Promises have been made for years and the federal money is in place. We won’t accept any more excuses.”
Save Our Sewers was the message sent by area residents and officials Saturday at a rally to make sure the Forge River Watershed Sewer Project stays on track. The well-attended event was in response to delays in the project, lagging since 2014, and talks of scaling it back due to bids coming in higher than expected. “Our area has been promised sewers for generations and we are not going to accept any more delays or broken promises,” Assemblyman Joe DeStefano told the crowd assembled at the corner of William Floyd Parkway and Montauk Highway. “In the wake of Hurricane Sandy, our government made a commitment to bring us sewers and we will not rest until that commitment is honored.” According to Brookhaven Supervisor Ed Romaine, Suffolk County received $188 million to extend sewers along Montauk Highway east to Mastic Road in an area around Forge River. “The county has moved very slowly in getting this project underway,” Romaine said. “The bids were opened earlier this year, but have yet to be awarded.” The project has been delayed so
In a press conference on Earth Day two days prior to the rally, County Executive Steve Bellone acknowledged a funding gap between the bids and the amount of money available for Forge River and other county sewer projects. He’s counting on additional monies from the Biden administration’s infrastructure bill to make up the difference. Under Bellone’s plan, groundbreaking for the local sewers won’t take place until next year. Jim Mazzarella, a candidate for the Suffolk Legislature in a special election May 25, said a top priority for the entire community will be to make sure the sewer project is properly funded and stays on track. “I won’t rest until a shovel is stuck in the ground,” he said. Kate Browning’s attempt to run for her old seat on the county Legislature was denied by state Supreme Court Justice James Hudson stating that her election would be in violation of the Suffolk’s Term Limit law. In his decision, Justice Hudson rejected Kate Browning’s arguments attempting to utilize laws of California in her pleadings and wrote, “The only way in which to balance these terms is to view “Consecutive” as a word of limitation and not as an invitation to run for Office in the future...It is the Legislature’s prerogative to craft such language, not the Court.” “This is a win for all 1.5 million residents of Suffolk County, regardless of political affiliation or philosophy, and a defeat to career politicians who look for loopholes instead of doing service to the people,” said Suffolk Republican Chairman Jesse Garcia who initiated the litigation to force Browning to adhere to the Term Limit Law. “Today’s Supreme Court

Justice was done.” Browning, who attempted to run against community activist Jim Mazzarella in the May 25 election, is expected to appeal Judge Hudson’s decision.

State Democrats Move Bill on Universal Health Care
By James Emery A bill to eliminate private insurance plans and bring universal health care to New York has been advanced by the
Democrats in the assembly. The plan, modeled after Obamacare, would put Albany in charge of all health care for New Yorkers. Emboldened by their record
$212 billion budget, which includes $4 billion in new taxes and $15,600 payments to illegal aliens, the Democrats in control of state government are moving to the next phase of their Progressive agenda as they try to take over the multi-billion health care industry. “Obamacare was a disaster and caused health insurance rates to skyrocket,” said Assemblywoman Jodi Giglio in opposing the bill. “We could not keep our doctors as they promised and the entire system was a mess. This is what the Democrats want to bring to our state.” According to Giglio, private health plans will go out the window and an industry that employs thousands will be taken over by government bureaucrats if the plan goes through. “We

We pay the highest taxes and fees in the entire country and the Democrats just raised taxes by $4 billion more,” said one local business owner who did not want his name used so he wouldn’t become a target. “People and businesses are fleeing in droves and the Democrat plan is to replace them with illegal immigrants drawn here with free health care and $15,600 checks which, if they cash them, will automatically register them to vote. Who do you think they’ll be voting for?”

Real Estate Market Remains Hot in Suffolk County While the COVID-19 pandemic has greatly impacted the economy nationally and locally, the Suffolk County real estate market has strengthened over the last year as prices have continued to rise. “2020 was one of the busiest years in the County Clerk’s Office. While onsite access was reduced to the public and employees were mandated by executive order to work remotely, the County Clerk’s Office still recorded nearly 165,000 land documents and collected over $500 million dollars in revenue,” commented County Clerk Judy Pascale. And while revenues increased dramatically in 2020 due to increased home values, low interest rates and high demand for housing, 2021 has continued that elevated pace. In the first quarter of 2021, mortgage recordings increased over last year by 47% and deed recordings increased by 13%. The increased sales activity and home values have resulted in a revenue increase of over 55% from the same period last year. New York State Mortgage Tax, assessed on every mortgage recorded in New York, increased by 44% over the first quarter of 2020. The Peconic Bay Community Preservation Fund Tax, a

2% tax on sales of property in Suffolk County’s five east end towns, increased by 77% from 2020 to 2021. “All indications are this hot real estate market will continue through this year. Slum Home Turned Illegal Homeless Shelter Angering Neighbors and Elected Officials

A homeless shelter in Gordon Heights has drawn the ire of neighbors and Brookhaven Town officials saying the surplus county property should not have been sold to a for-profit landlord and is operating without permits or a certificate of occupancy. In a letter to County Executive Steve Bellone and Legislator Robert Calarco, Town Supervisor Ed Romaine and the councilman for the area, Mike Loguercio, said the landlord refuses to grant town enforcement personnel access to inspect the property. The home, which was evaluated by Brookhaven twice for demolition as an unsafe structure, is owned by Domi Kismet, a landlord with numerous properties in the town that have been subject to complaints by nearby residents. “We are writing to you with great concern regarding the property located at 71 Beach Lane,” the town officials wrote. “As elected representatives of this area, our concerns lie with the residents of this community, who have been continuously impacted by situations such as these, time and time again. What is more frustrating is that this location, with the lack of proper permits
and approvals, has people there renting out space and the Suffolk County Department of Social Services is paying for them to do so.” According to Supervisor Romaine, the county has owned the property since 2014 and never entered into an agreement with the town “so that this dilapidated, unsightly eyesore” could be demolished. “It is our understanding that when the county sold residential property at its auction, it was to go to homeowners and not landlords.” “Clearly, this is a bad actor who is operating without the proper permits,” Legislator Calarco said. “I am frustrated with the way this is going and have asked social services to rescind the rental vouchers.” Calarco said he’s been in contact with town officials to make sure the facility, which was previously a funeral home, does not operate as a homeless residence. “Our records had this as a commercial property which could be sold to a landlord,” he said, adding, “To say I’m less than pleased with what’s going on here is an understatement.” The property is currently zoned for residential use, according to the town. “The county dumping homeless

The highlighted activities included Trick or Treat Street, an annual safe Halloween festival for the district and community’s students. Longwood High School Coach Joe Reilly Inducted into Suffolk Sports Hall of Fame Longwood High School track and field coach, Joe Reilly, is one of only nine individuals inducted to the Class of 2021 Suffolk County Sports Hall Fame. Mr. Reilly was chosen based on his substantial contributions on behalf of Suffolk County athletics, including the title of most wins in New York State history. Since 1983, he has earned League Coach 46 times and County Coach of the Year 33 times. He has also been designated Suffolk County Coach of the Year 17 times and Newsday Long Island Coach of the Year twice.

A plaque honoring 18 of Bellport High School’s finest cafeteria workers was unveiled on April 15 during a Women’s History Month commemorative ceremony in Ebersole Auditorium and attended by project director and history teacher Andrew Budris and members of the South Country Central School District administration. Bellport High School Principal Timothy Hogan thanked the workers and volunteers who dedicated their efforts in food preparation and distribution at Frank P. Long Intermediate School, Verne W. Critz Elementary School and Bellport High School at the height of the COVID-19 pandemic.

SUFFOLK CLOSEUP BY KARL GROSSMAN On his last day as president and CEO of the Long Island Association (LIA), Kevin Law sent a letter to President Joe Biden and Senate Majority Leader Charles Schumer requesting federal help for the undergrounding of electric lines on Long Island. And Mr. Law knows the situation well. Before becoming in 2010 the head of the LIA, the region’s largest business organization, Mr. Law was president and CEO of the Long Island Power Authority (LIPA) which owns those lines. Long Island is heavily treed and has near dependence on transmitting electricity through lines on poles. Getting hit with a big storm means outages. More extreme storms can be expected as a result of climate change, and thus even more widescale outages. Last year I told in this space about an article on T&D World, a website for utilities, headlined: “It’s Time for Utilities to Reconsider Undergrounding Power Lines.” It stated that “climate change is unquestionably generating intense, costly storms…a hard fact that utilities must confront.” It said “most utilities opt not to bury power lines due to cost. But leaving
so much of our power infrastructure exposed to environmental assault may not be worth the short-term cost savings.” Indeed, undergrounding electric lines is more expensive than stringing lines on poles. But needing to be considered are the huge costs of post-hurricane, post-storm electric restorations. We must recognize too, the terrible hardships which extended outages cause Long Islanders.

It is great that Mr. Law—as he closed out his tenure at the LIA—addressed this important issue. It’s high time to get electric lines on Long Island lowered into the ground. I wrote in the column last year about my 1986 book, Power Crazy, and how on its cover was a photo of a Long Island Lighting Company (LILCO) pole with it and its electric lines tilted
at a 45-degree angle after Hurricane Gloria struck the year before. The book started, I noted, with how Hurricane Gloria caused a loss of electricity to 700,000 customers of LILCO (whose poles and lines were acquired by LIPA when it was established.) But Power Crazy pointed out, service to 96 percent of telephone customers on Long Island had not been interrupted. Why? “New York Telephone began placing cable underground wherever feasible in the early 1970s in connection with a nationwide trend to avoid visual pollution and increased corporate concerns for cost-reduction,” explained company spokesperson Bruce W. Reisman. “Cost studies clearly indicated to us that it would simply be less costly for us over the long term to place much of our telephone cables underground. It is generally less expensive to maintain a telephone plant when it is underground. This is because underground facilities are less likely to be damaged by falling trees or branches, high winds, ice storms, etc…” What’s good for telephone lines is good for electric lines—going underground.

FROM A TO Z BY ROBERT CHARTUK In 1984, I covered a state hearing on a plan to raise the electric rates of what was then the Long Island Lighting Company. The room was stuffy and the experts were droning on about usage and kilowatt hours and more than one attendee was getting sleepy. I was sitting in the front row with my camera when one of the panelists, Assemblyman I. William Bianchi, started dozing off while his counterparts, Assemblymen George J. Hochbrueckner and Joseph Sawicki, Jr. were looking up in rapt attention. I clicked it. In politics, it’s often difficult defeating a popular politician who’s been around for a while and many times, the opposing party doesn’t put up much of a fight. It’s sad that everyone’s in on the arrangement except the candidate who gives it a shot despite the impossible odds. Such was the case with a guy named Sal Prisco who the Republicans ran against Assemblyman Bianchi pretty much to avoid the indignity of not putting up a candidate at all.
That is, until they got a hold of my picture. Soon after, an ad came out featuring Bedtime for Billy. I know
the name of the person who wrote it, but he will remain nameless at present. In fact, he had elbowed me in the side and encouraged me to take the picture of the sleeping assemblyman. “Above, 3rd District Assemblyman Bill Bianchi catches a
few winks during a recent Assembly committee hearing in Riverhead,” the ad stated. “Actually, Brookhaven taxpayers might be a lot better off if he’d spent more time sleeping over
the past 12 years. Unfortunately, Bianchi stayed awake long enough to vote to raise our taxes by over $1 billion during his career. Isn’t about time that career came to an end?” Sal Prisco was a beauty salon owner who got a job with the town. It was rumored that the supervisor
had her hair done at the shop and Sal was banded as her hairdresser— not someone to be taken seriously. He had big black glasses and a wooly bear mustache and I knew him to be
a likeable fellow, but not much else electorally speaking. No one gave him much of a chance. Then the ad came out. In what should have been a rout, the assemblyman held on to his seat by a razor-thin margin. Had Sal been taken seriously and the party put a little more effort behind him, he probably would have won.
As the results rolled in on election night, his race generated the most excitement as it looked, for a time, that the entrenched incumbent would go down. “I could have been a contender,” he woefully told me after coming up short. With Bianchi deemed vulnerable, the Republicans went all out against him two years later, putting up a charismatic highway department worker by the name of John Powell. Few imagined at the time how much of an upand-comer Powell would be as he defeated Bianchi and then went on to become the GOP leader of Brookhaven Town and then Suffolk County. He was an early backer of another unknown, George Pataki, and became a state-wide power player when his candidate upset Gov. Mario Cuomo for the state’s top job. I imagine the local Republicans are hoping lightning will strike again as they throw their weight behind Congressman Lee Zeldin for governor, a seat currently held by Cuomo’s son, Andrew.

It Pays to be Married: An Explanation of the Unlimited Marital Deduction and Portability
My accountant told me that in order to avoid the 40% estate tax, I should get married. Is that true?
It pays to tie the knot, at least according to the IRS. The unlimited marital deduction is a provision in the U.S. Estate and Gift Tax Law that allows individuals to transfer an unrestricted amount of assets to their spouse at any time, free from tax. The unlimited marital deduction is considered an estate preservation tool because assets can be distributed to surviving spouses without incurring any estate or gift tax liability. Keep in mind that the $23.4 million exemption per couple is not automatic. The federal estate and gift tax exemption is currently $11.7
million per individual, meaning a married couple can exempt $23.4 million from estate and gift tax. The unlimited marital deduction allows you to leave all, or part, of your assets to your surviving spouse free of federal estate tax. However, if you want to use your pre-deceased spouse’s unused exemption—a move called electing “portability”, you must file a federal estate tax return at his or her death, even if the value of the estate is below the filing threshold and no tax is due. If you or your accountant do not know what portability is and do not elect it, your surviving spouse could be hit with a large federal estate tax on his or her death. In order to elect portability of the

OF MEN & ANGELS BY DOMINICK FORTE Although not an Archangel, Metatron is an Angel and a very important figure in God’s scheme of things. Angelic folklore tells us he is the Scribe of God. This makes him a key player in the angelic hierarchy. In fact, he is one of the elite group permitted a full view of God. Metatron sits on a throne at the foot of God’s throne. His throne is far less ornate than the one occupied by God. God allows him such proximity because, as his Scribe, he records the good deeds of the faithful and the bad deeds of all others. God shares His innermost thoughts with him and tells him everything he wants revealed to angels and men. We could consider him God’s Administrative Assistant. But Metatron did not start out as an angel.
There was once a righteous man named Enoch. He was a mystic, a seer, and a teacher. He lived during a dark period in human history. Transgressions against God and man ran rampant with serious sin out of control. Enoch spoke out against the escalating decadence of his times and led by his pious example. A Community Mourns
JOHN REILLY, 71, passed away on April 15, 2021 after a long battle with his cancer. Even though cancer took him away from this world, his love for his family will never be gone. John is survived by his beautiful wife, Patricia, to whom he was married to for the past forty-two years. He was the loving father of David and John Jr. and stepfather to his daughter Stacey. He was a grandfather of eight and great grandfather of two. He was the wonderful brother of Cathy, Tricia, and Tom. A memorial service was held on Friday, April 23, 2021 at Roma Funeral Home in Shirley.

FRED WEISMANN, It is with deep sadness that we announce the passing of longtime local business leader Fred J. Wesemann. Wesemann who recently retired to Florida, died of pneumonia. Fred owned numerous stores/companies and business properties. Fred was a salt of the earth guy. He was old school. He worked with his hands. He earned everything he had through hard work and sweat. He enjoyed giving back to his community and helping neighbor kids. He enjoyed a good debate or community exchange. Fred’s word was his bond. Fred was active in his community. He was a volunteer member of the Mastic Fire Department, past President of the Mastic Sports Club, past President of the Montauk Highway Merchants Association, member of the Chamber of Commerce of Mastics and Shirley just to name a few. Over the years many of our friends and I could have a knock down argument with Fred and then go out and have wings and drinks. At the end of the day Fred would always win those arguments. He would stick you with the bill for the wings and drinks. He cared greatly about his kids and grandkids. But most important to Fred were his puppies. Despite his rough exterior Fred was a great friend, family man and community leader. He will be sorely missed and I am sure he’s trying to get God to pay for the drinks and wings in heaven.

This State of Emergency has been declared because there is a reasonable apprehension of transmission of COVID-19 cases in the Town of Brookhaven. I. During this period, the following order shall be in effect: A. The Town Board hereby creates, authorizes and permits COVID-19 Social D i s t a n c i n g Accommodations. There shall be four types of said Accommodations permitted: 1. Areas: Changes to outdoor spaces on existing improved sites, with a Certificate of Occupancy for the principal use, to be used where said principal use has been authorized by the Governor of the State of New York to re-open, but the occupant does not have the indoor area to accommodate COVID-19 social distancing requirements or occupancy restrictions imposed by the Governor of the State of New York. The placement of outdoor seating tables and/or chairs, display racks, public assembly areas, equipment or other similar items shall be permitted in the COVID-19 Social D i s t a n c i n g Accommodation Areas. 2. Signs - Changes to parking lot signage for designation and installation of curbside pickup signs or pick-up parking stalls signs. 3. Pick-Up Windows: Changes to existing facades for the installation of pickup windows or movable exterior walls or similar. 4. Alternate Indoor Dining Spaces: Changes in use to vacant indoor spaces to add dining areas for take-out restaurants, restaurants or major restaurants in existing improved sites, whether the vacant space is adjacent or not, where the existing take-out restaurant, restaurant or
restaurant has a valid Certificate of Occupancy , and where said take-out restaurant, restaurant or major restaurant use has been authorized by the Governor of the State of New York to re-open, but the occupant does not have the indoor area in its existing indoor space to accommodate COVID-19 social distancing requirements or occupancy restrictions imposed by the Governor of the State of New York. The placement of dining tables and/or chairs, equipment or other similar items shall be permitted in the COVID-19 Social D i s t a n c i n g Accommodation Areas. B. Only the following uses, hereinafter “permitted use(s,)” shall be permitted to utilize COVID-19 Social D i s t a n c i n g Accommodations: 1. Assembly and social recreation halls; delicatessens; health clubs; large commercial retailer, except those deemed essential business; lodges; major restaurants; nondegree-granting instruction/program except those associated with manufacturing or driver training; offices; personal service shops; places of worship; restaurants; retail sales establishments; shops and stores for the sale at retail of consumer merchandise and services; take-out restaurants; community or regional movie theatres; and tasting rooms as an accessory to a permitted principal farm brewery, cidery, distillery, or winery use. Motor vehicle wash facilities shall be permitted to maintain an Outdoor Accommodation Area limited to a customer waiting area only. C. COVID-19 Social D i s t a n c i n g Accommodations may be granted via administrative review and shall be subject to any conditions the Commissioner of Planning, Environment and Land
Management, or his/her designee, deems appropriate. Submission of applications shall be on a form provided by the Commissioner of Planning, Environment and Land Management. Said application form shall replace current application forms used for land use applications, building permits and tent and membrane structures, as may be applicable. D. Nothing herein shall be deemed to supersede, alter or amend New York State Uniform Fire Prevention and Building Code requirements for inspections, permits and certificates. E. No fee shall be charged for said applications or any other permits required herein. F. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, is hereby authorized to review and approve COVID-19 Social D i s t a n c i n g Accommodation Areas subject to the following: 1. The application must be for a legally existing permitted use with a valid Certificate of Occupancy. 2. Parking spaces may be used without penalty for loss of parking stalls, however, a physical barrier or separation to protect customers from vehicle traffic, such as bollards, substantial planter boxes or similar barrier, must be installed. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, may request a parking analysis to ensure that adequate parking for facility is always provided. 3. COVID-19 Social D i s t a n c i n g Accommodations must meet Fire Code standards, including points of egress, access to fire extinguishers, and tent and awning ratings, if applicable. Nothing shall block entrances, exits, fire lanes, hydrants, sprinkler
connection points, drive aisles, back-up areas, pedestrian or handicapped access. 4. COVID-19 Social D i s t a n c i n g Accommodations, including generators used for said areas, shall not be located within 250 feet of a structure used for residential purposes, shall only be utilized between the hours of 8:00 AM and 9:00 PM and shall expire on May 31, 2021. Any owner of any residential structure within 250 feet of a COVID-19 Social D i s t a n c i n g Accommodation must consent to the location of for seating to be located closer than 250 feet from their residence. This consent may be revoked at any time. 5. All items located within the COVID-19 Social D i s t a n c i n g Accommodation Areas shall be removed no later than June 14, 2021. 6. COVID-19 Social D i s t a n c i n g Accommodation Areas must be maintained, free of trash and other debris, and trash receptacles provided. 7. Take-out restaurants, restaurants and major restaurants utilizing COVID-19 Social D i s t a n c i n g Accommodation Areas must comply with all New York State Liquor Authority licenses, permits, approvals, guidance, and/or applicable laws. Nothing herein shall permit outdoor bars, taverns or nightclubs. Nothing herein shall be construed as to amend, repeal, supersede, override or alter the Alcoholic Beverage Control Law. G. If a tent or canopy is to be used, New York State and Town Code requirements for tent and membrane structures must be complied with. H. Handicapped/ADA parking stalls may not be used for Outdoor Social D i s t a n c i n g Accommodation Areas. The blocking of
handicapped/ADA routes (path from ADA parking stalls to sidewalk curb ramps to store entrances) is prohibited. Do not reduce sidewalk widths to less than 36”. I. Removal of existing natural areas or required buffers is prohibited. J. Outside loudspeakers or exterior live entertainment COVID-19 Social D i s t a n c i n g Accommodation Areas shall be prohibited within 1,000 feet of any structure used for residential purposes. Town Code Chapter 50 must always be complied with. K. Installation of barriers, bollards, planters or other portable structures to prevent vehicles from entering the COVID-19 Outdoor Social Distancing Accommodation Areas if said area is located within a parking lot or grass area. L. The submission of a plan meeting the following requirements: 1. Depict the location of proposed tents, other membrane structures, and canopies, inclusive of support ropes and guy wires, outdoor seating, display areas, public assembly areas, equipment or other items. Plans can be hand drawn on existing survey, site plan or aerial map from Google Maps/Earth, Bing, etc. 2. Depict the location within the COVID-19 Social Distancing Accommodation Areas, and the dimensions of, outdoor or indoor seating tables and/or chairs, display racks and/or tables, equipment or other items, service/customer aisles, and pathways from business to outdoor or indoor seating/area. Those occupying separate dining tables within COVID-19 Social Distancing Accommodation Areas must be spaced at least six (6) feet apart. All spacing within the outdoor or indoor areas must meet any other applicable current social distancing requirements. 3. Indicate

The application must be for a legally existing permitted take-out restaurant, restaurant or major restaurant with a valid Certificate of Occupancy and a valid Annual Place of Assembly permit, where applicable. 3. For use of indoor dining spaces immediately adjacent to existing takeout restaurant, restaurant or major restaurants: i. Submission of plans depicting existing and proposed space, including location of tables and chairs and exits. Plans shall indicate any alterations to either space including openings in walls, etc. ii.
Submission of one set of professional, detailed, dimensioned plans in a digital format, if alterations are proposed. iii. Any alterations will require the completion of the Fire Prevention Application (FP10) and Building Permit application. iv. Submission of Workers Compensation and Disability Insurance for the contractor, if alterations are proposed. The only Certificates of Insurance forms accepted are: Workers Compensation - C-105.2, Sl-12, U-26.3, GSl-12, WC/DB-100, WC/DB101. v. If alterations are proposed, submission of Disability forms- DB120.1, DB-155. Town of Brookhaven must be named as Certificate Holder. Accord Form 101 will not be accepted. vi. Prior to the issuance of any approval an inspection by the Chief Fire Marshal and/or Chief Building Inspector, or their designees, will be scheduled of the proposed space(s) to ensure appropriate fire and life safety features are present, and compliance with New York State Uniform Fire Prevention and Building Code and Brookhaven Town Code. vii. Submission of any other documentation necessary, as determined by the Chief Building Inspector and/or Chief Fire Marshal. 4. For use of indoor dining spaces NOT immediately adjacent to existing take-out restaurants, restaurants or major restaurants: i. Provide a drawing of the proposed space, including location of tables, chairs and exits. ii. Complete a Fire Prevention Application FP10 for a temporary place of assembly permit. iii. Submission of plans depicting existing and proposed space, including location of tables and chairs and exits. Plans shall indicate any alterations to either space. iv. The Commissioner of Planning, Environment and Land Management, or his/her designee, shall take existing improvements into consideration and determine whether or not additional on-site improvements are necessary and/or appropriate, including but not limited to drainage, parking, curbs and walks, landscaping and fencing, and may require such improvements as part of
his/her approval of said. T. The Commissioner Planning, Environment and Land Management, or his/her designee may, at his/her discretion, refer any COVID-19 Social D i s t a n c i n g Accommodations to the Planning Board as s/he deems appropriate. U. The applicant shall provide any additional information and documentation which the Commissioner of Planning, Environment and Land Management, or his/her designee, deems necessary and appropriate for his/her review of the application. V. All COVID-19 Social D i s t a n c i n g Accommodations approvals shall expire on May 31, 2021 and all items located in said area shall be removed no later than June 14, 2021. W. Approval for a COVID-19 Social D i s t a n c i n g Accommodations shall not negate or permit any violation which may exist on the subject premises at the time of approval of such accommodation. X. I hereby temporarily suspend or modify, for the period from the date of this Executive Order through May 31, 2021, the following: 1. Town Code Section 3-1(1) is hereby suspended to the extent that a take-out restaurant, restaurant or major restaurant with an authorized COVID-19 Social Distancing Accommodation area shall be permitted to serve alcohol in a place open to the general public limited to the COVID-19 Social D i s t a n c i n g Accommodation area only. 2. Town Code Section 163(L) is suspended to the extent that permits issued for said accommodation shall be valid until May 31, 2021. 3. Town Code Section 16-4(C) is suspended to the extent that debris affidavits shall not be required to obtain a Certificate of Occupancy, Certificate of Compliance, or their equivalent. 4.
Town Code Sections 85113 and 114 are hereby suspended to the extent that applications for a COVID-19 Social D i s t a n c i n g Accommodation shall not require an amended site plan application or new site plan application or change of use application or special permit application and shall not be subject to a public hearing. COVID-19 Social D i s t a n c i n g Accommodation applications shall be on a form approved by the Commissioner of Planning, Environment and Land Management, or his/her designee. Said application reviewed and approved via an administrative approval of the Commissioner of Planning, Environment and Land Management, or his/her designee. Building permits and Certificates of Compliance shall be required. 5. Town Code Section 85-107 is hereby suspended and shall not apply to a COVID-19 Social Distancing Accommodation Area. 6. Town Code Section 85190(A) is hereby suspended to the extent that outdoor places of worship shall be permitted. 7. Town Code Sections 85-190(A) and (B) are hereby suspended to authorize a COVID-19 Social Distancing Accommodation area to be used in conjunction with legal pre-existing nonconforming permitted uses. 8. Town Code Sections 85-190D(1), (2), (3) and (6) are suspended to the extent that a Board of Appeals special permit shall not be required and is subject to administrative review by the Commissioner of Planning, Environment, and Land Management, or his/her designee, pursuant to this Order as a COVID-19 Social Distancing Accommodation Area. 9. Town Code Section 427(H) and (K) are hereby suspended to the extent that Alternate Indoor

TOWN OF BROOKHAVEN STATE OF NEW YORK COUNTY OF SUFFOLK DECLARATION OF STATE OF EMERGENCY I, Edward P. Romaine, Supervisor of the Town of Brookhaven, pursuant to Article 2-B Section 24 of the New York State Executive law, hereby certify as follows: WHEREAS, on January 30, 2020, the World Health Organization designated the novel coronavirus, COVID-19, outbreak as a Public Health Emergency of International Concern; WHEREAS, on January 31, 2020, United States Health and Human Services Secretary Alex M. Azar II declared a public health emergency for the entire United States to aid the nation’s healthcare community in responding to COVID-19; WHEREAS, cases of transmission of COVID-19 have been documented in
the Town of Brookhaven and more are expected to continue; and WHEREAS, the Town of Brookhaven is addressing the threat that COVID-19 poses to the health and welfare of its residents and visitors. WHEREAS, the State of New York by Executive Order No. 202 dated March 7, 2020, has addressed the transmission of the cases of COVID-19. WHEREAS, the Town of Brookhaven is desirous of assisting existing businesses in the Town of Brookhaven which have been authorized to re-open and seek to utilize existing outdoor areas for drive-in movie theaters, provided social distancing and cleansing/ disinfecting measures are in place. Pursuant to the powers vested in me by Executive Law §24, I hereby declare a State of Emergency. This State of Emergency has been declared because there is a reasonable apprehension of transmission of COVID-19 cases in the Town of Brookhaven. From the date of this Executive Order until May 31, 2021, the Town Board of the Town
of Brookhaven hereby authorizes and permits the use of outdoor areas on private parcels of existing businesses in the Town of Brookhaven as drive in movie theaters subject to the following: 1. The Host/Applicant submit an Amusement/Event Application for DriveIn Movie Theater to the Brookhaven Town Clerk at least fifteen (15) days prior to the commencement of utilizing a parcel as a drive-in movie theater. 2. All areas designated for drive-in movie theater use must be situated at least one thousand (1000) feet from any residential property lines in the Town of Brookhaven. 3. The permissible event hours shall be daily, including weekends, commencing from sunset with the last movie commencing at 11:30 p.m. 4. At all times, all employees and guests shall strictly adhere to social distancing guidelines and occupancy restrictions imposed by the Governor of the State of New York, including but not limited to maintaining a distance of six (6) feet from other individuals and/or wearing
a face mask or cloth face covering that covers your nose and mouth when six (6) feet of social distancing cannot be maintained. 5. The Host/ Applicant is responsible for implementing all necessary cleansing/ disinfecting procedures for any on-site restroom facilities. 6. The Host/ Applicant is responsible for the designation of appropriate parking stalls which are at least six (6) feet apart in order to adhere to social distance guidelines imposed by the Governor of the State of New York. 7. Food trucks and mobile concessions in specifically designated and approved areas are permitted provided that all queue lines have floor markings at a distance of six (6) feet apart in order to ensure that individuals maintain a distance of six (6) foot distance. 8. The sale of alcohol is strictly prohibited. 9. Attendees shall remain within their vehicles at all times except to utilize the restrooms or make purchases from food trucks/mobile concessions. No outdoor seating is permitted for
viewing purposes. 10. Nothing herein shall be deemed to supersede, alter or amend the requirements for all preliminary approvals by Town of Brookhaven Division of Fire Prevention, Town of Brookhaven Division of Public Safety and Suffolk County Police Department. 11. No fee shall be charged for drive-in movie theater applications. 12. The Host/ Applicant is permitted one (1) advertisement sign per street frontage not to exceed thirty-two (32) square feet in area and shall not be placed in the Town’s right of way or in a location that will obstruct or impair vision or traffic in any manner or create a hazard or disturbance to the health and welfare of the public. 13. The Host/ Applicant is responsible for maintaining the events/parcels free of trash and other debris and provide trash receptacles in accordance with Chapter 49, Property Maintenance, code of the Town of Brookhaven. 14. All paved areas, including but not limited to parking spaces, must conform with Chapter 49, Property
Maintenance, code of the Town of Brookhaven, in order to afford safe passage for pedestrian and motor vehicle traffic in order to prevent hazards to public health, safety and welfare. 15. Outside loudspeakers, if utilized, must comply with all provisions set forth in Brookhaven Town Code Chapter 50. 16. The Host/Applicant must submit a public liability insurance certificate of limits not less than one million ($1,000,000) dollars naming the Town of Brookhaven as an additional insured, which shall not be cancelled without fifteen (15) days notice to the Town Clerk. 17. Any approval to utilize a site as a drive-in movie theater shall not negate or permit any violation which may exist on the subject premises at the time of approval of such accommodation. 18. The following sections of the Brookhaven Town Code are hereby temporarily suspended or modified, from the date of this Executive order through May 31, 2021: a. Town Code Section 57A-9(C) is suspended to the extent
