Dr. Varish was honored by her peers as the Wisconsin Chiropractic Association Chiropractor of the Year in 2021. On a local level, Dr. Wendy has been a long-term volunteer and board member of the Howards Grove Advancement Association and a Charter member and Secretary of the Howards Grove Education Foundation.

Episode 2: Dr. Steve Yeomans, Chiropractor | Ripon, WI Dr. Steve Yeomans joins the Back to Basics podcast with Dr. Chris Resch to discuss how he was inspired to become a chiropractor, what it was like to be a third-generation chiropractor, his research and teaching career, how he communicates with patients, and what is in his patient care clinical toolbox and much more. He concludes the interview with insights on what it takes to get better. Dr. Yeomans is a 1979 graduate of National College of Chiropractic. He is in clinical practice in Ripon, Wisconsin. He received the Wisconsin Chiropractic Association Chiropractor of the Year award in 1994 and the Lifetime Achievement award in 2019. Dr. Yeomans is a researcher, author, and educator to chiropractors around the globe.

FOREVER CHEMICALS MAY BE MAKING OUR PATIENTS SICK by Dr. David Brouilette

had the pleasure of speaking with a seasoned doctor at a WCA conference a while back and asked, “What do you see as the biggest difference between chiropractic practice now compared to when you started over 40 years ago?” His response was humbling in that his concern was not about insurance, record keeping, computers, technology, or the challenges in finding good staff. He said, “In the old days patients got well really fast, they stayed well much longer, and they were much less sick overall.”

According to the Agency for Toxic Disease Substance Registry (ATSDR),

"most people in the United States have been exposed to PFAS and have PFAS in their blood." Some PFAS in the environment are linked to harmful health effects in humans and animals at extremely low concentrations, possibly as low as 4 parts per trillion. The EPA has recently changed drinking water advisories accordingly.

After being so embarrassed that my own selfish concerns were on the increasing challenges of running a business, this doctor had opened my eyes to a perplexing phenomenon that I have witnessed in my comparatively short time in practice as well. My patients, and my own family, were getting sicker despite chiropractic care, exercise, and healthier food choices. In my own twenty-five plus years in practice, Diabetes has become a predictable outcome of older age, autoimmune disorders from Crohn’s Disease to RA are commonplace, we are forced to learn about developmental problems of the newborn that in school we were told, “you may never see this”, our schools now have entire wings devoted to educating those with learning disabilities, and our patients are physically getting huge starting at an early age. This is all anecdotal evidence but ask any older doctor – something is different.

Health problems associated with PFAS exposure may include: • decreased fertility • developmental difficulties in children (low birth weight, accelerated puberty, bone variations, or behavioral changes) • increased risk of some cancers • altered immune and hormone system function • increased cholesterol levels • and/or risk of obesity

My wife and I are not anti-vaxers, but our kids were not on the same schedule that our pediatricians recommended. For example, they were not immunized as infants for a disease that usually affects IV drug users and were never injected with mercury. And yet my own kids have not been spared despite being raised nearly as clean as any chiropractor’s kids. They all, however, have one thing in common – they consumed city water from conception.

(National Academies of Sciences, Engineering, and Medicine. 2022. Guidance on PFAS Exposure, Testing, and Clinical Follow-Up. Washington, DC: The National Academies Press). On June 1st, 2023, Time Magazine claims that manufacturers have known that PFAS chemicals were toxic for decades. A scientific paper was recently published that provided evidence that PFAS is likely present in 45% of our US population's tap water (Environment International Volume 178, August 2023, 108033). Although there are over 12,000 such substances, the possible presence of just 33 of them was tested in 716 tap water samples collected from residences, businesses, and water treatment plants across the entire US.

What are forever chemicals?

We all secretly like the forever chemicals. They cut grease, resist flames, protect our furniture and clothing from stains, clean our hair, and prevent food from sticking to cookware. Unfortunately, these chemicals, called Per- and polyfluoroalkyl substances (PFAS), that make our lives better in so many ways, take over 1000 years to break down – and are toxic.

The results seem to indicate that, • in rural areas, one might have a 25% chance of having these substances in your tap water; • if you live in a city, the possible likelihood increases to approximately 75%. • Living near a military base, an airport, a site of industrial contamination or a chemical spill, or being serviced by a water utility with known contamination issues, increases the likelihood of drinking water containing PFAS.

Forever chemicals were first developed in the 1940s and are widely used in common household items like cleaning products, water-resistant fabrics, non-stick cookware, personal care items (like shampoo), and stain-resistant coatings used on carpets, upholstery, and other fabrics. Any facility that produces, uses, or manages the waste from these products can be sources of PFAS release into the environment. Once inside the human body they bind to proteins, cannot be removed medically, and may take decades for the body to clear them naturally. National Library of Medicine

PFAS - Cont. from page 6 We cannot count on our natural water to improve anytime soon. The Clean Water Act protections that have been in place since 1972 have recently been substantially reduced. Another study was released on July 25th of this year in the Journal of Physical Chemistry (J. Phys. Chem. A 2023, 127, 30, 6309–6319) shows some promise that PFAS can be removed ultrasonically. View Article Hundreds of cities across the US are already in need of funding to upgrade their water treatment systems to be able to remove the PFAS.

Sackett v. Environmental Protection Agency. The short story is that because the Supreme Court redefined the word "adjacent" to mean "adjoining," vast areas of wetlands in the US will be less protected from waste disposal. You may read the actual decision at the link below. The connection between this decision and water protections is found on the last few pages.

Many healthcare providers are recommending that water should not be consumed unless it has been tested by a certified lab or has been processed through an NSF approved RO system or distillation filter, especially if pregnant or nursing.

This issue will have a substantial socioeconomic impact beyond the possible health consequences. In the home, reverse osmosis (RO) and home distillation systems effectively remove these chemicals at a cost of hundreds of dollars per household. NSF is a trusted thirdparty certifier that regularly tests the claims of water filter manufacturers, and the results of these findings can be found on their website.

To further reduce exposure, non-stick cooking surfaces should be avoided. 2019 Clinician Guidelines Fact Sheet Many municipalities have already tested their wells for PFAS; however, private well tests are available. For an investment of around $300, you may encourage your patients to have their tap water tested for the most common PFAS compounds.

On the municipal level, the city of Stuart, Florida has successfully taken on this challenge on a large scale and is now delivering safer drinking water to all of its residents through a process called ion exchange. For more information on this advanced water treatment technology, see their website. The cost to update this one plant was "millions and millions and millions" of dollars. A news report first published on September 5, 2023, provides a recap of their specific plight.

Tactics of Utilization Management Companies Called Out at Legislative Hearing Assembly Bill 507 would address many of these anti-patient practices but opponents are already working to kill it. The Assembly Committee on Health, chaired by Rep. Clint Moses (R-Menomonie), held a public hearing last month on legislation that would address many of tactics employed by health insurance companies and their associated utilization management companies that inhibit the ability of chiropractors, physical therapists and occupational therapists to provide necessary care to their patients without going through onerous pre authorization steps. AB 507, authored by Rep. Nancy VanderMeer (R-Tomah), is an ambitious piece of legislation that attempts to do the following:

The legislation has the support of a broad coalition of health care providers (see page 11) including the Wisconsin Chiropractic Association. Dr. Jeff Wilder testified on behalf of the Wisconsin Chiropractic Association at the hearing (see WI Eye video) The legislation is predictably opposed by the health insurance and business lobby (see below).

• Prohibits health insurance companies (and utilization management companies acting on their behalf) from requiring preauthorization for the first 12 visits for chiropractic care, physical therapy, occupational therapy and speech therapy;

• Prohibits health insurance companies/UM companies from requiring preauthorization for chiropractic care, physical therapy, occupational therapy and speech therapy for the first 90 days for patients with chronic pain;

“The WCA is fully committed to fighting for passage of AB 507 but the practical reality is that the insurance lobby is very influential in the Wisconsin Legislature and moving the bill will be an uphill battle,” said WCA Executive Director John Murray.

• Prohibits health insurance companies/UM companies from using claims data when determining approval of care;

Assembly Bill 507 - Next Steps

• Requires health insurance companies/UM companies to approve care requests within 48 or the care is automatically approved; • Requires health insurance companies/UM companies to explain denial of care in plain language;

The Assembly Health Committee did not vote on AB 507 after the public hearing. Most legislative committees in Wisconsin do not vote on bills the same day that they have a public hearing on them.

• Require co pays for chiropractic care, physical therapy, occupational therapy and speech therapy be the same as primary care visits; and

The next step is determining if the bill has the votes to be passed out of committee. That will require outreach to the 16 members of the Assembly Health Committee.

•

Requires health insurance companies to compensate providers for their time in dealing with preauthorization issues.

Chairman Moses, who is the first chiropractor elected to the Wisconsin Legislature, has indicated public support for AB 507 and;

five of the sixteen members of the Assembly Health committee are co-sponsors of the bill.

The question is where do the other 11 members of the Committee stand on the bill?

The WCA and the other provider groups supporting the bill will be working with Chairman Moses and committee members to secure enough votes for it to get voted out of committee. At this point in time, the WCA is “keeping its powder dry” in terms of mobilizing members to contact their legislative representatives asking them to support AB 507 but that might change when it becomes more clear where all 16 members of the committee are on it. “The WCA will be working with the other providers groups to build support for the bill with members of the Assembly Health Committee and hopefully position it for a committee vote in early 2024,” said WCA Executive Director John Murray. “Once the bill is out of committee and available for a floor vote in the Wisconsin Assembly, we will mobilize our members to contact their Representatives and ask them to support it.” If you have any questions on AB 507, please contact WCA Executive Director John Murray at jmurray@wichiro.org.

Medicaid Payment Parity State Budget Provision Update WCA confirms shared CPT code list with State Medicaid Office. The WCA backed state budget provision that requires the Wisconsin Medicaid program to reimburse chiropractors at the same rates as physicians for shared CPT codes is scheduled to go into effect January 1, 2024. This is consistent with the intent of the language of the budget provision approved in the 2023-2025 state budget. The WCA has been working with the Wisconsin Medicaid office to confirm the list of shared CPT codes that will increase in 2024.

View Shared CPT Code List According to the Wisconsin Medicaid Office, the increased reimbursement amounts will be communicated to participating chiropractors in December 2023 via a Forward Health bulletin and will go into effect January 1, 2024. “Payment parity for shared CPT codes within Medicaid is another step towards payment equality for chiropractors in Wisconsin,” said WCA President Chris Resch. “The WCA will continue working to get all of our services paid for under Medicaid at rates comparable to physicians.”

These four professionals were recognized at the WCA Fall Convention Achievement Awards Luncheon for their outstanding service and dedication.

Lifetime Achievement Award

Nels Bakke Award

The WCA Lifetime Achievement Award was created to recognize chiropractors that have made continuous contributions to the chiropractic profession throughout their careers. Because the award reflects a lifetime of involvement, it is meant to honor a chiropractor with at least 25 years of professional experience.

The Nels Bakke Award honors chiropractors that have been in practice for less than five years. It recognizes the contributions of younger practitioners who have equally dedicated themselves to serving the profession and their community.

Doctor Adam Considine is a Chiropractor in Fitchburg, Wisconsin. He earned his undergraduate degree from Wheaton College in Illinois before going on to graduate from the Palmer College of Chiropractic in 2021 earning his Doctor of Chiropractic. He enjoys helping athletes perform their very best, but equally enjoys caring for individuals of all ages who are motivated to reach their wellness goals. Dr. Considine is involved in numerous organizations and regularly has a positive impact on his local community. Dr. John Schubbe, DC is a Chiropractor who has been in practice since 1987. He currently practices in Appleton, WI where he has established himself as a leader both with his patients and in the community. Dr. Schubbe is someone who regularly demonstrates great honesty, compassion, determination, and intellect, setting the bar quite high as an ambassador of Chiropractic in Wisconsin.

Cindy is both a Chiropractic Technician and a Chiropractic Radiological Technician. Cindy has been working with Chiropractic Company since 1985, and in that time has served as CT, CRT and front desk staff until her recent promotion to business manager.

Dr. Eric J. Kirk is a Chiropractor in West Bend, WI who attended the Palmer College of Chiropractic. Dr. Kirk has been the Clinical Director of Chiropractic at Aurora Health Care for over 20 years and recently became the Chiropractic Residency Program Director. He regularly works to achieve positive patient outcomes in a highly integrated setting, and is also skilled in clinical research, orthopedic rehabilitation, pediatrics, and sports chiropractic. Dr. Kirk also contributes his time and expertise as a member of the Research Workgroup within the Chiropractic Future National Strategic Plan.

Earl Edward Jacot, Jr. Dr. Earl Edward Jacot, Jr., DC, also known as "Doc", passed away peacefully on December 3, 2023 at his home surrounded by his family at the age of 91. Earl was born in Chippewa Falls, WI to Earl and Nellie (Hamilton) Jacot on January 3, 1932. His family moved to Range, WI where he grew up and graduated from Amery High School in 1949. From there, he attended Northwestern College of Chiropractic in Minneapolis, MN to study and graduated in 1952 with his Doctorate in Chiropractic. In January of 1953, Earl joined the service and was stationed in Alabama where he served as an x-ray technician in the United States Army. After two years, he was discharged from the army and went on to finish his postgraduate courses at National College of Chiropractic in Chicago, IL. Earl married his sweetheart, Elvera Lundgren, on June 12, 1954, and together they were blessed with four children - Douglas, Sherry, Loren, and Teri. Earl operated his first chiropractic practice in Stevens Point, WI for one year before moving to Baldwin in 1957 and opening Baldwin Chiropractic Health Center. In 1973, he built the office where it currently stands and which is still family owned and operated. He had a passion for health care and for helping others which he did with warmth, love, and compassion. He served patients for 56 years and estimated giving 50,000 adjustments in his lifetime before fully retiring in 2011. Besides his passion for his work, Earl loved his family tremendously and enjoyed many adventures. With Elvera by his side, they enjoyed a love for music, singing, traveling, snowmobiling, motorhoming, and spending time in the company of those they love. He leaves behind a legacy, not only in his work, but also as a husband, father, grandfather, great grandfather, and friend. In the words of one of Earl’s favorite performers, Nat King Cole, “unforgettable, that’s what you are.” He will remain in the hearts of his wife Elvera; children Douglas (Debbie Gordon) Jacot, Sherry (Randy) Walker, Loren (Julie) Jacot, and Teri (Gregory) Adams; grandchildren Holly (Richard) Walker Kim, Anthony (Jessica) Walker, Gina (Daniel) Hatzung, Andrew Jacot, Cole Adams, and Dane Adams; great grandchildren Elsa, Lorelei, Emilia and Annika Hatzung, Charlie and Bennett Kim, Henry Walker; sister Carol (Ryder) Landgren as well as many nieces and nephews. He was preceded in death by his parents, Earl and Nellie Jacot, and brother, Harold Jacot. A celebration of life service for Earl will be held on Friday, December 15, 2023 at First Reformed Church in Baldwin, WI. Visitation will be from 10-12 pm with a service starting at 12 pm and interment and lunch to follow. Memorials preferred to the Chiropractic Alumni Scholarship Fund at Northwestern Health Sciences University or the First Reformed Church in Baldwin. WCA Welcomed State Rep. Clint Moses to Fall Convention Reception State Representative Clint Moses (R-Menomonie), the first chiropractor elected to the Wisconsin Legislature, was recently the special guest at an evening reception during the WCA fall convention at the Kalahari Resort in the Wisconsin Dells. The event featuring Rep. Moses was sponsored by the WCA political fund known as ChiroStrong. The event was held at Bucky’s Sky Box which is a private reception room decked out with Wisconsin Badger decor. “We were honored that Rep. Moses was able to join us during our fall convention and provide an update on the current legislative session,” said WCA President Chris Resch. During his update, Moses touched on a number of legislative issues from the recently passed 2023-2025 state budget to legislation related to physician titling, advanced practice nursing, and preauthorization of chiropractic and physical therapy services. He specifically mentioned the state budget provision that he worked with the WCA on that requires payment parity for chiropractic services on par with physicians within the State Medicaid program. Regarding the recently introduced legislation that would require health insurance plans to cover the first 12 visits of chiropractic, physical therapy, and occupational therapy and cover up to 90 days of non pharmacologic pain management by these same providers (SB 475), Moses said while the bill has strong support from the chiropractic profession, physical therapists and occupational therapists, moving it through the Legislature “will be a heavy lift.” Rep. Moses was joined at the reception by his wife Dr. Nora Moses, also a chiropractor. Both Rep. and Dr. Nora Moses graciously spent time after the Rep’s comments to talk with WCA members, take photos and snack on appetizers. “Rep. Moses has proven himself to be a serious policy maker in the Wisconsin Legislature who has earned the trust of leadership to Chair the Assembly Health Committee,” said WCA Executive Director and CEO John Murray. “We appreciate all of his work, particularly in the area of expanding access to chiropractic care in Wisconsin.”

Overlooked Components of Immune Health Nutrition plays a critical role in the maintenance of immune health. Similar to vitamin C, vitamin A helps maintain the integrity of epithelial barriers.3 It is also involved in the differentiation and function of immune cells and modulates cytokine secretion.3 As part of the adaptive immune system, vitamin A promotes the function of both T and B cells and supports the production of antibodies, which enables the adaptive immune system to develop a memory and respond more efficiently to subsequent pathogen exposures.3 Vitamin D is involved in the production of antimicrobial peptides, modulates immune cell function, and limits over-production of pro-inflammatory cytokines.3 Several medicinal herbs play an important role in modulating the immune system, including echinacea and elderberry. Echinacea is a popular herb for immune health as it is able to modulate the immune system and might have a preventative effect on the occurrence of certain infections.4 In one study, prophylactic treatment of echinacea taken over the course of four months appeared to be beneficial for preventing the common cold.2 Additionally, elderberry may reduce the duration and severity of colds and influenza.2,5 Proper nutrition is crucial for a healthy immune response. Vitamins and herbs are involved in many immune pathways including immune cell development, oxidative balance, and antibody production. Clinical studies support their ability to prevent infections as well as reduce the duration and severity of common illnesses. hen contemplating a sale, the question sellers often have is, “What does a practice broker do?” It is also of interest for buyers when purchasing a practice.

Generally, there are many steps in the sale or purchase of a chiropractic practice. The broker’s role is to manage the ins and outs of the process. Whether or not a broker is involved in the sale process, it’s important to have an appraisal conducted by an experienced chiropractic practice broker, one who is fully knowledgeable about chiropractic practices, and has ample comparables from actual successfully completed transactions.

How we help the sale process: CONTRACTUAL DOCUMENTS Contractual documents typically are provided by the broker as a go-between the buyer and seller.

BUYER SEARCH. Once your practice is ready for sale, a discreet search may start. Although a seller has many sources to find a buyer, experts stress the importance of finding the right buyer. One of the key objectives in the selling process is to attract the highest number of qualified buyers. Confidentiality is emphasized while the practice is discreetly marketed through the most effective channels.

LETTER OF INTENT. The letter of intent serves as an intermediate document before drafting a final purchase agreement. It is usually non-binding and summarizes the main terms of the purchase/sale. With a mutually agreed upon Letter of Intent, the bank can start the loan process.

FINANCING. A preliminary bank loan commitment letter prior to closing is helpful. Financing is not a simple subject. The loan must go beyond what is required to buy the practice. The buyer must include adequate operating capital into the initial loan. The good news is that it’s easier to obtain a loan for an existing practice than for a startup scratch. Selecting the right bank and banker is key. An experienced broker has banker connections and the ability to assist buyers in obtaining funding.

PURCHASE AGREEMENT. Upon being in agreement with the Letter of Intent, the Purchase Agreement should be promptly drafted. It is the most important and complex document. The first part is in structuring the sale. Will it be an Asset Sale or an Entity Sale such as LLC or Corporation? The majority of chiropractic transactions are Asset sales, however some Entity sales can be appropriate. The basic sections plus exhibits include parties’ identities, customary warranties, conditions, HIPPA compliance, tax allocation, etc.

DUE DILIGENCE Due diligence is the process for the buyer to investigate the practice. On the seller’s behalf, the broker can assist the buyer with their due diligence. Partial due diligence may include insurance credentialing, securing a lease for the premises or real estate purchase, and analyzing the seller’s information package and having operational questions satisfactorily answered. The buyer can then lay out a plan of operation along with an income projection.

Contingencies must be diligently worked on to satisfy ASAP! Closing. Practice transferred and funds distributed. Transition patients for a smooth takeover.
