Make wise choices and enjoy the process
W
hen only a new home will do, those in the market will be pleasantly surprised by the exceptional value and attention to detail buying new has to offer. When you buy new, you don’t inherit somebody else’s worn carpeting, personal taste in kitchen appliances or paint colour preferences. You get a fresh, clean space that’s waiting for your personal imprint. If you’ve always fantasized about buying a brand new home, here are a few tips that can help you make the process a pleasant one: • Shop the mortgage market to see what you can afford before you start your hunt; • Obtain a lawyer who is willing to review your offer as well as help you close the home; • Don’t be persuaded by high pressure sales tactics while you’re out shopping; • Determine which options and upgrades you want as part of your offer and ensure your lender will finance what’s required, if needed; • To save money, consider which upgrades you could purchase and install yourself after the sale closes. Some upgrades such as rough-ins and wiring inside the walls are easier to do before construction. Factors such as the cost of the home, neighbourhood, lot size and special features play a big role in your final decision. Determining which features your new house absolutely must have, and which features you could live without, should be among your first steps in the home-buying process. espite the fact that July was a dry month here in Vancouver (not a drop of rain fell for an entire month, a new record in our city), as a potential home investor now is the time to put plans for that imminent rainy day in the budget. It’s time, in other words, to take a cold, hard look at your finances to determine whether or not you can maintain your current lifestyle while paying off a mortgage. If you’ve already been tracking your expenses in preparation for becoming a homeowner, then you’re off to the right start, if not, then there’s no time like the present to begin. Before you start home shopping, it’s also a good idea head to the bank or a mortgage broker to get pre-approved for your mortgage. Don’t forget to factor in closing costs, including legal fees and insurance. For information on how to protect your name, family and credit while investing in property, this issue of New Home Guide offers “How to Protect Yourself From Mortgage Fraud.” On the lighter side, contributor Yanic Simard has some good advice on hanging light fixtures in “What Height Is Right?” because you’ll also want be certain to leave enough money in the bank to enjoy decorating your new home. mortgage fraud The promise of a quick profit
in real estate can be hard to resist. But consumers who misrepresent information when buying or refinancing a home could end up being responsible for any shortfall when the property is sold. If the misrepresentation is intentional, they could also be held criminally responsible as accomplices to mortgage fraud. The most common form of mortgage fraud, called straw buying, occurs when someone with good credit is convinced to put their name on a mortgage application for a home that someone else will be buying, usually in return for the promise of a quick profit. To protect your name, your credit and your family, Canada Mortgage and Housing Corp. (CMHC) offers the following tips on how to avoid becoming part of a mortgage fraud scheme: Never accept money, guarantee a loan or add your name to a mortgage unless you fully intend to purchase the property. If you allow your personal information to be used for a mortgage, even for a brief period, you could be held responsible for the entire debt even after the property is sold.
Always know who you are doing business with. If you are buying or selling a home, use only licensed real estate agents and other industry professionals. And never sign anything until you know exactly what you are signing. Determine the sales history of any property you are thinking about buying and consider having it inspected and appraised. Ask for a copy of the land title search, and find out if anyone else has a financial interest in the home. If a deposit is required, make sure the funds are held “in trust” by the Vendor’s Realty company or lawyer / notary. Get independent legal advice. Talk to your lawyer or notary about title insurance and other alternative methods of protection. To protect yourself from identity theft, never give out your personal information until you know who you are dealing with and how your information will be used. Review your mail, bank statements and other financial statements on a regular basis for inconsistencies. Shred or destroy all personal and financial documents before you throw them away. And inspect your credit report on a regular basis by contacting Equifax Canada at equifax.ca or TransUnion Canada at transunion.ca. Be wary of anyone who approaches you with an offer to make a quick profit in real estate. Remember: if a deal sounds too good to be true, it probably is. If you suspect that you or someone you know has been the victim of real estate fraud, contact your local police department immediately. Canadian home sales show highest quarterly growth since 2010: BMO ECONOMICS ACCORDING TO BMO SENIOR Economist Robert Kavcic, the latest data from the Canadian Real Estate Association shows that the Canadian housing market remains balanced and well-behaved. Existing home sales rose for the fourth month in a row in June, posting a 3.3-percent seasonally adjusted gain from the prior month and down just 0.6 per cent from the readings of a year ago. “These figures represent another body blow to the Canadian housing bears,” says Kavcic. “The June report leaves the second-quarter tally at an impressive 6.4 per cent above the previous quarter – the strongest performance since 2010. In fact, sales are now back to levels seen before
the latest round of mortgage rule tightening took effect in early July, helped by very low mortgage rates through much of the spring.” Kavcic noted that the recent rise in five-year fixed rates – now in the neighbourhood of 3.5 per cent versus subthree per cent just over a month ago – might have actually stoked sales activity in June, with buyers making their move before their lower rate contracts expired. Regionally, most markets have tightened up in recent months, including an impressive turnabout in Vancouver – sales are now 52 per cent of new listings, up from a low of 36.6 per cent late last year. Toronto is firmly balanced, while
Calgary is again seeing a sellers’ market. “It’s essential that homebuyers stresstest their mortgage against a higher interest rate to ensure they could handle any potential increases in interest rates down the road,” says Laura Parsons, mortgage expert, BMO Bank of Montreal. “It’s also wise to choose a mortgage with a shorter amortization, which can help homeowners become mortgage-free sooner.” Parsons added that those who are ready to enter the marketplace can get a head start on planning by getting preapproved for a mortgage before setting out to lock down the perfect home.

Canadian Home Builders’ Association of BC appoints new
Chief Executive Officer

A new leader is set to take the helm at the Canadian Home Builders’ Association of British Columbia (CHBA BC). Neil Moody has been appointed as the CHBA BC’s new chief executive officer effective August 1, 2013. “After a lengthy recruitment process which brought forth several impressive candidates, we are pleased to welcome Neil as our new CEO,” said CHBA BC President Nathan Stone. “Neil’s strong background in membership-driven associations will serve British Columbia’s residential construction sector well as we move forward in these challenging but exciting times. His experience working with national governments as well as business organizations will allow us to continue to grow as an industry association.” Moody’s entrepreneurial background will be helpful in understanding and serving the needs of CHBA BC’s members. He began his first successful manufacturing business at age 18

Moody’s most recent position as a real estate investment and renovation consultant with links to the Asia Pacific and Japan came on the heels of spending 14 years as executive director of the Canadian Chamber of Commerce in Japan. Moody was also the chair of the Foreign Chambers of Commerce in Japan and initiated the formation of the Canadian Chambers of Commerce and Business Associations in Asia, a membership network representing more than 3,000 members. “This is an exciting time to take on a leadership position within the residential construction industry, which is one of the most important drivers of the province’s economy,” said Moody. “There are several indications that we’re entering a period of positive growth and employment, but we’re also likely on the
cusp of rising interest rates. The way these and other factors play out over the coming months will present many opportunities as well as challenges.” There are several consumer-driven trends emerging within the residential construction sector, including the push for smaller and more affordable units, mortgage helpers including secondary suites and laneway housing, densification along transit lines, and the redevelopment of malls to include residential space. Moody takes over from M.J. Whitemarsh, who led the association for over 13 years. “I’m pleased to be working with Neil during the current transition period,” said Whitemarsh. “As a consensus-seeking team builder with political acumen and business expertise, he will provide strong direction for the industry as it deals with issues such as the release of marginal lands from the Agricultural Land Reserve and Industrial Land Reserve, both of which could play a key factor in housing affordability.” The Canadian Home Builders’ Association is the voice of the residential construction industry in Canada, representing more than 8,500 member firms across the country, including more than 1,870 members with CHBA BC. The association’s members include new home builders, renovators, developers, trade contractors, building material manufacturers and suppliers, lenders and other professionals in the housing sector. by HELLEN BUTTIGIEG ELIMINATE YOUR CLUTTER HOT SPOTS We all have certain spots in our homes that have become magnets for clutter, usually because they provide a convenient, empty flat surface to pile things on. Walk around your home to determine where the clutter hot spots are, then remove the clutter (toss it in a box or laundry basket for now) and put something beautiful in its place, like a vase or a sculpture. If it’s the dining room table, set it as if you were having a dinner party. This will deter you from using it as a drop zone. Walk around your home with the box you tossed everything into and deposit these items where they belong, either in the garbage or recycle box or stored elsewhere in your house. If they don’t have a proper home, create one.
KEEP YOUR PANTRY DECLUTTERED Most people can’t resist buying items when they go on sale. But when it comes to food, buying too much and neglecting to use it before the expiry will cost you more in the long run. It’s easy to forget what you have on hand when things build up. Whether you keep your food in the kitchen cupboards or are lucky enough to have a large pantry, keeping these areas streamlined and organized will save you time, money and frustration. Before going grocery shopping, take an inventory of everything you have and plan the meals for the upcoming week with an eye towards incorporating these items. Once you’ve used up the excess,
get into the habit of planning your weekly meals in advance. You will avoid overbuying and will always know what you’re making for dinner. STOP PAPERS FROM ACCUMULATING Are you wasting your valuable time shuffling papers? Get into the habit of thinking twice before bringing home any piece of paper or printing a page. Ask yourself whether you have a specific use for it, and if you don’t have a clear answer, leave it behind (no matter how interesting it looks). When you’re at a show or a conference, before you take the pamphlets and handouts, get realistic about what you’ll really have time to read when you get home. Paper hoarding is a habit that you can break, and doing so will save you time and energy. PURCHASE FURNITURE THAT DOES DOUBLE-DUTY Consider purchasing a few of the multi-functional furniture pieces that have become readily available in the stores recently. For example, consider an upholstered ottoman that not only provides a place to put your feet up, but also offers additional seating, doubles as a coffee table and opens up to reveal hidden storage. CREATE AN IN/OUT ZONE IN YOUR HOME Set up a small container for each family member on a table or a small bookcase by the door as a place to hold keys, cell phones and wallets. It can also act as a landing spot for brief-cases and backpacks. In addition to providing a home for those items when you walk in the door, it also gives you a consistent spot to place things you’ll need to take with you when you leave the next morning. ARE YOU BEING HELD HOSTAGE BY YOUR POSSESSIONS? If you’re reluctant to get rid of certain items because they were expensive, think about how much it’s costing you to keep them. The more possessions you have, the more time it takes to care for them and the more space it takes to store them. Although it may be difficult to let go of things that no longer serve you, the payoff is well worth it: you’ll have more free time in your day and be more relaxed in your home. FEELING STUCK If you find yourself backsliding when it comes to maintaining your organizing systems, don’t berate yourself, as this will sap your energy and prevent you from doing anything about it. Rather than dwelling on what went wrong, focus instead on what needs to be done. Just say “oops” and move on to taking action.

Demystifying Leasehold Properties

— after all, it doesn’t matter to a tenant whether the property is leasehold or freehold. Another benefit people often don’t realize is that new homes on leased land are GST exempt. So for example, if you’re buying a brand new, $500,000 home, you’ll save $25,000 — which is a lot of money.
Its origins date as far back as feudal times when kings and queens might chose to “pay” their knights with a lease giving them exclusive use of certain sections of the royal lands. Today, while leasehold is still a respected tradition in many parts of the world including England, Australia, and much of Asia, in North America it remains something of a rarity. It’s seldom discussed, frequently misunderstood, and often perceived as a second best alternative to freehold. This issue, New Home Guide chats with Kevin Hoffman, senior vice president of Aquilini Development and Construction Inc., about some of the myths and realities of the leasehold market.
Q: Okay, but what are you actually buying when you purchase a leasehold property? A: Simplistically put, you’re buying your home and renting the lot it’s on for the duration of the lease. But there are several different types of leases and different types of landlords. At UBC properties, leases are created through the UBC Properties Trust and are usually for 99 years. In False Creek, leasehold properties are with the City of Vancouver and are often shorter — 60 years or less. At Tsawwassen Shores, our master-planned community in Delta, the landowner is the Tsawwassen Shores Development Company Ltd. which is 100 per cent owned by 14, individual Tsawwassen First Nation (TFN) members. The

A: The most immediate advantage is that you’re typically able to purchase your home at a lower price than a comparable freehold — so up front you’re saving money. Obviously that’s a bonus for first time buyers. But this discount is also a huge advantage for investors because they can still rent the property out at market rates

leases are prepaid for 99 years because that’s the maximum term allowed by TFN law, but homeowners could choose to “top up” their lease after 40 or 50 years if they want to bring it back to the full 99 years.
on Westside Vancouver, and when the Band took a closer look at the surrounding area, they raised lease rates to be more in line with the neighbourhood. It was unfortunate the media coverage of that event fueled so many of the misconceptions about leased land.
Q: What happens at the end of 99 years if the homeowner decides to let the lease run its course? A: In our lease, the land would revert back to the owner who could then either renew the lease or buy the house on it for fair market value. But it’s important to look at this in context. First of all, the landlord is unlikely to want to buy back 700plus homes, so there will be motivation to renew the leases. Secondly, people generally only stay five to 10 years in one home. But let’s suppose you’re a 30 year old with children and you end up staying there for 50 years until you’re 80. You’ve still got 49 years left on that lease so you’re probably going to pass that property on to your kids or grandkids. And what’s interesting is that in many markets, we’re seeing leasehold land appreciating at roughly the same rate as freehold — so it’s a good legacy.
Q: What’s the most important thing you’d like New Home Guide readers to understand about leased land at Tsawwassen Shores? A: That they can feel secure knowing nothing can jeopardize their lease. It cannot be raised, and as long as they pay their property taxes the same as any property owner has to, they aren’t going to lose their home. Plus they get the benefit of the TFN’s extensive Neighbourhood Plan — the equivalent of a municipal OCP — that maps out where amenities like parks, schools, stores and transit will be located and will included construction of what will become BC’s largest shopping mall. When you look at it from both sides — consumers get lower prices and a planned community, the TFN is able to unlock untapped value in their land — this is a win/win for everyone involved. I believe as word gets out, there will be a fantastic response to this opportunity.
Q: Several years ago, the Musqueam Indian Band created sensational headlines — and raised the ire of dozens of homeowners — when they significantly raised lease rates on properties in Vancouver’s Southlands neighbourhood. How can buyers be confident the same thing won’t happen at Tsawwassen Shores? A: There is absolutely no chance of an increase because Tsawwassen Shores is a prepaid lease. When you purchase your home, you’ve paid the full amount of the lease — period. What happened in Vancouver was that while the leases were long-term, they were not prepaid — there was a clause that allowed the rate to be renegotiated every 10 years. Nothing happened for the first 30 years. But we all know what’s happened

What height is right?
PENDANT FIXTURES ARE AN ALL-TIME FAVOURITE BECAUSE THEY
can be installed in any room of the home. They can be casual or formal — dressed up or dressed down. The challenge most people face is deciding at what height to hang them. Here are some tips to help guide you: HALLWAY/ENTRY Especially in your entry, your pendant light should make some sort of statement since not much is going on in this area of the home. This can be one of the most difficult places determine how high to hang the light since there probably isn’t a piece of furniture underneath to help judge the distance. A general rule of thumb to follow is to hang it at least eight feet above the floor. If you have doors that swing out toward the fixture, make sure you take note of them so you leave the appropriate spacing for this also.
STAIRCASE If you’re looking to add drama and interest to your staircase, hanging a light fixture is the perfect way to do just that. Having plenty of clearance for walking up the stairs is ultimately all that needs to be considered when installing a pendant here. OVER A TABLE 28-32 inches above the table top is where this light fixture will usually hang, though it can be hung lower or higher, it’s more of a personal preference. Keep in mind for conversation, and for

serving and passing food, you don’t want it to hang right in your face while seated. Consider mounting two or three pendants above the table for added light and visual appeal. ABOVE THE KITCHEN ISLAND Whether it’s an area for cooking or an area for sitting and watching someone cook, kitchen pendant lights are normally hung 28-35 inches over the island. It really depends on the function of the island, how the area will be used most often and what you’re comfortable with. Again, hanging two or three pendants in a row can look quite beautiful. BATHROOM Instead of traditional sconces, hanging two pendants on either side of a mirror looks stunning. Choosing a fixture with clear glass will offer more light which is good for makeup and getting ready, while a diffused shade offers a more ambient feel. The middle of the light component of the pendant should hang at where the middle of the mirror is placed, close enough to the wall so no one will bump into it, but not touching the wall itself. If you’re just hanging one in the centre of the room, you again want to make sure it clears the door. MIDDLE OF THE LIVING ROOM With furniture underneath the pendant, such as a sofa or coffee table, don’t be afraid to hang your light fairly low. Usually the light will be hung over a seating area, which usually an area for conversation, as a spot for reading, watching television or resting — so you want to make sure it’s well lit but not over-bright. I would suggest having this light installed on a dimmer switch so that you have the luxury of setting your own tone of brightness.
ABOVE THE BED A pendant light hung above the bed can serve as a lovely focal point for any bedroom. Fixtures here are usually hung rather high so that you don’t end up hitting it in the middle of the night tossing and turning or when you jump out of bed because you’re late for work. Also keep in mind the sight line — if you have a television on the wall in front of your bed, you’ll want to hang it high enough so it doesn’t obstruct your view. ON EITHER SIDE OF THE BED In place of table lamps, I love the idea of hanging a pendant above each side table. Just like in the bathroom, you want it to be hung close enough to the wall so you don’t hit it, but not so it’s actually touching the wall. I would leave about 12-20 inches above the bottom of the side table so that you have room for accessories and books. SIDE NOTES

by peter kinch There has been a predictable trend in the Canadian real estate market over the past four years. The government has warned us on numerous occasions not to get overburdened with “cheap” debt. The continued low rate environment encourages homeowners to access more equity and allows the housing market to grow. Around January, the government has grown concerned about an overheated housing market and begins turning up the volume on calls for consumer restraint. By March, the federal finance minister decides to tighten mortgage rules to avert an over-heated housing market. Ironically, this action triggers an early start to the spring market as homebuyers adopt a “get in while you can” mentality and rush to make purchases before the new rules take effect. The result has been a prolonged period of low rates as central bankers around the globe look for ways to stimulate their economies. What does this mean for real estate investors? When the government looks at tinkering with mortgage rules, they tend to target the “fringe” players in the market — those deemed to be the highest risk of default: investors and self-employed borrowers. With all the changes that have taken place over the past four years, an investor could be forgiven for taking on a negative attitude, but the reality is now, more than ever, that it’s time for perspective. Investors should take a step back; it wasn’t that long ago that programs for the self-employed were limited and buying rental properties had a variety of restrictions. By 2006, in Canada, we saw amortizations shoot from 25 to 40 years. The minimum down payment on a rental property went from 25 per cent to zero. Self-employed borrowers needed only to state their income and as long as the cash flow on a rental property was positive, they could still get a mortgage with little or no money down at fully discounted rates. And although many still lament the loss of these programs, it is important to remember, that it was these

Like the elastic band, Canadian banks are retrenching from their fully stretched days of 2007, but they are not reverting all the way back to where they were in the 1990s. If a real estate investor looks at the marketplace over a 10- to 15-year perspective, then today’s banking environment for real estate investors is more relaxed than it was 15 years ago. At the end of the day, the secret is simply to understand which sandbox you’re playing in.

Resale markets continued to perk up last month. Sales rose from their May levels in 21 of the 28 major markets covered by this report, including 11 where the gains were five per cent or more. Particularly large jumps occurred in Victoria, Saskatoon and Trois-Rivières. Listings were down from the previous month in 16 markets, but trailed their June 2012 volumes in only 12 of 28 areas. Potential homesellers remain generally confident about their prospects for selling, as transaction numbers continue to be healthy. Rising sales lifted the sales-to-listings ratio in 14 markets between May and June. This should help boost future price growth. Balanced conditions were found in 26 markets during June, up from 22 in May. Easing listings and steady sales gains made Thunder Bay the only sellers’ market. Québec City was a buyers’ market. Existing home prices also appear more solid. The average sale price rose in 14 markets between May and June, while rising faster, or declining at a slower pace, in 16 areas. The large jump in Vancouver’s average price was the result of a large number of pricey detached homes changing hands. This hike is likely to be partly reversed in the coming months, given that this market remains tentative.

Canadian mayors ask that housing crisis be addressed
Canada’s Big City Mayors’ Caucus (BCMC) is calling on its provincial, territorial and federal partners to confront the growing housing crisis across the country. The BCMC, a group representing 22 of the largest cities in Canada, met recently in Vancouver ahead of the Federation of Canadian Municipalities’ (FCM) Annual Conference and Trade Show. “The rising cost of housing is an issue we see in cities across the country,” said Gregor Robertson, mayor of Vancouver and chair of BCMC. “Cities are ready and willing to help protect the economy and solve this housing crisis but we need federal and provincial partners who are committed to working with us.” $1.7 billion annually in federal housing investments are set to expire with the greatest drop in funding, up to $500 million a year, ending between 2014 and 2019. This will put more than half a million Canadians at risk of losing their homes unless federal, provincial and territorial governments take action. The BCMC is calling for a new housing partnership by all orders of government dedicated to: ›› Eliminating chronic homelessness through proven strategies ›› Stimulating new rental and affordable housing construction with tax incentives or other measures ›› Preserving and renovating existing social housing units ›› Housing workers to support a growing economy Canada’s housing crisis is too big and complex for any single order of government to solve on its own, given the thousands of builders, investors and community partners working within a web of federal, provincial and local policies. With the new 10-year infrastructure plan announced in Budget 2013, the federal government built the kind of practical partnership needed to meet this type of national challenge. This partnership must be expanded. “Record levels of household debt, new economic realities and changing demographics mean we can no longer rely solely on homeownership to meet Canada’s housing needs,” added Robertson. “Investing in housing is one of the most effective ways to both create jobs and boost economic activity in Canada today.”
Canada’s housing crisis is too big and complex for any single order of government to solve on its own, given the thousands of builders, investors and community partners working within a web of federal, provincial and local policies. While the face of this challenge may look different from one region to the next, all cities are struggling from this crisis. The average price of a new home in Canada nearly doubled between 2001 and 2010. 32 per cent of Canadians live in one of Canada’s 3.9 million rental units, yet purpose-built rental housing accounts for just 10 per cent of new residential construction over the past 15 years.
