A Footscray bar is spearheading a statewide drive to change rules banning dogs from Victorian bars and cafes after being threatened with heavy fines for allowing dogs onto the premises. Bar Josephine, billed as a ‘dog-friendly’ venue on Maribyrnong council’s own website, has been warned by the council not to allow dogs into the bar. The council earlier this year published an online guide to ‘dog-friendly cafes and bars in Maribyrnong’, listing a series of venues where dogs were made welcome.

Bar Josephine was listed on the site alongside a photo of dogs inside the bar. But the council has now told the bar it is breaching state food safety laws, despite no food being prepared on the premises. Food Standards Australia New Zealand regulations permit dogs in outdoor dining areas that are not enclosed, but there is no way to access the Bar Josephine beer garden without passing through the bar. Owner Aaron Donato told Star Weekly he will respect the ban but is fighting to overturn an “outdated nanny state law”. “When they told me this morning they had photographic evidence of dogs inside Bar

Footscray MP Katie Hall, who takes her dog Maggie to Bar Josephine, has promised to look into the matter. An online petition to Maribyrnong Council has raised almost 2000 signatures while another petition calling for changes to legislation has attracted more than 1000 signatures.

Substation wins funding By Goya Dmytryshchak Hobsons Bay council last week endorsed a three-year, $1 million funding agreement with The Substation despite calls from some community members to withhold the money. Councillors voted to enter into a triennial funding agreement with the Newport arts venue to provide $1,050,000 for the period of July 1, 2019 to June 30, 2022, with a proposed allocation of $350,000 referred to the council budget each financial year. The new funding agreement has some other key changes following heated controversy. As reported by Star Weekly, a community meeting was called in August by Darren

Williams, who had started a website called Save Our Substation. Mr Williams, who was the founder and president for 16 years of the Newport Substation restoration and redevelopment project, called on the council to withhold future funding to The Substation unless there was an open community membership structure. The Substation president Amber Stuart responded that the association had always acted in accordance with its rules and the law. Under the new funding agreement, the council has revised conditions including key performance indicators (KPIs) for local community involvement and the option for a councillor to represent the council on The

Substation’s committee of management. The terms of the new agreement include the establishment of a community ambassador role and community reference group. Cr Hemphill said the funding had been “quite controversial”. “We’ve had a number of discussions with all parties and there are some KPIs that have been developed and some suggestions as to how there could be better local community involvement,” he said. The council has advised The Substation of its intent to “step down the level of contribution” in future, noting its previous agreement is to support the committee of management to achieve a self-sustaining operation.

Oil spill source identified Boral Resources has received official orders to clean up the remains of an oil spill in Williamstown waterways this month. Parks Victoria confirmed the pollution, which started in Paisley-Challis Wetlands at Williamstown, had reached Jawbone Marine Sanctuary in Port Phillip Bay and impacted wildlife. The Environment Protection Authority has issued a clean-up notice detailing actions Boral must take to restore the creek and wetlands to their former condition. The notice follows an earlier minor works pollution abatement notice EPA issued, requiring the company to close an interceptor pit (a pit to trap pollutants like oil) on its premises as a preventative measure. Boral must comply with the legally enforceable clean-up notice by following a detailed plan and report to EPA and the other agencies each week on its progress. People are still being advised to avoid contact with water in the affected waterways. Signs along the Paisley-Challis Drain warn people not to eat fish from the waterway and not to allow pets to enter or drink the water. On Monday, the EPA issued a statement saying the pollutant had been successfully contained and plans were in place to deal with any rainfall that may boost flows into the wetlands. Goya Dmytryshchak

Call out for new nippers Children who love the sea or have an interest in becoming future lifesavers are being invited to join the fun at Williamstown beach. Williamstown Swimming and Life Saving Club has kicked off its summer Nippers program for children aged six to 12 years. Junior activities director Christine Polgar said it was a great way for children to make friends, be active and enjoy the beach in a safe environment.

“The Willy Nippers program runs on Sunday mornings from 9-10am,” she said. “This program has been formulated by Surf Life Saving Australia and is structured specifically to children of various ages and abilities and gradually teaches them basic lifesaving skills, first aid and how to be safe around an aquatic environment, in addition to developing their skills to compete in surf sports.

“The program is delivered by a group of enthusiastic volunteers and the Nipper parents themselves, and is a great way to get involved in all aspects of the club, both aquatic and social.” Everyone is welcome – just remember to bring bathers, sunscreen and a beach towel. Home invasion arrests

Five females were arrested at the scene of an Altona home invasion last Thursday night. A woman, 24, was sleeping in her Civic Parade home about 7.30pm when she heard a ruckus and opened her bedroom door to see a group of people smashing windows and damaging property. She locked her bedroom and called triple-0 before the intruders forced their way into her room and assaulted her. Police arrested five females at the scene. A Tarneit woman, 28, Hoppers Crossing woman, 19, and two Deer Park teenagers, 17, were charged with home invasion. A 17-year-old Tarneit teenager is expected to be charged on summons.

Foraging for food Finding ingredients in nature and preparing them to use in every-day cooking will be the focus of a foraging workshop, to be held at The Garden Feast in Werribee next week. Head chef Craig Huntley said that he and sous-chef Jason Brereton, often went “foraging” to find ingredients to use in the café’s menu. Mr Huntley said that he and Mr Brereton foraged for food items – including mushrooms, saltbush and seaweed – in coastal parks, forests and marshlands located in areas including Williamstown, Altona, Woodend and Point Cook. He said that people who attended foraging workshops at The Garden Feast were often “very shocked” to discover the variety of produce available in nature.

Mr Huntley said the café made all of its food in-house, except for bread, and did not purchase any pre-made or frozen ingredients. “I don’t write our menu, nature does – the reason we change the menu constantly is that we let the nature and the seasons dictate our menu,” he said. “We want to let the ingredients speak for themselves.” Mr Huntley will host a pizza-making workshop (cost: $45) at The Garden Feast on Saturday at 2pm, while the foraging workshop (cost: $25) will take place on Sunday at 2.30pm. Dog ban protects sandbar By Goya Dmytryshchak Dogs have been banned from a sandbar that has formed at the western end of Altona beach where the Esplanade meets Apex Park. As reported by Star Weekly in February, world renowned filmmaker and Altona resident Wain Fimeri had raised concerns about people crossing the sandbar which had formed over the mouth of Laverton Creek at Altona and accessing world-listed wetlands. The sandbar next to Doug Grant Reserve – a dog off-leash area – has extended the habitat area of Cheetham Wetlands, which is internationally recognised under the Ramsar environmental treaty and home to more than 200 bird species. From this area, the short-tailed shearwater migrates each year to Siberia and Alaska – one of the longest migrations of any life form on earth. Last week’s Hobsons Bay council meeting voted for the Laverton Creek Spit area to be made an exclusion zone for dogs in order to protect the significant conservation area. Cr Sandra Wilson said Parks Victoria had declared the spit one of the most significant feeding areas for migratory shorebirds and other seabirds. “This is on our doorstep and many people come from across the city, from interstate, from overseas to come and look at the significant birdlife that we have on our doorstep,” she said. She said in future she would propose naming the body of water that had formed as Shorebird Lagoon. Hobsons Bay council is offloading its unwanted furniture under a refurbishment of the Altona Civic Centre, with proceeds to benefit the local community. Office furniture no longer needed will be sold through the online sales portal of Egans with money raised going to the Hobsons Bay Community Fund to be distributed through its annual grants program. The refurbishment is part of creating a new customer service and community meeting space, with works due for completion by October 2020. The council’s customer service centre will operate from the Altona Theatre foyer until June 2020. Hobsons Bay mayor Colleen Gates said the community would benefit from the refurbishment. “We can’t wait for our community and staff to be able to enjoy the new working environment, meeting rooms [and] exhibition spaces,” she said. Petition calls for ground fix By Goya Dmytryshchak A petition from Williamstown Football Club for scheduled works at its home ground to be brought forward by three years was tabled at last week’s Hobsons Bay council meeting. As previously reported by Star Weekly, players are getting injured and games have been moved due to the ground being unfit for play. The petition, with 394 signatures, calls for council works scheduled for Downer Oval in late 2023, to instead start next October.

Cr Peter Hemphill told last week’s council meeting that works had not been completed at the time of the oval redevelopment several years ago due to cost cutting. “The ground gets horribly wet in the middle of winter and becomes virtually unplayable and I know one

AFL club that won’t play there during the height of winter,” he said. “It is an issue and I feel it was because there were costs cut when we did the oval and the development of the grandstand … unfortunately it’s had some consequences that we were not aware of at the time.” Cr Hemphill said he hoped the state government might come forward with some contribution, particularly since the club’s No. 1 ticket holder was “always a member of Parliament”.

Cr Jonathon Marsden said the inability to play at the ground – including night games – affected many other clubs. “It’s held to a higher standard than any other ground in Hobsons Bay so it’s unique in the sense that a judgement by an external body, that is the AFL, can effectively prevent anyone from playing on the surface for the period that it’s deemed unsafe, which has a knock-on effect to many other club,” he said. The council will bring back a report on the matter at the next appropriate council meeting.

Judo family on a mission The Coughlan family is making its mark on the world stage in a popular martial art. Siblings Eoin, Aoife, and Maeve – all students at Victoria University – are regularly jetting all over the globe to compete in judo tournaments. The siblings recently competed at the Perth Oceania Open, Aiofe Coughlan finishing fifth and Eoin claiming a top 16 finish, while Maeve was knocked out in her first bout. Eoin, 27, broke through as the Oceania Junior Champion in 2010 and 2011, before taking out the senior title in 2015. He represented Australia at the Rio 2016 Olympic Games and claimed a bronze medal at the Asian Open in Hong Kong in 2018. While travelling the globe in pursuit of his passion, the second-year apprentice is also juggling an electrical apprenticeship at Victoria University Polytechnic. Eoin said the course’s flexibility and VU’s support has helped him to balance his judo with work and study.

“I missed an exam while I was away competing and the teachers accommodated for that and I got to re-sit it,” he said. “When you’re competing, you have to be flexible and VU has always helped with that.” Aoife, 24, has been working her way through an exercise science degree and is now just five units short of graduating. “It’s a bit of struggle, but I’m enrolled in a block model, so that definitely makes it easier.” The block model involves students studying one unit at a time in intensive four-week blocks, rather than the traditional format of juggling several at once. Maeve, 21, has followed in her older siblings footsteps in both her chosen sport and choice of learning institution, studying exercise science like Aoife. “I can fully focus on sport while I’m away – and be fully focused on studies when I’m home. The west’s premier arts celebration finishes in style this weekend as the Due West Arts Festival comes to a close. Shining a spotlight on Melbourne’s west as a hotspot for art, culture and entertainment, a program of more than 40 events spread over 14 sites has been running since last Friday night’s entertainment-packed launch. The festival features a host of creative new forays into theatre, dance, visual art, spoken word and films by local, national and international artists. A vacant concrete block in the shadow of the West Gate Bridge at Spotswood is about to be transformed into Melbourne’s newest food precinct dubbed ‘Grazeland’, catering for 30,000 people. Located on land reserved for Scienceworks’ future expansion, Grazeland will span over 10,000 square metres and will have more than 50 sweet and savoury food vendors, three bars, two stage areas, roving entertainers and live entertainment. Grazeland managing director John Forman, who currently runs Eureka SkyDeck and Eureka 89, last week gave Star Weekly a taste of things to come now that all official approvals are in place. He said he was excited to turn the old industrial site into a foodies playground. “Every weekend when you come here, it will be like a festival feel and when people enter, it will have this excitement and a very Melbourne feel about it,” he said. “It will be a world of food, and if you look at the multicultural heritage of Melbourne and in particular this area, I think people will warm to it. “In Europe, they do it really well. If you look at Montpellier in France, they’ve got a similar-style concept. Crossing removal gets third hearing A third ‘Williamstown ideas workshop’ on the Ferguson Street level crossing removal has been added after an outcry from residents when the first two workshops were booked out almost immediately. Hobsons Bay council has already endorsed rail-under-road as the community’s preferred option for the level crossing removal at North Williamstown train station. Councillors voted to back the view of the Ferguson Street Williamstown Level Crossing Community Interest Group (CIG) in lobbying Public Transport Minister and Williamstown MP Melissa Horne for this option. Cr Jonathon Marsden told last week’s council meeting “the two workshops that have been advertised are insufficient for the community interest”. Cr Angela Altair told the meeting “there’s quite a deal of anxiety in Williamstown” about the crossing removal. The first two workshops, with a total of 120 places, quickly booked out. A third workshop with 120 places has now been added. Williamstown Crossing Group spokesman Lorenzo de Falco, who is also on the council’s Ferguson Street Williamstown Level Crossing Community Interest Group (CIG), said the group had several concerns over the lack of transparency of the Level Crossing Removal Project (LXRP) consultation process. “The workshop places are limited to 240, which means the people who are actually impacted may not be heard if others book

ahead of them,” he said. “Further, the workshops are before the summer holidays, despite LXRP having reassured us to the contrary. “We fear an unpleasant announcement right before Christmas, when people are distracted. “The only important question is the grade separation option. The community is clearly asking for rail under road, however the consultation format will have the effect of drowning this preference among other low-priority considerations.”

LXRP program director Tony Hedley said the workshop format had been used successfully on other projects to allow for detailed discussions on important issues. “We have also had staff out at local shopping centres and train stations encouraging people to join the conversation online, or submit their feedback in writing,” he said. “We want to make it easy for everyone to have their say, which is why we have replicated the structure of the workshops on our website and will equally consider this feedback.” Ms Horne said she had asked the LXRP to have a third session. The third ‘Williamstown Ideas Workshop’ is on Thursday, November 28 from 6pm to 8pm at Williamstown Town Hall. Registration is required.

Land value soars in the west By Benjamin Millar Land values in Maribyrnong and Hobsons Bay have skyrocketed in the past five years, with new figures showing almost half of the 20 inner-city suburbs to record the biggest price surge are in the inner west. A recent analysis by the Real Estate Institute Victoria on the price of land per square metre listed Essendon West (125 per cent), Parkville (86 per cent) and Deepdene (78 per cent) as the three inner-city suburbs with the highest growth in land value in the five years since

2014. But inner west suburbs took out most of the remaining top 10 places, finishing with eight of the top 20. The analysis, released last week, showed Maidstone coming in at four (67 per cent), Yarraville at five (66 per cent), Newport at six (63 per cent) and South Kingsville at seven (62 per cent). Kingsville finished ninth (59 per cent), while Maribyrnong came in at 13 (51 per cent), Seddon 17 (45 per cent) and Williamstown 19 (44 per cent). Brooklyn took out the number one spot for

middle ring suburbs, rising by a remarkable 148 per cent. REIV president Leah Calnan said the results show that despite a period of declining prices ahead of the recent upswing, property investment is going from strength to strength. “Melbourne’s outer growth southeastern and western suburbs are some of the fastest-growing parts of Australia,” she said. “While real estate commentary often focuses on clearance rates, it’s important to look at how the long term market is trending – as shown by the significant five year change in land value

per metre squared.” Ms Calnan said while sales volumes have declined, strong demand has continued to push up prices. She said location is always important, reflected in the suburbs recording the strongest growth. “These figures make for great reading; the Victorian real estate sector has demonstrated long term growth and stability,” she said. “In the west, Brooklyn provides great value with a median price of $1892 per metre squared, competing with neighbouring Footscray or Maidstone.”

The Inflatable Regatta is set to make plenty of waves when it makes its debut run on the mighty Maribyrnong this summer. Based on an idea first floated by Courtney Carthy, the regatta first took shape when Mr Carthy and his friends jumped into inflatable boats as a way to experience Melbourne’s urban waterways. The event sailed into history in 2016 when 500 people joined them on the Yarra River for the regatta’s first official run. “We thought 2018 was big when we had over 2000 people on the Yarra,” Mr Carthy said. “Then the opportunity came up to double that again, by holding it on the Yarra and the Maribyrnong – it’s going to be quite a sight.” Melbourne Water has come on board for the 2020 Inflatable Regatta as a way to promote the importance of clean, healthy urban waterways. Women of the water By Goya Dmytryshchak An all-women crew has built a traditional Scottish fishing boat known as a St Ayles skiff as part of a movement making waves across the world. Newport’s Jane Howard initiated a local St Ayles skiff-building project, inspired by a Scottish initiative to resurrect community spirit. In the past decade, Australian expat in Scotland Iain Oughtred has sold more than 300 boat-making kits around the world for coastal communities to build the boats for community use. Ms Howard recruited the Coastal Rowing Williamstown (CReW), a group of nine women, by putting up posters around Williamstown. “Having seen a St Ayles skiff being built by women in Tasmania,” she said. “We put a poster up saying, ‘Does anybody want to come and built a boat?’ “We’re all women from Hobsons Bay and our ages range from 40 up to late 70s. “It’s taken us three years to build a boat.” Williamstown boat builders Ferdi and Wendy Darley, based at Seaworks, supervised the project, which also involved Jodie Ebinger, Jodie Gregson, Lindy Marlow, Kay Robertson, Vicki Tyrrell, Mary Doohan and Anne Rogan. The 22-foot, four-person rowing boat will be made available to community members in Melbourne’s west in future. Ms Howard said the CReW planned to regularly row the boat out of Williamstown. “I just thought it was a fantastic community development project where the boat had to be built by the community and owned by the community,” she said. “There’s a whole community around the

A 600 square metre interactive ‘Air Playground’ will be launched at Scienceworks next month as part of its summer program. The Scienceworks gallery space will transform into six breezy worlds probing the powerful and elusive properties of air. The playground experience includes a giant inflatable for visitors to bounce and climb on, and gigantic bubbles blown across an ‘air-ena’. Children can play with the complex physics of compression and airflow, learn how to make objects levitate and master aerodynamics by designing paper planes. Another link in cycling chain By Benjamin Millar Cyclists riding from the western suburbs to the city have a safer journey in store following completion of a $4.8 million pathway upgrade along Dynon Road. Work on the bike path improvements began in March and was completed last week, helping to fix a key missing link between Footscray and the CBD. The upgrade included construction of new paths for cyclists and pedestrians along the northern side of Dynon Road.

Maribyrnong Street and Kensington Road are now linked by a two-way cycling path and a footpath, while a new shared path continues on to Highett Street and connects with a shared path through to North Melbourne. Pedestrian crossings at the Maribyrnong and Sims street intersections have been raised and signals installed at Maribyrnong Street. Other improvements include new line marking, extended kerbs and green pavement at intersections. Footscray MP Katie Hall said upgrading cycling infrastructure encouraged people to

get on the bike, helping them stay active and healthy while also cutting congestion. According to the Victorian Cycling Strategy 2018-28, four in 10 Victorians say they would be encouraged to cycle, or cycle more often, if there was a better-connected network and more inclusive cycling culture.

Looks a lot like Christmas ‘Tis the season to be busy, as Christmas festivities roll out across Maribyrnong. Christmas trees festooned with artwork decorations by pupils at all 15 local primary schools are now on display in Nicholson Street Mall in Footscray, where they will remain for the entire Christmas season. Fairy lights have also been installed throughout the mall to add to the festival glow lighting up central Footscray, with more lights winding their way through Seddon as well. Seddon is hosting an immersive ArtVo 3D art installation, while people will be able to ‘Elf –themselves’ in photos taken across Footscray, West Footscray and Yarraville. Letters can be posted to Santa at local libraries and a response will be sent to people’s homes. Children under 10 are invited to enter a colouring competition with a chance to win a Christmas hamper.

A series of events is also in store, including Braybrook Picnic in the Park at Braybrook Community Hub on December 6 and face-painting in a Seddon laneway on December 7. Kingsville Carols returns to Beevers Reserve on December 12 and Christmas in Yarraville in the pop up park on December 14. Runway choice delivers angst By Tate Papworth Keilor residents claim Melbourne Airport’s decision to build a second north-south facing runway will “kill” the area. The Airport’s decision, announced last Thursday, means that flights over suburbs including Keilor, St Albans and Bulla could increase substantially. Keilor Residents and Ratepayers spokesperson Susan Jennison said: “It’s a death knell … it’s devastating.” She said residents were concerned about the health and social impacts of another north-south runway and increased air traffic. “The big thing with this is that a lot of people are still not sure how it is going to affect them,” she said. Residents will consider their next move over the coming weeks. Airport chief executive Lyell Strambi said the additional runway is expected to open in 2025. “After a period of extensive analysis and consultation with industry partners, we’ve decided that building our third runway in the north-south direction is the preferred option over an east-west direction,” he said. “The main deciding factor is the availability of the runways in a north-south direction. They are just far more available for operations on more days of the year, particularly in those peak hours where capacity is really important to the airport.” More than 300,000 residents living in impacted areas will receive information packs

in the mail, starting from next week. “There’s no denying that a growing airport has an impact on the community. Some of those impacts are positive, some of those are negative and we have to work with the community to understand those and then find ways to deal with them,” Mr Strambi said.

“There’s a number of different ways you can operate a particular runway system to reduce the impact on your communities and that’s what we need to work through now – how best to run this airport and this new runway system which will create the best affect overall.” The airport hopes to begin construction on the new $1.5 billion runway in 2022. Mr Strambi said the main determining factor in the airport’s decision to scrap more than five years of planning on an east-west runway was availability, largely determined by the wind. “It’s complex but it’s wind, it’s the gusts that you’re dealing with, it’s wind turbulence around buildings, it’s a whole series of factors including windsheer. It’s about better understanding of the wind conditions at the airport,” he said. The plans will need to be approved by the federal government to progress.

MY PLACE Williamstown’s Rose McVicar is one of Hobsons Bay’s new recycling champions. She speaks with Goya Dmytryshchak. I have lived in Hobsons Bay most of my life. I am a current Williamstown resident and also grew up in Altona North. What do you like about Williamstown? It is a fantastic community, with so many of its residents so generous and willing to get involved. I also love all the heritage buildings throughout Williamstown. What don’t you like or what could be improved? I believe that all levels of government need to recognise the climate emergency and act accordingly – in fact everyone needs to act. I believe the quote by Robert Swan sums it up eloquently: “The greatest threat to our planet is the belief that someone else will save it”. What’s your favourite cafe and/or restaurant? I love the baked eggs at Crowed House and especially eating them in the courtyard on a nice day. What are you passionate about? I am passionate about sustainability and volunteer my time to hopefully help make a positive change. Here are some of the projects I am currently involved in: I am the founder of Recycling Made Easy, which is currently operating in all Hobsons Bay community centres; I collect secondhand runners via the drop-off point at Willamstown Sportspower and donate to various organisations including

charity West Welcome Wagon; I am on the West Welcome Wagon donation team, helping rehome secondhand and new items to asylum seekers families; I was part of the recent group of residents that successfully petitioned Hobsons Bay City Council to declare a climate emergency; I set up my local Buy Nothing Group and continue as a volunteer admin. This group is an online Facebook group that enables local residents to share/lend/borrow/give/ask and express gratitude. Can you tell us what being a local recycling champion involves? Council has redesigned its waste and litter collection service to proactively respond to both the recycling crisis and the change that the community wanted to see. The new system is about splitting our waste into different streams for better outcomes, which will result in an increase of service and deliver a purer recycling end-product. With a small bit of effort from all of us in the community, we can redirect almost half of household waste – in the form of food waste – from rubbish bins into a different stream: the food and organics green-lidded bin. Being a recycling champion is about helping to get the word out and supporting the community to use the new system effectively. The group will play as change agents and champions to support the new model and help improve recycling in Hobsons Bay. Through my research … I realised there was an enormous amount of confusion with recycling, which leads to unnecessary contamination.

Specialist Disability Accommodation (SDA) funding assists people with extreme functional impairment or very high support needs to access specialist housing solutions. “Our CareChoice Homes service aims to provide ‘forever homes’ for people with a disability,” Ms Cattermole says. “This is a lifechanging opportunity to live in a new home for

people who have not had that chance before. “This new wave of disability housing is transformative, moving away from the multi-resident homes of the past. “Participants might be inappropriately housed in a nursing home or community residential unit, or living with ageing parents, and uncertain about their future.” The large three-bedroom houses are designed for two participants, with an onsite overnight accommodation (OOA) room for a support worker. The six-star energy rated houses include structural provisions for ceiling hoists, extrawide hallways and assistive technology, as well as individual heating and cooling units to accommodate high physical support needs. Applications are open The West Gate Neighbourhood Fund has been established by the Victorian Government to support communities in Melbourne’s inner west during the construction of the West Gate Tunnel Project.

The $10 million government fund is managed by the West Gate Tunnel Project, Major Transport Infrastructure Authority, who are also responsible for managing the West Gate Tunnel Project on behalf of the Victorian Government.

Off the plan purchases The term ‘off the plan’ refers to the fact that the property being purchased does not currently have its own Certificate of Title on the Day of Sale. There are two types of ‘off the plan’ purchases: 1. The purchase of a vacant block of land. This is usually the purchase of a lot in a large-scale residential development (a housing estate). You purchase the land and then make your own arrangements to build a house on the land. 2. The purchase of a dwelling which is incomplete as at the Day of Sale. The dwelling may be partially finished and ready to move in to soon, or it may be a vacant block, with the dwelling still to be built. It may be a stand-alone house, townhouse, or apartment.

APARTMENTS The most common type of ‘off the plan’ transaction is when a large-scale developer sells residential apartments prior to construction having started. Given the scale of such developments, selling ‘off the plan’ is usually the only way to proceed, as a bank will not provide the many millions of dollars required to complete these developments until it is sure that the developer will make a profit. What this means is that, generally speaking, a significant amount of time can elapse between the date the Contract of Sale is signed, and the date settlement takes place (when the property is finished). In some cases, the timeframe can be more than two years. ‘Off the plan’ transactions carry with them both advantages and risks for the potential purchaser. Following is a short summary of those advantages and risks.

ADVANTAGES OF PURCHASING ‘OFF THE PLAN’ Minimal Upfront Investment: When purchasing an existing dwelling most vendors require the payment of a 10% cash deposit upfront. Generally speaking,

developers of ‘off the plan’ projects will be more inclined to accept a deposit bond or bank guarantee. These can be obtained for a fee far less than 10% of the purchase price. Secondly, as you will not be obtaining finance immediately (because the settlement is usually a long time away), you do not need to have saved the other 10% before you sign a Contract.

Sale and the settlement date, so may it deteriorate. In this case, a purchaser may end up with a property which is worth far less than what they contracted to pay for it.

Contractual Terms:

Sometimes a developer will offer incentives to purchasers in order to get a number of pre-sales (pre-sales are required so that the developer can obtain finance to start the project).

Vendors who sell large-scale residential developments ‘off the plan’ ensure that the Contracts that are prepared contain numerous special conditions that operate in the Vendor’s favour. These conditions can often be quite unfair for a Purchaser but are generally non-negotiable as a Vendor does not want to leave itself exposed to claims by many Purchasers.

Potential for Profit:

Dissatisfaction with Finished Product:

A potential benefit of having such a long delay between the Day of Sale and the settlement date is that there is a possibility that the property market will improve significantly. This means that by the time settlement falls due, the property may be worth significantly more than what you contracted to pay for it.

Often the reality of the finished product upon completion of the development is starkly different to all the glossy marketing material proffered by the selling agent at the time the Contract was signed.

Stamp Duty:

Another condition of the Contract of Sale will be that the Vendor can make alterations to the building plans where necessary. Although there is a limit on what changes can be made, that limit still leaves scope for some significant changes to be made to what you may have originally thought you were buying. Such changes include changes to floor covering, fixtures and fittings, external finishes and, in limited circumstances, changes to the layout of the apartment. This can often leave purchasers dissatisfied and with no legal recourse against the Vendor.

Purchaser Incentives:

This is the most well-advertised advantage of purchasing ‘off the plan’. Where you buy a property that is partially complete, including where construction has not yet commenced, you will only be required to pay stamp duty on a proportion of the total purchase price. This stamp duty concession is limited to purchasers who intend to occupy the property as their principal place of residence.

Changes to the Building:

RISKS OF PURCHASING ‘OFF THE PLAN’ Being Locked In: When you sign a Contract to buy a property ‘off the plan’, it will be a condition of that Contract that the Vendor has to have the plan registered by a certain date. This date is called the Sunset Date and is often at least 2 years from the Day of Sale (but can be as far as 5 years away). A purchaser can only withdraw from the Contract if the plan is not registered by the Sunset Date, so they are ‘locked in’ until that date.

Potential for Loss: In the same way the market may improve between the Day of

CONCLUSION As with all property transactions, ‘off the plan’ purchases carry with them both risks, and the potential for rewards. The main difference with ‘off the plan’ transactions is that the potential risks and rewards are somewhat greater than if you were to purchase an existing dwelling. Ultimately, you should give careful consideration to any property transaction into which you propose to enter, especially an ‘off the plan’ purchase.

ALTONA, the place to be No matter what the address in Altona, it’s never more than a six-minute drive to either the swimming beach, the iconic pier or the wonderful Cherry Lake. Mostly it’s less. This is a significant – though not the sole – reason for the rising number of families and singles moving in to Altona, writes Carole Levy Yes, there’s sea and lake and multiple reserves and a stunning pier as playgrounds for Altonians, but if you ask the locals you’ll hear just as often about the way you regularly run into friends and neighbours shopping, propped behind an alfresco coffee or picking up fish ‘n’ chips on Esplanade for Friday dinner.

While Altona has long been a literal hive of industry, it nevertheless has a seaside community soul, a strong identity underscored further following the influx of European migrants post WWII, bringing people who forged and relied on community links that continue to resonate today. Altona is home to many sporting clubs including Aussie rules footy, soccer, hockey, basketball, cricket and lacrosse. Melbourne Ballpark is a baseball complex, and golfers hit the greens at Kooringal Golf Club. Altona Sports Club is another business with a sporting focus.

Mediterranean, Vietnamese, Chinese, Thai, mod-Aus, Indian and Italian eateries bring the diversity demanded of Altona’s best-known strip, while the weekly Beach Market at Pier Street’s Logan Reserve attracts people from all over. Of course, there are neighbourhood cafes bedded down or sprouting in other places, emblematic of the trajectory this suburb is on – and to think it was once deemed the ‘bridesmaid of Williamstown’.

Louis Joel Arts & Community Centre is Altona’s cultural hub, with exhibitions, workshops, Arts Society and Joel Gallery, while amateur stage performers and singers can choose from three companies.

With all this, Altona is still affordable. First-home buyers can still snag a bargain, investors are getting in on solid returns, and families wanting a friendly coastal lifestyle can find their dream home. Altona is giving trendy Williamstown, Yarraville and Seddon a run for their money. The bridesmaid is definitely in line to catch the bouquet …

Is it time for Western United to shake up its starting line-up? Slow starts have been United’s Achilles heel so far in its inaugural A-League season. The issue reared again in an upset 1-0 loss to Newcastle Jets at GMHBA Stadium on Saturday night. “The mindset needs to be a lot better right from kick off,” coach Mark Rudan said. “The intensity, the energy, it has to be there right from the outset, [otherwise] teams will punish you, irrespective of who they are.” For the fourth game in a row, Western United stared a deficit in the face. United was made to pay for its lacklustre start by young Jets striker Angus Thurgate, who scored in the 36th minute. It was by no means a surprise lead for the Jets, who had been the more proactive side in the first half and were keen to pounce on the sloppy defending of the United backline. Rudan stopped short of suggesting there will be wholesale changes to the starting side because of the slow starts, but it will be up for discussion this week.

Bulldogs juggernaut rolls on By Lance Jenkinson Footscray is proving a tough nut to crack in the Victorian Premier Cricket this season. The Bulldogs can hurt you in all manner of ways with the bat in hand. The Allan Wise-coached Bulldogs showed the depth of their batting line-up in compiling 9-305 declared on day one of its two-day clash with Northcote at Merv Hughes Oval on Saturday. “We’ve been pretty consistent all year with the bat, but it’s sort of been dominated by our top four,” Bulldogs captain Dylan Kight said. “We went a different way about it [against Northcote], but still got the result that we were hoping for at the start of the day. “Our top order has been very good and dominant to start the season, but being part and parcel of cricket, you can’t expect that week in, week out. “We still had Matt [Underwood] and Trav [Dean] contribute really well and get us off to a good start, but when we were in that middle period at around 4-150, it could’ve gone either way. “For our middle order and our all-rounders to chip in and get us to 300 was good.” Footscray found the going tough early. The Bulldogs struggled to score freely, but Underwood (48) and Dean (63) battled it out to get their side on top with an 83-run second wicket partnership. “Northcote bowled really well and we definitely had to work hard,” Kight said. “It took a long while for us to get the scoreboard moving. “We just had to be patient and wait for the loose balls to come. “We just thought while Hamish was running hot, he was the confidence player of the day, so we gave him one over and he wasn’t far off getting a wicket in two out of his six balls.” While Footscray is pleased to have 305 on the board, it will need to work hard to defend the total. “The wicket is really good and the outfield is really quick,” Kight said. “We definitely have to bowl well to get 10 wickets.”

Altona women ready to hit the ground running Altona has put the foundations in place for its inaugural women’s team to hit the ground running in the Western Region Football League next season. The Valkyries have the infrastructure needed to house their men’s, women’s and junior section, and have a thriving youth girls set up that will stand the club in good stead for years to come. Above all, inaugural Valkyries coach Kerrie Clarke says the appetite for women’s football in Altona is there. “It’s exciting to start up something new, but it’s also exciting to see the interest that’s out there as well,” she said. “Because Altona has a very strong junior girls and youth girls, they needed a senior women’s team so they didn’t have to go off to other clubs. “They’ll have brothers or dads or whoever playing there, so it’s good to keep them there so they don’t have to go off to another club.” Altona went through significant pre-planning to prepare for its women’s team launch. was designed with a view to creating spaces for men’s and women’s teams. “They’ve got it all set up, so there’s nothing that has to be established, it is there,” Clarke said. “They knew the growth was going to happen as soon as the AFLW started.

“Therefore, at some stage there was going to be a senior side coming here, so they had to change the facilities because years ago they never had the facilities for males and females to use.” Just as important for Altona was the establishment of its girls teams. The Valkyries have teams in the under 14s, 16s and youth girls, so the pathway from the bottom to the top is now complete. “It’s already established and that’s what they wanted to start first,” Clarke said. “The youth girls go up to 18.5 now, so they can go up to seniors.” While the building blocks are in place for Altona, the recruiting for the senior women’s team goes on. Clarke has already began discussions with some VFLW players to call Altona home when they are not selected by their clubs. The Valkyries will also have a come and try day this Saturday at Civic Parade Oval from 10.30am to midday with a focus on new recruits from other clubs, code jumpers from

other sports and even new players wanting to try out football. Clarke is hopeful of a big turn out to the session. “It’s already on Facebook and Instagram and word of mouth of course,” she said. Clarke was vice captain of the VU Western Spurs last season. She has played for the Western Bulldogs in the VFL Women’s. While she might pull on the boots for a game here and there, Clarke said her priority would be coaching. That is why she is so keen to get some experienced on-field leaders, such as her VFLW targets, to point the way. “I know some of the girls have been selected for VFL sides need a community club, so there’s a couple that have said Altona will be theirs that are playing at Williamstown,” Clarke said. “They can share their experience and know what it takes to get to that next level because it’s a completely different level.” Lance Jenkinson

Sports shorts Soccer Michiel Hemmen has re-signed with Altona Magic in the National Premier League. The big striker showed glimpses of his quality with the Magic last season before a long-term injury forced him to return home to the Netherlands after just nine rounds. Hay on fire for Druids By Lance Jenkinson Michael Hay has propelled Druids to a competitive 238 with an “easy on the eye” display in the middle order against Sunshine United in their Victorian Turf Cricket Association senior division clash at Shorten Reserve on Saturday. Hay weaved his magic for the Wizards en route to a calculated 83 off 115 balls, including seven fours and three sixes. He timed his innings to perfection, knuckling down early on to get his eye in before launching late on. Only a run out – when he was pushed for a second run – could end Hay’s fun in the middle. “He batted really smart for the first 60 runs, pretty conservative,” Druids captain Leigh Wilson said. “Towards the end he sort of let loose and hit a few boundaries. “Whenever he’s batting, it’s fun to watch, it’s pretty easy on the eye. “He plays some of the best shots you’ll see at local cricket level.” Hay has been one of the form batsmen in the

top flight competition. The Druids star has made 182 runs at 45.5 and even got called up to play for Greenvale Kangaroos in the Vic Super Slam Twenty20 competition. “He’s got a bit of confidence now, so hopefully he can continue this form going forward,” Wilson said. Wilson was left in two minds about his side’s total of 238 off 78.1 overs. “It was one of those days where we felt we’d get to a point where we were just about to take the game away from them and then we’d lose a couple of wickets and bring them back into it,” Wilson said. “That happened two or three times during the day, so it was a bit of a topsy turvy one.” Elsewhere in senior division, Yarraville Club got a crucial breakthrough late to finish the day on a high against Haig Fawkner at Hansen Reserve. Looking for their first win of the season, the Titans were on the back foot after falling six runs behind in the third innings. BMW gets competition started By Ewan Kennedy, Marque Motoring BMW Australia says it will debut the BMW M8 Competition Coupé in the first quarter of 2020. It will be fitted with an updated version of the BMW M 4.4-litre V8 TwinPower turbo-petrol engine (460 kW / 750 Nm) and eight-speed M Steptronic transmission with Drivelogic. This will give it the ability to get from zero to 100km/h in just 3.2 seconds – that’s motorbike territory. Technical highlights include two twin scroll turbochargers in the V between the cylinder banks, indirect charge air cooling, direct injection with a maximum pressure of 350 bar, and cross-bank exhaust manifolds. We are assured it will produce a strong V8 sound thanks to the M Sport Exhaust system. A highly advanced M xDrive system offers 4WD, 4WD Sport and 2WD modes. Powerful M compound brakes are available as standard with blue calipers, while lightweight M Carbon Ceramic brakes are optional. The M8 Competition Coupé also comes with the BMW M Driver’s Package, that enables top speed of 305km/h.
