Our Industry’s Greatest Strength
A
s a member of the TIADA Board of Directors, I have the privilege of seeing firsthand the work that goes into making our annual conference one of the most valuable events for independent dealers in the country. That’s why I was especially excited about this year’s TIADA Conference & Expo. The automotive industry continues to evolve at a rapid pace. From regulatory changes and compliance requirements to advances in technology and shifts in consumer expectations, independent dealers face new challenges every year. The TIADA Conference provides an opportunity to step away from the daily demands of running a dealership and focus on the future of your business. What I appreciate most about this event is that it is built by dealers, for dealers. The educational sessions were practical, relevant, and designed to provide realworld solutions that can be implemented immediately. Whether you were looking to improve operations, strengthen your sales process, enhance collections, increase profitability, or better understand industry trends, we made sure the programming reflected your needs.
Auto Smart (Texarkana) TIADA VICE PRESIDENT, DALLAS (REGION 3)
Equally important are the relationships you’ve built. The independent dealer community in Texas is one of our industry’s greatest strengths. Every year, the conference brings together dealers from every corner of the state who are willing to share ideas, discuss challenges, and learn from one another. Some of the most impactful conversations happen between sessions, in the expo hall, or over a meal with fellow dealers who understand exactly what you’re facing. As one of your board members, I am proud to say that our goal is to ensure TIADA continues to provide resources, advocacy, and education that help independent dealers succeed. The annual conference is a reflection of that mission. It is an investment not only in your dealership but also in the strength and future of our industry. Attending the 2026 TIADA Conference was an extraordinary experience that allowed me to reconnect with friends, meet new dealers, and learn alongside the best operators in Texas. If you were unable to attend this year, we missed you. But there is always next year! Together, we can continue building stronger dealerships, stronger businesses, and a stronger independent dealer community across Texas.
As one of your board members, I am proud to say that our goal is to ensure TIADA continues to provide resources, advocacy, and education that help independent dealers succeed. 4

Bankruptcy Basics for Car Creditors: Separating Fact from Fiction
W
e’ve recently noticed an uptick in the number of consumer bankruptcy cases (mostly Chapter 13s) being filed involving our carcreditor clients. Recent higher interest rates and higher consumer prices have certainly added to the strain on debtor finances, especially in the sub-prime credit markets, and thus have no doubt contributed to the recent increase in filings. Recent record numbers of eviction filings in Dallas County, for instance, reflect the pressure on debtors in making their scheduled payments. We still get calls from dealers, finance companies, and credit unions who are experiencing their first bankruptcies, and don’t always understand what their rights and obligations are. This article attempts to summarize some of the more common issues car creditors face, and to debunk some of the more common myths that abound in the sub-prime finance world.
by Michael W.
Dunagan TIADA COUNSEL
Myth: Being “excluded” from the bankruptcy
allows a creditor to repossess despite the presence of a bankruptcy filing. Fact: There is no such thing as a creditor being excluded from a bankruptcy. Car creditors often are informed by debtors that the creditors are being excluded. What this usually means is that the debtor has chosen to “pay direct” or honor the terms of the contract instead of delaying, reducing, or “cramming down” the debt. Being classified as a “pay direct” does not exclude the creditor from the bankruptcy case. All creditors are subject to the bankruptcy stay and must obtain permission from the bankruptcy court to take any collection action, even if the debtor defaults.
Recent higher interest rates and higher consumer prices have certainly added to the strain on debtor finances, especially in the sub-prime credit markets, and thus have no doubt contributed to the recent increase in filings.
Myth: Until a creditor receives official notice from the Bankruptcy Court that a debtor has filed bankruptcy, that creditor is under no obligation to pay attention to the bankruptcy filing, and can handle the debtor as any other debtor. Fact: The courts have held that any notice is actual notice. From the moment a bankruptcy case is filed, the Automatic Stay is in existence and applies to every claimant and creditor of the debtor. The stay prohibits any creditor from commencing or continuing any collection activity against the debtor, including repossessing collateral or disposing of collateral that has already been repossessed. If a creditor takes action after having received actual notice (actual notice can come from the bankruptcy court, the debtor or the debtor’s attorney) of the bankruptcy filing, the creditor is in violation of the automatic stay and is subject to sanctions. Don’t make the mistake one car creditor did in ignoring a hand-written notice delivered by the debtor on yellow-pad paper. The judge made it clear after the creditor was arrested that the informal notice was actual notice. We’ve also seen fines and penalties as high as $35,000 for certain violations of a bankruptcy stay. Myth: Repossessing collateral prior to the debtor
filing bankruptcy protects the creditor from being affected by the bankruptcy. Fact: If the creditor (1) repossesses collateral, (2) sends appropriate post-repossession notice, (3) waits the appropriate time period, and (4) legally disposes of the collateral, all before the debtor files bankruptcy, the creditor is under no obligation. If, however, all of the above have not been completed prior to the bankruptcy filing, then the automatic stay will impact the creditor. We find that debtors and their attorneys often run out and file just before the 20-day holding period on a 9

strict foreclosure, or the usual 10day holding period on a private sale, expire. Absent some unusual circumstances (check with your attorney) the vehicle may have to be returned, and relief will usually have to be sought through the bankruptcy court. The 2021 U.S. Supreme Court decision in The City of Chicago v. Fulton held that a car creditor who repossesses prior to bankruptcy filing is not in violation of the automatic stay for merely refusing to immediately return the vehicle. But the creditor can’t sell or otherwise dispose of the collateral without court permission. Also, the bankruptcy court probably will, at the request of the debtor, order the return of the collateral. See Texas Dealer, “Bankruptcy Filed After Repossession: New Supreme Court case offers Guidance” (July, 2025) for a more detailed discussion of the effect of the Fulton case.
Myth: If the debtor files bankruptcy within a certain time after purchasing a vehicle, or has filed previously, the car creditor is immune from the bankruptcy. Fact: Amendments to the Bankruptcy Code have created certain presumptions with regard to repeat filings and recent purchases that limit the scope of the bankruptcy stay in Chapter 13 cases. However, these presumptions can be overcome by the debtor filing a request for relief with the bankruptcy court. Courts routinely grant relief to the debtor unless the relief is challenged by a creditor. For example, in a Chapter 13 bankruptcy filed within one year of the dismissal of an earlier case, the automatic stay will terminate 30 days after the filing, unless the debtor demonstrates that the second case was filed in good faith with respect to the creditor against whom the stay is sought. In a second repeat filing within the one-year period, 10

the automatic stay will not go into effect. Again, if the debtor can establish good faith, the court can still impose the automatic stay against a creditor. We’ve found that judges are quite liberal in granting relief to debtors under these circumstances. Another factor that has made Chapter 13 bankruptcies problematic for car creditors in the past, has been the so-called “cram down” of the creditor’s secured position to the fair market value of the collateral. That is, the indebtedness owed to the car creditor has been “crammed down” to the fairmarket value of the car, with any additional indebtedness being treated as unsecured debt. Currently, a purchase-money security interest in a motor vehicle purchased within two-and-a-half years (910 days) prior to the bankruptcy filing isn’t supposed to be crammed down. Thus, a Chapter 13 plan should provide for repayment of the entire indebtedness, regardless of the fair market value. However, we have seen debtor plans filed that do attempt to cram down the amount of the debt. These plans are often approved unless specifically objected to on the basis of the 910-day rule. Also, repayment of the indebtedness can still be spread over five years at a reduced interest rate, and delayed until after certain administrative expenses (such as fees to the debtor’s attorney) are paid. We have seen cases where the debtor consulted with a bankruptcy attorney just prior to buying a vehicle, then filed bankruptcy immediately after the purchase. We can only assume that some debtors are being advised to purchase vehicles with the intent of filing bankruptcy.
Myth: The bankruptcy judge and trustee will protect the rights of the creditor in a bankruptcy action. Fact: The judge is a neutral party who can’t take a position of advocacy for the debtor or creditor. Rulings are made based on motions and information presented to the court. The trustee is likewise not in a position to represent or advocate for one party of the other. The fact is that a creditor has the burden to look out for its own interests. Chapter 13 is a debtor-driven system. Almost every significant step in the bankruptcy process is initiated by the debtor or the debtor’s attorney. The trustee handles a large volume of cases, and its primary function is to distribute money coming into the bankruptcy as provided by the court. Thus, a creditor must invest the time and expense to intervene if a debtor‘s proposal is to be challenged. Otherwise, the debtor’s objectives are routinely accepted and approved. Myth: Once an individual files bankruptcy, he or she can’t refile for a lengthy period of time, making a prior bankrupt a good credit risk. Fact: Individuals can and do file on a repeat basis. While there are limitations on the number of discharges a debtor can receive in a given period of time, there are no such limits on filing. And it is the filing that creates the automatic stay, which is so devastating to car creditors. With some bankruptcy debtors, it’s just a matter of time before the next case is filed. Myth: If a debtor in bankruptcy lets insurance on the vehicle lapse, I can repossess despite the bankruptcy. Fact: The contractual insurance requirement can be enforced in bankruptcy, but only with the permission of the bankruptcy court. It would be a violation of the bankruptcy automatic stay to repossess without court authorization. And once bankruptcy is filed, the creditor should not contact the debtor directly July/Special 2026

Repossession 101: What You Need to Know
Dealer Academy This is a video course with
Michael W. Dunagan TIADA General Counsel, author of Dealer Financing of Used Car Sales and Texas Automobile Repossession: A Lien Holder’s Legal Guide.
In this two-part video course TIADA counsel Michael Dunagan answers repossession related questions for both the dealer starting out and those dealers who want a refresher. Dunagan goes through the basics of selfhelp repossession, repossession when a client has filed bankruptcy, and using the courts to regain collateral through sequestration. The course also covers all the repossession letters and includes a downloadable deck of slides to follow along with the course. • Preliminary Considerations Before Repossession • When is a Customer Considered in Default • Avoiding Liability from Repossession • Types of Disposition • Required Notices to the Debtors • Handling Personal Property • Using the Courts to Get Your Car Back

to demand insurance coverage, but should contact the debtor’s attorney.
Myth: Since most motor vehicle retail installment contracts provide that the filing of a bankruptcy by the debtor is a condition of default, the creditor can repossess without having to obtain permission of the court. Fact: The debtor would be in default under the contract for filing bankruptcy, but the automatic stay still trumps the contractual rights regarding any collection action, including repossession. Myth: A closing document signed by a
buyer declaring that he or she will not file bankruptcy; and that if bankruptcy is filed, the car creditor will not be subject to the bankruptcy, would keep the creditor out of bankruptcy danger. Fact: Such a contract term is forbidden by the Bankruptcy Code and is totally unenforceable. Obviously, if this device could be used, every creditor would include it in credit papers making the Bankruptcy Code useless.
Myth: A car creditor has no way of
protecting itself from consumer bankruptcies. Fact: Creditors can, through better underwriting, avoid potential bankruptcy filers. For instance, credit applications that inquire of all debt can help spot over-stressed debtors. Also, credit application forms that inquire of an applicant’s intentions with regard to bankruptcy might smoke out potential filers. And, special scrutiny should be given prior bankruptcy filers as the incidence of repeat filings is high in the sub-prime world. After a bankruptcy is filed, the creditor has rights, but they must be exercised in the bankruptcy court process. We have found that a prompt attempt to obtain relief from the automatic stay is the best course of action. Getting the collateral back while it still has value, even at the expense of retaining an attorney, may be the only way to come out on top. Michael W. Dunagan is an attorney in Dallas, Texas who has represented the Texas Independent Automobile Dealers Association for 50 years. He has written a number of books and hundreds of articles for trade journals and law reviews. His clientele includes dealers, banks, finance companies, auto auctions and credit unions. T e x a s

NATIONAL QUALITY DEALER of the
YEAR:
El Paso’s Cesar Stark Brings National Recognition Home
S
ome achievements speak for themselves, earning national recognition through years of consistent excellence rather than a single defining moment. For El Paso businessman Cesar Stark, that recognition came before hundreds of automotive professionals in Denver, Colorado, when the Nat-ional Independent Automobile Dealers Association (NIADA) named him its 2026 National Quality Dealer of the Year. The award is among the inde-pendent automobile industry’s high-est honors. It recognizes more than sales volume or business success. Recipients are selected for their ethic-al business practices, commitment to customer service, leadership with-in the automotive profession, and meaningful contributions tow their communities. Stark was chosen from eleven state finalists representing the very best independent dealers across the United States. For El Paso, the honor carries significance well beyond the automotive industry. Stark’s story reflects the kind of entrepreneurial determination that has long defined the Borderland. More than two decades ago, he began with a single vehicle and little capital, gradually transforming one sale into a thriving business. Today, S&S Motors has become a respected independent dealership built on trust, transparency, and long-term customer relationships rather than quick profits. That philosophy stands out in an industry where public confidence can sometimes be difficult to earn. The National Quality Dealer Award demonstrates
16

that integrity remains a competitive advantage—and that customers notice businesses that consistently place honesty and service ahead of short-term gain. Just as important is Stark’s commitment to the profession itself. Beyond operating a successful dealership, he has devoted years to improving the independent dealer industry through leadership roles with the El Paso Independent Automobile Dealers Association and the Texas Independent Automobile Dealers Association. He has mentored fellow dealers, participated in educational programs, and helped shape industry standards throughout Texas.
This award is much bigger than me—it reflects the incredible support of my family, the dedication of our team at S&S Motors, and the mentors and friends who have invested in me throughout my journey.” “Receiving the National Quality Dealer Award is one of the greatest honors of my career. When I started over 26 years ago with one vehicle and a dream, I never imagined I would one day receive this recognition. This award is much bigger than me — it reflects the incredible support of my family, the dedication of our team at S&S Motors, and the mentors and friends who have invested in me throughout my journey.” Noted Cesar Stark after receiving the prestigious award. He went on to say, “The most rewarding part of this recognition is knowing that it represents more than building a successful dealership. It represents serving our customers with integrity, giving back to our community, and being actively involved in improving our industry. July/Special 2026

Through TIADA, NIADA, and EPIADA, I’ve learned that the best dealers never stop learning and never stop serving. I hope this award encourages other dealers to become involved in their associations, share their knowledge, and help elevate our profession. I am incredibly grateful and humbled to represent Texas on the national stage, and I hope to continue giving back to an industry that has given so much to me.” Communities benefit when successful business owners invest not only in their own companies but also in strengthening the industries and neighborhoods around them. Stark has done precisely that. His acceptance remarks were equally telling. Rather than focusing solely on business accomplishments, he credited his family, employees, mentors, and late father for the values that shaped his career. In an era when success is often portrayed as an individual achievement, his acknowledgment served as a reminder that lasting accomplishments are usually built upon the support of others. Awards alone do not define a legacy. Character does. By earning the automotive industry’s highest distinction for independent dealers, Cesar Stark has demonstrated that ethical leadership, community involvement, and perseverance remain the strongest foundations for business success. His achievement is not only a milestone for S&S Motors but also a point of pride for El Paso and for Texas letting the nation know that excellence thrives there.
“The most rewarding part of this recognition is knowing that it represents more than building a successful dealership. It represents serving our customers with integrity, giving back to our community, and being actively involved in improving our industry.” The true significance of this recognition lies not in the medal itself, but in what it represents. By honoring Cesar Stark, NIADA has affirmed that integrity is not an outdated ideal but a competitive advantage, a leadership principle, and a legacy worth building. In recognizing one dealer, it has reminded the nation that character remains the highest standard of excellence.

QUALITY DEALERof the YEAR: Where Are They Now? AN INTERVIEW W I T H 2 0 0 0 AWA R D WINNER ROBERT MCDORMAN
T
o say that selling cars is his passion could quite possibly be the understatement of the year. For dealer-guru Robert McDorman it is more than simply moving inventory off his lot. It is about delivering exceptional customer experience on every level from sales and service to finance and more. He has lived by his dealership’s motto “No One Comes Close” and proven himself to be an exemplary example of what it truly means to be committed to building not just a business, but an automotive empire.

To say that selling cars is his passion could quite possibly be the understatement of the year. T e x a s
D e a l e r
July/Special 2026
McDorman began his automotive journey when he was still in junior high washing cars for a Houston area dealership. By the age of fourteen he graduated to selling cars on the lot and in one year made $58,000. Not bad for a freshman in high school. A few years later he gained ownership of an auto parts business in Dayton, Texas whose original owners were retiring. He buckled down, seeing his opportunity, and with hard work and a little elbow grease he turned a $21,000 a month shop into a booming $110,000 a month business in just eleven months. Over the years he has worked as a General Manager, Parts Manager, Service Manager, Finance Manager, Used Car Manager, and General Sales Manager. So, when he decided it was time to purchase his first dealership in 1992 he left no stone unturned in his quest for industry knowledge consistent with his commitment to the highest level of customer service. A small used car dealership in Vidor, Texas called Easy Auto Sales was rebranded as McDorman Motors and by 2004 the business had blossomed to 5 locations. Since then he has scaled McDorman Motors into one of the largest independent preowned dealerships in Texas with over 186 employees moving over 600 cars per month. His success has been recognized by several organizations over the course of his career. In 2000 he was awarded the Texas Quality Dealer of the Year Award as well as the NIADA Double Eagle Award. The following year he was also honored on a national level with the NIADA National Quality Dealer of the Year Award. This was followed by becoming a Better Business Bureau Torch Award finalist in 2004. McDorman also received his NIADA Certified Master Dealer Certification from Northwood University in 2002. We wanted to catch up with Robert McDorman to see how his life and business have changed since winning the 2000 Texas Quality Dealer Award. July/Special 2026

D e a l e r
Q: What was it like, winning the Quality Dealer Award in 2000? What
did it mean to you? Being presented with the Quality Dealer Award was a true honor and one of the greatest highlights of my life.
Q: How did winning the award change your career arc and the way you
do business as a Dealer in Texas? I have since sold my car operation to Vehicle Value Experts. However, in my current role at Auto Claim Specialists I work with car values all day long. At Auto Claim Specialists we refer our clients to Vehicle Value Experts to help them obtain a fair Actual Cash Value on their vehicle.
Q: What have you accomplished since then?
I am now the President of Auto Claim Specialists we are a National Public Insurance Adjuster Agency, and we specialize in motor vehicle claims. We are licensed in over 28 States. We work with many car dealers across the United States daily with their clients who are involved in a total loss and their insurance carrier has undervalued their proposed settlement. Our average settlement increase above the carrier’s final offer is $4,300. I am actively involved in legislative affairs concerning the Texas insured citizens.
Q: What advice would you have for other independent dealers in the
state of Texas who are striving to one day win the award? And why should dealers strive to achieve this honor? Each Independent Texas Dealer should strive to achieve this goal. In my professional opinion the award brings a high level of accountability and credibility to the dealer. Each dealer should cherish their dealer’s license, work hard each day to always educate themselves on compliance issues and place the highest level of focus on their clients and referrals.
Q: Do you have any closing thoughts you would like to add?
I am as proud of achieving this award today as when I achieved it back in 2000. I am equally proud of achieving the National Quality Dealer Award the following year. Each dealer should become actively involved and support the Texas Independent Auto Dealers Association and work hard to work with legislators to educate them on the needs of Independent Dealers in Texas. Today Robert McDorman applies his extensive background as a Certified Master Dealer and public insurance adjuster through his company Auto Claims Specialists, as well as the Auto Body Association of Texas (ABAT) as an advocate for independent dealerships at the Texas state legislative level. He is extremely active in legislative affairs regarding the auto insurance industry in the State of Texas and has testified often at the Texas State Legislature. Most recently he was present as part of the Senate Committee on Business and Commerce during the 89th Session Senate Hearing on the Texas Mandatory Appraisal Law. For over a decade he has also been a prolific editorial contributor to several automotive publications including Autobody News, RDN Repairer Driven News, Merlin Law Group, and Texas Automotive, where he penned a monthly article entitled “Ask the Expert” from 2018–2025. Robert McDorman continues to be a shining example of what can be achieved when passionately committed to excellence in one’s business. We look forward to observing his continued success and the countless achievements he no doubt will obtain throughout his career in the world of independent Texas automotive dealers. 23

The TIADA Conversation as Big as Texas by Trevor Jennings
TIADA Executive Director
I
n May TIADA took to the road for the first leg of its 2026 Big Texas Tour, a series of town hall meetings across the state with its first four stops in Dallas, San Antonio, Houston, and Donna. The meetings were designed with a simple purpose: bring timely information directly to dealers, create space for practical discussion, and hear firsthand what independent dealers are seeing in their businesses. Across the four stops, the events brought together more than 150 dealers, vendors, sponsors, tax assessor-collector representatives, board members, and industry partners for conversations focused on compliance, regulatory updates, and operational challenges affecting the industry. While each meeting followed a similar structure, the value of the tour came from the local conversations in each market. Dealers had the opportunity to ask

D e a l e r
questions, share concerns, compare experiences, and talk through issues that are difficult to fully understand from a written update alone. That type of direct exchange remains one of the most important ways TIADA stays connected to the realities facing independent dealers across Texas. A major focus of the meetings was the ongoing implementation of updated Texas ID requirements, including the upcoming January 1, 2027, effective date for registration renewals. While certain updated ID requirements for title and registration transactions are already in effect, the renewal timeline continues to raise practical questions for dealers, particularly those managing Buy Here Pay Here portfolios, customer communication, and collateral concerns. TIADA used the meetings to walk through what is 39
currently known, discuss key timelines, and hear directly from dealers about where questions remain. Dealers raised practical questions about customer communication, renewal timing, acceptable identification, lienholder concerns, and what the process will look like once renewal requirements take effect. Those conversations reinforced an important point: implementation details matter. A policy change may appear straightforward on paper, but the operational impact can look very different once it reaches a dealership, a customer, a lender, or a county tax office. Dealers are already thinking about how to communicate with customers, how to identify accounts that may be affected, how to prepare for renewals before the January 2027 date, and how to manage uncertainty when guidance does not yet answer every practical question. The town halls also gave TIADA an opportunity to recap the association’s engagement on the issue. Since the proposed Texas ID requirement changes first emerged, TIADA has submitted formal comments, worked with industry partners, engaged policymakers and agency staff, and continued to raise practical concerns on behalf of independent dealers. The goal throughout the process has been to protect dealer operations, reduce disruption, and push for clarity where questions remain. While the Texas ID requirements drew much of the discussion, the meetings also included important updates related to the Office of Consumer Credit Commissioner. TIADA shared information on the new annual revenue report requirement, the association’s work with OCCC and DMS providers, and the transition from ALECS to NMLS for license renewals.
40
The OCCC updates were another reminder that compliance issues often depend on implementation. Dealers need to understand what is required, but they also need practical systems and processes that allow them to meet those requirements without creating unnecessary confusion or burden. TIADA’s recent work with OCCC and DMS providers has focused on helping identify those practical challenges and encouraging solutions that work for dealers in the real world. Although many of the questions at the town halls focused on Texas ID requirements, the OCCC discussion gave dealers another opportunity to stay ahead of important compliance obligations and better understand what may be coming next. For many attendees, the meetings served as a timely reminder that regulatory changes rarely happen in isolation. Title and registration issues, finance compliance, license renewals, reporting requirements, and customer communication all affect dealership operations in different ways. Just as important as the formal updates were the conversations around them. Questions from one dealer often led to broader discussion among others in the room, highlighting concerns or practical scenarios that may not be obvious until dealers begin talking through them together. In some cases, those conversations helped clarify misunderstandings. In others, they identified areas where additional guidance or follow-up may be needed. That exchange is one of the reasons in-person meetings remain valuable. Emails, bulletins, webinars, and written updates all have an important place, but they cannot fully replace the benefit of dealers gathering in the same room to ask questions and learn from one another. A dealer in one market may raise a concern that applies to many others. A question about one issue may lead to a broader conversation that helps others think differently about their own processes. The Big Texas Tour also reinforced the importance of TIADA’s role in gathering dealer feedback, identifying areas where additional clarity is needed, and keeping independent dealers connected as regulatory and operational issues continue to evolve. The association’s work is strongest when it is informed by what dealers are actually experiencing, not just what appears in a rule, memo, or agency update. TIADA appreciates the dealers who took time away from their businesses to attend, as well as the sponsors, hosts, board members, tax assessor-collector representatives, and industry partners who helped make each meeting possible. These events require time and coordination, and they are only successful when dealers and partners are willing to show up, participate, and share their perspective. As these issues continue to develop, TIADA will keep working to provide updates, share dealer feedback with key stakeholders, and help independent dealers prepare for what comes next. T e x a s

The FTC’s Crackdown on Dealership Advertising on Social Media: What Dealers Need to Know by Gabrielle Faust
TIADA Marketing Coordinator
S
ocial media has become one of the most powerful marketing tools for automotive dealerships. Platforms like Facebook, Instagram, TikTok, and YouTube allow dealers to reach thousands of potential buyers with targeted ads promoting vehicle prices, financing offers, lease specials, and trade-in incentives. However, as social media advertising has expanded, so has regulatory scrutiny. The U.S. Federal Trade Commission (FTC) has increasingly focused on dealership advertising practices, particularly those that may mislead consumers about vehicle pricing, financing terms, fees, and availability. Recent enforcement actions signal that dealerships must exercise greater caution when promoting vehicles and offers online. The FTC states that advertising disclosures must remain clear and conspicuous regardless of the platform used. According to the agency, consumers should be able to understand the true cost of a vehicle and the actual terms of any financing offer before visiting a dealership.

97 Dealers. One Warning Letter.
In March of 2026 the FTC sent official warning letters to 97 different automotive dealerships across the United States. In this letter, the organization called out these businesses for possible deceptive advertising practices within their social media content. The letter focused on “prices for cars that are lower than what [you] actually charge consumers”. The letter went on to state, “Such deceptive tactics harm not only consumers, but competition, by making it hard for lawabiding businesses to compete on an even playing field.” For example, a social media ad may highlight a vehicle at a specific price but omit documentation fees, dealerinstalled accessories, or other costs that significantly increase the final purchase price. Or a bait and switch may occur where a “too-good-to-be-true” priced vehicle is suddenly not available when the consumer arrives to the dealership and the customer is talked into a much more expensive car. 43
The FTC has also scrutinized dealerships that advertise attractive financing terms without clearly explaining eligibility requirements. Advertising that promotes extremely low monthly payments, zero-percent financing, no-money-down offers and guaranteed financing without disclosing eligibility requirements may attract regulatory attention if consumers are unlikely to qualify for the advertised terms. Dealers must ensure that financing claims accurately reflect available programs and clearly disclose important limitations.
How False Advertising Affects Consumers
C onsumers cannot comparison shop or make informed decisions. C onsumers are placed in financially uncomfortable purchasing situations. H onest dealers must try to match imaginary pricing or lose possible customers.
What You Post Lives Forever. And the FTC is Watching.
Unlike traditional newspaper or television advertisements, social media content is often brief and highly visual. While these formats can increase engagement, they also create compliance risks. Disclosures hidden in captions, difficult-to-read graphics, or rapidly disappearing content may not satisfy regulatory requirements.

You may have heard the saying “what’s posted on the internet lives forever”? There is truth in this statement. Even though social media may seem fast and fleeting as users scroll on their devices, the content itself leaves a footprint, even long after it has been deleted. One the FTC is keen to track. Just remember, when advertising pricing, honesty is always the best policy.
Best Practices for Dealership Social Media Advertising
To reduce compliance risk, dealerships should consider the following practices:
1
Make Pricing Transparent
Advertised prices should accurately reflect the amount consumers can reasonably expect to pay. Any exclusions, qualifications, or mandatory fees should be clearly disclosed.
2
Clearly Explain Financing Terms
3
Review Every Platform Separately
4
Monitor Third-Party Marketing Vendors
5
Maintain Documentation
When promoting financing offers, dealerships should disclose key conditions, eligibility requirements, and material limitations in language consumers can easily understand. What works in a print ad may not satisfy disclosure requirements on Instagram or TikTok. Each platform’s format should be evaluated to ensure required information remains visible and understandable. Many dealerships outsource digital advertising to agencies or lead-generation companies. However, regulators generally hold dealerships responsible for advertisements promoting their inventory and services.
Keeping records of advertisements, disclosures, and approval processes can help demonstrate good-faith compliance efforts if questions arise later.
Looking Ahead
The FTC’s heightened focus on automotive advertising reflects a broader trend toward greater oversight of digital marketing practices. As social media continues to influence vehicle purchasing decisions, dealerships should expect regulators to closely monitor online promotions for accuracy and transparency. Successful dealerships will be those that balance creative marketing with strong compliance controls. Clear disclosures, honest pricing, and transparent financing information not only reduce legal risk but also help build long-term trust with consumers.

The Modern Independent Dealer: Adapting to Today’s Retail Auto Industry by Angel Arellano Ikenna Auto Sales
T
he retail automotive industry has changed dramatically over the last few years, and independent dealers are feeling those changes every single day. Between evolving customer expectations, rising interest rates, tighter affordability, and increased competition online, success in today’s market requires more than just selling cars it requires adaptability, discipline, and strong relationships. As independent dealers, we are no strangers to challenges. In fact, one of the biggest strengths of our industry is the ability to evolve quickly and continue finding opportunities even in uncertain markets.
and a smooth process from start to finish. Affordability also continues to be one of the biggest challenges in the market today. Higher interest rates and increased living costs have made monthly payments a major concern for many consumers. Dealers are seeing customers shop more carefully, take longer to make decisions, and compare multiple dealerships before moving forward. At the same time, inventory remains competitive particularly in the affordable, reliable vehicle segment. While overall availability has improved compared to previous years, sourcing quality inventory at the right price is still one of the biggest factors that impacts profitability.
What We’re Seeing on the Retail Side
Strategies That Continue to Work
Today’s customer is more educated and more cautious than ever before. Most buyers are spending significant time online before they ever submit a lead or visit the dealership. They are comparing prices, researching vehicle history reports, checking reviews, and analyzing financing options ahead of time. Because of this, transparency has become one of the most important factors in earning customer trust. Customers want accurate pricing, clear communication, July/Special 2026

In a market like this, consistency and operational discipline matter more than ever.
Market-Based Pricing
Customers today know when a vehicle is overpriced within minutes. Pricing inventory correctly from the beginning creates more engagement, stronger lead flow, and faster turns. Holding onto inventory too long in hopes of maximizing gross can often create more risk than reward. 45
Speed and Communication
Response time continues to separate successful dealerships from struggling ones. Customers expect quick answers, accurate information, and professional communication. Whether it is phone calls, social media inquiries, or internet leads, speed matters.
Focus on Customer Experience
Independent dealers have a unique advantage because we can provide a more personal experience. Building trust, treating customers with respect, and creating a transparent buying process helps generate repeat business and referrals which remain some of the strongest drivers of long-term growth.
Leveraging Technology
Digital retailing tools, CRM systems, inventory management software, and social media marketing have become essential parts of modern dealership operations. Dealers who embrace technology and adapt to changing consumer behavior are positioning themselves for long-term success.
The Importance of Industry Relationships
Organizations like Texas Independent Automobile Dealers Association continue to provide tremendous
46
value to independent dealers across the state. From compliance education to networking opportunities and legislative updates, these resources help dealers stay informed and protected in an ever-changing environment. Equally important is the collaboration between dealers themselves. One of the greatest strengths of the independent dealer community is the willingness to help each other grow, share knowledge, and support the industry as a whole.
Final Thoughts
There is no question that today’s retail auto market is challenging but there is also tremendous opportunity for dealers who stay proactive, disciplined, and customer-focused. The dealers who continue to evolve, embrace technology, build strong relationships, and maintain operational consistency will continue to stand out in this industry. At the end of the day, independent dealers are resilient. We have always found ways to adapt, overcome obstacles, and continue serving our communities. By staying united, sharing resources, and pushing each other forward, we strengthen not only our dealerships but the entire independent dealer industry.

250 Years of American Mobility: How Transportation Helped Shape a Nation by Gabrielle Faust
TIADA Marketing Coordinator
A
s the United States celebrates its 250th anniversary in 2026, Americans have an opportunity to reflect not only on the nation’s political evolution but also on the ways people, goods, and ideas have moved across the continent. From horse-drawn wagons traveling rough colonial roads to electric vehicles navigating smart highways, the history of transportation in America is inseparable from the history of the nation itself. For 250 years, advances in mobility have expanded economic opportunity, strengthened national unity, fueled industrial growth, and transformed daily life. The story of America is, in many ways, a story of movement.
The Colonial Era: Roads to Independence
When the United States declared independence in 1776, transportation was slow, difficult, and often unreliable. Most Americans traveled on foot, horseback, or in horse-drawn carriages. Roads were little more than July/Special 2026

dirt paths connecting towns and settlements, becoming muddy and nearly impassable during bad weather. Despite these limitations, transportation played a crucial role in the nation’s founding. Colonial roads enabled communication among the thirteen colonies, helping spread revolutionary ideas and coordinate political action. Riders carrying messages between cities and military leaders became vital links in the struggle for independence. Waterways were equally important. Rivers and coastal shipping routes served as the highways of the 18th century, moving people and goods more efficiently than overland travel. Ports became centers of commerce and political activity, helping establish the economic foundations of the young nation.
Canals and Railroads Open the Frontier
The early 19th century brought dramatic improvements 49
in transportation infrastructure. New roads connected growing communities, while ambitious canal projects transformed trade and settlement patterns. The opening of the Erie Canal in 1825 linked the Atlantic Ocean to the Great Lakes, reducing transportation costs and accelerating westward expansion. Farmers could ship crops more efficiently, manufacturers gained access to new markets, and cities throughout the Northeast experienced rapid growth. Soon, railroads began to surpass canals as the dominant mode of long-distance transportation. By the mid-1800s, rail networks stretched across much of the country, shrinking travel times from weeks to days. The completion of the first transcontinental railroad in 1869 physically connected the East and West Coasts, helping unify a nation still recovering from the Civil War. Railroads transformed the American economy. They enabled large-scale industrialization, facilitated migration, and encouraged the development of new towns and cities. They also helped establish standardized time zones, illustrating how transportation innovations often reshaped society beyond the movement of people and goods.
The Automobile Revolution
Few inventions have influenced American life as profoundly as the automobile. At the dawn of the 20th century, cars were luxury items owned by relatively few Americans. That changed dramatically when mass production techniques made vehicles affordable to the average family. Assembly-line manufacturing reduced costs and increased output, ushering in a new era of personal mobility.
communities expanded around metropolitan areas, and road construction became a national priority. The automobile became more than a mode of transportation— it became a symbol of independence, opportunity, and personal freedom.
Highways and a Connected Nation
The growth of automobile ownership led to one of the most ambitious infrastructure projects in American history: the Interstate Highway System. Authorized in 1956, the interstate network connected cities, regions, and states through thousands of miles of high-speed roadways. The system improved commerce, enhanced national defense capabilities, and fundamentally changed how Americans traveled. Businesses could move products more efficiently across the country. Families embraced long-distance road trips, creating a uniquely American travel culture. Tourism flourished as national parks, historic landmarks, and small towns became more accessible. The interstate system reinforced the nation’s economic integration at a time when the United States was emerging as a global industrial leader. Mobility became a key driver of prosperity and growth.
Flight Shrinks the Nation
The automobile gave Americans unprecedented freedom. Families could travel farther, live farther from where they worked, and explore parts of the country that had previously been difficult to reach. Entire industries emerged to support automobile ownership, including service stations, motels, restaurants, insurance companies, and roadside attractions. Cars also reshaped the American landscape. Suburban 50
While automobiles transformed local and regional travel, aviation revolutionized long-distance transportation. Commercial air travel expanded rapidly after World War II, connecting cities and regions that once seemed separated by vast distances. Journeys that had taken days by rail or car could now be completed in hours. Air transportation strengthened business relationships, encouraged tourism, and helped integrate the national economy. It also connected the United States more closely to the rest of the world, supporting trade, diplomacy, and cultural exchange. Today, aviation remains an essential component of American mobility, transporting millions of passengers and billions of dollars in goods each year. T e x a s

The Digital Age of Transportation
The late 20th and early 21st centuries introduced technologies that transformed not just vehicles, but the entire transportation experience. Global positioning systems eliminated the need for paper maps. Smartphones enabled real-time navigation, ride-sharing services, and instant access to transportation information. Logistics networks became increasingly sophisticated, allowing goods to move through global supply chains with remarkable efficiency. Technology has made transportation more connected, predictable, and convenient than ever before. Americans can now track deliveries, avoid traffic congestion, and coordinate travel with a level of precision unimaginable to previous generations. The digital revolution has changed mobility from a purely physical challenge into an information-driven system.
The transition is still evolving, but it represents another chapter in America’s long history of transportation innovation.
Looking Ahead: Autonomous Mobility
The next frontier may be autonomous transportation. Self-driving technologies are being tested and deployed in various forms across the country. While fully autonomous transportation remains a work in progress, advances in sensors, artificial intelligence, and vehicle connectivity continue to push the industry forward. Autonomous vehicles have the potential to improve safety, expand mobility for older adults and people with disabilities, reduce congestion, and transform freight transportation. Like the railroad, automobile, and airplane before them, these technologies could reshape both the economy and everyday life. Their ultimate impact remains uncertain, but they represent the latest example of America’s ongoing pursuit of greater mobility and connectivity.
Mobility and the American Story The Rise of Electric Vehicles
In the 21st century America, and the world witnessed the innovation of electric vehicles. While these vehicles are popular with the American consumer, the model of transportation has faced difficulties in expansion due to a fundamental lack in the recharging infrastructure necessary to fully support EVs. As concerns over energy security and environmental sustainability continue to be a dominate concern for many citizens, for now the traditional gas-fueled automobile is the mainstay for a predominant number of households. However, just as previous generations invested in canals, railroads, and highways, today’s investments in charging networks and clean-energy transportation infrastructure may shape mobility for decades to come. Throughout the nation’s history, transportation has done more than move people from one place to another. It has helped define the American experience. Roads connected colonies and supported independence. Canals and railroads opened new frontiers and fueled economic growth. Automobiles transformed communities and lifestyles. Highways united regions. Aviation shrank distances. Digital technologies redefined convenience. Electric and autonomous vehicles are now charting the course toward the future. As the United States marks 250 years of nationhood, the evolution of mobility offers a powerful reminder that progress has often depended on the ability to connect people, places, and opportunities. The history of American transportation is not merely a story of machines and infrastructure — it is the story of a nation constantly moving forward. 51

Dealer Questions Drive the Work
T
IADA recently completed four Big Texas Tour town hall meetings in Dallas, San Antonio, Houston, and Donna. Each event covered important updates affecting Texas’ independent dealers, including the updated ID requirements, the upcoming January 1, 2027 implementation date for registration renewals, OCCC reporting, the transition from ALECS to NMLS, and other operational issues facing dealers across the state. Being able to inform and educate our membership about these topics is extremely important and a large part of what we do to support dealers across the state. And, in turn, we were there to answer the questions that resulted from our talk. Some of the most pertinent questions voiced were in regard to topics such as customer communication, renewal timing, acceptable identification, and lienholder concerns. They were especially concerned about what these changes could look like once they reached the dealership level. When considering reporting requirements, they were curious how they would work within real systems and what preparation they should begin immediately.
Jennings TIADA EXECUTIVE DIRECTOR
And we were more than happy to address each of their concerns and uncertainties to the best of our ability. Afterall what sounds often like an amorphous concept, the reality of the nitty-gritty boots on the ground implementation means having to take into account their customers, staff, portfolios, and processes to ensure everything flows smoothly. That is why member feedback is so important to TIADA’s work. The association can monitor rules, review agency guidance, participate in meetings, and communicate with policymakers, regulators, and industry partners. All that work matters. But hearing directly from dealers helps us understand where the practical challenges are, where confusion remains, and where additional clarity may be needed. Dealer questions help inform the questions TIADA asks in agency conversations. They help guide the resources we develop for members. They help us know what needs to be explained more clearly in webinars, articles, alerts, and conference sessions. They also help us better represent the independent dealer perspective when decisions are being discussed or implemented. (cont’d on pg. 58)

That is especially important in a year when so many issues are moving at once. Title and registration requirements, finance compliance, reporting obligations, technology changes, and customer communication challenges do not exist in separate boxes inside a dealership. They overlap. They affect staff time, customer experience, deal flow, and business planning. Dealers are often the first to see those intersections because they are the ones who have to make the process work. Whether it happens at our annual Conference, a town hall, a committee meeting, a phone call, or an email exchange with a member, open discussions about the concerns of our dealer Members is tantamount to TIADA’s mission to advocate for independent dealers across the state of Texas. Your feedback keeps our organization connected through a heightened awareness of the microscopic details that might otherwise be overlooked. Because no one knows how your business runs like you do, and how policy and regulation changes impact your ability to make sales. Thank you to everyone who attended a Big Texas Tour meeting, asked a question, shared a concern, or helped us better understand what dealers are working through. TIADA’s job is not just to provide information. It is to listen to what dealers are experiencing, carry those concerns forward, and help the industry prepare for what comes next.
