Safer roads ahead BY HEATHER JANTZ, MJE LLC KCA PRESIDENT

Today, thousands of Kansans will travel our highways without giving much thought to the men and women working just a few feet from traffic. But, for those of us in the construction industry, we think about those men and women - our families and our workforce - every day.

use of red or blue lights, which they consider reserved for law enforcement use. Others opposed the use of green lighting, indicating it is reserved for natural disasters. And still others brought concerns about cell phone restrictions infringing on personal liberties.

Work zones are our workplaces. Unlike most workplaces, our employees often have little more than a few cones, signs, barriers and their training between them and vehicles traveling at highway speeds. That is why highway safety must remain one of our industry's highest priorities.

At the end of the day, KCA was able to negotiate a common-sense plan that successfully passed the Legislature and was signed into law by the Governor.

Different Perspectives

Earlier this year, we took that priority to the Legislature, seeking additional safety measures in work zones and during night work. Specifically, Senate Bill 366 restricts handheld cell phone use in active work zones when workers are present; and it allows for green lighting to be used during night work in addition to amber and white lighting. As contractors, increased highway safety measures seem like a no-brainer. But, other stakeholders bring different perspectives to the conversation. Law enforcement brought concerns about which colors of lighting could be used in work zones. They opposed the

Updates to the ACA employer mandate BY IMA FINANCIAL GROUP The IRS has begun issuing Letter 5699 (for failure to report) and Letter 226J assessments (with proposed Section 4980H penalties) for the 2024 tax year. As the IRS continues to actively enforce the employer shared responsibility payments and associated employer reporting requirements, we are reminded that all applicable large employers (ALEs) are subject to the Section 4980H offer of coverage requirements, and the Section 6056 employer reporting requirements on Form 1094-C and Form 1095-Cs. PAGE 6

ALEs that fail to comply with Section 4980H offer of coverage requirements may face penalties (i.e., employer shared responsibility payments) for fulltime employees who enroll in subsidized coverage through a public Marketplace.

Section 4980H Requirements

To avoid potential Section 4980H penalties, ALEs (50 or more full-time equivalents) must offer coverage to full-time employees that provides minimum value (60% or better actuarial value); and is affordable. ALEs must also offer minimum essential

coverage (MEC) to full-time employees’ dependent children (but not spouses). NOTE: Small employers (those with less than 50 FTEs) are not required to offer coverage, and if choosing to do so, are not required to use the ACA’s full-time employee definition (generally 30 hours per week) and do not have to offer affordable coverage.

Affordability

To meet the affordability requirement under Section 4980H(b) for 2027 plan years, the required employee contribution for the lowest cost minimum value plan option for employee-only (single) coverage cannot exceed 10.22% of the employee’s household income. Because employers generally do not know employees’ household income, they may instead rely on one of three affordability safe harbors (Federal Poverty Level, Rate of Pay, or Form W-2). The increase from 9.96% in 2026 to 10.22% in 2027 will allow ALEs to charge a slightly higher employee contribution for single coverage while still meeting Section 4980H(b) affordability requirements. The affordability percentage adjustments apply for “plan years beginning in…,” and therefore an ALE with a non-calendar year must apply the percentage for the year in which the plan year begins. For example, an ALE with a medical plan year of July to June would use 9.96% for the plan year beginning in July 2026 and 10.22% for the plan year beginning in July 2027.

Section 4980H Penalties

As employers prepare for 2027, ALEs need to weigh the potential risks of increased Section 4980H penalties against the cost of offering compliant coverage to full-time employees and their dependent children.

Section 4980H(a)

If the employer fails to offer MEC to at least 95% (or all but five, if greater) of full-time employees and their dependent children in any given month, a penalty will apply if any full-time employee enrolls

through a public Marketplace and qualifies for a premium tax credit (or tax subsidy). The penalty is multiplied by the total full-time employee count, minus the first 30 (allocated proportionally across controlled groups), regardless of how many employees were offered coverage. 2027 calculation = (full-time employee count – 30) x $315 for each month of non-compliance

Section 4980H(b)

If the employer satisfies Section 4980H(a) requirements, the employer may still owe a penalty for any full-time employee who is not offered minimum-value, affordable coverage if that employee enrolls through a public Marketplace and qualifies for a premium tax credit. This penalty applies on a per-employee basis rather than against the total full-time employee count. 2027 calculation = $472.50/month for each fulltime employee who enrolls through a public Marketplace and qualifies for a premium tax credit because they were not offered minimum-value, affordable coverage.

KCA'S 103RD ANNUAL CONVENTION DRAWS RECORD 649 ATTENDEES For 103 years, the Kansas heavy construction industry has gathered for KCA’s annual convention, a tradition built on relationships, education and a shared commitment to building Kansas. This year, that tradition reached a new milestone as a record number – 649 contractors, suppliers, policymakers and partners – gathered at the Overland Park Sheraton for what was already the largest construction event in the state. The popular Action Auction, sponsored by Foley Equipment, drew a packed house, raising record contributions for KCA's Political Action Committee, before giving way to a high-energy '90s honky tonk concert by Nashville artist Jeremy McComb. This year's auction was led by Ritchie Bros. An exclusive The Future of Transportation Funding panel talk with Carolyn Simons, forum for KCA ARTBA; Rep. Shannon Francis; and Rep. Adam Smith members featured the leading candidates in the Kansas governor’s race, sponsored by IMA and Merchants Bonding Company. The forum gave members a firsthand opportunity to hear from the candidates and discuss the issues that matter most to the transportation industry. The keynote with communications strategist Anthony Huey - sponsored by BRB Contractors – focused on The Power of Talk in an AI World and how to stand out through more authentic conversations and first impressions in a world where written communication generated by artificial intelligence is becoming the norm. The convention also tackled critical issues facing the industry including – a Q&A breakfast with KDOT Secretary Calvin Reed sponsored by Berry Tractor and a panel talk on what's ahead for transportation funding with Carolyn Simons of ARTBA; Rep. Shannon Francis, chairman of the House Transportation Committee; and Rep. Adam Smith, chairman of the House Tax Committee. Networking opportunities were also blended throughout the schedule, including the Opening Night Bash with Murphy Tractor, which featured premium cigar rolling, bourbon and wine tasting, and games. Building your bench BY FORVIS MAZARS

Right now, most contractors feel constrained by finding the workforce needed to meet demand. Bench strength is the depth of talent you have on your roster that helps your company grow and adapt. Not only do you need a deep bench of workers and trade partners, but you also need a bench of current and future leaders. These individuals are those who have been identified to take over when the time is right, and the people who will push your business forward even after current leadership has moved on. There are many aspects of today’s construction industry that contractors can’t control. But they can PAGE 12

lessen the impact of challenges by strengthening one of the most important value drivers in their business: their people.

Attracting the Right People

Signing new workers often feels like an uphill battle, and when your goal is to find qualified workers, the task may seem insurmountable. But there are several ways to improve your odds of attracting the right people. Understand How You’re Perceived in the Market. Step back and assess your reputation for a moment. Reputation matters more than you think. In a tight labor market, it may be the deciding

factor in whether someone joins your team or looks elsewhere. This is also useful internally. Having an awareness of this can reveal shortcomings in your organization’s people strategy and operations you didn’t know existed. Don’t Be Afraid to Raise Hiring Standards. It may sound counterintuitive, but a labor shortage isn’t a reason to lower standards. When workers are hard to find, they become mission-critical, and a bad hire can cost more in the end. Look beyond the technical qualifications and consider if this is someone who aligns with your company values. Are they known for being dependable? Do you think they’d fit in with the current team? These types of qualities aren’t going to be as easy to teach, so prioritize finding someone who is a good fit.

Retaining Your Best Talent

Retention strategies have changed. Your compensation package should be competitive, but more importantly, it should be transparent. Wages are one piece of the puzzle. Yes, you’ll need the basics: good healthcare and retirement benefits. But don’t overlook other benefits that workers value, like education reimbursement, childcare assistance, or skills training. Reconsider how you award bonuses. Rather than relying on discretionary bonuses (which employees can’t predict or plan around), consider structured incentive plans that tie bonuses to performance. If employees understand the key performance indicators that matter and how they’ll be rewarded for meeting them, they’re more likely to stay engaged and invested in the company’s success. When workers are given a reason to perform at a high standard, the bonus structure can serve as a way to build operational excellence.

Developing Future Leaders

You may have an extremely talented team that works well together and completes jobs efficiently. However, what happens if one of your key people leaves tomorrow? Contractors should address instances of relying heavily on a handful of workers,

as this forces management to develop a deeper bench of future leaders. Capture the Knowledge of Key Leaders. Every company has key employees who seem to keep everything running. It’s your job to understand and document what they actually do every day. It’s not just building a job description; it’s talking to them about what decisions they make, who they reach out to for help, what reports they review, how they solve problems, and how they communicate their decisions to others. Creating a standard operating procedure for these key positions will help ensure their knowledge isn’t lost if they unexpectedly leave. Create Stretch Opportunities. Future leaders can’t be developed overnight, so it is helpful to mentor people early. Even with knowledge of how their predecessor did the work, stepping into a leadership position overnight is rarely seamless. Giving lower-level employees opportunities to build leadership skills before they’re promoted is a lowrisk way to help them prepare. A great time to do this is during a leader’s planned vacation. Let an emerging leader take on portions of that person’s responsibilities for a finite period. Since the current leader has a definitive return date, the emerging leader has guardrails in place, and this allows them to grow their confidence. They can take initiative and know they have the freedom to make mistakes in a controlled environment.

Construction Cost $59 million Construction Timeline Construction began this Spring and is slated for completion in Summer 2029

Located through the heart of Western Kansas, U.S. 83 is the principal north-south route for moving ag products, goods and the traveling public to and from Nebraska, Oklahoma and I-70. U.S. 83 runs just north of the Finney/Haskell County line to the Arkansas River bridge, south of Garden City. With an average of nearly 4,500 vehicles traveling on U.S. 83 every day, the route is a primary freight corridor. One-third of that traffic volume is made up of commercial trucks, agricultural machinery, and oversize loads like livestock and wind turbines. To address the heavy and growing traffic volume, this $59 million investment – part of the IKE Plan – will redesign U.S. 83 as a two-lane highway with a focus on safety. That includes consolidating highway access points, improving intersection angles, and adding turn lanes and lighting. Additionally, the bridge over the Arkansas River will be repaired, and the intersection of U.S. 83 and Annie Scheer Road will be reconfigured to increase visibility and improve the angle of the intersection. Once complete, the project will increase capacity and reduce congestion with the addition of passing lanes. U.S. 83 is also being realigned south of the Buffalo Dunes Golf Course to accommodate potential for a future four-lane expansion. CONTINUED ON PAGE 16

Legislature passes stronger work zone safety laws

Governor Laura Kelly joined transportation and construction leaders July 22 to celebrate the signing of Senate Bill 366, a new law aimed at improving safety for Kansas highway workers and motorists. The ceremonial signing took place at the Polk-Quincy Viaduct jobsite in Topeka. Speakers included Gov. Kelly; KDOT Secretary Calvin Reed; Rep. Shannon Francis, House Transportation Committee Chairman; and KCA President Heather Jantz, Chief Operating Officer of MJE. “Senate Bill 366 sends a clear message that the safety of highway workers matters,” said Jantz. Several legislators who helped champion passage of the bill also attended, including Sen. Mike Petersen who chairs the Senate Transportation Committee, Sen. Mike Argabright, Sen. Brenda Dietrich, Sen. Ethan Corson and Rep. Robyn Essex. The law prohibits handheld cell phone use in active construction zones and allows additional warning lighting on construction vehicles and equipment. “This is about protecting the people who build the infrastructure that keeps Kansas moving,” said Jantz during the ceremony.

KCA Foundation awards $55,000+ in scholarships

The KCA Construction Education Foundation has awarded more than $55,000 in scholarships to 47 students pursuing careers in heavy construction. The tuition assistance helps students gain the education and training needed to succeed in construction while strengthening the pipeline of skilled workers for Kansas contractors and suppliers. This year's recipients are pursuing a range of degrees, including heavy equipment operation, construction managment, surveying and business. Scholarship recipients are eligible for additional tuition assistance if they complete an internship with a KCA member contractor. The Foundation's scholarship program is partially funded by the Spray Family Endowed Scholarship Fund, which was established in 2023 through a generous gift from Doris Spray. PICKING PROJECTS HOW WILL KANSAS' NEXT GOVERNOR CHOOSE TRANSPORTATION PROJECTS? BY BRAD COOPER | SUNFLOWER STATE JOURNAL The next governor of Kansas will have a big say in deciding how major highway projects are picked. A new multi-year transportation plan will likely be considered during the next governor’s term and the new administration will play a key role in deciding how projects will be selected for the future. During Gov. Laura Kelly’s term, the transportation department moved to a system – approved by the Legislature – for picking projects by placing them into a rolling construction pipeline that is dynamic and subject to change every two years as state transportation priorities evolve. Some projects may move faster than others, while some new work could be moved into the pipeline and expedited because of changing priorities. There also is a development pipeline for highway projects that are undergoing design and engineering work although there are no guarantees that these projects eventually make it to the construction phase. When the Legislature approved a multi-year transportation plan in 2010, the state identified $2 billion in major expansion and modernization projects upfront for construction. It’s a process that will be watched closely by the state’s highway contractors, who favor the current method.

Raymond Dondlinger recently earned a place on the Wichita Business Journal’s Power 50 list of the region’s most impactful business leaders.

Across Kansas, contractors and industry leaders are being recognized for something we’ve known for generations: the people who build our roads and bridges are also deeply committed to building stronger communities.

Companies are making an impact, too. APACKansas is investing in Newton with a new facility — creating a lasting presence and demonstrating confidence in the community’s future. And, Dane Barclay with Alsop Sand has been a driving force in bringing the economic and tourism infusion of The Bigger Dig, a national vintage construction equipment expo, to Concordia.

We see it in public service. Mike Hoffman with Alan's Excavating was elected to serve on the Butler County Commission, while Kenny Titus with Foley Industries takes his experience and perspective to Topeka as a member of the Kansas Senate. We see it in people tackling some of the biggest challenges facing Kansas. Heather Jantz with MJE is helping develop rural housing initiatives that will strengthen communities across the state and create opportunities for future growth. And we see our industry’s leadership recognized throughout the business community. Kansas Turnpike featured among projects that built our nation

The Kansas Turnpike, built in 1956, was featured in ARTBA's "Connecting a Nation: 250 Transportation Projects That Helped Build America." The list celebrates 250 transportation improvements that have fueled America's economic growth over the past two and a half centuries. The original caption on this photo, dated March 22, 1956 reads: Here's concrete evidence that Kansas motorists soon will travel in high, wide and handsome style. With spring just arriving, paving has resumed on the 236-mile Kansas Turnpike after a four-month winter lay off. Work began on a stretch eight miles east of Lawrence. Due to be completed and open for traffic in October, the highway runs from the Missouri border to the Oklahoma border.
