Suffolk County 4th District Legislator Tom Muratore passed away on September 9. He was 75. Muratore had a lengthy resume of public service that included a 34 year career in law enforcement. He served in the Suffolk County Police Department, including 18 years as Vice President of the Suffolk County Police Benevolent Association. In 2002, at age 56, Muratore graduated New York Institute of Technology, earning a Bachelor of Science Degree in Hospitality Management. He was an alumnus of Central Islip High School's Class of 1963.
Muratore was first elected in 2009 to serve Suffolk County's 4th Legislative District which covers the heartland of Suffolk's real estate that includes the communities of Centereach, Farmingville, Medford, Lake Grove, Selden, Lake Ronkonkoma, Port Jefferson Station, Coram, Holtsville, Holbrook, and the Brookhaven Town portion

Nick Caracappa Selected to Run in Special Election for 4th County Legislative District Against Joseph Turdik
Nick Caracappa, a Conservative and Union President for the Suffolk County Water Authority Utilities Workers Union of America 393, was selected last week to run as the Republican, Conservative and Independence candidate for Suffolk County’s 4th Legislative District special election. Caracappa, 53, is continuing the family tradition of service. He is son of former Legislator and Deputy Presiding Officer Rose Caracappa and the brother of former Legislator and Presiding Officer Joseph Caracappa. If elected, his family will become the first family in history to have three different family members serve as a member of the County Legislature. Besides his governmental work and family history, Nick Caracappa is married to his wife Bonnie and are the proud parents of four children, Joseph, William, Rosine and Julianna. Nick has been active in many community organizations including serving as a trustee in the Selden School District, the Selden Civic Association and the
Selden Little League. The issues Nick’s campaign is focused on include the Suffolk County budget and increasing revenue streams while maintaining services, protecting water quality and supporting key infrastructure projects like the Ronkonkoma Hub as well as supporting law enforcement. Nick opposes both cutting law enforcement funding and raising taxes. To challenge Caracappa, the Democrats have nominated Selden resident Joseph Turdik a Navy Veteran, Suffolk County Board of Elections trainer and Executive Vice Chair of the Brookhaven Town Democrat Commitee. Joe is married to his wife Diane and have two children, Jade & Joe. Suffolk County Democrat Chairman Rich Schaffer stated, “Joe has been a strong force in helping to elect our Democratic candidates at all level of government. Participants in the scheme would allegedly create synthetic identities by associating a stolen Social Security number with a different name, address and date of birth. The stolen Social Security numbers belonged to individuals with no existing credit history or those who were unlikely to be monitoring their credit history, such as children, recent immigrants, deceased individuals, elderly individuals, and incarcerated individuals.
The defendants allegedly took steps to then make the synthetic identities appear legitimate, including applying for phone accounts, e-mail accounts, rewards card accounts, library cards, and other accounts with minimal verification requirements. One of the perpetrators of this scheme would also allegedly insert the synthetic identities into public databases that are used by financial institutions to verify identity information in order to further legitimize the synthetic identities. The co-conspirators then allegedly took numerous steps to fraudulently build credit for the synthetic identities, including adding the synthetic identities as authorized users on an existing individual’s credit card. In furtherance of the scheme, Adam D. Arena, 43, of California, is alleged to have created shell corporations that then falsely reported the synthetic identities to the credit reporting agencies as though they were customers of the corporations, thus providing the synthetic identities with corporate tradelines that further boosted their credit ratings. Arena is alleged to have fraudulently backdated the information to make it appear as though the synthetic identities had good credit histories over the course of several years. Once the synthetic identities accumulated positive credit reports, participants in the scheme are alleged to have fraudulently obtained loans and credit card accounts from financial institutions using those synthetic identities. The financial institutions listed in the indictment as being defrauded by perpetrators of the scheme include Sheffield Financial, Bethpage Federal Credit Union, State Farm Bank, USAA Bank, Key Bank, Navy Federal Credit Union, Pentagon Federal Credit Union, Nassau Financial Federal Credit Union, Synchrony Bank, Peoples Alliance Federal Credit Union, Members 1st Federal Credit Union, AmeriCU Credit Union, Webster Bank, Santander Bank, First National Bank of Omaha, Suffolk Federal Credit Union, Roadrunner Financial Inc., Teachers Federal Credit Union and Nassau Educators Federal Credit Union. The accounts were allegedly used by several of the defendants to the maximum amount allowed and then the balances on the accounts were never paid, a scheme commonly known as a credit “bust out.” District Attorney Sini and Commissioner Hart urge residents to periodically check their children’s credit reports in addition to their own for any suspected fraudulent activity by visiting www.AnnualCreditReport.com. Any residents who find that their personal identification information is being used without their knowledge or permission should freeze their credit files immediately by contacting the three major credit bureaus (Equifax, Experian and TransUnion) and
call the Suffolk County Police Department’s Financial Crimes Unit at 631-852-6821. DEFENDANTS:
Adam D. Arena, 43, of Corona, California is charged with seven counts of Grand Larceny in the Second Degree, a C felony; eight counts of Grand Larceny in the Third Degree, a D felony; Criminal Possession of a Forged Instrument in the Second Degree, a D felony; four counts of Money Laundering in the Fourth Degree, an E felony; Scheme to Defraud in the First Degree, an E felony; and Conspiracy in the Fifth Degree, an A misdemeanor. Arena is alleged to have opened shell corporations and sold corporate tradelines to improve the credit profile score of the synthetic identities in this scheme. According to the indictment, the following corporations, which are owned by Arena, are charged as acting in concert with Arena to allegedly commit money laundering: GFS Auto Sales LLC is charged with two counts of Money Laundering in the Fourth Degree, an E felony. SBC Software LLC is charged with Money Laundering in the Fourth Degree, an E felony. ADA Auto Group is charged with Money Laundering in the Fourth Degree, an E felony. The following defendants are alleged to have furthered the scheme by obtaining loans and/or opening credit card accounts at numerous financial institutions using synthetic identities and by presenting forged identification documents and falsifying account applications: Charissa Baerga, 30, of Elmont, is charged with Grand Larceny in the Third Degree, a D felony; Falsifying Business Records in the First Degree, an E felony; and Conspiracy in the Fifth Degree, an A misdemeanor. David Bouey, 60, of Shirley, is charged with Grand Larceny in the Third Degree, a D felony; Criminal Possession of a Forged Instrument in the Second Degree, a D felony; two counts of Falsifying Business Records in the First Degree, an E felony; and Conspiracy in the Fifth Degree, an A misdemeanor. Daniel Delmoral, 55, of North Babylon, is charged with six counts of Grand Larceny in the Third Degree, a D felony; 10 counts of Criminal Possession of a Forged Instrument in the Second Degree, a D felony; 10 counts of Falsifying Business Records in the First Degree, an E felony; Scheme to Defraud in the First Degree, an E felony; and Conspiracy in the Fifth Degree, an A misdemeanor. Two remaining co-defendants are currently out of custody and are being actively pursued by law enforcement. If convicted of the top count, Arena and Morris each face a maximum sentence of five to 15 years in prison. If convicted of the top count, Baerga, Bouey, Delmoral, Evans, Osredkar, Pagan, Rivera, Smith, and Schellas each face a maximum sentence of two and one-third to seven years in prison. This case is being prosecuted by Assistant District Attorney Jessica Lightstone, of the Financial Investigations & Money Laundering Bureau. A criminal charge is merely an accusation and the defendant is presumed innocent until and unless proven guilty.

Golf Artist, Elaine Faith Thompson Unveils Kennedy Painting
Local golf artist, Elaine Faith Thompson will be unveiling her painting of John Fitzgerald Kennedy on Saturday, October 3, 2020 at the Pilot Club of Sayville Fundraiser Craft and Activity Fair. The unveiling will take place at 218 Oakwood Avenue in Bayport, NY at 11 AM. The Fair is being held October 3 and 4 from 10 AM to 4 PM. Masks and social distancing are required by all who attend. Thompson was inspired to paint JFK when she visited the John F. Kennedy Library, in Boston, Massachusetts. When she saw his little blue sailboat on display she decided
that a painting of him on it, would make a great painting. Over the past two years, Thompson accumulated a collection of photos of Kennedy for reference material. Last summer, Thompson found out that her two children, by her late husband Richard Polizzi, are directly related to the Fitzgeralds, JFK’s mother’s family. When the painting was completed, her son Richard walked into her studio to view it. To her amazement, her son strongly resembles Kennedy in the eyes and the nose. On another note, Thompson was delighted that one of her favorite professional golfers, Bryson DeShambeau won the 2020 U.S. Open at Winged Foot, NY this past Sunday. Thompson met with DeShambeau at the Shinnecock U.S. Open in 2018 and he purchased her commissioned limited edition fine art print. Last year she painted the commemorative poster for the PGA at Bethpage. The little boy in the painting, is her grandson and is now training to become an Army Ranger. In 2006, Thompson was commissioned to paint the Winged Foot poster.
In 2010, SUNY Farmingdale College President Hubert Keen presented Thompson, with the “Outstanding Alumnus of the Year Award”, for her 2009 U.S. Open Bethpage poster. She graduated from the college with a degree in art. She hand-paints the buildings, landscapes, trophies, logos, and lettering from skills she learned at the college. One reporter called her style of art “Rockwellism”. Her lighthouses, pet portraits and paintings of presidents including George Washington at Valley Forge and Theodore Roosevelt at Sagamore Hill have become very popular.

Superintendent Losquadro, Councilman Foley Announce $570,000 Resurfacing of Ronkonkoma Avenue Brookhaven Town Highway Superintendent Daniel P. Losquadro and Councilman Neil Foley have announced the resurfacing of Ronkonkoma Avenue from Portion Road to the North Service Road of the Long Island Expressway, as well as a portion of Carlson Street from Ronkonkoma Avenue to Willis Avenue.

Prior to the resurfacing of the roadways, crews removed and replaced 2,582 linear feet of concrete curb, 6,240 square feet of concrete sidewalk, and nearly 2,950 square feet of concrete aprons at a cost of $242,077. Coupled with the cost of milling and paving — $328,116 — the total cost for this paving project was approximately $570,193.
Superintendent Losquadro said, “Ronkonkoma Avenue is a heavily-traveled, main thoroughfare that was in need of repair. I am very happy with the progress we are making improving infrastructure across Brookhaven Town during our 2020 paving season.” Councilman Foley said, “Thanks to Superintendent Losquadro and the men and women of the Highway Department, paving is moving ahead at a very good pace across Brookhaven Town. Now that school is back in session, it’s very important that our roads are made as safe as they can be for motorists, walkers and bike riders.”
Town Demolishes Vacant House on Washington Drive in Mastic Beach for Open Space Preservation Farmingville, NY – On September 21, Councilman Dan Panico (left) and County Legislator Rudy Sunderman (right) were on-hand for the demolition of a vacant house located at 216 Washington Drive in Mastic Beach. The property, which is located within the Mastic/Shirley Conservation Area, was seized by Suffolk County as a property tax forfeiture, transferred to the Town for demolition and will be preserved as open space. A local law to preserve open space in the Mastic/Shirley Conservation Area was sponsored by Legislator Sunderman and adopted by the Suffolk County Legislature earlier this year. It protects flood prone areas against future flooding and storm damage by creating more open space within the designated conservation zone. Councilman Panico said, “We will continue to clean up our communities until there are no more homes to be demolished.”

William Floyd Schools Reopen After Covid Case Cleared William Floyd schools reopened last week after a COVID-19 scare involving a middle school student moved the district to shut them down. Relying on guidance from the Suffolk County Department of Health, the middle school and the Nathaniel Woodhull Elementary School were cleared to re-open on Thursday. The student will not return to school until cleared by the health department and contract tracing has been completed, according to the district. Anyone deemed at risk from exposure has been notified by the Department of Health and will follow their directions regarding quarantine and/or testing. “Please know that we will continue to diligently deep clean and sanitize all of our buildings each night after in-person learning,” the district said in a statement. “For those who use district transportation, buses are also cleaned after every morning and afternoon route by our transportation companies. As we enter cold and flu season, it is imperative to continue to take all necessary precautions such as staying home when sick, coughing/sneezing into the crook of your elbow, washing your hands frequently, staying socially distant and wearing a mask.” The district learned that the student tested positive for the virus on the evening of the 21st. The department of health contacted the student’s family and immediately began contact tracing. The student has a sibling attending Nathaniel Woodhull who did not test positive. “As a result, and out of an abundance of caution,” both William Floyd Middle School and Nathaniel Woodhull Elementary School moved to all virtual learning for the 22nd. All other buildings remained open to in-person learning. Since Wednesday the 23rd was a regularly scheduled all-virtual learning day, the district used the two days for a thorough cleansing and disinfecting of these buildings. “We will continue to work collaboratively with the Suffolk County Department of Health and keep you updated and informed every step of the way. Thank you and please stay safe.”

The reopening comes at a time when the district was challenged by student Maverick Stow who started a campaign to force the schools to be open five days a week. The senior was arrested for coming to class on what were designated off days and then suspended for the rest of the school year. “Anyone who believes that education is valuable should want students to be in school five days a week, with extracurricular and sports activities to go along with it,” Stow said. “Anyone who feels as strongly as I do about this should participate and make it so the administration can’t ignore it any longer. I have made it very clear that I think all kids should be able to go to school—and go five days a week.”

State, Local Law Enforcement Lines Up Behind Palumbo For State Senate Campaign
Assemblyman Anthony Palumbo today announced a coalition of 23 New York police unions, representing more than 200,000 law enforcement officers, is backing his campaign for New York State Senate. State Senate candidate Alexis Weik recently toured areas of Mastic Beach that are still prone to flooding eight years after Superstorm Sandy left a swath of destruction across the Tri-Hamlets and South Shore communities. Weik was joined by Mastic Beach’s Fire Commissioner and former Mayor, Bill Biondi, who described for her the storm’s impact and lingering effects. Earlier, Weik discussed flood mitigation efforts with community leaders at a Suffolk County Department of Planning’s meeting to redraw maps of the Mastic Shirley Conservation Area. “Mastic Beach and the TriHamlets were hit especially
hard by Sandy and they are still awaiting the help they need to prevent another catastrophe from future storms,” Weik said. “I am grateful to Mayor Biondi and all the ‘boots on the ground’ who helped the community recover from that storm, and for their continued advocacy to protect the community in the future. I pledge, as Senator, that I will work with TriHamlet community leaders to secure the resources they were promised and the funding they need to make permanent improvements to safeguard the homes, businesses and people of the community.” Weik, the Republican and Conservative candidate for the Third Senate District, has spent considerable time in
the Tri-Hamlets over the past few months, getting to know voters and community leaders, listening to their concerns and outlining her ideas for lower taxes and safer communities. OBITUARY SEBASTIANA CIATTO, 89, of Mastic, died peacefully at her residence on September 24, 2020. She was born in Italy and was a seamstress by trade. She was an accomplished cook and baker who was known for her incredible cookies. Sebastiana loved to feed and entertain people. Her greatest joy was to be surrounded by family and friends. She was a member of the senior club. She is survived by her loving son Giuseppe (Cindy). Her beloved son Nunzio predeceased her. She was the cherished grandmother to Liana, Frank, Tanya, Steve, Joe and Danny and adored great grandmother to Cayden, Joey, Jocelyn, Dakota, and Benjamin. She was the loving companion to Vincenzo Romano. Family and friends will be received at Roma Funeral Home in Shirley on Sunday from 2-4:00 pm and 7-9:00 pm. A Mass will be offered on Monday at St. Jude’s RC Church, Mastic Beach, at 10:00 am. Interment will take place at Holy Sepulchre Cemetery, Coram, NY.

As we make our way through life, we often see trends and familiar consistencies which make up our memories, sights, sounds, smells, and tastes. Our senses conjure up past events, some happy and some sad, yet, these are unique to each one of us. Our personality, our lives, are formed by the compilation of all these stored memories. One of my fondest memories was learning how to sew from my grandmother. She came to this country from Italy with nothing but the knowledge of how to sew. She would say, “Bella, if you can sew you will never go hungry”. On September 24, 2020, Sebastiana Ciatto, a talented seamstress, left our world to journey to heaven. During her life she threaded the yarn of mending hearts and embroidered a beautiful tapestry of love, family, and friendship. Much like my grandmother, Sebastiana came to this country from her beloved Italy with a trade that helped her throughout her life; she was a seamstress. She used her skill to help people, to create friendships and supplement the family income, but she also sewed a life filled with the richness of love and sharing. She loved to cook and bake. When you feed people you not only nourish their body but you bring them the hospitality of your home. You share your stories, your history, your memories and in the process, you become part of other people’s memories. Sebastiana was a loving wife, mother, grandmother, and great grandmother. She was a friend. She was a woman who suffered the loss of her husband and her son, but she never failed to find room in her broken heart for the rest of her family and friends. She will be forever the key piece in the tapestry of her family and will be missed by her loving son Giuseppe, her daughter-in-law Cindy, her cherished grandchildren Liana, Frank, Tanya, Steve, Joe and Danny and adored great grandchildren Cayden, Joey, Jocelyn, Dakota, and Benjamin. National Grid’s Push to Send Fracked Gas to Suffolk
Despite New York State’s Climate Leadership and Community Protection Act passed last year that sets a goal of 70 percent renewable energy in the state by 2030, and the state ban in 2014 on the environmentally polluting process of fracking in New York, National Grid is moving ahead with a major expansion of the transport and distribution of fracked gas—with Suffolk and Nassau Counties primary repositories.

National Grid, a British company which acquired Keyspan for $7.3 billion in 2006 and is the monopoly gas utility on Long Island, claims the expansion of pipelines, compressed fracked gas sites and other facilities for bringing fracked gas here is necessary because of a “gas shortage.” Six of the eight projects involving fracked gas that National Grid is seeking to have the state Department of Public Service to give its OK to are in Suffolk and Nassau—three in Suffolk, three in Nassau. And, the company is seeking state approval for nearly $1 billion in rate hikes to pay for its new gas proposals.
As public and governmental opposition to this $1 billion project mounted, National Grid threatened a “moratorium” on new gas hook-ups despite reports showing there was no “gas shortage” as claimed by the company to justify the Williams Pipeline. Governor Andrew Cuomo stood up to National Grid calling for a state probe of the “moratorium.” Meanwhile, there was intense grassroots action including demonstrations. The state Department of Environmental Conservation denied a water quality permit needed for the pipeline and also cited the Climate Act, and earlier this year the fight was won.
“The National Grid claim of a ‘gas shortage’ is false,” declares Kim Fraczek, director of the Sane Energy Project, a leader in the recently successful battle against the Williams Pipeline. “What National Grid is trying to do now,” says Ms. Fraczek, “is expand

City-based organization describes itself on its website—https://www.saneenergy. org/—as “committed to replacing fracked gas infrastructure with communityled, sustainable energy. We oppose the development, transport and export of fracked gas—’natural gas’—in favor of an urgent and just transition to a renewable economy with the goal of zero fossil fuel or nuclear dependence.” Fracking is a huge environmental and health threat. Some 600 chemicals—many of them cancer-causing—and massive amounts of water under pressure are sent underground to break apart shale formations and release gas and oil. There are constant leaks from the piping bringing the petroleum up causing groundwater to become contaminated by it and the chemicals. A landmark TV documentary on this was Gasland, nominated for an Academy Award in 2011. It and its sequel, Gasland Part II, both directed and reported by Josh Fox, include numerous scenes of homeowners turning on their water faucets, setting a match to what is coming out—with the result: the mix of water and gas bursting into flames. Many people interviewed had become seriously ill. The three fracked gas projects National Grid wants to build in Suffolk are an

Republicans in Washington DC believe the post office must change with the times and technology. That the post office should break even and pay for itself.

Ms. Fraczek says what’s especially “heinous” about the National Grid move is that New York passed the Climate Act to reduce “the use of fossil fuels—like gas—and have energy based on sources that don’t contribute to climate change. But National Grid is pushing in the other direction for its profit. There are many alternatives to gas including energy efficiency retrofits, air source heat pumps that can be installed in homes, solar thermal systems and geothermal systems Maybe we should just do away with this corporate shareholder model and push for New Yorkers to own our own power grid and cut out the expensive middle-man.” Because of the climate crisis, she says, “California is burning, the Gulf Coast is flooded by hurricanes one after another, and Long Island, a waterfront community surrounded on all sides by rising water stands to be threatened. We want to make sure all the nature and beauty of Long Island is not underwater because of decisions favoring fossil fuel giants over the future.”

Flight 800: Part Four
BY ROBERT CHARTUK Many along the coast that tragic evening said they saw a streak of light like a missile rise up into the sky and shoot down TWA Flight 800. Conspiracy theories abounded. One was terrorists shot down the plane and another had the U.S. Navy, which was conducting exercises in the area, send it to its doom. The crash was investigated as a crime and the FBI, among all of the government assets involved in the recovery operation, became the lead agency. Daily briefings took on an urgency to get to the bottom of what caused the 747 to fall from the sky in flames. The NOAA ship Rude crisscrossed miles of ocean and located almost every last piece of the downed aircraft and then dive teams spent almost a year in 120 feet of water to recover them. Huge salvage ships from the Navy, the Grapple and the Grasp, were on the scene and the wreckage was brought to an empty airplane hanger at the old Grumman plant in Calverton. Experts painstakingly put the Boeing plane back together piece by piece like a giant jig saw puzzle. Eventually, the FBI determined that the crash was not due to
terrorist activity and the National Transportation Safety Board took the lead in trying to figure out what went wrong. Four years after the catastrophe, the government agency announced its findings in a report that exonerated the Navy. The official explanation focused on the plane’s center fuel tank which was only partially filled since the flight from New York to Paris did not necessitate a full load. A spark from a malfunctioning gage ignited the volatile air/fuel mixture in the near empty-tank causing it to explode, concluded the NTSB. Lending credence to the explanation, they said, was the captain, recorded on the plane’s black box 10 minutes into the flight, voicing concerns over “a crazy fuel flow indicator on number four.” The reports of a missile rising into the summer sky was explained

Drowning – Shocking!

In the past, when we have written about “Man Overboard”, and about whether you need a life-jacket or not, the main thrust was all about safety of life at sea. But there is a little-known fact that you can drown right at the marina – in the most shocking way! It is called “ESD” – Electric Shock Drowning. Most mariners are not aware that such a danger even exists other than in the most blatant way. If there were an electrical cable thrashing about from a downed power wire, well, it is pretty obvious that whether that happens at the dock or in front of your house, this is a major danger. If it happens to knock you off the dock as it paralyzes you, you’re going to drown. But how about a charge as low 10 milliamps (.010 A)?
Boatyards, it will be cold comfort for you if you reach into the water to retrieve your cap and your muscular system is shocked into paralysis. The amount of electricity entering the body can be so small that often the postmortem doesn’t catch that stray current was the cause of death. “Poor Charlie reached in for his skipper’s cap and just kept going! Sources of Stray Currents at the Dock
There are two sources of stray current at the marina – faulty marina wiring and faulty wiring on your boat. At the marina, if there is a non-functioning grounding system, or an improper grounding of the neutral-white power conductor or just unapproved wiring near the water, there can easily be a charge snaking through the waters of the marina. Although these are all violations of the National Fire Protection Association’s PFPA 303 Fire Protection Standard for Marinas and

How Gifting Affects Medicaid Eligibility
My husband and I drafted Irrevocable Trusts a few years ago in case we ever need Medicaid long term care. Is it okay that we still gift each of our two children $15,000 per year with money we have outside our trusts?
No, you cannot continue to make gifts to your children if you are doing Medicaid planning. The gifting rules for Medicaid are not the same as the IRS gifting regulations. The IRS allows a person to give up to $15,000.00 per person annually without penalty. Oftentimes, seniors and their children erroneously believe that this same exemption holds true for Medicaid eligibility, and that gifting this amount of money away annually will not affect them should they need to apply for Medicaid benefits in the future.
Medicaid requires that all Medicaid applicants account for all gifts and transfers made in the five years prior to applying for Chronic Medicaid. These gifts are totaled, and for each approximately $13,407.00 that was gifted, one month of Medicaid ineligibility is imposed. It is also important to note that the ineligibility begins to run on the day that the applicant enters the nursing home rather than on the day that the gift was made. For example, if you annually gift your children $15,000.00 per year for three years, that amounts to $90,000.00. Under the IRS code,
no gift tax return would need to be filed and no tax would be owed because the federal gift and estate tax exemption is currently $11.58 million. But, if at the end of those three years you or your husband needed Medicaid, those gifts would be considered transfers “not for value” and make you ineligible for Medicaid benefits for approximately seven months. In other words, you would need to privately pay for the nursing home care for the first 7 months before Medicaid would kick in and contribute to the cost of care. The amount the individual would pay on a monthly basis would depend on the private monthly cost
of care at the nursing facility. If the nursing facility cost $17,000.00 per month, the individual would need to pay that amount for sevenmonths totaling approximately $113,900.00. What makes this even more difficult is if your children spent the money and are unable to give the money back.
This can immediately qualify the institutionalized spouse for Chronic Medicaid benefits to pay for the nursing facility. It is important to realize this does not exempt the 5-year lookback. Sinai Meadows, LLC for a change of zone from J Business 2 to Planned Development District (PDD) (including J Business 2 and MultiFamily Residence) and amendment of restrictive covenants, on property located at NYS Route 25A, Mt. Sinai, New York, further identified by SCTM Nos. 0200-139000600-003000-006000; 0200-14000-0400-002001, 003000-016000; 020016200-0500-008000, 018000-032000; 020016300-0100-001000033000; 0200-16300-0200001000-014000, 015001, 015002 and 016000028000 comprising approximately 30.2 acres; and WHEREAS, after due consideration and deliberation; RESOLVED by the Town Board of the Town of Brookhaven that the above application for a change of zone from J Business 2 to Planned Development District (PDD) (including J Business 2 and MultiFamily Residence) and amendment of restrictive covenants is hereby approved subject to the following: 1. That the covenants and restrictions contained in the Declaration of Covenants and Restrictions, adopted by the Town Board on
December 11, 2011, and filed in the Suffolk County Clerk’s Office on January 18, 2017 under Liber D00012896, Page 803, relating to a change of zone application known as Mount Sinai Industrial, LLC (Log Number 2010005-CZ) are hereby repealed in their entirety. Conditions 1. The applicant must submit proof to the satisfaction of the Town Attorney’s Office that the covenants and restrictions, approved as to form and substance, referenced below have been filed with the Suffolk County Clerk’s Office. 2. The applicant shall provide a final Mount Sinai Meadows Master Plan document that shall consist of the following documents combined to eliminate duplication: a. The Mount Sinai Meadows Master Plan & Guidelines. b. The Land Use and Development Plan. c.The Phasing Plan. d. A copy of the resolution of adoption. Covenants and Restrictions 1. All development shall be in general conformance with The Mount Sinai Meadows Master Plan. Development of The Mount Sinai Meadows shall also comply with the following requirements and guidelines: a. General Master Plan Requirements and Guidelines: i. Zones: 1. J-2 Commercial/Town Center Business District. 2. J-4 Commercial/Office Business District. 3. MF Residential/Village Residential District. b. The Planning Board shall have the authority during site plan review to amend or modify the master plan as necessary to bring the master plan into conformance with the requirements of this grant and in keeping with the general design and site layout as set forth herein and consistent with the Draft Supplemental Environmental Impact Study (DSEIS) and Findings Statement. c. Master Plan Development:
All future development shall conform to Master Plan development guidelines including the relationship between building facades and the public realm, the form and mass of buildings in relation to one another, and the scale and types of streets and blocks. 2. The configuration and layout of the proposed site development shall be situated along boulevardstyle roadways featuring ornamental landscaping, fountain, pedestrian lighting, benches and bike lanes anchored by a central civic square clock tower landscaped theme, subject to Planning Board review and determination at the time of site plan and consistent with the Design Standards listed below. 3. The subject property shall be developed as one common unified development (regardless of tax map parcels) and shall have a consistent architectural theme for the multiple buildings proposed for the property, subject to Planning Board review and determination at the time of site plan and consistent with the Draft S u p p l e m e n t a l Environmental Impact Study (DSEIS) and Findings Statement. 4. At the time of site plan review, the applicant/owner shall submit and agree to a perpetual future cross access easement agreement to the commercial properties to the west (0200 162000500003002) and north (0200 139000600001000 & 0200139000600002000), which agreement shall be subject and to the approval of the Department of Law. Upon execution by all parties, said agreement shall be filed as a covenant in the Office of the Suffolk County Clerk. 5. At time of the Chief Building Inspector issuing a Certificate of Occupancy for the 100th residential unit, the applicant/owner shall provide a $810,000
contribution to the Mount Sinai Community Improvement Fund, established by Resolution 2011-1000. The Mount Sinai Community Improvement Fund shall be utilized for, but not limited to, the following public improvements: a. Approximately $310,000 towards improvements to the Town of Brookhaven Heritage Park. b. Approximately $430,000 towards improvements to the Town of Brookhaven Cedar Beach Park and Mount Sinai Marine Stewardship Center. c. Approximately $100,000 towards New York State Route 25A Street Improvements such as or as may identified by the Route 25A Mount Sinai to Wading River Land Use Plan: general streetscape improvements, Heritage Park with Rose Caracappa Center pedestrian crosswalk link, pedestrian count-down timer at Rose Caracappa Center, pedestrian entrance from north-side of Heritage Park to Rose Caracappa Center and driver speed feedback sign. The applicant may elect to construct the New York State Route 25A Street Improvements in lieu of the contribution provided that improvements are substantially completed prior to the Chief Building Inspector’s issuance of Certificate of Occupancy for the second phase of the Master Plan. d. In the event that there are funds remaining from any of the above improvements, the balance in the Mount Sinai Community Fund shall be used for other public improvements projects within the Mount Sinai community. 6. Prior to final site plan sign off, the applicant shall redeem 9.65 Pine Barrens Credits. 7.Development and Design Standards: a. J Business 2 Business/Town Center Business District. i . The Planning Board hereby specifically is authorized to increase the maximum permitted office densities in order to permit this mixed-use development type, provided such increases are in compliance with the Phasing and Supplemental EIS thresholds established herein. b. J Business 4/ Community Office District. i. Approximately 43,000 SF GFA office/flex area with suitable development standards as outlined herein. 1. A natural and/or naturally revegetated, indigenous buffer of not less than one hundred and fifty (150) feet shall be required along the south and west property lines abutting residentially zoned or used properties, with the exception of the walking trails required herein and the following areas (as shown on the Master Plan prepared by
Hawkins, Webb Jaeger last dated 1/31/18): 1. The width of the buffer adjoining Hancock Avenue shall be 130 feet; and 2. The width of the westerly property boundary buffer at the most northern extent along SCTM parcel 16500 0500 017004, may be reduced below the 150’ for stormwater retention, subject to Planning Board approval at the time of site plan review. e. Public Space Standards. i. As part of the site plan and subject to final Planning Board determination, the applicant/owner shall provide the following onsite Public Space Standards: 1. Public plaza. 2. Walking trail around property. ii. Sidewalks shall be provided along both sides of the main boulevard access road, for the entire length, and throughout the project to inter-connect all uses within the development. The applicant/ owner/ developer shall implement appropriate pedestrian crossings and crosswalks within the site as approved by the Town. Crosswalks shall consist of decorative paving materials where appropriate and as determined by the Planning Board and should have curb extensions or bulb-outs where applicable to minimize crossing distances. iii. Pedestrian friendly streetscape shall be provided throughout the internal roadway network including: sidewalks, consisting of decorative paving material where appropriate and low-level decorative street lights. iv. Street Furniture and amenities including, but not limited to, benches, street planters, hanging flowers/plants, waste receptacles, community signs/bulletin boards or information kiosks, bollards and bicycle racks shall be provided subject to the determination of the Planning Board at the time of site plan review. v.The Planning Board is authorized and encouraged
to reduce internal street widths to promote a pedestrian friendly environment, reduce impervious surfaces and reduce stormwater runoff. vi. The Planning Board may require decorative bus shelters within the Village Residential District area for school children. vii. On street parking shall be permitted and encouraged along the main boulevard access road and internally throughout the property as appropriate. A clear zone shall be provided at intersections to maintain adequate sight lines for all users. f. Off Street Parking Standards. i. The Planning Board is authorized and encouraged to reduce parking requirements to the greatest extent practical. The Mount Sinai Meadows Master Plan contains parking standards that the Planning Board shall utilize as guidelines as follows: 1. Residential, other - 1 space/unit + 0.5 spaces/ bedroom. 2. Commercial retail - 1 space/150 SF 3. Office - 1 space/200 SF 4. Bank space - 1 space/200 SF 5. Restaurant space - 1 space/100 SF g. Phasing Standards. i. All development shall be in general conformance with The Mount Sinai Meadows Master Plan “Phasing Plan.” At the time of site plan review the applicant may amend the Phasing Plan and the timing, sequencing and the ratio and mix of residential and commercial uses of the proposed development subject to the determination of the Planning Board and consistent with the Draft Supplemental Environmental Impact Study (DSEIS) and Findings Statement. h. Transportation Standards. i. Transportation measures will be required, implemented and completed by the project developer, subject to the determination of the New York State Department
of Transportation (NYSDOT) and the Planning Board at the time of site plan review and approval. A list of preliminary transportation and traffic safety mitigation measures is provided in the Environmental Impact Statement. In addition, the applicant/ owner/developer will be responsible for all required traffic control devices, including, but not limited to, signals, signs, and pavement markings, within the internal roadway network in accordance with approved site plans. i. On-site Drainage and Stormwater Standards. i. The following onsite drainage and storm water measures shall be required, implemented and completed by the applicant/ owner/ developer subject to the determination of the Town of Brookhaven Planning Board. This list is not intended to be inclusive and will be subject to further review and determination by the agencies having jurisdiction. 1. A combination of stormwater retention methods that may include: rain gardens, reflecting pool, ponds, catch basin collection, leaching pools, wet meadows, natural retention and/ or traditional stormwater retention areas, subject to the determination of the Planning Board and demonstration of suitable soils. 2.
