A group of African American elected officials, ministers, activists and attorneys are speaking out against the recent decision by the Illinois Supreme Court to replace a retiring subcircuit court judge who is an African American female and a resident of Austin with a white suburban woman who is a top staffer to Cook County Sheriff Tom Dart. Earlier this month, the state’s highest court picked Cara Smith, Dart’s chief policy advisor, to replace Judge Marianne Jackson on the Cook County 7th Subcircuit, which covers a significant part of Austin, Lawndale and Garfield Park, as well as West Suburbs like Forest Park, where Smith lives. Jackson, who retired last year, was appointed to the bench in 2014 to replace Judge Anthony Burrell, who died that year. On June 14, the group of African American leaders, most of whom are from the West Side, gathered outside of the downtown office of Illinois Supreme Court Justice Anne M. Burke to demand that Burke rescind Smith’s appointment. Burke is the wife of indicted Ald. Ed Burke (14th), who for years headed up the Cook County Democratic Party’s Judicial Slating Committee. get one last chance to give their input on the proposed redevelopment of the former Sears store and its parking lots at the northeast corner of North and Harlem Avenues. Ald. Chris Taliaferro (29th), whose ward includes the site, said that he intends to have one final vote during his regular June 19 community meeting, which will be held at 6 p.m. at Rutherford Sayre Fieldhouse, 6871 W. Belden Ave.

On June 14, Taliaferro had not yet announced the vote on his ward Facebook page or through his online newsletter. When reached by phone, however, he indicated that the vote would take place during his community meeting. President Toni Preckwinkle, the chair of the county Democratic Party, removed him from that post. Burke has pleaded not guilty to the charge. But Ald. Burke’s downfall didn’t stop ministers and other leaders gathered outside of his wife’s downtown office from attaching him to the current controversy over Smith’s appointment. “To see [Jackson], this black woman from the West Side, put on a judicial robe was so inspiring and comforting,” said Rev. Ira Acree, the pastor of the Greater St. John Bible Church in Austin and a co-chairman of the Leaders Network, a faith-based social justice organization based on the West Side. “We will not sit idly by and allow the Burkes to once again disrespect our community and stagnate progress in Chicago and hinder race relations like they have in a history of doing.” Anne Burke is one of three Supreme Court justices representing Cook County. The justices take turns nominating people to subcircuit vacancies. When Jackson retired, the decision to nominate her replacement revolved to Justice Burke, who announced in February that applications were open for the position. According to a statement her office released on June 14, Justice Burke posted a vacancy notice on the Supreme Court’s website seeking applicants. Those applicants then submitted their applications to attorney Kevin Forde, the chairman of Burke’s Judicial Selection Committee. The committee checked the candidates’ bar association evaluations and interviewed them before making a recommendation to Justice Burke, who also interviewed the qualified candidates. “Once I make a selection, I nominate the qualified candidate to the full Supreme Court,” Burke explained in the statement. “Each member of the Supreme Court then submits a vote on the candidate.’ Burke said that Smith, who was found “qualified” by the Chicago Bar Association

and “highly qualified” by the screening committee, garnered the vote of six Supreme Court Justices. Supreme Court Justice P. Scott Neville did not participate, Burke said. According to Injustice Watch, Forde said that the committee had evaluated twelve applicants and interviewed five for the Jackson vacancy. He said that candidates — ‘a number’ of whom were white — were evaluated based on their abilities and personal and professional histories, but he added that the selection committee is not ‘colorblind.’” The main evaluating criteria for the position was that nominees live in the 7th Subcircuit, be attorneys in good standing and be licensed to practice law in Illinois. According to Injustice Watch, Forde acknowledged that the “the committee was ‘fully aware’ of Smith’s lack of recent courtroom experience.” In her statement, Justice Burke called the appointment process “fair and open.” Opponents of Smith’s appointment, however, said that her ascension to the bench flies in the face of why the subcircuit system was created in the first place. Formed in the early 1990s, the subcircuit system is the result of an attempt to ensure that African Americans have more representation in judgeships within Cook County. “Our experience with Justice Burke is that she has been a fair woman normally, but in this case, I think all of us feel that these subcircuit positions were created for diversity,” said Rev. Marshall Hatch Sr., the pastor of the New Mt. Pilgrim Missionary Baptist Church in Garfield Park. “The face of justice matters,” Hatch said. “The cultural experience you bring to the bench matters and determines the measure of justice we can expect. We’ve seen in this town the incestuous relationship between the police and the justices on the bench.” “As a judicial person who practices and has been in state and federal court, it matters who wears the robe,” said African American attorney Mable Taylor, a lifelong resident of the West Side. Taylor said that she didn’t apply for the subcircuit position, because she found out about the vacancy too late. “We need diversity [on the bench], because we don’t want to see so many of our young, Black men locked up, when a person may

Jason Ervin (28th), the chair of the Democratic Party’s 7th District subcircuit committee. “To say that there are no qualified individuals on the West Side of Chicago to take this seat … is a false narrative.” In her statement, Justice Burke seemed to indicate that Ervin’s frustration with Smith’s appointment may be related to the fact that his preferred candidate, attorney Pamela Reaves-Harris, did not get the post. Reaves-Harris won the 10th District Illinois House seat in 2014, but decided against running for reelection two years later. She was succeeded by Ald. Ervin’s wife, Melissa Conyears-Ervin, who held the House seat until she was elected City Treasurer this year. Justice Burke said that Ald. Ervin came to her office in October 2018 and “asked me to appoint Pamela Reaves-Harris to an upcoming 7th Subcircuit vacancy.” Burke said that she let Ervin know that ReavesHarris “was welcome to apply,” but that she would need to be reviewed by the screening committee.

When she applied, however, Reaves-Harris was found “Not Recommended” for the subcircuit seat due to her “limited practice and court experience,” which “would make it difficult for her to effectively serve as a Circuit Court judge.” At the June 14 press conference, Ervin put the spotlight on Smith’s apparent lack of courtroom experience. “What is Cara Smith’s record? What has she done [other than work for Tom Dart and Lisa Madigan as policy advisor]? It’s our job to bring people we feel are qualified, not that they feel are qualified.” Attorney Patrick Dankwa John, an African American Austin resident who also applied for the 7th Subcircuit seat, said that he was found “qualified” by the Chicago Bar Association “and by most of the other ones,” but that he didn’t get a “call or an interview and I’ve been practicing law for 21 years.” John added that he Judge Jackson married him and his wife in 2014. “I found out on the news that Smith was appointed,” John said, adding that he’s poised to become the first Black, Christian president of the Jewish Bar next year. “How qualified do we have to be? There’s always a plus-one with us.” Smith’s term was scheduled to begin on June 17 and ends next year. The activists and ministers at the June 14 press conference vowed to run a candidate against her in the 2020 election. In a recent blog post about the Smith appointment, longtime Cook County attorney Jack Lehayne wrote that Springfield lawmakers could also jump into the conversation. “Demographics have shifted in many parts of the county since 1990, including, in particular, in the 7th Subcircuit. But the subcircuit boundaries have remained unchanged since the subcircuit system was put in place,” Leyhane wrote. “These population shifts spurred the Illinois General Assembly, just this month, to pass HB 2625, requiring that the subcircuit boundary lines be redrawn after the 2020 census.” CONTACT: michael@austinweeklynews.com

An Austin student reflects on Mayor Lightfoot’s impact

Just a few week after Chicago’s new mayor, Lori Lightfoot, took office, an Austin high school student reflected on what’s ahead for the city. Darien McGee, an Austin College and Career Academy High School senior, plans to attend Paul Quinn College this fall and study engineering. He takes dual-credit classes, including AP Calculus and AP English, and was chosen by his principal, Simone Griffin, to speak with AustinTalks about this important time in Chicago’s history – and what’s ahead for him. Principal Griffin said McGee has an authenticity about him because of his honesty and the way he handles any challenges or struggles that come his way. She added he had a great interest in the conversations held at the school about the Chicago mayoral election. Where do you get your information about politics from? I get a lot of the information from the news on television and social media, but in my English class I also learned a lot. We read a lot of articles and looked at what was going on currently with the election. What was it about Lightfoot’s campaign that stood out to you? She has made it clear she wants to help improve and transform Chicago Public Schools. I like how she wants to help the communities and make elementary schools high quality. I also support her focus on transforming the crime rates in the city; in the Austin community there are a lot of shootings and people are dying. Making the neighborhoods safe is important to me. As a student, what did you notice about her policies for education? Lightfoot has said she wants to support trauma instruction and increase mental health resources. I support what she is wanting to do because I know a lot of people in the community that need that extra support. How would you say Lightfoot taking office will impact personally?

It will change the community a lot because a lot of people go through traumatic things as a child, and it haunts them as they get older. So the support will give them the will to move past it. Most of the people in the Austin community do not think they can improve themselves or soar to new heights, so with Lightfoot’s support it will make the community feel like they can do better. What do you hope to see happen while Lightfoot is in office? I hope to see more equality in my community as well as others. I want to also see a change in how people view or treat the LGBTQ community. Other students at my school feel like there will be a dramatic change in the way things are in Chicago right now. Why would you say students or young adults support what Lightfoot is doing? We see her, and we see hope; we see a change with her. She is somebody different, she is not like anybody else we have ever seen. She is full of energy and displays herself as a person that can carry everyone on her back and prosper. Wells Fargo, Kidz Express, KaBOOM! Leverage 200 volunteers to build play area in Austin on June 8

Two hundred volunteers from Wells Fargo and Kidz Express joined KaBOOM! to transform an empty site into a state-of-theart playground in just six hours, serving thousands of families in the South Austin community. “Up until now, play for these kids was limited to an indoor multipurpose room and a decrepit, old playground. Having a brand-new play area will provide a fun and engaging outlet for communication, problem-solving, sharing and other critical coping skills,” said Doug Low, executive director of Kidz Express. The new play area is located at Kidz Express, 5221 W. Congress Parkway. In March, Austin kids participated in a special event where they designed their dream playground. That dream became a reality when volunteers built their new play space on June 8, inspired by those designs, in under one day. This playground is part of a broader local effort led by Wells Fargo and KaBOOM! to create an oasis for kids to feel valued and nurture their potential. “Wells Fargo is devoted to transforming the lives of Austin residents, and this new playground is just one way in which we hope to achieve a lasting impact on the community,” said Andrew Ruehl, community relations senior consultant. “We want these kids to feel supported and celebrated. They deserve a space to call their own, where kids can be kids.” Since 2015, Wells Fargo has invested $100,000 each year in the Austin neighborhood. A jury of one’s peers

just finished watching the Netflix original series When They See Us. It is a fictional depiction of the “Exonerated Five,” the four young black and one Afro-Latino teenage boys who were charged and eventually convicted as the attackers in the case of the Central Park jogger. That case from 1989 generated the term “wilding” and began a visual depiction of young people who were just out of their minds, dangerous and destructive. Since the series’ debut, it has generated a lot of feedback and fallout against those who were once considered to be heroes of the case. Linda Fairstein, head of the sex crime unit for the Manhattan District Attorney’s Office at the time of the arrest of the Exonerated Five, was the first to feel the wrath of outrage generated by the series. Next, Assistant District Attorney Linda Lederer, who prosecuted the case, has been forced to resign from her Columbia Law School position. There’s been a lot of additional scrutiny pointed toward many, but the ones who should face the deepest scrutiny … we don’t know who they are. And it’s 12 of them. They were the jurors who found those young men guilty. We all know that when we face a trial, we should sit before “a jury of our peers.” But are they really our peers? The average person tries to avoid jury duty at all costs. But when something like the Central Park case happens, and you have to go into a trial, it is those 12 individuals who can listen to the evidence and decide one’s fate. And if they are 12 people who don’t really want to do their civic duty, how much will they truly care? How much will they pay attention to the evidence? And will they

allow one person to direct them into a verdict even if their gut feeling says otherwise? Two separate trials eventually found all five of those young boys, even though no physical evidence was presented. DNA was still a relatively new science for the average person back in 1989, but none of their DNA was found at the scene. The semen found on the victim’s body didn’t match any of the five defendants. They were teenage boys who hadn’t had any contact with the law, and yet the jury listened to what the prosecutor presented, and found them guilty. If we as a society want to get mad at someone, we first need to get mad at ourselves. Because in a system where we get to judge, then it is our civic duty to do so with intent. Not to dread the jury notification, looking for myriad excuses not to go. And if picked to be on a jury, to actually pay attention and listen to the evidence. And to think. Critical thinking seems in short supply of late, as well as asking the hard questions. As a juror, one should make sense of what has been presented — and use what jurors have always been able to do, which is find reasonable doubt if it doesn’t make sense. If nothing in the case points toward the five people other than their alleged confession, which they later recanted, does it make sense that they are guilty? The criminal justice system can implement many reforms. But the first reform starts with us, the voting public, who are eligible to be jurors. Let’s take that civic responsibility with a lot more seriousness!

Dozens of Michele Clark Academic Prep Magnet High School seniors dressed in graduation caps took to the streets of Austin for a bike ride this past week to visit eight nearby elementary schools. Those schools included Oscar DePriest Elementary School, Plato Learning Academy, Edward K. Duke Ellington Elementary School, Brunson Math and Science Specialty Elementary School, Ronald E. McNair Elementary School, Henry H. Nash Elementary School, Spencer Elementary Technology Academy and George Leland Elementary School. This is the second year Michele Clark has held a “grad ride” for its graduating seniors. Michele Clark Principal Charles Anderson said last year the school did a slow ride with BUILD Chicago and met with Divvy, who partnered with the school this year and donated 70 bikes for the event. Johntuanay Johnson, the community affairs organizer for Lyft, said that Divvy has been working with Michele Clark for the past two years as part of the “Divvy for Everyone” outreach program, which is designed to encourage Divvy use in neighborhoods where residents may not be able to afford regular rates or may not have access to smart phones and/or credit cards. “We’ve been on site trying to register them, so it’s become an annual thing,” she said. “We are showing the community that young black students succeed, too,” said Dejah Tillman, one of the graduating seniors who took part in last week’s ride. Another participant, Sharai Freeman, said her favorite part was getting the chance to see the community and spend time with her classmates.

“It is an amazing opportunity, and I am glad the school offers it,” she said. Anderson said one of the main reasons he wants to continue holding the event each year is to have his students and faculty see for themselves that their community is welcoming and safe. “It is basically another graduation for them,” Anderson said. “It is an opportunity for the community as a whole to celebrate their accomplishment.” The group bike ride began about 9:30 a.m. on June 11 and continued through the community with police blocking traffic. nervous at first, but once they saw us they were overjoyed,” Anderson said. He said it’s important to build a bridge with all of the schools in Austin and to communicate with each other. While at the schools, the seniors had the chance to visit with their previous principals and teachers. Freeman said when she was in elementary school, high school seniors did not visit her school like this, and she’s glad she had the chance to give the younger kids that experience. Freeman, who will be attending Western Illinois University to study nursing in the fall, said everyone at the schools they visited was excited to see the Michele Clark seniors and talk to them about what they will be doing after graduation.

“We got to take pictures and talk to all of the principals and show them that we made it,” Deja Lipscomb said. Lipscomb said her participation in the event has given her the opportunity to influence kids. “It was important to me to participate in the bike ride because we were able to show younger students and educators that we are doing good in our community and have a future,” Tillman said. The grad ride ended with a cookout for the seniors and faculty back at Michele Clark. “This is a testament to their success and work here at the school,” Anderson said. “They can now go forward and say they did it.” CONTACT: austintalks.org@gmail.com

The project requires two zoning changes, which in Chicago traditionally requires the local alderman’s blessing. Last week, the zoning application appeared on the agenda of the June 20 meeting of the Chicago Plan Commission. The commission’s approval is the first step in finalizing the zoning change. The commission meeting will be held at 10 a.m. at Chicago City Council chambers, 121 North LaSalle St. Taliaferro said that Tucker Development has made some “small modifications,” specifically mentioning “more green space,” but he declined to elaborate further, saying that he would share the information at the meeting. Seritage spokesperson Abe Tekippe wrote in an email that “that there are no updates to share at this time.” Although the alderman said that he takes public input seriously, he was sensitive to the fact that developers and prospective tenants wanted to move on the project as quickly as possible, and he had no interest in spending any more time discussing the project after Wednesday’s meeting. Originally, Taliaferro planned to let residents hold the vote on whether he should support the zoning changes during the April 24 community meeting, but he decided to postpone the vote to wait for the traffic study to be completed. Taliaferro also wanted time to see if the developer and the city could agree on reduced density and the number of affordable housing units. When reached for comment, Judith Alexander, chair of the North Avenue District, noted that the recent Urban Land Institute report listed the site as a potential catalyst for revitalization. “We hope all remaining open issues — including zoning — are soon resolved to the satisfaction of the interested parties so that the project can move forward in a timely fashion,” she said. “We need this project in our community,” Taliaferro said. “We need quality retail, we need new quality grocery stores.” Taliaferro also said that he received “hundreds of calls” both for and against the project.
