Standards of Disclosure: Owner vs. Trustee

Owner Occupant has highest disclosure duty > actual knowledge + issues they reasonably should know about because they live there.

Two main disclosure documents CA home sellers provide: Real Estate Transfer Disclosure Statement and Seller Property Questionnaire

Trustee Seller

Trustee Seller > actual knowledge only. no duty to disclose what they don’t know. BUT

Trustee sellers can still be liable if:

1. Fail to disclose items known to trust — e.g., prior water damage, insurance claims, unpermitted work

2. Make affirmative misrepresentations—saying “no” instead of unknown, providing information beyond actual knowledge

This also could expose the beneficiary of the trust (aka homeowner) to potential liability.

e.g., Trustee Seller who did not live in property should NOT fill out the Seller Property Questionnaire because could create liability for affirmative misrepresentation on the many “yes, no” questions.

What should trustee sellers do to disclose “actual knowledge” like water damage, past insurance claims, known unpermitted work?
