Dr. Mandal Brings Back House Calls in The Age of COVID

House calls by doctors had been a thing of the past, but with an increased community need for personalized care in the wake of the COVID pandemic, Dr. Kumar S. Mandal has renewed this traditional service for the Bay Area. “Our patients started having difficulties getting to the office, so we decided to come to them,” said Dr. Mandal’s office manager Anna Filoso, who is coordinating the new service, Suffolk Home Care. “Many of our seniors were afraid to come in and transportation became an issue. Having the doctor make house calls is the perfect solution.” To keep up with the growing demand, Dr. Mandal brought on

a new Physician Assistant, Karen Nuzio, who has been in the health care field since 2005. She has an extensive background in family medicine and geriatrics and is experienced in pediatrics which the office covers as well. “I give every patient personalized healthcare advice and support, in a relaxed and unrushed manner,” the new PA said. “I utilize the latest advancements in medicine and knowledge of the latest discoveries in medical research to help shape the care of my patients.” The office, at the Coraci Boulevard Suites on William Floyd Parkway, is open for both the rapid COVID tests and the more detailed Polymerase Chain Reaction, or PCR test.

“We will also be providing the COVID vaccines when they become available,” Filoso said. “Patients are advised to contact us and get on the schedule. When the vaccines come in, we will administer them as quickly as possible.” The office can be reached at 631-281-2600. Trained as a surgeon with a family practice in the Bay Area for more than 30 years, Dr. Mandal has been a mainstay in the community, and creation of Suffolk Home Care to make house calls shows his ongoing commitment. Additionally, 157,046 doses of COVID-19 vaccine have been administered in the last 24 hours. As of 1:00 PM today, New York’s health care distribution sites have administered 90 percent of first doses so far delivered. The week 11 allocation from the federal government is in the process of being delivered to providers for administration. “New York’s vast distribution network has now immunized over 1.5 million New Yorkers which is really great news. We’re working hard to keep up that momentum and get shots in arms of the entire eligible population, with special attention to Black, Hispanic and poor communities that have been among the hardest hit by COVID,” Governor Cuomo said. “We’ve already seen a 70 percent increase in vaccine supply from the federal government. We hope

that number will only continue to increase but it will take time and we must not get complacent or cocky about COVID. I urge all New Yorkers to remain vigilant and keep taking steps we know work to protect themselves and others: wear a mask, social distance, avoid large gatherings.” Approximately 10 million New Yorkers are currently eligible to receive the vaccine. New York’s vast distribution network and large population of eligible individuals still far exceed the supply coming from the federal government. Due to limited supply, New Yorkers are encouraged to remain patient and are advised not to show up at vaccination sites without an appointment. The ‘Am I Eligible’ screening tool has been updated for individuals with comorbidities and underlying conditions with new appointments released on a rolling basis over the next weeks. New Yorkers can use the following to show they are eligible:

New Yorkers may also call their local health department, pharmacy, doctor, or hospital for additional information and to

Thiele Co-Sponsors Legislation to Establish a Vaccine Prioritization Appointment Process for People 75+ New York State Assemblyman Fred W. Thiele, Jr. announced that in an effort to affirmatively fix some of the issues related to the vaccine rollout, he has co-sponsored legislation introduced by Assembly Member Kenneth P. Zebrowski, to establish a vaccine prioritization appointment process for individuals over the age of seventy-five (75). This cohort of individuals, who are some of our most vulnerable New Yorkers, were given only one day of prioritization before the State opened up the eligibility list to millions of additional New Yorkers. One of the biggest issues with the vaccine rollout has been the hodgepodge of providers and vaccine allocations. Individuals across the State are confused about where vaccines are being distributed in their community, how many are being distributed, who to contact, when to contact them and how to contact them. This bill seeks to remedy this by creating a more centralized process, starting with our most vulnerable populations. Individuals over the age of 75 disproportionately lack access to, and expertise with computers and the internet, putting them at a disadvantage in scheduling COVID-19 vaccine appointments. If passed, this bill would direct the Department of Health (DOH) to provide eligible individuals with the opportunity

to schedule an appointment in a centralized manner, either online or by phone. The DOH would be able to direct any vaccine site (both public and private) to allocate a number or percentage of their vaccine allotment to provide appointment slots for these individuals. Moreover, if enacted, the DOH would then have to report to the Legislature, no later than thirty (30) days after the enactment of this law, and every 30 days thereafter, on the number of vaccines administered to individuals over the age of 75 and the approximate number of eligible individuals remaining. Further, after the 30 days, the bill allows the Commissioner to identify additional population cohorts for prioritization following the previously established distribution schedule. Assemblyman Thiele stated, “Currently, there is little correlation between public health need and getting a COVID vaccine appointment. Being computer savvy shouldn’t be the primary basis for getting the vaccine. Now is the time to reform the current vaccine rollout system. I am pleased to join my colleague in sponsoring this important legislation that would prioritize our most vulnerable population and create a more centralized, efficient, and equitable vaccine distribution system.”

With the state legislature back in session, intense focus remains on Gov. Andrew Cuomo’s response to the COVID pandemic and efforts to cover up his mistakes in the face of a federal Department of Justice investigation. “We had hoped to get some answers during hearings on this year’s budget, but the Cuomo administration would give us nothing,” reported Assemblyman Joe DeStefano. “The budget hearings were delayed three weeks as it were and are not the COVID-specific hearings we requested. Nothing short of a federal investigation coupled with legislative hearings using subpoena powers will enable us to get to the bottom of what really happened as the death toll in state nursing homes rose to the highest in the nation.” Although there was a public clamor demanding the nursing home details for months, the issue made national headlines when Attorney General Letitia James released the results of an investigation showing that the governor hid the true extent of elderly deaths in the state. According to James, the number of deaths were almost double of what Cuomo had publicly admitted to. Shortly after the attorney general’s report was released, the public was shocked by the details of a private call between the governor’s secretary, Melissa DeRosa, and Democrat legislators during which she admitted that the administration withheld nursing home data for political reasons as the Justice Department and FBI moved in. One legislator on the call was Assemblyman Ron Kim of Queens

who described a “threatening” exchange he had with the governor after speaking out against him. “I was about to bathe my three kids when I received a call from the governor. He spent ten minutes threatening my career and ordering me to issue a statement that would be used to cover for the state secretary,” Kim

Governor Andrew Cuomo was reported as saying. “Cuomo is an abuser,” Kim said. “He has abused his powers. Abusers are cowards.” The administration has denied Kim’s claims. The governor’s actions as the Coronavirus plagued New Yorkers have led to calls for him to resign and the creation of a special commission to impeach him. Legislators are also moving to take back the exclusive powers granted to Cuomo at the start of the pandemic and return them to the elected representatives. Joining calls to conduct a full investigation into Cuomo’s handling of the crisis was another official of his

If there’s one thing we’ve learned throughout his three terms in office, it’s that Andrew Cuomo will not accept responsibility for just about anything willingly. New York legislators, voters and the media must do everything we can to hold him accountable.” Zeldin said on national TV that he has been asked by constituents and many prominent political leaders to mount a challenge to Cuomo in 2022. Adding to the governor’s woes was a New York Post headline last week, “Cuomo’s a Pig,” concerning sexual abuse allegations by Lindsey Boylan, his former deputy secretary for economic development. In a 1,700word essay, which Cuomo disputes, Boylan laid out in graphic detail the governor’s alleged abusive behavior toward her. Outside of Cuomo’s political problems, lawmakers remain focused on key issues to move the state past the epidemic. “The emergency powers granted to the governor were temporary and we must return back to the system of checks and balances that has served this state well for more than two hundred years,” said Assemblywoman Jodi Giglio. “The legislators must be part of the decision-making process. We are the closest to the people and our ideas and concerns must be taken into consideration.”

William Floyd Bowling Wins League II, Heads Back to County Championships

Mastic Beach, NY, February 24, 2021 – The William Floyd High School varsity bowling team under the leadership of head coach James Healey recently concluded their regular season with their second consecutive League II Championship, a 13-1 record and a 10th consecutive ticket back to the Suffolk County High School Bowling Championships. The county finals will be held this Sunday, February 28, beginning at 9 am at Bowlero in Sayville. It will be livestreamed on the William Floyd Athletic Department’s YouTube channel. This season was a banner one for the Colonials, with senior Louis Parrinello placing second overall in Suffolk County with a 227 average, earning him First-Team All-County honors and securing him a spot on the Suffolk County All Star team. Louis led the county by rolling a

700+ series seven times and finished the season with a 280-high game, earning him team MVP honors. After six seasons with the Colonials, Louis has earned countless awards including four All-League honors, an All-County nod, three White Letter awards for academic achievement and two perfect games. The Colonials had great performances from Juan Madera (216.4 average) and Alex Ramoska (211.6 average) earning themselves First-Team All-League honors on the season. Madera dominated League II this season finishing with the highest series of 748 and ranking in the top two in both match points and high games. Ramoska finished the season with a high series of 738, a high game of 277 and a top-10 finish in the county tournament. Other notable performances include Alex Hope who finished the season with a 192 average and a high game of a 267,

Bellport HS Students Meet Best-Selling Author Mateo Askaripour

In celebration of Black History Month, Bellport High School students had the rare opportunity to attend a Google Meet presentation with South Country Central School District 2008 graduate and New York Times bestselling author Mateo Askaripour whose book, “Black Buck,” strongly resonates today with the nation’s black and brown communities. Mr. Askaripour spoke to the students and faculty about the process of writing fiction and what spurred his writing of “Black Buck,” which tells the story of Darren who receives an opportunity to work for a technology startup as part of an elite sales team on the 36th floor in New York City. However, the cult-like atmosphere of his new workplace is not as it seems. After hitting a low point in his personal life and career, Darren eventually hatches a plan to assist

He explained that he never envisioned being an author, but that writing fiction has been his salvation. “I wouldn’t be here without going to Bellport High School and having engaged in all types of learning,” Askaripour said. “Putting goals out there can make you feel naked, but it’s important to bet on yourself. I decided to bet on myself.”

Rising to the Challenge: William Floyd Learning Center Students Excel in New York Road Runners Events Shirley, NY, February 24, 2021 – Students at the William Floyd Learning Center have been participating in the Rising New York Road Runners (NYRR) club activities as a way to improve their physical fitness and learn new ways to stay healthy. As part of this endeavor, students, earlier this year, completed a bus loop marathon outside of their school as a way to challenge themselves to meet and surpass their fitness and running goals. “All students, no matter their fitness ability, gave it their all and completed the race,” said Camelle Person, assistant principal, William Floyd Learning Center. “They had a great time challenging themselves to run their fastest and complete the virtual marathon challenge.” Additionally, throughout the year, students continued to compete in various NYRR events including the virtual Coast-to-Coast Challenge, in which they virtually traveled to all 50 states to take on physical challenges related to the geography in each state – which also served as a fun and

This year’s coat drive ran from January 4 to February 1.

Floyd Supreme Court Building. Former Supreme Court Justice Marquette L. Floyd dedicated 58 years of service to Suffolk County and our nation. Through his perseverance, tenacity, and unwavering commitment to his community, he became the first judge of color in Suffolk County in 1969. “Naming the Supreme Court building at the John P. Cohalan, Jr. Court Complex after the County’s first African American Justice is a fitting tribute to his legacy as a true pioneer of justice and equality – Judge Floyd is a source of inspiration to younger generations seeking to overcome racial bias and socio-economic adversity,” said Judge Crecca. “I am truly grateful to Legislator McCaffrey for introducing this Resolution at my request.” Marquette L. Floyd was born to a single mother on October 14, 1928 in Winnsboro, South Carolina. When he was 16, his family left rural South Carolina for New York to seek

better opportunities. He attended White Plains High School after which he briefly attended New York University before joining the United States Air Force. While in the military, he was denied admission to Officers Candidate School under the U.S. military policy of segregation. The policy was not formally abolished until July 26, 1948 by President Harry S. Truman. Despite these disadvantages, he served his country honorably for six years. Following his honorable discharge in 1954, Justice Floyd graduated from New York University and decided on a career in law. He attended Brooklyn Law School. While attending school, he was employed as a maintenance man, a clerk, a stock boy and in other odd jobs to pay his tuition. He was admitted to the bar in 1960 and entered private practice in Amityville, NY. Throughout his time in Suffolk County, he was active in politics, civic groups, assisted in forming charitable organizations and was, in all regards, deeply committed to his community. In 1969, he was elected to Suffolk County District Court and became the first person of color to sit on the Suffolk County bench. In 1986, Judge Floyd was appointed to the Suffolk County Court and, in 1989, was elected to New York State Supreme Court where he presided over significant civil cases until 2002. During his tenure as a Supreme Court Justice

he also served on the Appellate Term, Second Department, and in 2001, was designated its Presiding Justice. At the end of 2002, Justice Floyd retired from the bench. Justice Floyd was a mentor to the youth in his community and remained committed to the advancement of people of color. Justice Floyd died on December 12, 2020 at the age of 93. Justice Floyd had been heard to say, “As a child I thought being rich meant having money and material things. Now I know being rich means the life you live and the legacy you leave.” District Administrative Judge Crecca said, “Justice Floyd is an inspiration to the residents of Suffolk County no matter what their race, socio-economic background or the circumstances of birth. His dedication to community and commitment to justice and excellence are the pillars on which the courts stand. You will be caught, you will be fined and you could serve time in jail.” At approximately 3:08 a.m. on Sept. 27, 2019, Schuster, while driving an R&G Dumpsters truck, illegally disposed of 20 cubic yards of mixed C&D and other solid waste material at a property owned by the Town of Brookhaven located on Lloyd Court in Lake Ronkonkoma. The solid waste included lumber, wood doors, wood and plastic fencing, plate glass and mirrors, cardboards, plastics, foam paddings, empty cement bags, gypsum drywall wallboard, scrap metals, and ceramics, including toilet, tub, and sink pieces. Working in collaboration with the Suffolk County District

Attorney’s Office and Suffolk County Police Department, the Town of Brookhaven’s Highway Department cleaned up the property on Oct. 7, 2019. Following an investigation, Schuster was arrested by detectives from the Suffolk County Police Department’s District Attorney’s Squad on Dec. 10, 2019. Schuster’s truck, a white 2000 Freightliner FL50, was seized. Pursuant to the plea agreement, Schuster is required to pay $2,119.04 in restitution to the Town of Brookhaven for the cleanup and is required to forfeit his truck to the District Attorney’s Office. Schuster is being represented by Robert Macedonio. This case is being prosecuted by Assistant District Attorney Adriana Noyola, of the Enhanced Prosecution Bureau.

It was almost 30 years ago when local Legislator Herb Davis made the argument that term limits are necessary to prevent politicians from becoming entrenched and give new voices an opportunity to serve. Voters agreed and in 1994, they overwhelmingly approved term limits for Suffolk legislators. Since then, more than two dozen legislators have served their 12 years and have gone on to other things. Fast forward to the present and now Kate Browning wants to circumvent history in an ill-advised attempt to return to the legislature. The reason no one has ever come back is simple: the law set in motion by Herb Davis and the forward-thinking voters of the time does not allow it. There is no provision in the statute for a term-limited legislator like Kate Browning to leave office and then come back. If there was, every legislator affected by term limits could have simply resigned before election day and then never leave.

The natural course of action envisioned by the proponents of term limits is for a legislator, if they believe they’re such an asset to the community, to run for something else. Many Suffolk officials have done just that serving new roles in both state and local government. In fact, Browning herself attempted to move on and lost in a primary election for Congress. While Kate Browning was successfully elected to serve our area six times, she is not above the law. Term limits were put in place by the will of the voters and every legislator since then has honored their wishes. It would be entirely improper—and illegal—for Kate Browning to go against the voters for her own political purposes.

Long Island Electricity - The Decision Ahead

SUFFOLK CLOSEUP BY KARL GROSSMAN The G in PSEG could stand for Goofy. PSEG this month faces loss of the 12year contract it got in 2013 to operate Long Island’s electrical grid for the Long Island Power Authority. This stems from its massive failures during Tropical Storm Isaias in August 2020 when more than 500,000 of LIPA’s 1.1 million customers lost power, many for days, and communications with PSEG to report outages and find out what was happening were impossible. As Governor Andrew Cuomo, who was central in getting PSEG to replace National Grid as LIPA’s private contractor—after National Grid’s major failures in Superstorm Sandy—said of PSEG’s Isaias performance: “Utility companies are beholden to ratepayers, and when that service is inadequate—or as in this case, a complete failure—those utilities need to be held accountable.” LIPA is to make a decision later this month about going back to the original vision of LIPA when it was created by the state in 1986: being a full public utility operating Long Island’s electric grid itself and not jobbing that out to a private company. LIPA is also considering an alternative: strengthened provisions in its contract with PSEG. It should decide to be a full public

utility. And, also, the state should restore another part of the original vision for LIPA—having LIPA’s trustees elected. This would enable the Long Island public to control their public utility. (Now LIPA trustees are appointed, five by the governor, and two each by the State Assembly speaker and State Senate president.)

This became one of my early articles

with the name of Brookhaven National Laboratory. I called BNL and was told it had set up the station because a company from New Jersey, PSEG, planned to site nuclear power plants in the Atlantic. A BNL spokesperson said the laboratory

had borrowed a 75-foot LST from the U.S. Navy and was also using aircraft and a trawler. Clouds of white smoke were being sent up to determine likely dispersal patterns of radioactivity from the floating PSEG nuclear power plants. I was told the clouds, representing radioactivity, usually floated to Long Island because of prevailing winds being from the southwest. PSEG convinced Westinghouse to manufacture the floating nuclear power plants. In 1970 Westinghouse set up Offshore Power Systems to construct them at a massive facility built on Blount Island off Jacksonville, Florida. The plants were to be towed up the Atlantic into position. In a book I wrote, Cover Up: What You Are Not Supposed to Know About Nuclear Power, I showed an Offshore Power Systems sales brochure and featured three pages on the project. Offshore Power Systems went bust in 1984, after losing $180 million (in 1970s dollars) on the failed venture. PSEG itself, meanwhile, according to NJ Advance Media, “sunk millions into the project and [its] customers would spend the next 20 years paying off a large share of those costs.” More next week on the Long Island electricity decision ahead.

BY TOM BARTON The New York Rangers were a fashionable pick to win the Stanley Cup before the season for many bettors across the country. The Blue Shirts opened with about 25 to 1 odds to win it all and was quickly bet down to right near 20 to 1. As of this writing they sit under .500 and can’t seem to find any groove at all. They have now fallen all the way back to as far as 66 to 1 in some SportsBooks and most have them at least 50 to 1. The bettors have fallen off of the Rangers bandwagon but is there a rebound in sight? New York was a young team coming into the year and had all the makings of a team with upside, but they just can’t find their footing. They have had players released, suspended and all

sorts of off the ice problems on top of their play. The Tony DeAngelo fiasco was an utter mess, and the Panarin allegations also cloud this team but I see some hope. New York, with all the doom and gloom, sit only a winning streak away from getting back into contention. With a good week or week and a half this team can throw their name right back in the mix and have Rangers fans smiling again. The pessimist sees a tough 7 game road stretch ahead but the optimist also sees a team who faces the teams they have to catch right in front of them for the next month. The Rangers defense has stepped up and it could be the

Jacob Trouba leads the team in hits and is playing inspired hockey, K’Andre Miller may be young but he leads the team in takeaways, and Adam Fox has shown he can lead this team for years to come. I don’t like the future’s bet to win the cup, that is too lofty a perch to even discuss. But I also am not throwing in the towel here that this team can’t push for a playoff spot. One thing is clear, the future looks bright for this young team.

Beneficiary Trusts: Creditor Protection using HEMs

I need to create a last will and testament and my friend suggested leaving my assets to my beneficiaries in trust using HEMS language. Is there a reason to do it this way instead of distributing assets outright? What does HEMS mean?

When creating a last will and testament or a living trust, there are certain planning techniques that can be advantageous to those who inherit your assets. One such technique is distributing assets to your beneficiaries in trust to provide them with creditor protection, which they would be unable to create for themselves. The IRS rule is that when a trust limits the distribution of principal to an ascertainable standard, the trust is protected from creditors and divorce. Limiting distributions to beneficiaries for their health, education, maintenance, or support (HEMS) falls within the IRS guidelines of an ascertainable standard that creates creditor protection for the beneficiary. While this type of trust may sound restrictive, HEMS is very broad and the trust can essentially be used to maintain the beneficiary’s lifestyle. The principal of the trust can be used to pay for the beneficiary’s schooling, rent, taxes, medical expenses

and more. Additionally, assets, such as a real property, can be bought directly in the name of the trust, thus protecting the assets immediately upon purchase. Lastly, the beneficiary can be their own trustee and have the right to withdraw the income generated from the trust, all while maintaining creditor protected status.

FROM A TO Z BY ROBERT CHARTUK I received a rather startling call from American Express the other day: Someone applied for a credit card in my name and the fraud alert system flagged it because the address they used was different than mine. They did have my Social Security number. Thankfully, Amex didn’t issue the card and was very helpful in assisting me. Because I once worked for the federal government, I was offered credit monitoring through MyIDCare after my personnel files were breached. I checked my credit history and sure enough, the Amex poach was on there, along with an attempt for a Capital One card. There are three credit reporting companies in the U.S. and they keep intrusive records on all of our financial transactions. Through complex formulas, they assign us a credit score. This is a critical number since anyone who’s going to loan money for a credit card, mortgage, car, etc. is going to access this score before they make a decision. Your credit score is a window into the type of person you are and its use is becoming increasingly widespread.

Perspective employers may want to see how worthy you are, or a landlord or utility company will want to size you up. Your life can become more difficult—and expensive—depending on your score, especially if it tanks due to someone stealing your identity and running up some credit cards. You have to give permission for someone to access your score, but try getting anywhere if you deny them.

Identity theft has been on the rise during the pandemic and all of us are vulnerable in the electronic age. I strongly urge everyone to sign up with a credit monitoring service. Sorry, you can’t use MyIDCare since it is exclusive to people who are in the federal system, but there are plenty of others out there. I also recommend that you request a copy of your Credit Report from one of the agencies and flag any suspicious activity. You may also find incorrect items that are dragging down your credit score that you can get removed. It takes some time on the phone, but it is well worth it to keep your credit in order.

The fraud specialists at MyIDCare were very helpful and friendly. They called Capitol One with me on the line and had the credit card request cancelled. They assured me that I would not be liable for any charges. They also removed the card request from my credit score since even an inquiry is part of the equation when they formulate your rating. Amex did the same thing. Equifax is one of the three reporting companies and once I registered a “Fraud Alert” with them, it went to the other two, Experian and TransUnion. Now, if someone tries to apply for credit in my name, I will be alerted. Since I don’t plan on borrowing anything in the near

Angels appear in pop music on a regular basis, on cards and wedding invitations, and on bric-a-brac and jewelry. They have been major subjects of art, literature, and drama from preRenaissance until present day.

Before the input of modern science in the 17th century, angels were believed to move the stars and manipulate the universe for God. Gravity was not one of nature’s laws, it was the result of enlightened angelic activity.

In today’s era of sophisticated secularism some view belief in angels as ignorant superstition or unscientific twaddle, while others have attested to seeing or speaking with them. Belief in angels is rooted in monotheistic religions of Christianity, Judaism, Islam, and Zoroastrianism. All believe the cosmos is divided into Heaven, Earth, and Hell and is populated with humans, angels, and demons.

The very term angel derives from the Greek translation of the Hebrew mal’akh, meaning “shadow side of God,” which evolved into “messenger.” Refer to Genesis 18:14 where Abraham’s wife Sarah is told that she, although barren, will give birth to a son. Here the angel is unquestionably depicted as shadowy.

We can contrast these to the perception of the cosmos held by the Hindus and the Buddhists who have no belief in the existence of angels. Their focus is on reincarnations of holy sages or incarnations of their gods. In Western traditions based on prayer rather than meditation angels are very important. God’s

Covenants 1. Use of the subject site shall be limited to not more than sixty-six (66) attached dwelling units, except that additional residential dwelling units may be permitted up to a maximum of ninety-six (96) residential dwelling units as provided herein, with recreational facilities, recycling area, and any other facilities as may be required for the operation of the multi-family development. In addition, any model dwellings and/ or rental offices to be constructed, shall not be free standing and shall be contained within the building structures as indicated on the approved site plan. a. The applicant/ owner can only achieve the maximum number of dwelling units in the event a Sewage Treatment Plant becomes available in the locale and Transfer of Development Rights are utilized in conformance with the current Town Code redemption schedule of one Pine Barrens credit per every two units. b. A maximum of ten (10%) percent of the number of dwelling units up to sixtysix (66) units shall be maintained in perpetuity as

affordable units. Twenty (20%) percent of the number of dwelling units over sixty-six (66) dwelling units shall be maintained in perpetuity as affordable units. Ten (10%) percent of the “Affordable” units shall be offered for an amount affordable to occupants whose incomes are at eighty to one hundred (80% to 100%) percent or less of the median family income for the NassauSuffolk region as published by HUD based on family size. Ten (10%) percent of the “Affordable” units shall be offered for an amount affordable to occupants whose incomes are at one hundred to one hundred and twenty (100% to 120%) percent or less of the median family income or the Nassau-Suffolk region as published by HUD based on family size. c. Each dwelling unit shall be limited to not more than two (2) bedrooms; however, fifty (50%) percent of the second story units may provide a loft area subject to the determination of the Planning Board at the time of site plan review. d. The residential development shall not be a gated community. 2. The applicant/owner shall, at the time of site plan approval, make a perpetual offer of dedication to the Town of Brookhaven of the on-site wetlands. The exact area and dimensions of the dedication area shall be determined at the time of the site plan approval. The applicant/owner shall dedicate said land prior to the issuance of a certificate of occupancy for the 30th dwelling unit. a. The applicant/owner shall agree to a perpetual offer of access to the dedicated wetlands area through other lands of the applicant/owner, subject to the satisfaction of the Planning Board. b. The applicant/owner agrees to file a natural and undisturbed conservation easement on undisturbed

lands surrounding the wetlands area, subject to the satisfaction of the Planning Board prior to the issuance of a certificate of occupancy for the 30th dwelling unit. The exact area and dimensions of the dedication area shall be determined at the time of site plan review. 3. The applicant/developer shall, at the time of site plan submission, submit wetlands reclamation plan in conformance with all necessary requirements of NYS DEC and the Town of Brookhaven DEP. 4. The applicant/developer shall, prior to the issuance of a certificate of occupancy for the 30th dwelling unit, implement all necessary improvements to the wetlands on lands known as SCTM No. 0200-378000100-013000 in conformance with the aforementioned approved reclamation plan including development of any walking trails. 5. The applicant/owner shall, at the time of site plan approval, make a monetary contribution to a Middle Island Community Enhancement Fund in the amount of $50,000.00. 6. Development of the site shall be in substantial conformance to the 2006 Middle Country Road Land Use Plan for Coram, Middle Island and Ridge. 7. Architectural elevations shall be submitted pursuant to the satisfaction of the Department of Planning, Environment and Land Management and the Planning Board and shall be in substantial conformance to the recommendations in the 2006 Middle Country Road Land Use Plan for Coram, Middle Island and Ridge. 8. Parking shall be provided in accordance with the site plan approval. 9. Signage and lighting shall be consistent with recommendations and guidelines outlined in the Main Street Business Design Manual. 10. The developer shall provide the

necessary on-site recreation for the multifamily uses as required by Town Code. 11. The following transportation/ traffic safety mitigation measures shall be required of the developer of the subject project subject to the determination of the Town of Brookhaven Planning Board, Town Highway Department, New York State Department of Transportation (NYSDOT) and Suffolk County Department of Public Works (SCDPW) at the time of site plan review and approval. This list of mitigation measures is not intended to be conclusive and will be subject to further review and determination by the agencies having jurisdiction. a. A roadway shall be provided on the subject property connecting Rocky Point Road, CR 21, to Middle Island Road. This drive or roadway may be non-linear within the site and is subject to the determination of the Planning Board at the time of Site plan review and approval. A minimum of fifty (50) foot right of way shall be offered for dedication to the Town of Brookhaven subject to the determination of the Planning Board; and the Town Highway Department. b. All access to the residential dwelling units shall be by way of the internal road. No direct access shall be permitted to Rocky Point Road, CR 21, or Middle Island Road. c. Pedestrian friendly streetscape shall be provided, including sidewalks consisting of decorative paving material and low level decorative streetlights, as may be approved by the Planning Board. d. The developer shall be responsible for all off-site traffic control devices, as may be required, which may include signals, signs and pavement markings, subject to the

review and acceptance of the Town’s Department of Planning, Environment and Land Management (PELM), the NYSDOT and the SCDPW, as may be applicable. e. The internal drive or roadway shall be designed to accommodate any required culverts or other mitigation as may be required by NYSDEC in order to enhance the significant habitat identified in the locale. 12. If deemed necessary in order to comply with the Wetlands Overlay District setbacks and buffers as required in § 85-625 of the Town Code of the Town of Brookhaven, the applicant shall make the necessary applications to the Town Board at the time of site plan review and approval. 13. The applicant/ developer shall make all necessary applications, if applicable, to the appropriate agencies, including NYSDEC. 14. Provide the following general site plan mitigation measures: a. The applicant will submit a landscaping plan as part of Planning Board site plan approval process. b. Developer shall provide a decorative shelter on private property for children that may be waiting for a school bus, subject to the determination of the Planning Board. c. Storm water runoff shall meet all Town standard drainage requirements and may be handled by ponds to be constructed on-site and/or by leaching pools. d. Grading of the site shall be minimized to the maximum extent practical. Removal of material from the subject property shall be in conformance with Chapter 53 of the Town Code. e. In no case shall any building exceed three (3) stories. f. The applicant/owner shall agree to any future proposed abandonment of Middle Island Road. 15.
