Proposed Improvement Plans for Brookhaven Free Library Delayed

A proposal that maps out improvements to the Brookhaven Free Library is on hold. This, after more residents voiced opposition than support for the project during a Brookhaven Town Zoning Board of Appeals meeting. Residents voicing opposition claim the improvements to the quaint, 96 year old library, (located at 273 Beaver Dam Road in the Hamlet of Brookhaven), to the parking, drainage, landscaping, and building and grounds would, in essence be a threat to, or compromise the integrity of the character of the community. Brookhaven Free Library Director, Judy Papandrea, said she put in a request on behalf of the library’s board of trustees to postpone the next hearing until revisions are made after taking the community’s concerns into consideration. “At the heart of it are concerns about changing the character of Brookhaven Hamlet,” Papandrea explained. “The library is the focal point of this community, and there are concerns about how the proposal will affect the overall look and feel of the Hamlet.” While seemingly sensitive to the community’s concerns, however, Papandrea said there is a definite need for work to be addressed on the exterior of the building. “Over the years we have experienced several
issues that warrant addressing that involve drainage, exterior lighting, and walkways and parking, and these are all tied together,” Papandrea explained. Drainage on the walkways, on-street parking where there are no curbs have, over time, eroded, creating valleys and water pools. “These water pools create icing during the winter,” Papandrea pointed out. “which ties into accessibility which is another concern.” Another element of the project involves parking. Presently, there are no on-street defined parking stalls by the library. Papandrea explains: “Parking on the street is chaotic, and the plan proposes to formalize parking with T-marks on Beaver Dam Road to show where parking can be, as well as hatchings which would indicate where their is no parking, because,” Papandrea added, “sometimes patrons block walkways.” Proposed on Library Lane, Papandrea continued, is angled parking. “This is just to provide better and safer access for patrons to and from the library,” she added. Curbs and sidewalks are being proposed along Beaver Dam Road only. “Curbs would help stop the eroding, and sidewalks would give formal, safer walking access,” Papandrea said. “Over the years the area has constantly been eroding, and we’re looking for surfaces to easily maintain and plow.”

Eric McFerrin, a senior partner with the engineering, architecture and surveying firm of Nelson and Pope, said the library’s proposal will likely come before the Zoning Board of Appeals on June 8th or July 6th. “We’re working on trying to reduce the hardscapes and soften improvements,” McFerrin said. “There’s not a lot that can be done, “ McFerrin continued, “because the bulk of work is being done on Brookhaven Town right of way that involves curbs, sidewalks and
drainage where Brookhaven Town has jurisdiction.” The proposal, he said, calls for brick paver sidewalks. “We want to make this as pleasing as possible to the community, but, our creative options are somewhat limited,” McFerrin said. “The goal is also that they would like to be in compliance with accessibility laws.” From a fiscal standpoint, the project as presently proposed would cost an estimated $500,000 with funds coming from the library’s
reserve fund, thereby posing no impact on the tax rate. “At the end of the day,” Papandrea said, “we still have safety, ADA accessibility, and drainage issues, and they’re all closely tied together.” Meanwhile, postponing the hearing will give the library time to hold a public meeting to consider whether to modify the plan. “This continues to be a work in progress until we go before the Town (ZBA),” Papandrea said.

Brookhaven Highway Superintendent Daniel Losquadro and Councilman Jonathan Kornreich announced the recent installation of a new traffic signal at the intersection of Wireless Road and Strathmore Village Drive in South Setauket. After numerous requests from residents in the South Setauket Park communities, a traffic study was conducted and it was determined that a new signal was warranted based on the federal Manual on Uniform Traffic Control Devices (MUTCD). A compilation of
national standards for all traffic control devices, MUTCD defines the measures used by road managers nationwide to install and maintain traffic control devices on all public streets, highways, bikeways, and private roads open to public travel. The total cost for the installation of the new signal and guide rail was $136,192. “We often receive requests for new traffic signals or stop signs,” said Losquadro. “While it is not always found to be needed in a specific location, based on several factors including the number of

Knights of Columbus 60th Anniversary

The Knights of Columbus James V. Kavanaugh Council in Mastic celebrated 60 years last month by hosting an event that honored its namesake. Former charter member and the council’s first president, Denis Nankervis, who passed away in January of this year, was also honored. The Knights of Columbus is the world’s largest Catholic fraternal organization with 1.7 million members. It provides members and their families with volunteer opportunities in service to the Catholic Church, their communities, families, and young people. The James V. Kavanaugh Knights of Columbus Council operates out of 176 Madison Street in Mastic, New York. The building itself was once the old New York Telephone building. The council purchased the property in 1963 but began operating in 1962. For the first year, the Knights held meetings in their own homes until the building was purchased, proving that community is what it was always about, even from the very start. President Pete Costelloe says, “We are based in the community. The community knows where the hall is and we never say no to offering a helping hand.”
The honoring event that took place on Saturday, May 21, 2022, had approximately 100 people in attendance and included dancing, drinks, and a little bingo. The Council typically holds two bingo games a month; one on Thursday and one on Saturday. The bingo earnings help pay for fundraisers and donate to the church and the community. The Knights of Columbus James V. Kavanaugh Council also contributes to the Helping Makes U Happy organization, a not-for-profit charity that encourages others to volunteer their time helping others. In attendance at the event were Suffolk County Clerk, Judith Pascale, Town Supervisor, Ed Romaine, New York State Assemblyman, Joe DeStefano, Suffolk Country Legislator, Jim Mazzarella, Trustee, Angelo Cassarino, and William Floyd School District President, April Coppola. Organizations in attendance included the Mastic Beach Ambulance Company, Mastic Shirley Chamber of Commerce, Mastic Beach Peninsula Society, Mastic Beach Yacht Club, and All Faith Soccer League, to name a few. Costelloe’s own daughter started playing soccer at age 5 with All Faith Soccer League when it was first initiated, which goes to show how family and community orientated the organization truly is.
Currently, Colonial Youth operates their daycare out of the property. “Anything that has to do with community and everybody helping the community, that’s what it’s all about. I learned that at an early age when I started with the Knights of Columbus,” says Costelloe. “My feelings are, when you do a lot of volunteerism, you should feel good inside about what you did. So last night’s event was a very good feeling for me because we honored somebody. We always honor somebody that is well known in the community and helps the community.”

Portraits for the Youth of Nigeria

For the second time, Bellport High School partnered with the Memory Project, a nonprofit organization that invites art teachers and their students to create portraits for youth around the world who have faced substantial challenges such as neglect, abuse, loss of parents and extreme poverty. Through the collaboration, students in the high school’s National Art Honor Society and Drawing & Painting II class created portraits and inspirational artwork for a group of children from Nigeria. The portraits will serve as a piece of personal heritage and history for these children, who are often orphaned or living in refugee camps. The high schoolers utilized a range of media, including graphite, colored pencil,

watercolors, marker, paint and graphic design software, to create unique portraits based off of a digital photo they received. Art teacher and NAHS adviser Devin Auricchio said the students were thrilled to participate in the project again. “Some Art Honor Society members were able to participate for the second time, while for many others, it was the first time they had the opportunity to create the portrait,” said Auricchio. “For our students to learn that they can use their artistic skill to create something so meaningful for someone else is a truly rewarding experience.” Bellport artists were also thrilled to receive back a video that captures the joy and excitement of the children in Nigeria. Thorne Addresses Flooding at Canaan Lake
County Clerk Judy Pascale Announces Major Law Enforcement Endorsements
After receiving dozens of appeals for help from residents near Canaan Lake in Patchogue to alleviate destructive and dangerous flooding, Legislator Dominick Thorne last week announced that, working with county and Town of Brookhaven officials, the issue has been addressed. “My office and I responded to the pleas for help from the residents, and today I am proud of our work in moving immediately to provide relief to those who live near Canaan Lake,” said Thorne. “I want to thank my partners in government as well, who worked closely with me to move quickly and achieve almost immediate results.” Weirs installed at the lake were not functioning properly, causing water levels to rise dramatically and causing flooding in homes and on the local streets. In some cases, the flooding created health and safety issues for some families. With the removal of the weirs the flooding has been all but eradicated. “Some families could not even use their showers or tubs when the flooding occurred,” said Thorne. “That is a situation that cannot remain and needed immediate attention.” Thorne was elected to the Suffolk Legislature in November 2021 and began his first term in January 2022. To date, he has spearheaded an ongoing clean up and maintenance effort on Middle County Road, had a bus stop that had was overgrown and had become a place where crime was regularly committed repaired and maintained and started a critical baby formula collection drive to assist families who are being affected by the national baby formula shortage

that is gripping the country. Thorne’s efforts at Canaan Lake are not limited to flooding issues. He is involved in ongoing efforts to reduce nitrogen levels which cause algal blooms and fish die-off. A major contributor to the issue are cesspools around the lake. Working with the Suffolk County Department of Health, residents can convert to Onsite Wastewater Treatment Systems. “Having met the hardworking people of the Suffolk County Department of Health on other site visits, they are committed to helping our residents and our environment,” said Thorne. Clerk Vincent Puleo to Call on Suffolk Legislature to Impose Term Limits on Office of County Clerk
Smithtown Town Clerk Vincent Puleo Tuesday, said his first act upon taking the Oath of Office for County Clerk in January would be to officially request the Suffolk County Legislature to pass legislation to impose term limits on the office of the Suffolk County Clerk. The County Clerk does not presently have term limits because of a loophole created by longtime incumbent Judith Pascale when she joined in litigation with former District Attorney Tom Spota to remove term limits on their offices. In 2012, the now convicted DA Spota sued Suffolk County to lift term limits on his office, arguing that as an officer of the court and representative of the “People of the State of New York” that limits upon his office could only be imposed by the State of New York. County Clerk Pascale joined in this litigation, having paid some $5,000 to a Democrat-connected attorney, to remove similar term limits placed on the office she occupied as a result of a 1993 voter-approved referendum that passed with more than 70% of the vote. Spota was successful in his case. However, although the

Teenager Arrested for Threatening Mass Shooting

Court of Appeals ruled that a County cannot impose term limits on the office of District Attorney, neither the Court of Appeals nor any intermediate appellate court has rules as to whether a County legislature can impose term limits on the office of County Clerk. “This office belongs to the people. It should not be treated as a lifetime appointment by individuals seeking to enrich themselves at the cost of the taxpayers,” Puleo stated. “That’s why my very first act as the next County Clerk will be to officially request and lobby the Suffolk
County Legislature to pass a referendum placing term limits before the voters in November of 2023. The legislature should follow the will of the people, who time and again have stated in public hearings and at the ballot box that they want term limits on their elected officials.” Puleo, who is the designated Republican Candidate for Suffolk County Clerk, is a long time advocate of term limits. “Elective office is a calling to serve the public. It should not be looked at as a limitless, lifetime means of profiting at the taxpayers’ expense,” Puleo said.
Suffolk County Police arrested a teenager after he made threats on social media about committing a mass shooting last Thursday. A 16 year old posted on his Instagram story threatening to commit a mass shooting in Bellport on May 26. Multiple people called 911. Fifth Squad detectives, along with the assistance of Computer Crimes detectives and Fifth Precinct Crime Section officers arrested the teen at his home in Bellport at
7:45 p.m. Fifth Squad detectives did not find weapons in the house. The teen was charged with Making a Terroristic Threat and Aggravated Harassment. He is scheduled to be arraigned in the Youth Part of First District Court in Central Islip on May 27. A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
Weik and Boyle Recognize 300 Vets in Vietnam War Veterans Commemoration
State Senators Alexis Weik and Phil Boyle recognized 300 Suffolk County veterans in a pre-Memorial Day tribute to soldiers, sailors, airmen and Marines who served in the Vietnam War. The “Vietnam War Veterans Commemoration” event was held at East Islip High School and featured presentations of certificates, commemorative Vietnam War service pins to
each of the veterans and select family members. The event was moved from its original location after an overwhelming response swelled the audience beyond the original expectations. “Our Vietnam Veterans served with honor, distinction and valor but, sadly, too many never received the recognition and welcome that they truly deserved,” Senator Weik said. “I am very proud and humbled to
extend to them now the gratitude of our entire community and the honor they earned.” Senator Weik said she chose to host the event near Memorial Day, when Americans pause to remember all those who gave their lives to defend our nation, as a reminder of the sacrifice of all Armed Forces veterans. The nearly three-hour service featured presentations by active duty representatives of the Army, tributes by the Long Island chapter of the Patriot Guard Riders, remarks by Steven Castleton, the Secretary of the Army’s civilian aide and representatives of local veterans posts, as well as musical performance of the national anthem by Sayville High School student Amelia Wells. A member of the Senate’s Veterans Committee, Senator Weik has worked to expand services and recognition to veterans all across the state, but especially in Suffolk and Nassau Counties, which are home to the state’s largest veteran population.
She was an early and strong advocate for expanding the highly regarded Pfc. Joseph P. Dwyer Peer-to-Peer Program for veterans impacted by PTSI to every county of the state and making the program a permanent part of the state budget. What Should Be Done About Nuclear Waste?
SUFFOLK CLOSEUP BY KARL GROSSMAN Across the Long Island Sound, the largest newspaper in Connecticut, the Hartford Courant, ran a story bannered across its front-page last month headlined: “Where will state’s nuclear waste go?” We on Long Island are nuclearfree with the shutdown soon after it opened of the Shoreham nuclear power plant and closure of the two nuclear reactors at Brookhaven National Laboratory. But just west of New London in Connecticut are its two Millstone nuclear power plants. What, indeed, is to be done about nuclear waste—produced in Connecticut and elsewhere? Decades ago, one scheme was to put it on rockets to be sent to the sun. But the very big problem, it was realized, is that one-in-100 rockets undergo major malfunctions on launch, mostly by blowing up. As Forbes magazine has pointed out, because of the “possibility of launch failure” if “your payload is radioactive or hazardous and you have an explosion on launch…all of that waste will be uncontrollably distributed across Earth.” So, scratch that idea. Then there’s been the plan to construct a “repository” for nuclear
waste at Yucca Mountain, Nevada, 100 miles northwest of Las Vegas. It was designated the nation’s “permanent nuclear repository” in 1987 and $15 billion was spent preparing it. The very big problem concerning Yucca Mountain as a nuclear waste dump: it is riddled with 32 earthquake faults.
challenging—along with the state governments of Texas and New Mexico—the present U.S. government plan involving “socalled interim” nuclear waste sites in Texas and New Mexico. They’d be amid largely Latino communities, and on top of the Ogallala Aquifer, the largest aquifer in the U.S. It extends north to South Dakota, encompassing eight states, and is a main source of water for drinking and irrigation.
So, that idea was scratched. Now, Finland has built a nuclear waste site for its four nuclear power plants. “Finland wants to bury nuclear waste for 100,000 years,” was the title of an CNBC’s piece about it and how it uses “a labyrinth of underground tunnels.” The very big problem: nuclear waste needs to be isolated from life for way more than 100,000 years. The U.S. Court of Appeals for the District of Columbia Circuit in 2004 ordered the EPA to rewrite its Yucca Mountain regulations to acknowledge a million years of hazard. “And that’s actually a lowball figure,” says Kevin Kamps, radioactive waste specialist for the organization Beyond Nuclear. Some nuclear waste stays radioactive for millions of years, notes Kamps. “Iodine-129 that is produced in reactors has a 15.7 million-year half-life.” After a

half-life, a radioactive material is half as radioactive as when it was produced. For determining a “hazardous lifetime,” a half-life is multiplied by 20. Thus Iodine-129 remains radioactive for 314 million years. “The design of the storage facility” for nuclear waste in Finland “has taken into account the potential impact of earthquakes and even future ice ages,” related CNBC. But not for anything close to millions of years. So, what should be done about nuclear waste? First, says Kamps, “we should stop making it.” He calls for the

closure of every one of the 92 nuclear power plants now in the U.S., the building of no more and a push for safe, clean, green energy sources led by solar and wind energy. Nuclear power plants in the U.S. have since 1957 generated nearly 100,000 tons of deadly nuclear waste, he says. Second, the “best option is hardened onsite storage.” Currently, most nuclear waste, he says, is at reactor sites in pools of water which must be kept circulating. If there is a “loss of water” accident, the nuclear waste in the pools can go “up in flames.” Kamps and Beyond Nuclear, with other environmental and safe-energy groups, is now

Last week the ping pong balls were drawn and the NBA draft order was set. The Orlando Magic will pick first overall. The top three teams each had the same 14% chance to earn that #1 distinction. The Houston Rockets and Detroit Pistons being the other two, will pick 3rd and 5th respectively. Oklahoma City will select #2 while the Sacramento Kings will round out the top 5, as they pick 4th. Orlando will pick first for the first time since 2004, when they took Dwight Howard. The New York Knicks knew they wouldn’t be a top choice, but they did end up with the #11 overall pick. That should be encouraging for New York fans, as this is considered a deeper draft than most seasons. Jabari Smith is the favorite to go #1 overall with -130 odds. Chet Holmgren is next at +160 and Paolo Bancheroat +475 are the only names that aren’t 10 to 1 or more to be first
selected. While most insiders believe there is a lack of a true ‘difference maker’ in this group of youngsters, most do agree that they have been wrong before. That is what the Knicks can hang their hats on. Since the Euro model player has taken over the NBA we have seen the draft become more of a crapshoot than ever. You could argue that the 3 best players in the NBA right now are all from Europe, and all were taken later than they should have been. Giannis Antetokounmpo was drafted with the 15th pick back in 2013. The back to back MVP Nikola Jokić wasn’t selected until the 2nd round, with pick 41 overall, and even Luka Doncic watched two names be called before his in 2018. In recent drafts it goes even deeper than that where the Knicks can point to 2019 where Tyler Herro went #13 and 2020 when Tyrese Maxey went #21, both of whom have shown plenty of promise in

The first third of the baseball season closes out this week and this isn’t a bad week to look closely under the hood. Since there is still 2/3 of a full baseball season to be played, nobody should be throwing in the towels at this point. In my mixed dynasty league the best team ERA is 2.57 as a staff The worst staff ERA is 4.25. The league leading staff has had great performances from Taylor Rogers, Joe Musgrove, Tarik Skubal, , David Robertson and Shane McClanahan. The team with the worst ERA in the league has has had Trevor Rogers march out to an ERA over 5.00, they invested in Seattle rookie starter Matt Brash and the currently struggling German Marquez of Colorado. Are there lessons here in these examples? Of course there are. Let’s delve into them. Coming into the season, plenty of analysts in the fantasy baseball community advised caution with Shane McClanahan. I never bought into the innings usage arguments however. The fact that McClanahan never made it in to the 6th innings of a lot of his starts as a rookie did not concern me for his sophomore season. What did

disturb me however was that he did give up a lot of hard contact in 2021. If anything his ERA in 2021 looked generous and his WHIP gave off warning signs. Well, McClanahan has been superb in 2022 and has his WHIP below 1.00. I sure hate putting ceilings on young arms that can reach the high 90’s on the radar gun. Still, McClanahan’s 2.06 ERA and his WHIP of 0.88 are not sustainable, especially in the American League East. Contrast this with Miami’s Trevor Rogers. Rogers has struggled in nearly every start, but it is his pitches which are the big problem. Rogers had an awful lot of success in 2021 with his changeup and the pitch just isn’t working for him in 2022. So the team with the worst ERA in the league should consider benching Rogers for a week or two until you see some signs that the pitches are working better in 2022. What do you do about Shane McClanahan however? You know that his ERA and WHIP numbers are not sustainable but he goes out each week and throws another quality start. The answer is simple. DYLAN CEASE. Dylan Cease? What kind of

call that a reversion to the mean, and it can happen to anybody at any time. For all of the good pitching that Cease has done so far in 2022, it took one bad start for his numbers to revert to the mean. And you can’t pretend as if you know when this is coming or you can spot a trend that will give you advance notice that it is coming. It isn’t like we have 4 seasons of history with Shane McClanahan here. We have just one. So while

Memorial Day 2022
VETERANS WAY BY REV. FREDERICK MILLER. PH.D. Memorial Day is an American holiday observed on the last Monday in May, honoring the men and women who died while serving in the U.S. military. It became an official federal holiday in 1971. Many Americans observe Memorial Day by visiting cemeteries or memorials, or participating in parades. Originally known as Decoration Day, it originated in the years following the Civil War. The Civil War 18611865 claimed 620,000 lives, and required the establishment of the country’s first national cemeteries. By the late 1860’s Americans began holding springtime tributes to those fallen soldiers, decorating their graves with flowers and reciting prayers. General John A. Logan, leader of an organization for Northern Civil War veterans, called for a nationwide day of remembrance. The 30th of May,
1868, was designated for the purpose of strewing flowers, or otherwise decorating the graves of comrades who died in defense of their country. The date of Decoration Day as he called it was chosen because it wasn’t the anniversary of any particular battle. During World War I the United States found itself embroiled in another conflict, and the holiday evolved to commemorate American military personnel who died in all wars and became known as Memorial Day. In World War I we lost 116,520 military personnel. In World War II we lost 405,000, in the Korean war we lost 36,500, in Vietnam 58,200 and during the Gulf was and the War on Terror some 7,350 military personnel. In 1968 Congress passed the Uniform Monday Holiday Act, which established Memorial Day as the last Monday in May in order to create a three-day

weekend for federal employees. The change went into effect in 1971. The same law also declared Memorial Day as a federal holiday. On May 3, 2000 the United States government pushed out “National Moment of Remembrance” at 3pm local time on Memorial Day to take
several minutes and stop and reflect and have awareness and reverence for those who have died defending our Nation and our values. This important moment was signed into law on that date by President Bill Clinton. Cities and towns across the United States host Memorial Day
parades each year, incorporating military personnel and members of veteran’s organizations. Here on Long Island many of those parades are sponsored by the veteran’s organizations. It is also a day where many people not only fly their American Flags, but wear red poppies.

We’ve written a lot of about ethanol in marine environments for some important reasons – it is “hydrophilic.”

This means it loves water and absorbs it in greater quantities than conventional gasoline [read: not good for engines]) Also, it is a strong solvent – older resin-based fuel tanks dissolve when you add even E10 to the tank. In April 2022, the Federal government announced the authorization that allows the summer sale of gasoline that has 15% ethanol (E15). Although E15 is normally prohibited between June 1 and Sept. 15 because of concerns that it adds to smog in high temperatures, the waiver is another effort to help ease global energy markets that have been rocked since Russia invaded Ukraine. This action by the government is thus praiseworthy. However, the United States Coast Guard wants boaters to be aware of the possible damages that the recently-authorized fuel can cause to boats. Further, officials with the Coast Guard mention that the E15 is federally prohibited for recreational vessel use.

That is a legitimate concern that I don’t want to minimize. Here is an idea. When changing the fuel/ water separator, pour some of the gasoline, or ask your mechanic to pour some, into a clear jar and check the level of water and debris. If you see little specks in the fuel, you could have a potential ethanol problem. Those specks could be pieces of rubber fuel line that has begun to deteriorate internally.
Don’t put gasoline in my diesel tank!
Don’t put fuel in my water tank! Don’t put fuel in my marine sanitation holding tank! And now – don’t put E15 anywhere in my boat! Why? Remember, ethanol is a solvent. If hoses and tanks do start to dissolve even in the slightest, this will lead to gumming up of all fuel lines. As water gets picked up into suspension in the hydrophilic fuel, it becomes explosive as it turns to steam in a confined area – like the valves and piston areas. All modern marine engines are designed to run up to 10 percent ethanol blend. But not E15.
What Can You Do?
First, the EPA waiver is not an effort to mandate the use of E15 but it could create confusion among the owners of boats and other nonroad vehicles and that could lead to mis-fuelling. To aid the mariner, E15 can only be sold at pumps that are clearly marked, according to the EPA. But I wouldn’t be bashful about asking!

What About Winter LayUp – Empty or Full?
While we just came out of the winter lay-up, you’ll need to think about this eventually. And the question about the fuel system always is, “Empty or Full?” Do you drain down the fuel out of the tank for the winter or fill the tank to the top? Now, remember, ethanol is hydrophilic – it loves water. If you fill the tank up, AND you add fuel stabilizer AND you run the engine for a while so that the stabilizer makes it into your fuel lines, you will have a pretty good system. The full tank keeps condensation from forming along the sides of
the tank and the stabilizer, along with the fuel itself, is fighting the solvent nature of the ethanol. Some mariners believe that draining the tanks all the way down is best as you are not relying on the stabilizer to do a job that might be too tough over a long, cold and damp winter. I, for one, don’t buy it. Empty tanks invite condensation along the inner walls of the tank. This will be problematic in the Spring commissioning. And I remember why we used to fill the tanks in the old days – because the fumes are more likely to cause an explosion than the fuel!
But What About Those
If you find them, replace the fuel lines with a new ethanol-resistant line. A water/fuel separator can catch debris before it reaches the engine and I recommend filters with a 10-micron rating. If you use 2-micron filters, you will be changing the filters every other Saturday. 10-micron filters should be changed every 50 to 100 hours, as well as for winter layup. And don’t let them put E15 in your boat! I was told that if I do not agree with my Community Medicaid determination, I should request a Fair Hearing. What is a Fair Hearing?
A Fair Hearing is how to challenge a determination made by a local social services agency (hereinafter “Agency”). An Administrative Law Judge from the New York State Office of Temporary and Disability Assistance Office (“OTDA”) precedes over the hearing. If successful, the hearing will result in a written decision directing the agency to “correct” the case. The reason for a Fair Hearing varies from case to case. If the Agency denied your application, that is obviously reason to request a Fair Hearing. If the Agency approved only partial coverage, assessed a penalty period, or miscalculated your monthly contribution, these are also grounds for a Fair Hearing. Timing is crucial when requesting a Fair Hearing. You must request a Fair Hearing within 60 days of receiving the Notice of Decision. If you were already receiving Medicaid long term care
and your plan reduced or ended your eligible hours, the process is different. You must first make an appeal to your Medicaid Long Term Care Plan (“MLTC”) within 60 days. The plan has 30 days to render a decision. However, if you want your services to remain unchanged, you must request the Plan Appeal within 10 days, called “aid continuing.” If urgent, you can request a decision be fast tracked and you receive the plan decision within 72 hours. If the MLTC stands by its decision, you must request a Fair Hearing from OTDA within 120 days. A Fair Hearing can be initiated by mail, fax or telephone. You will need your Medicaid case number, notice number (if applicable) and the reason for requesting the hearing. The hearing request is processed by the New York State Office of Temporary and Disability Assistance in Albany. The actual hearing is conducted through your local social services agency (for example Suffolk County).
applicant or recipient is then given the opportunity to respond. Once both sides have stated their position, the Administrative Law Judge may pose questions to each party. Once the record is complete, all written material and the recording of the hearing will be reviewed and a decision will sent by mail. If you are successful with your Fair Hearing, the local agency will have ten (10) days to comply with the decision. If you are not successful, you have four (4) months to appeal in the New York State Supreme Court. Although you can request a Fair Hearing without an attorney, when the stakes are so high it is a good idea to hire an experienced elder law attorney. To prepare for a Fair Hearing, you have the right to request an evidence package from the local social services agency. The evidence package will explain why the agency made the determination it did. You’ll need this information should before the hearing so that
you have time to review and prepare your response. If you want to submit a written response, it can be sent to the local agency and Albany before the hearing date. At the hearing, the representative from the local agency presents the Agency’s case. The Medicaid

his own name. Jacob then names the place where they wrestled Penuel, which means “face of God” or “facing God.”
The earliest angels had no wings, not even the Judaic ones. Jacob, the son of Isaac, saw in a dream-vision a ladder of angels. Some of the angels were climbing and some descending as they hurried about their work between the realms of man and God. They are not described as having wings and did not fly.
The identity of Jacob’s wrestling opponent is a matter of debate. He is named variously as a dream figure, a prophetic vision, an angel, or even God. The interpretation that Jacob wrestled with God is common in Protestant theology, endorsed by both Martin Luther and John Calvin. Calvin believed the event was only a vision. Other commentaries treat the expression of Jacob’s having seen God “face to face” as referencing the Angel of the Lord as the “Face of God.”
In those days angels acted more as the kind of interior guides that people work with today in their dream journals rather than external beings. They could be counted on to appear when you called on them. Jacob wrestled all night with someone who would not reveal his name or identity. We could take from this strange tale that even in nomadic times men and women wrestled with their guilty inner selves. Jacob bore a great deal of guilt. As a young man, he had cheated his brother Esau out of his inheritance. He ran away and later took two wives and sired two sons and many daughters, including illegitimate children with various maids. Then he decided to return to his home in Canaan. He was very afraid. He camped a half day’s distance

from his brother’s place and sent presents by messengers to Esau. He sent him entire herds of goats and sheep, thirty milk camels with their foals, ten bulls, twenty donkeys and ten foals, and forty cows. Still, he could not sleep not knowing whether Esau would take revenge on him and he’d be killed the next day.
That night someone came to Jacob and engaged him in a night-long wrestling match. Jacob’s wrestling with the angel is described in Genesis and also referenced in Hosea. The “angel” in question is referred to as “man” and “God” in Genesis, while Hosea references an “angel.” The accounts include the renaming of
Jacob as Israel. In the Genesis narrative, Jacob spent the night alone on the riverside, camping close to his brother’s home. He encounters either a man or an angel who proceeds to wrestle with him until daybreak. In the end Jacob is given the name Israel and blessed, while his opponent refuses to give
This dramatic wresting scene has led to much commentary from Judaic, Catholic, and Protestant theologians, biblical scholars, and literary critics. Does Jacob wrestle with God or with an angel? Was the struggle an actual physical confrontation, or a dream or a vision? There is much speculation and no definitive answer. The story has been rationalized, romanticized, believed to be a myth, and treated symbolically.
