The Word of Moses

This bipartisan legislation was approved by the Assembly Committee on Health unanimously during both sessions. But it never saw a floor vote by the full Assembly or even a committee hearing in the State Senate. I asked Rep. Moses why he thought these bills never got past a committee vote. Here is his response;

I highly recommend watching or listening to the recent edition of the WCA Back to Basics podcast with host WCA President Dr. Chris Resch, State Representative Clint Moses (R-Menomonie) and myself.

There’s a lot of people that are paid to come and talk to us and sway our opinion on things. The insurance lobbyists in that building have a good presence. They do a good job advocating for their cause, their purpose. They kinda killed the bill once it got out of committee the last two sessions."

The topic was the 2026 fall elections and the discussion ranged from the race for Wisconsin Governor between Congressman Tom Tiffany (WI-7) and Milwaukee County Executive David Crowley, to possible changes in majority control of the Wisconsin Legislature.

Now this should come as no surprise to anyone who knows anything about how politics works in America. Deep-pocketed insurance companies have vast resources they use to hire lobbyists, contribute directly to campaign committees and invest millions of dollars in third party advocacy groups who pay for direct mail, radio, TV and digital ads helping those same politicians get elected and reelected.

We also touched on the political dynamics of pre authorization legislation in Madison. This last item deserves a little more attention. For the past two sessions of the Wisconsin Legislature, the WCA has advocated for passage of legislation that would prohibit health insurance companies from imposing pre authorization requirements for the first twelve chiropractic visits.

Membership groups like the WCA will never have the resources to compete with corporate health insurance companies when it comes to lobbying firepower, campaign contributions or third party money.

We need to support our chiropractic champions like Rep. Moses this election cycle so we have a fighter’s chance going into the next legislative session. Let’s start raising that ruckus NOW. Just because the majority of the members of the Wisconsin Legislature are in their districts running for reelection, it does not mean that their staff are not still working at their offices in the State Capitol.

Rep. Moses had the following to say about that:

So I think from a WCA provider side of things, get to know your rep, get to know your state senator and tell them about the frustrations you’re having in practice. Tell them about the patient stories, the patients who aren’t getting care because of the bottlenecks in the pre authorization process. Let them know it is important.”

Find Your State Representative and State Senator. Enter the address you use to vote.

Email or Call their office. His comment accurately reflects the political reality of the situation. The only way groups like the WCA can overcome the huge financial and political power of the corporate health insurance companies is through direct grassroots advocacy. Chiropractors and their patients have to raise a ruckus with their elected officials and demand that they take action to curb these abusive practices. Otherwise - nothing will change.

Keep your message simple and be cordial. Tell them:

You are a chiropractor who votes in their district and you want them to support legislation that prohibits insurance companies from imposing pre authorization policies that unfairly deny important health care to their constituents.

Ask your patients to do the same.

So now that Rep, Moses has confirmed what the WCA has known for a while, what is the plan, you ask?

The sooner we pressure lawmakers on the issue of pre authorizations, the better. We have to let lawmakers know that dealing with pre authorizations is important to chiropractors and their patients and that we are not going away until action is taken.

While we will never be able to compete dollar for dollar with the corporate health insurance companies when it comes to political contributions, we also can’t concede the field to them.

2026 Election Preview Episode Over the last three legislative cycles, Wisconsin expanded chiropractic Medicaid reimbursement; first the adjustment, then parity for exams and x-rays, and now extremity adjustments. Over the same period, chiropractors in Minnesota saw access to Medicaid coverage reduced for patients over age 21. Running a chiropractic practice means you’re likely wearing many hats. From juggling patient care, insurance headaches, and overall, keeping the whole business running smoothly, Health Insurance Portability & Accountability Act (HIPAA) compliance usually tends to sit on the back burner.

While chiropractors might fall under alternative medicine, they are covered entities under HIPAA just like any other healthcare provider. It doesn't matter if you're a solo practitioner with one front desk person or a multi-location organization, if your practice handles and transmits electronic Protected Health Information (ePHI), you need to follow HIPAA.

The non-negotiables Looking for where to start? Here’s what’s at the foundation of a compliant program.

A current Security Risk Analysis (SRA)

Staff training

The SRA is a proactive analysis of your chiropractic office’s physical, technical, and administrative safeguards. The SRA needs to be kept current and will be one of the first things the OCR asks for if your practice is investigated.

Once a year, minimum, and documented. "We talked about it in a meeting" doesn't count in the eyes of the OCR. If your office experiences a breach, make sure staff is retrained to avoid similar situations happening.

Dedicated Leadership

A breach response plan

Top to bottom, your organization must take compliance seriously. Having a HIPAA Compliance Officer (HCO) is key, a resource regarding all things HIPAA in your practice.

Because if something does go wrong, having a plan beats scrambling. You must have an action plan in order, knowing how you would lock down systems, notify patients and OCR, and depending on the size of the breach, looping in the media and state.

Written policies and procedures By having policies and procedures your staff can refer to, your staff knows if they’re doing things right by the book.

Access Controls and Encryption As technology continues to advance, so do hackers. It’s key to ensure your office’s ePHI is properly protected and barriers are put in place that only those who need to see data can.

Business Associate Agreements (BAAs) with every vendor touching PHI Your billing company, your cloud EHR, your IT support all have to complete a BAA, holding both parties liable to protect PHI.

Documentation OCR doesn't just want to know you're compliant, they want to see proof. Everything about HIPAA your practice does has to be organized and documented.

Why this matters beyond avoiding fines Patients trust you with sensitive health information, and in chiropractic care, that often includes details tied to injuries, accidents, or ongoing conditions that patients don't want floating around. Treating HIPAA as a real part of running your practice protects that trust. It also protects your business, since "we were going to get to it" is not a valid defense if your office is investigated.

Building a practice together, one decision at a time How Doctors Mike and Jody Wagner have grown their Appleton practice — and the decisions they've made along the way.

Their first office had never really been theirs. It was a satellite space from another chiropractor who was looking to transfer his lease and sell his equipment. They simply made it work. When the chance came to build something of their own, they had eight and a half years of experience to pull from and knew how patients should move through the space, where the rooms belonged relative to one another, and what a day actually feels like from the front desk.

Eight and a half years into practice, Doctors Mike and Jody Wagner decided their Appleton chiropractic clinic had outgrown its space, just as prime real estate on the corner across the street went up for sale. They asked around before they committed to a major decision. Not all of the advice was encouraging, but they decided to take a chance anyway.

What made the building right was not the design. It was the years that came before it: the time it takes to learn what you like, what you do not, and what you think you’ll still want a decade later.

The plan was to be moved into their new building by Labor Day, well before Jody's late-September due date with their second child. Then came the construction delays, and groundbreaking didn't happen until Labor Day weekend. It was a very stressful time for the Wagners.

Before they built their new practice, they were told "You're never going to lose a patient because your waiting room's too small." Now, when asked about the decision to build, Mike and Jody say the critics were wrong and it was the best decision they’ve made for their practice. - 13 -


Taking a chance on themselves

Partnership in practice and in life

Practicing chiropractic wasn’t necessarily the plan for the Wagners. Jody was an undergraduate at UW-Madison when a friend's father, Dr. Petersen in Watertown, invited her to shadow his chiropractic clinic. What captured her attention was the conversations with patients — she would rather be with people than in a lab. She left his office that day already certain of what she wanted to do. Mike arrived at his decision to pursue chiropractic from his own injuries as a high school athlete. He had seen firsthand what a good chiropractor could do for someone.

The natural division of labor has worked from the beginning. They see their own patients, run their own schedules and occasionally collaborate on a shared case or a tricky adjustment. What patients don't see is the business running behind closed doors. Jody oversees the front office and staff, while Mike, more naturally inclined toward the analytical side, handles the insurance contracts, the numbers, the parts of running a practice that happen after hours. They divide and conquer. At home, the boundary is even more deliberate. Most weekends, the family drives north to their cabin. Business talk gets exactly forty-five minutes, the length of the first leg of the drive. Then, it's off limits for the rest of the weekend. It is a small rule that is consistently kept. Their boys are now teenagers, and Mike and Jody are both aware of how little time that leaves before they are off leading their own lives. They are protective of what time remains.

They met as bacteriology majors in Madison and went on to Palmer together. It wasn't until the last year of school that the question became unavoidable: work for someone else, or start something of their own. With a good support system in place, they chose to take a chance on themselves.

Patient one and beyond They opened on a Monday morning with no idea when their first patient would come. A salesman stopped by and Jody told him if he ever needed a chiropractor, to give her a call. He did, and days later, he became "patient one" at five o'clock on a Friday — the only patient she saw all week. They still see members of his family today. Twenty-two years and thousands of patients later, "patient one" is still part of the story.

Lessons they’ve learned Clear expectations with patients The first lesson is one most new DCs learn the hard way. Early in their careers, they expected to get every patient to 100 percent. Over time, they came to see objective improvement as the real win, and being honest with patients about what's realistic as part of the care. Collaboration has shaped how they practice Mike and Jody refer regularly to a small list of physiatrists, orthopedists, and spine surgeons in the area, the same handful of trusted names, built up over years. One neurology-spinal group went so far as to invite them in directly, curious how chiropractors actually evaluate a patient. "We have no idea what you do," they were told. It was, in a small way, a sign of how much the relationship between chiropractors and other providers has shifted since Mike and Jody first opened their doors.

They have always practiced with patience and with a clear sense of how they want things done. They do not lean on aggressive treatment plans or push patients toward a fixed number of visits. Instead, care is adjustment-centered and plainly explained: what they expect to happen, and what the patient can (or can’t) do to help their progress. What that honesty has earned them is trust — the kind that turns a single patient into a family, and a family into three generations walking through the same door. - 14 -

Their advice to new DCs is straightforward Build trusted referral relationships and know when to involve other providers. Knowing when to make the call, and having someone you trust to make it, is part of practicing well.

The Wagners made a deliberate choice not to build the practice around specialists; so there's no single billing expert or office manager whose absence would leave a gap. Every staff member is cross-trained across roles, even as each naturally gravitates toward the parts of the job they're best at.

They find real value in their WCA membership Events give them a place to meet like-minded peers and build relationships beyond their immediate community, and that's a big part of why they've stayed members.

The payoff shows up in the moments that matter most: when one longtime staff member needed major surgery, coverage was seamless, because everyone already knew how to do everyone else's job.

Both describe themselves as politically active, and what they value most about a strong state association is access: the ability to get chiropractic in front of the people making decisions at the state Capitol — work neither of them has the time or expertise to do from an exam room.

They say that what has worked is treating the whole front office as a team where everyone is equally capable, not a hierarchy of specialists. It is the same philosophy that has carried the Wagners for twenty-two years: no single person, no single decision, resting on one set of shoulders alone.

And that is why they contribute to the WCA's political conduit, ChiroStrong, even if it's a small amount each month. It adds up, and it's how the profession gets a seat at the table.

Patients feel the difference without ever knowing why. They just know that whoever greets them at the front desk, whichever doctor adjusts them that day, they are in good hands.

Are You Charging What Workers’ Compensation Allows? by Dr. Ray Foxworth, DC, FICC More than 43% of the charges reviewed fell below the amount allowed by the applicable state schedule. In this sample, chiropractors left more than $99,000 in allowable revenue uncollected. Each undercharged service represented an average loss of more than $45.

A chiropractor recently told me workers’ compensation patients were no longer profitable. His collections looked low, so he assumed reimbursements had been cut again. But when we reviewed numbers, the carrier was not the problem. His fees were.

The biggest surprise was where the losses occurred. Many doctors expect treatment codes to present the greatest opportunity. Instead, Evaluation and Management services were undercharged nearly 55% of the time, and higher-level examination codes accounted for more than 83% of the total revenue lost.

Like many chiropractors, he had never compared his charges with his state’s workers’ compensation fee schedule. For years, he had billed well below the maximum allowable reimbursement for many services. He was not being underpaid. He was undercharging.

The greatest source of undercharging was not the adjustment. It was the doctor’s expertise: the history, examination, clinical decision-making, diagnosis, and treatment planning supporting quality care. Chiropractors often want recognition as portal-of-entry providers, yet many charge less than the state-allowed amount for the services that demonstrate their diagnostic and clinical value.

He is far from alone. We recently analyzed workers’ compensation fee schedules and clinic charges across 49 states.

Workers’ compensation systems are highly regulated, and allowable fees are established by law, regulation, or state-approved schedules. Charging less than permitted voluntarily reduces practice revenue without creating an additional benefit for the injured worker, employer, or carrier.

From the WCA Help Desk Navigating Medicaid’s 20-Spinal-Manipulation Spell-of-Illness Policy In early July, Medicaid issued a letter addressing chiropractic compliance and misunderstandings about the 20-spinal-manipulation spell-of-illness policy in DHS 107.15(3)(b). When a New Spell of Illness May Begin Under DHS 107.15(3)(b), a new spell of illness may be designated when treatment is medically necessary and one of the following conditions applies: • • •

An acute onset of a new spinal subluxation. An acute aggravation of a pre-existing spinal subluxation caused by injury. An acute change in a pre-existing spinal subluxation supported by objective findings.

How the Spell of Illness Is Calculated A spell of illness begins on the first day of treatment or evaluation following the onset of a qualifying condition. It ends when chiropractic treatment for that condition is no longer medically necessary or after 20 spinal manipulations, whichever occurs first. Documentation and Counting Requirements • • •

Document the spell: Record each spell of illness in the patient’s plan of care. Do not carry over unused treatments: Unused treatment days from one spell of illness cannot be transferred to a new spell. Count treatments paid by other insurers: Spinal manipulations covered by Medicare or another third-party insurer count toward the 20-manipulation limit for the spell of illness.

Breaking Through Bundling Denials Insurance payers are increasingly denying re-examination claims as bundled with chiropractic manipulative treatment (CMT). The central finding is that practices can strengthen claim clarity by accurately linking each service line to the diagnosis or diagnoses that justify it and by documenting any evaluation and management (E/M) service as significant and separately identifiable when billed on the same date as CMT. This report summarizes guidance presented by Dr. Evan Gwilliam in the June webinar, The Re-Exam Reality Check: When E/M and CMT Can Coexist, and translates it into practical billing and documentation actions. Bundling denials are a recurring reimbursement risk and practices may encounter denials when an E/M re-examination and CMT are reported on the same date.

➡ An E/M service should not be billed merely because routine assessment occurred before treat-

ment; the record must support work beyond the evaluation ordinarily included in the procedure.

Diagnosis pointing communicates medical necessity. Box 21 of the CMS-1500 lists the ICD-10CM diagnosis codes for the claim. Box 24E links each individual service line to the applicable diagnosis or diagnoses by using the corresponding reference letters A–L on the paper form. Each billed service line should contain at least one accurate pointer. Missing or incorrect pointers can obscure the medical-necessity relationship and contribute to claim rejection or denial. The claim form and clinical record must tell the same story. Clinical notes should explain what occurred, why the services were necessary, and how the findings affected care. The claim then communicates that same rationale through the selected procedure codes, diagnosis codes, modifiers, and diagnosis pointers. Consistency between the claim and the record is essential because the documentation must be available to support every reported service.

Separate E/M work requires specific support. When an E/M service is performed on the same date as CMT, the documentation should establish that the E/M work was significant and separately identifiable from the usual work associated with manipulation. Different diagnoses are not automatically required, but coding and modifier use must follow current payer policy and applicable coding rules.

Breaking it all down 1. Audit diagnosis pointers before submission. Confirm that every service line points to at least one diagnosis in Box 21 and that each pointer accurately supports the service reported. 2. Establish an E/M–CMT checklist. Require staff to verify separate and identifiable E/M work, appropriate modifier use, and payer-specific requirements before billing a re-examination with CMT. 3. Align coding with documentation. Ensure that diagnoses, procedures, modifiers, assessment findings, and the treatment plan present a consistent account of medical necessity. 4. Review denial patterns. Track bundling, missing information, and medical-necessity denials by payer to identify recurring workflow or policy issues. 5. Train clinical and billing teams together. Use the webinar in the website Resource Hub as a shared training resource and reinforce the connection between clinical documentation and claim-field accuracy.

AMPK (adenosine monophosphate-activated protein kinase) is a key regulator of cellular energy metabolism. But what happens when that patient asks to return?

Evaluate the passage of time. Has enough time elapsed to demonstrate meaningful change and reduce the likelihood of recurring issues?

If you decide to allow the patient to return, establish clear expectations from the outset.

Consider this scenario: A patient was dismissed after using an offensive slur and intimidating a staff member. Months later, the patient contacts the office, expressing remorse and claiming they've changed. Should the provider allow them back into the practice?

Meet with the patient to review the practice's standards for respectful behavior, outline both patient rights and responsibilities, and discuss the consequences if future incidents occur.
