William Floyd Culinary Arts Takes Third

Palumbo To Craft Legislation To Expand Pine Barrens Assemblyman Anthony Palumbo (R,C,I,RefNew Suﬀolk) expressed his excitement about introducing legislation to expand the Long Island Pine Barrens by approximately 800 acres, which will include the Mastic Woods and the lands surrounding the Old Shoreham Nuclear Power Plant. By crafting this legislation, Palumbo hopes to protect the bucolic nature of the Long Island Pine Barrens, protecting the fauna and wildlife that call these areas their home. “This legislation will preserve hundreds of acres of woodland and ensure that all future development is environmentally conscious,” said Palumbo. “With limited habitats for animals on Long Island and the dire need to preserve the Pine Barrens, securing this land is crucial. I appreciate the support and guidance I have received from Brookhaven Town Supervisor Ed Romaine,” said Palumbo. “Ed has been in the forefront of every environmental issue facing Suﬀolk County over the last 30 years covering his career. His knowledge will be instrumental in helping us expand the Pine Barrens for future generations.” “I thank Assemblyman Palumbo and the Brookhaven delegation in the Senate and Assembly for their unanimous support of this state legislation. Expanding the core will assure that these forested areas are preserved as open space and remain accessible to everyone. We cannot allow clear cutting to destroy acres upon acres of woodland that are so important to our environment,” said Brookhaven Town Supervisor Ed Romaine.

A team of William Floyd High School Culinary Arts students traveled to Disney World from April 21-24 to compete in “Cook Around the World,” a competition of 24 teams from across America and around world including Australia, Canada, Denmark, Honduras and Mexico. Despite having a team half the size of every other team in the competition, William Floyd took third place overall in the Dessert category. The trip and participation in this event was entirely funded through various culinary arts fundraisers held over the past year including pie, cookie, cake pop, and chocolate covered strawberry sales, catering functions for various William Floyd Alumni Association events, a cannoli fundraiser with the Foreign Language Honor Society and more. The team, led by Guinness Book World Record ice carver and culinary arts teacher, Rich Daly, and teaching assistant Wendy Waldron, consisted of senior culinary arts students, Zyaire Bias, Crystal Chen, Robert Napadano, Desmond Scott, Dena Sladky and Matthew Towle. In the competition, William Floyd was assigned foods of Asia and was tasked with creating 20 plates of a main item and 20 plates of a side dish. They also had to decorate 20 Asian-inspired cupcakes, all under very strict time constraints. The competition was judged by celebrity chef

Richard Blais, who according to Mr. Daly, was equally impressed by all members of the William Floyd team and commented that Zyaire has “an amazing skillset and shows promise” in reference to his pastry-piping skills. “I am very proud of their performance on this international stage and hope to return to this event next year to continue the success of the Culinary Arts program,” said Mr. Daly.

Why Sanctuary Cities Are Illegal

  A federal judge in the left leaning ninth circuit just put Trump Administration withholding  of funds to sanctuary cities on hold. It was a brutally poor decision, both from a legal and public safety perspective.  Without   question, sanctuary cities are illegal. Here’s why.

US Constitution specifically provides that promulgating laws and rules  The  regarding immigration is exclusively under the domain of the federal government. The judge said the administration could not withhold funds “merely because a   jurisdiction chooses an immigration enforcement policy of which the administration disapproves.”  But a local government cannot choose an immigration policy different from the     superseding Federal policy any more than it could enact a policy on segregation  different from that of the Feds. This concept is clearly enumerated in the Supremacy  clause of the Constitution and via the concept of federal preemption.  But  the federal preemption in this field is not limited to the Constitution; it was fortified by specific  laws enacted by congress to combat the explosion of  illegal immigration after the 1986 Amnesty Act.  In 1996, congress passed the Illegal Immigration    Reform Act (Title 8 of the US Code) which implemented three pertinent provisions.  Section 1324 made it illegal for anyone who “harbors”   or “shields” an illegal alien from being apprehended by federal authorities.  Section 1373 made it illegal for any public official     to order other public employees to refuse to provide information about illegal aliens when requested by federal     authorities.   Section  287 (d) states that when the Feds request that locals hold an illegal alien in custody, the locals SHALL detain that individual for up to 48 hours so the Feds can apprehend them.   Over the past few years, far left civil libertarians, aided by a few political   interventionist judges, have sought to make the case that local authorities have the to defy the Feds by claiming any such cooperation is merely voluntary.   ability Before responding to this, we must consider that there are two ways locals are  establishing sanctuary. The first is where locals refuse to honor the Feds’ demand that the criminal alien  be held for 48 hours until the Feds can take custody of the arrested individual. The other is where locals refuse to even provide information about whether the arrested    criminal is here illegally.     The   former is more complicated, in large part because President Obama muddied     the waters in his second term. In 2008, President Bush issued the Secure Communities  Act, which called for locals to submit the names of all arrestees to be vetted through a federal database to determine if the person is here illegally. The Feds would thereafter  have the discretion to determine whether the person should be apprehended for  possible deportation.  This was working well until Obama, stung by the criticism for not enacting  comprehensive immigration reform, pandered to the left by making confusing  statements, suggesting that locals could now consider their participation voluntary  because the Feds were simply making a “request” for that information.     This is nonsense.  The administration had no ability through a simple declaration to overturn laws  passed by congress, as in section 287, which says any such request, SHALL be abided

Emboldened by this ridiculous and unauthorized reinterpretation of the law, sanctuary city mayors used it as a hook to say they could “voluntarily” decide to ignore federal requests to hold the suspect for the Feds. In other words, they were free to send these suspected violent illegals back onto our street. They also latched onto two decisions in different federal circuits that addressed holding the suspects for 48 hours. Neither was directly on point, since one dealt with a person who was a legal citizen and the other was where the suspect was held past the 48 hour threshold. Nevertheless, civil libertarians claimed these cases were proof the 48 hour holding violated the suspect’s due process rights. Really? If that were the case, locals would never be able to detain violators of state parole, yet this happens every day. Someone picked up by local police for allegedly violating state parole is usually held at the request of state police in county jail so that the state can prosecute. If that’s not a violation, how can holding an illegal alien a mere 48 hours be so. Moreover, some claim they can’t be held without a warrant or probable cause. But how can they ignore that the mere fact that an arrestee flagged by the database as being here illegally, is, in and of itself, probable cause? Butt even if we conceded that the civil libertarians were correct, the locals should be doing all they can to cooperate with the Feds, and should accept an administrative warrant citing probable cause, as opposed to a lengthy judicial warrant Refusing to detain criminal illegal aliens is bad enough, but far worse are the actions of the biggest sanctuary offenders, such as the mayors of Chicago, New York and San Francisco, who have illegally instructed their employees to not share information with the Feds. Such an order is a clear violation of Section 1324, since it is in effect shielding an illegal alien from prosecution, and of Section 1373, which is even more specific in forbidding mayors from issuing such non-cooperation orders. The leftist talking points that sanctuaries cities make us safer is absurd. It’s analogous to the old military adage that we had to burn the village down to save it. Do they actually believe we are stupid enough to accept that we are safer by having violent criminals placed back on our streets? They cite selective statistics of some sanctuary cities such New York, where crime has dropped, but ignore Chicago and LA where it has spiked. But, even if New York’s murders did decrease from say, 400 to 350, that number would have been merely 300 if fifty would-be murders never occurred because the illegal alien perpetrators had been deported. Once again, a liberal interventionist judge from the ninth circuit area has thwarted common sense. Let’s hope our newly constituted Supreme Court brings logic and the law back into the equation. As Elizabeth Alvarado, the mother of a teen slain by an illegal alien MS-13 member in Brentwood, Long Island said, “We need to change the laws on how we handle criminal immigrants.” If only this judge had heard her plea. Bronze Award Project Junior Girl Scout Troop 713 from Girl Scouts of Suffolk County, Service Unit 48 in Shirley, NY recently donated over 20 glucose-testing meters and 8,000 testing strips to diabetics in third-world nations as a part of their Bronze Award project. The Bronze Award is the highest award a  Junior Girl Scout can earn. Operation Safe Stop Day

At the April 25, 2017 General Meeting of the Suffolk County Legislature, Introductory Resolution 1198 was adopted unanimously. The bill, sponsored by Legislator Tom Muratore, “declares April 27, 2017 as “Operation Safe Stop Day,” designed to promote school bus safety. Operation Safe Stop is a cooperative project supported by the   New York State Governor’s Trafﬁc Safety Committee, the New   York State Education Department, the New York Association of   Pupil Transportation, the New York State School Bus Contractors   Association, the student transportation industry and state, county,   city and local law enforcement agencies. Its purpose is to increase   awareness of school bus safety, as well as the dangers associated   with passing a school bus illegally.     “An estimated 50,000 motor vehicles  illegally pass New York  State school buses every day,” stated Legislator Muratore. “That   statistic is astounding to me—50,000 times each day, we put our    most valued resource, our children, in peril. The awareness provided   by Operation Safe Stop Day is crucial in preventing school bus accidents that could result in injury or death. Remember, if you approach a stopped school bus with its red lights ﬂashing, you must STOP…it’s the law!”

 

They will hatch sometime around May 14.  Praying Mantis: will be hatching any time between now and May 13th.  Approximately 100 mantids hatch but only about 25 survive to be released. Release  date is 3 days after hatch (we can only keep them for a few days because they eat  each other!)  Chicken eggs: hatch date is approximately Friday, May 5th. Obtaining A Veteran Peddler’s Permit Suffolk County Clerk Judith A. Pascale would like to remind all honorably discharged members of the United States Armed Forces, and their surviving spouses, that they are eligible to apply for a Veteran’s Peddler License. This license provides Veterans with the right to sell goods, wares and merchandise. “Service to our Country is amongst the highest of callings in a person’s life,” commented Suffolk County Clerk Judith A. Pascale. “I am proud to offer this service to our Veterans and sincerely thank them for their service.” To apply, you must present a valid driver’s license or photo identiﬁcation, proof of residency for at least 6-months (a local utility bill can be used), and a copy of your DD-214 or Military Discharge papers. Licenses are issued free of charge and are valid as long as you maintain residency within the county. To get a license, you must appear in person and bring two (2) passport photos with you. In addition to obtaining a Veteran’s Peddler’s License from the County Clerk, you will also be required to comply with village or town ordinances related to street peddling. Information can be obtained directly from the individual towns and villages in which the business will be conducted. “Be sure to contact the respective municipality to learn about their rules and regulations regarding the peddling of wares within their town or village,” commented Pascale. Non-veterans who are interested in obtaining a peddlers permit may contact their respective town or village government for more information. For a better understanding of all the services available to veterans within Suffolk County, individuals should contact the Suffolk County Veterans Services Agency at (631) 853-VETS (8387).

Military Rememberance Month The month of May is known as Military Remembrance month or as most refer it to the month when we honor those fallen soldiers on Memorial Day.The month of May was selected because it has most days set aside for celebrating and commemorating our military’s achievements. These days include Loyalty Day, which was established in 1921, Victory in Europe (VE) Day commemorating the end of WWII in Europe on May 8, 1945, Armed Forces Day created in 1949, Military Spouse Appreciation Day established in 1984, and of course the best known of the May holidays, Memorial Day. May 21st is Guardians of Freedom day. A single holiday for citizens to come together and thank our military members for their patriotic service in support of our country. This day honors everyone serving in the U.S. Military branches; Air Force, Army, Coast Guard, Marines, Navy. May 30th is Memorial Day, which is a remembrance of our veterans. It commemorates the men and women who died while in military service. Remembering Those Who Served. It is customary to mark Memorial Day by visiting cemeteries and war monuments. One of the biggest Memorial Day traditions is for the President or Vice President to give a speech and lay a wreath on soldiers’ graves in the largest national cemetery, Arlington National Cemetery, in Virginia. Most towns have local Memorial Day celebrations. Here are some ways you can honor the men and women who serve our country: - Put flags or flowers on the graves of men and women who served in wars. - Fly the U.S. flag at half-staff until noon. - Visit monuments dedicated to soldiers, sailors and marines. - Participate in a National Moment of Remembrance at 3 p.m. local time. - March in a parade in remembrance of those who were in the military and died while protecting our freedom.

   Charting A Course For Brookhaven Town’s 5th Council District

Story by Barbara LaMonica When Brookhaven Town 5th District Councilman Neil Foley was elected to the Town Board in a special election to fill the unexpired term of Tim Mazzei, 2014 would mark the beginning of cutting edge improvements to the District and the continuation of projects that were already underway during his predecessor’s tenure. Foley was determined to navigate his district and chart a course in a positive direction for his constituents and the town at large. During an interview last week, Foley outlined projects that are underway and plans he has mapped out for the foreseeable future. Taking into account Fire Island, Foley notes the 5th Council District is the largest ward in Brookhaven from a geographic standpoint. Parks were cited as among some of the more significant improvements. “We’ve renovated Peppermint Park from a point at which it was falling apart, and now we’ve changed the whole vibe,” Foley explained. Peppermint Park, situated in the heart of Medford on Route 112 at the corner of Jamaica Avenue, is what Foley acknowledges is “highly visible.” A few hundred thousand dollars later, the park which had outdated and weathered recreation equipment now boasts a new playground, swings, benches, gazebo and even a library book stand. “Everything that’s been done to Peppermint Park has been accomplished with an educational purpose and geared towards learning and education,” Foley explained. Further southeast along Council District 5 in Patchogue along Montauk Highway, Foley highlights the continuation of a host of enhancements to Swan River Preserve that was underway when he took office. “Tim Mazzei began this initiative and I finished it by taking out 20 tons of material where the old Nessenger Chevrolet car dealership was; the place was leveled and we’ve returned the property to nature where we have water flowing and beautiful vegetation,”

10th Annual Summer Campaign To Combat Teen Obesity 

Wanda’s Weight Room Plus (WRP) announced that it is launching its 10th annual “Free Teen Summer Membership” program on May 22, 2017. Non-Members’ as well as WRP Members’ Teenagers ages 12 to 15 can sign up a free summer membership that will allow them Club access from June 12, to August 31, 2017. This program, which was spearheaded to help ﬁght teen obesity, is in its tenth year. Interested teens must visit WRP with a parent or legal guardian to sign up and bring proof of age. After registration, teen members can work out, unaccompanied, and enjoy all day access 7 days a week from 10AM to close. In addition to access to the club’s state-of-theart strength training equipment and cardio machines, they can participate in group ﬁtness classes, like Zumba, Yoga, Bootcamp, Cycle, Kickbox and more.

Answer:

No, you cannot use the money in the irrevocable trust to pay for your motherâ€™s assisted living. In order for the irrevocable trust to be considered exempt for Medicaid purposes, it must provide that no principal distributions can be made to the grantor (your mother) or on the grantorâ€™s behalf. In other words, any distribution made from the irrevocable trust to your mother or directly to the assisted living would violate the terms of the trust. Since the house was transferred to the irrevocable trust over ďŹ ve years ago, the money in the trust is protected in the event your mother requires care in a nursing facility. Even though your mother is currently in assisted living, it is still

important to keep the irrevocable trust intact because she may need to be transferred to a nursing facility which would result at the rapid depletion of her assets. The average nursing home stay is $15,000.00 per month. The money in the irrevocable trust would be considered exempt if your mother needed to rely on Medicaid to pay for the nursing facility. The money that is held in the revocable trust can be used to pay for the assisted living as your mother maintained complete control over the assets during her lifetime. The revocable trust offers no assets protection with respect to Medicaid eligibility. The assets held in the revocable trust can be freely transferred and the trust can be changed or revoked at any time. I understand that you do not have access to this trust as you are not the Trustee. It would be my recommendation to schedule an appointment with an elder law attorney and your mother in order to make the appropriate changes to the revocable trust so that you have access to this money to pay for the assisted living. Spending the money in the revocable trust on the assisted living is allowable and also the better option as this money is not protected if your mother requires care in a nursing facility. Understanding the documents you or your family members have is imperative in order to make sure the maximum amount of protection is achieved during any health crisis.
