SPECIAL SALES CONDITIONS STANDARD INFORMATION FORM FOR PACKAGE TRAVEL CONTRACTS The travel services offered to you hereafter is a package as defined by the directive (EU) 2015/2302 and article L.211-2 of the French Tourism Code. You thus enjoy all of the rights granted by the European Union applicable to packages as they are defined in the Tourism Code. The CLUB MED corporation and, if necessary, the retailer, will be entirely responsible for the proper execution of the Package in its entirety. In addition, as the law requires, the CLUB MED corporation and, if necessary, the retailer, have insurance in order to reimburse your payment and, if transport is included in the package, guarantee your repatriation in the event they become insolvent. Essential rights as defined by the directive (UE) 2015/2302 as integrated into the French Tourism Code Travellers will receive all essential information about the package before concluding the package travel contract. There is always at least one trader who is liable for the proper performance of all the travel services included in the contract. Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the travel agent. Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs. The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs. Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate. Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package. Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee. If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem. Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed. ADDITIONAL CONDITIONS The operating conditions for activities related to the organisation and tourism and travel package sales are governed by the articles L.211 et al. and R.211-1 of the French Tourism Code. PREAMBLE The sale of Cruises is governed by these additional sales conditions that complete or modify the General Sales Conditions. They define the sales conditions of services offered on board Club Med 2, in agencies, online and by telephone. They make up a part of the preceding information aimed at article R.211-4 of the Tourism Code, the entirety of information related to cruise programmes and services that are available and able to be consulted on the website www.clubmed.fr. The entirety of this information is to inform G.M.s® prior to the signature of their contract of the content of services offered related to transportation, the stay aboard Club Med 2 (“Ship”) (especially the principle characteristics of the Ship, the characteristics of the Cabins, their level of comfort, different activities and sports), prices and payment methods, cancellation conditions and the modification of the Contract as well as conditions for crossing international border. The conditions of maritime transport are governed by the carrying contract that can be found on the back of the passenger ticket given to G.M.s® in the conditions defined hereafter in article 9. The characteristics of the trip/stay, the General Sales Conditions, these Additional Sales Conditions, the programme, the quote, and the Club Med® offer are contractually binding upon the signing of the Sales Contract by the G.M.®. In the absence of a brochure, a quote, and a proposition, the Sales Contract constitutes, before its signature or execution (payment of the balance), the preliminary information covered by R.211-7 of the French Tourism Code. Club Med® nevertheless reserves the right to modify information (such as information related to the price and content of transportation conditions, itineraries, and ports of call as well as the voyage offered onboard the Ship) located on these different information sources in the conditions defined hereafter in article 4. The present Additional Sales Conditions prevail over all others in case of contradiction with the General Sales Conditions in effect. 1. CLUB PACKAGES Club Med® offers its G.M.s® Packages that constitute a stay (in what constitutes maritime transport) aboard the Ship (with or without air
transport, in the former case the trips are referred to as “Port to Port”). These packages constitute a singular and indivisible product of which the content, cruise itinerary and price are laid out in detail on the site www.clubmed.fr (hereafter: “Package”) In the event of a Port to Port package, except in the event of special hours communicated on notices addressed to G.M.s®, the embarkment time begins at 4pm and disembarkment takes place between 9am and 11am (Cabins must be empty before 10am). In exceptional cases, a G.M.® may embark on a Ship during a cruise in progress at a port of call upon authorization from the management of the Club Med® Cruises department and upon payment by the G.M.® of the entirely of the corresponding cruise price, even if he or she has missed certain ports of call. 1.1 TRIP PACKAGES ON SHIPS Include: — one week (seven nights excluding exceptions mentioned in the Calendar and Price) or multiple week trips on the Ship, transport time included in Packages with transport. — Full board during the trip (including breakfast, lunch and dinner as well as the “Bar & Snacking” package offering glasses of champagne at the bar(s) at 6pm as well as drinks at the bar and minirefrigerators, excluding à la carte and paid options that will be clearly indicated on the Ship), — sporting activities advertised online and in the reservation confirmation email, usual Club Med® services such as reading libraries, activities and parties. The services not advertised as included in the Package are available as options according to availability (notable examples are excursions (keeping in mind that those offered at the beginning and end of the cruise may not be possible depending on flight arrival and departure time), spa and wellness services, and the beauty salon). Services with extra charges are identified as such online and onsite on the Ship. Excursions purchased by reservation are contingent on a minimum of eight participants. If this number is not reached, this will be considered a valid reason for cancellation by Club Med® without qualifying the G.M.® for reimbursement except in the case for reimbursements for already paid for by the G.M.®. Excursions may also be limited to a maximum number of participants. Taxes (port and aviation) and fuel surcharges may be subject to modification under certain conditions in article 4 of the General Sales Conditions valid in these additional conditions. *Full board includes three meals per day (except embarkment and disembarkment day including for “with transport” Packages, notably for the reason of transportation arrival and departure times.) and include wine (except for wines offered à la carte) at lunch and at dinner. G.M.s® can ask organisers about special requests or alert them to a particular need related to their stay or transportation (special meals, handicap access, babies…) that will be treated on a case by case basis. The request will not be considered validated until written confirmation by Club Med® and/or the air carrier and on the condition that the requesting G.M. fulfills the conditions that are communicated to him or her in this case. All requests for special transport must always be communicated ahead of time to your agency (physical handicap, overweight, etc.) at least 72 hours at the latest before departure and always before the purchase and issuing of transportation tickets. Reduced mobility guests: Non-autonomous guests (caused by an illness, physical or mental handicap: handicapped or reduced mobility guests) are required to inform Club Med® of the need for any particular assistance before any reservation is made. It is important that the most recent information related to the person’s specific needs in terms of lodging, seating or special services, or for medical equipment that the person must have access to, be communicated before any reservation so that Club Med® can confirm that it is able to fulfill its obligations as a transporter in satisfactorily safe and comfortable conditions for the guest and other passengers. This information
will be processed as quickly as possible by Club Med® after they are communicated by writing at the agency. Club Med® can, in necessarily cases, require that the non-autonomous guest be accompanied by a person that will be able to assist them onsite during their stay with the help and assistance required by their state of health and that will be necessary to assure a successful trip. Club Med® will not be responsible for the denial of embarkation for guests who have failed to properly communicate their needs during the reservation process. Club Med® reserves the right to refuse a non-autonomous guest for reasons of safety, insufficient equipment, or a state of health that would require particular care that Club Med® is not capable or providing. Disembarkment and stairs in certain ports can be difficult or even impossible to safely navigate, particularly during disembarkation by water shuttle, and may prevent certain guests from disembarking at certain ports of call. The list of these ports is available upon written request. Medical contraindications: as a general rule, all passengers must make sure that they are medically and physically capable of participating in a cruise without putting their own lives or the lives of other passengers in dancer. Club Med® and/or the commander on board reserve the right to refuse transportation any passenger whose presence on board may pose a threat to the safety of the other passengers, the crew, or the local order of ports visited by the Ship. The commandant and/or Club Med® can notably decide to refused embarkation or disembarkation to passengers in any port visited by the Ship, confine passengers in an onboard medical facility, at the hospital or other similar institutions that the onboard doctor deems necessary and administer any medication that the doctor deems necessary. Passengers are responsible for any resulting charges, notably including consultation fees, medicines and repatriation. The passenger will not in any case be able to claim indemnities, damages or interests, nor the reimbursement of the part of the trip that was not used. They are valid for one adult (18 years and older) staying in a Club Deck B cabin on the assumption of double occupancy and include port of call fees as well as Packages sold with transport, transfers, airport taxes, insurance, safety taxes, social taxes and fuel surcharges. The taxes are susceptible to change according to the Sales Conditions (details for adult and child prices by deck on the website clubmed. fr or by calling 0919 810 810 (service 0.05€/min plus carrier costs) or in your agency). The prices found in the Cruises Summer 2018 and Winter 2018/2019 Calendar and Prices were set according to the economic and fiscal data in effect from 7 September 2017 to 18 September 2017. For prices of Cruises for seasons after these dates, see the “Calendar and Cruise Prices” document available in agencies. Club Med® reserves the right to raise its prices to account for: — Transportation costs, notably the cost of fuel (including fuel for the Ship); — Fees and taxes pertaining to the services on offer such as landing, docking, disembarkation in ports (port of call fees) and airport taxes or also civil aviation taxes (“social tax”). — Exchange rates applied to the Package. For the Ship costs, the relevant price raise will be calculated as follows: exchange rate for fuel use (following the MGO index) and for exchange rate converted from American dollars to euros according to the currency rates applied to the Ship’s consumption previsions for the month of the cruise, amortized per passenger. In case of a variation of the different elements defined as such, Club Med® can transmit the entirely of this variation to its prices (with the understanding that the variation in exchange rates is only applied to services billed by Club Med® in the relevant currency). For G.M.s® already booked thirty days or more before departure, no price modification can be applied in the twenty days preceding the scheduled departure date. Lowering of prices will be assessed in the event of changes in these same reference points. 3. HOW TO PAY FOR YOUR PACKAGE See stipulation in chapter 3 of the General Sales Conditions in effect. 4. MODIFICATIONS, CANCELLATIONS AND/OR TERMINATION AND HANDOVERS
1.2 AIR TRANSPORT TO EMBARKATION PORT Except as noted in paragraph 1.2.2 of the General Sales Conditions, airport to port round trip transport is included in the price of Packages with transport, except unless otherwise noted. Club Med® charter flights can be take place by day or night as the first and last day of the trip are dedicated to travel. Club Med® does not have control over transportation times and thus cannot be held responsible in the case of delayed flights and/or a morning return on the first and/or last day.
See stipulations in chapter 4 of the General Sales Conditions in effect. Guests are reminded that G.M.s® are not entitled to refunds for the purchase of touristic services conforming to article L.121-21-8 of the French Consumer Code. The terms “termination” and “termination compensation” have, respectively, the same meaning as the terms “cancellation” and “penalties”. Last minute offers offered exclusively on the website www.clubmed.fr are subject to special modification and cancellation conditions that can be found on said website.
1.3. TRANSFERS
Without infringing upon the application of terms in chapter 4 of the General Sales conditions applicable at the time of reservation, note that the content of Cruises and ports of call can be cancelled or modified without prior warning due to local factors (official movements, cultural or sports events, political events, security measures, etc.) or weather conditions (for example, watersports during tropical storms), at which time the scheduled destinations are impossible to access. In the event that these modifications will affect in a substantial manner a fundamental element of the Package, Club Med® will inform G.M.s®.
— .3.1. Transport to port of embarkation Airport/Port transport is not provided by Club Med® and remains the responsibility of G.M.s® for Cruise Packages reserved without air transport (“Port to Port” trips). — .3.2. Port/Resort Transport (or Village/Port) In the event of a Resort Trip Package purchased in addition to a Cruise Package, the transport Port/ Resort (or Resort/Port) is not provided by Club Med® and remains the responsibility of the G.M.®. Transport for an additional fee may nevertheless be offered if certain circumstances at the time of reservation (inquire for more information). 1.4. TRIP EXTENSIONS IN RESORTS A stay in a Resort may be had before or after a Cruise, the reservation can be made with your travel agent. 2. HOW TO CALCULATE YOUR PACKAGE PRICE The prices in the “Calendar and Prices” chart are listed in euros with all taxes included (except for annual costs, see article 2.1 of General Sales
Concerning Discovery Space products, we remind you that an insufficient number of participants as indicated will constitute a valid reason for the cancellation of the activity by Club Med® without the cancellation allowing for the right to reimbursement of any sort. In the event of unavailable seats on charter flights, Club Med® may propose an alternative offer for special flights at the same date or another date, in this case leading to a modification of the Cruise duration as compared to that listed in the Calendar and Prices document and be just cause for a supplement of
reduced price, which will be communicated to the G.M.® before the signing of his or her contract. 5. LONGER STAY IN RESORT Dependent on availability and the fulfillment by the G.M.® of the required formalities regarding visas and/or vaccines, an extension of the Package can be possible at the price listed on the Calendar and Prices document. Payment must be completed in totality on board and in euros. Payment by a third party in one of our points of sale cannot be accepted. 6. WITHDRAWAL IN THE COURSE OF A PACKAGE An interruption of the Package due to a port of call and/or the cancellation of certain services included in the Package or purchased in supplement to the Package price during reservation (such as classes, excursions, etc.) may not lead to a reimbursement request or credit of any sort. An eventual premature departure from the Ship cannot be in any case considered as an agreement for reimbursement of any kind. 7. RESPONSIBILITY Consult the terms of chapter 12 in the General Sales Conditions in effect. The transport of passengers and their baggages by sea is governed by the Athens Convention of 1974 and the London Convention of 1976 as indicated on the passenger ticket given to the passenger before departure and that the G.M. thus accepts. The Athens Convention limits the responsibility of the transporter in case of death or bodily harm as well as loss and damages to baggage and valuables. The limitation of responsibility benefits Club Med® in the same conditions. 8. COMPLAINTS Complaints pertaining to the Package must be sent by the G.M.® by means of certified delivery in the thirty days following the end of the Package or online by filling out the form located in the “Contact” section of ClubMed.fr. Complaints with the possibility of leading to insurance damages or civil responsibility by Club Med® must be the subject of a written declaration before the departure of the Ship, or to the transporter if the litigant is implicated during departures and returns organized by Club Med®. After having contacted the Client Relations Service, and in the absence of a mutually satisfying agreement within sixty days, G.M.s may call upon the French Tourism and Travel Mediator (BP 80 303, 75 823 Paris Cedex 17), of which the terms and conditions of referral are available on the website www.mtv. travel. Complaints pertaining exclusively to terms and conditions of a reservation made online can be sent to the platform http://ec.europa.eu/ consumers/odr/. Without superseding the preceeding information, we remind you that complaints must be addressed directly to the insurance adjuster MARSH — Tour Ariane — La Défense 9 - 92088 Paris La Défense Cedex. 9. FORMALITIES Passport and visas: Passport and visas: refer to the stipulations in chapter 6 of the General Sales Conditions in effect on the “practical information” page (PASSPORT, VISAS section) of the website www.clubmed.fr/ croisieres Travel documents: G.M.s® will receive their Contract, their Itinerary with the details of the dates, places and hours of travel as well as their ticket, which is necessary for departure, before the beginning of their trip. G.M.s® must share relevant information about their Passport and their ESTA (for cruises with ports of call in the United States of America) with their travel agency during reservation. Flight times and the names of airlines listed on the Sales Contract are subject to modification on the Holidays Rendez-vous. Health: passengers who are twenty-eight weeks or more pregnant at the time of the cruise’s end cannot be accepted for reservation or transport. Passengers who will be less than twenty-eight weeks pregnant at the end
of the cruise must have at the time of embarkment a medical certificate that confirms their ability to travel by sea. In the absence of this, Club Med® and/or the captain reserve the right to refuse their access to the Ship without leading to any sort of right to damages or reimbursement of money spent. Club Med® reserves the right to demand a certificate confirming the guest’s ability to participate in a cruise at the time of reservation. Vaccinations - health - ability to travel: consult the “Health” section of the Sun Destinations Trident® or Winter Sports Destinations Trident® in effect at the time of reservation or at www.clubmed.fr. G.M.s® with known allergies or intolerances to certain foods are requested to share this information at the time of arrival with the Restaurant Manager or the Head Chef depending on the ways and means indicated onsite. 10. PERSONAL DATA CONFIDENTIALITY Consult the stipulations in chapter 14 of the General Sales Conditions in effect. In accordance with the “Technology and Freedoms” law n° 78-17 from 6 January 1978 and modified on 6 August 2004, each G.M.® enjoys the strictly personal right to access, correct and oppose for legitimate reasons the information that concerns them. As this is a strictly personal right, the right to access and correct can not be exercised by anybody but the concerned party with proper identification or by a legal representative if the situation concerns a minor or incapacitated adult. The concerned party can practice this right with a simple letter addressed to the Clients Relations Department, the address for which can be found in chapter 8. 11. SPORTS Consult the information available on the website www. clubmed.fr. There will be no watersports while the Ship is docked except in otherwise indicated situations. The opening of the nautical center (which allows for access to diverse nautical activities including free diving) is determined according to the weather conditions and/ or decisions from local authorities. 12. LODGING We remind you that the concept of lodging on board the Ship, known as “by Unit”, is lodging meant to be shared with another G.M.® registered to the same sales document and/or reservation file. It is thus only accessible to families or G.M.s® who know each other. For travellers who are registered alone to the sales document and/or reservation file, lodging is thus obligatorily in a Cabin (single occupancy, with the possibility depending on the date of stay, a price supplement to pay). With the understanding of the principle of lodging “by Unit”, a child (less than 12 years old) must be housed in a Cabin to share with his or her parents and/or guardian(s), or in an individual Cabin requiring the payment of a single supplement. In any event, minor children are the complete responsibility of their parents and/or guardian(s) during the entire duration of the stay and it is thus the responsibility of these adults to determine whether their child(ren) who are more than 12 years old can responsibly be lodged alone in a single-occupancy Cabin. Club Med® offers in this regard, depending on availability and for a reduction in price (see Calendar and Prices) of family Cabins and/or in triple-occupancy but still “by Unit”. The cabin number listed on the Contract is listed for informational purposes only and Club Med® reserves the possibility to change cabin assignments in the same comfort category. Lodging conditions (name and category of the hotel, dining options) outside of the Ship are those listed on the mini-circuit program. 13. CHILDREN Without superseding the application of stipulations in Chapter 5 of the General Sales Conditions in effect, must be at least eight years old to be accepted onboard and are not subject to childcare or special services. They are the complete responsibility of their parents and/or guardian(s). 14. ANIMALS Club Med® regrets not being able to welcome G.M.’s® domestic animals on board. Service dogs that are recognized as necessary (substantiating documents issued by the relevant authority must
be provided by the concerned party to Club Med) to non-autonomous individuals can nevertheless be admitted under the conditions that (i) they are accepted by airlines during the guest’s travel and no quarantine period is imposed by the host country (ii) Club Med® has been duly informed at the time of reservation. Guests accompanied by a recognized service dog must present Club Med with, before the date of departure, their disability card (article L.241-3 of CASF) as well as the dog’s service contract (article D.245-24-2 of CASF)). Club Med® reserves the right to demand any additional documentation that justifies the need of a service dog in accordance with change in legislative or regulatory textes. In the event that the required documents cannot be produced, the travel contract will be considered cancelled by responsibility of the G.M. at the date of the trip’s start. 15. ASSISTANCE/INSURANCE It is noted in advance that the G.M. has a form of assistance listed on the sales contract at the destination in the event of difficulties or problems. Refer to the stipulations of chapters 15 and 16 of the General Sales Conditions in effect. We strongly recommend that you purchase supplemental insurance. To this effect, Club Med® offers the opportunity to sign up for supplemental insurance, Écran Total®, that covers the risks inherent to your trip including those on the following non-exhaustive list: cancellation, baggages, premature returns. For the details of this offer (ways and means of subscription and coverage), please consult your travel agent. 16. VALUABLES Valuables, identity papers, and jewels must not be left without surveillance in your Cabin or in your hotel room. Each Cabin is equipped with a mini-safe in which currency of no more than 1000 euros and valuables with a maximum value of 2500 euros can be kept. Beyond these limits, safeguarding at the reception’s main safe must be requested. 17. PHOTOS AND ILLUSTRATIONS Club Med® does the best it can to provide photos and illustrations that allow G.M.s® to have a sense of the services on offer. These photos and illustrations are meant to give an idea of the category of services but do not contractually bind Club Med® beyond this purpose.
