TERMS AND CONDITIONS 1. General 1.1 The following Terms and Conditions are attached with Estimate and/or Invoice and shall form part of the contract between TREDI INTERIORS LLC (hereinafter “Supplier”) and Customer. 1.2 Customer understands and agrees that all products described in this Invoice are specially designed and custom manufactured and once placed the order is not subject to cancellation by Customer for any reason whatsoever. 1.3 Failure of Customer to pick up products within hundred eighty (180) days shall trigger Supplier's right to resell the products under applicable law and Customer and Supplier hereby agree that whenever Supplier is permitted to resell the products under applicable law it may do so either by private or public sale. Customer further agrees that Supplier's place of business is a reasonable place, but not the only reasonable place for such sale. 1.4 Customer shall be responsible for any applicable storage costs for failure to pick up products in a timely manner.
2. Exclusions 2.1 This Invoice and/or Estimate is for the purchase of the products set forth herein and does not include products installation, purchase or installation of appliances; material and/or labor in connection with any excavation, site work, plumbing, electrical, masonry, flooring, floor covering, painting, decorating work, and/or demolition of existing products unless specifically provided. 2.2 Supplier is not responsible for any problems resulting from uneven surfaces or incorrect measurements supplied by Customer, including, but not limited to floor or walls.
3. Conformance with Plans, Specifications, and Addenda 3.1 All products are guaranteed to be in accordance with submitted and approved drawings and specifications. 3.2 No change order may be authorized under this Invoice unless in writing and signed by Customer and Supplier. Additional material cost may apply and must be paid before any changes can be made pursuant to this Invoice. 3.3 Tredi Interiors provides installation plans and elevations for the contractors to place plumbing, electrical and wood blocks, etc. 3.4 Tredi Interiors will do ONE free walk through before installation to check if installation plans have been followed and space is ready for installation. 3.5 Tredi Interiors can provide a FOLLOW UP contract which includes 5 on-site visits during construction. Visits should be scheduled by the GC to check framing, plumbing, electrical, etc. Each visit will be followed by a report sent by e-mail to the GC and/or architect and customer. Flat fee for such contract will be determined by Tredi Interiors depending on size and complexity of the kitchen design. For extra visits, refer to 3.6. 3.6 If the job site doesn’t meet requirements for a proper installation, a 30% increase of a standard installation will be applied.
