LEGAL MATTERS CORNER

MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

Sophie had a relationship with Brian and they have broken up but he is still texting her, watching and besetting her home and sending her nasty emails. He has threatened her with violence. She is wondering what she can do.?

The Domestic Violence Act 2018 aims to prevent physical and psychological violence and intimidation in the home whether from someone living with the person or someone who lives elsewhere but is engaged in that type of behavior to the person in their home. It could be a spouse, cohabiting or former cohabiting partner, dating or former dating partner. The new Domestic Violence Act 2018 protects more people than it did before. The act is gender neutral and applies to both men and women experiencing this type of behavior our Sophie could be a Steven. Under the act there is a remedy known as a SAFETY ORDER: This can be granted for up to five years and protects the applicant or any dependent person from threats and intimidation without barring the offending person. However, if they are not living together it operates to effectively stop the person watching or besetting the home of the applicant. The order is that the person the subject matter of the order shall not use or threaten to use violence against, molest (i.e. annoy) or put in fear the Applicant or dependent children or if no longer living with Applicant will not watch or beset the place where the applicant resides. It stops them following or communicating (including by electronic means) the applicant or dependent person. The people who can apply for these orders are 1. a Spouse/Civil Partner. 2. A Person who was in an intimate relationship with the respondent. 3. A Parent of an adult child. 4. A person of full age residing with someone in a relationship not primarily contractual. E.g. brothers/sisters, homosexual/lesbian relationships and perhaps cohabitees. 5 Where the parties had a child together. 6. The Child and Family Agency can apply for a person who may not be able to make the application themselves. Having an order in place enables the Gardai to take more action e.g. in relation to arresting the perpetrator of the behavior if they are causing trouble at Sophie’s residence. Pending the court hearing on the Safety Order application Sophie could get an emergency protection order from the courts to protect her pending the hearing. This operates the same as a safety order pending the hearing. If any of these orders are breached there are fines of up to €4000 and/or 12 months imprisonment penalties. In addition to the above the act has multiple other provisions aimed at protecting people from domestic violence and a multiple of different factors related to previous history can be taken into account by the court including previous violent behavior and animal cruelty amongst other issues.

KERRY SKIN CLINIC

ROSACEA (RED, SPOTTY FACE IN ADULTS) BY DR DAVID BUCKLEY

Irish people with Celtic skin are particularly prone to rosacea. This is a red, pimply rash on the face that develops in some adults. It can look a bit like acne because there is usually numerous pimples and spots on the face. However, unlike acne, there is no blackheads or whiteheads and the skin is not usually oily. With rosacea, the skin is red (hence the name) and the skin blushes easily, especially with stress, exercise, alcohol, spicy foods, etc.

Rosacea usually occurs in adults. However, it can occur even in teenagers and elderly people.

Rosacea is aggravated by ultraviolet light. This includes sunlight and sunbeds. Ultraviolet light can penetrate through clouds, so people with rosacea must protect the skin on their face using a high factor sunblock (e.g. SPF 30) and a broad brimmed hat all year round, even on cloudy days. They may need to take extra vitamin D in the winter if they are covering up with hats and sunblocks. People with rosacea should avoid putting any steroid creams on their face.

Offering

Treatments for rosacea include special rosacea creams which are usually only available on prescription from the doctor. These can take six to twelve weeks to work. More troublesome cases may also have to add in rosacea tablets which are similar to acne tablets that we give to teenagers. A course of the tablets usually last six to twelve weeks.

Rosacea can occasionally affect the eyelids causing gritty eyes. Fortunately, this can be treated with similar treatments as mentioned above for the skin.

On completion of a course of treatment, all the pimples and spots should be gone, and the redness should have reduced. Some people have persistent redness despite treatment and may benefit from laser treatment to get rid of the redness which is due to broken veins.

Most cases of rosacea can be managed by your GP but more troublesome cases may need to be seen by a skin specialist.

HELLO BEAUTIFUL PEOPLE!

I HOPE YOU’RE HAVING AN AMAAAAZING WEEK!

This week I have an announcement -if you follow me on Instagram or YouTube you will already know, but…

I’M GOING CRUELTY FREE WITH ALL MY MAKEUP!

Yes, ALL of it. Both the makeup for my kit and for myself personally. I thought about it recently, about how so many ‘new’ brands are cruelty free from the get go. I decided to do some research and find out for myself exactly what brands are cruelty free.

As it turns out, there are actually more cruelty free brands than non cruelty free, so I thought to myself… “why support the non cruelty free choices when there’s plenty to choose from amongst the rest?”. It didn’t make sense to me, especially in today’s climate, to support any brand that is not cruelty free.

So, that being said, I have started to replace a lot of my kit. Some of my favourites and go-to products unfortunately fell into that non cruelty free bracket.

But it’s ok because some amazing brands are cruelty free. These include, Anastasia Beverly Hills, Clarions, Fenty Beauty, Too Faced, Huda Beauty, Laura Mecier, Hourglass Cosmetics, Tarte, Morphe, Urban Decay, Ardell… the list goes on!

I hope to educate any future clients on cruelty free products and will answer any questions that they have. The number one thing to me is, the quality of my work will not be compromised as I can still use amazing high end products on my clients. And they walk away with a feel good factor knowing everything used was cruelty free.

HELLO STRONG PEOPLE

I hope you are all having a fantastic week!

I’m home!!! I arrived last Thursday night, so it’s been a week & it’s so so good to be back.

It’s especially good to be home to all the amazing Irish food I missed while being away. Speaking of food, this week that’s what we’re going to talk about.

Since being home, I’ve guesstimated my calories at 1,800/1,900 as I’m not back in the gym yet (waiting for The Arena Tralee to open and I’m not about to pay 8 euro per day for pay as you go at a gym)… so I’ve been tracking using MyFitnessPal & My Fitbit ensuring I’m getting those 10,000 steps per day.

Breakdown of macros (protein, carbs & fat)? I’m just trying to hit 150g minimum of protein per day.

“Rebecca, why are you having protein if you’re not going to the gym”… EYE ROLL.

BEXBLAHFITNESS! Rebecca

You don’t only need protein when you’re going to the gym, you need protein as part of you’re everyday life. You can consume that protein whatever way suits you, meats, dairy, eggs, tofu, beans and legumes, protein supplements… literally whatever you want. Protein helps to keep you fuller for longer so if you’re trying to decrease your calorie intake, that will help.

I just love the concept of tracking macros, it makes sense for so many reasons…

• It’s literally science.

• It doesn’t demonise any food or put you into a weird food hating mindset. Every food has a value, and you need to add those values up into your daily calories.

• YOU KNOW THE NUTRITIONAL VALUE OF WHAT FOOD YOU’RE EATING. You are an adult, you can choose for yourself what nutrients to consume, and will be more aware of the nutrients in foods.

• Just make sure you don’t calculate your macros on MyFitnessPal, they’re incorrect.

I’m so so excited to start training properly again, and I’ve chosen to start in The Arena Tralee as I feel a brand new gym will have insane energy and it will add much needed motivation as I haven’t been in a gym in over a month. Also I’m just out here trying to support new business’ in Tralee you know.

Here’s a few people I would recommend to follow on Instagram… @jamessmithpt @tea.to.triceps & @ martinnutrition.

Traditional Arts Training for all ages

22nd May 2019, Tralee, Co Kerry: As Siamsa Tíre, the National Folk Theatre of Ireland celebrated the final showcase of its’ third year Training Academy Graduates on Monday 20th May, it announced its audition schedule for the National Folk Theatre Training Academy. Every year, Siamsa Tíre searches for the most talented traditional singers and dancers living in Kerry, starting from the ages of 7-12 years. For the first time, auditions will now be open to teens (1318 years) and adults (18+ years). Successful candidates train in the traditional arts of Irish music, song and dance with the potential to become a member of the cast of the National Folk Theatre of Ireland.

This year’s auditions will take place by appointment only on Thursday 13th June from 6-8pm at Teach Siamsa Finuge, Friday 14th June from 6-8pm at Teach Siamsa na Carraige, Dingle and on Saturday 15th June from 10am – 2pm at Siamsa Tíre, Tralee. Applicants must have a song and an Irish dance piece prepared for their audition and

need to demonstrate some previous interest in Irish music and/or dance, as this training is not for complete beginners.

Successful junior candidates take part in a three-year formal educational training programme with classes taking place weekly from October to May. The new training classes for teens and adults will run throughout the summer (updated schedule to be announced in June on www. siamsatire.com ). Candidates are trained in Irish dancing, traditional singing and drama in the unique Siamsa Tíre style with a view to becoming a member of the community cast and performing with the NFT in the annual Festival of Folk summer seasons.

“Kerry has such a wonderful pool of talented traditional Irish performers of all ages! In recognition of this, we decided to extend our auditions to traditional artists of all ages that may not have had the opportunity to audition with us previously. Successful Irish dancers, singers and musicians will train with Ireland’s only traditional theatre company to learn

our unique style and help us preserve and share these arts with audiences worldwide, while developing and showcasing their talents on the Siamsa stage. For some, this leads to being eventually cast in the National Folk Theatre after more training and for others they gain very solid performance foundations that they go onto use in their future training and performing careers,” said Anne O’Donnell, Training & Development Officer, The National Folk Theatre of Ireland.

The strength of Siamsa Tíre’s performing company lies in the extended Community

Cast who have trained and performed with the company over more than forty years. The National Folk Theatre Community Cast of performers complete a minimum of three years of training with the company before going on to an advanced training class as part of their performance preparation. Students who have completed the training offered by Siamsa Tíre have gone on to achieve national and international success as performers, including John Fitzgerald, Seán Hanafin, Sarah Jane Drummey, Justin Walsh and Paula Murrihy.

WHATS DIFFERENT ABOUT BROOKFIELD?

"This year , we celebrate working with students for 31 years , since 1988 " says Principal Elisha Dowling . "I like to emphasise the word 'with' as it conveys the approach we take with all students who come here ...We have created an atmosphere in the College where students are expected and encouraged to perform to the best of their ability. The most important part of this equation (yes , Elisha also teaches Maths!) has to be our teachers .At present we have 15 teachers in the school , all highly qualified teachers who are motivated and enthusiastic about teaching ...They just love teaching ...and that does come out in the students! And because there is rarely any changeover of teachers , that gives our students consistency ..very important in the exam years . We dont have uniforms and teachers are known on a first name basis... this all fosters maturity amongst the students. All our students are given regular assessments and each is assigned a tutor who meets with them several times during the year , discussing progress and giving both advice and guidance.Career guidance also gets priority during the Senior Cycle as we find it answers a lot of questions that students may have and gives them clarification. Its very satisfying to hear, maybe even a few years after they've gone that former students have found their time with us to be hugely positive... thats enough for me "

BROOKFIELD COLLEGE ...

UP THERE WITH IRELAND'S BEST!

In an Irish Times survey conducted on Irelands best College Feeder schools, Brookfield emerged as one of the top 2 schools in Ireland . The survey noted that 100% of all Brookfield students who sat the Leaving Cert in 2012 went onto third level education . This puts Brookfield ahead of other schools in large urban areas such as Dublin , Cork , Galway and Limerick .

According to Principal Elisha Dowling " We have an extremely high standard set here and in my experience when you combine excellent teachers who are highly motivated with an atmosphere that demands the greatest effort from the students , this can have a significant positive effect on an individuals results !"

JUST SOME OF OUR REVIEWS

We were enormously impressed not only by the quality of the teaching but also by the very obvious commitment you have to fulfil each students potential. (Parents review)

Very structured way of teaching and makes sure everyone gets what they're capable of achieving.

There is so much more to Brookfield than studying!

Great Teacher...Very approachable which is a big plus! Went from a D average to getting a B+

Post Election comment with Padraig Harnett

Seats Filled but are there any real winners?

The dust has settled on the latest election in the country or should I say elections after what was a lacklustre campaign. Worryingly for the political set-up for the first time the turn-out was less than 50% nationwide which means more people decided not to vote than went to the ballot box. The changes to the Divorce Laws were always going to pass by a huge margin. Can we really even say was their even a Vote No campaign?

The European Elections saw a huge field of 23 contest a massive Ireland South constituency. One has to wonder about many of these who did not even have European policies or ideas but just wanted to get their domestic viewpoint across. I would suspect that some of these were looking to raise their profile ahead of a General Election that will probably come in late November or could be stretched into early next year. It looks like there will need to be 4 By-Elections with 4 TD’s moving to Europe but this won’t happen so there will be an election – its jut a case of

when.

But from a Kerry point of view Sean Kelly topped the poll which is good news. It will be a very different European Parliament

So closer to home and we now know the 7 members on the Kerry County Council representing the new Tralee Municipal District. The Council will have Fianna Fail as the biggest party with 10 Councillors. There will also be 10 Independents on the Council which is a gain of two. Fine Gael had a bad day at the polls losing two seats and are down to 7, Sinn Fein are also down losing one seat. Labour gained a seat in Killarney but lost their second in Tralee to remain on 2.

Tralee Municipal District:

The Winners: The Tralee Councillors are Norma Foley and Mikey Sheehy of FF, Toireasa Ferris and Pa Daly SF, Jim Finucane FG, Terry O’Brien Labour and Sam Locke Independent.

The Count: The total number of people eligible to vote was 25,036 with 13,169 actually voting giving a 52.6% turn-out.

There were 170 spoiled votes (a debate needs to be had in how we educate our young people on voting as there were a huge number of spoiled votes in all areas but that’s for another time). That left a valid pole of 12,999 giving a quota of 1625.

Now if you are involved with a candidate the two most important counts are the tally and the first count. Most will know their fate from the tallies where their supporters count the votes as they are taken from the ballot boxes and spread out. The tallies are usually a very accurate prediction of the first count.

The Winners: In Tralee Norma Foley topped the poll with 2,106 first preference votes and elected on the first count. Toireasa Ferris was just short on 1539 followed by Terry O’Brien (1462), Jim Finucane (1202), Mikey Sheehy (1180), Pa Daly (1123) and Sam Locke on 810.

As you will see these were the 7 elected even if Sam Locke had to wait until the 13th count. Probably the most impressive performance was that of Sheehy who has

certainly put himself on the FF radar as one to watch.

Losing Out: Probably happy with her poll of 683 will be the Green’s Anne Marie Fuller, as will Aontu’s Mary Fitzgibbon who polled 318 on her and her parties first time out.

Sinn Fein will be wondering if vote management was better managed could they have won a third seat. Cathal Foley got 653 but the party are not transfer friendly.

Fine Gaels nationally did not have a good day and with Bridget O’Brien getting 612 and with Jim Finucane not having any big surplus two seats were never on the cards. Labour’s Ben Slimm seemed to be attracting attention in the debates but it didn’t work out with the party losing Graham Spring’s seat. Johnny Wall has given a lifetime of working for the town but his 412 never had him in with a shout while Ted Cronin, Ber Fahy, Yvonne Dineen and Denis O’Reilly will only know themselves if they got the votes they expected.

Retired greyhound Frida and her owner Theresa Holohan were delighted to welcome the Kerry ladies and clubs from all over the county to the Kingdom Greyhound Stadium last Saturday night for the Kerry LGFA fundraising night.

A man walks into a bar and orders six whiskies. He lines them up in a row and knocks back the first, third, and fifth glasses. Then he gets up to leave. “ Don’t you want the others?” asks the barman.”You’ve only had three of your whiskies.” “Best not” replies the man, “My doctor said it was only okay to have the odd drink.”

A GUY TOOK HIS BLONDE GIRLFRIEND TO HER FIRST FOOTBALL GAME...

After the game, he asked her if she liked it. She replied, “it was fun but I don’t see why they made such a big fuss over 25 cents.”

The guy asked, “What do you mean?”

And she said, “Well, at the beginning of the game, they flipped a coin and someone took it, and for the rest of the game, they kept shouting ‘Get the quarter back! Get the quarter back!’”

DONALD TRUMP IS BOARDING AIR FORCE ONE

When all of a sudden, an assassin jumps out and points the gun at Trump. A member of the secret service sees this and yells, “Mickey Mouse!” This startles the would-be assassin so much that it gives the other agents time to apprehend him. While the agents interrogate the assassin, Donald Trump pulls the agent aside and says, “ Why did you yell Mickey Mouse when you saw the assassin?” The agent says, “Well, I got nervous and meant to say Donald Duck.”

A MAGICIAN WAS WORKING ON A CRUISE SHIP IN THE CARIBBEAN. THE AUDIENCE WOULD BE DIFFERENT EACH WEEK, SO THE MAGICIAN ALLOWED HIMSELF TO DO THE SAME TRICKS OVER AND OVER AGAIN.

There was only one problem, the captain’s parrot saw the shows every week and began to understand what the magician did in every trick. Once he understood that, he started shouting in the middle of the show:

“Look, it’s not the same hat!”

“Look, he’s hiding the flowers under the table!”

“Hey, why are all the cards the Ace of Spades ?”

The magician was furious but couldn’t do anything; it was the captain’s parrot, after all.

One day the ship had an accident and sunk. The magician found himself on a piece of wood in the middle of the ocean, and of course the parrot was by his side. They stared at each other with hate, but did not utter a word. This went on for several days.

After a week the parrot finally said: “Okay, I give up. What’d you do with the boat?”

I STARTED DATING THIS BLONDE CHICK LAST NIGHT.

“Do you have any kids?” she asked.

“Yes,” I replied.

“I have one child that’s just under two.”

She said, “I might be blonde, but I know how many one is.”

University Hospital Kerry Opens New Pigmented Lesion Clinic

University Hospital Kerry, in conjunction with the South/ South West Hospital Group and the National Cancer Control Programme, are delighted to announce the official opening of a new Pigmented Lesion Clinic, by Minister of State for Tourism & Sport, Brendan Griffin T.D.

The Pigmented Lesion Clinic in Kerry will take place on alternate weeks and all patients in the clinic will be seen by a consultant dermatologist and, if required, same day excision service will be offered. The annual incidence of melanoma in Ireland has reached 1,000 per annum. The south coast of the country has the highest incidence of melanoma, which can be fatal but when caught early most patients are cured. Therefore skin cancer awareness and rapid access to diagnosis and treatment is vital to improve patient outcomes.

Research from Irish and International studies has shown that consultant dermatologist delivered Pigmented Lesion Clinics can improve outcomes. The new Pigmented Lesion Clinic at UHK will accept referrals from General Practitioners for patients with suspicious pigmented lesions and a consultant dermatologist will deliver a rapid access clinic for the early detection of melanoma at the hospital.

Fearghal Grimes, General Manager of University Hospital Kerry said: “University Hospital Kerry is delighted to announce the opening of the new Pigmented Lesion Clinic. The clinic will provide patients in Kerry with direct access to a vital service. Skin cancer is the most common cancer, therefore early detection and treatment is a vital element in

improving patient outcomes. To mark the opening, the hospital held a free skin cancer screening on Saturday 18th May.”

The first Pigmented Lesion Clinic in Ireland was established in South Infirmary Victoria University Hospital (SIVUH), Cork in 2003 and is now the largest centre for the diagnosis and treatment

of melanoma in the country. The regional service for the Cork/Kerry area was previously provided in SIVUH and in order to reduce lengthy journey times for patients in Kerry and to achieve greater access for patients, consultant dermatologists from SIVUH launched the outreach Pigmented Lesion Clinic in University Hospital Kerry.

Anam Cara Kerry Parent Evening

Anam Cara Kerry, the organisation that supports bereaved parents, is holding its monthly parent evening on Tuesday 11th June at 7:20pm in the Recovery Haven, 5 Haig’s Terrace, Killierisk, Tralee, Co. Kerry. This free event is open to all bereaved parents providing a safe and comfortable space for them to access information and meet with other parents who have also experienced the death of their son or daughter. With Father’s Day approaching at the end of the month it is often a particularly hard time, as is any milestone for bereaved parents. It is vital that the services and support of Anam Cara are available. During the Anam Cara Parent evening mothers and fathers can avail of the support and comfort from other bereaved parents who understand the intense grief, pain and devastation after the death of a precious child. Bereaved parents can also visit our website www.anamcara.ie, where in their own time they can watch our short videos with testimonies from bereaved parents and couples who have attended Anam Cara events. The videos, which are just four minutes each, show parents interviewed on topics like A Dad’s Grief, Sudden and Traumatic Death, and The Grieving Family. Anam Cara director Valerie O Riordan stressed that this parent evening is open to all bereaved parents “regardless of the age your child died, the circumstances of their death or whether the death was recent or not. Anam Cara gives bereaved mothers and fathers a chance to meet and connect with other bereaved parents in a safe and comfortable setting. Here we can find a level of support and understanding that – even with the best will in the world – it can be difficult for family and friends to offer.” A parent who attends the Kerry group commented “ The feeling of not being alone is so wonderful, even on a bad day I know I will at least leave the meeting feeling somewhat better”

Please note Anam Cara will take a break in July and August. Events will resume in September.

KNOW YOUR RIGHTS: EARLY CHILDHOOD CARE AND EDUCATION SCHEME JUNE 2019

Question

How do I access the Early Childhood Care and Education Scheme for my 2 year-old child?

Answer

The Early Childhood Care and Education (ECCE) Scheme provides free early childhood care and education for children of pre-school age. It gives children their first formal experience of early learning before starting primary school.

Your child can start ECCE when they are 2 years and 8 months of age and continue until they transfer to primary school (once they are not older than 5 years and 6 months at the end of the pre-school year). The Department of Children and Youth Affairs’ eligibility calendar shows when your child can participate in the ECCE Scheme.

If your child has special needs they may be able to get an exemption from the upper age limit. If you have a child with a disability, you can also apply for additional supports under the Access and Inclusion Model (AIM)you can find more information on aim.gov.ie.

Children can only enrol in pre-school in September. The ECCE Scheme runs from September to June for 3 hours a day, 5 days a week. If your child attends a childcare service (crèche, playschool, naíonra, Montessori or parent and toddler group) for longer than this each day or for extra weeks outside the school year (38 weeks) you have to pay for these extra hours.

To get a place for your child, apply to a participating playschool or day care centre. You can get a list of participating services from your local City or County Childcare Committee (CCC) on myccc.ie. You will need to provide a copy of your child’s birth certificate or passport and their PPS number.

TORQUING CARS!

MOTORING SNIPPETS

Just days after images of the new Corsa (pictured) were leaked, Opel released official details - majoring on the car’s electric version. Due here early next year, it will develop 136bhp and have a claimed range of 330km.

This sixth-generation Corsa marks the brand’s first time to produce a battery-electric car. Order books for the Corsa-e will open in a few weeks - it will be followed by diesel and petrol versions.

The 50kWh battery can be fast-charged to 80pc in 30 minutes, they say. You can charge via cable, wall box or high-speed charging. There is an eight-year warranty on the battery.

Hard to believe Dacia will be soon be seven years on the market here. They’ve sold more than 21,000 models in that time.

Now, they are marking the milestone with special editions, called TechRoad, of the Sandero Stepway large supermini, Logan estate and Duster SUV for 192-registration.

The TechRoad editions cost from €16,440. Dacia is also bringing in a new TCe 130 petrol engine for the Duster. That will make it the most powerful version of the popular family crossover to date. It will cost from €23,040.

The new Focus ST estate will arrive in September. It will have a 2.3-litre 280 PS EcoBoost petrol engine, with six-speed manual or seven-speed auto transmissions. There will also be a two-litre 190 PS diesel with a six-speed manual box.

Best wishes to Gabriel Keane, managing director and owner of Kia Liffey Valley, who was elected president of the Society of the Irish Motor Industry (SIMI), at the organisation’s recent AGM.

Good to see mobility solutions specialist easytrip has renewed its support of not-for-profit charity Blood Bikes to cover their toll charges for the next two years. Blood Bikes provide urgent transportation of donated blood, human tissue, breast milk and other essential medical items to hospitals and medical centres all year round for free.

Land Rover’s Discovery Sport has been updated - and the company says its 4cyl petrol and diesel engines now have mild-hybrid technology. Emissions are from 144g/km. A plug-in hybrid electric (PHEV) model and three-cylinder petrol are due later. There are also major improvements to the cabin; the second row of the 5+2 layout gets 40:20:40 seats. The cars can be ordered from next month - prices will be announced then.

Best wishes to Alan Nolan, who has just retired as director general of the SIMI after many years at the helm. In his own inimitable fashion, he steadfastly expressed and contextualised the views of the industry and the tens of thousands of people who depend on it for a living. I was always impressed by his ability to deal with so many pressures during some extremely difficult times. He has given exceptional service. We wish him the very best in his retirement, but somehow I don’t think we’ve heard the last of him. Indo Motoring

CAR ADVICE WITH HONEST JOHN – YOUR QUESTIONS ANSWERED

I BOUGHT A CAR AT AUCTION BUT HAVE DISCOVERED IT HAS BEEN CLOCKED - WHERE DO I

STAND?

I have won a car at auction. Before making payment to the auction company I checked the car history and found that the car has been clocked. The original mileage from the last NCT shows 135,000 miles but the auction detail mileage was 62000 miles. I called the auction company and they said it is in their T&Cs that mileage is not guaranteed. My question is where do I stand now?

Asked by Umer

H.J.says

At an auction, you buy on the auctioneer’s description, which is recorded. You do not buy on the catalogue description and that is made clear in the terms and conditions. If the auctioneer does not state that the mileage is warranted, you can assume that it isn’t. If the auctioneer stated “62,000 miles warranted”, then you have a case, otherwise, you don’t.

I HAVE RECEIVED £8500 FINES FOR DRIVING IN A CONGESTION ZONE IN ITALY - WHAT DO I DO?

I have received a bunch of fines for driving in a ZTL (congestion zone) in Italy. I am aware that by law Italy can take a year to deliver the fines. Will they sell my debt to an international recovery agency so as to take me to court in England and affect my credit rating or not? The fines amount to £8500. I didn’t realise I was in a restricted area 44 times.

Asked by Peter

H.J. says

I’d check with the Italian Consulate that the fines are genuine, but I think they probably are. But if you committed the offences, you are liable, you were traced back via the DVLA through the reciprocal agreement and if you don’t pay the penalties could be enforced via a UK court.
