Conditions of Sale

1 The highest bidder to the purchaser, subject to the Auctioneers having a right to refuse the bidding of any person. Should any dispute arise as to the biddings , the lot in dispute to be immediately put up for sale again at the preceding bidding, or the Auctioneers may declare the purchaser.

2. No person shall advance less at a bid than a sum to be nominated by the Auctioneer and no bid shall be retracted.

3. All lots are sold subject to the right of the seller or his agent to bid or else to impose a reserve.

4. The purchaser to give his name, address and to pay down 10 per cent of the purchase money in part payment thereof. In default of any of which matters the lot or lots purchased may be immediately put up again and resold .

5. All lots are sold as shown and with all faults, imperfections , and errors to description. The Auctioneers act as agents, they have full discretion to refuse any bidding or to withdraw any lot or lots from the sale without in either case giving any reason, neither they nor the Vendor are responsible for errors of description or for genuineness or authenticity of any lot or fault or defect in it, and make no warranty whatever

6 The lots are at the buyer ' s risk from the fall of the hammer and are to be taken away at the buyer ' s expense, in default of which the Auctioneers will not hold themselves responsible, if the same are lost, stolen , damaged, or otherwise destroyed, but they will be left at the sole risk of the purchaser. If the lots are not cleared or paid for, they may then be sold immediately either publicly or by private treaty, without any notice being given to the defaulter

7 Upon failure of the purchaser to comply with any of the above conditions the money deposited in part payments shall be forfeited, and the defaulter shall make good any loss arising from the resale , together withthe charges and expenses in respect of both sales .

8. No goods are to be removed while selling is in progress. Receipted invoices must be produced prior to delivery of any lot. The auctioneers reserve the right to request identification in the case of any purchaser not known to the Auctioneer who pays by cheque. Charging to credit cards will not be accepted as means of payment.

Ernest Heber Thompson was born in Dunedin and as a student he studied under A.H. O ' Keeffe. He served with the New Zealand Expeditionary Force in Egypt and France and after the war continued his studies at the Slade School in London and at the Royal College of Art. He exhibited at the Royal Academy and later became etching master at Harrow. He died in Buckinghamshire in 1971. illustrated 7 ,000-10 ,000

Demonstration given before a small class of senior pupils at Manchester High School for Girls, November 1922. Given to H.R. (Hannah Ritchie) and D.J.S. (Jane Saunders) with another now owned by D J.S. H.R. keeping this 1931. The above inscription is probably in the hand of Hannah Ritchie, the artist's close friend, and from whose estate the painting was acquired.
