice, I wanted to make sure that community service became a part of my work-life balance, so I immediately joined the Urban League of Nebraska Board of Directors. Over the course of nine years, I served in various capacities on the Urban League Board of Directors, culminating with a three-year term as board chair.

How do you maintain work-life balance?

As an attorney and father of three, two of which are toddlers, achieving a work-life “balance” is a moving target, and looks different every day. To stay sane, I try to work out three to five times a week and take my toddlers on golf cart rides when the weather permits.

Why Do I Need an Attorney to Review My Commercial Lease?

Aren’t all leases the same?

No, commercial leases can vary tremendously from building to building and landlord to landlord. Although some basic concepts will remain the same, how lease terms are implemented can vary greatly.

For example?

Most “NNN” or triple net leases require tenants to pay their share of common area maintenance, insurance and taxes. A savvy real estate lawyer can help a tenant protect itself, so they aren’t paying for a landlord’s negligence in those costs. Other costs can be hidden, too, such as fine art, excessive landscaping or the landlord’s personal attorney.

Are leases negotiable?

Yes. We represent many landlords, so we know what areas can be negotiated and which terms are likely non-negotiable. Our goal is to achieve a balance that protects a tenant, while still providing the landlord with certainty. Ultimately, we can negotiate a document that clearly spells out the parties’ rights and responsibilities, so both landlord and tenant know exactly what will happen during the term of a lease. Businesses require certainty — on both the landlord and tenant sides.

What are big areas of concern for tenants?

Most standard leases contain provisions for a tenant’s default and the remedies available to a landlord for the same. If a tenant fails to pay rent, a tenant will be in default and a landlord can start an eviction process after proper notice. But many commercial leases do not provide a tenant with ANY remedies upon a landlord’s default. What if a landlord doesn’t fix the roof or another area of the building for which the landlord is responsible? What about a noisy neighboring business? If a landlord defaults, a lease should clearly define a tenant’s ability to seek a remedy.

Yikes! Any other areas?

Yes, exclusivity. If you run a coffee shop, you probably do not want the landlord to permit another tenant to open a coffee shop in the same shopping center. Sounds obvious, right? Without a good exclusivity clause (which your attorney can help you secure), that nightmare can happen.

I’m a landlord . . . why are you giving away my secrets?

We represent plenty of landlords, too. If you are using the same form every time, a good real estate lawyer will make your life easier. Each landlord’s lease form should likely be modified for every situation and tenant. In particular, tenant improvement allowances and related provisions for tenant buildouts need to be carefully monitored. When was the last time you reviewed your insurance provisions? For what standard of negligence are you responsible? These provisions can and should be tailored in favor of the landlord.
