Over One Hundred Fugitives Arrested on Long Island

A two week warrant operation dubbed “Long Island Wave” led by the U.S. Marshals Service has put dozens of gang members behind bars. The initiative resulted in 116 arrests. The goal of the operation was to disrupt gang activity in Nassau and Suffolk Counties by locating and arresting gang members with outstanding warrants. Eighteen state and local law enforcement departments, as well as our federal partners from across Long Island joined together to create a two hundred officer task force. Long

Island Wave was conducted from May 2 through May 13, 2022. The operation was the culmination of months of planning and resulted in the arrest of 69 gang members with charges that include homicide, attempted murder, robbery and weapon possession. Legislature/Local Organizations Band to Address Baby Formula Shortage By Barbara LaMonica

The singular source of nutrition for most infants and babies is baby formula. But, a nationwide shortage has left parents, their families and friends, scrambling around the Island in pursuit of the formula, only to come up short after spending hours searching store shelves and money on gasoline. The shortage was triggered, in part, by New York supply chain issues, only to be compounded by the closing of Abbott after it was discovered bacteria from the plant was allegedly associated with the Abbott’s which manufactures Similac and EleCare. This prompted a Similac recall. Calls made to Reckitt at 1-800BABY-123, which manufactures Enfamil, were on hold longer than an hour. So, in an effort to help increase the baby formula supply shortage, Suffolk County 7th District Legislator Dominick Thorne hosted

a press conference at the Patchogue Theatre and was joined by Randi Shubin Dresner, CEO of LI Harvest Food Bank; Adriann Combs, DNP Clinical Director of OB-GYN Services for Northwell Health; Patricia Mele, DNP, NNP-BC, Director of Prenatal-Neonatal Services of Northwell Health; and a representative for LI Health Start. Together, they are teaming up in a baby formula collection effort appealing to anyone who is able, to bring sealed, UPC use-by code dated formula to LI Harvest or to Legislator Thorne’s office, located at 90 West Main Street, in Patchogue. “We’re accepting donations of baby formula to get them into the hands of families with infants and babies, and we’re going to continue outreach,” Thorne told the throng of media at the press conference on Monday. Dresner said LI Harvest is reaching out to communities,

parents and caregivers who are busily combining through supermarket shelves for the baby formula. “All they used to do was go to the store and pick up their baby formula ~ that’s all,” Dresner said. “They would just go to the store to buy their formula, but nowadays, that’s not the case.” Dresner held up baby formula samples explaining that LI Harvest will accept formula with unexpired use by dates that are in sealed canisters and packaging.

Northwell’s Dr. Combs said Northwell Health performs 30,000 deliveries annually. “We are committed to making sure mothers and infants get everything they need...” Dr. Combs said mothers are encouraged in the beginning to breastfeed feed their babies, and are further encouraged to continue sustained breastfeeding. Dr. Combs cautions mothers not to dilute the formula and to only feed their infants FDA approved

formula. Dr. Mele cited an email she received that is only one of several reflecting similar stories where a grandmother of her 11 day old grandson was in pursuit of the infant’s hypoallergenic formula. “This is one of so many emails we have been receiving,” Dr. Mele said. Meanwhile, FDA Director Dr. Robert Califf reported that Abbott may be reopening to resume formula manufacturing, but it’s anyone’s guess as to when young families will see light at the end of the tunnel. LI Food Harvest’s Dresner defined the formula shortage as “a rolling problem,” and said that once production does pick up, manufactures are going to have a lot of catching up to do to meet the ever increasing demand for baby formula. He has been at the helm of the Suffolk County District Attorney’s, (DA), Office for just under five months, and he’s making inroads and paving the way for groundbreaking initiatives aimed at increasing the public’s safety. Elected to the office on November 2, 2021, Ray Tierney brings 27 years of experience as a federal and state prosecutor to the office of the Suffolk County District Attorney’s Office. In an interview with South Shore Press last week, Tierney outlined steps he is taking to restructure the District Attorney’s Office and the aggressive stance the office is taking to put a lid on violent crimes. Restructuring the DA’s office was high on Tierney’s agenda of priorities when he sought election to the office, and is a campaign promise he is keeping. “We generally took the resources of the office and centered them around directing those resources into courtrooms to expedite cases,” Tierney said. Additionally, the District Attorney explained since taking office January 1, 2022 his office now has a “dedicated Gang Unit” which is designed to address violent criminal enterprise. “We

Tierney further commenced the BEAST, (Biologic, Environmental, Animal Safety Team), unit headed by recognized prosecutor Jed Painter, a recognized leader in prosecuting animal cruelty cases in the county. “We have ten prosecutors and an investigator who are targeting animal cruelty cases,” Tierney explained. “Also,” Tierney continued, “under the prior administration merged the Homicide Squad, and we’ve taken that and made it into its own Bureau.” Tierney says solving a myriad of cold cases is included on his office’s list of “accomplishments”: “There are a lot of cold cases, including Gilgo Beach, and we need to specifically address these crimes, and we’re going to provide support and expertise.” Tierney cited the most recent 42 year old unsolved homicide case involving exhuming the body of Herbert Rice and through DNA analysis proved he was the perpetrator. “This provided closure for the Wilkowitz Family, and is emblematic of the efforts of the

Oasis Rehabilitation And Nursing “Knocking Out” Parkinson’s Disease Kathryn Montgomery was successfully discharged from Oasis Rehabilitation and Nursing on Monday, May 16th after several months. When she was admitted, Kathryn was unsure if she would be able to return to her home due to her decreased ability to function independently secondary to Parkinson’s Disease. Parkinson’s Disease debilitated her and placed her at a high risk for falls. Her Movement Disorder Specialist recommended Oasis because of our specialized Parkinson’s program. With our multidisciplinary care team, we were able to develop a comprehensive and individualized treatment program. Parkinson’s specific strategies and exercises are taught in the Parkinson’s Program, and as a result of Kathryn’s hard work, her previous medical conditions no longer inhibited her function. By eliminating her fear of falling, increasing her strength, and improving her balance, her quality of life has improved. She is able to spend time with her loved

ones at home. Kathryn’s progress won’t stop now that she has safely returned home. The Parkinson’s Program at Oasis provides a community support group and Rock Steady Boxing classes at no charge to the participant. Kathryn has successfully completed her rehabilitation and regained her independence. Had she not worked so hard with the Oasis team, she may have spent her golden years living in a LongTerm Care Facility due to her Parkinson’s disease.

An Ivy League graduate, Tierney is a 1988 alumnus of Brown University where he earned his BA in History and English, and subsequently received his juris doctorate from St. John’s

University School of Law. He came to the office decorated with a litany of recognitions and awards. He was named Federal Prosecutor of the Year for the successful prosecution of over 20 MS-13 members in US v Alvarenga; he is a recipient of the FBI Long Island Gang Task Force “Meritorious Service Award” for the successful prosecution and support of the FBI’s Mission to Combat, Disrupt and Dismantle MS-13; Federal Law Enforcement Association Prosecutor of the Year for trial prosecution of several MS-13 members in US v Geovany Prado; Federal Agents “True American Hero Award” for successful trial prosecution of Colombian Norte Valle Boss in US v Carlos Arturo Patino Restrepo; Southampton Town Police “Full Court Press Prosecution Award” for successful prosecution of US v Manning, Coffey, Johnson and Gilliam; Suffolk County District Attorney Office Distinguished Trial Advocacy Award for successful trial prosecution in People v. Clune American Legion Post 1533 Annual Mastic Beach Memorial Day Parade and, suffice it to say, he has a thing or two (or three or four) to be honored for. U.S. Air Force Veteran Fred Miller began serving his country in the 1950’s as a medic for the Air National Guard in the Korean War. Since then, Miller has donned many hats including Nassau County Chief of Parasitology, ordained

Veteran Frederick Miller Named Grand Marshal at Mastic Memorial Day Parade reverend and chaplain, and pioneer of the Veteran’s Peerto-Peer program on Long Island. In 2012, about a month after becoming minister, Miller received a CNN article that spoke about the suicides of veterans in the United States. After doing his homework and discovering that a staggering number of approximately 20 suicides a day are committed by veterans, Miller knew that he had to do something about it. “I found that everyone was taking this survey (on PTSD) suicides but nobody

was preventing them from happening. So, I formed a program to train members of the Post on PTSD and how to help a veteran and prevent suicide,” Miller says of the programs conception. Miller’s Veterans Peer-toPeer Program started in 2012 at his Post in Mastic, but has since grown to become a Nassau and Suffolk County program. To date, over 100 legion members and over 50 auxiliary women have been trained in peerto-peer work and can bring a veteran to a clergy or a hospital to seek help. Miller has also made arrangements to bring approximately 50 clergymen into the program. Those who participate in the program as

counselors undergo training and then work with veterans who are struggling with posttraumatic stress disorder associated with serving in combat. Legion and clergy members who serve as peer counselors in the program go through training via the International Critical Incident Stress Foundation, which provides similar training to first responders who provide peer support. The meetings are an opportunity for struggling veterans to talk one-onone with someone who may have gone through similar experiences as them. Meetings are always confidential, and only first names are exchanged.

“A veteran will talk to another veteran or a member of the clergy quicker than they’ll talk to anyone else. Amazingly, you see a change in their eyes,” Miller says of the veterans who seek help through the program. “I really believe that’s my purpose, that’s why I was sent here. And I won’t stop until I can’t walk anymore and even then, I’ll get on the telephone. Whatever it takes.” In addition to the Peer-toPeer program, Miller he is also a member of the Rotary Club and a member of the Chamber of Commerce of the Mastics and Shirley. “I jokingly will say to people that I need to find a job so that I can get a day off”, says Miller. “But really I tell people I’ve never worked a day in my life. I do what I love to do so I never consider it working.” And the trick to still having the energy to do it all? Miller says, “well, the trick is to not sit on the couch and die. You gotta stay busy. Veteran Educator Named Next Superintendent of South Country CSD

During the May 18 meeting of the South Country Central School District Board of Education, the board appointed Mr. Antonio Santana as its next superintendent of schools. To ensure a smooth leadership transition, Mr. Santana will join the district on July 1 as assistant to the superintendent. He will work closely with current Superintendent of Schools Dr. Joseph Giani before assuming the role of superintendent effective July 30. A veteran educator with more than 23 years of experience, Mr. Santana joins South Country from the Glen Cove City School District, where he has served as principal of Glen Cove High School for seven years. Prior to joining Glen Cove, he served as principal of Port Jefferson Middle School and held administrative positions in the Three Village Central School District and Valley Stream Central High School District. He began his career in education as a teacher at Alfred B. Mason School, PS/IS 226, in Brooklyn. “We are thrilled to welcome Mr. Santana to our district,” said

He also developed and implemented a credit recovery program utilizing district resources facilitated by teachers, as well as a work-based learning coordinator, to provide opportunities for students to utilize career and technical education pathways. In addition, he oversaw the development and implementation of the high school’s budget, including auditing school expenditures and forecasting programmatic changes and related costs to inform budgetary planning. “I am extremely excited and humbled to have been selected to serve the South Country Central School District as the superintendent of schools,” Mr. Santana said. “Through the valuable experiences I have been afforded in the various districts I have served, I have come to appreciate what an educational community values and

The Eastport-South Manor Central School District hosted its inaugural STEAM Fair at Eastport-South Manor JuniorSenior High School on May 12. The well-attended event welcomed students in grades K-6 to participate in a plethora of hands-on science, technology, engineering, art and math-

themed activities with friends and family members. Among the activities featured at this expansive event were cup stacking, button making, shark drawing, KidOYO, Lego walls, escape boxes, a catapult challenge and a robotics demonstration by an ESM Junior-Senior High School student.

A Library/Town Digital Partnership

The Mastics-Moriches-Shirley Community Library received a $20,000 grant to digitize its business records. The library is partnering with the Town of Brookhaven to use Laserfiche© software – the system used by the Brookhaven Town Clerk’s office, which is one of the largest town clerk offices in the country – to digitize the library’s human resources and operational records. Paper records will be scanned offsite using the

Town Supervisor Speaks with Generation Citizen Students

Bellport High School senior Rianna Raghunandan has earned a full Gates Scholarship to attend Yale University in the fall to study biology on a pre-med track. Raghunandan is one of only 300 students from across the country to earn this highly selective scholarship following an application process and interview. Among other criteria, applicants must be in the top 10% of their graduating class and participate in extracurricular and community service activities. Raghunandan is the Class of 2022 valedictorian, an AP Scholar with Honor and a National Hispanic Recognition Award recipient. She is also treasurer of the Tri-M Music Honor Society and a member of the National, Math and Science honor societies, as well as the Art Club,

and later as village hall for now dissolved Village of Mastic Beach. The building – which is now undergoing a complete renovation – is part of a comprehensive three-site library expansion and renovation project to be completed in full by 2024. Dr. Bernard Berger, Lyme Disease Medical Pioneer in Suffolk, Passes Away

SUFFOLK CLOSEUP BY KARL GROSSMAN A medical pioneer in Suffolk County in identifying, treating and also speaking out about the gravity of Lyme disease and its spread died this month. Dr. Bernard Berger, a dermatologist who passed away at 85, wrote early journal articles in the 1980s on the identification of Lyme disease and its treatment with antibiotics. And he was highly critical of the lack of urgency the Suffolk County Department of Health Services took toward the disease. “I absolutely believe we’re approaching an epidemic,” Dr. Berger was quoted as telling The New York Times in 1987 in an article it published headlined “TickBorne Disease Infects Suffolk.” Said Dr. Berger: “There are certain areas like Montauk, Shelter Island and North Haven where it’s not unusual to have at least one member of the family contract Lyme disease.” Dr. Berger was a “go-to” medical person when I wrote early on about Lyme disease. As to the insufficient interest in Lyme disease by the Suffolk County Department of Health Services, in this column in 1987 I noted that the New York State Department

of Health had just described Lyme disease as “endemic” in Suffolk and said the county was the worst area for Lyme disease in the state.

I related that Suffolk County health commissioner, Dr. David Harris, asserted that Lyme disease must take “its place besides other diseases in the county” and holding that it was “treatable.” That’s 35 years ago, and in retrospect it should be acknowledged that Dr. Harris, and under him the county Department of Health Services, was vigorous then in efforts at dealing with AIDS. AIDS was striking the New York area—and Suffolk—hard in the early 1980s. And unlike many areas of the nation where, amid the homophobia of the time, strong action wasn’t taken, the Suffolk health department was moving robustly, even though the miraculous “cocktail” drugs for AIDS were yet to become available. But, no question, on Lyme disease, strong action by the Suffolk agency was lacking. Indeed, Suffolk County Legislator John Foley of Blue Point, long chairman of the legislature’s Health Committee, felt compelled to put forth a resolution directing the Department of Health Services to develop an action plan

because, as Foley said, its actions had not “been strong enough.” Meanwhile, Dr. Berger, out of his office in Southampton, was treating hundreds upon hundreds of Lyme disease victims, conducting research and speaking out. He retired in 2018 noting that when “I opened my practice in 1971, with my pregnant wife serving as secretary and nurse, I was the only dermatologist on the South Fork,” and that he planned to remain active in sports. He was a passionate athlete who competed in triathlons and running events, loved tennis and sculling. He was diagnosed that year with

Amyloidoisis, a disease that causes failure of organs such as the heart and kidneys. He died at home in East Hampton surrounded by his family and friends. Dr. Berger and his wife of 52 years, Phyllis, had three children. Dr. Berger also had an extensive military career. This included serving in the Army as a captain with service at an Army hospital. Discharged in 1968, he went back to the military in 1975 joining the Air Force and was chief of hospital services at a U.S. base in Japan. He continued in the Army Reserve retiring with the rank of colonel. Will the kind of miracle drugs developed for AIDS ever come

The medical need for vaccination against Lyme disease is steadily increasing as the geographic footprint of the disease widens.” Dr. Berger warned us decades ago about that widening.

The New York Mets sit in first place in the NL East. Mets fans should feel great. They have the most wins in the National League, and Mets fans should feel great. They also have the second best run differential in the league and still sit as the 3rd shortest odds to win the World Series at 8 to 1. Let’s repeat ... Mets fans should feel great, but they don’t. This week it was revealed that their big free agent acquisition Max Scherzer would miss 6 to 8 weeks with an oblique injury. Scherzer was pitching like a Cy Young candidate, which is nothing new for the ace, but it was so much more needed this season with the Mets regular ace Jacob deGrom missing much of the year. When Scherzer was signed in the offseason Mets fans had visions of a Mad Max and Cy deGrom combo. That deadly 1-2 punch would intimidate any offense in baseball and the Amazin’s looked just that. There was however the other

side of the argument, that other side is why New York fans are down on this team suddenly. Scherzer is soon to be 38 years old while deGrom has had a multitude of arm issues for years. The health of these two seem even more important than ever because Steve Cohen has pushed all his chips into the middle for the 2022 season. All of the Scherzer news came on the back of some ominous deGrom news just days before. It was reported that deGrom went for an MRI to check on his scapula injury. The news after was spotty at best. The good news was there were no setbacks, the bad news is the Mets made it very clear that there is no timetable for his return. Mets fans can look at the glass half full. They can see Scherzer returning in July and be thankful it isn’t an arm injury. They can also be hopeful they will see deGrom back around the same time, fully healed and ready to roll into the postseason push. Optimistic Mets fans can also

Every Memorial Day Weekend signals the 1/3 mark of the baseball season roughly. It is the point of the season where the front runners broadly identify themselves. However, it is by no means set in stone as to who is going to win your league and there is still a ton of baseball to be played. Most pennants are decided in September and that is the true gut check time. Still, much has to be done as you pull into the Holiday Weekend and a good look under the hood is in order. Hopefully, you are not considering bailing on any categories at this early point, and you are doing the things necessary to add to your counting stats in a host of areas. I like the simplicity of looking at every stat and multiplying by 3 to garner a peak as to how the current season looks from a season long perspective. Trea Turner has 2 home runs thus far in 2022. He is on a rough pace for 6 home runs. There is no way that people drafted Trea 1st overall in fantasy drafts to get 6 home runs. Throw in his .280 batting average. What to do with this puzzling slow start. Part of me looks at his slow start

It’s too early to decide if this is affecting Trea Turner in the same way. After all, a review of his home/road splits show a much higher OPS at home for Turner. I would mark Turner down as a candidate to put in a very good remaining 2/3 of the season and you might come across an impatient Trea Turner owner who could be swayed into parting with him at an attractive price. A player on the upside is certainly Jeremy Pena of Houston. The Astros never pushed the panic button on the Carlos Correa free agency period and certainly acted as if they had an ace up their sleeve. Well, they certainly do seem to have had one. Pena has been a force at the plate with 7 home runs and a .276 batting average and a .338 on base percentage. His .856 OPS is a nice mark from a 24 year old

Trevor Story’s bat has woke up in Fenway Park and he hit 3 home runs the other night. He is now up to 5 home runs and 5 stolen bases on the season and I think we have all gotten used to 20/20 seasons out of Story over the years. Fenway is

Selling Property in a Trust

Q: Can I sell property that I have put in my trust? A:

Yes. Selling a property held in trust is very like selling a property held in one’s individual name. But, there are certain factors to consider before deciding to sell and how to structure the sale.

The Trustee holds the power to sell property held in a trust. For most revocable trusts, the creator of the trust is also the acting Trustee of the trust. The Trustee lists the property for sale, hires the real estate broker and real estate attorney, and goes through the standard sale process. The Trustee is the grantor and beneficiary, so the sale process does not require any additional parties. The sale proceeds are then placed in an account titled in the name of the trust. An irrevocable trust usually has a Trustee separate from the grantor. Even if the grantor is still living, the Trustee has the discretion whether to sell the property and must sign all papers related to the sale. There are many different types of trusts and it is important to remember that the

language in the trust instrument controls.

Some irrevocable trusts, like Medicaid Asset Protection Trusts, reserve a life estate in a residence for the grantor. This means that the Trustee cannot sell the grantor’s home without the grantor’s permission. If the grantor of a Medicaid Asset Protection Trust agrees to the sale, the money from the sale will not be available to grantor. It instead may be used to purchase substitute assets in the name of the trust, for instance, a new home. This is very important to keep in mind when depositing the sale proceeds into the trust account. No matter the type of trust, the net sale proceeds must be distributed in a bank account titled in the name of the trust. The Trustee of the trust will be the one to open this account with a financial institution. It is a good idea to set this up in advance of the closing to avoid any issues or delays in opening the account. The Trustee must consider the tax implications of a sale. Assuming the trust is a “grantor trust”, the grantor

is taxed on any capital gains from the sale. If this is the grantor’s primary residence, they have a $250,000 individual exclusion ($500,000 for a married couple) for capital gains purposes. An irrevocable trust is sometimes structured to be a grantor trust for income tax purposes. This allows the grantor the primary residence exclusion above, but also means that the property gets a step up in basis at death. If the grantor dies while owning the property or

with a life estate, the property gets a step up in basis to fair market value at the grantor’s death. No capital gains tax would be due when heirs sell the property. If the Trust is an “non-grantor” trust, then the capital gains issue is more complicated. A non-grantor trust pays income tax at the trust level - which is the highest tax level. A non-grantor trust would pay 20% in federal capital gains tax on the difference between the purchase

price and the sale price. A nongrantor trust does not get the benefit of primary residence exclusion. Sometimes the Trustee wishes to sell property, but the beneficiaries do not want it sold - or vice versa. If the Trustee is at odds with the grantor or beneficiaries, there is usually a provision authorizing the replacement of the Trustee. Removing a trustee may involve bringing a motion for removal in court. Although there is usually no problem with selling a property held in trust, it is still important to speak with a trusts and estates attorney. The language in the trust dictates the sale. An attorney with a background in trusts can ensure there are no negative implications associated with the sale. OF MEN & ANGELS BY DOMINICK FORTE According to the Old Testament, the first angels appeared as men. They came as guides to walk a few miles beside hungry humans, or to assist and support men or women in a time of need. In the book of Genesis, we are told that three angels appeared to Abraham when he had a tent set up by the sacred oaks of Mambre. They looked like ordinary men. They didn’t have wings, glowing garments, or halos surrounding their heads. They sat under the oak trees while Abraham washed their feet as was the custom of hospitality in those days. He served them veal, bread, and cheese, which unlike angels mentioned later on in the Bible, they did consume. Chapter 18 of Genesis relates this story and reveals that one of the men was the Lord Himself with two attending angels. When the meal was over God told Abraham that his senior- citizen wife Sarah would give birth to a son whose descendants would become a great nation. Sarah, because of her advanced years, found this amusing.

This visit is similar to those made by the Greek gods to their favorite mortals, without the lustful activities which were common for Zeus when he visited our planet. It resembles the appearances that come in the worshipping by the Hindus. However, these visits are not

from angels carrying messages from a distant God. They are from the god or goddess themselves taking on human form and appearing lovingly to their follower on a one-to-one basis. Eventually Sarah did give Abraham a son which they

named Isaac. Sometime later Abraham was commanded by God to take the boy to a distant mountain in the land of Moriah and make a human sacrifice of him. Abraham had Isaac carry the wood for the sacrifice as he carried the knife and the coals for the fire. When Isaac

questioned where the animal was which he thought was to be sacrificed, his father answered “God will provide.” They traveled up the mountain, built an altar, and lit the fire. Abraham suddenly seized Isaac and bound his hands and feet. He laid him on the altar and had the knife at his throat when, just in the nick of time, an angel stopped him from going through with the human sacrifice of his son. “Lay not a hand upon the boy,” the angel intervened. “Now I know that you honor and obey God because you have not kept back your only son from Him.” At that moment Abraham caught sight of a ram caught by the horns in the bushes. He took the ram and killed it and offered it to God instead of his son Isaac. There has been speculation that the original command came from the angel pretending to be God and not God Himself. We don’t know. But the story of Abraham’s sacrifice of Isaac is one of many Biblical accounts of the presence of angels in the lives of humankind.

Ahoy, Skipper, Prepare To Be Boarded

Unlike any other law enforcement arm, the U.S. Coast Guard (USCG) may board your boat at their discretion — they need no search warrant, no provocation, and no reason other than ensuring your boat is in full compliance with all applicable federal laws and regulations. Do you know what do you do and say (other than maybe “Yikes!”) if you see a USCG vessel in the vicinity and hear their voice on VHF channel 16 (or across the water) hailing your vessel and ordering you to bring your boat to a full stop? You have been stopped by highly trained federal officers who will soon impress you with their professionalism. Before they even step off their vessel onto yours, the very first question they will ask you is, “Without reaching for them or touching them, do you have any weapons on board?” Subtly but powerfully, the tone is set: “I am polite. I am professional. And I mean business.” Let’s assume (and hope) that the answer to that question is “no” since an affirmative answer sets up a scenario outside the scope of this article. Of note to boaters in the First Coast Guard District, which is us, the Coast Guard has a new program called the Responsible Boater program, which can make your time on the water much more pleasant – and safer. Read on! Once your boat is boarded, the officers will be seeking compliance with regulations, starting with those applicable to all boat sizes: Your actual registration needs to be aboard and current. If you just have a

copy, that’s a problem, but if you have no registration, you have a much bigger problem.

takes other actions. You will be notified by mail and be given an opportunity to appeal.

The Hull Identification Number needs to be the same on your registration and on your boat (embossed into the transom, low on the starboard side). If they don’t match, you’ve got a lot of explaining to do.

However, under the new Responsible Boater program, the boarding officer will tell you to contact us, get the violation fixed and recorded as such on the Vessel Safety Check form (that the Vessel Examiner will give you), mail them both in (Report of Boarding and VSC form) and, very likely, the Hearing Officer will note that and no fine will be levied. Fines can run high so this is free insurance!

The registration numbers on the hull must be at least three inches high, appear as a contrasting color to your hull, and be the most forward of any numbering or lettering on the boat. If you have a Marine Sanitation Device (aka head or toilet), it must conform to regulations. As Long Island is a “No Discharge Zone,” an overboard, through-hull holding tank must be in the locked/closed position and the key must under the control of the captain (no exceptions unless it can be seized closed or the handle can be removed in the closed position). Other applicable laws and regulations are dictated by the size of your vessel: Is there at least one readily available life jacket in good working order for every person aboard? To be readily available, the jackets must be out of the wrapper and not buried under other gear or in a cupboard (think of your children or grandchildren having to put them on in hurry). The number of fire extinguishers depends on boat size, but all must be in working order. The amount of required flares varies by boat size, but all must be unexpired.

Now that sounds like a lot and it is – and it should be. And the list gets longer as the boat size increases. However, if you already have a valid Vessel Safety Check sticker on your windshield, you are eligible for an “Abbreviated Boarding.”

An abbreviated boarding means that the Coast Guard will check for appropriate life-jackets for all aboard, that you have a sound-producing device, flares, registration and fire extinguisher (if required for the vessel of your size) aboard. That’s it.

A “Notice of Violation” may be issued on the boat, resulting in one of two general outcomes. If the boarding officer believes that the nature of the violation is inherently unsafe (some aspect of your boat may lead to serious injury or death to you, your crew and passengers, or other boaters), you will be directed to follow the Coast Guard vessel back to the dock. If the violation is benign enough to allow your voyage to continue, it takes on the aspect of a driving violation. Outside the new Responsible Boater program, the notice is mailed to the USCG hearing office where the boarding report will be reviewed by a case officer who issues fines, further letters of violations, or

Remember – a check is not an enforcement event — if your boat fails, you get a report that details the deficiency and the inspector’s phone number. He or she will tell you, “When you have this addressed, call me. I will come down and re-run the inspection.” This results in a Vessel Safety Check sticker of compliance being affixed to your windshield. Once there, you are considered a Responsible Boater, with all attendant benefits to you, your crew, your vessel and the USCG. Origin of the Poppy Symbol

VETERANS WAY BY REV. FREDERICK MILLER. PH.D. The history of the poppy symbol dates back to World War I, from 1914 to 1918. That war took a greater toll than any previous conflict, some 8.5 million soldiers died of battlefield injuries or diseases. In addition the landscape of Western Europe was ravaged where most of the fiercest fighting took place. The battlefields’ landscape devastated by the war were replaced with the red poppy. In northern France and Flanders (northern Belgium), brutal clashes of the war tore up fields and forests plants and landscape and the soil beneath. In the spring of 1915 bright red flowers began peeking through the battle-scarred land. These flowers were known as the Flanders poppy weed. Shortly after the Second Battle of Ypres Lieutenant Colonel John McCrae, a Canadian surgeon for an Allied artillery unit while tending to the wounded spotted a cluster of poppies. Struck by the sight of bright red flowers

on the broken ground, McCrae wrote the poem, “In Flanders Field,” in which he channeled the voice of the fallen soldiers buried under those hardy poppies. The poem was published in Punch magazine in late 1915 and used in countless memorial ceremonies. “In Flanders Fields”: In Flanders fields the poppies blow. Between the crosses, row on row. That mark our place; and in the sky the larks still bravely singing, fly scarce heard amid the guns below We are the Dead. Short days ago we lived, felt dawn, saw sunset glow, loved and were loved, now we lie in Flanders field. Take up our quarrel with the foe: to you from failing hands we throw the torch; be yours to hold high. If ye break faith with us who die we shall not sleep, through poppies grow in Flanders fields.” Here in America, Moina Michael read “In Flanders Field” in Ladies Home journal and vowed to always wear a

red poppy. She found an initial batch of fabric blooms and came up with the idea of making and selling red silk poppies to raise money to support the returning veterans. Michael’s campaign to create a national symbol for remembrance- a poppy in the colors of the allied nations, flags entwined around a victory torch did not get very far. However, in 1920 she convinced the American Legion to adopt the poppy minus the torch as its symbol, and join her by celebrating National Poppy Day in the United States the following May. Today here in the United States, the tradition has developed where instead of wearing the poppy on Veterans Day- which honors all living veterans- we wear the symbolic red flower on Memorial Day, the last Monday in May, to commemorate the sacrifice of so many men and women who have given their lives fighting for our country.

A VFW worker (veterans of foreign wars) holds red -buddy poppies in his hands. As VFW’s official memorial flower, the Poppy represents the blood shed by American service members. It reiterates that VFW will not forget their sacrifices.

John Leslie Sumwalt

Longtime resident of Mastic Beach, John L. Sumwalt died May 17, 2022, at East End Hospice, Kanas Center for Hospice Care, in Westhampton Beach. He was 81.

John was born March 31, 1941 at St. Catherine’s Hospital in Brooklyn, NY to Leslie Forbes Sumwalt and Anna (McMahon) Sumwalt. John graduated from Center Moriches High School in 1959. He served 21 years in the United States Navy from 29 October 1959 – 31 March 1981, when he retired as a Chief Petty Officer (E-7). Following military service, he continued to serve as a Naval Junior Officer Training Corps (NJROTC) Instructor for the Mattituck and Southold School districts. Chief Sumwalt (affectionately referred to as “Grandpa” by his cadets when not in uniform) impacted many lives over the course of his 22-year teaching career. He was also a Life-Member with the Mastic Beach Volunteer Ambulance Company, serving for 25 years. John was a loving brother,

husband, father, grandfather, friend, mentor, and teacher. Predeceased by his sisters, Lucille, Susan and Margaret. He is survived by his wife Mary (Coady) Sumwalt, sons and daughters-in-law, John and Heather, Keith and Josephine, Jeff and Janel, David and Sarah, and his sister Mary Reichert. John was also known as “Pop-Pop” to his nine grandchildren, Coady, Patrick, Ava Lily, Nicholas, Griffin, Heath, Miller, Zeke, and Will. The family will receive
