hat’s on your wish list when searching for a home to lease? I did an informal survey with a small group of past and present renters to see what people look for, and the results are in.

In the top spot – without a doubt – are actually two key items that go handin-hand: clean and quiet. A building with reliable security system was also near the top of the list in many cases, as was a property manager that responded quickly to issues, and a laundry room that was readily available and fully functional. New appliances and new paint were also in demand and in one case, a home that offered lots of natural light was a request. While your “Top 10” list may read differently, make sure you do in fact have a list handy so that you can compare apples with apples when shopping for a space to lease. It’s important for property managers to know what you’re looking for when you’re shopping so that they can help you find what you’re looking for or can offer alternatives if they have access to other locations. The more locations you have to compare, the better the chances of finding just the right one that tops your list.

Whether it’s the first time moving away from home, or it’s a ritual to go back home to family and friends for the summer break and then move back to school in the fall, there is a lot of movement into student apartments and communities. But not just parents and students, summer is just an ideal time to move for everyone. Apartment balconies have more to offer – buildings onsite pools seem just too appealing, and with less chance of rain and no chance of snow, a smooth move is much more likely for summer moves. Security deposits & post-dated cheques:

DO I NEED TO PROVIDE THEM? BY JAYSON SCH WA R Z LL M & ER N E ST WOO LLB POST-DATED CHEQUES This will also vary from province to province. A post-dated cheque is a cheque that is dated for a future date. In the context of landlord and tenants, it is usually a cheque dated for the day rent is due for the remainder of the tenancy agreement. The reason for post-dated cheques is that a cheque will be incapable of being cashed until the date of the cheque.

EVERY TIME SOMEONE BEGINS TO NEGOTIATE A LEASE FOR A RESIDENTIAL PREMISES, the issue of security deposits and post-dated cheques needs to be dealt with. Consumers are often unaware of their rights and obligations and so have an unequal bargaining position with a potential landlord. Here are some comments on both issues. We hope they help. SECURITY DEPOSITS A deposit is usually demanded by the landlord in order to use all or part of the deposit to cover any damages to the property caused by the tenant or to cover rent should a tenant fail to make a rent payment. The legal limit for deposit and the type of deposit allowed will vary from province to province. A tenant may also be able to get interest on the security deposit when the tenancy ends or is terminated. Check with your local Landlord and Tenant Board to get up to date information on your rights. In Ontario, for example, a landlord can demand a rent deposit equal to one month’s rent, or the rent for one rental period, whichever is less. If the rent payments are made weekly, the deposit cannot be more than one week’s rent. If the rent payments are monthly, the deposit cannot be more than one month’s rent. However, it is illegal for a landlord in Ontario to demand a security deposit, for potential damages to a rental unit . Due to this, many landlords have tried to use creative ways to come up with charges to get around the rule for security deposits. However, the Ontario Residential Tenancies Act prohibits any other additional charges . Your landlord cannot directly or indirectly require or attempt to require from a tenant any fee or deposit of this nature. In British Columbia, the rules are different. A security

than half the one month’s rent. If a landlord accepts a security deposit that is greater than this amount, you have the right as a tenant to deduct the overpayment from your next rent payment or recover your overpaid rent. A landlord may also demand a pet damage deposit which ypnexthome.ca would cover damages to the property caused by your pet.

This is convenient for both the landlord and the tenant. The landlord will not have to hound the tenant for cheques every month and tenant will get the benefit of post-dating, namely, the landlord will be prevented from depositing all the cheques at once. However, in practice, sometimes things do not go as smoothly. Due to the large amount of cheques and the automated process in most of the country’s financial institutions, sometime cheques may be cashed early. These causes issues as the bank may hit you with fees should your account have insufficient funds and go into overdraft. This is important to keep in mind should your landlord requests post-dated cheques. For example, in Ontario and Manitoba, landlords may request post-dated cheques, but a tenant is not required to provide them. However, once a landlord and tenant agree to a method of payment, it cannot be changed unless both the landlord and tenant agree. In other provinces, such as British Columbia or Manitoba, post-dated cheques may be requested by landlords. So remember, in the rush of signing a tenancy agreement and moving into a new place; do not neglect to read over your tenancy agreement. You should never agree to a requirement in your tenancy agreement if you are unsure of its effect! Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. So help us!!! SUMMER SUN IS UPON US ONCE AGAIN. If only we could find a way to capture some of it to warm us in January (or deflect winter’s wrath to cool us down in July). Until then, try these tips for surviving the summer without air conditioning. Window coverings: During the day, close your blinds and curtains to block the sun. For even better protection, get aluminized blinds. Open windows during the evening or on cloudy days. Use fans to create a cross-breeze, circulating cooler air throughout the rooms. As soon as the sun hits the building in the morning, close windows and keep them closed until it is cooler outside than it is inside. Use fans: Personally, I have a strong preference for ceiling fans, but other people claim that all they do is push warm air down from the ceiling. You may need to get your landlord’s permission before installing one. Get the best fans you can afford – the kind that rotate are most effective. Place them strategically. Turn it off: Turn off all electrical heat sources, including electronics. Avoid using your stove or oven for cooking. Cook at night if you must, and then reheat your food in the microwave or just eat cold food. Incandescent lights create heat – switch to CFLs if possible. Sweat it out: Water vapour produced by sweating actually ypnexthome.ca takes heat away from your body if it is exposed to air and allowed to evaporate. Put your sweaty self in the path of a cool breeze or fan. Misting yourself can also give you relief. Or use wet washcloths and place them on your wrists and behind your neck.

Dress for the heat: There are different strategies here. Wear light colours and natural fabrics, not artificial fibres. Many cultures wear light clothing covering a person from head to toe. This may be effective outdoors, but at home, feel free to walk around in the bare minimum – just make sure the drapes are drawn! Eat spicy: Spicy food increases perspiration which cools the body down as it evaporates. It can also cause an endorphin rush that might make you forget about the heat. Get outside: Leave your apartment for as much of the day as you can. Take a blanket and a book and head for the nearest park or shady spot. Take a walk around the mall, or spend some time in the library. If you don’t have A/C, enjoy a setting that does! Get wet!: Many buildings have swimming pools, if yours doesn’t, find the nearest one, such as the local community centre. Alternatively, take a cool shower or fill up your bathtub with cool water and get in. You can get in and out several times during the day when necessary. I used to live in Florida and recall taking three showers a day at times. You can just soak your feet or splash cold water on your face if you like. Keep well hydrated: Drink as much water and other sugar free fluids as you can. Iced herbal tea is wonderfully refreshing. We can acclimatize ourselves somewhat to warmer temperatures, but if you find the heat too uncomfortable, consider purchasing an air conditioner for the season. Be sure to check with your landlord to make sure the wiring in your apartment will support a widow unit, and if the windows aren’t appropriate for this type of unit, a portable air conditioner may cost a little more but may be worth it to beat the heatwave.

CITY LIVING KIND OF FORCES YOU INTO A SMALL SPACE. Whether it’s because you’re on a budget – hello bachelor apartment – or not. Condos and apartments are just not made to offer a lot of storage space. But no happy renter is about to give up their perfectly located rental, next to the best 24-hour Chinese restaurant in town for more space. Come to think of it, I know a happy renter who wasn’t willing to give up their rental for a long time girlfriend, never mind leaving it for a bigger closet! No, renters just learn to live in a small space by learning and accepting a few notions along the way: HOW TO STAY ORGANIZED: Organizing your home straight from the beginning is key to manage living in a small space. It’s also key when you’re late for work and you need to find your lucky tie, spreadsheets and coffee mug in a jiffy. Luckily, renters are as creative as they get and you’ll think of plenty of tricks and storage solutions for all your home items. HOW TO LOOSE THINGS IN 100 SQUARE FEET AND LESS: Yet no matter how small your space is or how organized you try to be, you will still manage to loose things. Where do my hair elastics go? Where is the spatula when my omelet is ready to be turned over? So many questions, yet so few answers. HOW TO LET GO: Small space living forces you to purge any unnecessary items and regretfully decline beautifully crafted pieces of furniture that won’t fit up the stairs of your rental, never mind in your actual home. Sometimes you have to choose between a 40 inch tv and space to stand to change your socks. This can be tough, but it can also be liberating.
