Beforeapplyingforapet

InNSW,tenantscankeeppetsinarentalpropertyonlywiththelandlord’sconsent.Tenantsdo notneedtoaskforconsenttokeepanassistanceanimal.Alandlordcanonlyrefuseconsent forcertainreasons.

Atenantwhohassignedanagreementandwantstokeepapetinthepropertycanapplyto thelandlordusingthepetapplicationform.Landlordsmustgivetheirresponseusingthe sameform Ifthelandlordconsents,theycansetconditionsforkeepingthepetintheproperty, buttheconditionsmustbereasonable.Tenantswhohavealreadybeengivenconsentfora petdonothavetoapplyagain.

Asatenantconsideringapet,it'simportanttothinkabouthowthe petwillfitinwithyourlifestyle.Tenantsshouldbeawareofany requirementsforthepet,including: legalrequirements(suchascouncilrules,microchipping, registration,orlicences) carerequirements long-termcostsandneeds

Tenantsshouldalsoconsiderwhetherthepropertyisappropriate forthetypeofpettheywishtokeep.

Stepstoapplyforapet

Tenantsmustusethepetapplicationformtoapplyforconsentforananimal. Thisformcanbegiventothelandlordatanypointduringatenancyandmustbegivenbefore thepetiskeptintheproperty

Tenantsmust:

1.CompletesectionAofthepetapplicationform

2.Ensurealltenantswhoarelistedonthetenancyagreementsigntheform

3.Givetheformtothelandlordortheiragent.

Tenantsshouldkeepacopyoftheformfortheirrecords.Landlordshave21daystorespondto anapplication.Ifnoresponseisgivenwithin21daysaftertheapplicationisgiventothe landlord,thenthepetisautomaticallyapprovedwithoutconditions Landlordsshouldusethis timetodiscusstherequestwiththetenant,includinganyconditionsforconsent.

Torespondtothetenant’srequest,thelandlordmust:

1.CompletesectionBofthepetapplicationform

2 Ifsettingconditions–listthereasonableconditionsthatwillapplytokeepingthepet

3.Ifrefusingthepet–givethereasonsforrefusalandexplainwhythereasonapplies

4.Givethecompletedformtothetenant.

Tenantsinastrataproperty

Tenantsinastratapropertymayalsoneedseparateapprovalfromthestrataowners corporation,ifrequiredbythestrataby-laws.Thisisinadditiontothelandlord’sconsent. Beforebringingapetintoastratapropertytenantsshould:

1.Checkthestrataby-lawstoseeifstrataapprovalofpetsisneeded.

2.Ifstrataapprovalisneeded,followtheapprovalprocessintheby-laws.

3.Alsocompleteapetapplicationformforthelandlord.

4.Submitbothapplicationsassoonaspossibletoavoiddelaystothepetsbeingapproved.

5 Aftergettingboththelandlord’sconsentandthestrataapproval(ifrequired),bringthe petintotheproperty.

Notallstrataschemesrequirepetstobeapproved Checktheby-lawstoseewhatrulesthey haveforpets,includingrulesforkeepingpetsinthescheme.

Thestrataapplicationprocessisseparatetotheapplicationtothelandlord.Tenantscan applydirectlytothestrataforapprovalanddonothavetoaskthelandlordtoapplyontheir behalf

Therearelimitedreasonswhyanownerscorporationcanrefuseananimal.

Movingintoanewrentalwithapet

Tenantswithapetmustgetthelandlord’sconsentbefore bringingthepetintoarentalproperty.Whilelandlordscannot advertiseapropertyas'nopetsallowed',thisdoesnotmean thepetisautomaticallypermittedtomovein.Tenantsmay wishtoincludeinformationabouttheirpetintherental application,sothelandlordcanconsenttothepetbeforethe agreementissigned.Movingapetinwithoutconsentfromthe landlordmayresultinabreachoftheagreement

Reasonsalandlordcanrefuseapet

Alandlordcanonlyrefuseatenant’srequesttokeepapetinarentalpropertyfor specificreasons.

Thereisanunreasonablenumberofanimals

Thefencingisnotappropriate

Thereisnotenoughopenspace

Theanimalcan’tbekepthumanely

Theanimalwillcauseexcessivedamage

Theanimalisnotallowedunderotherlaws

Thelandlordlivesintherentalhome

Thetenantdidnotagreetoreasonableconditions

Conditionsforkeepingapet

Alandlordcanputreasonableconditionson keepingapet.

Landlordsandtenantsshoulddiscusswhat conditionsmaybereasonablefortheanimal beforethelandlordgivestheirresponse. Conditionsmustbelistedinthelandlord’s responsetothetenant’sapplication.

Reasonableconditions

Tenantsalreadyhavetocomplywiththeconditionsoftheiragreement,includingthatthe propertyiskeptreasonablyclean,thatthetenantdoesnotcauseorallowanuisanceto others,andthatthetenantdoesnotintentionallyornegligentlydamagetheproperty

Landlordscanaddadditionaltermstotheagreementasaconditionoftheirconsentforapet. Theseconditionsmustbereasonable.

Reasonableconditionsthatthelandlordmayaskforinclude:

Theanimalisnotallowedtobeindoors–thelandlordcanonlyaskforthisconditionifthe animalisatypenotusuallykeptinside(forexample,achickenoragoat)

Thecarpetsmustbeprofessionallycleanedattheendofthetenancy–thelandlordcan onlyaskforthisconditioniftheanimalwillliveindoorsanditisappropriateforthetypeof animalandproperty(forexample,keepingagoldfishshouldnotrequirethetenantto committoprofessionalcarpetcleaning).

Thepropertymustbeprofessionallyfumigatedattheendofthetenancy–thelandlord canonlyaskforthisconditioniftheanimallivesindoorsandisamammal.

Landlordscansetotherreasonableconditions.However,theseconditionsmustonlybeabout keepingtheanimalattheproperty

Unreasonableconditions

Therearelimitsonthekindsofconditionsalandlordmayputinplace.

Landlordscannotasktenantstoincreasethebondortherentasaconditionforallowingthe pet.Theycannotaskforanyotherformofsecurity,suchasrequiringinsurance.

Landlordsalsocannotsetanyotherunreasonableconditions.

Conditionsarelikelytobeunreasonableiftheyinterferewiththetenant’srighttoquiet enjoymentoftheproperty Forexample,ifthey:

areoverlyrestrictiveabouthowthetenantcanusetheirhome createobligationsonthetenantthatinterferewithorcontroltheirday-to-daylife areinconsistentwithrentallawsorotherlaws(includingexistinglawsaboutaccesstoor inspectionoftherentalproperty).

Disputesaboutpetapplications

Tenantscandisputealandlord’srefusalofapet,oraconditionofthelandlord’sconsent. Theycandisputethisif:

thereasonthelandlordrefusedthepetisnotapplicable,or aconditionsetbythelandlordisunreasonable.

Atenantorlandlordwhodisagreeoverarefusaloraconditionshouldhaveconstructive conversationsandattempttoresolveittogether.NSWFairTradingcanalsohelpbyfacilitating theconversationorbygivinginformationtobothpartiesabouttheirrightsandobligations

Thelandlordandtenantwillhavethemostcontrolovertheoutcomeiftheycanreacha decisiontogether.

Iftheissueisstillunresolved,thetenantcanapplytotheNSWCivilandAdministrativeTribunal (theTribunal).Thetenantmustapplywithin28daysofreceivingthelandlord’sresponse, unlessanextensionisgrantedbytheTribunal.

TheTribunalcan: giveanordertoallowthetenanttokeepthepetattheproperty remove,changeorreplaceanunreasonablecondition

Afterarequesttokeepapethasbeenapproved

Onceatenanthasreceivedconsenttokeepapet,itremainsforthelifeofthepetwhilethepet livesintheproperty.

Thismeanstheconsentdoesn’tchangeevenifthereisachangetothelandlord,theiragent, ortheagreement.However,ifatenantmoves,theywillneedtoseekconsentagainatthenew rentalproperty.

Tenantresponsibilities

Tenantshaveresponsibilitiesthatapplywhiletheyliveinarentalproperty.These responsibilitiesapplytoalltenants,includingthosewithapet

Thetenant’sresponsibilitiesinclude: notcausingorallowinganuisancetoothers,and notinterferingwiththereasonablepeace,comfortandprivacyofneighbours.

Atenantthatisnotcomplyingwiththeirresponsibilities,includingwithanyreasonable conditionsthelandlordputonkeepingthepet,risksbreachingtheiragreement

Makingchangestothepropertytoaccommodatethepet

Atenantthatwantstomakechangestotherentalpropertyforapetwillneedthelandlord’s agreementtothechanges.Tenantsshouldraiseanymajorchangesthatareneededtokeep theanimalinthepropertybeforesigningtheagreement,ifpossible

Alandlordmustnotunreasonablyrefuseconsenttochangesthatareminorinnature.
