Corruption convictions overturned

2nd trial pledged for Dean, Adam Skelos on Nassau-centered charges BY JA N E LL E CL AUSEN A federal appeals court overturned the 2015 corruption convictions of Dean Skelos, the former Republican majority leader of the state Senate, and his son, Adam, on Tuesday. The decision by the U.S. Court of Appeals for the 2nd Circuit cited a U.S. Supreme Court case involving former Virginia Gov. Bob McDonnell, which narrowed the deďŹ nition of an â&#x20AC;&#x153;oďŹ&#x192;cial actâ&#x20AC;? and what constitutes corruption. Because of this, the court said that jurors in the Skelos case were not instructed properly. â&#x20AC;&#x153;Because we cannot conclude that the charging error was harmless beyond a reasonable doubt, we are obliged to vacate the convictions,â&#x20AC;? the decision said. Skelosâ&#x20AC;&#x2122; defense attorney Alexandra Shapiro applauded the deci-
sion. â&#x20AC;&#x153;Senator Skelos is grateful for the Courtâ&#x20AC;&#x2122;s careful consideration of the issues and looks forward to the next steps,â&#x20AC;? Shapiro said in a statement. â&#x20AC;&#x153;We believe that as events unfold it is going to become clear that this is a case that never should have been brought.â&#x20AC;? Prosecutors, meanwhile, said they intend to retry the Skeloses, who have been free during the appeal. â&#x20AC;&#x153;While we are disappointed in the decision and will weigh our appellate options, we look forward to a prompt retrial where we will have another opportunity to present the overwhelming evidence of Dean Skelosâ&#x20AC;&#x2122; and Adam Skelosâ&#x20AC;&#x2122; guilt and again give the public the justice it deserves,â&#x20AC;? acting U.S. Attorney Joon H.
