WHAT ARE DAMAGES? There is a difference between damage (harm) and damages In any claim for personal injury, it is necessary to establish the factual and the counter factual scenarios.

Damages are a sum of money intended to place the injured person in the same position they would have been in had they not been injured. Damages are supposed to compensate the injured person for the damage that they have suffered.
