Conditions of Sale

1. The highest bidder to be the purchaser. subject to the Auctioneers having a right to refuse the bidding of any person. Should any dispute arise as to the b1dd1ngs , the lot 1n dispute to be immediately put up for sale again at the preceding bidding, or the Auctioneer s may declare the purchaser.

2. No person shall advance less at a bid than a sum to be nominated by the Auctioneer and no bid shall be retracted.

3. All lots are sold subJect to the right of the seller or his agent to bid or else to impose a reserve

4. The purchaser to give his name address and to pay down 10 per cent of the purchase money 1n part payment thereof. In default of any of which matters the lot or lots purchased may be immediately put up again and resold.

5. All lots are sold as shown and with all faults 1mperiect1ons , and errors to description. The Auctioneers act as agents ; they have full discretion to refuse any b1dd1ng or to withdraw any lot or lots from the sale wi thout 1n either case g1v1ng any reason ; neither they nor the Vendor are re sponsible for errors of description or for genuineness or authenticity of any lot or fault or defect 1n it and make no warranty whatever.

6 The lots are at the buyer ' s risk from the fall of the hammer and are to be taken away at the buyer ' s expense 1n default of which the Auctioneers will not hold themselves responsible ; 1f the same are lost stolen , damaged , or otherwise destroyed but they will be left at the sole risk of the purchaser If the lots are not cleared or paid for the y may then be sold immediately either publicly or by private treaty without any notice being given to the defaulter

7. Upon failure of the purchaser to comply with any of the above conditions the money deposited 1n part payments shall be forie1ted and the defaulter shall make good any loss arising from the resale togeth er with the charges and expenses 1n respect of both sales

8. No goods are to be removed while selling 1s 1n progress Receipted invoices must be produced prior to delivery of an y lot. The Elias series was painted at his home in Titirangi during 1959 and , as the artist states, "the whole series numbers about 100." Of these a few only are major works , of which He Calls For Elias is one. The series is about the inhibiting effect doubt can have on the actions of people The text is based on the ambiguous interpretation of works recorded in St Matthew ' s Gospel when Jesus calls out shortly before He dies on the Cross . The Elias series is one of several important series which occupied McCahon during the productive years following his trip to America in 1958 The painting was first exhibited at Gallery 91, Christchurch, during October 1959. It was also included in : Colin McCahon , A Survey Exhibition, Auckland City Art Gallery , March 1972: cat. no 35.

This is one of a number of works on paper produced by McCahon in mid-1972 in association with the large Parihaka Triptych This was done at the request of James Mack for the Waikato Art Museum ' s exhibition telling " The Story of Te Whiti 0 Rangomai of Parihaka " which opened 17 March 1973 In coupling Te Whiti with the earlier prophet Te Ua , McCahon was seeing their common association withthe Taranaki area , here represented as two separate but linked monuments At the time McCahon wrote of these " new ones I'm happy about - all in colour and all tough and gentle " Provenance: Private collect ion , Auckland 30 ,000-40 ,000

This , the most typical of McCahon ' s landscapes painted during his early period , is the one painting to stand out from an otherwise not very productive period , 1944 to early 1946 , when he was reassessing his aims as a painter As Colin McCahon recalls , his young son William , wanting to help , " painted the explosion in the sky I wickedly kicked him down the bank towards the pear tree ." Spring , Ruby Bay was first exhibitied in " A Retrospective Exhibition : M. T. Woollaston - Colin McCahon ," Auckland City Art Gallery, May 1963: cat. no. 55.
