
1.Background
AvocatsSansFrontièreshasbeenimplementingtheprojecttitled:Unlocking CivilSocietyVoicesforsustainabledevelopment,whoseobjectiveistopromote publicparticipationinsocio-economicandpublicgovernancethroughthe reinforcementofcivilsocietycapacity.Theprogramisanchoredonthreestrategic pillarsnamely:i)ImprovingCivilSocietymethodsofengagementwithdutybearers(documentationandmonitoringofhumanrightsviolations):ii)CivilSociety Organizations(CSOs)andLegalAidServiceProviders(LASPs)areableto accompanylocalpopulationstoaccessremedies(capacityenhancement,public legaleducation,legalprotection);and,finally,CSOsinfluencedecision-makerto adoptpositivereforms(evidence-baseddialoguesandstrategiclitigation).
InIsiolo,themainissuescoveredwerenaturalresourcegovernance,communal landrights,andmilitarizedsecurityoperations.Incontrast,Mombasafocussedon civicspaceviolations,policeabuses,andcounter-terrorism-relatedmisconduct.
Thisproject,fundedbytheBelgianDirectorate-GeneralforDevelopment CooperationandHumanitarianAid(DGD),wasimplementedbetween2022and 2026inIsioloandMombasaTheinterventionfocusedonstrengtheninghuman rightsprotectionmechanisms,improvingaccesstojustice,andpromotingcivic space.ImplementationwasledbyASFandLegalResourcesFoundation(LRF)in collaborationwithlocalcivilsocietyandcommunity-basedactors
2.ObjectiveoftheAssignment
Thepurposeofthisfinalexternalevaluationistoassesstheproject’sperformance andachievementsagainstitsintendedobjectivesandtodrawkeylessonsand recommendationstoinformfutureprogramming.Theevaluationwillserve accountabilityandlearningpurposesfortheimplementingpartners.
3.ScopeofWork
Theconsultantwillbeexpectedto:
DesignanevaluationframeworkandtoolsalignedwiththeOECD-DAC criteria(Efficiency,Effectiveness,Relevance,Sustainability,Coherence)and DGD’stransversalthemes(GenderandEnvironment),tailoredtothe project’scontextandobjectives.
Conductacomprehensivedocumentreviewofkeyprojectmaterials, includingproposals,progressreports,monitoringandevaluationdata,policy briefs,andlearningoutputs.
Facilitateparticipatoryevaluationsessionswithprojectstakeholders,
includingimplementingpartners,community-basedorganizations,duty bearers,andrightsholders,usingmixed-methodapproaches.
Undertakefieldvisitstoselectedimplementationsitestotriangulate findings,observeprojectoutcomes,andconductfocusgroupdiscussions andkeyinformantinterviewswithbeneficiariesandstakeholders.
Assesstheproject’sperformanceagainsteachofthefollowing:

ASFintervenesinsituationswherethefullandeffectiverealisationofrightsandindividual andpublicfreedomsisseriouslyendangered.Thesesituationsaremainlycharacterisedby: structuraldysfunctionsofthejusticeinstitutions,alackofindependenceofthese institutions,themanipulationofthelawbypolitical,militaryoreconomicgroups,atthe expenseofthegeneralinterest,shortcomingsintermsofwillingnessand/orcapacityofthe Statetoensuretheprovisionofbasicpublicservices,includingthepublicserviceofjustice; economicdevelopmentprospectsseverelycompromised;orsignificantsocialtensions.
Inrecentyears,ASFhasalsoasserteditselfasanorganisationthathasthewillandthe capabilitytomobilise,createlinksandanimatecollaborativedynamicsbetweenactorswho fightforthepromotionofaccesstojusticeandthedefenceofhumanrights
Allouractivitiesarecarriedoutinpartnershipwithlocalentities:organisationsandcivil societygroups,lawyers,barassociations,localinstitutionsandauthorities,community leaders,paralegals,socialworkers,internationalNGOsandotherinstitutions.Ouractivities fallintothreecategories:provisionoflegalaidservices,capacitybuilding,andadvocacy.
Theproject
WithfundingfromtheBelgianDGD,AvocatsSansFrontières(ASF)isimplementingafiveyearprogramme(2022-2026)invariousEastAfricancountries.Throughcivicparticipation, theprogrammeaimstooperateaparadigmaticchangetowardssocio-economic developmentthatissustainable,inclusive,andrespectfuloftheruleoflawandhuman rights.
TheoutcomesoughtthroughthisprojectistoempowerKenyancommunitiesandcivil societyorganizationstoengagegovernmentandindustryinfosteringaccesstojustice, goodgovernanceandhumanrightsinnaturalresourcegovernance.Theprojectworks aroundthreemainpillars,includingdocumentation,remedyandadvocacyUnderthe secondpillardedicatedtoremedy,legalassistancewillbeprovidedtocommunitieswhose humanrightshavebeenaffectedbybusinesses.Thisresearchaimstopavethewayforthis legalassistanceactivitybymappingoutremediesandcommunities’challengesinengaging withthem.
