L E T T E R S Response to Walter Lamb’s letter Editor: Regarding Mr. Walter Lamb’s responses to my letter in the 10/7/21 Argonaut, here are my rebuttals, respectfully: 1. In my letter I never named Mr. Lamb’s organization, the Ballona Wetlands Land Trust, nor stated they are guilty of fiscal malfeasance (his words, not mine). Perhaps Mr. Lamb and his litigating allies would care to report to Argonaut readers the general amounts and categories of income for their organizations in year 2020, as well as the general categories of expenditures in that same year (overhead, labor, contract, and legal). What percentage of their income in any year was spent procuring expert scientific testimony and what “educational programs” of theirs do public schools partner with? Why is Mr. Lamb’s organization “Not Rated” by CharityNavigator. org, while Friends of Ballona Wetlands rates 100 out of 100? 2. Mr. Lamb asserts his organization has “successfully” sued developers of various nasty projects with positive results, but I beg to differ. His organization

sued to stop Playa Vista, but whatever one thinks of it, PV was built. His organization joined litigation to stop the Ballona Freshwater Marsh at the Lincoln/ Jefferson intersection, but it, too, was built and remains one of the premier birdwatching locations in Los Angeles. He spoke against and his allies sued to stop the state’s Malibu Lagoon Restoration, which also proceeded and has proven wildly successful in both ecological and public access terms. Mr. Lamb asserts his Ballona litigation will improve the state’s Ballona EIR and project, but he and his allies have clearly stated opposition to the state’s preferred plan, instead advocating a plan rejected by the EIR analyses as neither meeting state restoration goals nor consistent with state law. Donors who believe these advocacy groups will in fact “stop” whatever horrible project they oppose ought to check their performance history per the documented outcome and decide what they consider “success.” Perhaps delays and cost escalation is a valid measure of success for some. 3. Mr. Lamb and his allies

continue to make false and alarming statements about the state’s Ballona restoration project and represent them as facts. Now that his organization has sued our state, fact vs. fiction will not be decided by he, I or any other gadfly. Superior Court and likely Appeals Court judges will decide what is true and what is fallacy, hopefully beginning in mid-2022. 4. Whatever the Gas Company’s motivation for relocating their wells, Mr. Lamb’s “Defend Ballona” allies were visible to all on multiple days along Culver Boulevard earlier this year, protesting with signs that falsely linked the utility’s work to the state’s wetland restoration project. He cannot dispute that the restoration EIR calls for those wells to be properly abandoned. Relocation of wells or closure of the storage facility is under the purview of other state agencies that have nothing to do with the Fish and Wildlife Department’s restoration plans. 5. Mr. Lamb continues to flatter me by proposing he and I debate publicly about the state’s extraordinary restoration plan for Ballona. As I have previously stated in Argonaut and elsewhere

many times, I can think of nothing more boring to the general public than such a debate. An event like that would only pointlessly draw in our own respective choruses to hear our preachings. Again, deciding who speaks the truth must now be left to the courts, thanks to Mr. Lamb and his allies’ lawsuits. The General Public, I believe, is not interested in hearing Mr. Lamb and I debate scientific minutiae, such as how the Belding’s Savannah Sparrow will adapt to new habitat created at Ballona, nor how high marsh habitat at Ballona will gradually evolve into low marsh over a century of inevitable sea level rise. I believe the 85,000 people who commute through Ballona every work day, and many more who do not but live nearby, have very different priorities. Among them, the ability to pack the family in the car or on bikes on a Sunday morning and visit a lushly vegetated, ecologically vibrant public open space nearby - a place where they can walk, paint, birdwatch or just get fresh air and see natural vistas. That is the vision of the state’s Ballona

restoration plan. Stopping that vision is the foundation of the opponents’ fundraising efforts. Dr. David W. Kay Playa Vista Mayoral candidates Editor: There is an obvious “disconnect” between this new crop of mayoral candidates looking to succeed the failed administration of lame duck Mayor Eric Garcetti, now seeking political refuge in India while Congresswoman Karen Bass becomes the latest entrant into a race that identifies the central issue of housing and homelessness, but doesn’t have a clue on how to address it! The Bass announcement was long on flowery rhetoric, but lacked any sense of gravity to the housing and homeless condition that has paralyzed Los Angeles and in particular Venice for some time. An ally of Garcetti and the embedded status quo, how does a Bass Administration change anything when she has been nothing but a silent supporter of the disastrous era of Eric? ArgonautNews.com Bonin as a supporter, can she be depended upon to hear the cries and concerns of Venice when our council representative has no standing or support with the residents of Dog Town he pretends to represent? Last week we saw the 20-count federal indictment of Councilman Mark Ridley-Thomas on bribery charges having to do with his time as a LA county supervisor, USC and his disgraced son, who was forced from the legislature and then seeking employment and scholarship in exchange for millions in discretionary county funding his father controlled in this attempted quid pro quo? And like Mike Bonin, Mark Ridley-Thomas is yet another self-anointed homeless advocate who like Mike has no real accomplishment or solution for this tragic human condition that has gotten worse under the leadership of both Mike and Mark! Candidate Bass apparently has disowned the Ridley-Thomas endorsement; will she do the same regarding Mike Bonin? Venice needs to know. And if she won’t reject his help which seems to be the case, is the Bass candidacy for mayor just more of the stale and tired rerun

we have had under both Eric Garcetti and his predecessor Antonio Villaraigosa? For when was the last time Karen Bass has been to Venice, and will she be escorted by Bonin should she decide to see for herself the state of affairs here at the beach directed and produced by Mike himself? For this former LA and Sacramento insider, who is now a DC insider that was passed over for a Biden cabinet position is coming home to LA under the premise we need a female mayor more than the notion of a mayor that has a plan to turn LA around? For the other mayoral aspirants seem equally dismal and disappointing as hopefuls Kevin de Leon, Mike Feuer and even Joe Buscaino appear lost and confused when it comes to clearly articulating what they will do and how they will do it when it comes to the issue of housing and homelessness. And as this garden party of political candidates talk past each other and offer Venetians little to nothing on how to end this encampment debacle that continues to plague our community, is it any wonder that locals are signing and supporting this

Bonin recall effort because no one is really listening as this mayoral “mosh pit” is nothing but more of the same with a wink of the eye and silent support for another term of office for Mike Bonin? Is nearly nine awful years of Mike Bonin representing Venice proof enough it’s time for him to go? For isn’t it really time to retire our $300,000 a year councilman, the highest paid in the entire country? And even more tragic is the notion Venice can somehow “lawyer” its way out of terrible and defective public policy? For all the lawsuits in the world and thinking that writing checks to underwrite continued litigation somehow works, look around Venice. For the problem is not “legal,” but “political” and the way you fix your political problem is by picking up a clipboard and ensuring the recall signature drive is successful! That is the way you dispose of Mike Bonin as councilman. It is the only sure-fire solution you control as a resident and the one guaranteed way to replace Mike Bonin as he continues to play “chess” while many

more homeless than anywhere else in Los Angeles with the exception of Skid Row, what will be the fate of this community under Karen Bass? Tragically, failed Councilman Michael Bonin, in the throw of yet another recall attempt tries to rehabilitate what’s left of his political career with “I like Mike” placards has endorsed Bass, making it almost impossible for any rational and reasonable Venetian to consider her candidacy moving forward. Why would Venice support Congresswoman Bass if she thinks Mike Bonin is not part of the problem, but part of the solution when it comes to rampant homelessness, rising crime and the squandering of precious public dollars when it comes to the construction of permanent housing? Does Bass support Bonin’s “containment” policies that have turned Venice into this homeless ghetto and slum by the sea? For what is LA’s most undervalued asset that is Venice, is Karen Bass open to the suggestions and advice of a Mike Bonin, and if so why would anyone take her candidacy seriously? For if Karen Bass views Mike

Venice Beach after the first storm of the year. Venetians would rather play “checkers.” Nick Antonicello Venice Beach

Ocean Rescue

Marina del Rey resident saves woman lost at sea By Haley Beyer t wasn’t long after Marina del Rey resident Koz Khosravani had purchased a sailboat, taken American Sailing Association courses, and earned his California boater’s license that he ended up saving the life of a young woman who was alone in the middle of the ocean. On September 26 around 11:30 a.m., Khosravani had sailed outside of the Marina del Rey harbor for the first time. He had brought along a friend and two neighbors to act as his crew, and spent roughly an hour training them on safety procedures before setting sail. Khosravani had also purchased safety gear on Amazon to prepare for his first trip out of the harbor and the night before he made sure the boat’s VHF radio was fully charged and that he knew how to use it. “I am not religious nor that spiritual, but one must wonder about this universe,” Khosravani said.

While sailing to Malibu recently, Marina del Rey resident Koz Khosravani and three friends saved the life of a young woman who had been lost in the ocean for 12 hours.

When Khosravani and his crew headed to Paradise Cove in Malibu that morning, a pod of dolphins crossed in front of the boat and swam in a way that almost suggested they should follow them. It wasn’t long after that Khosravani spotted a young woman in the water waving her hand to them. He couldn’t believe someone was out in the open water more than two miles from the shore. The woman was exhausted and nude, wasn’t wearing a lifejacket and didn’t have anything to keep her afloat. When Khosravani got the boat up close, he knew they needed to act immediately. One of the guests threw a lifesaver to the woman while Khosravani got the boat in the right position so that she wouldn’t get run over. Another guest threw a 70-foot orange rope so the woman could grab it while they slowly pulled her toward the boat. When she was close enough, the ladder was released in the back of the boat

ArgonautNews.com and the engine was turned off. Khosravani and the other male on board used all their strength to pull the woman on board, as she had no muscle capability left. The two women on board ran downstairs to get dry towels, water and a thick blanket. Khosravani also looked out in the surrounding waters to make sure there weren’t others in need of rescuing. “I was grateful to have women on board to help the survivor,” Khosravani said. “I would have obviously still helped the woman regardless of her lack of clothes, but I think it made everyone, especially the survivor, more comfortable to have the women on there to help her,” Once the woman was safe and dry, Khosravani issued a “Mayday” transmission to the U.S. Coast Guard on the VHF radio and it took less than 10 minutes for the LA County Rescue Boat Captain Matt Rhodes and his partner to show up. The woman was taken back to shore and immediately transported to Ronald Reagan UCLA Medical Center. The rescue boat then radioed Khosravani and asked him to meet at the Marina for a small investigation, where they asked him a few questions about the rescue.

Khosravani was relieved and grateful that the safety courses he had taken paid off on his first trip out of the harbor, and the safety equipment he had purchased on Amazon helped him save a woman’s life. “In my training by the former Navy Seals at SEALfit of Encinitas and the Wakeup Warriors of Laguna Beach, I learned the most important qualities to have are mental toughness, clarity and focus,” Khosravani said. “I think my crew and I, and the survivor, all expressed exactly those in this situation. I am so grateful I didn’t freeze under the pressure of a stressful situation and god bless the guests I had with me for keeping calm and following my instructions to get the woman out of the water the safe way.” After further investigation, it appeared the woman had been treading water for 12 hours in the dark after going skinny dipping alone around midnight. Luckily for her, late September reportedly has the highest water temperature for the entire year, and she survived. Khosravani and his guests are still processing the traumatic

event. “It is incredible that I saved someone’s life, I still can’t believe it,” Khosravani said. “There are sailors with decades or over half a century of sailing experience who have never been in this situation, but I have lost some sleep from having some nightmares about the woman. They are all of me worrying about what she must be going through trying to recover and what she went through before we came.” Khosravani hopes that sharing his personal experience will make people more aware of what can happen and he reminds people to always be responsible and prepared. “There is a reason safety courses and equipment exist,” Khosravani said. “These things were one of my best investments. Please take advantage of that and take safety seriously. I want people to understand the power of the ocean. They underestimate its strength. It needs to be appreciated and though this wasn’t a problem in this situation, this is why I always say it’s best not to drink a lot, if at all on any boat, especially as the person in charge. Anything can happen at any time and you always want to be ready.”

Khosravani credits the safety courses he took along with the equipment he purchased as instrumental in his successful rescue.

Rides for Rams Fans

Rally offers affordable bus rideshare to SoFi Stadium By Kamala Kirk ally, a recommended transportation partner for the Los Angeles Rams, is providing crowdsourced fan shuttles to the team’s remaining five home games at SoFi Stadium from Santa Monica, downtown LA and Pico Rivera. In Santa Monica, the route begins at 302 Colorado Avenue (Santa Monica Shopping Center). Rally partners with local bus companies in LA, Santa Monica and Pico Rivera to provide the vehicles for its routes. To book their trips to SoFi Stadium, Rams fans can select their game of interest on the Rally website or app, then reserve their spot on the ride. Riders can also add new crowdfunded Rally Point pickup/ drop-off locations to a route, which will be confirmed based on rider demand. Perks for fan riders offered by Rally include: food and beverages are allowed onboard; tailgating gear can be stored under the bus during the game while riders are in the stadium; buses are equipped with Wi-Fi and charging ports, an A/V system, a restroom, plush bucket

seats and overhead bins; bus arrival time at the stadium is three hours before kickoff; buses will park in a special Rally area in the stadium’s on-site parking throughout the game; and Rally’s buses are cleaned according to CDC and local government guidelines. “Rally is the most convenient way for Rams fans to get to SoFi Stadium,” said Numaan Akram, founder/CEO at Rally. “The reason we go to a game is to be with other fans, and Rally enhances this sense of community by extending the gameday experience with our flexible routes and comfortable buses. Also, each full Rally bus means that as many as 40 fewer cars will clog the highways. Santa Monica Brew Works announces return of special release ale By Kamala Kirk anta Monica Brew Works (SMBW) has announced the return of Next Day IPA, a special release India Pale Ale that features whole cone Mosaic hops from the Yakima Valley. Most beers are brewed exclusively with pelletized hops, which are produced by grinding up dried hop cones and pressing them into condensed pallets. However, on rare occasions brewers have access to wet, whole cone hops, which retains the delicate oils and aromas of the flower in its purest, unprocessed form. “Next Day IPA is such a special beer because it captures the essence of Mosaic right off the wine,” said Avery Colomb, SMBW head brewer. “On top of the tropical sweet fruit that Mosaic pellets are known for, the fresh hops contribute a beautiful herbal earthy note that borders on fresh cut grass and sweet

The expedited delivery inspired the name for Next Day IPA, which clocks in at 8.1% ABV. “We look forward to the return of Next Day IPA every fall,” said Scott Francis, SMBW’s cofounder, president and CEO. “It’s one of our most anticipated releases of the year.” Next Day IPA is available exclusively in 19.2 oz cans to-go from SMBW’s tasting room on Colorado Avenue in Santa Monica. Culinary Celebration

Westside Food, Wine & Spirits Festival returns PHOTO S COURTESY OF WESTSIDE FOOD, WINE & SPIRITS FESTIVAL

The Westside Food, Wine & Spirits Festival returns Nov. 7 at the Automobile Driving Museum in El Segundo and will feature food, drinks, live music, a silent auction and more. By Bridgette M. Redman festival that started out as part of a celebration of Culver City’s Centennial is back after taking a pandemic break. The Westside Food, Wine & Spirits Festival returns Nov. 7 at the Automobile Driving Museum in El Segundo. It’s a festival filled with plenty to do, as well as great food and drink, according to its founder, Todd Elliot, who said that families are welcome, though those under 21 will have to stay out of the liquor area. There will be live music outside, a cool DJ vibe inside, a magician who made it to the finals of “America’s Got Talent” wandering the grounds, a complimentary photo booth,

A

caricature drawings and a silent auction. “It’s an awesome museum and venue that is both indoors and outdoors,” Elliot said. The museum is a new venue for them and Elliot said that people will not only get to see the many classic cars, but they’ll be able to take rides in them for an additional donation. “It’s just an awesome museum,” Elliot said. “Most people know about the Petersen, but not this one. It’s like a hidden treasure. They have a big car museum room and it is just incredible. You could spend a couple hours just there.” The sixth edition of the festival showcases culinary treats from throughout Southern California. There will be restaurants,

PAGE 10 THE ARGONAUT NOVEMBER 4, 2021

caterers, food trucks and wine, craft spirits, beers and nonalcoholic drink exhibitors. This year’s festival benefits the Westside Food Bank. “I like to have some sort of food-related charity because of the theme,” Elliott said. “I like the people at Westside Food Bank and I like what they do. They donate to the homeless and the hungry. We raise funds for them. They will be on the site to provide education and accept donations.” This year’s food tickets work a little different than in the past when everything was all-inclusive. Restaurants and caterers would have to prepare all-youcan-eat portions for 400 to 500 people and Elliot wanted to help them out this year because of

the challenges food establishments have had during the pandemic. The VIP pass comes with six food tickets. General admission comes with one and food tickets have to be purchased separately. Those with a VIP pass also get to enter earlier, providing them with better access to parking spots and their choice of food. Those with a VIP pass can get in at 12:30 p.m., general admission enters at 1:30 p.m.. Until Nov. 1, general admission tickets are $50 and VIP passes are $80. A packet of 6 food tickets are available for $20. All ticket prices go up by $10 after Nov. 1. Readers of the Argonaut can use the code “argo” for a discount. Elliot said he tries to get a

large variety of food from chicken to pizza to sliders to seafood to ice cream and desert. ON CROWD NINE

I’m a 43-year-old woman in my second marriage with a man who’s also on his second marriage. We are both determined to make this marriage our last! We have a scheduled date night. We make sure sex happens weekly. I’d like to know whether there are other things we can do to keep from walking down the aisle a third time. — Hopeful In some marriages, somebody could lose consciousness and it wouldn’t be all that noticeable. Date nights are good for keeping the marital jets firing, as is having sex weekly, but regular dates and sextivities don’t change how being married is like subscribing to Netflick. No, my copyeditor isn’t day-drinking, and yes, I mean “flick.” Netflick would have only one movie, and you and your partner would be forced to watch it every night of your life together...until one or both of you shrivel up and die of boredom or start dialing jackals with law licenses (aka divorce lawyers). What can help is making your married life more like single people’s lives – uh, in ways that don’t remodel your vows into something more along the lines of suggestions. In a New York Times op-ed, social historian Stephanie Coontz explains, “Single people generally have wider social networks than married couples, who tend to withdraw into their coupledom.” Though marriage “can provide a bounty of emotional, practical and financial support … finding the right mate is no substitute for having friends and other interests.” Disappointingly, Coontz trots out a view widely (and uncritically) accepted among researchers: “On average, married people report higher wellbeing than singles.” And sure, there are studies that conclude this. However, social psychologist Bella DePaulo points out rather glaring flaws in some of the research making this claim. For example, she observes that even respected developmental psychologist E. Mavis Hetherington couldn’t see her faulty reasoning in concluding: “Happily married couples are healthier, happier, wealthier, and sexier than are singles.” The problem? Hetherington is comparing a subset of married people – HAPPILY MARRIED people (as opposed to ALL married people) – with ALL single people. I put this in perspective in a 2013 column: “Yes, shockingly, happily married people are happier than clinically depressed single people.” In fact, people who are unhappily single – who feel “distress” about being single – tend to be those who’d previously been married (and espe-

cially those newly divorced or widowed), notes Coontz. About the single-’n’-miserableness of the newly divorced or widowed, you might think, “Duh...they’re lonely or grieving!” Some or many might be. But I think Coontz is onto something in advising married people to “cultivate the skills of successful singlehood.” (Conversely, “people who are successful as singles” – meaning socially connected and relatively content with their lives – “are especially likely to end up in happy marriages, in large part because of the personal and social resources they developed before marrying.”) Coontz suggests you bring other people into your marriage – though not like they did in the ‘70s at those suburban parties with all the couples dropping their keys into a bowl. She’s talking about friendships with people beyond your spouse, and ideally, not just one or two others but a whole group. Research (by evolutionary social psychologist Stephanie Brown, among others) consistently finds being socially connected increases individuals’ personal well-being and is even associated with better physical health. Likewise, “maintaining social networks … after marriage” can also “enhance and even revitalize your marriage,” writes Coontz. As for how you two could put this into practice, you might start by making some date nights double-date nights. This might seem like a bad idea – a date-night romance- and intimacykiller. However, Coontz describes a date-night experiment in which researchers “assigned some couples to spend time by themselves and have deeply personal conversations,” while others were set up with a couple they’d never met “and told to initiate similar conversations.” Afterward, all of the couples “reported greater satisfaction with their relationship,” but only those who’d been on the double date reported feeling more “romantic passion” for each other! Because it seems “the more” really is the (maritally) merrier, you and your husband could also host regular dinner parties, cocktail hours, brunches, and/ or game nights. However, it’s also important that you each maintain individual interests, activities, and friendships. Ironically, regularly spending less time together – as well as following wise advice from Coontz to each maintain your ability to be self-reliant – should help you avoid going your separate ways. It’s great if your relationship starts to remind you of an iconic one in a classic movie – but not if the movie is “Cast Away,” starring Tom Hanks and a volleyball he draws a face on so he won’t be all alone on a desert island.”

By Jordan Houston latinum-selling artist, producer, songwriter and DJ Dillon Francis has made waves since dropping out of Santa Monica College – including the recent release of his jovial happy-house third studio album. In celebration of his 34th birthday, the Los Angelesbased musician recently launched “Happy Machine,” an infectious and bubbly house album boasting a grip of new material. The eight-track piece features previously released songs “Unconditional,” with 220 KID and Bryn Christopher, “Love Me Better,” which recently reached No. 1 on Billboard’s Dance/Mix Show Airplay Chart with Shift K3Y and Marc E. Bassy, and “Reaching Out,” featuring Bow Anderson. “Happy Machine” seeks to celebrate life, family and friends, while signifying the joyous journey in returning to a post-pandemic era, Francis shared. “I feel like the reason I named it is so self-explanatory,” Francis said. “I feel like you would have an inkling that it must be a very happy album to listen to – so, be prepared for hooking yourself up with a serotonin IV drip while listening to this.” The Mad Decent-released album, which exudes optimism and bright beats, is also the 34-year-old’s most collaborative work of art. It highlights contributions from globally recognized songwriters who have worked with the likes of Selena Gomez and Shawn Mendes, including Jenna Andrews, MNEK, Teddy Geiger and Sarah Aarons. Despite its title, Francis said he was the opposite of “happy” when he created the album during the height of the COVID-19 pandemic. “I was really going through it, I had been Pelotoning a lot and my favorite instructors happened to all be from the UK,” he explained, noting his favorite instructor frequently played “euphoric” piano house music. “I started listening to a lot more music in that genre and it was making me so happy, especially for what we were all going through,” he continued. “Though that, I kept diving into piano house and said, ‘You

This is what I want to make right now.” Since 2011, Francis has built a reputation for himself as a champion of the moombahton electronic genre, as well as embracing trap and dance-pop. With numerous chart-hitting records and Grammy nominations under his belt, Francis’ resume includes the No. 1 Dance Radio Airplay hit “Anywhere” (feat. Will Heard), “Candy” (feat. Snappy Jit), No. 1 Billboard Dance Club Songs chart topper “Coming Over” with Kygo (feat. James Hersey), and the RIAA platinum certified “Get Low” with DJ Snake, which surpassed 500 million worldwide streams. In 2012, Francis made history as “the first moombahton artist to achieve the No. 1 spot on Beatport” on the Something, Something Awesome EP, according to Insomniac. His 2014 major label debut “Money Sucks, Friends Rule” graced

Rolling Stone’s Top Electronic Albums of 2014 list, while its 2015 follow up “This Mixtape Is Fire” EP bowed at No. 1 on Billboard’s Top Dance/ Electronic Albums Chart. In 2018, Francis earned back-toback Latin American Music Award and Latin Grammy nominations for the song “Sexo,” featuring Residente and iLe. But the path to success wasn’t always a straight arrow for the exuberant entertainer, he shares. Born in 1987, Francis grew up LA as the son of an alternative medicine doctor. However, he was a fan of mix of punk and electronic music by the time he reached high school. Francis later briefly attended Santa Monica College, in which he also started experimenting with music production. It wasn’t long before he took the plunge to drop out of college pursue his dreams of

making music full time. Francis recently announced his upcoming Sugar, Spice and Everything Ice U.S. tour with co-headliner Yung Gravy for 2022, featuring stops in New York, Washington, D.C., Austin, Nashville and other locations nationwide. The platinum-selling artist said he is looking forward to performing for live audiences again, emphasizing the value of interacting with fans. “It’s really awesome to finally see people ingesting the song,” he shared, recalling a recent performance of “Real Love” in Tampa. “It was already so cool to see people singing it in the crowd. That is such a satisfying feeling because I’ve played them without anybody listening to the songs – I can see the reaction now.” For more information about Francis, his music and upcoming tour dates, visit his website at dillonfrancis.com.

Wings for Riley

Art installation raises awareness of suicide prevention By Bridgette M. Redman ridget McCarthy is convinced that if she knew then what she knows now, she would have been able to prevent her son Riley from dying of suicide 13 days after his 16th birthday. It’s why she is now dedicated to making sure that other parents have the information that she once needed, whether through organizing fundraising walks or helping to paint the background of the enormous wings that her neighbor put up on her fence to honor Riley and raise awareness of his loss. McCarthy said that Riley had been suffering from depression and issues that had to do with gender dysphoria — he was a transgendered youth. He’d been speaking to a therapist and multiple doctors. “No one had said, ‘You need to be aware of these things,’” McCarthy said, adding that while she knows there is a privacy act, there were still some things she needed to know. “I was the kind of mom that if they had said, ‘Do this because your kid is at risk,’ I would have done that. I would have judged those final moments differently with a different awareness. Within that moment, with the knowledge I have now, it would have been a different result.” That has become her mission, because while she said therapists are legally bound to behave in a certain way, she is not. After spending 90 minutes online, she was in tears because what she needed to do was so simple and she could have had the information. She now wants to make sure that those parents who are open and willing have the information and awareness that she did not. On October 23, McCarthy organized a walk called “Out of the Darkness Greater Los Angeles Santa Monica Walk” along 3rd Street Promenade to raise money for suicide awareness. She’s been helped along by her neighbor, Susan Klos, and local artist, Lalo Marquez. During Pride month, Marquez made rainbow wings for an installation. After the event, he put them up on the Facebook page, “Buy Nothing Mar Vista.” “That’s where I came across his ‘give’ and adopted his wings for my front fence,” Klos said. Klos met McCarthy when she

She signed up for the team and the two became friends. After Klos and Marquez posted the wings on her fence, Klos thought it would be a fitting tribute to dedicate the wings to Riley as he was transgendered. “Bridget and I painted the background together in NAMI (National Alliance for Mental Illness) green and she added the finishing touches — her dedication to Riley,” Klos said. “Since it’s been up, people have stopped to admire the wings, taken pictures in front of them, and one of Riley’s junior high teachers rang my doorbell to ask about the mural and reminisce about Riley.” McCarthy described Klos as one of the most wonderful, generous and warm people she’s ever met. “She’s continuing to promote Ry’s website and the awareness and everything with me,” McCarthy said. “She has the history in mental health, being involved in NAMI and having a couple kids who struggle with their own issues. The wings came about after Pride. I’d wanted to do something with Pride, but it was difficult with things shut down. The wings are iconic to gay pride. I have a picture of Ry in front of wings at age 12 or 13. Ry loved wings. He had multiple sets for the costuming and

dress-up that he did. It was perfect.” Klos made the wings on her fence an art installation that was a memorial to Riley. People can come there and find the website and put candles, balloons and other things. Many of his friends, McCarthy said, have made pilgrimages to see them. “Susan put those wings on her fence out of her own generosity,” McCarthy said. “It is extraordinary, really.” It is an installation that McCarthy said has continued to spread awareness and gather donations for the American Society for Suicide Prevention. She chose that organization because 87% of the money raised goes directly into programs — such as training new people to answer the hotlines after there was a surge in their use at the end of 2020. “The hotlines went up 800% during COVID,” McCarthy said. “While the numbers are preliminary, it looks like the suicide rate may have gone down a bit or held steady, which may be attributed to the hotlines catching people. With the increase so great in the hotlines there should have been a correlation in attempts and death and there wasn’t. So that money goes directly to a fund that is actually stopping people from dying and keeping the rate from skyrocketing. It is vital to keep doing that.” McCarthy pointed out that it is a new world for parents of this generation in part because of the

Websites exist, she said, that encourage teens to commit suicide —telling them how to do it and how to avoid their parents. There is an effort to get those sites banned. Suicide is the number two cause of death among 14 to 19 year olds. Among young people in the LGBTQ+ community, it is much higher. It’s why McCarthy said it is so important to build connection in the community. “That’s what the wings represent,” McCarthy said. “It’s a physical place people go to and

Susan has a little library.” Meanwhile, she continues to try to get as much awareness as she can to parents who are struggling, to connect them with the assistance that they need so they don’t have to go through what she has. “Your world literally turns upside down,” McCarthy said of losing a child. “That’s the only way to describe it. It’s a daily thing. Things come from nowhere and out of the blue.” rileychart.com

THE ARGONAUT REAL ESTATE Q&A What does a buyer do when their offer is finally accepted? In todays’ real estate market, buyers are used to frustration and disappointment. Especially properties considered “entry level” that are in such demand, buyers are doing just about anything to get to the final round. This can be a stressful and fast paced period, where offers and counteroffers are exchanged, and the buyer is trying to anticipate and beat out their competitors. Bidding up the price is the obvious tactic but waiving or shortening contingency periods are also valuable enticements in a multiple offer situation. While a few buyers may be willing and able to throw all caution to the wind and waive contingencies as part of their offer, most buyers can’t take that risk. First, what are contingencies? Contingencies are the “but if” clauses that permit you to cancel your purchase without penalty, as it is contingent or conditional on certain things. Let’s take a look at those contingencies and their significance. • Appraisal contingency- this is a clause allowing the buyer to cancel if the property is appraised at less than the purchase price. In a market where prices are rising quickly, it is not uncommon for the appraised value to not have caught up with value “on the ground”. Even though you may have multiple offers at or above the sales price,

the appraiser is required to have enough comparable sales- already closed- to support the price. Because of this, many sellers are looking for buyers willing to waive this contingency. All cash buyers can easily offer this, but banks make loans based on the appraised price. If you have waived the appraisal contingency and are obtaining a loan, you need to be willing and able to contribute enough cash to make up the difference. • Loan contingency- this is a contract clause allowing the buyer to cancel if they are unable to obtain the financing to close the sale. Generally, the buyer will set forth the terms of the expected loan- for example, 80% of purchase price at no greater than 4% interest rate. If rates suddenly rise and they are unable to obtain that rate, they are permitted to cancel. Even buyers obtaining a loan are sometimes waiving this contingency to compete. Sellers, when considering offers that include loan contingencies, will be evaluating the buyers’ information, such as the size of downpayment and/or additional assets shown, to determine which buyers are most likely to not have difficulty obtaining financing.

PAGE 16 AT HOME – THE ARGONAUT’S REAL ESTATE SECTION NOVEMBER 4, 2021

• Inspections and due diligence contingency, probably the most important of all and the one that buyers should be most discouraged from waiving. This contingency gives the buyer a period of time to conduct their own physical inspection(s) of the property and to review all of the sellers’ disclosures about the property and its condition, any regulations impacting property rights (For properties within Homeowners Associations, this includes CC&Rs, financials, and other relevant information). Although a seller must disclose any known material defects, the buyer is required to rely on their own due diligence. A general physical inspection is usually the first step. You may also conduct more specialized inspections, depending on the property. This contingency is the one that is most likely to disrupt a sale. No property is completely free of issues- they can be very minor or significant. Upon discovery, the buyer may be unwilling to proceed with the purchase- or request that the seller take a lower price or make certain repairs. While it is not advisable to waive this contingency, shortening this contingency period is a common term in this competitive market. It allows for a quick determination of

deal-breaking discoveries- either the parties can move forward with this out of the way or the property can be back on the market without having lost too much time. The ability to offer shorter than typical deadlines for any and all of these can be a great advantage in a competitive offer situation. Ask your lenders if they can help you meet shorter loan, appraisal and even closing timelines. No matter what timeline you do offer, make sure you have enough information to understand and proceed at each stage. When you finally have released all contingencies, any cancellation may cost you your deposit. As long as you have done proper due diligence before releasing them, that’s when you can call the movers!

Plaintiffs incorporate by reference as though fully set forth herein all previous allegations in the Complaint. 20. An employer has the right to the undivided loyalty of its employees. The duty of loyalty is breached and may give rise to a tort cause of action on behalf of the employer when the employee 27 takes action inimical to the employer's best interests. See Stokes v. Dole Nut Co. (1995) 41 Cal.App.4th 28 285; Service Employees International Union, Local 250 v. Colcord (2008) 160 Cal.App.4th 362. 21. As a trusted employee of lmpact, Ralph owed Impact a duty ofloyalty and honesty, and 3 a duty to discharge her responsibilities in good faith, with the care an ordinary prudent person in a like 4 position would exercise, and in a manner she reasonably believed to be in Impact's best interests. 22. As Impact's Creative Director, Ralph had a duty to act with honesty and integrity in her dealings with Impact as well as the customer accounts she managed. 24. As Impact's Creative Director, Ralph had a duty not to act in her own self-interest and 9 not to act to the detriment of Impact. 25. of loyalty to Impact by taking the following actions, all of which caused injury to Impact: ( a) for a period of at least six months before Ralph voluntarily resigned as Impact's Creative Director, Ralph owned and operated her own competing business, Hello Hazie, without Impact's knowledge or consent; (b) by owning and operating Hello Hazie for at least six months while still employed at Impact, Ralph failed to give Impact her undivided loyalty; and (c) upon information and belief, for at least six months, Ralph used Impact's time and resources to conduct business for her own self-interest by owning and operating her own competing business, Hello Hazie. 26. As a direct and proximate result of Ralph's breach of her duty of loyalty, Plaintiffs have been and will continue to be damaged in an amount that is in excess of this Court's minimum jurisdiction, which includes, among other things, actual damages, disgorgement of at least six months of Ralph's annual salary she was paid while employed at Impact (i.e., $65,625), and revenues received 21 by Hello Hazie. 27. At the time Ralph committed the above wrongful conduct in breach of her duty of loyalty, Ralph was guilty of malice, oppression, and a willful and conscious disregard for the rights of Plaintiffs. As a result, Ralph is liable for p un i ti v e d a ma g es in a n amount to be proven at trial. Unless enjoined by the Court, Defendants will continue to engage in the acts, conduct, and omissions set forth above, which have resulted, and will continue to result in irreparable injury to Plaintiffs. own business, Hello Hazie, which directly competed with Impact. 17. Ralph never advised Impact, either during or after her employment at Impact, that she owned and operated a competing business. 18. Ralph never advised Impact, either during or after her employment at Impact, that she owned and operated Hello Hazie. FIRST CAUSE OF ACTION Breach of the Duty of Loyalty (Against Ralph) 19. 22. As Impact's Creative Director, Ralph was in a position of trust. 23. 25. Ralph breached her duty of loyalty to Impact by taking the following actions, all of which caused injury to Impact: ( a) for a period of at least six months before Ralph voluntarily resigned as Impact's Creative Director, Ralph owned and operated her own competing business, Hello Hazie, without Impact's knowledge or consent; (b) by owning and operating Hello Hazie for at least six months while still employed at Impact, Ralph failed to give Impact her undivided loyalty; and (c) upon information and belief, for at least six months, Ralph used Impact's time and resources to conduct business for her own self-interest by owning and operating her own competing business, Hello Hazie. As a result, Ralph is liable for p u ni tiv e da ma g es in a n amount to be proven at trial. SECOND CAUSE OF ACTION Unfair Competition in Violation of California Business & Professions Code§ 17200 et seq. (Against All Defendants) 28. Plaintiffs incorporate by reference as though fully set forth herein all previous allegations in the Complaint.

ness & Professions Code§ 17200 et seq. (Against All Defendants) 28. Plaintiffs incorporate by reference as though fully set forth herein all previous allegations in the Complaint. 29. As alleged herein, Defendants have engaged in conduct that constitutes unlawful, unfair, and fraudulent business practices in violation of California Business & Professions Code § 1 7200 et seq. 30. Defendants have taken the actions alleged herein with the intent to injure Plaintiffs and to gain an unfair competitive advantage in the marketplace. 31. As a direct and proximate result of Defendants' unlawful conduct, Plaintiffs have suffered, and will continue to suffer, substantial actual losses for which they are entitled to restitution from Defendants that is in excess of this Court's minimum jurisdiction, which includes but is not limited to, actual damages, disgorgement of at least six months of Ralph's annual salary she was paid while employed at Impact (i.e., $65,625), and revenues received by Hello Hazie. 32. Unless enjoined by the Court, Defendants will continue to engage in the acts, conduct, and omissions set forth above, which have resulted, and will continue to result in irreparable injury to Plaintiffs. Plaintiffs have no adequate remedy at law for such acts and threatened acts. Therefore, Plaintiffs request, pursuant to California B u s i n e s s & P r o f e s s i o ns Code § 17203, that during the pendency of this action, the Court issue a preliminary injunction, and that after trial, the Court issue a permanent injunction, restraining and enjoining Defendants and their agents, employees, attorneys and representatives, and anyone acting at their direction or on their behalf, from engaging in further conduct constituting unfair competition. WHEREFORE, Plaintiffs pray for judgment against Defendants as follows: 1. For compensatory damages in amount to be proved at the time of trial, but believed to be in excess of $100,000; 2. For punitive damages in an amount to be proved at trial; 3. For injunctive relief prohibiting unfair competition; 4. For an award of attorneys' fees, to the extent provided by statute or contract; 5. For costs of suit; 6. For such other relief as this Court deems just and proper. Dated: June 14, 2021 By: David C. Van Dyke, Esq . Robert L. Farmers markets, essential for the health of local communities, remain open but are making some changes in response to the coronavirus pandemic. Expect to see wider spaces between vendors, no samples, more gloves, possible waiting lines, and other precautions. As always wear a mask and practice social distancing.
