AGM to highlight progress in strategic plan

his edition of ARCA News will be made available at the Association’s Annual General Meeting (AGM) which is being held at the London Zoo Conference Centre. I look forward to seeing as many members as possible at the AGM, where the achievements of the Association over the last 12 months and how the Association intends to progress in the future will be presented. A key element of the AGM presentation will be an update on the progress of the Association’s strategic plan which was launched last year. One of the main elements of the strategic plan was a review of the Association’s Site Audit Accreditation Scheme. Colin Seditas, ARCA Technical and Development Manager, and Geoff Silver, ARCA Membership Compliance Manager, along with the ARCA Membership Committee, have been reviewing the Audit Scheme to ensure it is fit for purpose. With HSE’s greater focus on planning and management of asbestos removal work, the intention is to introduce more elements of management and planning into the ARCA Site Audit Scheme. In addition, cost effective auditing software has been identified, and subject to the software developer’s assurances that they can modify the software to meet our needs, we intend to offer electronic auditing in the near future. One benefit to members will be that the audit report will be available to the member company’s management via email shortly after the audit is completed. As reported in the last issue of ARCA News ARCA offer the NVQ Level 2 Diploma in Removal of Hazardous Waste (Construction) – Licensed Asbestos qualification. All ARCA members paying the CITB levy will be able to take advantage of the generous grant funding that CITB provide for this qualification. Satish Patel, ARCA Training Manager, has been working hard to develop the ARCA assessment method for this qualification and has been working closely with CITB to ensure the assessment method meets with their requirements. The assessment process is now
complete and Satish Patel will report on the results of the NVQ pilot at the AGM. Full Contracting Members of ARCA (Licensed Contractors) should have now seen the ‘ARCA Membership Guide for Licensed Asbestos Removal Contractors’ which was published and mailed in August. The guide explains what ARCA does, and can do, for its Licensed Contractor members. Since the appointment of Colin Seditas as ARCA Technical and Development Manager (formerly of the HSE Asbestos Licensing Unit), many members have taken advantage of the unique services that Colin can provide to improve their management systems. Further details of this range of services is included in this edition of ARCA News on page 10. Members will recall that I discussed the installation of a new Customer Relationship Management (CRM) system some time ago. As a result of the original software supplier being unable to meet their own deadline for providing a system for ARCA an alternative software supplier was sought. I am pleased to report that development of the system is currently underway. I am sure that once the new software is live ARCA and its members will benefit from increased efficiencies and member engagement. Finally, it’s not too late to book your spaces at ARCA’s end of year Winter Party. The party is being held on the 28th November at the Belfry Hotel near Birmingham (see page 9). Join us and start the Christmas celebrations in style with an evening of first class entertainment.

ARCA Delivers Seminar in Dublin T
o introduce ARCA and its members in the Republic of Ireland, ARCA held a half day seminar on July 8th at the Clarion Hotel, Dublin. The seminar, ‘How to Manage Asbestos Safely’, was designed to inform delegates of the aims and objectives of ARCA in Ireland, provide an overview of the asbestos legislation in Ireland, provide practical advice on selecting competent asbestos surveyors and advice on how to manage asbestos in buildings. Presentations were delivered by Steve Sadley, ARCA Chief Executive, Geoff Silver ARCA Membership Compliance Manager, Darren Arkins, Senior Inspector, Chemicals & Prevention Division Health and Safety Authority, and ARCA and ATaC members. The seminar was attended by representatives from the Office of Public Works (OPW), The Health and Safety Authority (HSA), the National Treasury Management Agency, ARCA and ATaC members from Ireland, amongst others.
The seminar provided an excellent opportunity for delegates to consider all aspects of managing and working with asbestos from all points of view, and to get an understanding of how the industry fits together and operates in Ireland. From feedback received it was apparent that
the delegates found the seminar useful and informative: “It was a very informative conference with some very good speakers.” “Very much enjoyed the seminar. Professionally presented and information very valuable.”

First ARCA candidate to receive ILM unit certificate A
Satish Patel, ARCA Training Manager, presents ILM Unit Certificate to Jamie Purdon
RCA has presented an ILM certificate to the first candidate to complete and pass a course unit towards the leadership and management qualification. Jamie Purdon, Project Manager for Asbestos Abatement Services Ltd, received the certificate for passing the ‘risk management in the workplace’ course unit. “As soon as ARCA made the leadership and management qualification available I was keen to be involved. For my professional development and for the professionalism of the industry this qualification is a big step forward,” commented Jamie. “I have completed the risk management unit which was very well structured and presented, and during the assignment the tutor support was excellent. It’s great to have something to work towards and rewarding when you pass. Now I look forward to starting my second unit, motivating people in the workplace. Gerry Maguire, the MD of Asbestos Abatement Services Ltd and a Fellow of ARMI, has been very supportive as he understands the importance of professional qualifications, especially for managers. Also, as I am working towards this ILM qualification I was able to apply for membership to ARMI – I’m now a member! This qualification is a great step forward for managers, it’s a challenging course but covers some very interesting topics which should help all candidates become better leaders and managers. Thanks ARCA for developing and delivering this qualification, it’s what the industry needed.”

ARCA launch range of specialist services for the asbestos management industry Unique knowledge pool supports licensed asbestos removal contractors

RCA has launched a comprehensive range of services which has been developed to provide expert support and advice for the management and delivery of safe operations in this hazardous industry. ARCA’s team of experts in asbestos management, auditing and the Health & Safety Executive (HSE) licensing requirements, provide member companies with a unique knowledge pool to call upon. “All businesses need effective management and health & safety systems. In our industry this is particularly crucial. Clients’ legal responsibilities Appointing asbestos contractors

1) Clients are at the head of the procurement chain and they ultimately have the final say on the course of action to be taken during a project. Clients have enormous opportunities to control how a project is ultimately delivered. Clients can set standards for how they want the project to be delivered. They are in a position to make arrangements to check that others, that they are depending on to deliver the project, are doing what they need to do to manage health and safety. Therefore the law requires that clients make suitable arrangements for managing a project, and maintaining and reviewing these arrangements throughout the project, so the project is carried out in a way that manages the health and safety risks.
actions and inaction have an enormous impact on how work can be delivered, causing contractors to fail to meet industry and legal standards and potentially leaving clients with substantial criminal and civil liabilities, lengthy delays and disruptions to projects.
2) Commercial clients have a duty under Sections 2 and 3 of the Health and Safety at Work etc Act 1974 to ensure the health, safety and welfare of their employees and any persons who visit their premises or may be affected by work done on their premises. The Construction (Design and Management) Regulations 2015 (CDM 2015) place explicit responsibilities on clients. Successful projects require good coordination and cooperation between all parties. Clients’ decisions,
4) The human cost of asbestos disease is devastating and significant exposures are entirely avoidable. When asbestos is managed well, inadvertent exposure is prevented and asbestos will be dealt with in a controlled and safe manner. The financial and reputational costs of getting asbestos management wrong are substantial.

3) Clients are not expected to be ‘experts’ in either construction work or asbestos work, and do not need to directly manage or supervise the work themselves. However, they are responsible for ensuring appropriate arrangements are in place to manage and organise projects during both the ‘pre-construction’ and ‘construction’ phases of the project. This means appointing suitably competent people and providing them with sufficient information, time and resources to do the job properly.
Clients, principal designers and contractors 5) CDM 2015 responsibilities fall on three main duty holders. The CLIENT has overall responsibility for the successful management of the project (CDM 2015 regulations 4 and 7 and guidance at paragraphs 23-45 of HSE publication L153 Managing Health and Safety in Construction). Clients must appoint a PRINCIPAL DESIGNER and a PRINCIPAL CONTRACTOR (regulation 5). All three must communicate and coordinate effectively with each other (paragraphs 66-68 of L153). 6) In practice, the asbestos contractor is likely to fulfill the roles of both principal contractor and principal designer. Principal designers manage ‘pre-construction’ health and safety, ensuring cooperation between clients and others, and obtaining and interpreting relevant information, such as asbestos surveys. Principal contractors manage the ‘construction phase’, maintaining liaison with the client and principal designer throughout. Experience has shown that the early involvement and liaison between all duty holders delivers more successful projects.

The duty to manage and asbestos surveys 7) Regulation 4 of the Control of Asbestos Regulations 2012 (CAR) places a ‘duty to manage’ asbestos on those in control of non-domestic premises. Clients must assess the presence, location and condition of asbestos on their premises, and have management arrangements in place to make sure it cannot be inadvertently disturbed. There is no legal duty to remove asbestos: before appointing an asbestos contractor, a client should have considered whether it would be more appropriate to manage the asbestos materials in-situ. 8) Regulation 5 of CAR requires employers to identify the presence of asbestos (and its type and condition) before any building/maintenance/ demolition etc work is carried out that is liable to disturb the asbestos. Conducting a survey is the first step towards managing asbestos: a good survey will identify what is (or could be) present and this information must be then used to develop an appropriate management plan. Where asbestos materials have been identified,
or are liable to be present, the management plan would typically be based on a Management Survey. Where the client has commissioned work requiring refurbishment or demolition that will disturb the fabric of the building a Refurbishment and Demolition Survey would be required. In the past, some clients have specified “all risk contracts” for refurbishment or demolition work. In these cases, it is highly unlikely that they will be complying with their legal duties CDM 2015 and the Health and Safety at Work etc. Act 1974.
Appointing the right people 9) Clients need to make reasonable enquiries, satisfying themselves that contractors are appropriately resourced and competent for the work. During the selection process, the contractor’s management systems should be closely scrutinised. 10) For licensed asbestos work, and prior to handover of the work area for reoccupation or demolition etc., an analyst must be appointed to verify that a work area has been thoroughly cleaned and the level of airborne fibres in the work area is as low as reasonably practicable. It
is desirable that the analyst is employed directly by the client. This arrangement helps avoid any conflict of interest (perceived or real). Accredited analysts can be found on the Asbestos Testing and Consultancy Association’s web site, www.atac.org.uk
Scope of work 11) A clear, precise and accurate scope of work (or brief) provides a foundation for the whole project. Clients need to describe (a) why they are having asbestos work done, (b) what will follow on from the asbestos removal, and therefore, (c) what asbestos material needs to be removed. Where possible, the client should a) Discuss the type of survey required with contractor and surveyor, and b) Discuss how the area will be determined ‘clean’ and fit for reoccupation with contractor and analyst.

guidance notes Occupancy: other contractor and staff activity on the site that may need to be considered as part of the plan of work. Site restrictions and security: any security or access restrictions which may be applicable.
Provide accurate information to contractors 12) CDM 2015 gives clients the responsibility for preparing pre-construction information (paragraphs 42-43 of L153). Asbestos surveys are a critical component of such information. The asbestos contractor / principal designer should assist by helping to assess the adequacy of the information, identifying gaps and advising how these can be addressed. For example, if it was not possible to access all areas when the asbestos survey was carried out because part of the building was occupied, the contractor should advise the client to commission additional surveys, or make other reasonable enquiries. This should be done well before construction work starts, or it should be presumed that asbestos is present. 13) Clients should expect to hold a precontract meeting with contractors, allowing sufficient time for any issues arising to be addressed.
Liaise with contractors to ensure proper planning and site control 14) Asbestos contractors will need appropriate pre-construction information in order to prepare a suitable work plan. Contractors need time (and access) to assess the premises properly and discuss key site information with the client, such as: Access: transit routes, waste routes, location of decontamination unit and asbestos waste skip, including any segregation of these areas, which may be necessary. Services: location of water supply, well earthed electrical supplies and drains for decontamination unit wastewater discharge. Site hazards: known non-asbestos hazards particular to the site. The client needs to provide the contractor with details of relevant hazards on site.

Isolations: the relevant electrical, gas, and water isolations that have been carried out to ensure the work can be completed safely. ‘Hot Work’ will only be permitted in exceptional and fully justifiable circumstances, and, as it must be identified on the notification to the enforcing authority, it is likely to be challenged. HSE guidance states that hot working and asbestos removal are almost incompatible activities and therefore all avenues should be explored to remove the heat source. Wherever possible hot plant should be turned off and allowed to cool before asbestos removal work begins. Turning plant off may not always be possible, and therefore asbestos removal should be programmed for times when the plant will be cool i.e. summer months or other planned downtime. Existing emergency arrangements: the emergency arrangements particular to the site such as fire and evacuation procedures. Clients shall liaise with the contractor to establish the client’s point of contact in case of an emergency particularly with regards to weekend working and out of hours working.
what removal methods will be used to prevent / control exposure. 18) A good plan should be self-explanatory and able to provide the client with confidence that the project has been thoroughly assessed and resourced. Where generic assessments and method statements are presented in a plan of work, this may raise legitimate questions about the adequacy of the contractors’ planning process.
Good communication and coordination is maintained throughout the project 19) The client must confirm that effective arrangements have been made to coordinate the work. For example, asbestos contractors’ transit and waste routes must not be obstructed.
On completion: retain ‘health and safety file’ 20) HSE Guidance Note HSG 248 “The Analysts Guide” provides the framework for final clearance and reoccupation of any area from which asbestos has been removed. Agreements and procedures for completion should be agreed when the programme is scoped. The documentation should be handed to the client at the end of the project and formal site sign-off. The client should update asbestos management plans and registers, as necessary.
Ensure adequate welfare is in place 15) This requires cooperation, coordination and communication between all parties. Clients must confirm that adequate facilities (toilets and washing areas, rest areas, access to drinking water, changing rooms and lockers) are in place.
Allowing adequate time and space 16) Clients must allow sufficient time for asbestos surveys to be carried out. An effective Refurbishment and Demolition Survey cannot be carried out in an occupied building.
Ensure an adequate plan is in place for the work 17) For any kind of work with asbestos clients must ensure there is a written plan of work in place. For very simple, un-licensed jobs the kinds of work methods described in Asbestos Essentials may suffice. For licensed work a ‘suitable and sufficient’ plan of work is always required and is a standard condition placed on all licence holders. It must be prepared prior to work being notified to the enforcing agency, at least 14 days prior to work starting. The written plan of work should very clearly describe the scope of work and explain: what is being removed, where is it located and how is it fixed, how will it be accessed and

ARMI publish guidance
‘Competency within the Asbestos Removal Industry’ A
s part of the Asbestos Liaison Group (ALG) sub-committee on Training and Competency ARCA has assisted the sub-committee in producing industry guidance; ‘Competency within the Asbestos Removal Industry’. The guidance will be published by the Asbestos Removal Management Institute (ARMI) with endorsement from the ALG. The document provides guidance on how to produce an effective competency management system within the asbestos removal industry and it is applicable to all categories of asbestos licence holders. Asbestos Licence Holders (LHs) often ask ‘what is competence and how is it assessed?’ Most LHs will already be carrying out “competency assessment”, but probably in an informal and less structured way. Competence is simply the ability to perform a task to a specified standard; competence assessment involves using a range of methods to measure performance against that standard. Competencies are the skills, abilities, knowledge and behaviours that lead to successful performance. A defined set of competencies, related to performance standards for each role in a business, will demonstrate the standards of work that this organisation expects and values. Competency assessment is continuous and helps to identify training and support needs.

The guidance describes a process of continuous performance management, which can be applied to all types of LH and all employee positions. It will help LHs achieve and maintain compliance with legal requirements and will also help to identify training needs for specific individuals. Competence does NOT simply mean that the operative / supervisor / manager has a current training certificate.
LEGAL REQUIREMENTS A competency-based assessment process is needed as part of “effective management arrangements” and in order to identify training needs. This is an employers’ responsibility and it cannot be delegated. Employers can nominate others to do all or part of the work to assist them in complying with some or all of their duties. l Control of Asbestos Regulations 2012 w Regulation 10 requires employers to ensure that anyone liable to disturb asbestos during their work, or who supervises such employees, receives the correct level of information, instruction and training to enable them to carry out their work safely and competently and without risk to themselves or others. w Regulation 18 requires that every employer must ensure that only competent employees enter a respirator zone; and that adequate supervision is provided for any employees who enter a respirator zone. A competent employee means an employee who has received adequate information, instruction and training. l The Management of Health and Safety at Work Regulations 1999 w Regulation 5 requires employers to give effect to appropriate arrangements “for effective planning, organisation, control, monitoring & review of preventive and protective measures”. Effective management arrangements are a fundamental requirement for all licence holders. A competency-based approach to employing, supporting and monitoring staff will be central to this. l The Health and Safety at Work etc. Act 1974 w Employers have a general duty to provide information, instruction, training and supervision to those working under their control. The nature of supervision etc required will be strongly influenced by the competence of employees.

A competent individual has the experience, training, skills and expertise appropriate for the job at hand. Training is delivered in accordance with “training needs analysis”: this means that the employer assesses an individual’s actual performance and provides additional training (where needed) on the basis of that assessment. This will be more difficult to do (and demonstrate to the enforcing authorities) where the licence holder chooses to employ staff on a casual, or temporary basis. It is very important to remember that ‘training’ can be provided in many ways and is not only formal, classroom-based presentation. Training means providing information and instruction, leading to new knowledge, new skills and abilities or to change in behaviour. A line manager verbally coaching and correcting work practices on a live site is a form of training. Training could also include teaching, tool-box talks, discussions and demonstrations.
The guidance document describes a six-step process the ‘competency cycle’. Six steps have been described to make the overall process of competency management clear. In practice, the process can be flexible and often informal. Steps 3-5 (get evidence, TNA, train) may often merge together; for example, where a visiting manager observes an operative wearing coveralls incorrectly and immediately
advises on correct practice. Similarly, some steps will be repeated less frequently than others; for example, once roles have been identified (Step 1) they will only need to be revisited in the event of promotion, company restructuring, or doing an annual review, etc.
SIX STEPS OF THE COMPETENCY CYCLE 1. Establish the employees’ roles and duties. Identify the relevant skills and competencies for the position using the competency tables. 2. Agree performance standards in relation to relevant competency elements and the employees’ duties. 3. Collect evidence of the employees’ performance and compare with the desired performance standard. 4. Produce training needs analysis based on the gaps identified between the employees’ performance and the required performance standards. 5. Provide training to close performance gap(s). 6. Carry out on-going assessment to ensure continued competency.

Understanding How much responsibility does the employer have for human failures that occur remotely on one of their sites? The answer is, in most cases, full responsibility. This is a fact well established in law through the principle of vicarious liability where an employer can be held liable for the acts and omissions of its employees in the course of their employment. The key question in any case of vicarious liability is whether the employee was acting in the course of their employment or in some other personal capacity, and whether the employer had taken all reasonable steps to prevent such acts or omissions from taking place. One key to reducing human failure is to better understand what human failures are. It is generally considered that there are two types of human failure – human error and violations. This article focusses on types of human error, which can occur even with the best will in the world. Violations are deliberate actions, and will be covered in the next edition of ARCA News. It is estimated that human error is a cause in up to 90% of all workplace accidents1. Highly publicised accidents such as the Hillsborough football stadium disaster, the Paddington rail crash, the capsizing of the Herald of Free Enterprise, and the Kegworth air disaster all demonstrate the devastating effect of human error. Given the complexities and expectations involved in asbestos removal, no job is exempt from the possibility of human error, and therefore management has responsibility for ensuring that all reasonable steps have been taken, on every job, to reduce or eliminate human error.
With the existing health legacies related to asbestos exposure, how much tolerance should there be in accepting human error in today’s asbestos abatement industry? LARC’s who understand human error will have extensive systems and procedures in place to reduce human error to the lowest levels reasonably practicable, and will have a sound business case for doing so. Human errors are defined as unintentional actions or decisions, and surprisingly can happen to even your most experienced and well-trained employees. One type of skill-based human error is a Slip of Action, which can occur in very familiar tasks which may be carried out with insufficient conscious attention. These are occasions when you don’t do what you were meant to do, like performing an action too soon, or too late, in a procedure, such as asbestos removal procedures for a particular

Human Failure - part 1 You may be adequately managing the risks to your employees, but have you fully considered how well you are managing risks created by your employees?
material type, or for decontamination procedures. Some asbestos tasks are routine and very familiar, and are therefore prone to Slips of Action. Consequently, LARC’s have a site pack containing numerous standard procedures detailing, step by step, the sequence of actions for those procedures. Competent managers will be taking steps to ensure that these procedures are rigorously followed, with an audit trail of evidence to show that these risks have been adequately managed. Managers can also increase the opportunities to detect and correct such errors. A Lapse of Memory is when an employee forgets to do something, or loses their place midway through a task, often due to interruptions and distractions. These are more likely to occur when steps in a procedure don’t follow naturally, when tasks are complicated, or where employees may confuse two similar tasks. One way to reduce slips and lapses is to openly acknowledge to all workers that they do happen, so they are more likely to be corrected than concealed. Simply providing more training will not eliminate slips and lapses – effective procedures will be required2, along with robust checks to ensure they are followed. So the LARC management formulate and communicate the procedures, site teams (in particular the supervisor) perform and record the inspections, and the inspections are verified through a combination of internal and external audits. Itemised checklists are a very useful tool to confirm all actions have been completed, rather than just a single tick box to record that the task has been done, e.g. following an itemised checklist for each individual RPE inspection is far more effective (and less prone to lapses in memory) than just a blanket record of completion.

Hold points are often utilised, whereby a task cannot continue until a specified sequence of steps have been taken, and some contractors insist on photographs at the hold point as evidence of sequence completion. Authors of Plans of Work can decrease the likelihood of slips and lapses by ensuring the site layout and methods of work are in a logical sequence. Another type of human error is that of Mistakes, which are decisionmaking failures, and may be either rule-based or knowledge-based. Like Slips and Lapses, these are also unintentional, and arise when employees do the wrong things, believing them to be right. They occur when employees are under time pressures, often on complex tasks, or trying to do too many things at once – all of which can reflect the constraints that LARC’s could easily be faced with. Competent supervisors are essential in reducing the number of mistakes made on site, and especially if there are inexperienced operatives in the site teams. The use of diagrams in Plans of Work (e.g. sketch plan of enclosure, needle pattern for injection of surfactant, etc.) are valuable tools in clarifying intended actions and reducing the likelihood of mistakes. Photographs taken at the planning stage of a job could help to clarify the location and extent of the works, reducing the likelihood of costly mistakes. Thorough planning of asbestos removal works is not just about the more visible control measures, but must include the elimination or reduction to the lowest levels reasonably practicable, all opportunities
for human error. Acts or omissions on site may well stem from the way the jobs are planned, the design of the work methods, the clarity of procedures, and the standards of leadership and management at office level. Remember that an employer can be held liable for the acts and omissions of its employees on site, and for LARC’s, their licence is vulnerable if human failure is not sufficiently understood and managed. In summary, human error is inevitable. Reducing accidents and incidents, and minimising the consequences that may arise, is best achieved by understanding and learning from human errors, rather than by attributing blame. Feeding information from accidents, errors and near misses into design solutions and management systems can drastically reduce the chances of future accidents3. LARC’s who understand human error, and have systems and procedures in place, will be able to reduce human error to the lowest levels reasonably practicable. ATaC Apprenticeship uptake gathers momentum

The Advanced (Level 3) Laboratory Technician Apprenticeship (Industrial – Asbestos) is available through a number of Cogent Skills’ quality assured providers across England, and ATaC will provide qualified tutors to deliver the specialised asbestos training and assessments. The Apprenticeship will include three ATaC asbestos related modules - asbestos surveying, air monitoring and asbestos bulk analysis, along with NVQ and BTEC modules.

Fatal Injury Statistics T
he latest full-year statistics on fatal injuries in the workplace in Great Britain for 2014/15 is now available on the HSE web site In summary: w The provisional figure for the number of workers fatally injured in 2014/15 is 142, and corresponds to a rate of fatal injury of 0.46 deaths per 100,000 workers.
w The figure of 142 worker deaths in 2014/15 is 9% lower than the average for the past five years (156). The latest rate of fatal injury of 0.46 compares to the five-year average rate of 0.53. w The finalised figure for 2013/14 is 136 worker fatalities, and corresponds to a rate of 0.45 deaths per 100,000 workers.
w Over the latest 20-year time period there has been a downward trend in the rate of fatal injury, although more recently (since 2008/09) the trend is less clear. w There were 102 members of the public fatally injured in accidents connected to work in 2014/15 (excluding railways-related incidents).

Heating engineers in court over asbestos A Stockport heating engineering firm were sentenced after two of its engineers were exposed to asbestos while working at a Manchester school. Trafford Magistrates’ Court heard Flueclean were contracted to replace boilers in the boiler room of the school. However, two of Flueclean’s gas engineers were exposed to asbestos when they took the side panels off boilers which had asbestos insulation on the boiler casing.

Flueclean Installations Services Limited Lytham Street Works, Shaw Heath, Stockport, Cheshire, pleaded guilty to breaching Regulations 6(1) and 11(1) of the Control of Asbestos Regulations 2012 and was fined £4,000 for each breach with £3,517 costs. HSE inspector Kevin Jones said after the hearing: “Asbestos is the greatest cause of work related deaths in the UK with over 4,000 deaths arising from past exposure. “Contractors have a duty to ensure they protect
their workers from the risk of exposure to asbestos and must properly plan any work which is likely to disturb it. “In this case, Flueclean Installations Services Limited failed to carry out a suitable and sufficient risk assessment which if they had would have clearly identified that the work should have been carried out by a licensed asbestos contractor. As a result of this failing, two of their operatives were exposed to asbestos.”

sbestos management specialist Lucion Environmental has extended its laboratorybased analytical services after announcing their UKAS accreditation of “airborne asbestos fibre determination and fibre counting using SEM (Scanning Electron Microscopy) and EDS (Energy Dispersive Spectroscopy)”. As part of a recent £250,000 upgrade to its specialist laboratory facilities in Gateshead, Lucion’s extended analytical capability in SEM means clients can benefit from higher limits of asbestos detection, providing greater levels of reassurance and a choice of remediation management where it is required. Formal SEM accreditation from the United Kingdom Accreditation Service (UKAS) for the identification and quantification of asbestos fibres confirms that samples are analysed by fully trained and qualified laboratory professionals who are skilled in the use of Scanning Electron Microscopy.
Lucion receives UKAS Accreditation for Scanning Electron Microscopy The approval also extends to laboratory documentation procedures and sample analysis reporting procedures. Lee Kerridge, Lucion Laboratory Manager, said: “SEM allows us to count smaller fibres and also allows us to carry out low concentration tests which would not be possible using standard methods. The Energy-Dispersive X-ray Analysis (EDX) system fully integrated with the SEM allows us to determine whether or not any fibres found are asbestos, or another material.
The current method used during air monitoring and subsequent fibre counting (phase-contrast optical microscopy - PCOM) allows us to count only respirable fibres according to the World Health Organisation rules. However, this method cannot discriminate between asbestos fibres and other respirable fibre types. One of the main benefits for our customers is that the addition of the SEM to our laboratory allows us to take this a stage further and gives the client a definite identification of the respirable
fibres by Energy-Dispersive X-ray Analysis (EDX). EDX analysis gives a chemical composition of fibres found which can assist the client if the standard PCOM count shows as elevated, and also helps customers in the choice of the remediation management. SEM is useful for the client to conduct further analysis after background air monitoring has been undertaken. It gives a higher limit of detection allowing greater levels of reassurance.”

Female Health & Safety Manager breaks the mould
Asbestos removal is a male dominated industry, so it is unusual to see a female undertake an asbestos removal operative training course, especially when her role is not an operative but a health & safety manager. This summer, Lauren Fox, of Edenbeck Limited, undertook the ARCA three day operative training course, even though her role is health & safety manager. So why?

“I’ve been working in the asbestos industry for just over two years now, managing health and safety, as well as co-ordinating training for our workforce,” stated Lauren. “Asbestos removal is hazardous, dirty and sometimes is physically demanding due to the location of asbestos containing materials, so perhaps that is why it is seen as a man’s job. I thought the course would give me a better understanding of an operatives’ role – and as I like a challenge, I thought I should give it a go and try to break the mould!” “The course itself was excellent. The trainer was brilliant and made me feel so comfortable, as did his female colleague who assessed my competence in the decontamination unit,” commented Lauren. “The other trainees were surprised to see me on the course, but as I did everything they did over the three days I believe I earned their respect.”

Is your powered air respirator still certified?
U
sed by workers in high risk asbestos removal circumstances, Powered Air Purifying Respirators (PAPR) can stop 99.95% of airborne particles, using a motor to pass air through the filter to give a supply of clean air, providing a very high level of protection to workers. A key component of any respirator is the filter. However, did you know that in order to retain the safety certifications supplied with the PAPR once purchased, you must only use the manufacturer’s specific particulate filter tested and approved with the device? Failure to do so can leave employers and workers exposed to both legislative and safety failings. Rigorously tested as a complete device, from the blower, battery and hose to the exhalation valve and seal of the facemask or hood, particulate filters are critical to the whole system performance. PAPRs must meet the European standard for powered air filtering devices incorporating a face shield or visor (EN 12941) or a full facemask (EN12942), before making it onto the shelves. In addition the
CE certification, awarded to the manufacturer for the PAPR as a complete solution, gives you confidence that the equipment has met its legal safety requirements. With a vast array of particulate filters on the market Scott Safety has identified a worrying trend whereby companies are purchasing compatible alternatives and not the official filter tested with the device. Reducing risk and costs with good fleet management Good proactive management and control of company vehicle fleets is vital for reducing exposure on risk and substantial costs. Adept Vehicle Management Sales Director Mark Pedley, who manages and procures nearly 500 vehicles for ARCA and ATaC members, commented:
How do you help manage fleet safety and efficiency with customers? For one customer, with a fleet of over 150 vehicles, we have set up an internal Fleet Monitoring Team which consists of the customers HR and H&S Managers and our Outsource Fleet Manager. The team meet quarterly to discuss any issues and plan for the next quarter. They monitor driver assessments, tracker feedback, driving licence feedback and they also provide fleet health and safety ‘toolbox’ workshops for drivers and managers.
Why fit telematics to fleet vehicles? Telematics is a method of monitoring a vehicle and the data gathered can also provide an insight into driver behaviour and risk. Telematics can support fleet management in many ways including job mileage management, fuel reimbursement and

protecting company image (as vehicles are liveried with company logos poor/good driving reflects on that company). For example, poor and dangerous drivers can be identified, as data is available on speeding, braking and acceleration. To help manage any dangerous driving we have introduced a speed monitoring policy that includes a low cost online driver assessment test.
What impact has speed, acceleration and breaking measurement had? By introducing this management control we soon noticed that tyre wear, brake usage and fuel consumption had decreased. We are seeing a decrease in fuel usage of around 10-12% per year.
Is there an interest in ultra-low emission vehicles? We introduced hybrid vehicles onto our customers fleet policies two years ago for managers who travel further than is feasible with an electric vehicle. In truth, this has been a lot more successful than we originally thought - one ARCA member has taken ten hybrid vehicles! Adept also have about forty Toyota Auris hybrid’s in their short term fleet for companies that have new starters on

probationary periods and require flexi contracts. Through our free environmental consultancy service we have helped customers reduce CO2 levels enabling lower banding, meaning savings for drivers and the company.
Have you introduced any other costsaving initiatives for customers? For some customers we manage fleet maintenance. One area we have recently reviewed is tyres – mileage and damage. So for some customers we now use budget tyres, enabling around a £1,000 saving on vehicle whole life tyre costs.

Support for members paying CITB levy Today over half of ARCA members pay the CITB levy and many are not aware of the grants available to them as a levy payer. As a result of this ARCA commissioned a pilot of the NVQ Level 2 operative qualification and following a successful trial ARCA launched this NVQ qualification at the AGM on 2nd October. Through ARCA all members can now undertake the NVQ qualification, a competency qualification which can be used to gain a CSCS card for asbestos removal operatives. Also those members paying the CITB levy will now be able to apply for a CITB grant to offset the costs of their operatives gaining this NVQ qualification.

3. So what are the steps involved in getting an NVQ?
1. What is an NVQ?
There are six steps to gaining an NVQ: a. Enrol and receive an induction onto the NVQ Level 2 Diploma – Licensed Asbestos. b. Site visits will be arranged between the individual, employer and ARCA assessors to collect the evidence for the NVQ on-site assessment. c. The ARCA assessor will provide support, assessment and guidance on constructing a portfolio of evidence. d. Once the ARCA assessor and the individual are happy with the portfolio it will be marked and then submitted to CITB National Specialists Accredited Centre for internal verification to check that the ARCA assessor has collected all the evidence and that it is suitable. e. Once approved a NVQ certificate will be issued. This will support an application for a CSCS asbestos removal operative card.
National Vocational Qualifications (NVQs) are work based awards that are achieved through assessment and training. NVQs are a set of work-based qualifications that recognise an individual’s ability to carry out a particular job role to the national standards. There are five qualification levels ranging from Level 1, which covers basic work activities, up to Level 5 for senior management. NVQ Levels 2 and 3 are broadly equivalent to 5 GCSE passes (at grades A*-C) and 2 A Levels respectively. NVQs were set up to meet employers’ growing needs for a consistent and reliable workforce, and to raise skill levels in commerce and industry within the UK. NVQs are: w based on the employee’s competence w relevant to their employment w separate from their training w assessed to national standards
2. How long does it take to gain an NVQ? There isn’t a one size fits all answer. Operatives new to the industry may take longer to complete the NVQ than those with experience of working as an operative. It also depends on how much effort an individual puts into completing the NVQ, if you are conscientious then you can qualify quicker. However, all operatives must complete and pass all the assessments within 12 months from the start date.
4. What will I have to complete to gain the NVQ Level 2? This NVQ Level 2 qualification is made up of five units which will need to be completed to attain the full qualification: w Unit 641 - Conforming to General Health, Safety and Welfare in the Workplace. w Unit 642 - Conforming to Productive Working Practices in the Workplace. w Unit 643 - Moving, Handling and Storing Resources in the Workplace. w Unit 462 - Installing and Removing Enclosure or Containment Areas for the Removal of Licensed Asbestos Materials in the Workplace. w Unit 463 - Stripping and Removing Licensed Asbestos Materials in the Workplace.

Competency relating to these units will be assessed on-site by an ARCA assessor. The assessor will, if required, offer advice and provide feedback on how to build a portfolio of evidence, to enable suitable proof of knowledge, skills and understanding of asbestos removal.
5. How do I book an operative on to an NVQ with ARCA? To book a place and start the process, contact ARCA on 01283 505777 or email info@arca.org.uk.
6. Can ARCA members who pay a CITB levy apply for a grant and how do they claim the grant for the NVQ? Grants are payable to those members that are registered with the CITB for grant and levy purposes. Grants are paid upon completion of the NVQ and can be claimed from the CITB. These grants are to help off-set some of the costs towards an operative gaining this Level 2 qualification.
7. What type of CSCS card can an operative obtain while working towards this NVQ qualification? There is a Trainee card available for new nonexperienced operatives who are registered on the NVQ. Prior to applying for the card applicants are required to have passed the CITB health, safety and environment test at the relevant level for their occupation. More information on the CSCS Trainee card can be found on the CSCS website (www.cscs. uk.com). There is an Experienced Worker card for operatives with on the job experience (normally at least one year in the last three). The card is issued
on a temporary basis (valid for one year and cannot be renewed), while the applicant is undertaking the NVQ. Prior to applying for the card applicants are required to have passed the CITB health, safety and environment test at the relevant level for their occupation. 8. Is there an NVQ for Supervisors? Not right now, but the industry is working on developing an NVQ Level 3 for Supervisors.
9. Can an asbestos removal operative work without a CSCS card? Yes, if a client does not request a CSCS card then an operative will not need one. However, most principal contractors require all construction workers on their sites to hold a valid CSCS card. Especially, those companies that form or are linked with Build UK.
10. How do I apply for a CSCS card? There is CSCS card application information on the CSCS web site, www.cscs.uk.com (type ‘Applying for a CSCS card’ into a search engine and you can go directly to the application page). The application web page applies to individuals and employers making applications on behalf of their operatives. Part of the application process will require the submission of the individual’s NVQ certificate and the CITB Health, Safety & Environment test (Operative Level) certificate (also known as a touch-screen test).
11. Where can I take the CITB health, safety and environment (HS&E) test? How do I book and how much will it cost? A HS&E test can be booked online, at a centre at a preferred location, once the individual has registered details at www.citb.co.uk. The correct page can be found easily by using the search function on the web site for ‘Book a CSCS test’. Bookings can also be taken over the telephone by calling 0344 994 4488. Lines are open between 8am and 8pm Monday to Friday, and 8am to midday on Saturdays. The date and time of the test will be given when booking, with confirmation of details sent by email or through the post. There is also the option to receive an SMS text message or email reminder 24 hours before your test. The cost, payable with booking, is £19.50.
12. I already have a CSCS green Construction Site Operative card so can I just renew this card? The green Construction Site Operative (CSO) card was withdrawn on 1st July 2014, so cannot be renewed, but will remain valid until its current expiry date. There is a new green CSCS card for people genuinely working in labouring occupations. There is more information on the CSCS web site (www.cscs.uk.com).

ast month saw two ARCA trainers travel out to Gibraltar to run a week’s training for HSE Consulting Limited.
“All the staff are very keen to keep up-to-date and refreshed on all aspects of asbestos removal,” stated Shaun Wilson, Lead Trainer and Assessor for ARCA. “We delivered refresher training to ten operatives and supervisors. We also delivered the surveying course as the company had four candidates for the RSPH Level 3 Surveying qualification. A busy but fulfilling week”. ARCA has been providing training for HSE Consulting for nearly five years, as the company continues to ensure that their staff receive ongoing training, and support for their professional development.
