GEORGE CLOONEY

Y LO MALO DE LA FAMA

Beverly Hills.

No me estoy quejando.

GenteVIP Magazine interviews attorney Joseph Bryan Business News

We had the pleasure of meeting a young, local attorney who is passionate about what he does. We asked him a few questions about his life, both public and private. This is what he said:

My name is Joseph Bryan. I am an attorney here in Fort Myer and Naples. I was born and raised, actually born in Lee Memorial Hospital. I am one of the true natives (we’re far and few between). I went to (University of) Florida for law school.

When did you first have an interest in becoming a lawyer?

My parents say of course that from the time I was old enough to talk the decision was made. I am not sure that’s entirely accurate. In my undergraduate I was contemplating whether or not to go to law school, or medical school, so I took courses in both. When the time came, it was just the right decision to make. I went to law school. It was a fit for me.

Who is your inspiration?

Inspiration. That would have to be my mother, Dr. Bonnie Bryan. She was recently retired. She was the principal at Spring Creek Elementary. Many of our children probably know her, Dr. Bryan. She’s been in the district here for 30 years. Fantastic woman, she taught me how to speak and that’s a large part of what I do every day.

What type of law do you practice?

I practice what is generally referred to as litigation. I do criminal defense. I do general civil litigation. I do paternity. I do family law. Essentially, if it involves court room, I do it. Aside from tax matters, I try to stay away from that … and immigration.

What type of criminal cases do you handle?

I literally in Collier and Lee County handle thousands of criminal cases.

You also cover Child Support/ Family Law

Absolutely, family law, paternity.

If someone is caught with drugs?

Absolutely, all criminal defense. I’ve done it all, from driving without a license to homicide.

And domestic violence?

Absolutely, that a little bit different creature because it often involves a civil side also. Generally, when you are talking domestic violence, there has to be a familial relationship, where you have to live with somebody, so often times you’ve got other issues that I have to deal with other than just the domestic violence in criminal court. Often times you are talking about splitting up the household, you are talking about no contact orders where you can’t go back to your house. Often times, your children are there and that presents real problems which you need to get a lawyer involved quickly, otherwise you’re going to have real problems in your life in the short run.

What is a felony and how is that different from a misdemeanor case?

Misdemeanor is simply defined as anything that is punishable by a year or less in jail. Felony is a year or more. Misdemeanors for the most part aren’t very serious. You know, there are times when it’s the 20 th time someone’s been arrested, you start to look at it a little bit… the judge gets a little more angry and it takes a little more finesse and skill to deal with it. Felonies, you always need a lawyer to handle them. Florida has very strict sentencing guidelines and in many drug cases in fact the mandatory minimum, they can range from 3 to 30 years.

All drug cases are felony cases?

That’s correct. Other than marijuana, in the state of Florida, which you would have to have 20 grams or less, all drug cases are felony cases … that’s correct, including medications. If it’s a prescription medication and you possess it without a prescription, that’s a felony in the state of Florida.

Why is it a good idea to hire a lawyer rather than having a public defender?

I speak about this topic a lot and I may feel differently than a lot of other private attorney do. There are public defenders that are outstanding lawyers, okay. The problem is this: A public defender may have 250 cases at one time. They cannot provide the attention that you need to resolve a case how it should be resolved. Private lawyers- part of the reason that the expense is there is because they dedicate their time to you. In a criminal case, it is an absolute necessity. We are always preparing for trial. Preparing for trial is often times what gets a state attorney to either drop a case or to offer you a deal that you may want to take. And circling back to the public defender, they’re just so busy, they can’t prepare like they should often times, so they can’t get the result for you that you would want to have… bottom line, if your freedom matters to you, you need to hire a private attorney.

Tell us a story about your childhood, growing up in Southwest Florida.

You want this story to fit in with being a lawyer, I assume, not just a good childhood story ...

A case where you had to face a principal or …

Ok, yeah…Previously you asked me who my hero was… I said my mother. Well, being that she was always in the school district, I often times was at the school she was, and you would think that that would make it easier… not the case at all, quite the opposite. When you are sent to the principal’s office and it’s your mom, your ability to speak and maybe make excuses as a child or defend your actions, is much more difficult… because it’s your mother. She knew all my shenanigans. So, I had to walk a chalk line and …I did everything I could to stay out of mom’s office.

Where is your office located?

We are moving back down to Bonita. We were previously here in Bonita and we went to Fort Myers and Naples. Recently, my wife and I bought a home here off East Terry and we are going to come back to Bonita. We’re probably going to be back in the Bonita Bay Commons area right at the corner of 41 and Terry. We haven’t decided yet, but in all likelihood, that will be the spot.

Would you ever join a law firm?

Oh sure, I’ve been a member of law firms. At one point, I was with Henderson Franklin, which is the largest law firm here, in the Fort Myers-Naples area. In fact, they are the largest law firm between, I believe, Miami and Tampa. I was also previously with a partner outside of familial… I prefer with litigation and the type of practice I have now to work by myself, of course with a translator, secretary, paralegal, as may be required, but for litigation purposes, I prefer to handle cases on my own with the client… you don’t want too many opinions in the room. We have the client’s and we have mine and that works the best for handling litigation problems, especially criminal defense problems.

And Business law…

Absolutely, I do business litigation. Primarily through experience in litigation, through the pitfalls of litigation, I have learned what to do for businesses, as far as setting up the businesses, as far as liability goes. Essentially, anything that you would need for a business, I’ve learned in a nontraditional way. Most lawyers that get into business-type law, they do it through a non-litigation side, they started on the side where they set up a business, they set up taxes. I came (from) the total opposite direction. I started by litigating problems and from

litigating those problems, I learned the right way to handle business situations. It presents a unique perspective because I have addressed the pitfalls that when most lawyers get into handling (business cases) for the first time, that’s where I started from…

A quick summary of the types of litigations that Joseph Bryan covers…

If it involves a court room, I do it. I do criminal defense. I do family law, and when I say family law, I mean divorce, paternity, and child support. I do business litigation. I do personal injury. Anything, again, that would involve being in a court room, being in front of a jury, being in front of a judge, I do, with the exception of immigration, primarily because so much of the immigration issues involve going down to Miami to handle and with a wife and young kids it’s very hard to be constantly out of town. I am already out of town enough. I am licensed both in Colorado and Florida, so I am back and forth enough, adding Miami in that takes me over the top.

Closing statement…

My name is Joseph Bryan. I am an attorney. I practice here in Bonita, Fort Myers, and Naples, primarily although I will go farther out if needed. I can be reached at area code 407 718-1951. I have had that same number for 15 years. When I am in the office, it goes to my office phone. When I am out of the office it goes to my cell phone. You can always get me on that. I am always available. Please leave a message if it’s late or if I am in court (I may not be able to pick up), but if you leave a message, I will get right back with you and we will get right on the problem you are having. Thank you.
