KEEPING YOUR DOCUMENTS SAFE DURING THIS HURRICANE SEASON FREKEET

MAR IS S ANALY

Suffolk County Clerk Judith A. Pascale has issued the following document safety tips for this hurricane season. “The devastation wrought by recent hurricane seasons serves as a strong reminder that hurricane preparedness needs to be pushed to the forefront of everyone’s agenda. Experts agree that storing key documents in safe locations provides the maximum level of security and convenience in the aftermath Mastic Beach $339,000 of a catastrophe like a major hurricane,” commented Suffolk County Clerk•Judith A. “While safes and safety deposit boxes are among the best places to store your most sensitive documents, I want to assure all Suffolk County residents that a permanent copy of all documents recorded in our Office, i.e. deeds, mortgages, powers of attorney, etc., are readily available, should an unfortunate disaster strike,” commented Pascale. By digitally scanning and retaining land records, digital surrogates are utilized in place of the actual hard copies to preserve land transactions while also providing for an efficient and effective safeguard of the land records of Suffolk County. “Although traditional paper mediums are increasingly susceptible to disaster, we utilize state-of-the-art computer storage systems to hold digital images of these paper mediums to provide an added layer of security in the protection of the public record,” concluded Pascale.

County IT Supervisor Arrested for Bitcoin Mining Scheme tolerate County employees already on the payroll, stealing taxpayers’ money and illegally using government resources for their own personal gain,” Sini said. But associated costs for Naples’ alleged cryptocurrency mining operations could exceed $6,000 as investigators continue their efforts.

By Barbara LaMonica

Suffolk County IT Supervisor, Christopher Naples, 42, of Mattituck, has been arrested for alleged Bitcoin mining on County time, using County resources, costing Suffolk residents thousands of dollars. Suffolk County District Attorney Timothy D. Sini announced the arrest at a press conference last week where Naples, an Assistant Manager of IT Operations for the Suffolk County Clerk’s Riverhead Office, has been charged with multiple counts including: Public Corruption as a class C felony, Grand Larceny

in the Third Degree as a class D felony, Computer Trespass as a class E felony, and Official Misconduct as a class A misdemeanor. Naples could get five to fifteen years if found guilty of the top count. It’s the latest in DA Sini’s efforts to root out crimes in the County. Sini said Naples’ Bitcoin mining activity racked up a tab for taxpayers to the tune of at least $6,000 in electricity and other energy costs, and compromised the integrity of information technology systems, putting at risk important, sensitive County infrastructure. “We will not

Upon executing search warrants at the County Center in August, investigators unearthed 46 cryptocurrency devices that were concealed in six rooms hidden under removable floorboards, in and around server racks, as well as in an unused electrical wall panel. Sini said one of the six rooms housed “critically important computer servers, security data storeage systems and Communications equipment” for County government. In addition to putting the County’s IT systems at risk, Sini said Naples had to bypass Suffolk County internet protocols in order to get devices online, potentially jeopardizing security of the County’s network. The Suffolk County Clerk’s Office and the Suffolk County Comptroller’s Office assisted with the investigation which remains ongoing.

Be on the Look-Out for State Tax Debt Collection Scam

Suffolk County Clerk Judy Pascale

Suffolk County Clerk Judy Pascale would like to bring to the attention of Suffolk County residents a recently released scam regarding fraudulent tax debt collections. Law enforcement officials and other public officials have recently received reports of fraudulent activity by scammers posing as debt collectors seeking to

settle alleged outstanding state tax debts. The scammers are pressuring consumers into sending payments via money order to satisfy debts that the consumers may not actually owe.

to help New Yorkers avoid various tax-themed scams:

This latest scheme involves scammers telling consumers they owe a tax debt to the state, which may not actually exist, and then promising to settle the alleged debt for a fraction of the cost that they claim is owed. Some of the calls have been reported as coming from the number 305-507-8505. Scammers are reportedly using high-pressure tactics to intimidate consumers into purchasing money orders to satisfy debts and then instructing them to call back for instructions on how to submit the payment. Both federal and state tax authorities send notifications in writing. Consumers should be wary of demands for tax payment via phone, especially if the caller suggests the use of a money order to remit payment.

If you owe money, you will receive a legitimate notice in writing that identifies the agency and the reason you owe money;

The Attorney General’s Office offered the following tips in an effort

Tierney Says Sini’s Inaction Caused East End Drug Deaths

The IRS and legitimate government agencies never demand payment by phone;

Do not give out personal information, including your Social Security number or bank account information, to telephone callers; Legitimate government organizations will never threaten arrest or deportation for failure to pay a debt. Suffolk County residents must be vigilant consumers and should report instances of fraud to the New York State Attorney General’s Office. Consumers who believe they have been victims of any tax scams are urged to file complaints by visiting the Attorney General’s Office website www.ag.ny.gov or calling 1-800-7717755.

Ray Tierney held a press conference outside the Suffolk DA’s office in Hauppauge on September 8 to explain to reporters how the current DA, Tim Sini, had four opportunities to lock up Justin K. Smith and Lavain Creighton for felony drug charges, but failed to do so. He said Sini’s inaction led to six overdose deaths on the East End of Long Island.

Suffolk County District Attorney candidate Ray Tierney revealed, on September 8, shocking information showing how current District Attorney Tim Sini’s inaction and gross incompetence allowed six individuals to be killed in drug overdoses on the East End last month. At a press conference outside the District Attorney’s Hauppauge office, former Federal and Suffolk County prosecutor Tierney highlighted numerous times in the past year when Sini could have arrested, held, and indicted the two men, Justin Smith and Lavain Creighton, accused of selling the fentanyl-laced cocaine believed to have caused six deaths and injured twelve others. “These two dangerous criminals should never have been on the streets of Suffolk County in the first place to sell their deadly poison. Tim Sini had at least FOUR opportunities in the past TEN months to put Smith and Creighton behind bars on felony charges and he failed to

act!” said Tierney. Tim Sini, who ran for District Attorney after a failed race for Suffolk County Legislator, has never tried a criminal case in Suffolk County Courts. Ray Tierney has been lead prosecutor on hundreds of major criminal cases in both Federal and Suffolk County criminal courts. Included in Tierney’s long record of successful prosecutions, ironically, was putting Justin Smith behind bars for twelve years for a 1996 drug sale. “We need to ask District Attorney Tim Sini tough questions about his failures and why he did not indict Smith and Creighton when he had the chance. Is it too much to expect the District Attorney to do his job and protect the residents of Suffolk County?” added Tierney. Veterans and Health committees.

Suffolk County 2nd District Legislator Bridget Fleming is seeking re-election. She will appear on the Democrat and Working Family Party lines of the ballot. The 2nd Legislative District is comprised of Long Island’s South Fork in addition to Shelter Island, Southampton and East Hampton townships, extending westward to East Moriches and Eastport in the Town of Brookhaven. Fleming was first elected to the County Legislature in 2015. Prior to her election to the County Legislature, Fleming served on the Southampton Town Board where she won a special election in 2010 to fill the unexpired term of Anna Throne-Holst. Fleming is Chair of the County Legislature’s Ways and Means Committee, and Vice-Chair of the Public Safety Committee and the Public Works, Transportation & Energy Committee. She sits on the

While “actively campaigning to retain” her County seat, Fleming is seeking election to the 1st Congressional seat. “The 1st Congressional race is in the early stages, and right now that’s all about fundraising, so my focus is to focus on and retain my County seat” Fleming said.

“ But now, sales tax is up, and we have an excellent opportunity to increase our reserves to get our budget rating up, and to fill budget holes that have existed since 2008.”

Fleming said her focus for the next two years if she is reelected to the County Legislature is on Coronavirus issues. “We have to work on getting back on our feet to ensure there is testing, vaccines, ensuring that protocols are in place to keep our communities safe, and reopening the economy and helping small businesses that were impacted,” Fleming explained. From a fiscal standpoint, Fleming said the County is on firmer footing than in previous years. “We have faces challenges on fiscal conditions since I was elected to the Legislature,” Fleming noted.

Legislator Bridget Fleming Fleming pointed out that “capital spending is so important for our District.” She acknowledged the “support the county received from state and federal partners which helped take the sting out of the

budget.” “We were well supported during COVID and received $286 million in COVID relief which came directly to Suffolk County,” Fleming continued. “I take our budget responsibilities very seriously, and it’s important for me to be in the Legislature because I have a steady hand at the wheel and we have to expend these revenues in a responsible way that supports services for residents.” Asked why she is also actively pursuing a campaign for election to Congress in 2022, Fleming told South Shore Press: I’m deeply troubled about the level of partisanship in our communities and also the discord between members of our community that comes from the top from our leaders in Washington. People are angry and dismissive, and it’s important that we change that,” Fleming said. “My team has a reputation for delivering practical, pragmatic results for our

community,” Fleming said, “and in politics, we need to get back to a place of compromise, honor, agree to disagree, and get back to doing the people’s business.” Meanwhile, Fleming said she’s “very happy to continue her leadership roles” in the county, citing Suffolk’s crime rate that is trending downward. “Crime in the county is trending downward by 7% by this time last year,” Fleming said. “Our police, the FBI, and federal partners are working to reign in individuals with illegal guns to get those guns out of their hands and off the streets. We’re going to be keeping a responsible eye on meeting the needs of everyone while continuing to be one of the safest counties in New York State.” Fleming lives in Noyak with her husband, son, and their English Springer Spaniel, Dune. Fleming’s opponent, Robert J. Carpenter III did not reply to phone calls or emails for an interview.

Gregory Sperl By Joan Travan

On September 8th, the Henry James Post 2937 honored 19 year old Gregory Sperl, presenting him with a plaque for the community service project he did at their hall on Long island Avenue, Medford. Because of Covid 19, the recognition was a little late in coming -eighteen months ago, while a senior at Miller Place high school Greg completed his community service project which was to renovate and decorate an old U.S. mail box and repurposed it as a retired flag drop-off box. Along with an American Flag motif, he decorated the box with decals honoring all branches of the military. Along with the box he built a concrete platform for the box to sit on and planted a small garden bed around it. Greg raised the thousand dollars to pay for the project by having a huge yard sale with the help of his family. Post Commander William Hart, said that he is thrilled with the project and that it is something that the post wanted for a long time to augment their service to the community. Greg’s Grandfather Ray Sperl, who is the Post Quartermaster, said that he couldn’t be more proud of his grandson and that he is honored that Greg chose to do his project at our VFW post. Greg is a humble young man who was shying away from attention and said that he just wanted to honor our Veterans and their service to our Country in some small way.

LETTERS TO THE EDITOR

Open Letter to Senator Schumer Dear Senator Schumer, Thank you for taking time last week to visit Fire Island and to discuss the need to move up and expedite the work of the Army Corp of Engineers (USACE) in protecting Fire Island from future storms. With more than two thirds of Fire Island within the Town of Brookhaven this project is of great concern to the Town and the local residents. As you are aware, Phase Two of the Fire Island to Montauk Point Plan (FIMP) calls for the dredging of Moriches Inlet. In this phase, USACE will pump sand and shoal from the inlet of Smith Point County Park and Cupsogue County Beach, all of which is in the Town of Brookhaven. This work is scheduled for Fall 2022 after the start of hurricane season. I am concerned that if this work doesn’t start earlier, the barrier island and these two great county parks could be subject to major beach erosion, breaches and additional shoaling of the Moriches Inlet. I agree with your statement that we need to protect our barrier island, which protects our local bays and main island. I appreciate your efforts to get this project underway before the 2022 hurricane season. Brookhaven Town stands ready to work with your office to make this happen. Sincerely,

Edward P. Romaine Town Supervisor

Longwood Public Library is Certified Sustainable

The Sustainable Libraries Initiative has recognized Longwood Public Library as a leader in sustainability. Longwood Public Library in Middle Island, NY, has been certified as a “Sustainable Library” through the award-winning Sustainable Library Certification Program. This ground-breaking initiative guides library leaders through a step by step process to infuse triple bottom line sustainable decision making into their library’s

policies and actions. Longwood Public Library will be recognized at the 2021 Annual Conference of the New York Library Association held in Syracuse, NY November 3rd-6th, 2021. With so many challenges unfolding over the past 18 months, the actions involved in the completion of this certification have helped to strengthen the partnerships between Longwood Public Library and community organizations at a critical time.

“Going through the process encouraged us to seek out additional partnerships, such as one that resulted in the installation of a Little Free Pantry at the library,” said Lisa Jacobs, Longwood Public Library Director. The rigorous certification process, which has distinct paths tailored to public, academic, and school librarians, is designed to assist libraries in evaluating and reflecting on their current and future actions in the areas of environmental stewardship, social equity, and financial solvency. This realignment of the path forward strives to meet the needs of both their communities and the environment.

International Impact

Longwood Public Library is among the first libraries to participate in the Sustainable Library Certification program, the first of its kind in the world to assist libraries of all types – public, academic, and school – to assess their opportunities to make better choices on behalf of the local and global community.

Losquadro and Loguercio Announce Completion of Paving Project in Farmingville/Medford the completion of this paving project include Fairmont Avenue, Lyndsie Court, Poe Drive, Sachem Court, Whitman Drive, and Whittier Avenue. The total cost for this project was approximately $435,000. “We continue to work our way through the Town, improving our infrastructure one road at a time,” said Superintendent Losquadro. “Roadways in this neighborhood had deteriorated significantly over the years and are now smoother and safer for residents, motorists, pedestrians and bicyclists.” L to R: Superintendent Losquadro and Councilman Loguercio on Fairmont Avenue in Medford.

Brookhaven Town Highway Superintendent Daniel P. Losquadro and Councilman Michael Loguercio have announced the completion of a paving project in Farmingville and Medford.

Prior to paving, crews made concrete improvements, including replacing damaged concrete curbing and aprons. In addition, two new drains were installed in the area to alleviate flooding issues and concerns. Roads paved during

Councilmember Loguercio said, “I am always happy to work with Superintendent Losquadro to improve our roadways in the 4th Council District. Thanks to the hardworking men and women in Highway for helping this substantial re-paving project come to fruition.”

The program has been recognized by the International Federation of Library Associations at their 2019 World Congress in Athens, Greece, becoming the first program in the United States to be honored through their “Green Libraries” Award.

Comprehensive Approach

With categories of actions focusing on each of the three pillars of triple bottom line sustainability such as Collective Impact, Resilience Planning, Energy, and Materials, this comprehensive process leads a library toward institutional change that shifts the rationale for every decision to consider both the local and global impacts. Library Director, Lisa Jacobs, describes how completing the certification process aligned the values of the library with their community and provided a new framework for their organizational decision making: “Sustainability is a core part of who we are and what we do at Longwood Public Library. We are lucky that our community had the foresight to endorse a LEED Platinum building design several

years ago. Going through the Sustainable Libraries Certification process has helped employees throughout our library add the sustainability ‘lens’ to many of our day-to-day practices. We look forward to incorporating even more sustainable practices into our service plan in the future.” The Sustainable Libraries Initiative is expanding throughout New York State, with forty libraries and school librarians currently enrolled in the Sustainable Libraries Certification Program. Longwood Public Library joins Lindenhurst Memorial Library, North Babylon Public Library, and Patchogue-Medford Library as certified libraries in Suffolk County. An additional nine Suffolk County libraries are enrolled in the Certification Program. A nationwide and Academic Library rollout is planned later this year. For more contact:

Bellport 9/11 Anniversary Ceremony On the Evening of Saturday September 11th 2021 the Bellport Fire Department , South Country Ambulance and Hagerman Fire Department joined the Village of Bellport in hosting a 20th Anniversary Ceremony for the 9/11 attacks. The service which was lead by Bellport FD Assistant Chief David Didio who is also an FDNY member and Chaplin Frank Trotta of Bellport FD. Members of the Fire and EMS agencies gathered along with veteran’s organizations , religious leaders and local government leaders on this somber night at the monument in the Bellport Marina’s Park to reflect on the events of that tragic day and remember the lives of the many Firefighters, Police , Rescuers, Military and civilians lost at the World Trade Center, Pentagon and in Pennsylvania. Members of the local area were among those lost while serving as firefighters, police or in the military after the effect and some are still living with the effects of that day and the days that followed still. While local leaders like Councilman Michael Loguericio and Assemblyman Joe De Stefano spoke 2 towers placed near the piece of world trade center steel in the park glowed blue as a memorial to those lost as well. The night wrapped up with the reading of names of local people who were lost and members of the audience were invited to add names if they wanted to. A bell was rang following the announcement of each person. Followed by a gun salute from the veteran’s groups and shortly after the playing of Taps by a local student.

Mastic Fire Department 9/11 Tribute Earlier this past weekend, the Mastic Fire Department reaffirmed their vow to “Never Forget.” 20 years ago today the nation faced one of its biggest challenges. Attacks against us resulted in thousands of Americans losing their lives. This weekend, Mastic Fire Department assembled to remember and honor all of the lives lost because of the events on 9/11/01, those who passed that fateful day, those who lost their lives after the fact fighting the war on terror, and those who bravely served and suffered from 9/11 related illnesses. 343 empty chairs sat front and center to remember the 343 FDNY members who bravely ran into the twin towers, never to return home. Upon these chairs red, blue, green, and white flowers were placed to symbolize the police, EMS workers, military members, and civilians who also valiantly served and were never able to return home to their families. Included in the remembrance was hometown hero, FDNY Firefighter Kevin Smith. Kevin was serving with FDNY Hazmat 1 on 9/11 and sadly was one of the 343 who did not return home. Besides being a firefighter in New York City, Kevin was a past member and former Lieutenant with the Mastic Fire Department and a long time volunteer with the Mastic Ambulance Company.

Long Island is on the front lines of climate change. As we all know catastrophic flooding, sea level rise and storm events are happening more and more frequently. The good news is we CAN fight climate impacts by investing in renewable energy. New York is a leader in the fight against climate change and is working towards 70% renewable energy by 2030. But we need your voice to support this critical change. The Sunrise Wind Farm is a proposed offshore wind farm that will generate clean power for over half a million homes. It will be located at least 30 miles off the coast of Montauk and will not be visible from Long Island. These upcoming public meetings are an opportunity to learn more about the project and to make your voice heard. We need you to STAND UP and SPEAK OUT on the importance of offshore wind power.

THE BETTOR ANGLE

Saquon Will be Gone Early On

TM

BY TOM BARTON Saquon Barkley is the best football player in the New York city area (we can’t say New York because Josh Allen plays up in Buffalo), but he is a player you can’t bank on this season. Barkley has become an enigma in the biggest media market in the United States, because while uber talented, he still is a player who has trouble staying on the field and carrying a team. Barkley was selected over high profiles QBs and a once in a generation talented offensive lineman despite the questions reigning down from analysts and fans alike. At this point in his career it doesn’t seem like Big Blue made the right call. The good news is he is still very young, very talented and has a chance to prove everyone who doubted him wrong. The bad news is this season probably won’t be the

year he can do it. The Giants RB is coming off of an injury that requires time to heal, and even when healed it takes even more time to get back to full strength. His multi ligament injury has an average recovery time of about 10 1/2 months. This week will be 12 months since Saquon’s injury. That is cutting it close. The Giants also play a Thursday night game for week 2, meaning that for everyone it will be a grind playing 3 games in 14 days. For Barkley, testing out his injured leg in such a short time is dangerous, and furthermore the Giants know this, so likely will limit his workload. Even if you are a full on Barkley believer you have to acknowledge the fact that Joe Judge and the Giants staff will try to ease him

back into the season. That means he is unlikely to turn heads early on, which could lead to some disappointing final statistics at year’s end. The sportsbooks around the country seem to agree with the assessment that Barkley won’t be himself this year. The general consensus line for him to win the MVP is 120 to 1. It’s a long shot for any running back to win the award, but these are astronomical odds for such a talent. The odds for Barkley to lead the league in rushing are much more grounded but still at 16 to 1 that’s a long shot as well. Then there is the odds that Barkley will lead the NFL in TDs and that sits at 20 to 1. If you are a believer and want to buy into some Barkley prop plays, the over 9 TDs and over 1,185 rushing yards could be tempting,

The results of our March drafts set the foundation for the fantasy baseball season that we have experienced this summer. In my mixed Dynasty League the 1st place team has opened up a 15 point lead despite the fact that they were only in possession of a 1 point lead on the last day of August. In 2017 I held a 9 point lead on the Tuesday of the final week, only to find myself down 1.5 points on the morning of the final Sunday of the season. Blake Snell went out and threw a 13 strikeout gem that Sunday and I ended up winning the league by 2 points. There are glass half empty and there are glass half full people you will meet in life. The guy who cried sour grapes in our league that an unproven rookie like Blake Snell could strike out 13 guys on an Autumn Sunday against an opponent of minor league 40-man roster call ups is clearly a glass half empty guy. I always prefer to be the glass half full guy that noticed that Blake Snell had struck out 12 batters in an early September start and picked him up off the waiver wire. The glass half full guy was not surprised when Blake Snell struck out 13 guys on the final game of the season, because he

Fantasy Sports

had witnessed him strike out 12 batters earlier that month. If you didn’t win your fantasy baseball league in 2021, it’s better to look and find the Blake Snells who were on the winner’s roster and refresh your outlook. There are almost certainly lessons in a review of that roster for you to grasp, and it will always make you a better player of this great game. When I look at the probable winner of my ESPN Dynasty League a number of improbable seasons jump out. Or should I view them as improbable. Am I being that lazy, spiteful mouse of a man from that 2017 season who hated what Blake Snell did on the final day of the season? Or should I consider mitigating factors that tell me I should love that Kevin Gausman finally lived up to all of the hype he garnered as a Baltimore Orioles prospect. Because Gausman has had a huge breakout season. At age 30, Gausman is delivering a 2.58 ERA with a WHIP that stands at an even 1.00. With Baltimore in 2016 and 2017 Gausman started 30 and 34 games respectively. And while he struck out 170+ batters both seasons, Gausman had WHIP’s of 1.28 and 1.49 in both of those years.

year, but he certainly could turn some heads after he shakes the rust off.

but I warn you, the coaching staff may limit him early and you’ll have to play catch up late. Barkley might not prove everyone wrong this

discover control in their 29th year on the planet. That both Kevin Gausman and Robbie Ray are on the same team in my league is not out of line for this owner either. He almost never gambles on young, unproven pitchers. Certainly a lesson for all of us. For every Dylan Cease, there is a Mitch Keller out there. Young pitchers always disappoint. Corey Kluber has been dropped by numerous owners in Dynasty leagues and I think that is a mistake. Will I be surprised if Kluber rebounds with a good 2022 season? Not in the least.

Gausman was always touted by scouts. This breakout, while long in coming, shouldn’t be considered abnormal. Robbie Ray turns 30 years old on October and it is a legit question as to where this 2021 season is coming from. His career WHIP is 1.32 in over 1,000 innings. So his WHIP being under 1.00 is certainly not in keeping with his previous

seasons. But with a career number of 1,254 strikeouts in 1,008 innings, it can certainly be argued that Robbie Ray always had swing and miss stuff. The change in 2021 is how Robbie Ray has really cut down on his strikeouts. Only 41 walks to date from a guy who routinely would walk between 70-90 batters per season is a drastic reduction. It is not so out of line to find starting pitchers who

Let’s switch gears to football quickly. My favorite football league had its draft over the Labor Day weekend and like every season I love the draft that my 13year old son and I had. Then again, after we drafted Saquon Barkley and Austin Ekeler in Rounds #1-2 last year we were equally optimistic. This year, our picks in Rounds #1-2 were Alvin Kamara and a repeat of the Austin Ekeler pick. So our hearts sank to see him held out of practice this week for 1 day and be rated as questionable for Week #1. Another fascinating season of reading through injury reports is indeed upon us.

An Act of God – Just What is That..?

ON THE SEA BY VINCENT PICA, COMMODORE

First District, Southern Region (D1SR) United States Coast Guard Auxiliary

Any school child knows, or at least believes, a terrible storm or other natural phenomena that causes damage to your property, or, causes your property (your boat) to damage someone else’s (another boat), is an Act of God. Behind this “fact” lies protection for the insurance company that may, or may not, have to pay (check the fine print and be sure of what you are paying for) or for you when your boat sets down on someone else’s during a storm and sinks it. Or, does it? What are the facts?

insurance company was professional in every way.

The 4-Day Nor’easter of ‘05

What Actually Is an Act of God?

Some of you may recall the severe nor’easter we had in the late fall of ’05. I do in particular because my son and I moor our boats in a bite of water east of Gunning Point, along with about a dozen other boaters. During that storm, two of those dozen boats broke loose from their ground tackle. One, my son’s, ended up about 300 yards to windward, way up in a marsh. The other, my neighbor’s (“Joe”), set down on my boat in the storm and sank it. His boat ended up against my dock and sustained considerable damage, just from being banged up against the bollards. After two days of mourning, I said to myself, “Hey, it’s a boat. Call the insurance company. Work something out. Buy another boat.” And I did. The

Given the presumption of fault, the judge had to weigh that these facts – boat double checked, lines doubled, all by competent mariners – were sufficient ballast against the presumption of fault under the law.

Enter Joe, the Neighbor

My neighbor, Joe, was really and truly sorry that it had happened. He came over to the house, hat and checkbook in hand, and offered to pay for the damages. “Joe, don’t be silly. It was an Act of God. No one’s fault. For cripes’ sake, the wind blew for 4 days straight! Go home.” And, after many, many attempts at redressing what he felt was his fault, he went home*.

An Act of God from a layman’s point of view is any natural act caused without human intervention – hurricane, tornado, earthquake, lightning, etc. From a legal point of view, it is the same. However, to seek a defense as an Act of God, there is a second test. There must be no negligent behavior by, for example, the vessel owner that contributed to the accident. There is a presumption of fault under the law, from the start, that a vessel adrift is adrift due to negligence so it is a difficult “beat to windward” to offset that presumption. If, for example, everyone in the marina doubled their lines because a heavy storm was predicted, and you didn’t, you very well may have an issue

Page 13

You won’t be surprised to know that the judge, despite several arguments by the marina owner that the vessel could have or should have taken further precautions, ruled in favor of “Trust Me II”’s owner that the facts met the legal test of an Act of God. But, what if the owner hadn’t asked for that extra help? Only God knows.

with the second test. Were you negligent in failing to act as other skippers did? A case having to do with Hurricane Katrina, a vessel named the “Trust Me II” and the marina that she was moored at highlights all of these issues. First, Katrina clearly passes the Act of God test as a natural act caused without human intervention. And there was plenty of damage caused by “Trust Me II” as she broke from her mooring lines and pingponged through the marina. And, as noted above, the presumption of fault

lies with the owner of the adrift vessel, despite the massive power of Katrina, so the facts have to be compellingly on the side of the vessel owner. So, was there negligence? The owner of “Trust Me II” didn’t go down to the marina herself. She did, however, ask two qualified mariners to check on her vessel and make sure that she had adequate lines. Extra lines were added and one of the mariners testified that “Trust Me II” was secured as well as she could be, given the circumstances.

* several months later, with his youngest daughter in tow, Joe came over with a sealed greeting card, and said, “we’re not leaving unless you open the envelope.” So, I did. Controlling Your Anger Part I

Anger is a painful, powerful, and complex emotion. When it overwhelms your spirit, you may at first just want to push it away or stuff it down, as you try to ignore or forget it. The GI Bill Part I

VETERANS WAY BY REV. FREDERICK MILLER. PH.D. When our troops returned from World War I back to civilian life it didn’t go well. Many of our veterans flooded the labor market. Many could not make ends meet. Congress stepped in and passed the Bonus Act of 1924, which promised veterans a bonus based on the number of days served. But nothing happened and the veterans got no money. In 1932 during the Depression around 20,000 veterans marched on the capital demanding their bonus money. Instead of giving them the money President Herbert Hoover sent the Army to get them out, a move which pitted the soldier against the veteran. President Franklin D. Roosevelt was determined to do better for the veterans returning from World War II. He started preparing for the veteran’s return well in advance of the end of the war. Congress developed a limited benefit to veterans who met

specific criteria such as income.

living stipend.

Former American Legion National Commander and Republican National Chairman, Harry W. Colmery proposed extending benefits to all World War II veterans. His proposal became the first draft of the GI Bill. The bill went to congress in January 1944 as the war still raged in Europe and Pacific fronts and was signed into law as THE GI Bill by President Roosevelt on June 22, 1944. In 2017, President Donald Trump signed the Bill called the Forever GI Bill.

• Provide a $20 weekly unemployment benefit for up to one year for veterans looking for work, job counseling. • Government guaranteed loans for veterans who borrowed money to purchase a home, business or farm. • Medical is for veterans.

GI BILL BENEFITS

• In 2008, Congress passed the Post-9/11 Veterans Educational Act not only giving the veterans greater educational benefits. It also allows them to transfer unused educational benefits to their spouse or kids. This will be covered in our next article.

• Those wanting to continue their education in college or vocation school could do so tuition-free up to $500 while also receiving a cost of

The GI Bill has enabled hundreds of thousands or men and women to get a higher education, many of whom could never have afforded it otherwise. It continues to empower and enable veterans and their families to reach their goals.

The GI Bill gave World War II servicemen and servicewomen many options and benefits.
