Justice Secretary Menardo Guevarra said local government units (LGUs) may not need to wait for a law to be enacted by Congress to implement mandatory vaccination against COVID-19 within their jurisdiction. “Local government units, through their legislative organs, may also exercise police power. For example, a local ordinance prohibiting video game arcades within a certain distance from schools is an exercise of police power,” Guevarra said in a text message. “Theoretically, a local ordinance compelling all residents within the territory of the LGU to get themselves vaccinated against COVID-19 may be enacted even without a national law,” he added. However, like any other law, Guevarra said, the legality or constitutionality of the ordinance may be questioned before a court. “But like all other laws and ordinances invoking police power, it may be challenged in court by anyone on the issue of reasonableness, among others,” he said. PH protests latest China sea foray Hefty LPG price FOREIGN Secretary Teodoro Locsin Jr. on Thursday ordered the filing ofthree new diplomatic protests against China over a series of unlawful actions taken by Beijing in the West Philippine Sea. In a string of tweets on Thursday, Locsin said he wanted separate protests filed on China’s radio challenges issued against Philippine maritime patrols, the unlawful restriction of Filipino fishermen from Bajo de Masinloc (Scarborough Shoal), and the continued presence of Chinese ships in the vicinity of Iroquois Reef, some 125 nauticalmiles off the coast of Palawan. Scarborough Shoal, located 124

nautical miles off the coast of Masinloc, Zambales, is a traditional fishing ground for Filipinos and other nationals. Locsin did not disclose further details about the latest Chinese incursions. The fresh diplomatic protests follow a flurry of notes verbale lodged by the DFA early this year over Beijing's continued and increased presence within Philippine waters. ‘PH economy to take 10 years to recover’

T

HE Philippine economy will take more than a decade to return to pre-pandemic growth, an official said Thursday, warning the next two generations of Filipinos would be paying for the cost of COVID-19.

Lockdowns and other restrictions aimed at slowing the spread of the coronavirus have shattered the Southeast Asian nation's economy, throwing millions out of work and leaving many poor families hungry. "Our long run total cost of COVID

and the quarantine both to the present and future society – meaning our children and our grandchildren – will reach P41.4 trillion,” Economic Planning Secretary Karl Kendrick Chua said. The figure is more than twice the

country's gross domestic product in 2020, which the World Bank estimates at $361.5 billion. The economy is expected to expand by four to five percent this year, Chua said, compared with a record contraction of 9.6 percent in 2020. But it would take 10 years before the country returned to pre-pandemic growth, which averaged 6.4 percent in the 10 years before COVID-19 hit. Nearly 70 percent of the economy,

Without an enabling law, Guevarra said the government may only urge, persuade or try to convince people to heed its call to get vaccinated. Quezon City Mayor Joy Belmonte, for her part, said passing such an ordinance is not a priority since vaccine hesitancy is low in Metro Manila's biggest city. "It has become so much easier to convince people since the Delta surge occurred. So at present, speaking on behalf of Quezon City, I do not see this as a priority measure in terms of legislation," Belmonte told Manila Standard in a text message. "We are also actively setting up community vaccination sites that are located in our urban poor communities to encourage more people to be vaccinated by bringing the service to them," Belmonte added.

The Philippines has already administered a total of 45,147,477 doses of COVID-19 vaccines nationwide, the government's task force on the pandemic response said on Thursday. Based on the data from the National Covid-19 Vaccination dashboard, as of Sept. 29, a total of 21,103,317 Filipinos have already acquired full protection against the dreaded disease, while 24,044,260 are waiting to get their second dose. The average daily jabs administered in the last seven days stood at 353,774 doses. National Task Force (NTF) against COVID-19 chief implementer Secretary Carlito Galvez Jr. said the government has allotted 29 million doses for the vaccination of minors aged 12 to 17 years old.

The inoculation of adolescents will be piloted in five identified hospitals in Metro Manila. Children with comorbidities will be prioritized in the test run of pediatric vaccination. The Philippines has received a total of 71,324,50 doses of COVID-19 vaccines as of Sept. 30, with additional 883,350 Pfizer doses and another 2.5 million Sinovac --both purchased by the government – will be delivered on Friday. Galvez said a total of 6,085,170 doses out of the 40 million doses of government-procured Pfizer jabs have been delivered to the country. The country's Food and Drug Administration has initially approved the use of Pfizer and Moderna for pediatric vaccination, which will start on Oct. 15.

Meanwhile, placed under Modified Enhanced Community Quarantine (MECQ) from October 1 to 15 are Apayao, Kalinga, Batanes, Bataan, Bulacan, Cavite, Lucena City, Rizal, Laguna, Naga City, and Iloilo Province. Areas placed under General Community Quarantine with heightened restrictions from October 1 to 31 are Abra, Baguio City, Ilocos Sur, Pangasinan, Cagayan, Isabela, City of Santiago, Nueva Vizcaya, Quirino, Quezon, Batangas, Bacolod City, Capiz, Iloilo City, Lapu-Lapu City, Negros Oriental, Bohol, Zamboanga del Norte, Zamboanga del Sur, Cagayan de Oro City, Misamis Oriental, Davao del Norte, Davao Occidental, Butuan City and Surigao del Sur. Davao de Oro will also be under GCQ with heightened restrictions but only from October 1 to 15. Under “regular” GCQ from October 1 to 31 are Ilocos Norte, Dagupan City, Benguet, Ifugao, Tarlac, Marinduque, Occidental Mindoro, Oriental Mindoro, Puerto Princesa City, Albay and Camarines Norte for Luzon. For Visayas, GCQ areas are Aklan, Antique, Guimaras, Negros Occidental, Cebu City, Cebu Province, Mandaue City, Siquijor and Tacloban City. In Mindanao, GCQ areas are

Zamboanga Sibugay, Zamboanga City, Misamis Occidental, Iligan City, Davao City, Davao Oriental, Davao del Sur, General Santos City, Sultan Kudarat, Sarangani, North Cotabato, South Cotabato, Agusan del Norte, Agusan del Sur, Dinagat Islands, Surigao del Norte, Cotabato City, and Lanao del Sur. The rest of the country will be under a Modified GCQ, the lightest restriction level. The Philippines logged 14,286 new COVID-19 cases on Thursday, bringing the total number of infections to 2,549,966. There were 130 new deaths reported, bringing the COVID-19 death toll to 38,294. The DOH also reported 8,26 new recoveries, bringing total recoveries to 2,373,378. The IATF also released its updated list of countries/jurisdictions/territories that belong to the Red, Yellow, and Green List for October 1-15, with Bermuda the only country on the Red List, while 49 countries remain in the Green List. The Private Hospitals Association of the Philippines (PHAPi) earlier urged a two-week extension of Alert Level 4 in the NCR, saying it was too early to say if the number of COVID-19 cases was really going down. Some business groups, on the other

hand, asked that the NCR be put under Alert Level 3 in the fourth quarter. Trade Secretary Ramon Lopez, meanwhile, said he wants to open up more businesses, including micro, small and medium enterprises (MSMEs) at all alert levels subject to operating capacity limits especially as the holiday nears. Lopez said he wants more businesses to open but without sacrificing the minimum health standards imposed by the government. He said opening up businesses may still need an exclusion list, but a shorter one, "for the high-risk non-essentials." probe, saying "Smuggled agricultural produce may contain invasive pests and host various diseases. The exposure of other food products to these goods poses a serious threat to the health of our people, the productivity of the agriculture sector, and our country's food security," he said. "As an example, smuggled pork from China was the culprit behind the recent outbreak of African Swine Fever in the country," he said in Proposed Senate Resolution 922. Assistant Majority Leader and Rizal Rep. Fidel Nograles, for his part, cited the need for immediate government intervention on the reports of smuggled carrots flooding NCR, Cebu, and Cagayan de Oro markets amidst the complaints of affected farmers and agricultural traders. “We should be alarmed with all these

reports. Our farmers are still reeling from the effects of low demand due the pandemic-related economic slowdown, and then unfair competition suddenly slaps them. This is too much for Philippine agriculture and we are hoping that the Department of Agriculture will act swiftly,” said Nograles. Earlier, Lorna Menzi, a vegetable dealer from Benguet, told the media that demand for carrots dwindled and farm gate prices decreased due to the proliferation of cheap smuggled carrots. She also said that farmers are wary that rumors are circulating that smuggled broccoli and cauliflower will be the next ones to flood local markets. Nograles warned that if not solved immediately, this will cause tons of local produce to rot. “We call on the DA not to let this

happen. Our farmers have already tried to compete with the smuggled goods by lowering their margins but they can only do so much. The solution lies in how fast the government will be able to help them by stopping the influx of unfair competition,” he added. Agriculture Secretary William Dar earlier warned the public against buying smuggled vegetables due to the possible pesticide residue even as his agency has ordered the confiscation of all shipments that entered the country without the necessary permits. Pangilinan, citing Republic Act 10845 or the Anti-Agricultural Smuggling Act of 2016, called on the government to perform its duty to protect the agriculture sector, the local farmers, and the public from the manipulative schemes of economic saboteurs. sion on Elections reminded aspirants for national positions in next year's elections that they were only allowed to have three companions when filing their certificates of candidacy which will start today (Friday). “For candidates from the president to senators, we allow a maximum of three companions,” Comelec chairperson Sheriff Abas said in a television interview. “For party-lists, we only allow two representatives. We will regulate the flow of candidates one at a time,” he added. He said they would entertain candidates on a "first come, first served" basis. “Those who arrive first will be allowed to enter the venue first,” Abas added. The filing of COCs for president, vice president, senator, and party-list representative will be held at the Sofitel Garden Tent in Pasay City. Meanwhile, the filing of COCs for local positions will be held at local Comelec offices in cities and municipalities.

Abas also reminded candidates that those who would be allowed at the Sofitel Garden Tent must present a negative antigen or RT-PCR test result taken within 24 hours. “The filing area is located in Pasay City. We already have a layout, before you enter, they need to show us the negative result. If they did not bring a result. We have an antigen testing booth onsite,” Abas said. In case an aspirant has symptoms, he/ she will be brought to an isolated area where medical personnel will attend to him/her. A duly authorized representative will be allowed to file the COC on his/her behalf. “We have an ambulance on standby, just in case it is needed. We also have coordinated with the Armed Forces of the Philippines and Philippine National Police for security, Metro Manila Development Authority for traffic. Our partner agencies

are all ready for the one-week long filing of COCs,” he added. The Comelec chief said they ordered their people in the field to look for big spaces in the province or municipalities where to hold the filing process. “We have an order to our personnel to find suitable and big areas within the municipality or province. They were also given an order to meet the minimum health protocol, especially social distancing,” he added. On the other hand, Comelec spokesperson James Jimenez said they decided to change the venue for the filing period for the security of the aspirants and also to prevent crowding. “We located it there to provide better security for our filers, prevent crowds from forming outside the filling area. One of the main things of the filing of COCs this year is that we really went to a great extent to make sure that the filing would be sober,” he added.

exercise the state’s police power to compel people to get vaccinated. But Guevarra pointed out that a law is required if sanctions or penalties would be imposed in the exercise of police power. “The President correctly invoked police power as the basis to compel… vaccination for everyone except those who have valid reasons. The power rests upon the inherent right of the State and the people to self-protection,” he said. “But this power, especially if accompanied by penalties or sanctions to enforce obedience or compliance, must be exercised through the legislature,” he added.

The task force also approved the reopening of fitness studios and gyms at a limited 20-percent capacity for fully vaccinated individuals, provided that all gym workers should also be fully vaccinated. Also approved by the IATF is the pilot rollout of the vaccination of children ages 12 to 17 years old with vaccines granted Emergency Use Authorization by the Food and Drug Administration. The inoculations will begin also on October 15 under a phased approach “as may be determined by the National Vaccination Operations Center.” Following the directives of President Rodrigo Duterte, the IATF also affirmed the opening of the national vaccination program to the general population nationwide “upon the determination of the National Task Force Against COVID-19 and its Vaccine Cluster.”

including 23.3 million workers, remained under "heightened quarantine" restrictions, Chua said. He warned lockdowns caused greater hunger and were not the answer to the pandemic. The Philippines has recorded more than 2.5 million infections, including over 38,000 deaths. Just over a quarter of the adult population has been fully vaccinated amid a delayed and slow vaccination rollout. AFP

COVID NEWS BRIEF FDA: Beware online vax sale

THE Food and Drug Administration on Thursday warned the public against buying branded coronavirus disease (COVID-19) vaccines sold on online selling platforms and social media. Based on its advisory dated September 30, the FDA said the scheme was a “scam” used to attract buyers with preferred brands like AstraZeneca, Pfizer, and Moderna. “The public is advised that this is a scam which uses online platforms and social media to attract buyers, especially those who have preference on the brand of vaccines, specifically our countrymen who work abroad (OFWs),” the FDA said.

Supreme Court workforce

THE Supreme Court announced that only 15 percent of its total workforce would still be required to report physically from 9 am to 3 pm starting today, (October 1), despite the “any modification of the alert level guidelines in Metro Manila.” In a circular, Chief Justice Alexander Gesmundo stressed that officials and personnel who will not report physically will work from home as required. The top magistrate also said that personnel who were required to report physically but who reside in areas under granular lockdown or in critical zones should be replaced by those residing in areas under lower alert levels.

'Not the worst'

THE Philippines is not the worst when it comes to COVID-19 resilience, because the Bloomberg report did not include all the countries in the world, according to Malacanang. Presidential spokesman Harry Roque said the recent COVID-19 resilience ranking placed the Philippines at the bottom of Bloomberg’s COVID Resilience Ranking because it only surveyed 53 countries when in fact there are 194 countries. “There are 194 countries in the world but only 53 were surveyed. We are not the last in the world, we just ranked last among those surveyed," Roque said. “Bloomberg said the Philippines only had a vaccine coverage rate of 20 percent, among the lowest of those ranked. It is also 'engaged in one of the most stringent lockdowns' and its borders remain sealed to visitors. Perhaps where we can agree is they are testing economic resilience. Every time we go on lockdown, the economy closes and there is no economic resilience,” he said.

Additional benefits

SENATOR Joel Villanueva pushed the passage of a bill that would institutionalize additional benefits for health workers, saying action should speak louder than words in giving honor to those who put their lives on the line in the battle against COVID-19. “We can shower our health care workers with words of admiration, praises and all kinds of love languages. I am sure that they will appreciate it. But action speaks louder than words," he said. “From the very beginning when we have yet to know the gravity of the COVID-19 pandemic, when we thought the lockdown would end after two weeks, our health care workers answered the call of duty and continue to do so,” added Villanueva. ‘La Niña may elevate risk for floods, landslides’ THE La Niña phenomenon’s possible re-emergence this year may elevate the risk for flooding and rain-induced landslides, particularly in the country’s eastern seaboard, the state weather bureau said. Various weather systems, including the northeast monsoon or “amihan” that prevails annually during the latter part of the year, could bring rains that might trigger such hazards in the area and other parts of the country, Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) hydrologist Richard Orendain said Thursday. “(The) onslaught of La Niña is an additional trigger for elevating the flooding and landslide risk,” he said. In its latest assessment this month, PAGASA said there is a 70 to 80 percent chance for La Niña’s formation during the last quarter of 2021. Orendain said the eastern seaboard directly faces the Pacific Ocean where tropical cyclones that may affect the country usually originate. PAGASA said monsoon activity and winds from the east are stronger during La Niña. The development of more tropical cyclones and the occurrence of abovenormal rainfall due to increased cloud formation are among La Niña’s effects on Philippine climate, it said. According to the weather bureau, most parts of the country may receive above-normal rainfall from October to December this year. La Niña may persist until the first quarter of 2022, PAGASA’s assessment showed.

Pharmally exec a no-show at Senate hearing By Macon Ramos-Araneta PHARMALLY Pharmaceutical Corp. executive Krizle Grace Mago, who admitted that her firm “swindled” the government over the procurement of medical grade face shields for health workers, skipped yesterday’s continuation of the Senate probe on the multi-billion peso contract. Senate Blue Ribbon director general Noel Quimbo told committee chairman Senator Richard Gordon that Mago, considered a “material witness” was not present. “She’s missing, neither has she emailed the blue ribbon that she was going to attend,” Quimbo said. Mago also failed to send an email to confirm her attendance, Quimbo added. Gordon then directed the Office of the Sergeant-At-Arms to locate Mago’s whereabouts, stressing that she is more than just somebody who appears to be a clerk. “I think she knows a lot more and she does a lot more for Pharmally,” Gordon said. Last week, Mago admitted her company tampered with the expiry dates of the face shields delivered to the Department of Health. Another material witness, Linconn Ong, the firm’s director, attended the probe despite his previous request not to attend further hearings. However, his counsel, Ferdinand Topacio, said Ong was being forced to attend the proceeding. “Our client, Linconn Ong, is being physically forced to attend the Blue Ribbon committee hearing. He has the right not to participate. No matter what he says, he will just be put in contempt, humiliated, and his character assassinated,” Topacio said.

Palace eyes deferred SSS premium hike

T

HE Office of the President is studying a proposal to defer the increase in the monthly contributions of Social Security System (SSS) members, Malacañang said on Thursday. This after business and labor groups have asked President Rodrigo Duterte to issue an executive order (EO) postponing the SSS contribution hike. “The Office of the President is already studying that [proposal]. The SSS has already submitted a recommendation,” presidential Spokesperson Harry Roque said. Roque said the OP would decide in view of the financial viability of SSS and the plight of businesses. “We are looking at the financial vi-

ability of the SSS, and at the same time, the weakness of businesses amid the pandemic. So, expect the decision to come out as soon as possible,” he added. The heads of at least 10 private sector and labor organizations signed a joint letter dated September 27, urging Duterte to take urgent action on the pending request for deferment of the scheduled hike in SSS premium contributions. They said an EO is still needed despite the signing of Republic Act No. 11548 to

implement the postponement of the increase in SSS contributions. RA 11548 amends the Social Security Act of 2018 to allow the President to defer the scheduled hike in SSS premium contributions in times of national emergency and for the duration of a state of calamity. The deferment of the SSS contribution hike, they said, will provide relief to micro, small and medium enterprises that are still struggling amid the prevailing COVID-19 pandemic. SSS members’ monthly contributions were raised in January 2021 to 13 percent from the previous 12 percent. The next schedule for the SSS contribution hike will be in 2023 and 2025 to bring the rate to 15 percent by the end of the period.

A PARTY-LIST lawmaker on Thursday questioned the increase in the budget for traveling expenses of the Office of the President under 2022 national budget During the plenary deliberations Thursday, ACT Teachers party-list Rep. France Castro took note of the OP’s proposed P8.18 billion budget for next year, which includes an increase in its travel funds amid the pandemic. Castro pointed out that the OP’s proposed budget for travel expenses increased to P314.37 for next year from this year’s P283.33 million. In response, Zamboanga del Norte Rep. Romeo Jalosjos Jr., who was sponsoring the proposed budget of the OP, said “cancelled trips” explained why there was an increase in the travel funds. “The increase of almost 11 percent for next year is due to the planned local and foreign travels that [were scheduled in 2021] during the COVID outbreak [which were] canceled,” Jalosjos said. “They are planning to do those travels for next year,” he added. Jalosjos said the proposed increase was intended to “move forward from this pandemic.” “We have to put additional funds so that we can maximize the opening of our economy, to move forward from this pandemic,” Jalosjos said. Meanwhile, House Deputy Minority leader Carlos Isagani Zarate scored the Department of Transportation’s alleged “parked” funds of P1.127 trillion at the Procurement Service of the Department of Budget and Management (PS-DBM). “Parked” funds refer to the practice of listing of items under the budget of a congressional district so that it could be used for a different project in a different district.

MTFI, MWSS officials break ground for La Mesa nursery OUTGOING MWSS chairman Reynaldo Velasco led guests yesterday at the groundbreaking ceremony for the Million Trees Foundation, Inc. (MTFI) plant and saplings nursery at the La Mesa Watershed area. “I am proud to be part of this significant step towards environment sustainability,” Velasco said. Velasco, who ends his stint today as MWSS chief, initiated the Annual Million Tree Challenge (AMTC) project of MWSS aimed at rehabilitating seven critical watersheds – Angat, Ipo,Kaliwa, La Mesa, Laguna Lake, Umiray, and Upper

Marikina, including Manila Bay – that are essential in the water supply chain in Metro Manila and neighboring provinces. The AMTC is on track, achieving more than its target of four million trees in four years. “We have to join hands to address the state of our watersheds as these greatly affect our water supply. I am grateful to the proponents of Million Trees Foundation, Inc. (MTFI) for joining together for a noble cause,” he added, emphasizing that water is not only used to sustain basic life but also to give more quality to the way of living. Velasco also thanked MWSS conces-

sionaires Manila Water, Maynilad, and Luzon Clean Water Development Corporation (LCWDC) as well as other project partners for supporting the AMTC. “AMTC would not have been as successful without the support of the concessionaires and other civic organizations.” The establishment of a plant and tree nursery is an integral component of MTFI programs. THE Bureau of Customs has filed criminal complaints against two importers for their failed attempt to smuggle fake cigarettes and other goods worth P115 million. In a statement, the bureau charges were filed against Goldlink Int’l Subic Inc. for the alleged misdeclaration and unlawful importation of over P111 million worth of counterfeit cigarettes on June 20 and 23, 2021 at the Port of Subic. “Unlawful importation of counterfeit cigarettes is a violation of Republic Act No. 10863, otherwise known as the Customs Modernization and Tariff Act (CMTA), existing circulars of the National Tobacco Administration and the Intellectual Property Code of the Philippines,” the BOC said. Another importer, Lion King Industrial Corporation, is also facing a criminal complaint for the alleged misdeclaration and unlawful importation of hazardous chemicals worth P3.8 million at the Manila International Container Port. “To date, 73 criminal cases have already been filed before the DOJ against 237 individuals and customs brokers,” the bureau said.

PrimeWater addresses pipeline leak problems in San Pedro By Macon Ramos-Araneta SAN PEDRO, Laguna – PrimeWater San Pedro and San Pedro Water District have recently conducted a 4.8kilometer pipe laying activity that included well-drilling and the replacement of old pipes to increase water pressure and address low water supply concerns in some areas of San Pedro following their “Walk the Line” activity last June and July. Under the “Walk the Line” initiative, PrimeWater detects pipeline leaks that affect customer’s water flow and pressure.

“We do this to ensure that we respond to our customer’s concerns as much as we can,” said John Paul Pascual, PrimeWater San Pedro Branch Manager. He said comprehensive leak detection activity gained significant data on water leaks in the piping system, with most of the discoveries found in Southern Heights 2 and 2-A. At least 46 leaks in June and 51 in July have been detected based on reports. Southern Heights 2, along with other areas in San Pedro, have been greatly affected by these concerns due to aging pipes in the area. Pascual said pipeline leakages can be

attributed to many factors like the quality of materials used, location of pipes, and natural wear and tear, among others. Since the water district’s Joint Venture Agreement (JVA) with PrimeWater in 2014 , PrimeWater has worked handin-hand with San Pedro Water District to address the issues. With the completion of their Phase 1 pipe-laying replacement, Pascual said positive feedback has been received from Southern Heights 2 residents. “Sixty percent (60% ) of Southern Heights 2 residents have already experienced the improvement in their service,” he said.

IN BRIEF Bongbong: Better Xmas with vaccines FORMER Sen. Ferdinand “Bongbong” Marcos Jr. is looking forward for a better Christmas season for Filipinos this year, with more citizens vaccinated and protected against contracting severe COVID-19. Marcos also said that herd immunity is achieved when 80 to 90 percent of the population has been vaccinated. Malacanang is hopeful that the country would be closer to achieving that with the vaccination of the general public set to begin in October. “Hopefully our Christmas will be good, more of our countrymen will be vaccinated and protected against the serious case of Covid by December. And we can gradually reopen our economy,” he explained. The former lawmaker called for a more systematic and efficient vaccination roll out, with provincial local governments equipped with the necessary logistics and cold chain requirements for the vaccines. Erap’s sons raring for return to Senate THE two sons of former President Joseph Estrada will stage a comeback in the Senate in next year’s elections, both offering programs to help the country recover from its economic slump due to the COVID-19 pandemic. Former Senators Jinggoy Estrada and JV Ejercito said they got the blessings of their father, who committed to support them. In a Zoom briefing Wednesday night, Estrada noted he opted to run again because he wants to help Filipinos who were rendered jobless due the global health crisis that crippled the economy. The senator, who served as Senate Labor and Dmoloyment committee chairperson, has been known for giving jobs especially to the poor. “I have left pending bills in the Senate that would alleviate the lives of our farmers, workers, OFWs and the other poor Filipinos- the sector of “modern heroes” and the backbone of the economy,” stressed Estrada. Opinion Motion to dismiss vis-a-vis Answer

WHEN a party that is a defendant to a civil case is served with summons and a complaint, the first thing that his or her lawyer needs to decide on is whether to file a Motion to Dismiss or an Answer. It is important to note that the procedural steps to be undertaken by the defendant must be aligned with the facts of the case and his or her defense. The 2019 Amendments to the Rules of Civil Procedure provides that a Motion to Dismiss is a prohibited pleading except on the grounds that: (a) the court has no jurisdiction over the subject matter of the claim; (b) there is another action pending between the same parties for the same cause; and (c) the cause of action (claim) is barred by a prior judgment or by the statute of limitations (prescription) (Section 12, Rule 15).

Ignorance of the law excuses no one. The amended Rules limited the grounds for a Motion to Dismiss to stop its indiscriminate filing. Once denied, a Motion for Reconsideration may be filed, and if further denied a Petition for Certiorari to the next level court may be pursued. This practice had for decades delayed the conduct of the proceedings in the trial courts. To further curb this practice without denying the defendant the immediate dismissal of baseless actions, the 2019 Amendments deleted Rule 16 on Motion to Dismiss and transferred the other grounds to Section 12, Rule 8 as affirmative defenses, in addition to the existing affirmative defenses in Section 5[b], Rule 6. The deleted grounds for a Motion to Dismiss, and which are now just affirmative defenses, are: (a) lack of jurisdiction over the person of the defendant; (b) improper venue for the action; (c) lack of a plaintiff’s legal capacity; (d) a pleading asserting the claim states no cause of action; and (e) instances when a condition precedent has not been complied with (Section 12 (a), Rule 8). The remaining grounds for a Motion to Dismiss were limited to the most essential. These are the same grounds for which the court can, motu proprio, or in its own initiative, dismiss the case (Section 1, Rule 9). With limited grounds for a Motion to Dismiss, the defendant/s will be more inclined to file an Answer resulting in the joinder of issues and leading the parties to pre-trial. The desire to expedite the proceedings without depriving the defendant of the chance to dismiss a frivolous and baseless complaint at the first instance, was achieved when the trial court was given the power to motu proprio resolve the affirmative defenses in the Answer within thirty days from its filing. However, the original affirmative defenses under Section 5(b), first paragraph, Rule 6 (such as fraud, release, payment, illegality, estoppel, and former recovery, among others), may be the subject of a summary

hearing within fifteen days from the filing of an Answer. The affirmative defenses shall be resolved by the court within thirty days from the termination of the summary hearing (Section 12 (d), Rule 8). Interestingly, the denial of affirmative defenses may not be the subject of a motion for reconsideration or petitions for certiorari, prohibition or mandamus; however, these may be among the issues or matters raised in an appeal after a judgment on its merits (Section 12 (e), Rule 8). This provision was introduced to deter the abuse of legal remedies such as petitions for certiorari, prohibition, or mandamus that delay the progress of legal proceedings. Recently, the Supreme Court rendered a decision on the case of Colmenar v. Colmenar involving the application of the 2019 Amended Rules on motu proprio resolution by the court of the affirmative defenses. In the said case, the action was commenced in September 2018 and remained pending when the 2019 Amendments took effect on May 1, 2020. In the same case, Defendant ProFriends filed its answer with an affirmative defense on December 2018; Defendant PEC and Crisanta Realty on January 3, 2019; and Defendant Amaia on February 27, 2020; all before the effectivity of the 2019 Amendments. According to the Supreme Court, Judge Gill should have desisted from applying the 2019 Amendments specifically, Section 12, Rule 8 (G.R. No. 252467, June 21, 2021). The records show that when Judge Gill motu proprio resolved the affirmative defenses on May 22, 2020, the prescribed thirty (30) day period for resolution from the filing of the answer had long expired. It was also inaccurate for Judge Gill to say that she was motu proprio acting on the affirmative defenses when she had already resolved the common affirmative defense of failure to state a cause of action in her Omnibus Order dated February 12, 2020 (G.R. No. 252467, June 21, 2021). In the Omnibus Order, she denied the motions to dismiss and motions to set the affirmative defenses for hearing because in her words, “the issues x x x are complex x x x and are x x x better threshed out in trial.” Furthermore, PEC, Crisanta Realty, and Amaia had pending motions for reconsideration when Judge Gill “motu proprio” dismissed the case based on the common affirmative defense (G.R. No. 252467, June 21, 2021). Thus, instead of applying the 2019 Amendments, Judge Gill could have simply resolved the defendants’ pending motions for reconsideration. The worst part is that Judge Gill ignored the injustice caused by the application of the 2019 Amendments to the case (G.R. No. 252467, June 21, 2021). As provided in the 2019 Proposed Amendments to the 1997 Rules of Civil Procedure, it “shall govern all cases filed after their effectivity on May 1, 2020, and also all pending proceedings, except to the extent that in the opinion of the court, their application would not be feasible or would work injustice” (G.R. No. 252467, June 21, 2021). There is a legal maxim, ignorantia legis neminem excusat, which translated means: ignorance of the law excuses no one. It is with more reason that judges and lawyers must continue to study, update, and improve themselves in order to assist in the swift and orderly administration of justice.

NOT that which goeth into the mouth defileth a man: but what cometh out of the mouth. –Matthew, 15:11 If the fool holds his tongue, he may pass for wise; if he seals his lips, he may pass for intelligent–Proverbs 17:28 These words of wisdom apply to many leaders nowadays. Gone are the days when politicians, academics and even ordinary people chose the words they use. Gone are the days when people engaged their brains before they operated their mouths. In several instances, many a political leader spit out ugly words in utter abandon on the podium or even in supposedly private conversation, unmindful of the dire consequences of painting a morally or ethically depraved person of their own self. Time was when public speakers did their best in delivering well-crafted, well thought-out speeches that will indelibly stay in the memory of their listeners for some time, if not forever. Today, a resident of the so-called “palace by the river” seems to think that having a good supply of cusswords and swearwords is fashionable, and that using these makes him a powerful leader. Apparently, he mistakenly believes that incessant use of expletives make him sound intelligent and witty. The effect is that he is exposing himself for what he is -- a nitwit. Public speakers should be reminded of Ecclesiastes 10:20– The words of a wise man’s mouth are gracious, but the lips of a fool shall swallow him up. Recklessness in public discourse may get leaders and countries, and yes, even

religions in trouble. In a talk with fellow Jesuits in Slovakia, Pope Francis was quoted saying that the criticisms against him were the “work of the devil.” Thus he already sentenced to hell those who criticize him. However, Pope Francis earlier said there is no hell and that bad souls just “disappear” while the good ones get their reward in the contemplation of God. But isn’t hell the devil’s lair? Therefore if there is no hell, there will be no devil. And so who is working to criticize him? By the way, by saying there is no hell, Pope Francis flushed down the toilet the 2000-year teaching of the Catholic Church on the forgiveness and punishment for sins.

Words expose who we are. Last week, Pope Francis praised Ireland President Michael D. Higgins, who legalized abortion in his country. The Pope heaped praises on Higgins just as news broke about his backing of communion for pro-abortion politicians, like US President Joe Biden and Speaker Nancy Pelosi of the US House of Representatives. Both abortion and allowing communion to politicians who publicly support it are big issues in the Church, particulary in the US and Europe. Still, in Slovakia, Pope Francis was asked by fellow Jesuits, “who looks at you with suspicion?” His answer: “There is, for example, a large Catholic television channel that has no hesitation in continually

Lockdown toll

R

ESTRICTING the mobility of people through the enhanced community quarantine will naturally result in business closures and the forced displacement of millions of Filipino workers. Such business shutdowns were more evident in August when the government re-imposed the ECQ to curb the spike in COVID-19 cases. Retail outlets operating inside shopping malls, fast-food restaurants and personal care services centers like salons and gyms had to close down to comply with social distancing rules. The lockdown measures, unfortunately, took their toll on the working class. The higher unemployment rate in August as expected increased to a four-month high of 8.1 percent from 6.9 percent in July. The jobless rate in August, while lower than those reported in January, February and April, was higher than the rates in March (7.1 percent) May (7.7 percent) and June (7.7 percent) and July (6.9 percent). In all, the number of unemployed

Put another way, the employment rate in August dropped to 91.9 percent from 93.1 percent in July this year. The rise and fall in the unemployment rate is directly linked to the lockdown measures being imposed

over areas with increasing COVID-19 cases. The unemployment situation is not expected to dramatically improve over the near-term period, unless the domestic economy reopens further, classes resume and tourism and hotels are allowed to participate in the recovery process. The country’s economic managers have been batting for the safe reopening of the economy, while limiting the mobility restrictions to granular lockdowns and accelerating the vaccination program. COVID-19 cases seem to be on the decline now—a cue to further reopen the economy and allow the majority to return to work and earn a living. The Philippine experience has shown that a general or widespread lockdown will not effectively slow down the virus spread because the clusters of infected areas are not pinpointed and attended to. Granular lockdowns seem to be working, judging from the lower COVID-19 cases now. More importantly, the limited lockdown measure is enabling more Filipinos to join the labor force.

Turning UP campuses into communist havens

THE House of Representatives of Congress wants to make all campuses of the University of the Philippines havens for communists and their sympathizers, and to keep UP the recruitment center that it is for the Communist Party of the Philippines, the New People’s Army and the National Democratic Front. Former UP Executive Vice President Teodoro Herbosa said so in an online story carried by the Philippine News Agency last Tuesday afternoon. Herbosa disclosed that the House recently approved House Bill No. 10171 which proposes to amend Republic Act No. 9500, or the New UP Charter. It purports to protect the academic freedom of UP. More specifically, House Bill No. 10171 bans state police and military personnel from entering any UP campus without the prior permission of the campus authorities, except in cases of “hot pursuit” or similar emergencies. Herbosa said House Bill No. 10171 is unnecessary because the academic freedom of UP is already expressly guaranteed under its charter. Further, Herbosa said the bill reinstates the so-called 1989 accord between UP and the Department of National Defense. That accord provided that policemen and soldiers must first get the permission of UP officials before they can enter any UP campus, even for law enforcement purposes. Defense Secretary Delfin Lorenzana withdrew the DND from the accord last January 21. Lorenzana said the accord transformed UP into, among others, a recruitment center for the communist movement. Herbosa shares Lorenzana’s assessment, and confirms that when the accord was in force, the residential areas of the UP campuses in Diliman and Los Baños became clandestine havens for gambling, narcotics and communist cadres.

speaking ill of the pope.” “I personally deserve attacks and insults because I am a sinner, but the Church does not deserve them,” the pope said. Does this mean that in his view, an attack on him is already an attack on the Church? An old Roman saying goes: Aquila non captat muscas meaning, “The eagle does not hawk for flies.” It seems that the pope forgot what Abraham Lincoln said about criticism: “If I were to try to read, much less answer, all the attacks made on me, this shop might as well be closed for any other business. I do the very best I know how—the very best I can; and I mean to keep doing so until the end. If the end brings me out all right, what’s said against me won’t amount to anything. If the end brings me out wrong, ten angels swearing I was right would make no difference.” Pope Francis is the Bishop of Rome,

Former Chief Justice Reynato S. Puno Anita F. Grefal Baldwin R. Felipe Edgar M. Valmorida

I agree with Herbosa and Lorenzana. If House Bill No. 10171 becomes a law, the UP campuses throughout the country will continue to be recruitment centers for local communists. As Lorenzana once succinctly put it, what is so special about UP that law enforcers need the prior permission of UP officials in order to enforce the law inside its campuses? Nobody, not even UP, is above the law. Come hell or high water, Philippine laws must be enforced throughout the territorial jurisdiction of the Philippines, with or without the prior permission of criminals, terrorists, communists,

The House bill will have this effect. The Senate should do its part. fugitives, or anyone who wittingly or unwittingly harbors them. UP campuses are public places. Like any public place, a UP campus should have visible police presence in order to discourage criminals, terrorists and their kind from committing unlawful acts there. Parents who send their children to study at UP have the right to expect that their children will be safe from criminals and terrorists while they are at UP. One step in that direction is to keep police presence in the UP campuses visible. The absence of uniformed policemen in any public place is a tempting invitation for criminals and terrorists to operate there. There are, of course, security guards inside each UP campus. However, because these security guards are fielded by private security agencies, they do not have the same law enforcement powers vested by law in actual police officers. Unlike policemen who are responsible to the public in general, private security guards are primarily loyal to their agencies. Private security guards in UP are not employees of UP. They are employees of their security agencies. Obviously, they are not public officers. Precisely for that reason, private security guards cannot be

Successor of Peter, Prince of the Apostles, Archbishop and Metropolitan of the Roman Province, Primate of Italy, Patriarch of the West, Sovereign of Vatican City, Vicar of Jesus Christ on Earth and Supreme Pastor of the Universal Church. So, with all those titles, why should he even be bothered by Raymond Arroyo, a television news reader or pejoratively, a talking head. Or, is Pope Francis on a mission of distraction to keep the minds of the faithful away from the more serious problems of clerical sexual abuse, abortion, communion for openly pro-abortion politicans and other major concerns like his alleged throwing of Chinese Catholics under the bus with his concordat with the Chinese Communist Party? held liable under the strict laws applicable only to state law enforcers. Unlike policemen and soldiers, private security guards cannot be held to account before the Ombudsman. In other words, don’t expect quality public service from private security guards because they are not public servants in the first place. Despite the abrogation of the 1989 accord, policemen cannot enter UP offices, college buildings, classrooms, libraries and dormitories unless they are called in. They cannot enter homes inside the campus without a judicial warrant. Like any other public place, police presence in UP is confined only to public areas like roads, parking lots and the like. As such, I do not see how the lawful presence of law enforcers inside a UP campus can actually compromise the academic freedom of UP. To repeat, parents send their children to UP to graduate and become successful adults. No right-thinking parent will send his child to UP just to end up recruited by the communists, and to take up arms and die fighting government troops in the countryside. House Bill No. 10171 should be rejected outright by the Senate. If it manages to pass the Senate, President Rodrigo Duterte should veto it. Should it lapse into law, it should be challenged before the Supreme Court by parents who do not want their children to enter UP just to die for CPP chief Jose Ma. Sison’s useless war to make the Philippines a communist state.

Bangladesh and elsewhere,” he added. “The opportunity to prevent the military from entrenching its rule could be narrowing,” and it is important to support “the democratic aspirations of the people of Myanmar,” Guterres continued. Myanmar has been in the grip of unrest since the coup on February 1. The military has launched a bloody crackdown on opponents, with more than 1,100 civilians killed and 8,400 imprisoned, according to the Assistance Association for Political Prisoners (AAPP). At the UN, Myanmar’s ambassador Kyaw Moe Tun, who was appointed by the former civilian leader Suu Kyi, has retained his country’s seat, defying the junta to do so. AFP

Business UK economy expanded more than expected in 2nd quarter LONDON—Britain’s economy performed better than previously thought in the second quarter, as households spent more and saved less as a result of easing lockdown restrictions, official data showed Thursday. Gross domestic product in the three months to June grew by 5.5 percent, up sharply from the previous estimate of 4.8 percent, the Office for National Statistics said in a statement which also cited accounting changes. The economy has slowed since then, however, with the Bank of England warning that the recovery is flattening as a result of ongoing pandemic fallout and global supply chain bottlenecks. The outlook also darkens Thursday with the end of the UK government’s costly furlough scheme, which kept millions in their jobs during the pandemic Consumers and businesses also have to contend with runaway gas prices and a chronic shortage of lorry drivers that helped spark a run on motor fuel last week. “While the upward revisions to GDP are clearly welcome, the second quarter was three months ago, and the recovery appears to have stagnated since,” said Ruth Gregory, senior economist at research consultancy Capital Economics. The biggest driver of the large upward revision in the second quarter was household expenditure. The ONS also revealed the economy shrank by 1.4 percent in the first quarter. That marked an improvement from the prior estimate of a 1.6-percent contraction. “Today we’ve published new, revised estimates of GDP, which include numerous improvements to sources and methods,” said ONS statistician Jonathan Athow. He noted the latest data showed health services and the arts performing better than previously thought. “The revised figures show households have been saving less in recent years than previously thought,” added Athow. Market climbs; PLDT, Converge up

T

HE stock market rose slightly Thursday on expectations the government will shortly ease lockdown restrictions further in Metro Manila due to lower COVID-19 cases.

The Philippine Stock Exchange Index added 18.77 points, or 0.3 percent, to 6,952.88 on a value turnover of P9.9 billion. Gainers beat losers, 115 to 78, with 51 issues unchanged. Noodles maker Monde Nissin Corp. advanced 5.5 percent to P18.80, while fiber internet service provider Converge ICT Solutions Inc. climbed 5.3 percent to P40. Universal Robina Corp. of the Gokongwei Group, the biggest snack food maker, rallied 4.2 percent to P135.90,

while PLDT Inc., the biggest telecommunications firm, rose 3 percent to P1,680. Equity markets In Asia mostly rose Thursday after the previous day’s retreat, though investors remained worried about surging inflation leading to interest rate hikes, while the debt standoff in Washington also frayed nerves. Shanghai, Sydney, Seoul, Singapore, Wellington, Taipei and Jakarta all rose. But Hong Kong slipped after a threeday gain and Tokyo retreated after a recent rally to three-decade highs. The Dow and S&P 500 provided a positive lead, though the unconvincing end to the trading day on Wall Street indicated lingering uncertainty on trading floors. While expected for most of the year, the prospect that the Federal Reserve and other major central banks will soon begin to remove the ultra-loose mone-

tary policies they put in place at the start of the pandemic has dampened sentiment in recent weeks. The planned moves come as officials look to keep a lid on inflation, which has soared this year on the back of economic reopenings but has been more persistent than many predicted owing to supply chain problems. Concerns that banks will have to tighten policy quicker and sooner than hoped come as the global economic recovery shows signs of a slowdown, with a spike in coronavirus infections dragging on sentiment among consumers. “Growth has clearly hit an air pocket here with concerns about COVID, with the drama going on in Washington right now, the Chinese property sector that has sent tremors to global markets,” Christopher Smart, at Barings, told Bloomberg TV. short-term economic stimulus,” according to an online statement. The central bank also stressed that “houses are used for living, not speculation.” The readout of the meeting with the banking and insurance regulatory commission did not specifically mention Shenzhen-based Evergrande. But it sends a clear signal that authorities are worried about the repercussions of Evergrande’s crisis on China’s property sector, which has seen months of tightening regulations intended to curb speculation. Beijing has so far been reluctant to

bail out the conglomerate, but Chinese media reported that the Shenzhen government has begun an investigation into Evergrande’s investment arm. Shenzhen’s financial regulator said in a Monday letter to investors that a “thorough investigation” was being carried out after collecting information about Evergrande Wealth, Chinese media reported this week. Chat groups containing hundreds of disgruntled Evergrande investors on the WeChat messaging service have been deleted or blocked since Monday, two investors told AFP, with members unable to send or receive messages.

These social media groups were used to organize protests in recent weeks, as investors demanded repayment after the properties and high yields on wealth products they were promised by Evergrande never materialized. An error message in several chat groups shown to AFP read that the group was “suspected of violating relevant laws and regulations.” “Many group members were summoned by local police (in Shenzhen), some were even asked to sign agreements to... not petition Beijing,” said one investor who wished to remain anonymous. Power outages roil China, threatening growth and supply chains By Beiyi Seow with Jing Xuan Teng DONGGUAN, China—From southern factories hustling to meet Christmas export orders to residents of northern towns panic buying candles, China is suffering widespread power cuts that threaten growth in the world’s second-largest economy and hit global supply chains. A confluence of factors has led to the rolling brownouts in a country where nearly 60 percent of the economy is powered by coal. Record coal prices, state electricity price controls and tough emissions targets have conspired to squeeze the power supply, forcing over a dozen provinces and regions to announce curbs on energy usage in recent months. In Guangdong, where China’s manufacturing reputation was chiseled out on the mass production of everything from electronics to jeans to ship around the world, entire supply chains have faced power outages or restrictions for weeks. Some power-guzzling machines have been shut down and working hours have been reduced, rationed or flipped around to ease the strain on local grids. “But we still require suppliers to meet their deadlines and ask them to do night shifts instead or use their own generators to ensure production is smooth,” Sherman Chan, deputy general manager at Shenzhen television manufacturer Express Luck told AFP.

Beijing urges banks to avoid housing speculation to control Evergrande risk BEIJING, China—China has urged banks to steady the housing market and avoid speculation as fears mount that Evergrande’s debt crisis could spill over into the property sector. Saddled with more than $300 billion in liabilities that it is struggling to repay, the Chinese property developer’s potential collapse poses systemic risks for the national and global economy. At a Wednesday meeting, the People’s Bank of China (PBOC) said the country’s financial sector must meet the goals of “stabilizing land and housing prices” and “insist on not using real estate as a

“We also face rising costs, as suppliers have to put in added capital to complete the work.” That has further constricted supply chains in a country where order books already bristled with demand from home and western markets emerging from the pandemic. From Chinese snack giant Toly Bread to Tesla suppliers, companies warn of production delays as the crisis deepens. Meanwhile, in Dongguan—a sprawling Guangdong factory city powered by armies of internal migrant laborers— workers are being pushed to their limits. “We worked overnight yesterday, and we’re working overnight again today,” said Cui, a warehouse worker at a shoe factory forced to cease daytime produc-

tion for much of the week. “Of course we’re unhappy… but we’re going along with the hours that the power curbs take place,” he added, declining to give his full name. Christmas coming Xu, an employee at a factory making metal pipe fittings, told AFP the lastminute outages have lowered production by almost 40 percent this month, as the plant’s machinery takes hours to start up properly. “We cannot carry out production normally,” she told AFP. Gripes at limited air conditioning in the warm south are rebounding across Weibo; Chinese media reports surging orders at northeastern candle makers, while authorities in Beijing and Shang-

hai have tried to rebrand supply shortages as “routine maintenance.” Ever reflexive to the risks of social unrest, China’s leaders are taking note. The State Grid held an emergency meeting on Tuesday where leaders pledged to guarantee power supply for residential use, calling the issue a “most urgent political task.” In an alleyway in Beijing’s old city, where authorities had previously said a handful of courtyard homes would be temporarily cut off for “routine work.” AFP on Wednesday saw notices on buildings saying the maintenance work had been cancelled. The power crunch comes as the country’s energy demand soars past pre-pandemic levels, while restrictions on coal imports from Australia—owing to a political stand-off— squeeze supply. “The main culprits are a global energy shortage and China’s price controls for power,” Julian EvansPritchard, analyst at Capital Economics, said in a note. “The prices of coal and natural gas have soared everywhere due to unseasonable weather and supply disruptions.” At the same time, China’s strict regulation of end-user electricity prices have heaped the burden of rising coal costs onto power plants. Disruptions have hit expectations for China’s economic growth this year, with Goldman Sachs and Nomura lowering their annual predictions this week. AFP

Supply crunches to limit recovery, says ECB head FRANKFURT, Germany—Acute bottlenecks in supply are driving inflation and holding back the recovery from the coronavirus pandemic, the heads of several major central banks said on Wednesday. The uncertainty around supply issues was a “threat to growth,” President of the European Central Bank Christine Lagarde said at the close of the Frankfurt institution’s annual forum. “How long those bottlenecks will take to be resolved and to fade out remains to be seen,” Lagarde said. She was joined virtually on the closing panel by the Chair of the US Federal Reserve Jerome Powell who said bottlenecks were “holding inflation up” longer than expected. Prices rose at a rapid 4.2 percent pace in July, on the Fed’s preferred inflation measure, the personal consumption expenditures (PCE) price index, far above its two percent goal. Shortages in raw materials and key components which have affected companies worldwide were “not getting better” Powell said, and could continue to have an effect into next year, although the Fed’s expectations for growth remain “strong.” Missing supplies were “really holding back the economy,” said the Governor of the Bank of England Andrew Bailey, and the challenge for the coming months was to “get through this period of uneven growth” caused by shortfalls. The shortages did not have a “common cause,” Bailey said, and could not all be solved by changes to central bank policy. In the UK, a lack of lorry drivers linked to the country’s exit from the EU has caused scarcities of fuel and food, leading to queues at petrol stations and empty supermarket shelves. AFP

PAREX to revive Pasig River, ease road congestion, says DOTR chief By Darwin G. Amojelar THE Department of Transportation said Thursday the proposed P95-billion Pasig River Expressway project of San Miguel Corp. is “environment-friendly” and will revive the Pasig River. “The project will not only address the traffic congestion in Metro Manila and San Miguel promised that the project is environment friendly and it would revive the Pasig River,” Transportation Secretary Arthur Tugade said during the agency’s budget hearing at the Senate. “The proponent is also open to any dialog and sharing of information to ensure that the project is environment-friendly,” he said. San Miguel earlier said it initially allotted P2 billion to extract at least 3 million metric tons of solid waste from the river to allow it to channel floodwaters more effectively. This will also allow for safer operations of water ferries. The company said PAREX would be built only on the banks of Pasig River, with its posts occupying only 1 meter of the average 200-meter width of Pasig River. The DOTR earlier approved the proposed project—an elevated hybrid highway that will stretch 19.37 kilometers along the banks of Pasig River from Manila to Taguig. PAREX will have three major segments. Segment 1 would run from R-10 to Plaza Azul, Manila; Segment 2 from Pandacan to C-5; and Segment 3 from C-5 to C6. PAREX will also connect to, and utilize a 2.7-km. portion of the new Skyway Stage 3, from Nagtahan to Plaza Azul. PAREX, which will start from Radial Road 10 in Manila and end at a connection to the South East Metro Manila Expressway or Circumferential Road 6, is seen to reduce travel time from Manila to Rizal to just 15 minutes. San Miguel plans to put up a bus rapid transit system on Skyway and PAREX to provide commuters faster, more convenient and reliable alternative transportation to different points in Metro Manila.

September inflation may breach 5% due to higher oil prices BANGKO Sentral ng Pilipinas Governor Benjamin Diokno said Thursday inflation in September likely breached the 5-percent level and rose to as high as 5.6 percent on rising oil prices and power rates. Diokno said in an online briefing inflation in September might settle within a range of 4.8 percent to 5.6 percent, compared to 4.9 percent in August. “Inflation will be driven by the upward adjustments in domestic oil prices, Meralco electricity rates, suggested retail prices of basic necessities and prime commodities and prices of selected fruits and vegetables as well as rice,” Diokno said. These could be partially offset by the decline in meat prices along with the slight appreciation of the peso, he said. The last time inflation went beyond the 5-percent level was in December 2018 at 5.1 percent. Diokno said the BSP would continue to monitor emerging price developments to help ensure that its primary mandate of price stability conducive to balanced and sustainable economic growth is achieved. The Monetary Board of the BSP kept the benchmark policy rate at a record-low of 2 percent last week in support of the economy that is gradually recovering from the impact of the COVID-19 pandemic. Diokno said the prevailing monetary policy settings remained appropriate given the manageable inflation environment and uncertain growth outlook. He said latest baseline forecasts indicated a higher inflation path over the policy horizon. He said average inflation was seen to settle slightly above the upper end of the target band of 2 percent to 4 percent in 2021. Diokno said the risks to the inflation outlook tilted towards the upside for the remaining months of 2021, but remained broadly balanced for 2022 and 2023. Julito G. Rada

Business ECQ in August increased unemployment rate to 8.1% By Julito G. Rada

T

HE unemployment rate in August climbed to a fourmonth high of 8.1 percent from 6.9 percent in July after Metro Manila was placed under the enhanced community quarantine to curb the spread of the more contagious Delta variant of COVID-19, the Philippine Statistics Authority said Thursday. Data showed while the unemployment rate in August was lower than those reported in January, February and April, it was higher than the rates in March (7.1 percent) May and June (7.7 percent) and July (6.9 percent). National statistician and civil registrar general Dennis Mapa said in a statement the total number of unemployed persons in August reached 3.88 million among individuals who are 15 years old and over. “Employment rate in August 2021 dropped to 91.9 percent from the 93.1 percent in July 2021. In terms of magnitude, 44.23 million out of 48.12 million individuals in the labor force were employed,” Mapa said. “This was higher than the employment

rate in April 2021 [91.3 percent] during which the National Capital Region Plus Bubble was under enhanced community quarantine status,” Mapa said. Economic managers composed of Finance Secretary Carlos Dominguez III, Economic Planning Secretary Karl Kendrick Chua and Budget and Management officer-in-charge Tina Rose Marie Canda said in a joint statement the increase in jobless rate in August was expected, “given the stricter quarantine imposed to curb the spread of the delta variant.” “We reiterate that the safe reopening of the economy, limiting restrictions to granular lockdowns and accelerating the vaccination program are key to our recovery. Based on a seven-day moving

average, the number of COVID-19 cases have gone down by around 15 percent since the peak on Sept. 11, 2021. This trend will support the further reopening of the economy and the use of granular lockdowns to allow the majority to return to work and earn a living,” they said. ING Bank Manila senior economist Nicholas Mapa said the September labor market figures should look relatively similar to the August figures with a slight improvement. “We could see unemployment dip while underemployment will likely rise with mobility curbs and the overall downbeat economic outlook capping labor hours and wages,” Mapa said. The economist also said business closures due to the protracted downturn and rising borrowing costs would likely limit the ability of the economy to provide enough job opportunities in the near term. “This development will hamper household consumption for as long as the labor market faces these challenges and a clear cut sign that the Philippines is in need of sustained support and more than a year away from simply returning to pre-COVID levels of growth,” he said.

AC Energy purchases 20% stake of Marubeni

THE Ayala Group said Thursday it completed the acquisition of Marubeni Corp.’s 20-percent stake in South Luzon Thermal Energy Corp. that operates a coal-fired power plant in Batangas province. AC Energy Corp. said it acquired the 20-percent ownership interest of Axia Power Holdings Philippines Corp. in SLTEC. “With this acquisition, the company now owns 100 percent of SLTEC, which owns and operates a 2x135 MW coal-fired power plant in Calaca, Batangas,” the company said. SLTEC is a joint venture of AC Energy Inc., AC Energy Philippines (now AC Energy Corp.) and Marubeni Corp.’s Axia Power. AC Energy announced in November 2019 that it acquired the stake of Axia Power to boost its cash flow. AC Energy signed a deed of assignment with parent firm AC Energy Inc. The deed of assignment transfers ACEI’s rights to purchase the 20-percent ownership stake of Axia in SLTEC. The Ayala Group took possession of SLTEC after it acquired Phinma Energy Corp. from the Del Rosario family for P6.3 billion in January 2019. Alena Mae S. Flores

Gov’t debt hits record P11.64t

OUTSTANDING debt of the government increased to a record P11.64 trillion as of end-August from P11.61 trillion in July the Bureau of the Treasury said Thursday. “For August, the national government’s total debt increased by P32.05 billion or 0.28 percent due to domestic debt issuance as part of government financing,” the Treasury said in a statement. It said of the total debt stock, 29.4 percent was sourced externally while 70.6 percent represented domestic borrowings. Domestic debt amounted to P8.22 trillion, up by P100.70 billion or 1.2 percent from the end-July 2021 level as a result of the net issuance of government securities. Domestic obligations climbed by P1.53 trillion or 22.79 percent from the beginning of the year. External debt hit P3.42 trillion, down by P68.65 billion or 2.0 percent from the previous month. “The lower figure was due to the net repayment of foreign loans amounting to P34.22 billion,” the Treasury said. Telecom firms roll out mobile number portability service THE country’s three mobile phone operators on Thursday rolled out their mobile number portability service, enabling customers to switch to other operators without having to change their numbers. “We wish to announce to the Filipino people that as of Sept. 30, the core services of mobile number portability are now ready,” said Melanie Manuel, general manager of Telecommunication Communication Inc. “We do expect to experience some inconveniences as we start offering the service, but we are confident that with the continued cooperation and hard

work of our three partner telcos, we can say that finally, forever is here,” he said. TCI expects one million subscribers to initially port out from existing providers. Under the MNP, customers may also switch their prepaid account to a postpaid plan and viceversa without replacing their mobile number. “MNP is a game-changer, and Smart is best-positioned to champion this initiative and support the government’s call for world-class services for all Filipinos,” said Alfredo Panlilio, president and chief executive of PLDT Inc.

and Smart Communications. To switch to the Smart network, a mobile user should first secure a unique subscriber code from his or her originating provider to serve as clearance and bring it to the nearest Smart store along with a valid ID and any proof of mobile ownership. From there, Smart will begin processing the MNP application without any charges. Globe Telecom Inc., Smart and DITO Telecommunity Corp. invested P120 million in the MNP service. The three telcos tapped Syniverse to be the MBP service provider in the country. Darwin G. Amojelar

THE country’s leading mass housing developer, 8990 Holdings Inc., was named by Pag-ibig Fund as the No. 1 among the top 10 developers in the Visayas and Mindanao. Lawyer Anthony Vincent Sotto, president and chief executive of 8990, said the two top awards from the Home Development Mutual Fund or Pag-ibig Fund recognized 8990’s mission to continue serving the strong demand for low-cost housing in the Vis-Min regions. Despite the lingering effects of the pandemic, many Filipinos were able to fulfill their dream of owning their dream homes, he said. The company’s newly installed CEO also feted the brokers, sales agents and homeowners who supported the company’s many projects nationwide. Among the projects in the Visayas that contributed to the company’s outstanding performance are Deca Homes Pavia Resort Residences 1 and 2 in Pavia, Iloilo, and Deca Homes Sta. Barbara Resort Residences also in Iloilo. Meanwhile, the Deca Homes GenSan 1 project in General Santos City propelled 8990 to bag the top citation for Mindanao.

Mezabarba replaces Ham in ONE Women’s Atomweight GP HAM Seo Hee is out of the ONE Women’s Atomweight World Grand Prix, but taking her place is Julie Mezabarba. ONEFC.com broke the news last Wednesday night that Ham had to withdraw from the tournament owing to an injury she sustained while training for her semifinal showdown against #2-ranked Stamp Fairtex at ONE: NEXTGEN on October 29. Losing Ham, who was considered one of the favorites in the tournament, might be a big blow, but the good thing is that Mezabarba is an excellent replacement. The Brazilian had a debut to remember as she dominated former ONE Atomweight World Title contender Mei “V.V” Yamaguchi in the tournament’s alternate bout at ONE: EMPOWER last May, staying in control from start to finish. The RD Champions standout showcased her beautiful boxing, popping Yamaguchi with crisp straight rights and thunderous uppercuts all night long, while also showing her impressive grappling defense by repeatedly stuffing the Japanese woman’s takedown attempts. With Mezabarba’s smooth boxing going up against Stamp’s world-class Muay Thai, fans can still expect the same striking masterclass they originally did with Ham. Number four-ranked Ritu “The Indian Tigress” Phogat and Itsuki “Android 18” Hirata will be contesting the other Grand Prix final spot in a clash between two grapplers. However, it’s back to the drawing board for Ham, who will have to take some time off recovering. But considering that she was eyeing that World Grand Prix win the moment she came in, it will be interesting to see how she returns from this setback. In the meantime, ONE Championship returns to live action with ONE: FIRST STRIKE on October 15. Download the ONE Super App for more details on the event.

Beermen flog Batang Pier, set semis faceoff with Giga By Peter Atencio

J PEREZ led a seven-man wrecking crew that pushed the San Miguel Beermen into the semifinal round of the 2021 Philippine Basketball Association Philippine Cup. The 6’2” Perez unloaded 21 points in a 21-minute performance that helped ease out the NorthPort Batang Pier, 100-95, on Thursday. Mo Tautuaa, Marcio Lassiter, Junemar Fajardo, Chris Ross, Arwind Santos and Terrence Romeo also scored in double digits for the Beermen, who finished with a two-game sweep of their best-of-three quarterfinal series with

the Batang Pier at the DHVSU Gym in Bacolor, Pampanga. “There’s no need for us to go into a third game. Because a third game for us is a do-or-die. You can expect anything from your opponent in Game 3,” said Beermen coach Leo Austria. Perez kept the Beermen out of range in the last 44 seconds with his split free throw, 97-91.

Batang Pier managed to come close for the last time at 93-97 in the final 34 seconds, off Greg Slaughter’s putback. But Ross, who had 11 points with Santos and Romeo, converted two charities in the final 31 seconds in keeping the Beermen ahead, 99-93. Tautuaa added 17 points for the Beermen, who kept their poise while fending off repeated rallies in the final quarter from the Batang Pier. Romeo’s triple with 6:24 to go gave the Beermen an 11-point lead at 89-78, before Lassiter, who had 15 points, protected SMB’s advantage with his trey, 92-85, in the remaining 4:40. Slaughter showed the way for the Batang Pier with 27 points, 12 re-

The tournament involving the 11 member countries of the ASEAN region, was done on a home-and-away basis when it was last staged back in 2018. But this time, it will be played in a centralized format due to the COVID-19 pandemic. Cooper said the Azkals won’t be that well-prepared when their first game happens against host Singapore on Dec. 8, but the team will still come out fighting. “We cannot be at full strength, but we’ll still give our best shot,” added Cooper. The staging of the competition was delayed by a year because of coronavirus restrictions. The Philippines and host Singapore

are in Group A with Thailand, Myanmar, and the winner of a playoff between Brunei and Timor Leste. The opening game will be on Dec. 5, with the f inals scheduled on Januar y 1. Philippine Football Federation president Mariano Araneta welcomed the move to have Singapore be the host this year. “We welcome the ASEAN Football Federation’s selection of Singapore as host of the 2020 AFF Suzuki Cup. Singapore has a wonderful track record in hosting major competitions. And we are confident that this year’s AFF Suzuki Cup will be conducted with the health and safety of players and staff as the main priority amid the COVID-19 pandemic,” said Araneta. Peter Atencio

No training camp for Azkals before Suzuki Cup THERE won’t be a training camp before the Philippine Azkals national men’s football team plunges into action in the ASEAN Football Federation-Suzuki Cup 2020 this December. Getting a team together for an organized period of training activity will be difficult at this time. Azkals’ coach Scott Cooper said this after Singapore was selected as the only venue for this year’s biennial staging of the regional meet. “I think for now we can’t have early training camps unlike Singapore or Thailand can because our players are scattered worldwide and it’s still going to be a logistical challenge for us to see who we can bring in, like the players who aren’t in season and the players in season,” said Cooper.

set by the sad realities of strife. That is why we continued supporting this city, by rehabilitating the MSU Track Oval to an Olympic-standard facility and helping accelerate sports development, we hope to shore up the spirits of the people and spark inspiration among the youth through sports,” added Ramirez. In July 2017, just two months after the siege in Marawi, the PSC aided more than 300 displaced children in Brgy. Buru-un in Iligan city, to conduct the PSC’s UNESCO-recognized project, the Children’s Games. The following year, the agency came back and brought the program inside MSU to more than 500 children from all over the city. Through the PSC, sports was played by more than 20,000 children from Marawi, down to the coastal islands of Limasawa. Ramirez assured that it will continue to reach more places, even in the challenges brought by the pandemic. “I am beholden to you and the country to continue to work towards the development of sports and our youth,” concluded the agency chief. Ramirez is set to return in Marawi for the official unveiling of the newly rehabilitated MSU Track Oval next month.

THE Philippine Sports Commission is set to conduct a pre-recording of traditional sports and games of Indigenous Peoples from October 8 to 12, 2021 in Sarangani Province. The project is in line with the 2021 Quincentennial Commemorations in the Philippines, which will feature eight traditional sports and games that include blowdart, Kmisong (fire-making drill), Skuyah (track and field), javelin throw, pana, among others. Also part of the program is to highlight one traditional dance that is common among the Tagakaulo, T’boli, and B’laan Indigenous Cultural Communities to be held at the Municipality of Malungon. “The activity aims to promote the traditional sports and games of the Sarangani IPs through a pre-recorded mini-documentary,” said PSC Commissioner Charles Raymond A. Maxey, oversight for the Indigenous Peoples Games program. Maxey also shared that the agency already secured permission from the Sarangani Provincial Tribal Council to proceed with the documentation of the traditional sports and games. “We will observe the health and safety protocols implemented by the Provincial Government of Sarangani and Municipality of Malungon,” said Maxey, adding that the video output will be streamed live on PTV4 and the National Quincentennial Committee Facebook pages. The activity is supported by the Pocari Sweat and Otsuka-Solar Philippines, Inc., in coordination with the National Commission on Indigenous Peoples, Provincial Government of Sarangani, and Municipality of Malungon.

Looking better for horseracing industry IT remains a difficult task for the horseracing industry to fully get back on its feet because of the pandemic, but things are looking up for sure. LITO I had a long chat with Reli CINCO de Leon, chairman of the Philippine Racing Commission and after nine months of the year, total sales are close to P1.4B already with almost P400M earned by the national government. And Reli expects that with remaining races for the last quarter, Philracom is on track to double the P344 million it turned over to the government in 2020. Racing fans are looking forward to some exciting races that should pump up the industry more. On October 3, at the race track in Naic, Cavite, is the schedule of the 3rd leg of the Triple Crown series, then the Philippine Charity Sweepstakes Office Silver Cup set on November 7, followed a week later by the Japan Cup. November 21 is reserved for the Amb. Eduardo Cojuangco Cup in honor of the first Philracom chairman, December 21 is for the industry’s biggest race, the annual Presidential Gold Cup, while finishing off the year will be the first time ever Grand Derby on December 26. The 3rd and final leg of the Triple Crown series will see erstwhile unheralded Nuclear Bomb aiming to join an illustrious list of 12 other horses, which have won all three legs of the series. Last leg’s runner-up Kaparkan Falls will be out to thwart Nuclear Bomb, owning the distinction of being the last horse to beat the TC hopeful. It will certainly be a windfall for Nuclear Bomb as it already has banked P4.2 million in the first two legs, ran over 1600 and 1800 meters, respectively, with the third a 2000-meter distance. Another P2.1 million for the 3rd leg, plus a P1 million bonus for a possible Triple Crown victory awaits Nuclear Bomb. Reli also shared the fact that this colt was not a first choice for buyers before as it was ordinary looking, with a not so impressive record by its parents. And if it can talk, maybe what it will say is “eat your hearts out.” The Japan Cup is a reciprocal race with the Japanese to promote our industry as Japan also holds a Philippine Cup race. The Philracom is now eyeing similar races with other Asian countries like Singapore, Korea, Malaysia and Australia. The Silver Cup is a good pre-Gold Cup event. I also would like to commend Reli and his board for holding stakes races for the benefit of the less unfortunate. In the first leg, disabled jockeys were the recipients, while the second leg benefited the Ayuda Sa Atleta program for our national athletes, something I initiated a few months ago. Reli will be finalizing the beneficiary of the third leg . He also disclosed that Philracom also has scheduled a Philippine Sportswriters Association Cup this year for charities to be chosen by sports editors, while next year, he is open to holding one for the Tabloids Organization of the Philippines. Hopefully, I can travel already next month as I plan to watch the third leg of the Triple Crown and Reli has promised to give me a VIP seat if I make it there. What else can I ask?

Vax holdouts won’t be paid

The policy means players with teams based in San Francisco and New York—where local regulations require full vaccination for indoor events—must get vaccinated or else risk seeing their pay effectively cut in half. “Any player who elects not to comply with local vaccination mandates will not be paid for games that he misses,” NBA spokesperson Mike Bass said in a statement to reporters. The NBA comment comes amid tensions between the league and a minority of players who have declined to be vaccinated. Around 90 percent of the NBA’s players have been vaccinated, but a hardcore have either refused to get vaccinated or have declined to divulge their vaccination status. That minority includes Brooklyn Nets star Kyrie Irving, who earlier this week would not comment on his vaccination status. Irving is a key part of the Nets’ plans for the coming season, but as things stand he will not be able to play in home games unless he gets vaccinated. Local COVID-19 regulations in San Francisco could also mean the Golden State Warriors are without Andrew Wiggins, another vaccine holdout. The NBA on Friday denied a request from Wiggins for religious exemption from the vaccine, meaning the Warriors swingman will be unable to play home games for the club. “I’m just going to keep fighting for what I believe and for what I believe is right,” Wiggins said on Monday. “What’s right to one person, isn’t right to the other and vice versa.” The Warriors’ first home game of the regular season takes place against the Los Angeles Clippers on October 21. I think naka-add ‘yung spice na nakikita mo sa harap mo ‘yung makaka-challenge mo onstage and ‘yung immediate reaction or comments nung judges in front of you,” Julie shared in a recent virtual junket fir the show. “Filipinos are very talented and very supportive. Giving viewers an exclusive peek backstage again are Journey Hosts Ken Chan and Rita Daniela who are both eager to be back. “There are many singing competitions out there, with similar systems in place and similar storylines. Life TRAVEL AND LEISURE

A

S WE eagerly await the easing of travel restrictions and safe reopening of tourism here in the Philippines, some of our neighbors are making strides in their programs – opening their doors wide open to fully vaccinated travelers. Thailand pioneered tourism reopening in Southeast Asia with its Phuket Sandbox launched on July 1. The program allows fully vaccinated visitors who test negative for COVID-19 before and after arriving to freely roam and enjoy the sights of Phuket without quarantining. The previous program, however, mandated tourists to stay for 14 days in Phuket. The new program, called Phuket Sandbox 7+7 Extension, slashes the number of days required to stay in Phuket from 14 to seven. After the seventh night, the other seven can be spent in any of the extension areas: the provinces of Krabi (Ko Phi Phi, Ko Ngai, or Railay), Phang-Nga (Khao Lak or Ko Yao), or Surat Thani (Ko Samui, Ko Pha-ngan, or Ko Tao). In the Phuket Sandbox, tourists can enjoy sea excursions such as yachting and cruising, enjoy traditional dance performances around the island, and enjoy the dining, shopping, and lodging establishments on the island as long as they are accredited by the Amazing Thailand Safety and Health Administration Plus (SHA Plus). Phuket is home to world-class beaches and crystal clear waters. The most remarkable part about the island is its selection of beaches fit for any vacationer’s lifestyle. There’s the bustling Patong Beach, the limitless stretch of Mai Khao Beach, and the relatively untouched Nai Harn and Nai Yang beaches. Get lost at the sight of sweeping ocean views melding seamlessly into grooves of tree-laden grounds, mountains at the far end, and a barrage of clouds from the Karon Viewpoint. Or book a scuba diving tour with one of the local tour agencies to witness life thriving in the Andaman Sea. Just as better, go on an island hopping excursion to discover the nooks and crannies of Phuket’s islands. After days under the sun, visitors can find peace at the Wat Chalong Temple – one of Phuket’s 29 temples, and its biggest and most popular. Since its launch, the Phuket Sandbox has been well-received by tourists from Europe, the United States, Mid-

Sports tourism thrives in Clark

MY FRIEND, Charles Lim, the chairman and founder of the Philippine Sports Tourism Awards, shared with me this very encouraging and “trailblazing” piece of good news. The Clark Freeport and Special Economic Zone, popularly known as “Clark”, the perennial winner in the Philippine Sports Tourism Awards as Destination of the Year, continues to press on by hosting sports tournaments in spite of quarantine restrictions brought about by the pandemic. In fact, it holds the distinction of being the first spot in the country to create a safety bubble to stage in September last year the Philippine Basketball Association’s (PBA) Philippine Cup. Added to that, Clark has also played host to two more major events
