he Court of Appeals late on Monday rejected a writ of certiorari filed by Anthonieska Avilés Cabrera and upheld the continuation of criminal proceedings against her in the Aibonito Court of First Instance, according to a resolution announced on Tuesday. Following the decision, Justice Secretary Lourdes Gómez Torres reiterated in a written statement that “our commitment remains to litigate this case seriously and responsibly before the trial court, committed to the truth and justice for Gabriela Nicole [Pratts Rosario] and her family,” referring to the teenage victim of a fatal stabbing on Aug. 11 in Aibonito for which Avilés Cabrera and her mother, Elvia Cabrera Rivera, stand accused. According to the appellate court, none of the criteria established in Rule 40 of its regulations were met to justify its intervention at this stage of the judicial process. According to the resolution, the defense requested a review of a determination by the trial court that denied several motions to dismiss for alleged lack of jurisdiction, as well as a stay of a preliminary hearing scheduled for this past Monday, Dec. 15. The Court of Appeals concluded that there is no dispute that Avilés Cabrera, who turned 18 on Sept. 23, was over 15 years of age at the time of the events and that she faces charges for acts constituting first-degree murder, therefore her prosecution as an adult is appropriate under the Puerto Rico Juvenile Law. As a result, the intermediate court lifted the previously issued stay order and returned the case to the Court of First Instance to continue with the corresponding proceedings.

atural and Environmental Resources Secretary Waldemar Quiles Pérez and designated Consumer Affairs (DACO by its acronym in Spanish) Secretary Hiram Torres Montalvo announced on Tuesday that inspections of metal collection centers will intensify in the face of a rise in thefts of catalytic converters in Puerto Rico. “We are announcing a complete review of all the data in the agency on metal collection centers since 2021 with the aim of evaluating each of these facilities,” Quiles Pérez said in a written statement. The official said the administrative review will be complemented

by an increase in joint operations with DACO and other agencies with jurisdiction over the establishments, as part of efforts to ensure compliance with current laws and regulations. Torres Montalvo noted that DACO began a study of the Regulation of Weights and Measures Number 9219 to evaluate possible adjustments according to the current reality and announced that inspections in the collection centers will be stepped up. “Everyone has to operate under the law and regulations,” he said. According to data from the Puerto Rico Police, between Jan. 1 and Dec. 7 of this year, 416 complaints have been received for catalytic converter theft, a lower figure than the previous year, but which the authorities recognize as a problem that continues to harm consumers.

Governor vows to keep suit against LUMA in local courts By THE STAR STAFF

ov. Jenniffer González Colón stated on Tuesday that the government will request that the lawsuit challenging the extension of LUMA Energy’s contract not be heard in federal court but rather remain in the commonwealth court, as stipulated in the contract itself. “We are going to invoke the right to have this case heard in Puerto Rico, because that is what the contract provides and because we are alleging that the granting of that extension was null and void,” the governor told reporters. González Colón maintained that the government’s argument is not related to bankruptcy or alleged breaches of contract, but rather to the legal validity of the letter that extended the agreement with the private operator of the island’s energy transmission and distribution system. “We are not addressing issues of breach of contract or matters related to bankruptcy or the [Financial] Oversight [and Management] Board,” she added. “We are saying that the extension of that contract is ultra vires, it is null and void, it should never have been carried out because it did not meet the basic legal requirements.” The governor stated that the extension letter was granted without the required approvals from the Puerto Rico Electric Power Authority (PREPA), the Puerto Rico Energy Bureau, and the island Legislature. “We are not talking about the contract itself; we are talking about a letter that unilaterally extended the life of this contract without any oversight or accountability,” she said. Jenniffer González Colón announced on Tuesday that she will declare a day of mourning following the death of journalist Alex Alberto Delgado Rosado, who passed away from cancer. “I want to join Alex Delgado’s family in offering my condolences on behalf of the people of Puerto Rico,” the governor said at a press conference. The broadcaster’s family announced that funeral arrangements will be released soon. “I believe that journalist Alex Delgado demonstrated professionalism of the highest caliber and the highest level in the performance of his duties, at NotiUno, on Pelota Dura, and in each and every forum where he participated,” she added.

González Colón stated that the death of the broadcaster has shaken many on the island and emphasized the courage with which Delgado Rosado faced his diagnosis alongside his family. “We are saddened by the outcome, after how brave, courageous, and stoic Alex Delgado and his family were in facing his diagnosis,” she said. “I will declare a day of mourning for the death of journalist Alex Delgado,” she added, asking for comfort for the broadcaster’s family. Delgado Rosado studied at the University of Puerto Rico, Río Piedras Campus. He had a long career in radio, starting at WAPA Radio (Borinquen Radio) and Cadena Radio Puerto Rico (WIAC 740). He was also a producer and on-air talent for television programs and a columnist.

San Juan mayor proposes higher fines, other changes to address noise & unclean public spaces By THE STAR STAFF

an Juan Mayor Miguel Romero Lugo presented a draft ordinance on Tuesday to amend the municipality’s Public Order Code, in order to strengthen enforcement related to unnecessary noise, waste management and the proper use of public spaces. “These amendments allow us to better respond to the needs of our communities, without losing sight of the balance that must always exist between economic activity and civic

coexistence,” Romero Lugo said in a written statement. The mayor said the measure seeks to more efficiently address complaints that affect the quality of life of residents, particularly those related to excessive noise, the cleanliness of public areas, and the proper disposal of garbage. Among the proposed changes is allowing law enforcement officers to determine whether noise measurements will be taken from the source of the sound or from where it is perceived by residents, as well as an increase in fines for violations related to waste management and the care of public spaces.

Powerball jackpot rises to $1.25 billion; $200,000 prize won in Orocovis

Jenniffer González Colón has signed four bills into law, including one from her administration, addressing issues ranging from childhood cancer awareness to promotion of manufacturing to expanded rights for vulnerable populations. She made the announcement Tuesday but the new laws were enacted over the weekend. The first is Law 157-2025, sponsored by District 38 Rep. Wanda del Valle, designates Sept. 4 as “Childhood Leukemia Awareness Day” in Puerto Rico. The law also mandates the use of orange and gold ribbons to symbolize support for children battling leukemia and their caregivers. According to the American Cancer Society, leukemia is the most common cancer among children and adolescents. Data from Puerto Rico’s Central Cancer Registry ranks leukemia among the top 10 cancers for both men and women. The governor also enacted the License Portability for Military Spouses. Law 158-2025, authored by District 7 Rep.

U.S. Space Force was established in 2019 as the sixth branch of the Armed Forces. González Colón also enacted the Manufacturing Day Alignment. Law 159-2025, introduced by House Speaker Carlos “Johnny” Méndez Nuñez (District 36), amends the Puerto Rico Manufacturing Month and Day Act to align Manufacturing Day with the first Friday of October, as observed in the United States. The law also requires the governor to issue an annual proclamation and authorizes the Department of Economic Development and Commerce to promote the event. Manufacturing has been a cornerstone of Puerto Rico’s economy for more than 75 years, according to a recent executive order. Law 160-2025, an administration-backed measure, creates the Uniform Law of Supplementary Rights for the Population with Functional Diversity and Older Adults. The bodies of Rob Reiner, 78, and Michele Reiner, 70, were discovered Sunday in what police described as an apparent homicide. One of their sons, Nick Reiner, 32, was arrested Sunday night and is being held without bail on suspicion of murder. Nick Reiner’s struggles with drugs left his parents ‘desperate’ By JULIA JACOBS and NICOLE SPERLING

A

fter Nick Reiner entered his first drug treatment program around age 15, his turbulent life veered between rehab and homelessness, sobriety efforts and relapse. At times, it appeared as if he had achieved more stability in adulthood. But any semblance of equilibrium was shattered when Reiner’s parents, Hollywood director Rob Reiner, 78, and Michele Singer Reiner, 70, were found stabbed to death in their Los Angeles home on Sunday. Nick Reiner, 32, was arrested on suspicion of murder and is being held without bail. For many years, Rob Reiner, creator of beloved movies such as “When Harry Met Sally …” and “The Princess Bride,” was contending with a child in crisis. The family struggle was largely kept private when Nick Reiner was young, but as an adult he openly discussed his battles with heroin and cocaine in interviews and podcasts. He once estimated he had been in drug treatment 18 times during his teenage years. In the public interviews, Nick Reiner told anecdotes about his crises and his volatile behavior. Once, awake for days on cocaine in his parents’ guesthouse, he “started punching out different things,” including a television and a lamp, he recalled on the podcast “Dopey” in 2018. “Everything in the guesthouse got wrecked,” he said. Another time, he said, he had a heart attack on a plane because of cocaine use and woke up in a hospital. And he once threw a rock through a window at a treatment center to convince officials that he needed medication, he said on another podcast about addiction in 2016. “I was so lost — I didn’t know anything about myself or the world,” Reiner said on the podcast. “And that’s all I knew as a coping mechanism.” Alan Horn, a former Disney studio chair and a close friend and longtime collaborator of Rob Reiner, said that family friends had known about Nick Reiner’s history of substance abuse problems but that the Reiners had largely kept the details private. He recalled that Michele Reiner had said a few years ago of her son’s struggles: “We’ve tried everything. We don’t know what else to do.” When Nick Reiner was first sent to rehab as a teenager, he recalled in the 2016 podcast, he was put in a room with a heroin addict. Though he told himself at the time that he would never try the drug, he eventually did. “I’ve noticed that when you’re surrounded by people that are so willing to go out and ruin everything just for this one thing,” he said, “you get desensitized to these really

You roll the dice and you hope you make it.” Born in 1993, Nick Reiner grew up with two siblings, Jake and Romy. By the time they were born, their father was a Hollywood hitmaker who had gotten his acting start on the sitcom “All in the Family.” Their grandfather Carl Reiner, who created “The Dick Van Dyke Show,” was a giant of 20th century television. Nick Reiner eventually entered the entertainment industry himself. At one drug treatment center more than a decade ago, he started writing a television script with another resident, Matt Elisofon, pulling from their experiences in rehab. Unable to spend much time on the computer, they wrote it longhand. After getting his GED, Reiner had planned to go to college in North Carolina but decided against it. After reconnecting with Elisofon in New York, they committed to realizing their script. With the backing of Reiner’s father, the idea became a feature-length movie centered on the tensions between an actor turned politician and a drug-addicted son. The release of the movie, “Being Charlie,” which was

directed by Rob Reiner and loosely based on his relationship with his son, included a round of interviews in which the Reiners laid bare the difficulties they had faced. In an interview with the Los Angeles Times in 2015, Rob Reiner expressed some level of regret about how he had handled his son’s unraveling. When his son told his parents that a drug-treatment program was not working for him, Reiner said, “we wouldn’t listen.” “We were desperate, and because the people had diplomas on their wall, we listened to them when we should have been listening to our son,” he added in the interview. After years distancing himself from his family, Nick Reiner eventually moved back to Los Angeles. He and his father said making the movie had helped repair their fractured relationship. Barry Markowitz, who met the Reiners as cinematographer on “Being Charlie,” said that although Nick Reiner had seemed inclined to stay under the radar, his parents and siblings had encouraged him to do what he loved, and he had funneled his love for writing into a movie about his life. “It was some feat that after what Nick went through, that he can pull together and write a script about his experience,” he said. After the movie was finished, Markowitz found himself embraced by the family, which he described as a tight-knit, warm household. Whenever Markowitz was in Los Angeles, Rob and Michele Reiner insisted he stay with them. “Whenever I went to LA, the door was open,” he said. “They wouldn’t have it any other way.” The children regularly ate dinner with their parents at the home in Brentwood, Markowitz said. A common scene was the entire family sitting in the living room watching a basketball game or the news — with the whole group often yelling at the TV at the same time. Markowitz described Michele Reiner with the Yiddish word “balaboosta,” a mother who runs the show. “There’s nothing they wouldn’t do for the kids,” he said of the couple. But tensions in the family remained. The night before the Reiners were found dead, Rob and Nick Reiner had attended a holiday party at the home of comedian Conan O’Brien, according to three attendees who asked not to be identifed to maintain relationships. Rob and Nick Reiner got into a shouting match at the party, said one of the attendees, who recalled Rob Reiner as saying that his son was behaving inappropriately. The attendee said that it was unclear what the argument had been about but that Nick Reiner’s past struggles were commonly known. Nick Reiner was arrested Sunday night and remains in a jail in Los Angeles County. It is unclear whether he has a lawyer. Geoffrey Mark, a comedian, knew Rob Reiner for about 30 years, seeing him at group dinners and other events. He said his friend had never been explicit about the challenges he was facing at home, but he noticed that Reiner would sometimes use a joking — but pointed — expression when asked how he was doing: “Go have children.” “It’s a humorous way of sharing with someone that there are troubles that they don’t really want to go into,” Mark said, “but that they’re there.”

Fixing the Pentagon’s gilded fortress By THE EDITORIAL BOARD

T

o understand why the United States is struggling to buy and field the weapons of the future, consider the trouble it had buying the most basic weapon of the past. In 2011 the Army decided to get its soldiers new pistols. The odyssey that followed included a 350-page list of technical specifications, years of testing and a protracted battle on Capitol Hill between competing gun makers. The Pentagon won’t complete delivery until 2027 at the earliest. The Army could have raised an infantryman from birth to within two years of enlistment age in the time it would have taken to get him a new handgun. The story of the Pentagon’s new pistols would be funny if it didn’t point to a serious problem at the heart of America’s military. The Department of Defense has built a gilded fortress of people and processes that is slow, wasteful and married to the past. Of all the obstacles to fielding the military that America needs, the Pentagon’s bureaucracy may be the hardest to overcome. The military’s top ranks are dominated by pilots, captains and other commanders who are disdainful of new, cheap alternatives to fighter jets, warships and tanks. The byzantine system for buying and testing weapons isolates the military from the innovative parts of the U.S. economy. Congress underwrites the dysfunction with appropriations that are designed to deliver wins for its members rather than for national security. Fixing this requires intervention. leaders John Thune and Chuck Schumer should insist that the U.S. military serve the nation before it serves as a local jobs program. But the biggest reformer needs to be the president. We say this with some reservations, given President Donald Trump’s destructive approach to government and his disregard for administrative competence. That said, he has shown an eagerness to disrupt old bureaucratic habits, and the Pentagon needs disruption. Trump should fix the Defense Department’s bureaucracy and provide political top cover for members of Congress to cut programs that their constituents support. Reforming the military is a long-term proposition, and politicians who plan to run for president in 2028 and the aides who will advise them should make Pentagon reform a central part of the policy agenda they will soon begin compiling. Bureaucracy may sound boring, but the safety of the country — and of our democratic allies in Asia and Europe — depends on the federal government getting serious about how it finances and equips our military. The problem starts with Congress. The proposed 2026 defense budget is loaded with pork for unnecessary programs. It has more than $300 million that the Defense Department didn’t ask for to buy and upgrade Humvees. There’s $240 million for the Gray Eagle drone, the Model T of unmanned aircraft that the Army labeled “obsolete.” Then there’s over $360 million for an Apache helicopter that the Army didn’t request. As the House and Senate work toward the country’s first trillion-dollar defense budget, more than $52 billion is for things members of Congress added, unbidden, to the Pentagon’s wish list, according to the independent budget watchdog Taxpayers for Common Sense. Congress manages to make things worse when it fails to spend money, too. For much of the past 15 years, lawmakers have passed budgets months late. That hobbles Pentagon planners, delaying investments on programs the military desperately needs. Between the pork and the budget lapses, no one can keep track of where all the money goes. The Defense Department is the only major federal agency never to get a clean bill of health from outside accountants and has failed its last seven audits in as many years. When the bean counters can follow the money, they often find it has been wasted. Bases that the government targeted for closure more than a decade ago remain open. The military doesn’t have an adequate way to track spare parts, so instead of using what it already has, it just orders more. The services budgeted an estimated $1 billion more than they needed for parts in 2021 alone. Worse than the waste is the status quo all that money strengthens and supports. The U.S. military, whose budget is larger than the military budgets of the next nine countries combined, oversees about 3 million people and controls some 82% of the U.S. government’s total physical assets. A 2020 RAND study found that officers who rose to leadership tended to be risk-averse and largely trained in positions such as captains and pilots. Unsurprisingly, it also found they were more likely to promote those with similar experiences and

outlooks. That status quo command structure helps protect the labyrinthine inner workings of the Pentagon. Companies that want to sell to the military must navigate more than 2,000 pages of the Federal Acquisition Regulation. The military’s testing and approval systems can then run to a decade for new weapons systems — a lifetime in an era of rapid change. Both hurdles favor the five major defense contractors and their armies of lobbyists, lawyers and former Pentagon officials. The result is a tendency to adapt old weapons platforms rather than develop new ones. The Army is paying the country’s largest military contractor, Lockheed Martin, $43 million to convert Blackhawk helicopters, which were designed in the Vietnam era, to allow them to carry and launch drones. Much cheaper options, like off-the-shelf drones, never see the light of day. The final problem: The system feeds on itself. Pentagon officials and congressional staff members have long migrated to the arms industry, getting well-paid jobs as board members and senior executives. That’s especially true of those at the top. By one count, more than 80% of four-star generals and admirals who retired between 2018 and 2023 went on to work in the defense industry. So the spending continues on programs that won’t help America win the next war — and may ensure we lose it. The Trump administration has attacked the problem with its signature headstrong disruption. Army Secretary Dan Driscoll has tried to cancel multiple outdated weapons systems — the M10 Booker light tank, the Humvee replacement, overpriced aircraft — with resolve. In May, Defense Secretary Pete Hegseth slashed by half the staff of the Pentagon’s infamously slow testing office. In November, he unveiled an ambitious plan to reform the military’s approach to buying weapons. Fixing the broken bureaucracy, however, will take more than killing programs and firing people. After cutting the Pentagon’s testing staff, Hegseth left many requirements in place. An Oct. 15 memo he wrote requiring that any Pentagon employee receive permission before engaging with Congress undercuts his attempt to reform weapons purchases by making it harder to get new programs off the ground. Congress’s 2026 spending bill, introduced after many of Driscoll’s moves, was nevertheless larded up with failing programs. Trump should push for real change, not just the appearance of it. He should force the Pentagon to experiment with market approaches to budgeting in place of centralized planning. He should force services to place bets on startup companies that get results rather than established ones that have mastered the broken system.

Wall St slips on losses in healthcare and energy stocks; focus on economic data W

all Street’s main i‌ndexes ​slipped on Tuesday, impacted by declines in healthcare ‌and energy stocks, but the Nasdaq pared some losses in the afternoon. Investors evaluated delayed economic d​ ata to gauge the Federal Reserve’s monetary policy outlook for next year. A Labor Department report showed nonfarm payrolls increased by 64,000 jobs in November ‍following a decline in October because of ​government spending cuts. But the unemployment rate rose to 4.6% in November against the backdrop of economic uncertainty stemming from President​ Donald Trump’s aggressive ⁠trade policy. A separate report on Tuesday showed retail sales were flat in October, just below an estimate of economists polled by Reuters calling for a rise of 0.1%. Analysts flagged the likelihood of the figures being distorted by slow data collection due to a recent government shutdown. “This is all fairly old news at this point. Most data points are being viewed in the ‌lens of what they are going to do to the Fed, and the data you got today isn’t likely ​to move ‌the needle,” said Mark Hackett, ‍chief market strategist at ⁠Nationwide. After Tuesday’s data, investors are pricing in interest rate cuts of at least 58 basis points next year — more than double the 25 bps signaled by the Fed last week. At 2 p.m. EST, the Dow Jones Industrial Average fell 303.67 points, or 0.63%, to 48,112.89, the S&P 500 lost 28.91 points, or 0.42%, to 6,787.60 and the Nasdaq Composite lost 14.24 points, or 0.06%, to 23,043.18. All of the 11 S&P sectors posted declines except information technology stocks. Energy stocks declined the most as crude prices slid to their lowest level since 2021. “The crude m ​ ove today is the one that stands out. Everything else seems like lethargy among investors and just a modest technical move to the sidelines,” Hackett said. Healthcare fell 1.7%, with Pfizer down 5.1% after the drugmaker forecast a challenging 2026 due to weaker sales of COVID-19 products and squeezed margins. The S&P 500 and the Nasdaq hovered near their threeweek lows as persistent uncertainty over rate cuts and concerns about lofty tech valuations continued to weigh on market sentiment. Among other stocks, B. Riley jumped 41% after the investment bank reported a profit for the second quarter, compared with a year-ago loss in an overdue quarterly filing. Comcast rose nearly 4% after CNBC financial journalist David Faber speculated about potential involvement by an activist investor. Humana lost 5.7% after the health insurer announced leadership changes. Separately, a Reuters r​ eport said Nasdaq submitted paperwork with the U.S. Securities and Exchange Commission to roll out round-the-clock trading of stocks, months after the New York Stock Exchange and Cboe Global Markets announced similar plans. Declining issues outnumbered advancers by a 1.93-to-1 ratio on the NYSE and by a 1.38-to-1 ratio on the Nasdaq.

A one-two on payrolls tallies - a hit to ‍October from the government shutdown and a recovery last month - ​is the consensus forecast, with the jobless rate expected to emerge steady at 4.4% for November. The likely noisy data will fill in most gaps in the Federal Reserve’s and investors’ view of the jobs market but also leave enough questions to keep ​markets guessing on next year’s ⁠interest rate trajectory. Retail sales updates for October are also due. As it stands, futures markets price just a one-in-four chance of another Fed rate cut next month and another quarter point move is not fully priced until June.

Australia doubles down on gun control after mass shooting By VICTORIA KIM

F

or decades, Australians have watched in disbelief as the United States endured mass shooting after mass shooting. Each horrific episode touched off a familiar cycle of horror in the United States: an outpouring of grief, followed by calls for tougher gun laws that would inevitably dissolve to the status quo. Most Australians felt certain that things at home were different. After all, three decades ago, it took just 12 days after a massacre in which a gunman killed 35 people in Port Arthur, Tasmania, for the country to adopt sweeping gun ownership restrictions. For two decades after the carnage, there wasn’t a single mass shooting in Australia. Leading Democrats in the United States have pointed again and again to Australia’s example. New Zealand modeled its laws on Australia’s after a gunman killed 50 people at two mosques. Public health researchers have labored over Australia’s experience as a case study of how lives could be saved. But Sunday’s massacre at Bondi Beach, in which two gunmen with half a dozen legally obtained long guns sprayed bullets on defenseless families at a Hanukkah celebration, chipped away at that long-held comfort in the country’s gun laws. The shooting, which left at least 15 dead and scores wounded, has forced a hard look at gun control in Australia — how the number of licensed firearms had steadily risen over the years, how some of the pledged changes were never fully implemented, how the country had gotten complacent in three decades largely free of this particular brand of indiscriminate terror. “I think there was a real perception that gun control was something we fixed in the ’90s, and we’ve patted ourselves on the back ever since,” said Rod Campbell, research director for the think tank Australia Institute. Within 48 hours of the Bondi shooting, federal and state leaders in Australia pledged to further tighten the country’s gun laws, already some of the most restrictive in the world. Among the new measures under consideration are capping the number of firearms that can be owned by an individual, further limiting the types of guns that are legally permitted and making Australian citizenship a condition

of gun ownership, officials have said. On Monday, Prime Minister Anthony Albanese spoke of the speedy, bipartisan action after the Port Arthur massacre, calling it “a proud moment of reform” that had made an enormous difference, vowing to do the same. “If we need to toughen these up, if there’s anything we can do, I’m certainly up for it,” he said. Even though it remains an open question whether more stringent measures could have averted Sunday’s killings, many Australians were supportive of the promises for decisive action. They noted that they were a lot more concrete than the “thoughts and prayers” so often offered by American officials after mass shootings. Australian authorities have not detailed what weapons were used by the suspects in the Bondi Beach shooting. Witnesses recounted powerful shots steadily ringing out over at least 10 minutes, thundering far louder than the return fire from the police officers who shot back with handguns a few minutes in. The older of the two suspects, 50-yearold Sajid Akram, had applied for a license for sports and target shooting in 2020, which was granted in 2023, police said Tuesday. Earlier, authorities had said that he had held his license since 2016, but a police official corrected the information to say that the initial application had lapsed for technical reasons, after which Akram refiled the paperwork. Based on that timeline, Akram got the license after his son Naveed, his suspected accomplice, had been investigated in 2019 for his association with individuals who were later convicted of terrorism. Officials have said that the father was also questioned during that investigation, which concluded that the younger man did not pose an imminent threat. The older Akram was shot and killed by police officers on the scene; his son remains hospitalized. Among the new restrictions under consideration, according to the prime minister’s office, is the use of “criminal intelligence” in the process of evaluating gun license applications, in addition to criminal records. It was a watershed event.” This week’s quick promises from political

leaders to strengthen gun laws was not without pushback from some corners of Australia. A hunting podcast with a large following urged listeners to call the premier’s office in New South Wales state to say gun owners were being scapegoated. The Shooters, Fishers and Farmers Party, a fringe conservative party that advocates for relaxed gun control, said in a statement Monday that the Bondi episode had exposed flaws in the licensing system and that stricter laws were not the answer. “Licensing did not cause this attack,” the party said in a statement. “Extremism did.” On Tuesday, Howard partly echoed that sentiment. He said he did not want “the focus on guns to be used as a pretext to avoid the broader debate about the spread of hatred of Jewish people and antisemitism.” Even so, there were virtually no voices making the argument that quickly began circulating in the United States — that if some of the civilians at the scene of the shooting had been armed with their own guns, they could have stopped the massacre. Gun ownership in Australia is considered a privilege, not a right, said Tim Quinn, president of Gun Control Australia, an advocacy group. Any conversation around firearms is centered around practical need, for things like feral animal control in rural areas, he said.

Hong Kong media tycoon’s conviction was years in the making By ANDREW HIGGINS and ALEXANDRA STEVENSON

I

n a verdict long foretold by China’s Communist Party, a Hong Kong court earlier this week convicted Jimmy Lai, a media mogul and rambunctious critic of the rulers in Beijing, finding him guilty of crimes endangering national security. The conviction, swathed in the formal garb of a nominally independent judicial system left over from British rule, was never in any real doubt. Lai, 78, has been pilloried for years by China’s ruling party and its loyalists in Hong Kong as a traitor, a crook and the leader of a subversive “gang of four” who must be severely punished. In this case, he was convicted of two counts of conspiring with foreign forces to impose sanctions against Hong Kong and another of publishing seditious material in the former British colony. He had already been convicted and imprisoned on fraud charges. When Lai was arrested five years ago and released briefly on bail, a group of self-declared Chinese “patriots” gathered outside his home in Kowloon and waved banners warning ominously that “traitors who bring disaster to Hong Kong will not have a good end.” Monday’s verdict delivered on that warning and brought nearer to a close a case that has crystallized the changes that have swept Hong Kong since the introduction of a harsh national security law in 2020 in response to months of anti-government street protests that authorities suppressed. Lai, who took part in the protests and supported them through his now defunct newspaper, Apple Daily, was seen by many outside the city’s elite as a symbol of what once made Hong Kong special — noisy irreverence, freewheeling rags-toriches ambition and an impish disregard for the pomposity of British colonials and the turgid, often menacing, pronouncements of mainland officials. His preferred language is Cantonese, the dialect of Chinese spoken by most people in Hong Kong, over the Mandarin used by Beijing. Apple and a sister publication, Next magazine, also now shuttered, used Cantonese slang popular with readers while at the other end of the spectrum, party-controlled newspapers in Hong Kong, which sold far fewer copies, wrote in a bloated mix of communist jargon and formal Chinese. Lai delighted in taunting fellow tycoons, many of whom repeatedly told him to shut up and parroted Communist Party talking points in pursuit of business on the mainland. He reveled in riling an elite polite society saturated with the hypocrisies of the colonial era and also of the Communist Party. Apple Daily feasted on entertainment gossip, gory crimes and for a time published a regular brothel review by a columnist who went by the name Fat Dragon. But it was also heavy on serious political coverage slanted in favor of demands for more democracy and exposing the riches of China’s top political families and cronyism. “The establishment hates my guts,” Lai said in a 2019 interview with The New York Times. “They ask, ‘Why don’t you just let us make money in peace?’ They think I’m a troublemaker,” he said, adding: “I am a troublemaker, but one with a good conscience.” On the eve of Monday’s court ruling, members of Hong Kong’s Democratic Party, once a boisterous mainstay of the city’s legislative assembly and its largest opposition force, voted to formally disband. China took back control of Hong Kong in 1997, ending 156 years of colonial rule, after promising in a 1984 agreement with Britain that the “previous capitalist system and lifestyle shall remain unchanged for 50 years.” The agreement promised legal protection for rights and freedoms, including those of speech and assembly. But the arrangement known as “one country, two systems” has frayed as the Hong Kong government, at the party’s behest, has not only snuffed out public protest, previously a regular feature of life in the city, but viewed even mild criticism of Beijing as a threat. It has vowed to uproot “soft resistance,” citing what officials see as signs of foreign subversion in a book fair, music lyrics, a U.S. holiday celebration and environmental groups. Space for free expression has become so constricted that Hong Kong’s national security police have arrested more than a dozen people since the city’s deadliest fire in decades, a lateNovember blaze that engulfed seven apartment towers and killed at least 160 people. Authorities have been on heightened alert for what they say are “anti-China forces” looking to exploit the tragedy, but critics have said authorities are targeting people who call for greater government accountability. The charges on which Lai was convicted can be punished by up to life in prison. A presentencing hearing is set to begin Jan. 12. In Beijing, the Foreign Ministry spokesperson Guo Jiankui welcomed Lai’s conviction. The court’s “actions are reasonable, lawful and beyond reproach,” he said, while condemning what he described as a “blatant defamation and smear campaign” by “certain countries” critical of the Hong Kong judiciary. President Donald Trump told reporters on Monday that he wanted China’s top leader, Xi Jinping, to release Lai. “I feel so badly. I spoke to President Xi about it, and I asked him to consider his release,” Trump said, without specifying when he made the request. Before his election last year, Trump promised “100% I’ll get him out. He’ll be easy to get out.” His administration has since curbed its hopes of extracting favors from China. In recent weeks it has worked to calm turbulent relations with Beijing following a trade war truce reached in October during a meeting in South Korea between Trump and Xi. Media outlets in Hong Kong controlled by China’s Commu-

nist Party had pronounced Lai guilty long before the trial started. A 2020 enumeration of his alleged misdeeds by Wen Wei Po, a party-controlled Hong Kong newspaper, listed 10 “unpardonable crimes,” which ranged from treason to a lack of filial piety and drug use. These, the newspaper predicted, “make it extremely difficult for him to clear his name.” That Lai had no real chance of doing that was clear even before his arrest. In a 2017 speech celebrating the 20th anniversary of Hong Kong’s return to Chinese rule, Xi, China’s leader and the general secretary of its Communist Party, described the red lines which he said it was “absolutely impermissible to cross.” These included “any challenges to the power of the central government in Beijing,” a line that Lai, an irreverent critic of Beijing authorities, crossed repeatedly. Lai, in the party’s telling, was not just a lone troublemaker, a label he welcomed, but the mastermind of a plot to sow chaos. Party-controlled media outlets condemned those they saw as supporting him, including American diplomat Julie Eadeh, who is now the U.S. consul general in the city; her bosses in the State Department; and other so-called “anti-China elements,” including a former U.S. naval intelligence officer, Mark Simon, who worked as a business adviser to Lai. Wen Wei Po, a party newspaper, described Lai as the “number one political agent painstakingly cultivated by the United States in Hong Kong.” The evidence for this, rolled out in a fiery propaganda article since his arrest and in prosecutors’ arguments during 156 days of court proceedings, consists mainly of the fact that he met at various times with U.S. officials, made disparaging remarks about the Communist Party, and supported foreign sanctions for the curtailment of basic freedoms guaranteed in the 1984 agreement with Britain. In their 855-page ruling Monday, the judges said the evidence against Lai clearly proved him guilty. An ebullient self-made millionaire and churchgoing Roman Catholic, Lai fled to Hong Kong at age 12 from China’s neighboring Guangdong province. He made a fortune from a retail clothing chain, Giordano, but later threw himself into publishing, founding Next, a weekly magazine, and Apple Daily, both now defunct. Unlike many in Hong Kong, he disagreed with young prodemocracy activists who voiced indifference over the state of China and insisted they were not Chinese, but Hong Kongers. A few even called for “independence” for Hong Kong, a cause Lai never supported. Each year he attended a candlelight memorial event in Hong Kong for those killed in the Chinese military’s assault on peaceful protesters in and around Beijing’s Tiananmen Square in 1989, and voiced support for Chinese dissidents who shared his concern over their country’s direction. Hong Kong authorities have effectively banned the Tiananmen vigil since 2020, bringing the city into line with the rest of China, where any mention of the 1989 bloodshed is taboo. Lai’s quarrel with Beijing, he said in the 2019 interview, was never over patriotism — literally “loving country” in Chinese — but over “loving the party,” a fusion of political and national loyalties at the heart of Xi’s concept of nation. “I always feel Chinese because I belong to the older generation,” Lai said. “I had always hoped that China was changing and would become a democracy. I was wrong. It was wishful thinking.”

How tech’s biggest companies are offloading the risks of the AI boom

T

his fall, Microsoft announced a series of deals, totaling tens of billions, to lease computer power for its artificial intelligence ambitions. Meta secured almost $30 billion in financing to build a massive data center in Louisiana without taking on the debt itself. Google also committed to rent computing power from a small company and then sell some of it to OpenAI. Those deals had one thing in common: They allowed companies that make massive quarterly profits to reduce their financial exposure to the frenetic, global buildup of data centers. They also signaled new ways the biggest companies in tech are maneuvering to push some of the risk of the AI boom onto the shoulders of upstarts eager for a piece of the action. The moves let companies like Meta and Microsoft add computing power quickly and then wait to see how demand for AI shapes up before committing to projects that can last for decades. Trillions of dollars are at stake as tech companies try to predict how much computing power AI will demand years down the line. If the big companies decide they don’t really need all that computing after the deals are over, the smaller companies and their lenders will be stuck with the consequences.

“Risk is like a tube of toothpaste,” said Shivaram Rajgopal, an accounting professor at Columbia Business School. “You press it here, it is going to come out somewhere else. It’s always in the system, it’s a matter of where.” These deals also add a level of mystery to data center financing because many companies running the data centers for the tech

giants are far from the household names of Silicon Valley. Some are privately held, do business with large startups, and borrow from private lenders, all of which offers less transparency about their stability. Meta’s data center project in Louisiana mixes many of those creative financing elements into a multibillion-dollar plan taking shape among farmlands in the northeast corner of the state. Meta created a so-called special purpose vehicle named Beignet Investor LLC and worked with Blue Owl Capital, a private credit firm, to borrow money for the project. Meta was responsible for constructing the data center, but Blue Owl was on the hook for 80% of the financing. As part of the arrangement, Meta agreed to “rent” the data center from Beignet with a series of four-year leases. That allows the tech giant to categorize the funding as operating cost, not debt, according to financial filings. As part of the deal, Meta is paying a premium to Blue Owl so it doesn’t have to borrow the money itself, said Solomon Feig, a private credit lender at Pinnacle Private Credit. “Instead, Meta is renting risk,” he added. Blue Owl primarily funded the project, called Hyperion, through a bond offering from Pimco, an asset management firm. Pimco, in turn, sold the so-called “Beignet bonds,” which mature in 2049, to clients including insurers, pension funds, endowments and financial advisers. BlackRock also

bought some of the bonds. “The key part of Meta’s strategy, in my view, is that they’re going to get as much of this built out with what the industry calls OPM: Other people’s money,” said Andrew Rocco, a stock analyst at Zacks Investment Research. If the AI boom were to slow, Meta can walk away from the deal as soon as 2033. How much it may have to pay depends. Blue Owl could find a new customer or sell the project, though the data center’s value could depreciate if demand for AI underwhelms. Meta promised to cough up enough cash to effectively repay the underlying debt without formally putting that debt on its books, said S&P Global, the ratings firm. Other tech companies have expressed interest in similar financial structures. But since this was the first-of-its-kind, Meta provided more protections than future deals may require, according to two people involved with the deal who spoke on the condition of anonymity. Rajgopal cautioned that the arrangement recalls other investment booms that relied on private credit and special purpose vehicles, which are less transparent ways of raising funds than through the traditional banking sector. “I thought we had solved the off-balance-sheet problem,” he said, referring to the accounting methods banks used in the lead up to the dot-com bubble of the 2000s. “This is like Groundhog Day all over again.” Meta declined to comment. Big tech companies are also signing massive deals with a new generation of data center providers known as neoclouds. Typically contracts for three to five years, these deals give them more computing power quickly, without locking into decades-long commitments. By agreeing to shorter deals, big companies can get computing power that shows up in their financial reporting as a day-to-day operating expense, rather than a long-term capital investment, which can spook investors. Industry experts say the costs of the AI build out have gotten so large that it is no longer possible to mitigate most of the risk. So the tech giants are spreading it around. “It is very savvy of them,” said Alex Platt, an analyst at the investment bank D.A. Davidson. “There are only a handful of companies that can even do it.”

Mark Norell, who studied link between dinosaurs and birds, dies at 68 By RICHARD SANDOMIR

M

ark Norell, a globe-trotting paleontologist whose research focused on the evolutionary links between dinosaurs and birds, and whose expeditions yielded rare discoveries like the nearly intact embryo of a birdlike oviraptor, died Sept. 9 in Manhattan. He was 68. His death, in a hospital, was caused by heart failure, said his brother, Todd. Mark Norell, for many years the chair of the American Museum of Natural History’s division of paleontology, hunted for fossils in China, Chile, Argentina, Romania, the Sahara and Mongolia. His main research was on the links between theropod dinosaurs — a group of two-legged carnivores — and birds, the subject of “Dinosaurs Among Us,” one of the exhibitions that he curated at the museum, in 2016. Asked at the time of that exhibition by WNYC radio host Leonard Lopate if all birds were descendants of dinosaurs, Norell said, “They certainly are. Just like humans are a kind of primate, birds are a kind of dinosaur.” Dinosaurs did not go completely extinct, he added; they survived as birds. After decades of Western paleontologists being barred from hunting for fossils in Mongolia, Norell and Michael Novacek in 1990 led a team from the Museum of Natural History that explored the desolate terrain of the Gobi Desert in association with the Mongolian Academy of Sciences. In 1993, in the summertime heat of the Gobi, the group discovered an astonishingly fertile fossil field called Ukhaa Tolgod. Its many varieties of remarkably well-preserved skeletons included birdlike dinosaurs like oviraptors and velociraptors, lizards and mammals. “The Gobi is a paradise for paleontologists,” Norell wrote, with his colleagues Novacek, Malcolm McKenna and James Clark, in Scientific American in 2014. “Its eroding terrain exposes nearly complete skeletons of creatures hitherto known only through painstaking reconstructions from a few scattered bones. Freshly exposed skeletons sometimes look more like the recent remains of a carcass than like an 80-million-year-old fossil.” Novacek recalled in an interview that the team had already made some im-

The team discovered more nesting oviraptors at the site over the next few years, as well as specimens of other dinosaurs, like the beaked, herbivorous protoceratops. The behavior of the nesting dinosaurs further confirmed their connection to birds, Novacek said, with their careful positioning of the eggs, which was probably a way to optimize incubation. “That really underscored the close relationship between living birds and di-

As a child, he collected insects, rocks and fossils and made museum-style displays in his room, including one of a coyote skeleton that he reassembled. In middle school, his science teacher recommended him for a program in the paleontology department of the Los Angeles County Museum, and in high school, he accompanied its scientists on fossil hunts in the Mojave Desert and Mexico. He earned a bachelor’s degree in zoology from California State University, Long Beach, in 1980; a master’s degree in biology from San Diego State University in 1983; a master’s in philosophy from Yale University in 1986; and a doctorate in biology from Yale in 1988. He lectured at Yale for a year before he was hired by the Museum of Natural History as an assistant curator in 1989. He was promoted to curator in 1999, when he was also appointed chair of the museum’s paleontology division, a position he held from 1999 to 2006 and again from 2008 to 2021, when he became chair emeritus. Norell was a curator of numerous exhibitions at the museum, including “Dinosaurs of Jurassic Park” (1993) and “Fighting Dinosaurs: New Discoveries from Mongolia” (2000), about the 80-million-year-old fossils of a velociraptor and protoceratops that were preserved in the heat of battle, the former’s foot claw sunk deeply into the neck of the latter. “There is no doubt these animals were fighting,” Norell told New Scientist magazine. “There is nothing else like the fighting dinosaurs, which captures direct evidence of a single instant in time.” His books included several aimed at children, like “Searching for Velociraptor” (1996) and “A Nest of Dinosaurs: The Story of Oviraptor” (1999), both with Lowell Dingus, and “Unearthing the Dragon: The Great Feathered Dinosaur Discovery” (2005). Touting the article as “Secrets of the Wildman,” the magazine called him the “Obi-Wan Kenobi of ‘dirtbagging,’” for sleeping on the ground, refusing to use high-tech camping gear and, during a five-week desert expedition, changing clothes once and bathing twice. “I bring stuff I can wear and dispose,” he told The New York Times in 2000. “A ripped and trashed T-shirt with a little gasoline on it starts a pretty good campfire.” Mark Allen Norell was born July 26, 1957, in St. Paul, Minnesota, and grew up mainly in Downey, California, near Los Angeles, with his parents and brother. eep-pocketed baseball organizations have gained an advantage in recent years by flexing their financial muscle in the minor leagues. By spending significantly on cutting-edge tools like high-speed cameras and motion capture technology to gather in-game data, those teams widened the information gap over their rivals with fewer resources. Not anymore. Beginning next season, Major League Baseball will regulate the in-game technology available for use across all minor league parks, multiple people around the league told The Athletic. The move is designed to bring parity and to quell what until now has been an unchecked arms race. “We are taking this step to ensure that all 30 clubs are working with the same set of information as they make baseball operations decisions,” an MLB spokesperson said in a statement confirming the change. “Each club can use the information however they see fit, but it is important that we provide a level playing field on access to information.” The league will now approve in-game

data and technology vendors, a change that for many teams could mean access to new information at the minor league level. But for clubs that have already made significant investments in technology they have come to rely on, the rule change could result in the removal of that technology from their stadiums if it is not approved by the league. Critics called the new policy an antispending measure that will curb innovation, render some past investments useless and set the sport on a path toward more stringent limits on front office spending. “That’s definitely a concern,” one research and development executive said. “And there has been a vocal subset of owners that have wanted to limit front office spending for a while.” According to people with knowledge of the situation, who were granted anonymity because they do not have permission to talk about the change publicly, certain executives were informed of the development at the general manager meetings in November. By last week’s winter meetings, the talk about this news was rampant among executives who deal with data and technology. The goal of the new rule appears

straightforward: give every team in the minors the same set of data and video, just as the league has done in the major leagues. That stands in contrast to the current system, which has led to disparity. For example, though some organizations have spent to install Hawk-Eye tracking data at all of their minor league stadiums, others have not. That could change with centralization, in which MLB would pay to install the new technology where needed. Though it remains unclear which technology and data vendors will be approved, the league has acknowledged the possibility of some teams needing to scale back. “The effect will be different by ballpark, as some facilities will see additional tech installations while others will be unchanged or reduced,” the MLB spokesperson said. “MLB will pay for and manage the technology.” In the past, well-heeled teams were able to take meetings with different technology providers and invest if they thought there was additional value with the new product. Many of those teams also pressed their financial advantage by securing every available technology to accumulate as

much data as possible — even if they were not yet sure how to use the data and might only figure it out later. The rule change takes away that ability to gather now and analyze later. Multiple vendors privately bemoaned the decision, even if they still theoretically have the opportunity to work with the league. “We won’t know what sort of innovation we’ll miss because of this,” one highlevel research and development analyst said. “But we’ll probably miss out on something.” There’s also the question as to whether the move will have a negative effect on the quality of data in the minors. Consider Kinetrax, an in-game markerless motion-capture company that produces biomechanical data. Multiple teams prefer Kinetrax to Hawk-Eye, which is a partner of the major leagues. Since late last year, the firms share the same parent company (Sony), which could make it more likely that they will be one of the approved vendors. But Kinetrax is also a premium product with a high price tag, and MLB may balk at upgrading every minor league park to include that costly technology. “We’re a Kinetrax team,” a frustrated research and development executive said. “What will we do with our systems and existing tech if they aren’t approved?” Some teams use additional high-framerate cameras, like Edgertronic, to augment their ability to analyze in-stadium movements. Catapult, a wearable technology that tracks player movement and can help teams understand fatigue better, is used by major and minor league players — but only in games at the minor league level. The future of those pieces of technology in minor league games might also be in question. An all-team memo will probably clear up the many questions front office employees have, including what exactly constitutes data or technology versus a service, which types of technology might have to be taken out of current stadiums, and how minor league complexes might be regulated compared with minor league stadiums. The details of this developing issue will be ironed out over the course of the offseason, executives were assured. Whether they like the answers remains to be seen.
