NOTICE IS HEREBY GIVEN that on May 18, 2021, the City Council of the City of Davis introduced, and on June 1, 2021 the City Council shall consider adopting the following entitled ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DAVIS AMENDING SECTION 40.03.040 OF ARTICLE 40.03 (R-1 DISTRICT) OF THE DAVIS MUNICIPAL CODE TO REQUIRE A CONDITIONAL USE PERMIT FOR ADDITIONS, CONVERSIONS, OR NEW CONSTRUCTION THAT RESULT IN SIX OR MORE BEDROOMS IN A DWELLING UNIT

The proposed ordinance will amend Section 40.03.040 in Article 40.03, Residential One-Family (R-1) Zoning District, of the Davis Municipal Code to require a Conditional Use Permit (CUP) for additions, conversions, or new construction that result in 6-bedrooms or more in a dwelling. In 2007, the City adopted Ordinance 2276 which added the CUP requirement to the R-1, R-2, R-2-CD, and R-R Districts and similar PD Districts. A subsequent amendment inadvertently deleted it from the R-1 District (Article 40.03). The proposed ordinance amendment will reinstate the CUP requirement in Article 40.03 for a dwelling with 6 bedrooms or more. This permanent ordinance will replace the extension of the interim urgency ordinance previously adopted by City Council to temporarily reinstate this requirement.
