On July 29, 2021, Rajya Sabha passed the Limited Liability Partnership (Amendment) Bill 2021. The Cabinet gave its approval to the Amendment Bill on 28.07.2021. The Amendment Bill aims to make life easier for law-abiding businesses by decriminalising certain provisions of the Act.
The bill proposes a number of significant changes, including:
a) Introduction of the concept of ‘small companies’
b) Decriminalisation of certain offenses
c) Empowering Govt. to establish special courts
d) Authorisation to Regional directors w.r.t. compounding of offenses - fine only
e) Empowering Govt. to prescribe ‘AS’ and ‘Auditing Standards for a certain class of LLPs, etc.
