Bellone Announces “Take Your Shot” Campaign to Encourage Residents to Get The COVID-19 Vaccine

Suffolk County has set the Goal of Vaccinating 75 Percent of Eligible Residents, which Equates to more than 850,000 County Residents Residents Encouraged to use Hashtag #TakeYourShot to Share on Social Media Reasons for Vaccination Suffolk County Executive Steve Bellone today kicked off a robust public awareness campaign to educate residents on the importance of receiving the COVID-19 vaccine, and to encourage residents to pledge to #TakeYourShot against COVID-19. The County’s “Take Your Shot” initiative will be a multifaceted, multimedia campaign that will incorporate social media, paid digital advertising, and trusted community stakeholders, with the goal of securing pledges from at least 850,000 County residents to commit to receiving the COVID-19 vaccine. “The arrival of the COVID-19 vaccine signals the ending of this pandemic, but it will only work if the majority of our residents participate,” said Suffolk County

Executive Bellone. “Getting vaccinated is not only critical to protecting the health and safety of our communities, but is vital in our continued economic recovery, and keeping our businesses and schools open. Our goal is to vaccinate more than 850,000 County residents, and over the next 100 days we will work tirelessly to spread the word that this vaccine is safe, effective and will save lives.” The educational campaign will open a dialogue on the importance of getting vaccinated, address any misinformation or lack of trust, and disseminate guidance on the COVID-19 vaccine. Suffolk County will mobilize and leverage resources from the Health Department, Police Department, Department of Fire, Rescue, and Emergency Services, the Office of Minority Affairs, and Suffolk311 to engage directly with residents regarding the efficacy and safety of the vaccine. As part of the “Take Your Shot” initiative, the County will launch a social media campaign encouraging doctors, nurses, first responders, community leaders and the general public to share short videos about why they plan on getting vaccinated against COVID-19, using the hashtag, #TakeYourShot. The

County will then share these videos across various platforms including Facebook, Twitter, and Instagram to raise awareness. As part of the #TakeYourShot campaign, Suffolk County will leverage $50,000 in funding to undertake a robust paid advertising campaign to educate residents on the importance of inoculation. The paid campaign will incorporate digital radio advertisements featuring trusted health leaders, such as the County Health Commissioner, social media ads, billboard signs, and more. And finally, Suffolk County will collaborate with a variety of outside organizations and stakeholders to reach targeted communities, including communities of color who have been especially hard hit by the pandemic. The various trusted stakeholders, which will include the business community, faith-based organizations, health care providers, school districts and more, will work to educate and encourage their memberships and communities to get vaccinated. The County will work in partnership with these groups through various platforms including social media, Zoom, and other marketing tools to

Man Arrested for Killing Victim and Burning Body

On Saturday, December 26, 2020 at approximately 2:30 a.m., Suffolk County Police Homicide Squad detectives have arrested a Shirley man for killing a person and setting the body on fire in the backyard of a residence this morning. Police responded to a 911 call reporting a fire in the backyard of a residence located at 27 Mastic Blvd. West at approximately 2:30 a.m.

Upon arriving on scene, officers found a body burning on the property. The fire was extinguished. An autopsy will be conducted by the Office of the Suffolk County Medical Examiner to determine a cause of death and identify the victim, who is believed to be a male. A resident of the home, Peter Pendzinski, 20, has been charged with Murder 2nd Degree. He was

transported to a local hospital for treatment of non-life-threatening injuries and is scheduled to be arraigned at First District Court in Central Islip on a later date. A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.

Faculty, staff and students were extremely generous with their donations of gifts that were included in gift boxes for secondary-level students struggling this holiday season.

From Suffolk: Investigating Nukes-in-Space

SUFFOLK CLOSEUP BY KARL GROSSMAN Suffolk County is nuclear-free as a result of the battles to stop the Shoreham nuclear power plant from going into operation and preventing the construction of the many other nuclear power plants the Long Island Lighting Company planned to build here. Indeed, all over the United States there have been opposition to nuclear power plants which has caused their number to be reduced. But there’s a look upward for using nuclear power. There are now plans afoot to put nuclear power plants on the Moon and Mars for would-be colonies. “US Eyes Building Nuclear Power Plants for Moon and Mars,” declared the headline this July of an Associated Press dispatch. There’s also work on nuclear propulsion in space. In July, too, the White House National Space Council issued a strategy for space exploration that includes “nuclear propulsion methods.” Nuclear propulsion, its promoters say, would get astronauts to Mars quicker. And last week The White House released a “National Strategy for Space Nuclear Power” elaborating on its desire for nuclear power and nuclear propulsion in space.

Meanwhile, Elon Musk, founder and CEO of SpaceX, has been touting the detonation of nuclear bombs on Mars to, he says, “transform it into an Earth-like planet.” As Business Insider has reported, Musk “believes it will help warm the planet and make it more hospitable for human life.” The website www.space.com says: “The explosions would vaporize a fair chunk of Mars’ ice caps, liberating enough water vapor and carbon dioxide…to warm up the planet substantially, the idea goes.”

The nuclear space issue is one I got into 35 years ago when I learned from reading a U.S. Department of Energy newsletter about two space shuttles to be launched the following year with plutonium aboard. One shuttle was the Challenger. It was to carry up a space probe loaded with 24.2

The season will be truncated but still have an 868game regular-season. That means each team will play 56 games. The lines makers have set the pre season betting favorites for the Stanley Cup with the Colorado Avalanche leading the way with +750 odds. That young squad is followed by the Vegas Golden Knights at 8 to 1 odds, the defending champion Tampa Bay Lightning at 9 to 1, the Boston Bruins come in at 14 to 1 and the Flyers at 15 to 1.

Oddsmakers have also pointed at both New York area teams as long shot value plays. The Islanders and their great defense have odds that sit at 27 to 1 and the Rangers are getting some attention at 30 to 1 odds. But New York does have a 3rd team and the Sabres will be in the same division for the first time in nearly 50 years. The Rangers and Islanders will also be in the same division for a 48th consecutive season. This year’s schedule however is quite unique as they will play each other 8 times. Said the headline in Universe Today last month, “Solar Power is Best for Mars Colonies.” The extensive piece stated how “a NASA-sponsored MIT think-tank has weighed up the future energy needs of a manned settlement on Mars and arrived at an interesting conclusion… solar arrays might function just as well, if not better, than the nuclear options.” Likewise, solar power is

seen as abundant on the Moon. A 2016 Discover magazine piece was headlined “How to Harvest Terawatts of Solar Power on the Moon” and spoke of the Japanese corporation, Shimizu, “gearing up to develop solar power on the moon.” As for propulsion, there are solar sails. The magazine New Scientist published a comprehensive article in October titled, “The new age of sail,” with a subhead: “We are on the cusp of a new type of space travel that can take us to places no rocket could ever visit.” Japan sent up its Ikaros spacecraft in 2010 using energy emitted from the sun to sail in the vacuum of space. Last year, the LightSail 2 mission of the U.S.based Planetary Society was launched and is still up in space flying with the sun’s energy. The New Scientist article piece spoke of scientists wanting to use solar sails “to set a course for worlds currently far beyond our reach— namely the planets orbiting our nearest star, Alpha Centauri.” Solar power has also begun to replace plutonium power on space probes. NASA in 2011 launched its Juno space probe on a mission to Jupiter. It uses three solar arrays instead of nuclear power to generate onboard electricity. Juno is still up there, orbiting and studying far-off Jupiter.

The Tragic Story of Norman Kean and the Shadmoor Preserve

FROM A TO Z BY ROBERT CHARTUK Working as a reporter gave me a sideshow seat to a tragic and tawdry episode played out under the harsh lights of Broadway. I received a call from a man named Norman Kean who was upset over a development project on the bluffs of Montauk overlooking the Atlantic Ocean near his summer home. The land is of magnificent beauty with a panoramic view of eastern Long Island and towering dunes cascading down to the sea. Montaukett Indians lived there eons ago and it once served as Camp Wycoff where Teddy Roosevelt and his Rough Riders were quarantined for malaria after their exploits in the Spanish-American War. During World War II it was used as a coastal artillery station and concrete bunkers that housed 16-inch guns remain there today. Now it’s known as Shadmoor, after the heathland shadbush that grows there. “They’re salting the wells,” Kean told me, rather emphatically. “They can’t build there because there’s not enough

fresh water and they’re faking the test results. They’re salting the wells, I say, and it’s wrong.” I wrote a story about Shadmoor and Mr. Kean’s opposition to the 100-acre development plan. The attention focused concern on the fragile area’s ability to provide water for such a large development and the approval process ground to a halt. Norman Kean was delighted. Soon after my story appeared, a letter came to the office inviting me to attend the Tenth Anniversary of the musical, Oh! Calcutta!, and backstage passes to the cast party. It turns out that Norman Kean was not only the producer of the play which was, at the time, the longest running revue on Broadway, but also owned the Edison Theater where it was staged. I went with my newspaper colleagues and Mr. Kean could not have been a better host. The seats were great and I took further advantage of his hospitality by scoring front row tickets to the show a few weeks later for me and a few friends.

made it a nature preserve, one of the premier expanses of open space on the Eastern Seaboard. Too bad Norman Kean didn’t live to see the day. He had discovered his wife of

many years, an actress with the peculiar name of Gwyda DonHowe, was having an affair and after their 14-year old son headed off to school one morning, stabbed her to death. When the maid arrived, he gave her some letters, one of which stated that the show, Oh! Calcutta!, must go on, and plunged himself 15 stories from the roof of his apartment building to the courtyard below. He was 53 years old. It was 30 years later that I visited the preserve for the first time and hiked through trails that opened up to a breathtaking view of the Atlantic. In the parking lot, I imposed upon a young couple like the narrator in Coleridge’s poem, the Rime of the Ancient Mariner, and held them with a “glittering eye.” I told them the story of Norman Kean and how the land was saved. They were among a few who had heard the tale in its entirety.

What to Expect in an Article 81 Guardianship Proceeding

What happens during an Article 81 guardianship proceeding? What are the roles of everyone involved?

A guardianship proceeding is commenced under Article 81 of New York State Mental Hygiene Law. The purpose of the proceeding is to have a guardian appointed for a person who has been deemed incapacitated and unable to make decisions with respect to his/her person and/or property. The Court must find that the alleged incapacitated person (or “AIP”) cannot appreciate the nature and consequences of his or her actions. There are two types of guardians: Personal Needs Guardian and Property Management Guardian. The Personal Needs Guardian make decisions with respect to health care. The Property

Management Guardian handles all financial matters. This can be the same person depending on what the Court deems most appropriate. In order to a commence a guardianship, an Order to Show Cause and Petition must be submitted to the Supreme Court. This should outline why the AIP is in need of a guardian and potentially nominate a specific person to serve as the guardian. There are certain individuals that must be notified that a guardianship proceeding has been requested: the AIP, the spouse of the AIP, any children of the AIP, parents of the AIP, siblings of the AIP and if there are any agencies/ facilities that would potentially be

involved with the proceeding (i.e. a nursing home where the AIP resides). Once a guardianship proceeding is commenced, the Court will appoint a Court Evaluator who will act as the “eyes and ears” of the Court and will visit the AIP, interview the potential guardian and any other persons that may have pertinent information to the pending guardianship. There is also a possibility that the AIP will receive his or her own attorney appointed by the Court. This is to ensure that the rights and wishes of the AIP are always protected. A hearing will be scheduled to hear the case. The hearing should be scheduled within 30 days of the Court receiving the Order to Show Cause and Petition. At the hearing, all parties can

put on evidence to the issues of whether a guardian is required and who that guardian should be. Ultimately, after hearing all of the evidence, the Court will make a finding with respect to the guardianship and if necessary, appoint a guardian. Once appointed, the guardian will be required to undergo a Court-approved training program, background check and potentially be bonded. In addition, the guardian will be required to maintain financial records and file an initial accounting within 90 days of the appointed and ongoing each year. The reporting must be taken very seriously as failure to keep sufficient records and/or report to the Court,

the guardian may be removed. Usually, the guardianship will be maintained indefinitely and only terminate upon the death of the AIP; however, if the AIP improves, a termination proceeding (or “Get Well Proceeding”) may be commenced to terminate the guardianship earlier. In order to avoid being the subject of a guardianship, it is advisable to take the necessary steps to execute a complete estate plan – including a comprehensive Health Care Proxy and Durable Power of Attorney. With appropriate estate planning documents in place, a guardianship proceeding can usually be easily avoided.

Here’s how the story goes. In the dead of winter, two duck hunters and their trusty hunting dog drive their brand-new Range Rover out on to the ice of (choose: _______ [a] Long Island Sound, [b] Moriches Bay, [c] Shinnecock Bay, [d] Great South Bay, [e] body of water of your choice) and, seeing that there were no open leads to entice migratory birds to land, take out a stick of dynamite, light it and throw it as far out on the ice as they can. The plan is simple. The dynamite blows a substantial hole in the ice; they get back in the car and run the heater until the migratory birds arrive. They step out with their shotguns full of bird shot and bag much of the flock. So, as the dynamite stick is flying through the air, the dog takes off after it, thinking that a game of fetch is exactly what will make his day. Grabbing the lit stick of dynamite in his mouth,

he turns and starts running back to his master and fellow hunter. This of course alarms the hunters no end. Seeing that waving their arms wildly and shouting, “no! no! no!’ isn’t working, they fire their bird shot at the charging dog – striking fear into a bewildered Fido. Fido turns to his only source of cover – the car. Running under the car to hide, all is fine until he burns his rump on the still-hot exhaust pipe. As he yelps and takes off running again, the dynamite stick, which was left behind with the yelp, explodes. community in responding to COVID-19; WHEREAS, cases of transmission of COVID-19 have been documented in the Town of Brookhaven and more are expected to continue; and WHEREAS, the Town of Brookhaven is addressing the threat that COVID-19 poses to the health and welfare of its residents and visitors. WHEREAS, the State of New York by Executive Order No. 202 dated March 7, 2020, has addressed the transmission of the cases of COVID-19. WHEREAS, the Town of Brookhaven is desirous of assisting existing businesses and places of worship in the Town of Brookhaven which have been authorized to re-open and lack the indoor areas or facilities to accommodate COVID-19 social distancing requirements and/or occupancy restrictions, and wish to temporarily use existing outdoor areas, install pickup windows or add parking lot signs. Pursuant to the powers vested in me by Executive Law §24, I hereby declare a State of Emergency. This State of Emergency has been declared because there is a reasonable apprehension of transmission of COVID-19 cases in the Town of Brookhaven. I. During this period, the following order shall be in effect: A. The Town Board hereby creates, authorizes and permits COVID-19 Social Distancing Accommodations. There shall be four types of said Accommodations permitted: 1. Areas: Changes to outdoor spaces on existing improved sites, with a Certificate of Occupancy for the principal use, to be used where said principal use has been authorized by the Governor of the State of New York to re-open, but the occupant does not have the indoor area to accommodate COVID-19 social distancing

requirements or occupancy restrictions imposed by the Governor of the State of New York. The placement of outdoor seating tables and/or chairs, display racks, public assembly areas, equipment or other similar items shall be permitted in the COVID-19 Social D i s t a n c i n g Accommodation Areas. 2. Signs - Changes to parking lot signage for designation and installation of curbside pickup signs or pick-up parking stalls signs. 3. Pick-Up Windows: Changes to existing facades for the installation of pickup windows or movable exterior walls or similar. 4. Alternate Indoor Dining Spaces: Changes in use to vacant indoor spaces to add dining areas for take-out restaurants, restaurants or major restaurants in existing improved sites, whether the vacant space is adjacent or not, where the existing take-out restaurant, restaurant or restaurant has a valid Certificate of Occupancy , and where said take-out restaurant, restaurant or major restaurant use has been authorized by the Governor of the State of New York to re-open, but the occupant does not have the indoor area in its existing indoor space to accommodate COVID-19 social distancing requirements or occupancy restrictions imposed by the Governor of the State of New York. The placement of dining tables and/or chairs, equipment or other similar items shall be permitted in the COVID-19 Social D i s t a n c i n g Accommodation Areas. B. Only the following uses, hereinafter “permitted use(s,)” shall be permitted to utilize COVID-19 Social D i s t a n c i n g Accommodations: 1. Assembly and social recreation halls; delicatessens; health clubs; large commercial retailer, except those deemed

essential business; lodges; major restaurants; nondegree-granting instruction/program except those associated with manufacturing or driver training; offices; personal service shops; places of worship; restaurants; retail sales establishments; shops and stores for the sale at retail of consumer merchandise and services; take-out restaurants; community or regional movie theatres; and tasting rooms as an accessory to a permitted principal farm brewery, cidery, distillery, or winery use. Motor vehicle wash facilities shall be permitted to maintain an Outdoor Accommodation Area limited to a customer waiting area only. C. COVID-19 Social D i s t a n c i n g Accommodations may be granted via administrative review and shall be subject to any conditions the Commissioner of Planning, Environment and Land Management, or his/her designee, deems appropriate. Submission of applications shall be on a form provided by the Commissioner of Planning, Environment and Land Management. Said application form shall replace current application forms used for land use applications, building permits and tent and membrane structures, as may be applicable. D. Nothing herein shall be deemed to supersede, alter or amend New York State Uniform Fire Prevention and Building Code requirements for inspections, permits and certificates. E. No fee shall be charged for said applications or any other permits required herein. F. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, is hereby authorized to review and approve COVID-19 Social D i s t a n c i n g Accommodation Areas

subject to the following: 1. The application must be for a legally existing permitted use with a valid Certificate of Occupancy. 2. Parking spaces may be used without penalty for loss of parking stalls, however, a physical barrier or separation to protect customers from vehicle traffic, such as bollards, substantial planter boxes or similar barrier, must be installed. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, may request a parking analysis to ensure that adequate parking for facility is always provided. 3. COVID-19 Social D i s t a n c i n g Accommodations must meet Fire Code standards, including points of egress, access to fire extinguishers, and tent and awning ratings, if applicable. Nothing shall block entrances, exits, fire lanes, hydrants, sprinkler connection points, drive aisles, back-up areas, pedestrian or handicapped access. 4. COVID-19 Social Distancing Accommodations, including generators used for said areas, shall not be located within 250 feet of a structure used for residential purposes, shall only be utilized between the hours of 8:00 AM and 9:00 PM and shall expire on March 31, 2021. Any owner of any residential structure within 250 feet of a COVID-19 Social D i s t a n c i n g Accommodation must consent to the location of for seating to be located closer than 250 feet from their residence. This consent may be revoked at any time. 5. All items located within the COVID-19 Social D i s t a n c i n g Accommodation Areas shall be removed no later than April 12, 2021. 6. COVID-19 Social D i s t a n c i n g Accommodation Areas

must be maintained, free of trash and other debris, and trash receptacles provided. 7. Take-out restaurants, restaurants and major restaurants utilizing COVID-19 Social D i s t a n c i n g Accommodation Areas must comply with all New York State Liquor Authority licenses, permits, approvals, guidance, and/or applicable laws. Nothing herein shall permit outdoor bars, taverns or nightclubs. Nothing herein shall be construed as to amend, repeal, supersede, override or alter the Alcoholic Beverage Control Law. G. If a tent or canopy is to be used, New York State and Town Code requirements for tent and membrane structures must be complied with. H. Handicapped/ADA parking stalls may not be used for Outdoor Social D i s t a n c i n g Accommodation Areas. The blocking of handicapped/ADA routes (path from ADA parking stalls to sidewalk curb ramps to store entrances) is prohibited. Do not reduce sidewalk widths to less than 36”. I. Removal of existing natural areas or required buffers is prohibited. J. Outside loudspeakers or exterior live entertainment COVID-19 Social D i s t a n c i n g Accommodation Areas shall be prohibited within 1,000 feet of any structure used for residential purposes. Installation of barriers, bollards, planters or other portable structures to prevent vehicles from entering the COVID-19 Outdoor Social Distancing Accommodation Areas if said area is located within a parking lot or grass area. structures, and canopies, inclusive of support ropes and guy wires, outdoor seating, display areas, public assembly areas, equipment or other items. Plans can be hand drawn on existing survey, site plan or aerial map from Google Maps/Earth, Bing, etc. 2. Depict the location within the COVID-19 Social Distancing Accommodation Areas, and the dimensions of, outdoor or indoor seating tables and/or chairs, display racks and/or tables, equipment or other items, service/customer aisles, and pathways from business to outdoor or indoor seating/area. Those occupying separate dining tables within COVID-19 Social Distancing Accommodation Areas must be spaced at least six (6) feet apart. All spacing within the outdoor or indoor areas must meet any other applicable current social distancing requirements. 3. Indicate the total number of seats for take-out restaurants, restaurants, or major restaurants thereon. Pursuant to the powers vested in me by Executive Law §24, I hereby declare a State of Emergency. This State of Emergency has been declared because there is a reasonable apprehension of transmission of COVID-19 cases in the Town of Brookhaven. From the date of this Executive Order until March 31, 2021, the Town Board of the Town of Brookhaven hereby authorizes and permits the use of outdoor areas on private parcels of existing businesses in the Town of Brookhaven as drive in movie theaters subject to the following: 1. The Host/Applicant submit an Amusement/Event Application for DriveIn Movie Theater to the Brookhaven Town Clerk at least fifteen (15) days prior to the commencement of utilizing a parcel as a drive-in movie theater. 2. All areas designated for drive-in movie theater use must be situated at least one thousand (1000) feet from any residential

property lines in the Town of Brookhaven. 3. The permissible event hours shall be daily, including weekends, commencing from sunset with the last movie commencing at 11:30 p.m. 4. At all times, all employees and guests shall strictly adhere to social distancing guidelines and occupancy restrictions imposed by the Governor of the State of New York, including but not limited to maintaining a distance of six (6) feet from other individuals and/or wearing a face mask or cloth face covering that covers your nose and mouth when six (6) feet of social distancing cannot be maintained. 5. The Host/ Applicant is responsible for implementing all necessary cleansing/ disinfecting procedures for any on-site restroom facilities. 6. The Host/ Applicant is responsible for the designation of appropriate parking stalls which are at least six (6) feet apart in order to adhere to social distance guidelines imposed by the Governor of the State of New York. 7. Food trucks and mobile concessions in specifically designated and approved areas are permitted provided that all queue lines have floor markings at a distance of six (6) feet apart in order to ensure that individuals maintain a distance of six (6) foot distance. 8. The sale of alcohol is strictly prohibited. 9. Attendees shall remain within their vehicles at all times except to utilize the restrooms or make purchases from food trucks/mobile concessions. No outdoor seating is permitted for viewing purposes. 10. Nothing herein shall be deemed to supersede, alter or amend the requirements for all preliminary approvals by Town of Brookhaven Division of Fire Prevention, Town of Brookhaven Division of Public Safety and Suffolk County Police Department.

11. No fee shall be charged for drive-in movie theater applications. 12. The Host/ Applicant is permitted one (1) advertisement sign per street frontage not to exceed thirty-two (32) square feet in area and shall not be placed in the Town’s right of way or in a location that will obstruct or impair vision or traffic in any manner or create a hazard or disturbance to the health and welfare of the public. 13. The Host/ Applicant is responsible for maintaining the events/parcels free of trash and other debris and provide trash receptacles in accordance with Chapter 49, Property Maintenance, code of the Town of Brookhaven. 14. All paved areas, including but not limited to parking spaces, must conform with Chapter 49, Property Maintenance, code of the Town of Brookhaven, in order to afford safe passage for pedestrian and motor vehicle traffic in order to prevent hazards to public health, safety and welfare. 15. Outside loudspeakers, if utilized, must comply with all provisions set forth in Brookhaven Town Code Chapter 50. 16. The Host/Applicant must submit a public liability insurance certificate of limits not less than one million ($1,000,000) dollars naming the Town of Brookhaven as an additional insured, which shall not be cancelled without fifteen (15) days notice to the Town Clerk. 17. Any approval to utilize a site as a drive-in movie theater shall not negate or permit any violation which may exist on the subject premises at the time of approval of such accommodation. 18.
