Avoid home purchase surprises By Jim Rivait

B

uying a home is a challenging process, and no purchaser wants to discover a potentially costly deal breaker at the last moment. That’s why it’s essential for consumers to be aware of the possible pitfalls of signing an exclusive service agreement with a real estate agent to help you buy a home. Our association is hearing of cases where buyers never realized that an exclusive agreement means a real estate agent is entitled a commission on the sale of a new home or condo bought directly through a builder. Buyers are then in a tough spot. It’s important to understand that the builder has no legal obligation to pay the commission. So, how can buyers protect themselves against unexpected shocks? The first step is to understand that the Real Estate Council of Alberta (RECA) introduced new requirements for real estate professionals last July, so the rules may have changed since you last bought a home. The non-government regulator made it mandatory for its members to use written service agreements with clients. The goal was to clarify the roles and responsibilities of agents and their clients in an attempt to reduce conflicts and confusion. The RECA website provides more information about what parts of the agreement are negotiable, including the services to be provided, length of the agreement and remuneration. Buyers can also negotiate whether the buyer representation agreement is exclusive or non-exclusive. A non-exclusive agreement leaves the consumer free to act on their own without having to pay a commission on a sale. Consumers can also enter into non-exclusive agreements with multiple agents. An exclusive agreement locks the consumer into the terms of the contract – including commissions – even if the buyer deals directly with a builder. RECA states that consumers can request a non-exclusive agreement but that its members are not obliged to accept those terms. The buyer has the option of finding a different agent. Builders have taken steps in the past to work with buyers who want to be represented by an agent. The Builder/Realtor Cooperation Program is in place in both Edmonton and Calgary, and many major builders participate. A key principle of that program is that agents must register a client with the builder and then accompany the prospective buyer to view any showhomes. This ensures that all the participants understand right from the start that

an agent will be involved in the sale. Homebuyers can avoid unexpected costs and stress by ensuring that they fully understand the terms and conditions before they sign either an exclusive or non-exclusive a service agreement. That’s the simple way to avoid complications later. an Jose, one of California’s most sought-after real estate hotspots, played host to the Canadian Home Builders’ Association (CHBA) – Alberta housing tour last month. CHBA – Alberta members had the opportunity to tour 40 new homes in just two days, showcasing different builders, new models and exciting neighbourhoods to inspire CHBA – Alberta members and give them a taste of what’s happening in this bustling housing market. San Jose is the self-proclaimed ‘capital of Silicon Valley’ located in the Santa Clara Valley, boasting a pretty extensive roster of famous tech-savvy residents. Apple, Google and Facebook all have offices scattered throughout. The San Jose housing market is booming; employment growth has contributed to the high housing demand in the area. However, the development of new homes is relatively scarce due to such things as capped building permits, strict environmental reviews requirements, and local resistance. And of course, when high demand meets limited supply, housing costs begin to rise. CHBA – Alberta highlighted a few trends noted throughout the tour: developers are producing as many units on their sites as possible. The multifamily housing component of the tour outweighed single-family homes two to one, with starting prices ranging from $530,000 to $1.9 million. The tour also revealed common design features, like stair-intensive layouts. A typical townhome features a main-floor garage, half bath and small bedroom or office. The rest of the rooms, kitchen and living area sit on the upper floor, followed by another flight of stairs leading to the rest of the bedrooms.

Mortgage costs about to rise for some Canadians By Lydia McNutt

I

f you’re planning to buy a home this year with less than 10 per cent down, you can also plan for higher mortgage costs as of June 1, 2015. Canada Mortgage and Housing Corp. (CMHC) and Genworth Canada have announced that they are raising their mortgage insurance premiums by 15 per cent. CMHC increased its target capital requirements in mid-2014. The move isn’t expected to have a big impact on homebuyers’ pocketbooks or Canada’s housing markets, CMHC says. The higher premium would amount to an additional $5 per month for the typical borrower with a 95-per-cent loan-to-value ratio on a mortgage of $252,530. However, in Canada’s pricier markets, those monthly mortgage costs will inevitably be higher. In addition, the looming rise in mortgage costs could also

signal a busier-than-normal spring real estate market, as homebuyers try to beat the clock on the May 31 deadline. The increase in mortgage insurance premiums reflects concerns that Canadians are overextending their budgets by taking on more home than they can afford, leaving them in a tight spot when interest rates rise or at the slightest economic turn. Experts advise that homebuyers plan ahead, save their money and put down as much as possible, to avoid taking out a high-ratio mortgage. Homebuyers unable to save up this often hefty amount can still buy a home with a downpayment of less than 20 per cent, but federally regulated lenders require mortgage loan insurance, which covers them in case of payment default. The lender is responsible for the premiums and passes those costs on to the homebuyer in the form of a lump-sum payment, or more commonly, higher monthly payments. CMHC is Canada’s largest insurer of residential mortgages. Existing mortgages, high-ratio mortgages with more than a 10-per-cent downpayment, and mortgages on multi-unit properties will not be affected by the premium increase.

MORTGAGE ADVICE

The overnight lending rate stays put, for now... By Alyssa Richard

T

he Bank of Canada recently announced it would leave its overnight lending rate at 0.75 per cent – for six more weeks, anyway. The rate has sat at this position only since Jan. 21, when the central bank made an unexpected rate cut, after holding it at one per cent for nearly 4.5 years. The drop of 0.25 percentage points in January came as a surprise, as most economists had been predicting the opposite would occur some time in 2015. It was the Bank’s way of attempting to shield highly indebted Canadians from the negative impacts in the energy sector, caused by the sharp drop in oil prices in the latter half of 2014. But it was also a signal for banks to drop their Prime rates, to stimulate the economy as a whole. The banks expressed concern that dropping their rates would cause Canadians to take on more debt they couldn’t afford to repay, versus help those who were feeling the pinch, so initially they chose not to budge. Eventually, they all dropped their Prime rates by 0.15 per cent, from three per cent to 2.85 per cent, but none have made a full 0.25-percent cut, as suggested by the central bank’s move. According to our mortgage calculator, the additional 0.10 per cent that’s missing could lower our best five-year variable rate from two per cent to 1.9 per cent, which would result in a savings of $18/month or $1,080 over five years on a $400,000 home (the average price in Canada), with 10 per cent down and a 25-year mortgage. That may not sound like much, but it hurts to think about, when you know the banks have control and are choosing not to make a move. 50 NEW CONDO GUIDE | VOLUME 23 ISSUE 05 | NewHomeAndCondoGuide.ca

All of this is to say that some people predicted the Bank of Canada would further cut the overnight lending rate at its latest announcement, potentially by an additional 0.25 per cent. However, Governor Stephen Poloz noted that data from 2014 suggests we’ll see stronger growth in non-energy exports and investments in 2015, and the central bank wants to wait and see how the economy responds to the first rate cut of the year, before making any further moves. So, the overnight lending rate – and therefore Prime rates and your variable mortgage rates – are going to stay put. For now. But if the economy declines, we may see another cut. And if things continue to get better, we may see it go back up to one per cent – or more.

dmonton home prices are up in the first quarter of 2015, according to the latest Royal LePage House Price Survey. Detached bungalows showed the strongest gain, with the average price increasing 6.8 per cent year-overyear to $364,906. Meanwhile, twostorey homes gained 5.5 per cent to an average price of $391,378 and condos rose 3.1 per cent to $231,093. “The widely reported and much talked about drop in oil prices has affected the number of homes sold rather than average prices in Edmonton,” says Tom Shearer, broker and owner of Royal LePage Noralta Real Estate Inc. “Concern over the stability of the economy and employment has caused many who were planning on buying or selling a home to get on the fence and wait it out. As such, sales activity is down significantly compared to this time last year.” According to Shearer, inventory heading into the important spring market is up by approximately 2,000 units compared to this time last year. “Pent up demand from homebuyers and an influx of houses on the market are setting the stage for an active and healthy spring market,” he adds. Nationally, Canada’s real estate market is experiencing a soft landing, characterized by slower-than-normal home price increases. Much higher price increases were observed in

the country’s two largest urban markets, which combined to send the national average values upwards, partially obscuring the broader national trend. During the quarter, the average price of a home in Canada rose between 3.8 and 6.6 per cent year-over-year in the first quarter. When broken out by housing type, the survey showed a year-over-year average price increase of 5.3 per cent to $451,463 for standard two-storey homes, while detached bungalows rose 6.6 per cent to $405,895. During the same period, the average price of standard condominiums climbed 3.8 per cent to $261,782. The steady softening of prices in most markets across the country was first observed in the mid-year 2014 Royal LePage House Price Survey. In recent months, two unanticipated factors disrupted the natural housing price cycle: the steep decline in oil prices late in 2014, and the Bank of Canada’s subsequent reaction of lowering the overnight rate early in 2015. “Canadian homebuyers, with the last decade’s recession still top of mind, have been very sensitive to shifting, broad economic factors. The oil shock has been unsettling for the national economy, consumer confidence and by extension, the housing market,” says Phil Soper, president and chief executive, Royal LePage. “That said, lower prices at the pump and the confidence-boosting move by the central bank to lower interest rates have been supportive. With these factors combined, we have a soft-landing for housing after several years of robust expansion. We define a soft-landing as a market in which home prices are flat or increasing slightly, giving the economy and family incomes, a chance to catch up. “On balance, we believe we will not be seeing the kind of appreciation observed over the last three years any time soon, as markets work through the current cycle and align with broader economic conditions,” Soper continues. “In terms of downside risk, we do not foresee a sharp decline in home prices, particularly in today’s low interest rate environment.”

Solving the “stuff” problem By Hellen Buttigieg

T

he closets are full. The junk drawer is overflowing. The piles have piles, and the storage space is full too. You need it all, you just don’t have enough space to put it. Or do you need it all? Take a closer look and separate ‘need’ from ‘obligation’, ‘sentimentality’ and ‘just in case’. You may find you have the space to store what you need. You’ll just have to dig deep to find the strength to free yourself of the rest. After all, do you own all that stuff – or does it own you?

Let go of ‘obligation clutter’ This refers to the stuff we hold on to because we feel a sense of duty. It can be gifts, heirlooms we’ve inherited, or things we’re saving for our kids. If you are holding on to any of these, you have permission to let them go, and here’s why: » You have no duty to keep gifts forever. The last thing the gift-giver would want is for their gift to become a burden. » It can be emotionally taxing to part with inherited items, but there are more meaningful ways to honour a person’s memory than keeping all their stuff. Releasing a loved one’s belongings doesn’t betray the memory of the person. It’s a bit easier with time, so take the time you need. » If you’re keeping things for your children, consider asking them if they are even remotely interested in having them. Remember, they will have their own tastes.

3 | “I paid a lot of money for it.” You feel guilty every time you look into your closet and see it hanging there, so let go of the shame. 4 | “I wore it on my first date.” Don’t let sentimental items take up closet space. That’s like allowing the past to crowd out the present. Take a picture and let it go. 5 | “Someone bought it for me.” They’ll never know that you got rid of it, and even if they find out, they’ll understand. 6 | “It needs repairs.” Set a deadline and let it go if you miss it. 7 | “I need it just in case.” This is probably the top excuse I hear, and it is based on fear. Be brave – unless you can find a specific reason to hold on to something, find the courage to let it go.

Off-load off-site storage If you are paying a hefty monthly bill to store your belongings off-site in a rented storage container, it’s time to reconsider its value. Out of sight is usually out of mind. If you are not using the items, it may be beneficial to sell them or give them away. The money spent storing the stuff over a long period of time often exceeds the value of those items. Liberate your linen closet Let go of the sheets and towels that are torn, stained, or stored just in case. You really only need one extra set of sheets for each bed. Fold pillowcases and fitted sheets into their matching flat sheets so that the set stays neatly together. Don’t let excuses keep you stuck When editing your closet, you’ll make all kinds of excuses to keep things. Here’s are the most popular excuses I’ve heard, and my response to them: 1 | “It will come back in style.” Yes, it will. But the fabric and cut will be different and everyone will know you’ve been holding on to it since 1978! 2 | “It will fit once I lose weight.” You may lose weight in different places and it may still not fit. It may go out of style by the time you lose the weight. Reward yourself for your weight loss by buying new clothes.

05 Multiply this figure by the amount you need to borrow. Divide by 1,000.

02 Divide by three. This figure is the monthly payment you can afford to make on your condo.

06 Add to this your estimated monthly heating costs and monthly property taxes.

03 Take the total price of the condo and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

07 If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream condo.

04 Refer to the chart above. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most first-time buyers take the 25-year amortization.)
