LEGISLATIVE & REGULATORY UPDATES: H-2B Rule Announced for the Additional FY 2021 Visas The Biden administration has published the final rule for the additional 22,000 H-2B visas approved for this year. Employers should be aware of several new stipulations which apply to these visas. Included in the rule is: · The requirement that 6,000 of the 22,000 must be from the counties of El Salvador, Guatemala, and Honduras. · The employer must make a new recruitment effort and sign an attestation form of irreparable harm to their business cannot these visas.LOCATIONS TAKING PART IN THE 2021 LAWN & GARDEN TAX BELOW ifISthey A LIST OF secure PARTICIPATING

· New flexibility allowed to H-2B workers to leave an abusive employer in search of another H-2B employer. Employers should be aware of this new “portability” function to ensure they are aware of the changes to the visa program. Employers should also be aware industry has been informed that the Dept. of Labor will be conducting more robust audits of employers in the program following these additional visas. You can find more information from the DOL website and the release by clicking here. Join the Texas Delegation on the Washington D.C. Virtual Fly-in Each year TNLA sends a state delegation to participate in an Washington D.C. Fly-In in coordination with the National Association of Landscape Professionals. This year, NALP’s fly-in will be conducted in a totally virtual format, starting on Monday, June 14th. You do not have to be a NALP member to participate in the fly-in and meet with congressional members. However, you must create a simple account and register on the NALP webpage below. I would encourage all TNLA landscape and supplier members to register for the event to make sure we touch on as much of the Texas congressional delegation as possible. The topics will be two-fold: H-2B cap relief and climate change policy impacts to our industry. Please register by clicking here. TNLA Finishing Out a Dynamic Legislative Session The Texas Nursery and Landscape Association team has had tremendous success this legislative session. Two of our major priorities were some of the first bills signed into law by Governor Abbott. In the last week, we have drawn even closer to getting our last remaining priority bills over the line and headed to the Governor’s desk. We greatly appreciate all the TNLA members who responded to the Legislative Action Center alerts. TNLA looks forward to discussing the accomplishments on behalf of the green industry in the coming months.

TNLA Tailgate Topics: TRUCK AND TRAILER MAINTENANCE CHECKLIST Objective: Participants will be able to correctly maintain truck and/or trailer prior to use through use of the following checklist. APPLICATION: Using a truck and trailer have participants practice completing the following checklist. The checklist should be completed prior to an individual ever starting the vehicle. Regardless of how skilled you may be with an automobile, you must acquire new skills when driving a truck and hauling a trailer. The movements of the trailer depend almost entirely on the driver. When driving on highways, you are responsible for not only your life but also the lives of other motorists. Equipment maintenance directly influences your ability to safely operate a truck and trailer.
TRUCK CHECKLIST: General: Have a current driver’s license Air filter (Change with each oil change) Check tire air pressure (including spare tire) and adjust if necessary Clean windows and mirrors Before starting engine check adjustment of outside and rearview mirrors and readjust if necessary Headlights High beam Low beam Turn signals
Taillights Both taillights work Both stoplights work Turn signal lights Fluid Levels Coolant (Service radiator annually, or as instructed) Windshield washer Engine oil (Change oil and filter every 3,000 to 4,500 miles, or as instructed) Automatic transmission level (Change transmission fluid and filter every 15,000 to 20,000 miles, or as instructed) Brake fluid level
TRAILER CHECKLIST: Check tire air pressure (including spare tire) and adjust if necessary Check wheels by grabbing tires at top and shaking vigorously Check lug nuts for proper torque Check wheel bearings Check wiring plug to ensure same as truck; if different an adapter must be used Grease equalizer monthly (if trailer is used daily) TRAILER TO TRUCK CHECKLIST: Back truck into position to connect to trailer Lower trailer tongue onto ball and secure with holding pin Check trailer hitch Check bumper or receiver hitch for tightness Check ball for tightness and correct size
