Suffolk County 4th District Legislator Tom Muratore passed away on September 9. He was 75. Muratore had a lengthy resume of public service that included a 34 year career in law enforcement. He served in the Suffolk County Police Department, including 18 years as Vice President of the Suffolk County Police Benevolent Association. In 2002, at age 56, Muratore graduated New York Institute of Technology, earning a Bachelor of Science Degree in Hospitality Management. He was an alumnus of Central Islip High School's Class of 1963.
Muratore was first elected in 2009 to serve Suffolk County's 4th Legislative District which covers the heartland of Suffolk's real estate that includes the communities of Centereach, Farmingville, Medford, Lake Grove, Selden, Lake Ronkonkoma, Port Jefferson Station, Coram, Holtsville, Holbrook, and the Brookhaven Town portion

It took a high school senior to declare that something just isn’t right. It took Maverick Stow to point out the obvious and make a stand.

Union Demand Putting Additional Burden On Long Island’s Oldest Theater Already Struggling to Survive The Gateway Playhouse in Bellport, Long Island’s oldest professional theater, announced this week that they have filed suit against Actor’s Equity Association and the union’s pension and health fund on behalf of the theater and some of its employees, after the fund demanded that Gateway pay $212,014 to the fund while also denying pension and health benefits to some of Gateway’s employees. Gateway’s Executive Artistic Director, Paul Allan says that despite attempts to reach a settlement prior to filing the lawsuit, the union left the theater no alternative, “We did this after exhausting all avenues to resolve our differences. We need to protect the Theater which has been operating for 71 seasons, as well as our employees who are like family members to us. The Union’s unwillingness to compromise comes at a time when we are reeling from the fall from of the COVID-19 pandemic and this allegation could put the future viability of our entire theater operation in jeopardy.” Allan says that due to COVID-19 restrictions, Gateway had to cancel its 2020 summer season and is estimating losses totaling over $800,000 this year “If you add the union demand and operating losses together we are facing a million dollar plus loss which is extremely
difficult – if not impossible – to come back from.” At issue is the union’s allegation that Gateway signed some employees to Actor’s Equity contracts even though the employees, according to Equity, are not vested actors. Gateway strongly denies those allegations and says that Equity happily accepted payments on behalf of these actors for years, if not decades, without raising
any concerns over the eligibility of the employees, “One of the employees has been working at Gateway on a union contract for over 25 years. In other cases, some of the employees who are plaintiffs in the suit have performed at Gateway and many other theaters throughout their entire careers.” Gateway maintains that whatever employment practices they followed during the operation of the theater are
contracts, “Is it really feasible that they could accept payments and review contacts for two and a half decades and now decide that one or more of their members are not eligible? If they prevail with their demands on Gateway, God help other theaters throughout the United States because whatever they are having issues with as far as Gateway, could become a problem at other theaters nationwide. It seems to me that if they want to change the rules in the middle of the game, they should put us and everyone else on notice that moving forward they will not be allowing certain types of contracts. To now make a demand for money, especially given what is going on with the entertainment industry across the country, will put many theaters in financial jeopardy, not just us.” Allan says that up until now Gateway has always had a good relationship with Actor’s Equity Association and hopes that they can continue to work together in the future, “Virtually every Broadway show for the past two decades has had a Gateway Alumnus either performing or working backstage. No one is going to thank Actor’s Equity, even if they prevail, for contributing to the demise of this or other theaters.”
Prior to the suspension, which prohibits the 17-year-old from attending his prom, graduation or other school-related activities, the district had Maverick arrested when he tried to attend class on days when he was told to stay home. He was given a superintendent’s hearing last week and shortly after, was notified of his suspension.
“We have zero tolerance for suspended students or unauthorized people trying to enter our buildings to disrupt the educational process and/or to potentially cause an unsafe environment for our students and staff,” said a district representative. “We do not usually discuss student matters publicly, however, we will do so once again, since he shared his suspension with the media.” According to the school, Maverick will be provided with on-line instruction and, “if he abides by the suspension and is a student in good standing, we will revisit his suspension at the end of the second quarter to determine whether or not he will be permitted to attend in-person classes and have his senior privileges reinstated for the second half of the school year.” The district stressed that “safety and security has been and always

He had a message for his fellow students: “Anyone who believes that education is valuable should want students to be in school five days a week, with extracurricular and sports activities to go along with it. Anyone who feels as strongly as I do about this should participate and make it so the administration can’t ignore it any longer. I think that if people are very passionate about this issue we should collectively, as students and as parents of students, try to affect change. I have made it very clear that I think all kids should be able to go to school — and go five days a week.”

Ahearn has denounced many of Palumbo’s assertions on his opponent’s platform about bail reform and his record, and is calling for the return of the balance of power for two party rule in Albany. “Mr. Palumbo is the only candidate in the race who was an elected official in Albany when bail reform passed,” Ahearn said, adding, “He acknowledged that bail reform was ‘necessary’
but said that the bill went too far. He was ‘ineffective’; in the Assembly advocating for judges to have discretion and it would be ‘naive’ to think he would be any different in the Senate. It takes much more than just a no vote, a one house bill that goes nowhere, and a press conference to complain to make a difference for us in Albany. It will take much more than Senator LaValle’s hat to make Mr. Palumbo effective,” Ahearn said. Not so, asserts Palumbo, who has underscored the “imperative for the mandate and restoration of the balance of power for two party rule” in Albany. Palumbo explained, “For decades, Senator LaValle and the Senate Republican Majority stopped the disastrous policies that we have seen come to fruition like bail reform and the elimination of the STAR rebate check under Democrat rule.” Palumbo continued, “Of course, my opponent, who has never held elected office, wants to run away from these dangerous policies that came from her own party. Quite frankly,” Palumbo added, “Attacking Senator LaValle and me will not change the fact that Ms. Ahearn’s party has embraced the ‘defund police movement’ and is solely responsible for the current state of affairs here in New York.” Candidates will be giving updates on their lists of endorsements as they look ahead to Election Day and the possibility of head to head debates.
Candidates for Assembly Seats Brace as Election Season Approaches Home Stretch By Barbara LaMonica Candidates running for New York State Assembly seats are gearing up for the November 3rd Election Night home stretch after a series of primaries followed by a whirlwind tenacious campaign season. In Assembly District (AD) 1, incumbent Fred Thiele, Jr. is seeking re-election. Thiele, who has a lengthy environmental and fiscal record advocating for land
acquisitions and securing millions of dollars of state education aid, was first elected to the Assembly in 1995 to fill the seat vacated by John Behan. Thiele first entered public office when he was elected to the Suffolk County Legislature in 1987. In 1991 he was elected Supervisor of the Town of Southampton. Thiele will appear on the Democrat and Independence lines of the ballot. Challenging Thiele is Heather Collins of Quogue. Collins, who works for the Suffolk County Board of
Elections. will appear on the Republican and Conservative lines of the ballot. The 1st AD covers the townships of East Hampton, Southampton, Shelter Island and the southeast sector of Brookhaven Township. Two candidates are running for the 2nd Assembly District. and Democrat candidate Laura Jens Smith. Giglio, of Baiting Hollow, is also running on the Conservative and Independence lines of the ballot. She is currently serving as Riverhead Town Councilwoman with a record of protecting east end farmlands, improving public safety, and advocating for downtown revitalization. Jens Smith, who served six years on the MattituckCutchogue School Board and Riverhead Town Supervisor, will also appear on the Working Family Party line of the ballot. The 2nd Assembly District covers the townships of Riverhead, Southold and sections of the Town of Brookhaven. In the 3rd Assembly District, Republican incumbent Joseph DeStefano is seeking re-election. DeStefano will also appear on the Conservative and Independence lines of the ballot. Prior to his election to the State Assembly in 2019, DeStefano was Suffolk County Sheriff’s Public Safety Communications Supervisor and has an extensive volunteer record with Medford Fire Department where he was an active member sine 1980 and subsequently elected to the department’s Board of Fire
Commissioners in 1980. DeStefano is being challenged by Democrat candidate Steven Polgar. A business owner who founded an all-volunteer education charity, Polgar is experienced in insurance and finance. He is the youngest recipient of the President’s Lifetime Achievement Award received from President Barack Obama. A third candidate is vying for the seat. Adam Martin is running on the Libertarian line of the ballot. Fourth District Assemblyman Steve Englebright will appear on the Democrat, Working Family Party and Independence lines of the ballot. Englebright was first elected to the Assembly in 1992 in a special election in which he succeeded Robert J. Gaffney. Prior to his election to the Assembly, Englebright served on the Suffolk County Legislature in 1983 where he served until his election to the Suffolk County Legislature. He is the sole natural scientist serving on the State Legislature with a lengthy environmental record. In February 2015, Englebright was appointed chair of the Assembly Committee on Environmental
Conservation. Challenging Englebright is Republican candidate Michael Ross who also received the Conservative nod and will appear on both lines of the ballot. Ross is a former prosecutor and attorney who is making his inaugural run for public office. Fifth District Assemblyman Doug Smith is running for re-election and will appear on the Republican, Conservative and Independence lines of the ballot. Smith was first elected to the Assembly in an April 24, 2018 special election to fill the unexpired term of Al Graf who vacated the seat to fill a judgeship. Smith was appointed to to the Higher Education Committee, Banks Committee, Aging Committee, Energy Committee and Housing Committee. Democrat challenger Fred Ianacci also received the Working Family Party endorsement. Ianacci is a project manager in architecture and mill work. In a recent interview, Brookhaven Town Republican Chairman Jesse Garcia asserted his GOP candidates will reverse
ASSEMBLYMAN DESTEFANO TO LEAD CAMPAIGN TARGETING ALBANY CORRUPTION The Committee to Reform the State Constitution to target corruption and the payto-play culture in Albany has issued a report of legislators supporting their efforts and Assemblyman Joe DeStefano said he is proud to be one of them. The Anti-Corruption Amendment to the Constitution would replace the state’s weak and politically-controlled ethics boards with a single independent body with broad sanctioning power. “This would provide a real watchdog over Albany and go a long way toward reducing the outrageous taxes and fees we are forced to pay due to government corruption,” Assemblyman DeStefano said. To see just how badly compromised state government really is, you need only look at the convictions of the leaders of both the senate and assembly, as well as one of Gov. Cuomo’s top aides, on corruption charges. “Fighting corruption in state government is one of my top priorities and I will help lead the campaign for the Anti-Corruption Amendment,” DeStefano promised. According to the Committee to Reform the State Constitution, “The cornerstone of the proposal is an enforcement body sufficiently independent to be above political pressure. The
current structure for enforcing the State Code of Ethics is just the opposite. As few as two of the governor’s appointments to the 14-member Joint Commission on Public Ethics (JCOPE) can veto an investigation or adverse determination. A JCOPE commissioner recently resigned because of a breakdown of a rule designed to insulate commissioners from political pressure and JCOPE’s failure to determine accountability for that failure.” In Albany, JCOPE is known as J-Joke. It is an embarrassment to the state and rather than increasing public confidence in government, it actually reduces it. “I believe that establishing independent and effective ethics enforcement is a vital first step to restoring public trust in government and enforcing the principle that no one, not even powerful politicians, are above the law. Real ethics enforcement is our first line of defense against political corruption and an effective way to strengthen the voice of the people by reducing the conflicting power of special interests,” DeStefano said. “I am urging my colleagues, as well as public officials and citizens across the state, to fight for the Constitutional Amendment to bring about real ethics reform in our state. It may be our only hope to clean up Albany and end its abusive payto-play culture.”

Stop for Stopped School Buses: It’s the Law

Like most elected officials, my friend and colleague Legislator Tom Muratore had a few issues that were especially close to his heart. School bus safety was one of them. He was responsible for having April 27 declared as “Operation Safe Stop Day” in Suffolk County to increase awareness of the dangers associated with passing a school bus illegally, and he established an annual school bus safety poster contest for elementary school children. In a heartbreaking loss for the Suffolk County Legislature, Tom passed away on Sept. 8, but his advocacy for bus safety lives on. Back-to-school season is here, and I want to remind everyone of the law when it comes to school buses on the road. Motorists must come to a full stop when approaching a school bus that is stopped with its red lights flashing and stop arm extended. It does not matter whether you are approaching the bus from the front or are behind it – you must stop, even if you are across a divided highway or on school grounds. Flashing lights mean the bus is picking up or dropping off students, who frequently must cross the street to reach their destination. And yet, an estimated 50,000 cars illegally
pass school buses every day in New York, according to the New York Association for Pupil Transportation. I watched it happen recently when I was putting my children
on the bus. As a parent, I can attest to how horrifying it is to see someone’s reckless behavior put your child’s life at risk. School buses transport more than 2.3 million children each day. Over the course of an average school year, children board or exit a school bus approximately 1.65 billion
times. That’s more than a billion accidents waiting to happen if motorists ignore the law rather than waiting for the all-clear. To stop drivers from engaging in this dangerous behavior, some school buses in Suffolk County will soon be fitted with cameras. If a motorist is captured on camera illegally passing a school bus, the car’s registered owner will receive an automatic ticket. The fines will be $250 for the first offense, $275 for a second offense within 18 months, and $300 for any subsequent offenses within 18 months. This school bus photo violation monitoring initiative was made possible through state legislation allowing counties to implement the program with school districts that choose to participate. So far, 22 of the 72 school districts in Suffolk County have signed on and 18 others are expected to opt in this month. The rest of the school districts are still reviewing the program, but we expect them to be on board as well. Districts could be fully outfitted as early as next year. Let us all take the baton from the late Tom Muratore to help protect our most cherished resource – our children. Our message is simple: Protect our children. Stop for stopped school buses.

Important Information For Recently Discharged Veterans Suffolk County Clerk Judith A. Pascale would like to remind all veterans, especially those returning from abroad, to file a copy of their DD-214 (military discharge papers) with the Suffolk County Clerk. “Very often veterans are required to submit DD-214 papers when they apply for certain benefits. By filing their papers with the County Clerk, veterans are assured that a permanent record exists in the event their original DD-214 is misplaced, destroyed or needed by their family,” commented Suffolk County Clerk Pascale. At the time of filing, a copy of the original must be presented along with a current mailing address. The County Clerk’s office will return the original; issue a convenient identification card and two certified copies free of charge to the veteran. Additionally, all filed discharge papers are sealed from public view, but available to the veteran and his/her next of kin. A DD214 can be filed at any time after separation from the armed forces. In Suffolk County, veterans may be eligible for numerous service related programs. Most notably is a reduction in their county, and sometimes town property taxes based on the type of service they rendered to their country in wartime. Additionally, a DD-214 is required and must be submitted for other programs including Social Security benefits, Veterans Administration services, Civil Service testing, and replacement medals. OBITUARY HOWARD LEE KNAPP, 77, a longtime resident of Shirley, died at his residence on September 16, 2020. Howard was born in Brooklyn and served honorably in the United States Air Force. He was a supervisor at Lourdes Industries in Hauppauge. He was the beloved husband of fifty years to Miriam, loving father to Keith (Lori) and Craig and adored grandfather of Joseph, Jonathan, and Mikayla. Family and friends will be received at Roma Funeral Home in Shirley on Wednesday from 3:00 to 8:00 p.m.
Mr. Fixer By Barbara Guarino Kruk There are countless memories we hold dear as our children ascend the ladder to adulthood. One of my fondest memories involved the neighborhood posse. These were the boys and girls, friends, and schoolmates, who were inseparable. I watched with great pleasure how theses children grew into fine men and women. One of the boys who stood among the group was Craig Knapp. A tall, lanky, intelligent young fellow who evolved into a wonderful man. When the call came that Howard Knapp, Craig’s father, had passed away, all those old memories came flooding back. Howard was a man who cared deeply for his family. A devoted husband to Miriam for fifty years; a good father and fine example to his sons Keith and Craig and a loving grandfather to Joseph, Jonathan, and Mikayla. Howard was a man who gave freely of his time and talents. A patriot who served his country honorably in the United States Air Force. He was a man who others came to for help. He loved people. Everyone knew he could always be counted on to aid and assist others; it was his greatest legacy. As a husband, a parent, a grandparent, and a friend to so many, he will be greatly missed. He loved to fish, walk on the beach, sit by the pool, and go kayaking. He enjoyed classic rock, Hallmark movies and loved animals. On September 16, 2020 a loving heart stopped beating. The man who could fix anything was called to make his repairs from heaven. His greatest fixer was the memory he left of a good man who cared deeply for his family and others; his kindness will live on for many years to come. NOAA has meaningfully pushed up its forecast of named storms by at least 31%, from just 3 months ago. Almost without exception, we get the tail, shoulder or rump of one or two of the dozen or so that form up in the Atlantic between the Caribbean and Africa and bring so much destruction and misery with them as they thunder west and north… and Hurricane season still has months to go. We live on an island. This column is about that. TIDAL SURGES For Islanders, as bad as the winds will be (more on that below), it is the tides and tidal surges that will do most of the damage, which is why even these tails that go by every year leave so much trouble behind. The storm tide is added to the astronomical tides. And when those waves hit something solid, they generate force dozens of times more powerful than wind of the same speed. Andrew generated a storm tide of 17 feet. Camille in 1969? 24 feet. And of course, there was Sandy who just sat there, at high tide. Look, if a Category-4 or -5 gets up here like in 1938, there are no levels of preparedness except evacuation. A storm surge like Camille’s basically means that everything “south of the highway”, as real estate agents like to classify the choicest properties on Long Island, is gone for all intents and purposes. But what if the glancing blow like Ivan’s in 2004 or, Earl, who came by earlier in 2012, came in head-on? How can you be ready? BEFORE THE STORM ARRIVES 1. See standing water? Do you know if any power cables lie in it? 4. Never use candles and other open flames indoors. Keep the flashlight at your side… This is by no means an exhaustive list. What is a Qualified Terminable Interest Property (QTIP) trust and when would I use it?
Qualified Terminable Interest Property trust, commonly known as a QTIP trust for short, is a type of marital trust that offers flexibility in planning for your spouse and remainder beneficiaries upon your death, while also providing estate tax planning if needed. QTIP trusts are popular amongst second marriages because unlike traditional marital trusts which give the spouse broad authority to use trust income and principal in any way they choose during their life, and may even permit the surviving spouse to change the beneficiaries at their death, a QTIP is essentially a means to
provide in some way for the spouse, but ensures that whatever is left at their death is distributed to the first spouse’s chosen beneficiaries.
he provides necessary support for his wife during her lifetime, but ensures that anything remaining goes to his children.
For example, a husband dies and leaves assets to his wife, to whom he has been married for 20 years, in a QTIP trust. He has two children from a previous marriage. The QTIP trust names his wife and his son as Co-Trustees. The Trust gives all the income earned therefrom to his wife, and also allows for principal distributions to her for her health, education, maintenance or support. Whatever is left in the trust at her death shall be distributed to his children. By structuring his estate plan this way,
At a minimum, QTIP trusts must at least give the surviving spouse an income interest for life. They may also provide for principal distributions, such as for health, education, maintenance and support, but are not required to provide the same. At the death of the second spouse, all assets would be distributed to the beneficiaries listed in the original trust agreement or Will. Despite the fact that a QTIP trust may be drafted to provide very little to the surviving spouse, they
can still qualify for the unlimited marital deduction for estate tax purposes if a QTIP election is made on the decedent spouse’s estate tax return. In fact, you can even choose to make the election for certain assets in the QTIP trust, but not others. This allows the fiduciary of the estate to do estate tax planning and maximize both the federal and NY estate tax exemptions. It is important to note that because some QTIP trusts may provide for principal distributions, they are not necessarily protected for Medicaid purposes. Medicaid can be applied for to cover the cost of long term care services not otherwise covered
by Medicare and Secondary or Supplemental Health Insurance. In order to be eligible for Medicaid, an applicant must have limited resources. The Medicaid regulations provide that any trust in which a beneficiary is entitled to principal, other than a validly created Supplemental Needs Trust, is considered an available resource to a Medicaid applicant. “I was there for the bodies,” my friend, Big Daddy, told me. “We were out fishing and right around sunset, saw the whole thing. There was a streak of light like a missile heading up into the sky and then the explosion. There was no sound at first, and then it hit us square in the chest. By then the pieces were falling down in streaks of flames and smoke. We took off after it. It was about nine miles out and when we got there the ocean was on fire from the jet fuel. I was blinded by the smoke and had to find my way through the flames, but I got us into an area where everything was floating. The first body we saw
was a woman who popped up right next to us. I was on the bridge and the guys were pretty reluctant to do anything about it. And then one of ’em, he was in Nam, had no problems handling the dead. He opened up the tuna door and pulled her right in. She was completely naked. It was pretty bad, but we had to do what we had to do. “The next thing we know there’s a lot of shoes floating in the water. We pulled in a mail bag and a backpack with diapers in it. And then we pulled in a pair of shoes with feet in them. That was pretty rough. We got as close to the flames as we could, but it was the fumes that got to us, burned our
eyes and made it hard to breath. For a while, we didn’t find anything else and then suddenly, a couple of bodies popped up like they just broke away from the wreckage. The one thing I’ll never get out of my head was the look on their faces— sheer terror. One guy’s hands were up like he was clenching the seat in front of him; he had the most horrible look on his face. And everyone we pulled in, six altogether, were totally naked, clothes completely blown away. Pretty soon there were rescue boats everywhere pulling in what they could. It was cat-and mouse with the flames and more than once I had to throw her
in reverse and back the hell out of there. There was a guy driving around with a body draped over his gunwales and that just wasn’t right. I yelled at him to get it the hell off of there for Christ’s sake. We could have pulled in more, but the ones we had were starting to bleed out and it was a mess. We didn’t want to start stacking ’em on top of each other, so we headed for shore. “They told us to go to the Coast Guard Station and what a sight that was. Bodies were lined up on the docks like cordwood. Boats unloading and heading back out. Once we pulled into the station, the authorities took over. They
unloaded everything and decontaminated the boat. Then they decontaminated us, sprayed us with bleach, but the problem was they didn’t have any water to rinse us off, so we stood there with the Clorox burning our privates. We decided not to head back out. One thing I’m pretty sure of, the plane was blown from the sky. Terrorists, or maybe it was the Navy doing some kind of exercise in the area and now it’s one big cover up. All’s I know is we saw something streak through the sky toward that plane and then we saw the explosion. It came down in burning pieces. Nobody had a chance.”
