INTRODUCTION 1. Petitioner Chittakone (“Alan”) Phetsadakone is a 47-year-old national of Laos who has lived in the United States since the age of three. In May 1998, when he was 20 years old, an immigration judge ordered Alan removed to Laos, based on a federal fraud conviction he pled guilty to upon the misadvice of counsel that he would likely not be deported. Upon being ordered removed, the government detained Alan for at least six months in an unsuccessful effort to deport him to Laos. In June 2001, immigration authorities released him from custody on an order of supervision. For twenty-four years, Alan has been fully compliant with that supervision order.
