A good build contract THE BASIS FOR A SUCCESSFUL PROJECT

re you building your dream home or expanding your property portfolio? Building can be a stressful, expensive and daunting process for new and experienced owners and developers. Whilst build contracts are not as exciting as choosing your Lulu Lytle wallpaper, a good build contract can form the basis of a successful project.
YOUR RIGHTS AND OBLIGATIONS A homeowner’s main objectives will be to build a home of high quality, within budget and on time. The aim of the build contract is to address these issues and clearly set out your and your builder’s expectations. However, a number of curveballs may arise that make achieving these objectives less straight forward.
PRICE Although build costs are often stated to be a fixed price, this may not always be the case. Homeowners need to be aware of how and why costs may increase. The most common reason is when changes to plans are made. Homeowners should also be mindful that costs may increase due to a change to ‘provisional sums’. Provisional sums are a best guess for work that cannot be priced by the builder at the time of entering into the contract for example, site works, services connections or not yet designed structural elements (a pergola where the homeowner has not yet decided on the size or materials).
MATERIALS Global demand for construction materials
continues to dramatically outstrip supply and shows little sign of slowing down. This inevitably increases costs. Whilst the build contract will not be a silver bullet to resolving this shortage, it can help homeowners understand the impact so that they can focus on managing those risks.
DELAY There are many reasons for late completion but what many homeowners do not appreciate are those less obvious costs, arising from a delay, for which they will be responsible. These may include additional costs of hiring equipment, retaining labour and insurance. Our team can assist homeowners with identifying steps that can be taken to minimise these costs. ood design maximises architecture’s experiential quality – its dynamism and serenity, the stillness or movement created within space, and its sense of memory and place. As part of the total design approach, Peter Diprose specialises in integrated design solutions, simultaneously designing buildings and landscapes. “We also endeavour to meet our clients’ requirements rather than impose a predetermined practice style on the outcome. This can be seen in two contrasting projects presented on this page and on the magazine’s cover,” he says. One of PDA’s recently completed projects is an alteration to a Georgian style home in Remuera (cover shot). “Our client was very keen to retain the overall look of the existing house, whilst allowing greater access and views across a new lawn, swimming pool and an English style garden. To do this we realigned the kitchen, opening this up into a new family

room and loggia for outdoor dining. The pool incorporates a beach for small children, and to facilitate access to the water, together with a perimeter garden and fountain.” Another recent PDA project is a Modernist style house in Mellons Bay (pictured this page) comprised of interlocking cubic volumes of natural finished concrete and timber. Its forms are dressed in elaborate gold anodised brise-soleil screens to provide privacy from the street. Utilising the theme of the four classical elements, the living space has been seamlessly extended into an outdoor barbecue area with fireplace, swimming pool

Auckland’s newest shopping centre now open The opening of the new Ormiston Town Centre in March 2021 heralded a new shopping era for south east Auckland.

aunching a retail development in a worldwide pandemic was not for the faint-hearted but Ormiston Town Centre bravely went ahead despite Covid-19 challenges said Evan Davies, managing director of development company Todd Property Group at the opening. Part of a 19-hectare development of Auckland Council land around Ormiston Road, construction on the new $250 millionplus complex million-plus development began in October 2018 however, Covid-19
restrictions delayed opening, scheduled for October 2020, by six months. Major tenants in the centre include New World, Hoyts cinemas, The Warehouse, Noel Leeming and CityFitness. In addition there are food and beverage options, a mix of health and beauty studios and speciality services, such as the ASB Bank, Unichem Pharmacy, 2 Degrees and SnapFitness. More businesses were expected to occupy space the centre as the 2021 year progressed.
“We have commitment and interest from some great operators and are currently working through the details relating to timings for future stores, which will open over the next few months,” said Mr Davies. In addition to serving residents within the Ormiston and Flat Bush suburbs, Ormiston Town Centre will service the surrounding residential suburbs of Whitford, East Tamaki Heights, Clover Park and Totara Heights along with commuters from Maraetai and Beachlands.

The Howick Local Board and Auckland Council have talked for years about delivering a library and community centre to Flat Bush. In September 2019 the former Howick Local Board voted to approve land at Ormiston Town Centre for the new dual facility. The library, community centre and an aquatic leisure centre were then deemed to be “priorities.” It was envisaged that a design team would complete concept designs for the facility to be discussed at a workshop with the board early in 2020. Present board chairperson, Adele White said recently that the board had expected to see a community centre and library in Flat Bush by mid 2021. “The Flat Bush and Ormiston community has quickly grown to being home for over 40,000 people, she said. “A community centre is essential in providing a space where residents will share ideas, celebrate their cultures, and truly connect as a community.
However, Council head of asset management and investment programme Rob Cairns has said the Flat Bush library and community hub project has been put on hold as part of the Council’s response to the Covid-19 pandemic and the financial constraints in its emergency budget 2020-2021. “Prior to being put on hold, community engagement on the activities and services required was completed and procurement for a design team was well advanced.” He added that the library and community hub remained a priority project and would be delivered as a single integrated building offering multiple services and activities, on the northern side of the Ormiston Town Centre.” However he said timing of progress is dependent on when budget is available through the [council’s] 20212031 long-term plan, which was due to be adopted in June (2021).
FAIRWAY GARDENS RETIREMENT HAVEN Modern day retirement just gets better and better with resort style retirement villages generally offering a secure and comfortable, social and active lifestyle.

resently under construction on the corner of Botany and Cascades Roads, and overlooking Pakuranga Golf Course, is Metlife’s new retirement village – Fairway Gardens. Stage one, due for completion in early 2022, will comprise 58 two and three bedroom apartments across four architecturally-designed buildings – many of which will enjoy stunning views across the Pakuranga Golf Course. Hot on the heels of Stage 1 will be construction of the clubhouse, home to a lounge, bar, café, library, activities room, pool, gym, spa, beauty salon and hobbies room. This building will also house 27 one, two and three bedroom premium apartments also due for completion in 2022. Development sales and marketing manager, David Martin says the $180 million development in East Auckland is unlike any

other retirement village in the country, and demand is expected to be extremely high. Aimed at becoming a high-quality, community focused village, which promotes activities, wellness and social interaction, it has been designed around a pedestrian friendly, tree-lined avenue. The main building, with its reception and common amenities such as the café, bar, outdoor lounge, fireplace and barbecue area, will be the heart of the village, centrally located and right on the golf course edge. The stunning wellness area with its swimming pool, gym and spa together with hairdresser, beauty, massage and physio consulting rooms will be complemented by a shared lounge, private dining, a media room, library and activities room on the ground floor. Easy access to all amenities, including
undercover parking, has been incorporated into the design. Seniors keen to retire to this part of east Auckland, will find Fairway Gardens not only caters to golfers and those who appreciate a park-like outlook, but offers close proximity to Botany Town Centre and Howick Village with other malls and local beaches just a stone’s throw away. n line with the property grab, land and house packages are often secured within no time of sections being released to the public and building companies. With the pressure on to make quick decisions, it’s easy to overlook or forego those necessary checks ahead of signing on the dotted line. In particular, faced with a multi-offer situations, the scurry to present an unconditional deal can often override the good sense of completing checks to ensure the property in question is sound, meets your needs and is not over-priced. In order to act quickly, yet still proceed with caution by completing due diligence, heed the following advice: Talk to real estate companies and choose an agent with whom you feel comfortable to work with. Outline your budget and what you are looking for so they can let you when a property comes on the market. Sort out a good building inspector in advance – you may need his/her services quickly. Talk to your bank or mortgage broker
before beginning your search and have pre-approved finance in place if possible. However, even with this in place banks often need to approve a property before final confirmation of finance. If you are working with a broker, or bank manager, this approval can often be completed very quickly. When you find a property you like ask the agent for a LIM report but don’t rely on a vendor obtained report, It’s generally better to source your own from council although that will come with a cost. If you plan to access your Kiwisaver to help with the deposit on a property, speak to your lawyer before signing any agreements. There are strict timelines with using Kiwisaver money, which don’t always match with your need for speed! It pays to talk to a lawyer about how an offer can be structured to give you the time you need to draw down Kiwisaver funds yet also give the vendor certainty that the deal will proceed. If seeking a new build, visit show homes and building company websites. Talk to company sales reps about price structures,
build quality and materials, extras you may need to pay for, and what the ‘package’ covers such as landscaping, paths and letterboxes. Ask about build times and if the section title has been issued. Importantly, take any agreement to your lawyer first. When looking at properties be sure to consider your work and lifestyle needs. For example, it may be tempting to buy a few acres but if you have a busy job in the city and then need to travel extra each day, ask yourself if the property will work for you. Also, be aware that extra land not only means extra work, it means extra knowledge about keeping that land well maintained. This isn’t always straight forward for those who have little knowledge of rural living. Of course, in mid 2021, mortgage interest rates were at an all time low in New Zealand which has helped ease house hunters into new properties but it’s important to calculate what extra you can afford to pay should rates increase. Planning before you look will help avoid unwise decisions when the time comes to buy.

New public housing ‘SALLIES’ BACK PROJECT A new Salvation Army development of 46 homes in Flatbush was opened in June 2021 by the Prime Minister, Jacinda Ardern and the Housing Minister, Megan Woods.

aitiakitanga in Flat Bush, comprising 10 one-bedroom units and 36 twobedroom units is a welcome addition to public housing places in Auckland and at the time of opening, about 85 percent of referrals for tenants were households with dependent children. “This is another great example of community housing providers, in partnership with Government, delivering warm, dry, and healthy homes for more New Zealanders,” said Housing Minister Megan Woods. “This progressive partnership with the Salvation Army shows how innovative solutions can help speed up delivery [of new homes].” The homes have been built using
structurally insulated panels, which reduce build time and costs, and have a far higher insulation value than traditional building products, Ms Woods added. While much of the operating funds for the developments were provided via Tuapapa Kura Kainga – the Ministry of Housing and Urban Development, the project received a quick start with initial funding from the Salvation Army with an impact investment through The Salvation Army Community Bond. This was the first such bond arranged by Community Finance, an impact investment platform established in 2019, which is committed to driving significant growth in community housing.

MILL ROAD PROJECT SHOVED ASIDE The controversial widening and realignment of Mill Road in the Papakura/Alfriston district, now looks unlikely to go ahead despite being on government and council agendas for a number of years and even being announced as ‘shovel ready’ in 2020.
I
n mid 2021, the Government announced a budget blowout had stalled (and probably buried) the long awaited project, at least for the time being. In past years, Design & Build has published various plans put forth and has seen these altered and retrenched, despite the route being a key link to the east and usually heavily congested at peak commuter times. One of six projects from the NZ Upgrade Programme which won’t go ahead as planned because of the recent expensive cost blow outs, the rebuilding of Mill Road, was initially costed at $1.3 billion but in 2021 was recosted at $3.5 billion. So, instead of rebuilding the road, Transport Minister, Michael Wood has said that the Government would focus on important safety improvements to the road, upgrades to SH1 and rail, and new rail stations connected to public transport, walking and cycling infrastructure. Infrastructure Minister, Grant Robertson, added that the changes represented a “balanced approach”. “Fully funding the new estimated costs for every project (six in total) would have cost up to $6 billion extra on top of the original $6.8 billion, so instead we’ve taken a balanced approach with a mix of additional investment and a handful of projects being re-scoped while also keeping a lid on debt,” he said. As it stands, this vital link to east Auckland, which was also seen as a way to relieve congestion on the Southern Motorway, may well continue to remain clogged at peak traffic times during the week. Furthermore, with exponential growth occurring in Takanini – townhouses and terraces style housing now covering a vast tract of land in the vicinity of Mill Road and adjoining Cosgrove Road – the route may well be more heavily used than ever. It remains to be seen if an upgrade, considered essential by many commuters especially as direct links to the east from the south are limited, will go ahead in the future, particularly if there is a change of government.
City Rail Link: GREAT DAME DIGS – AND PHIL’S IN! Politics may bore many people but, when politicians lent a helping hand to set wheels in motion for Auckland’s City Rail Link, (ironically) ‘boring’ was far from boring.
“T
he official start of tunnelling represents an important milestone on Auckland’s journey towards providing a world-class, 21st century transport network,” Auckland Mayor, Phil Goff, said of the official 2021 launch of the Tunnel Boring Machine (TBM), named Dame Whina Cooper – who was far from boring! The tunnels will play a vital role in the overall City Rail Link, ‘on track’ until (and in another way, after) completion in late 2024. The link is also expected to ease pressure on the beleaguered road network, which should be great news for local commuters who work in the city. Although the first 50 metres of tunnel at the Mt Eden site had already been mined, the TBM is now at work excavating the remainder of the 1.6km tunnel which will run under the motorway and connect
with the CRL (City Rail Link) tunnels already constructed from the Britomart Station. “When complete, the City Rail Link will transform rail travel in Tamaki Makaurau,” Mr Goff believes. “It will carry up to 54,000 people an hour, moving the equivalent capacity of three Auckland Harbour Bridges or 16 extra traffic lanes into and through the city at peak times.” Joined by another boring enthusiast, Transport Minister Michael Wood, Mr Goff pressed a button to start the machine in early May 2021. Such ‘shovel-ready’ projects also provide further benefits, Mr Wood added. “Building infrastructure like the City Rail Link is part of our Covid-19 economic plan – this project is providing real jobs and opportunities for thousands of Aucklanders. It’ll give us a step-change in our public transport and cultivate a diverse and highly-skilled workforce.”

Howick police presence uncertain Howick has long had a police station, and a friendly police presence but, in mid 2021, the site was put up for sale and there was some doubt whether the area could continue to maintain such a strong police presence in the village precinct.
A
lthough objections to the sale of the Moore Street property (occupied by the Howick Police Station), are unlikely to prevent it going ahead, there is a chance police will maintain a physical presence locally. Counties Manukau East Police area prevention manager inspector Colin Higson told a public meeting in May 2021 that the important thing to realise was that the land would be sold. He also said the police had given a very public undertaking to maintain a presence in the Howick community but added, “what that looks like is a different question.” “What I’m hearing from the community is you want a police station or a police presence in the community, so collectively how do we achieve that purpose? We need to work together with the community to
work out a solution that gives the community what it wants.” Mr Higson said options for the future were to find an alternative premises which, he added, essentially mirrored what was currently available [in Howick]. Another option was some sort of “pop-up” service or presence such as a shop-front situation where [police] would make it known what time and day officers were available for members of the community to drop in and report any issues they may have. “If neither of those options becomes available we need to revisit where we’re at, and how we have a public face within Howick.” Mr Higson advised the Police needed to be prepared to move from the current Howick station building if a new owner wanted the land however, should the new owner want the Police as a tenant that could be taken into consideration. “The key message from me is….we are aiming to maintain the same standard of service for the community, because that is our job.”
ABLUTIONS PROJECT AWASH WITH PRAISE! A long awaited toilet and shower block renovation at Maraetai Beach Boating Club has been given the thumbs up by the local community, the facilities among a major club upgrade aimed at fostering new membership and attracting residents who have boating and other activities in their blood.
O
verall redevelopment plans for the club were first unveiled in 2014 with stage one beginning two years later and encompassing asbestos removal, water leak, fire protection, interior upgrades and deck work. Stage two included the new toilets and showers with mobility access, increased storage and improved kitchens. Monies for the $430,000 project came from club fundraising and various grants
including a $45,000 Franklin Sport and Active Recreation Facilities grant At the unveiling of stage two, Franklin Local Board, Wairoa representative, Malcolm Bell said that the club had $30,000 and $45,000 in pledges from Pub Charities and the NZ Communities Trust when it approached the Board for assistance. “We could see how hard they [club members] were working. It was a case of chipping in to get the project over the line,
rather than funding everything.” Today the club is home to a variety of club and organisations and invites membership interest.

Classic Builders Step inside the Andrew and Michelle Skipworth’s brand new build and the feeling of ‘home’ is overwhelming.

panning about 260m2, the home is clad in black-painted brick with a smooth finish, and dark brown cedar. It features a four-bedroom wing (with bathroom and en suite), an open-plan main living wing with an interconnecting area that’s a family room opening to the outdoors. Andrew and Michelle had specific ideas for their new home so it was important to them that the building company they chose really understood what they wanted. They spent time with a few companies, and Classic Builders came out trumps.

HOUSING SHORTAGE STRONG DEMAND KEEPS PRICES HIGH Over the past year, demand for houses remained stronger that ever, and prices generally kept increasing, especially as mortgage interest rates remained low. The demand was further fuelled by fewer properties coming on to the market.

y mid 2021, the onset of winter and the new regulations aimed at making home buying less attractive to investors did not dampen the price or the number of Auckland houses sold in June 2021. At the time, managing director of Barfoot & Thompson, Peter Thompson said normally in June, sales numbers would start to edge lower. However, with 1243 homes sold that month (up 3.8 percent on those for the
previous month), both the average and median prices paid were higher than those for May. “Even though our new listings for the month, at 1485, were solid, at month end our total listings at 2864 were the lowest at a month end for five years,” Mr Thompson commented at a time when the Government was trying to put the lid on escalating property prices. Mr Thompson said demand and competition for homes had never been higher with the number of homes the company had for sale at the end of the month down by a quarter on the number available at the same time the previous year. “The average price paid was $1,143,328, up 2.6 percent on that for May 2021, and the median price at $1,109,000 was up 3.4 percent.
“Our June-on-June median price increase stood at 21.9 percent and The Real Estate Institute’s Price Index for May-to-May for Auckland was an increase of 26.3 percent.” Mr Thompson commented that demand for housing, low levels of supply and record low mortgage interest rates continued to prove a strong counterbalance to the new regulations which looked to pull back the rate of price increases. Demand for high end housing continued unabated at that time, he added.

BUSWAY TO BOTANY
on hold
Over the past 12 years (at least) plans have been drawn and redrawn several times, regarding AMETI – the Auckland Manukau Eastern Transport Initiative – a busway and new roads running between Panmure and (eventually) Botany Town Centre.
J
ust when residents thought it was on track, total project completion has been delayed by another two years, to 2027/2028. Over the past decade or more, houses have been bought along route to later be demolished when making way for more transport lanes including the busway. However progress has been slow though work is currently well on the way for that section which runs from Lagoon Drive, Panmure to Pakuranga Plaza. However, the projected delay time means the Eastern Busway and a planned Reeves Road Flyover are on hold for now. In June 2020, Auckland Mayor, Phil Goff said there would be no delays to the Eastern Busway project despite projected shortfalls in the Council’s budget as a result of the Covid-19 pandemic. Pakuranga MP, Simeon Brown and Botany MP, Christopher Luxon said in a joint statement that the Mayor had spoken of the Council’s commitment to the project given how critical it was to solving congestion issues in the wider transport network and because it would provide more reliability and choice in our public transport options. They concurred that Pakuranga Road remained one of the busiest non-State Highways in the country and despite local expectation that the Regional Fuel Tax would
be used on important projects such as the Eastern Busway, this did not appear to be the case. Mr Brown and Mr Luxon agreed that the Government and Auckland Council needed to urgently work together to find the money and reverse this funding cut to ensure the Eastern Busway was delivered to the promised timeframe. At that same time, Auckland Mayor Phil Goff said he was worried but held out little hope the matter of funding could change, while, Auckland Councillor (Howick Ward), Paul Young, said it was a huge blow to east and south Aucklanders who had been waiting a decade for the busway. “Both south and east Auckland have suffered historic under-investment in transport from both central and local government. The Eastern Busway is the first opportunity for us to change that story,” Mr Young said. “Once completed it will provide a convenient and reliable connection from the east to the rest of the region. If we want to earn the confidence of Aucklanders, and if we are serious about meeting our emissions reductions goals, we should be speeding the busway up not slowing it down. I am committed to finding a way to bring the funding the Eastern Busway back to the earlier years as was originally consulted on by AT”. Howick Youth Council co-chair Danica
Loulié-Wijtenburg added that further delays were inexplicable to most young people. “The Eastern Busway is essential to improving public transport for our community. When built, it will open opportunities across Auckland for public transport users, alongside people using bicycles,” she said on hearing of the delay. “Youth often choose to use public transport to get around their neighbourhoods and their city. They’ve told us they want public transport to get better now – not later. “A student’s trip from Botany to uni [university] in morning rush hour would normally take more than an hour, depending on traffic congestion. Once the busway is complete, alongside the City Rail Link, trips would reliably take about 40 minutes in rush hour. That’s simply transformative.” Although funding for delivery of the programme has been spread out by a further two years (to 2027/28), authorities have said this does not mean a reduced commitment to the programme. Overall, there is a proposed increase in funding for the busway of $199 million (from $912 million to $1.11 billion) between the 2018 RLTP and the 2021 draft RLTP. Stage 1 of the busway, allowing for road widening and dedicated bus lanes between Panmure and Pakuranga is not impacted and was still due for completion late 2021. For many years most New Zealand homes included just one bathroom although, in two storey homes there was usually a toilet on each floor while homes in the upper echelon of society would likely have at least two bathrooms.
A
round 1970, the en suite started appearing as almost standard in any new build home not just the most expensive houses but, now, as the price of homes continue to escalate we are again seeing more new builds with just one bathroom or toilet, a saving on cost. So, if building a new home or wanting to renovate an existing property, the homeowners may be wondering how many bathrooms to install. Here are some tips to help you make the right choice: • KNOW THE DIFFERENT TYPES: Bathrooms are sometimes categorised as full baths, three-quarter baths, half baths and quarter baths. Full bathrooms have a vanity, toilet, shower and bathtub. Threequarter baths have a shower, vanity and toilet but no tub – a format often favoured for en suites attached to a bedroom. Half baths, often known as powder rooms, only

have a vanity and toilet. Quarter baths, a term not usually used in New Zealand, have just a toilet or, as Kiwis would say, a separate ‘loo’. • ASSESS THE FAMILY’S NEEDS: It’s important to consider how many people are in your family as well as their accessibility requirements. For example, a bathtub may be difficult for a person with limited mobility to step over, but it’s convenient for bathing young children. If you have teenagers, an extra full bathroom or ‘three-quarter’ bath (ensuite) is probably a wise investment and if you have a family member with mobility issues then a large, walk-in shower may be preferable over a cubicle shower especially if a cubicle shower base has a lip. Take into account the type of door on an enclosed shower – a door that swings wide open will probably suit better than a three-panel slider especially for people of large build. • KEEP THE LONG TERM IN MIND: You should be mindful of the future when
installing or renovating a bathroom. In addition to considering how the needs of your family members are likely to change over time, you should think about how your choices may impact the resale value of your property. Even though some new builds now have only one bathroom, it is often desirable to have an extra toilet. If you need advice on your renovation project, consult a building contractor in your area. • BE PRACTICAL: For those who have a generous build or renovation budget, there may be the possibility of including some extra practical solutions, such as a toilet and basin and even a shower near the backdoor, laundry or garage. Those who do a lot of outdoor work, such as gardening, or have a wellused swimming pool, then a toilet or small bathroom which can be accessed from the outside will save people traipsing through the house in wet swimwear or dirty work clothes. small bedrooms Kiwi homes of the past, especially those built prior to the 1970s, were often threebedroomed but sometimes the third bedroom was suitable for only one single bed. Whether a child’s room, guest room or main bedroom, such rooms often leave today’s occupants wishing for more space.
B
ut there are ways to maximise space even in a small room. For example, under-bed storage can be a boon. You could buy a bed with built-in under storage or simply use bins and boxes to tuck underneath.
If your bed is too close to the ground, use bed risers or fit longer legs to elevate it. Alternatively, consider investing in a loft bed – a single elevated bunk which allows for a
dresser underneath, or better still, a desk unit or even a sofa. Opt for double-duty furniture. Look for floor lamps with shelves, ottomans with storage space and cabinets fronted by a full-length mirror. If the room is a nursery consider a dresser which can also be used as a changing table. Wall cabinets and shelves close to the ceiling will also provide added storage. And why not pop a shelf above the door? This often-ignored area is ideal for a shelf where you can place a couple of pretty baskets or bins to hold your things not needed on a daily basis. Use the space behind doors, too. Attach hooks, towel rails, over-the-door organisers or peg boards to the backs of the bedroom door or closet doors.

TO GET YOU STARTED: • Create a designated space to safely store tools, fertilizers, pool chemicals and other potentially dangerous items. Keep them well away from inquisitive hands and don’t keep toys in the same area.
• If planning to build a multi-tiered garden, consider using ornamental gates and ramps (with a handrail) to reduce the risk of falls – these will also be useful for elderly visitors. • Be doubly sure pools, ponds and other bodies of water are properly fenced off and only accessible through a gate which latches. Drownings at home are far too common in this country especially where safety measure have been inadequate. Check council’s fencing rules. • If using stakes to support climbing plants in your vegetable garden, cover the ends to
