Supreme Court To Hear UGC Equity Regulations

Petitions to challenge the new Equity Regulations 2026 set forth by the University Grants Commission (UGC) are going to be heard by the Supreme Court of India, a step that has provoked a debate in the country. The hearing would be held on Thursday, January 29, but it would be chaired by the Chief Justice of India (CJI) D.Y. Sunraykant along with Justice Joymalya Bagchi.
The laws, which aim at ensuring equality in higher learning institutions are both welcomed and criticized. Key Petitions Under Review
Nine constitutive challenges to the constitutionality of the new rules of the UGC have been brought to date. The former is the request of a social and business activist Rahul
Dewan, whose attorney, Parth Yadav, asked the Supreme Court of India to hasten the case. According to the petition by Dewan, the rules as they stand are seen to potentially bring about new types of discrimination rather than equality.
An appeal has been filed individually by post-doctoral researcher Mr. Tiwari of Banaras Hindu University (BHU) and advocate Vineet Jindal. All the petitions are directed to the amendment in the 2012 regulations that were officially announced on January 13, 2026.
Scandalous Prepositions and Outcry
Equity Regulations state that there should be equity committees, equal opportunities centers, and 24/7 helplines in the university. Although these provisions are meant to empower redressal of grievances against SC, ST and OBC students, critics believe that the wording of the provisions may be used against the students of the general category. There are also concerns that there are no measures in place to prevent the abuse of the system of complaints.
Already, the new rules provoked protests on a national level. There are people who have declared a countrywide India bandh, such as the Karni Sena, which has claimed that the regulations were enforced without thorough consultation with all the stakeholders.
UGC and Government’s Stand
The UGC asserts that the regulations are meant to deter discrimination and even out the opportunities in the colleges and universities. The authorities believe that the more inclusive environment can be achieved by forcing the establishment of equity committees and complaint centers. UGC says that such reforms were based on a Supreme Court petition submitted in August 2019 that required more serious anti-discrimination policies in educational institutions.
