RBI Tightens Norms for Personal Loans, Credit Cards Amid Demand Surge

O
n 16th November, the Reserve Bank of India (RBI) implemented stricter regulations on personal loans and credit cards, increasing the risk of a slowdown in loan growth. These new rules, involving higher capital requirements, are expected to raise the cost of such loans, potentially restricting the growth in these sectors that has surpassed the overall bank credit growth of approximately 15% in the past year. The RBI has raised the risk weights for both banks and non-bank financial companies (NBFCs) by 25 percentage points to 125% on retail loans. This adjustment applies to personal loans for banks and retail loans for NBFCs, excluding housing, education, vehicle loans, and loans secured by gold and gold jewellery. This higher capital requirement may lead to more expensive loans if lenders decide to pass on the additional cost, potentially reducing loan growth.

Ola Electric Transitions to Public Limited Company in Anticipation of IPO
O
la Electric, the electric vehicle manufacturing division of Ola, has undergone a transition from a private company to a publicly listed entity as part of its preparations for an upcoming initial public offering (IPO). The company, established in 2017, has also modified its name to Ola Electric Mobility Limited, as indicated in regulatory filings. With plans for a public listing by the close of 2023, the electric two-wheeler manufacturer boasts a claimed 35% market share of electric two-wheelers in India and operates the largest two-wheeler factory in Krishnagiri, Tamil Nadu. Ola Electric has initiated the construction of a 5 GWh lithium-cell manufacturing plant earlier this year. In October, the company secured Rs 3,200 crore in a funding round featuring a mix of equity and debt, led by Temasek and the State Bank of India. The funds are intended to support the expansion of its 'Gigafactory.' Ola Electric's Founder and CEO, Bhavish Aggarwal, has expressed the company's consideration of establishing a four-wheeler factory to consolidate its manufacturing facility as a comprehensive hub for all Ola Electric components.

ndia is reportedly nearing the finalization of a deal with Tesla Inc., allowing the American automaker to import its electric vehicles into the country from next year and potentially establish a manufacturing plant within two years. Sources familiar with the Indian government's plans revealed this information to Bloomberg. The official announcement is anticipated to occur at the Vibrant Gujarat Global Summit in January, with Gujarat, Maharashtra, and Tamil Nadu being considered as potential locations due to their established infrastructure. According to the report, Tesla is planning an initial investment of around $2 billion for a new plant in India. The company also aims to procure auto parts from India, with an estimated value of up to $15 billion. Tesla is contemplating the production of some batteries in India to reduce costs, though these plans are subject to change. While Tesla CEO Elon Musk stated in June his intention for a "significant investment" in India and expressed plans to visit in 2024, there has been no official confirmation.
India Needs to Add 80 GW Coal-Based Capacity by 2030 to Meet Demand: Minister
I
ndia is facing a pressing need to boost its thermal coal-based power generation capacity by a substantial 80 GW, according to statements made by Union Power Minister RK Singh during a recent review meeting. Presently, only 27 GW of such capacity is under construction. The urgency is underscored by the minister's projection that the country's peak power demand is poised to escalate from the current 241 GW to a staggering 335 GW by the year 2030. The review meeting, which saw the virtual and physical participation of independent power producers and stateowned generators such as NTPC, SJVN, NHPC, DVC, THDCIL, and NLCIL, also included the involvement of energy secretaries from 13 major states. This collaborative effort aimed to address the growing energy demands faced by the nation.
SEBI to Introduce T+0 Settlement Trade by March 2024 and Instantaneous Settlement by 2025

he Securities and Exchange Board of India (SEBI) is actively developing a plan to implement same-day settlement of trades by March 2024, with an optional system for instantaneous settlement, as stated by SEBI chief Madhabi Puri. During a press conference in Mumbai following a SEBI Board meeting, Puri highlighted the shared view among market infrastructure and brokers on the need for a technological pathway to achieve immediate settlement. She emphasized the preference for a direct transition from T+0 to instantaneous settlement, avoiding a one-hour delay as an interim step. Puri noted significant progress in discussions, with a nearly finalized roadmap for the optional parallel system. Addressing the timeline, she mentioned, "What market participants have told us is that we will need to start at T+0 and then move to instantaneous. For T+0, it will be by the end of March, then instantaneous will be another year later."

Davis Cup Final 2023: Italy Beat Australia to Win First Title for 47 Years

taly clinched their first Davis Cup title in 47 years as Jannik Sinner dominated Alex de Minaur, securing a 2-0 victory over Australia in Malaga, Spain. Matteo Arnaldi set the tone with a tense 7-5, 2-6, 6-4 win over Alexei Popyrin in the opening singles, giving Italy a 1-0 lead. Sinner, in exceptional form, then cruised to a 6-3, 6-0 triumph against De Minaur, sealing the historic victory. The win marked Italy's second Davis Cup triumph, the previous one dating back to 1976. Sinner's outstanding week, including a crucial win against Novak Djokovic in the semi-final, underscored his late-season brilliance. Italy's path to victory also featured Matteo Berrettini's positive contribution. Sinner, ranked fourth globally, showcased his dominance by breaking De Minaur early and maintaining control throughout.

The tragic incident occurred when Paty, who had shown cartoons of the Prophet Muhammad during a class on freedom of expression, was killed by a Chechen refugee. The teenagers are accused of slander and of guiding the murderer to Paty at the school. The youngest among them, a 13-year-old girl, had been suspended from school just days before the murder, for reasons unrelated to the case. However, she falsely claimed to her father that she confronted Paty over an alleged request for Muslim students to leave the class, leading to social media posts that prosecutors believe influenced the killer's actions.

Italy Bans Lab-Grown Meat in Nod to Farmers
I
talian Members of Parliament have given their approval to a law that bans the production, sale, or import of lab-grown meat or animal feed, a move championed by the right-wing government under the banner of defending Italian culinary traditions. Agriculture Minister Francesco Lollobrigida asserted that Italy has become the first nation to shield itself from the perceived social and economic risks associated with synthetic food. The parliamentary vote prompted both support and opposition, leading to a physical altercation between farmers and some MPs. Despite the scuffle, the bill passed with a majority of 159 votes in favor and 53 against. Violating the law could result in fines of up to €60,000. Presently, the impact of the law is limited, as lab-grown meat has only been approved for human consumption in Singapore and the United States. The European Union has yet to give the green light to lab-grown meat, categorized as "novel foods." If EU approval is granted, Italy's new law may face challenges from the European Commission.
Spain’s Pedro Sánchez Wins New Term as PM After Amnesty Deal
S
ocialist leader Pedro Sánchez has successfully navigated weeks of negotiations to secure a parliamentary vote, allowing him to serve another term as Spain's prime minister. Despite the Popular Party winning elections in July, their leader, Alberto Núñez Feijóo, failed to form a majority. Sánchez, however, clinched a four-seat majority in the 350-seat chamber, solidifying his position. One key aspect of Sánchez's success was the sealing of an amnesty deal for Catalans involved in a failed bid to secede from Spain. This move was pivotal in gaining support from two Catalan pro-independence parties, even though it has stirred controversy. Critics argue that Sánchez's proposed amnesty for politicians and activists may reignite secessionist sentiments, posing a threat to Spain's territorial unity.

The outlook for gold looks promising to me since Indian economy is poised to grow at a faster clip driven by both urban and rural demand
Shri V.P.Nandakumar MD & CEO Manappuram Finance Ltd
What Next for Gold? Despite elevated prices, faster-than-expected economic expansion is driving domestic demand for gold
F
or me, gold is always a subject that I keep close to my heart. And I always find it amusing to see how the gold market navigates through the various phases of an economic cycle. A nuanced reading will show that many a time gold market behaviour puts conventional economic wisdom to test by taking a different course. For the sake of context, economic theory has it that the demand for
20

any goods or for that matter services is a function of supply and demand. The market arrives at an equilibrium when the demand and supply curves intersect at a particular price point which is considered as optimum for both producers and suppliers. However, a closer scrutiny of gold market behaviour may prove this hypothesis null and void. For one, in the case of gold, the first condition – that supply clears
demand at an equilibrium price point – could be relaxed since the availability of the yellow metal is a given at any point of time. It goes without saying that it is the singular factor of inelastic supply that gives gold the status of precious metal. Therefore, it is a no brainer to infer that the demand for gold – indeed while other things remain equal – may be influenced by many other factors.
The recent tidings in the Indian gold market support this hypothesis that the demand for yellow metal is a function of a host of factors and prices have a diminishing role to play in explaining its demand. To sticklers to economic dogma, this line of argument may sound bizarre or outlandish and they might have their reasons to think so. But, as is often proved, real life economic realities are far from textbook economics, and the gold market behaviour in recent times provides further evidence to this fact. Let me elucidate my line of argument with evidence from the Indian gold and jewellery market. We hit the festival and wedding season this year with the hope of higher retail gold sales but high prices were seen weighing on demand with many in the industry throwing up their hands in desperation. Many in the retail trade even foresaw lower sales as prices tend to trend high as the geopolitical situation took a turn for the worst. However,

the negativity soon gave way to optimism, if not euphoria, as the festival sales reportedly beat previous records. Though, we still don’t have the required numbers to prove this point, umpteen conversations I had with my friends in the industry unequivocally pointed to the fact that this festive season was exceptionally good for gold retail trade. There are supplementary evidences to support this optimism. Government data shows that India's October gold imports surged to a 31-month high to 123 tonnes against 77 tonnes a year ago as trad-

ers increased buying on the back of good demand. To me, two factors indeed played out for gold; a good monsoon and increase in household discretionary spending. It may be in order here to note that in India, economic growth and demand for gold are highly correlated despite the evolution of market for financial assets. In other words, higher the level of economic activity, higher is the demand for gold. A plausible reason for such a strong correlation may be the insurance the yellow metal provides in times of need for the Indian households.
Going by this line of reasoning, the outlook for gold looks promising to me since Indian economy is poised to grow at a faster clip driven by both urban and rural demand unless, to borrow a fashionable term from Prof Nassim Nicholas Taleb, who famously predicted the 2007 global financial crisis, any black swan events surface. To conclude, despite growing risks to global growth and elevated prices, faster than expected domestic economic expansion is driving domestic demand for gold and that may remain so going forward

Defining That Binding Thread of Every Organisation – Culture
W
hat defines you as an organization? Is there a way of doing things in this organization? Is there that invisible binding thread that characterizes the purpose of the firm and what they stand for? That mystical rubric is called Culture. It is very often we hear the speeches – “Our key success
factor is our culture!”; “There is something wrong with our culture”; “We want people who will fit into our culture!” ; " We are like that – only!" Most management pundits glorify culture as the difference between the pioneers and the laggards or from the winners and the ‘alsorans'. Culture is like the pulse of an organization. It cannot by itself give you a lot of informa-
tion – slow, fast, normal, weak et.al. But it is an opportunity to peek into the portals of the organization. It helps you to ask questions to delve deeper into the institutional psyche at the moment – what ails or what could be the probable causes? With the mind-set of organizations moving from being 'assetbased' to 'people-based outlook’, this discussion populates your

BUSINESS guesses and surmises about the organizations. Like a lot of management disciplines, ‘culture’ is best understood by questions and reflective observation and not necessarily answers. There is also a general tendency to demean culture as something esoteric and intangible and is also a popular and convenient excuse. While we often use clichés and banal statements to describe it, it always presents an interesting cue point to understand the organization. The better you understand it, the better you can leverage it to build a highperformance organization. Edgar Schein the 'supreme guru' of culture defines it as: "A pattern of shared basic assumptions that the group learned as it solved its problems of external adaptation and internal integration that has worked well enough to be considered valid and, therefore, to be taught to new members as the correct way to perceive, think, and feel in relation to those problems." "…a basic set of assumptions that defines for us what we pay attention to, what things mean, and how to react emotionally to what is going on, and what actions to take in various kinds of situations." "…is neither innate nor purely driven by strategy, rather culture

is learned and therefore can be changed." The interesting thing about culture is that – it can never be clearly defined by the people bound by it – difficult to 'see the forest through the trees'. It is also best to employ an iterative method to ask questions and understand the connections between the various symptoms and draw a palette of link diagrams that effectively helps one to boil down to a couple of causal factors. Management science itself has developed a few official sounding tools like Culture web analysis, Social network analysis, etc. to categorize and affinitize various issues and present to you a diagnostic chart that broadly describes the enterprise culture organizational alignment to various people and strategic issues. But an easier way would be to answer a series of questions internally like:-
What kind of actions is applauded in the organization? Who are the 'rock stars' in the organization? What do we see in our role models? What are the attributes that we admire in them? One should also be cautioned to not fall for stereotyping like – engineers like technology, HR hates numbers, the marketing department is more aggressive, customer representatives don’t want challenges, the IT department is inflexible et.al.
How do we respond to situations?
How are we perceived from the outside?
When there is a critical incident in an organization, it is often the best time to observe the character of the organization. Read these actions from the organizational context. Do we always adhere to a set of documented procedures? Or are we encouraging our managers to take the best course of action that
It always helps to have an external stakeholder talk on how the organization is perceived from outside. It is often the characteristics of the leaders that are clearly visible to outsider. There is also the argument that – the leader is the showcase of culture of the organization. But the apparent impression gets formed
deems fit to them? Are we driven by selling more or are we conscious to create a work ethic around creating great products? Are we focused on the bottom line or is it the top line that excites us? Some of these questions seem to have the right answer. But the more you ponder and look for action evidence; you will stumble onto trends.
What are the perceived winning behaviours in our organization?
not just through experiences but also by articles, word of mouth and the media hyperbole. This is another reason companies spend enormous amounts on public relations and seemingly say the right things in public. A point of caution is the front line staff. They are often the touch point the organization has with the outside world. They can make and break impressions. Their recruitment and training is paramount and has to be aligned with the organizational ethos. Based on what I have seen in the last two decades these are some great ways to build a high-performance culture in your organization. 1. Have a shared vision - More than a statement on the newsletter, a framed picture on the wall, or an organization screen saver, a simple clear statement conveying what the company exists for is important and more importantly, something that
has meaning to every employee. Great examples are the Tatas - “To improve the quality of life of the communities we serve”, Or P&G- “To improve the life of world's consumers”. 2. Reinforce the right behaviours – Have a clear rewards policy where employees who do the ‘right thing’ are lauded and rewarded and made an example of. Likewise, one also has to take a tough stance when there are breaches of trust and integrity. 3. Create informal communication avenues – A good newsletter is often not enough, one has to encourage employees to discuss the organization by leveraging social media, group chats and informal fetes. Water cooler discussions and gossip should not be dismissed. They are a valuable source of information. 4. Look at culture from the organizational context – It is im-
portant to be aware of what your employees think of your structure, processes, salaries, incentives, etc. It is this context that outlines your culture and is what needs to change before the mind-sets. 5. Cultural change is a gradual process – Do not try too many things together. Cultural change needs concerted thinking and detailed interventions. There is no prescription for culture. While leading by example is the most common solution – it is not always easy. The additional challenge is the transient workforce. Attritions are at appalling levels and it becomes more and more important to have formal mechanisms to teach and reinforce key attributes. Whether you like it or not, you cannot ignore it … As the popular cliché goes – when strategy and culture interface – culture has strategy for breakfast! It is often true

physical and mental health and getting you ready for another day. Even minimal sleep loss takes a toll on your mood, energy, and ability to handle stress. A side effect of sleep deprivation is microsleep where we sleep for only a few seconds or a few minutes, but we don't realize it. Microsleep can get out of our control and can be extremely dangerous or fatal if we are driving or while doing some high-risk jobs. Microsleep refers to episodes of sleep lasting less than 30 seconds. Often, we aren't aware of them. We may have multiple episodes of mi-
crosleep close together, as you try and fail to stay awake. A period of sleep needs to last at least a minute before the brain can register it. Public safety is threatened when certain workers experience microsleep. Microsleep is commonly seen among long distance drivers, Pilot, Air traffic controller, Truck driver, Process workers in a plant or refinery or in the medical field. Sleep deprivation is the main cause of microsleep. Poor quality of sleep may also result in microsleeping. Poor sleep can stem from physical and mental conditions,
including Sleep apnea, narcolepsy, and other sleep disorders, obesity, depression, anxiety or bipolar disorder. The use of alcohol and certain medications can lead to episodes of microsleep. Antihistamines are one commonly used medicine that can cause sleepiness.
Preventive Tips for Microsleep •Change what you are doing. It only takes about half an hour for monotony to affect your alertness. •Take a power nap of 20-30 minutes. •Conversation wakes up the brain cells. •Have some caffeine.

respond to how long we have been awake and the changes between light and dark. At night, our body responds to the loss of daylight by producing melatonin, a hormone that makes you sleepy. During the day, sunlight triggers the brain to inhibit melatonin production so we feel awake and alert. Our internal clock can be dis-
rupted by factors such as nightshift work, traveling across time zones, or irregular sleeping patterns-leaving us feeling groggy, disoriented, and sleepy at inconvenient times. The production of melatonin can also be thrown off when we are deprived of sunlight during the day or exposed to too much artificial light at nightespecially the light from electronic
devices, including TVs, computers, tablets, and mobile phones. The average sleep required for an adult between 18-64 years is 7-9 hours (as per the National Sleep Foundation). But the average adult sleeps less than seven hours per night. In today's fast-paced and competitive society, six or six and a half hours of sleep may sound pretty good. In reality, it's chronic sleep deprivation. During sleep, the brain rests busy neurons and forms new pathways so that it can start new functions in the morning. Sleep deprivation leaves the brain exhausted, producing sleepiness. It interferes with our ability to concentrate and learn new things. It negatively impacts both short-term and long-term memory. It gets in the way of our decision-making process and stifles creativity. Our emotions are also affected, making us more likely to have a short temper and mood swings. If sleep deprivation continues long enough, it increases the risk of hallucinations, mania, impulsive behaviour, depression, paranoia, and suicidal thoughts. Brain events called “sharp wave ripples” are responsible for consolidating memory. The ripples also transfer learned information from the hippocampus to the neocortex of the brain, where long-term memories are stored. Sharp wave ripples occur mostly during the deepest levels of sleep.
Tips to Improve Sleep •Stick to a sleep schedule. •Create a room that's ideal for sleeping. Often, this means cool, dark and quiet. The mattress and pillow can contribute to better sleep. •Create a bedtime ritual like taking a warm bath or shower, reading a book, or listening to soothing music - preferably with the lights dimmed. Relaxing activities like alpha meditation are useful. •Don't go to bed either hungry or stuffed. Nicotine, caffeine and alcohol should be taken with caution. Take only adequate water before sleep. •Limit daytime naps. If you choose to nap during the day, limit yourself to about 10 to 30 minutes and make it during the midafternoon. •Regular physical activity/ aerobic exercises can promote better sleep. •Consider healthy ways to manage stress

Charting Legal Frontiers: A Brief Review of the Proposed Law in Criminal Jurisprudence Introduction The Bharatiya Nyaya Sanhita’ Bill (“BNS” or “the BNS Bill” or “the Bill”) introduced during the conclusive session of the monsoon session in Parliament, represents a significant legislative initiative with the primary objective of supplanting the Indian Penal Code of 1860 (“the Code” or “IPC”), a relic of the British colonial administration in India. The proposed BNS seeks to usher in a comprehensive legal framework characterized by several pivotal reforms. At its core, BNS
endeavours to institute a paradigm shift towards gender neutrality in addressing offenses. In recognizing the evolving societal dynamics, the bill incorporates provisions specifically tailored for the enhanced protection of women and children. Notably, the proposed legislation takes a formidable stance on crimes related to sedition, subversive activities, separatist endeavours, or any actions perceived as jeopardizing the sovereignty and unity of India. A salient feature of the BNS is its proactive approach to combating organized crime and
armed rebellion. By introducing novel provisions designed to thwart such activities, the bill reflects a commitment to fortifying national security. The legislation adopts a forwardlooking perspective on criminal justice, particularly for first-time offenders in minor transgressions, emphasizing a rehabilitative rather than punitive approach. A critical aspect of this legislative overhaul is the recalibration of fines and penalties associated with various offenses. The BNS, in its pursuit of a more stringent legal framework, seeks to

establish a deterrent effect through heightened repercussions for transgressions. This augmentation of punitive measures underscores the bill's commitment to fostering a safer and more just society. This article aims to illuminate some of the distinctions between the entrenched Indian Penal Code (IPC) and the prospective Bharatiya Nyaya Sanhita’, providing a nuanced understanding of the transformative legal landscape envisioned by the proposed legislation.
Analysis BNS has proposed a set of modifications to the penalty framework for criminal offenses. As a result of these changes, an additional fine of INR 5000 has been introduced along with a maximum imprisonment for a period of 6 months as the prescribed
punishment for the offense of Intentional omission to give information of offence by person bound to inform. The punishment for Dishonest Misappropriation of Property has undergone a structural change. The maximum punishment for the said offence still remains the same as two years but a minimum punishment has been introduced through The BNS Bill as 6 months. This meets the objective of the BNS to enhance the punishments for the penal provisions. BNS as a legislation aims to make the statute as comprehensive as possible. Consequently, several provisions in the Penal Code has been omitted with the introduction of this bill in the Parliament. Indian Penal Code (IPC) had provided a separate section for prescribing punishment for the offence of Criminal
Breach of Trust under Section 407 of IPC, but the drafters of BNS took an inclusive approach to it and provided definition, explanation and punishment under the same roof, which is Clause 314 of the Bill. It is also worth noting that the Punishment for the offence of criminal breach of trust has been increased to 5 years from 3 years. The Code under Section 410 defined the word “Stolen Property”. For a property to be considered as stolen, it has to be obtained through certain acts prescribed under the Code. This initially consisted of Theft, Robbery, Extortion and Criminal Breach of Trust through Criminal Misappropriation of Property. Cheating has been added to this list by virtue of the BNS Bill, thereby increasing the scope of the Offence of

amendments has been brought to the punishment of Cheating, which was earlier provided under various heads. Maximum Punishment for cheating has been increased from one year to three years and Maximum punishment for Cheating with
knowledge that wrongful loss may ensue to person whose interest offender is bound to protect has been elevated to five years. Additionally, Maximum punishment for Cheating by Personation has been increased from three years to five years. Such
characterisation of the various forms of cheating and its related punishment is a positive step. The punishment for the offence of Dishonest or fraudulent removal or concealment of property to prevent distribution among creditors has undergone a similar change like dishonest misappropriation of property. The Maximum Punishment for the offence remains as two years but a minimum punishment of 6 months has been added by the BNS. Similarly considering the gravity of the offence of Dishonest or fraudulent execution of deed of transfer containing false statement of consideration, its punishment has been increased from two years to three years. Further, whoever dishonestly or fraudulently causes any person to
sign, seal, execute or alter a document or an electronic record or to affix his electronic signature on any electronic record knowing that such person by reason of mental illness of mind or intoxication cannot know the contents of the document or electronic record or the nature of the alteration comes under the purview of making a false document under Clause 333 of BNS. The word “unsoundness of mind” under Section 464 of IPC has been replaced by the word “mental illness” in the Bill. Thereby making the scope of the provision narrow and specific. Even though these words are used interchangeably, they are distinct in itself. Any mere irregularity in the mental capacity of a person will constitute unsoundness of mind whereas to constitute
mental illness, a person has to be diagnosed with certain specific illness. The judiciary has been insisting on changes for this provision for a long time now and this alteration is notable while considering the judicial opinion in the case of Sheila Sebastian vs. R. Jawaharaj and Ors. (11.05.2018 - SC) MANU/ SC/0542/2018, where the court explicitly stated that “unless and until ingredients under Section 463 of the Code are satisfied a person cannot be convicted under Section 465 by solely relying on the ingredients of Section 464, as the offence of forgery would remain incomplete”. The Court was also of the opinion that the ingredients under Section 464 of IPC is not sufficient in itself to constitute the offence of Forgery.

FINANCE The offence of forgery of record of court or of public register was initially limited to certain documents such as certificate of birth, burial, marriage, documents held by court and public servants etc. Through the BNS Bill, documents for identification issued by the Government such as Aadhaar Card and Voter Identity card has also been made part of this provision. A new sub clause namely Clause 339(3) has been added to the BNS for punishing possession of any seal, plate or any other instrument knowing to be counterfeit. Similarly, sub-clause 4 of the same clause provides the punishment for using any genuine seal or plate or any other instrument with sufficient reason to believe it as to be counterfeit. This act will be treated as if he had made or counterfeited such an instrument. The major aspect to consider in these offences are the intention of the parties. This provision was not present in the colonial penal code. Changes brought to the offences discussed above haven’t affected the basic nature of the crime. Whereas changes brought to the offence of sedition and the reintroduction of the offence of adultery after being repealed by the Hon’ble Supreme Court in the case of Joseph Shine v. Union of India (2019) 3 SCC 39 has affected the whole structure of the offence which was initially embodied in the Code. One would note that the purport of law governing adultery was recently clarified by the Constitution Bench of Hon’ble Supreme Court in 2023 SCC Online SC 149 as being in the nature of a “civil wrong”.
Conclusion In conclusion, the introduction of the Bharatiya Nyaya Samhita (BNS) marks a pivotal juncture in the trajectory of India's legal framework, particularly in the realm of punishments and penalties. The comprehensive overhaul of the punitive measures within the BNS

The BNS, in its departure from the established norms of the Indian Penal Code (IPC), introduces a recalibration of fines and penalties for various crimes. This deliberate re-evaluation underscores the legislative intent to create a more stringent deterrent against transgressions. By amplifying the severity of punishments, the BNS signals a clear departure from leniency, emphasizing a resolute stance against unlawful activities. Furthermore, the Bill's approach extends beyond conventional punitive measures. While it introduces harsher penalties for certain offenses, it also demonstrates a willingness to adopt a more rehabilitative outlook, especially in the case of first-time offenders involved in minor infractions. This dual-pronged strategy highlights the BNS's commitment to fostering a legal system that balances retribution with an opportunity for reformation. The Cancer Code Lifestyle Strategies for Prevention
O
n the 7th of November, India observed National Cancer Awareness Day, shedding light on the widespread impact of cancer. As we reflect beyond this dedicated day, it's crucial to grasp the gravity of this new health menance that has a huge correlation to our lifestyle. Globally, the rise in cancer cases reaffirms the urgency of adopting a balanced lifestyle, not only as a component of treatment but also as a formidable tool in the prevention of this lethal disease.
According to a study by the World Health Organization (WHO), one in ten Indians is diagnosed with cancer, with one in fifteen succumbing to the disease. The studies by the Indian Council Of Medical Research (ICMR) paints an even more alarming outlook, that by 2025, India may experience a seven-fold surge in cancer cases. This increase in cancer incidence is attributed to factors such as escalating air pollution, a rise in chain smokers, and sedentary lifestyles. In this article, we will explore
the broader landscape of cancer awareness, with insights into lifestyle changes that can strengthen the fight against this formidable adversary.
Prevention is Better than Cure! Breast, Lung, Prostate, Liver, Thyroid, Cervical, Esophageal and Colorectal Cancers are some of the most common types of cancers globally. Preventing cancer is not as simple as singling out one specific food item as a problem maker. Also, there is no single food that can prevent its

onset. That said, adopting a healthy diet and lifestyle significantly contributes to lowering the risk of several prevalent cancers. Genetics and certain health conditions can influence cancer prevalence. Many a times, these factors are often beyond our immediate control. However, one aspect we can actively manage is our food choices. Opting for a nutritious diet and embracing a health-conscious lifestyle plays a pivotal role in reducing the risk of common cancers. Healthy eating not only serves as a preventive measure against cancer but also helps mitigate the likelihood of developing chronic conditions that are linked to increased cancer risk. The following lifestyle changes are key contributors to safeguarding against this deadly disease -
Lifestyle Steps to Reduce the Risk of Cancer 1. Maintain a healthy weightOverweight individuals often experience chronic low-grade inflammation which can create a pro-cancer environment. Inflammatory processes contribute to DNA damage and promote the growth of cancer cells. Overweight and obesity are particularly associated with an increased risk of developing cancers such as breast, colorectal, ovarian, pancreatic, kidney, liver, and esophageal cancers, among others. 2. Be physically active-Exercise has anti-inflammatory effects in our body and reduces the risk of inflammation-related cancers. Some research, such as a study in "Psychoneuroendocrinology" (2016), suggests that exercises may be linked to longer telomeres (the protective structures at the end of chromosomes, that are associated with DNA stability). They promote enhanced DNA repair, reducing the likelihood of genetic mutations and better cellular health. 30 mins of low to moderate intensity exercises for 5 days a week is a great start.

Eat a diet rich in whole grains, vegetables, fruits and lean protein. 4. Limit consumption of red meat and processed foodsThere is strong evidence that consuming processed meat (sausages, ham, bacon, salami) increases the risk of colorectal cancer. Nitrite and Nitrate compounds added as additives to processed meat can form nitrosamines that are potential carcinogens. Sodium Benzoate, is yet another preservative added to acidic food which can form into benzene, a known carcinogen. 5. Limit consumption of sug-

ar and sweetened beverages. 6. Limit Alcohol Consumption When the liver metabolizes alcohol, it is converted into acetaldehyde, a known carcinogen. Acetaldehyde can cause damage to DNA and proteins, leading to the formation of abnormal cells that may contribute to the development of cancer. After cigarette smoking and excess body weight, alcohol consumption stands as the third major modifiable factor contributing to an elevated risk of cancer. According to research by American Institute of Cancer research, even consuming less than one alcoholic drink per day, irrespec-
tive of the type, heightens the risk of various prevalent cancers such as breast, head and neck, and esophageal cancers. Notably, a decrease in alcohol intake has been associated with a reduction in cancer risk. Various studies have shown strong correlation that consuming alcohol increases the risk of Breast Cancer, Colorectal Cancer, Esophageal Cancer, Liver Cancer, Mouth, Pharynx, and Larynx Cancer and Stomach Cancer. 7. Avoid smoking and chewing tobacco - Tobacco smoke contains over 7,000 chemicals, and at least 250 of them are known to be harm-
ful, with more than 60 recognized carcinogens that can damage the DNA. Smoking is the leading cause of Lung cancer, apart from causing many types of cancer, including throat, mouth, pancreas, bladder, kidney, cervix, and stomach cancers. Chewing tobacco and using smokeless tobacco products expose the oral cavity and esophagus to carcinogens, increasing the risk of cancers in these areas. Tobacco also weakens the immune system, making it less effective in recognizing and eliminating cancer cells. 8. Limit excess sunlight exposure - Prolonged and excessive exposure to ultraviolet (UV) radiation from the sun can damage the DNA in skin cells, leading to mutations that may contribute to the development of skin cancers. While UV exposure is a known risk factor for skin cancer, moderate sun exposure is es-
sential for the body's production of vitamin D, which plays a vital role in bone health and overall well-being. Balancing the benefits of sunlight with protective measures is the key. 9. Reduce inflammatory activities - Adequate Sleep, limit exposure to carcinogenic chemicals, pesticides, smoke and radiation. 10. Cut down on unhealthy fatsFocus on cutting down saturated and trans fats found in processed foods, fried items, and fatty meats. Instead, prioritize healthy fats such a monounsaturated fat found in avocados, nuts, seeds, and olive oil. A diet rich in omega-3 fatty acids from sources like fatty fish can also contribute to a lower cancer risk.
Can Cancer Be Prevented With Diet? There is no scientific evidence supporting any specific diet pattern that can cure cancer. However,
a balanced diet will help the body repair itself and recover from treatment, improve the immune function and protect the healthy cells from damage. Antioxidants play a crucial role in reducing the risk of cancer by neutralizing free radicals in the body that can damage cells and DNA. A diet rich in fruits, vegetables, and other plant-based foods, are rich in antioxidants such as Vit-A, Vit-C and Vit-E. They help prevent oxidative stress, inflammation, and DNA damage, thus creating an environment less conducive to the development and progression of cancer. Many of the phytonutrients (chemicals found in plant based food) are also being studied for their cancer fighting properties. Allicin (onions and garlic), Anthocyanins (blueberries), Carotenoids, Flavanoids, Isoflavones (Soy), Indoles (broccoli, cabbage), Lignins (whole grain and flaxseeds), Lutein (leafy vegetables), Lycopene (tomato), Phenolics (citrus fruits) are some of the phytonutrients that have purported antioxidant properties and reduces the risk of inflammation, oxidative stress to the cells of the body. However, there are no recommended dietary guidelines for these nutrients to fight or prevent cancer. It's crucial for individuals living with cancer to consult their doctors and dieticians for personalized dietary recommendations created for their specific condition and treatment plan to prevent malnutrition and aid recovery. The role of the ketogenic diet in cancer has received a lot of emphasis in recent years and still remains an area of ongoing research. The ketogenic diet is characterized by a high-fat, low-carbohydrate, and moderate-protein intake, leading the body into a state of ketosis. Some hypothesize that cancer cells rely heavily on glucose for energy, and by limiting carbohydrate intake through a ketogenic diet, one may create an

unfavorable environment for cancer growth. While some findings suggest potential benefits of such a dietary approach, more robust clinical and conclusive research evidence is needed to establish clear guidelines. It is extremely crucial for individuals already undergoing cancer treatment to discuss with their doctor while considering dietary changes. Ketogenic diet can be extremely stressful to certain organs and hence the suitability of such an approach, based on the organs involved in the cancer treatment, should be discussed with a medical practitioner. Besides, the inclusion of protein through animal food sources may be counter productive and inflammatory in may cases (based on the

quality and type of meat). Numerous studies and research have proven that regular exercise is associated with a reduced risk of certain types of cancer. The American Cancer Society, World Health Organization, and other health organizations recommend engaging in regular physical activity for cancer prevention.
Other Preventive Strategies The Human Papillomavirus (HPV) vaccine protects against several high-risk HPV types, reducing the risk of HPV-related cancers including cervical, vaginal, vulvar, anal, penile, oropharyngeal cancers. Hepatitis B Vaccine is crucial in preventing HBV infection and subsequent liver cancer. It is often
administered in infancy but can be given at any age. While there is no vaccine for Hepatitis C, advancements in antiviral medications can effectively treat and cure Hepatitis C infection, reducing the risk of liver cancer associated with chronic Hepatitis C. Programs and interventions to help individuals quit smoking or using tobacco significantly reduce the risk of cancers (lung, throat, mouth, esophageal, bladder cancers) related to tobacco use. It's important to follow recommended vaccination schedules and discuss with healthcare professionals to ensure you receive appropriate vaccinations based on your age, gender, and risk factors. These vaccinations not only
contribute to cancer prevention but also provide broader health benefits by preventing infections associated with various diseases.
Can Supplementation Help? Supplements generally do not provide protection against cancer or offer any significant benefits to survivors concerned about recurrence. In many cases, these supplements might pose potential harm, and may even interfere with medications. For example - antioxidant supplements, Vit-C, Vit-E etc may interfere with some chemotherapy drugs altering the effectiveness of these medicines.
Is Cancer a Genetic Disease? Cancer is caused by changes in genes that control the way cells grow and multiply. In that sense, it is a genetic disease. This could occur due to two main factors - Hereditary (Inherited) gene mutation, or Somatic (Acquired) gene mutations. Cancer in itself is not passed
down from a parent to the child. However, certain genetic alterations that elevate the risk of cancer can be inherited if it exists in the egg or sperm cells of a parent. Examples of hereditary cancer syndromes include BRCA1 and BRCA2 mutations associated with an increased risk of breast and ovarian cancers, and Lynch syndrome associated with an elevated risk of colorectal and other cancers. Somatic mutations occur in the DNA of individual cells during a person's lifetime. These mutations can result from exposure to environmental factors, lifestyle choices (obesity, smoking), exposure to carcinogenic chemicalds and radiation that can cause errors in DNA replication. If there is a familiar history of cancer, it is ever more important to adhere to a healthy lifestyle devoid of smoking and alcohol, follow a healthy diet and regular exercise, and also maintain a healthy weight.
Conclusion In conclusion, taking proactive
steps is crucial in preventing and supporting those dealing with cancer. National Cancer Awareness Day reminds us of the pressing need to tackle this global health issue. A balanced diet, packed with antioxidants and phytonutrients, stands out as a practical tool against cancer. The rising number of cancer cases highlights the importance of lifestyle changes, especially in maintaining a healthy weight, regular exercise, and minimizing exposure to environmental risks. Vaccinations targeting virus-related cancers and a cautious approach to supplements add to a comprehensive preventive plan. While genetics may play a role in cancer risk, our daily choices wield significant power in shaping our health. Every move towards a healthier lifestyle not only strengthens our defense against cancer but also enhances overall well-being. It's a collective journey where awareness, nutrition, and practical choices come together to empower us in the battle against this deadly disease

We are being changed continuously without our knowledge or permission. The importance of critical thinking comes into play here. It is indeed an acquired skill to decipher data. Critical thinking is when we are able to question every thought we run in our heads and all information that we consume on a daily basis. There are subliminal messages too that’s dispersed through the air when are asleep and awake which gets impressed on our subconscious mind even when we carefully try to consume the information that we are fed with. if we can get closer to the truth. Most of the times, we witness people rushing in on a rat-race they are in frantically without having a clarity on which destination they are heading to and why. We are being only asked to work hard and hard, that it would bring results. Majority of us haven’t been adequately trained and guided as to what are the complementing skills that make our hard work bring results. Albert Einstein puts it this way, “The definition of insanity is doing the same thing over and over again and expecting different results”. We have mostly been programmed to keep trying, try, try and try. However what we miss out is on to stop a bit, take a breath, ana-
lyse where we are standing, have an understanding about our situation, vitally understand why our several hits were missed, what’s to be kept in mind when we are trying on it again, learn the new trick and then try again. Just trying hard like a broken record wouldn’t really take you to the result which you were expecting to be at. If you are in trouble, you need to check your belief system. Snow More Dry Skin: Winter Skincare Tips That'll Have You Glowing Through the Blizzard!
A
s the air grows crisp and snowflakes dance in the wind, it's time to give your skin and hair the extra love and care they need during the winter months. The chilly weather often brings dryness, flakiness, and brittleness, but fear not! With a thoughtful routine and some winterfriendly products, you can keep your skin glowing and your hair luscious all season long.
Hydration is Key The foundation of any winter care routine is hydration. Both your skin and hair crave moisture when faced with harsh winds and indoor heating. Swap lightweight summer lotions for richer, creamier moisturizers. Look for ingredients like hyaluronic acid, shea butter, and glyc-
erin to lock in moisture and keep your skin supple. For your hair, indulge in hydrating masks or deep conditioning treatments once a week. This will replenish lost moisture and prevent frizz and breakage caused by the dry winter air. Don't forget to use a leave-in conditioner or serum to protect your locks from the cold.
Gentle Cleansing Avoid stripping your skin and hair of their natural oils by opting for gentle, hydrating cleansers. Consider using a creamy, non-drying facial cleanser to avoid exacerbating dryness. For your hair, try a sulfatefree shampoo that cleanses without stripping away essential oils.
Protective Layers Just as you layer clothing for
warmth, layering skincare products can provide extra protection. Start with a hydrating serum containing ingredients like vitamin E or ceramides to strengthen your skin barrier. Follow up with a moisturizer to seal in the goodness. Similarly, use styling products that offer heat protection for your hair. This shields your strands from the damaging effects of styling tools and the cold weather.
Sunscreen, Always Yes, even in winter! Snow can reflect UV rays, intensifying sun exposure. Apply a broad-spectrum sunscreen with at least SPF 30 to any exposed skin, especially your face, before heading outdoors. Don't skip this step; it's crucial for preventing sun damage.

Remember, beauty isn't just skin deep. Your lifestyle choices impact your skin and hair health. Stay hydrated by drinking plenty of water and maintaining a balanced diet rich in fruits, vegetables, and omega-3 fatty acids. Regular exercise can also improve blood circulation, benefiting your skin and scalp.
Extra Tips •Use a humidifier indoors to
combat dryness caused by central heating. •Avoid long, hot showers that can strip away natural oils. Opt for lukewarm water instead. •Exfoliate gently to remove dead skin cells and allow better absorption of your skincare products. •Treat yourself to a weekly athome spa session with a nourishing face mask and hair treatment. Winter doesn't have to be a battle against dryness and dullness. By adjusting your skincare and hair care routine to accommodate the season, you can embrace the beauty of winter while keeping your skin and hair healthy and radiant. With the right products and a little extra care, you'll glow through the frostiest days! So, cozy up, sip on some hot cocoa, and pamper yourself with these winter care tips. Your skin and hair will thank you for the extra love and attention during this chilly season!

Tata Harrier 2023 T
ata Motors has always been instrumental in updating their Harrier from time to time. We drove the new 2023 version much before its launch, in Pune and as far as facelifts go, this is a big one. The changes are more than skin deep, but let’s begin with what you can see. Gone are the big headlamps and in their place, there are smaller, sleeker LED units similar
to the ones seen on the new Nexon facelift. The Harrier’s styling has triangular elements which differ from the vertical ones seen on the Safari. There is full width LED bar both front and rear. The grille has a blacked out look which combined with the new light signature in the dark gives it a sleeker appearance. The rear bumper mimics the front ones with auxillary lights built into them. The choice of yellow
and purple colour is part of the new personas, although milder colours are also available. The wheels are all black in the test car which come in other finishes too. Inside, you get a new steering wheel, revised dashboard
and new screens for the driver display and infotainment. The 10.25-inch driver display sits deep inside its recess and doesn’t catch reflections like in the Nexon. The animations are slick but we noticed some bugs in the cars we were driving. Tata
said they would rectify this before the product hits the market. The 12.3-inch infotainment screen gets its own 3D surround camera, 13 JBL sound modes, Apple Carplay, and 10 speakers including a subwoofer. The air conditioning controls have been

tastes. Rear seat passengers now get sun blinds and adjustable winglets for the headrests. There is also a powered tail gate with gesture control and boot space has increased by 20 litres to 445 litres. Tata’s 1.5 litre turbo petrol is still some time away and the Harrier continues to be powered by the 2.0 litre diesel four-cylinder engine with
170bhp and 350Nm. The engine is a bit coarse, but it has good low end grunt and midrange. The test cars were all manual and we aren’t big fans of the long clutch travel, the strange point and gear shift quality. Unless you really want a manual, just go for the automatic. The automatic is a Hyundai sourced six speed unit and although it doesn't like to
be hurried, it's smooth in the way it delivers its shifts. The biggest difference with the Harrier is the new updated electric power steering. Gone is the heavy, inconsistent old hydraulic unit and now it’s so much easier to drive and park. You still get a lot of slack in the straight-ahead position, but the steering makes it so much better to drive. The Harrier facelift also sees the shift to 17, 1 and even 19-inch wheels in the Dark edition. Ride quality isn’t
too bad in the 18-inch version, but you do feel a bit of firmness than before. You get six airbags, ESC, traction control, tyre pressure monitoring etc as standard in all variants and higher versions get knee airbags, ADAS etc on top of that. With the new updates, the Harrier has enough to be back on top of the buyer's list in that segment. It is just as comfortable, now has more features to boast and looks even better than before
