State Supreme Court reviewing FOID law constitutionality White County case draws national attention from gun rights and gun control advocates

The Illinois Supreme Court is being asked for a second time to decide whether a state law requiring gun owners to have a firearm permit is unconstitutional – a question the court previously declined to answer. The case involves a White County resident, Vivian Claudine Brown, who was charged in March 2017 with possession of a firearm without a Firearm Owner’s Identification, or FOID card. The charge was filed after her husband had called the White County Sheriff’s Office to report that she had fired a gun in their home. When officers arrived, they found a rifle beside her bed but no evidence that she had fired it. Nonetheless, she was charged with the crime. But a circuit judge in White County threw out the charge, saying the Illinois law requiring potential gun owners to fill out a form, provide a picture ID, undergo a background check and pay a $10 fee to obtain a FOID card was unconstitutional, at least as it applied to Brown. The judge said it imposed a burden on Brown’s Second Amendment

right to keep a firearm in her own home for self-defense. The circuit court went on to say, even though Brown’s attorneys never raised the issue, that it is impossible to comply with the act in one’s own home. That’s because it would mean anybody who had knowledge of a firearm in the home and exclusive control over the area where it was kept could be construed as possessing the gun and therefore would have to have their FOID card on their person 24 hours a day. The state appealed that decision directly to the state Supreme Court, but in April 2020, the high court declined to answer the question of the law’s constitutionality. Instead, it said the White County court had rushed to rule on the law’s constitutionality when it could have decided the case on other grounds, namely that the General Assembly never intended the FOID Card Act to apply in the home. The Supreme Court then sent the case back to White County with instructions to enter a modified order that did not touch on the constitutionality question. The White County court did that, but then in an unusual

move, Brown’s attorneys asked the court to reconsider, arguing that the modified order forced Brown to take a position she didn’t want to take and one that would ultimately be overturned on appeal, thus delaying any final resolution of the case, possibly for years. The circuit court agreed and reinstated the charges against her. Brown’s attorneys then filed a new motion to dismiss on constitutional grounds. The judge then upheld that motion, finding that “any fee associated with exercising the core fundamental Constitutional right of armed self-defense within the confines of one’s home violates the Second Amendment.” The state then appealed that decision back to the Illinois Supreme Court. During oral arguments Wednesday, Assistant Attorney General Garson Fischer argued that the law imposes only a minimal burden on people wishing to own firearms and it serves a legitimate state interest of keeping guns out of the hands of felons and mentally ill individuals. “It imposes a de minimis burden on law-abiding citizens to allow the state to determine

whether they are, in fact, a law-abiding citizen who has the absolute right to possess a firearm in their home for self-defense, or falls into one of these high-risk categories,” he said. “The FOID Card Act is the mechanism by which the state answers that question.” Fischer also noted that Brown never applied for a FOID card in the first place and therefore should not be allowed to argue that the law was overly burdensome. Appellate defense attorney David Sigale, however, argued that the law imposes a significant burden because it provides for criminal penalties against those who don’t comply, even if they are otherwise entitled under state and federal law to own a firearm. In addition, he argued that the law is duplicative because there are already state and federal laws prohibiting people with felony convictions or certain kinds of mental illness from owning a gun. He also noted that the screening process the state uses to determine whether someone falls into one of those categories is fallible, which results in people who are eligible for a FOID card having

to file appeals, and sometimes even hire attorneys, to overturn a wrongful denial. “So the burden is not de minimis, and the effect is not de minimis,” Sigale said. “It is not quick, it is not easy.” Some of the justices, however, still seemed to question whether the Supreme Court even needs to address the constitutional question. Chief Justice Anne Burke questioned why Brown’s attorneys asked the White County court to reconsider a decision that effectively dropped the charges against her. “Is it ethical for a criminal defense attorney to move to vacate an order that grants his client complete relief?” she asked. Attorneys on both sides, however, argued that it was because the order that the White County judge would have issued—dismissing the charge on the grounds that the FOID Card Act doesn’t apply to possessing a gun in one’s own home—probably would not stand on appeal. Justice Mary Jane Theis also hinted that the court could send the case back to White County as it did before. She then asked Sigale what his ethical

obligation would be in defending Brown before an appellate court if the White County court dismissed the charge on statutory grounds and the state appealed to the Fifth District Court of Appeals. “I guess, at best, I would have to say something ethically along the lines of, if the Fifth District agrees with the position of the circuit court and that original order, then we’ll take the dismissal and go home,” Sigale said. “But I would not argue that the trial court was correct.” The court took the case under advisement but did not indicate how long it might take to issue a decision. The case has drawn the attention of national gun control advocates such as the Giffords Law Center to Prevent Gun Violence and Everytown for Gun safety, along with gun rights advocacy groups like Guns Save Life Inc., and the Firearms Policy Foundation, all of whom submitted or contributed to amicus briefs in the case. The city of Chicago and Cook County also filed an amicus brief in support of the FOID law, saying it has been an effective tool in helping them combat gun violence.

The 2022 Illinois spring trout fishing season will open April 2 at 57 ponds, lakes and streams throughout the state. The Illinois Catchable Trout Program is funded by those who use the program through the sale of inland trout stamps. The Illinois Department of Natural Resources (IDNR) stocks more than 80,000 rainbow trout each year in bodies of water where trout fishing is permitted during the spring season. An additional 80,000 trout will be stocked for the fall trout fishing season, which begins in October. All anglers, including those who intend to release fish caught before April 2, must have a fishing license and an inland trout stamp unless they are younger than 16, blind or disabled, or an Illinois resident on leave from active duty in the Armed Forces. The daily catch limit for each angler is five trout. Illinois 2022 fishing licenses and inland trout stamps are available now at IDNR license and permit locations, including many bait shops, sporting goods stores and other retail outlets. For a list of locations, check the IDNR website at https://www.dnr. illinois.gov. Fishing licenses and trout stamps also can be purchased online. Biden signs legislation appropriating more than $14 million to Lake County infrastructure projects Lake County is slated to receive millions of dollars in infrastructure funding as part of a new federal bill. This week, President Joe Biden signed the 2022 Consolidated Appropriations Act that includes more than $14 million in funding for Lake County infrastructure projects. The infrastructure projects, which aim to mitigate flooding, strengthen emergency operations, replace aging infrastructure and expand behavioral health service, were selected among a list of projects submitted by Lake County’s US Representatives, Brad Schneider (IL10), and Lauren Underwood (IL-14) and US Senator Dick Durbin through the Community Projects Funding and Member Designated Proj-

ects federal initiatives. “Over the years we’ve worked closely with our federal delegation on Lake County’s infrastructure needs,” said Sandy Hart, Lake County Board Chair. “We are extremely excited to hear that they have been successful in their efforts to obtain federal funding for some of our critical projects. We thank our legislators for their tireless advocacy and commitment to successfully garner this funding. It will allow Lake County to be better prepared to handle challenges in emergency communications, flood management and behavioral health that will benefit residents and businesses now and into the future.” Lake County will receive federal funding for the fol-

lowing projects:

• $1 Million: New Lake County Emergency Operations Center (Representative Schneider) Construction of a new facility integrating the County’s Emergency Operations Center with expanded 911 operations and technology, improving response, coordination, and value for Lake County communities and agencies. • $1 Million: Lake County Behavioral Health Center Addition (Representative Schneider)

State’s Attorney testifies before House Committee on pilot text notification system for victims State’s Attorney Eric Rinehart testified before the House Appropriations-General Services Committee, via zoom, for a subject matter hearing. State’s Attorney Rinehart was there to explain the need for his proposed pilot program to automatically text victims and witnesses about upcoming court dates in Lake County. State Representative Joyce Mason (D-Gurnee) introduced the measure in the House and is shepherding it through the legislative process in Springfield.

The bill would appropriate $50,000 from the General Revenue Fund to the Lake County State’s Attorney’s Office for the 2-year pilot program. “Victims and surviving family members deserve the same notice of court dates

that perpetrators receive. This pilot program will ensure that those who have been victimized are aware of upcoming hearings so they can be involved in the proess,” Representative Mason said. “I am happy to be partnering with Lake County State’s Attorney Eric Rinehart to stand up for crime victims and look forward to seeing this program take effect.” “I am so grateful that we have strong victim advocates, like Representative Mason, among our Lake County delegation in Springfield who are pushing to ensure our victims receive all the support they need,” said State’s Attorney Rinehart. The Lake County State’s Attorney’s office employs 12 full-time victim witness

coordinators who guide and support victims through the court process. The coordinators work to connect the survivors of crimes with services while also educating them about how their case will proceed through court. Part of the coordinators’ duties include updating victims and witnesses on changes in court dates.  “Our office is here to support every victim in every way we can. This is an important program that will use reliable, fast technology to assist victims and survivors who choose to participate,” Rinehart said. “This system allows our amazing support professionals to spend their time providing individualized support instead of leaving voice messages. Unlike other court

notification systems that are powered by (some) clerk offices, this opt-in system will allow our support specialists an interface to respond to additional questions that a victim may have. Also, the automated information will be available in any language.”  The Lake County State’s Attorney’s office estimated that it supports more than 1,000 victims at a time. While the program spearheaded by Mason would start in Lake County, it would give other prosecutors’ offices a chance to learn and build upon the Lake County program down the road.   House Bill 4613 awaits a vote in the Appropriations-General Services Committee.

Funding received for Sylvan Lake Dam modification project The Lake County Stormwater Management Commission (SMC) announced it will be receiving $1,342,500 in federal funding to modify and improve the Sylvan Lake Dam. This funding was secured by Congresswoman Lauren Underwood (IL-14) through a new federal Community Project Funding initiative for Fiscal Year 2022 that allowed Underwood to request direct funding for projects that address some of the most pressing needs throughout northern Illinois. This project was included among nine others to support our community. “Residents living near the Sylvan Lake Dam are on the brink of experiencing severe flooding damage to their homes and the surrounding environment is at risk of fur-

ther erosion and degradation. I’m proud that this funding will secure the dam, keeping residents safe and making our communities more resilient in the face of climate change,” said Underwood. The Sylvan Lake Dam Modification Project will increase safety for residents and communities surrounding Sylvan Lake in Lake County as well as the roadway and local utilities infrastructure. The project will also increase resiliency for future extreme rainfall events and flooding. Lake County experienced countywide record flooding in 2017, and erosion damage to this infrastructure has accelerated as increased precipitation and climate change impacts the region. This project will help protect almost 500 homes near

the lake or serviced by the sanitary sewer. “Maintaining critical infrastructure like the Sylvan Lake Dam is a top priority for the County,” said Jessica Vealitzek, Lake County Board Member representing District 10. “I want to express my gratitude to the Sylvan Lake Improvement Association, Fremont Township, and Congresswoman Underwood for championing this project that will protect local homes and the surrounding environment from flooding and the damage it creates for years to come.” “The Sylvan Lake Dam has protected our community for close to 100 years,” said Alicia Dodd, Fremont Township Highway Supervisor. “Thank you to Congresswoman Un-

derwood and Lake County SMC for their continued commitment to mitigate flooding in Lake County.” The Lake County SMC was established in 1990 through state legislation to coordinate stormwater management activities from a countywide and interjurisdictional perspective. The Lake County SMC coordinates the stormwater activities of more than 80 local jurisdictions to improve water quality, reduce flood damages, and restore and enhance the natural drainage system. Representative Underwood helped secured funding for nine other projects that will directly benefit the 14th district. Randall Road project awarded $8 million in federal omnibus bill The McHenry County Division of Transportation has secured $8 million in federal funding for the second phase of the Randall Road project. The funding, part of the FY22 federal appropriations bill by US Sens. Dick Durbin and Tammy Duckworth, will help fund improvements to Randall Road from Alexandra Boulevard, in Crystal Lake, to Polaris Drive and Acorn Lane, in Lake in the Hills. Work finished last year on the first phase of the project, which widened Randall Road between Lake in the Hills and Algonquin. “The second phase of our

plan to widen and improve Randall Road, one of McHenry County’s most vital transportation and economic corridors, just got an $8 million boost as our nation and state continue to pursue historic investments in our transportation infrastructure,” McHenry County Board Chairman Mike Buehler, R-Crystal Lake, said. “We’d like to thank Senators Duckworth and Durbin for working so hard to move our funding request forward.” The appropriations bill now heads to President Biden’s desk to be signed into law. Work finished last August

on the first phase of the Randall Road project, which added lanes, improved flow at the intersection of Randall and Algonquin roads, added two new signalized intersections, and added pedestrian and bicycle amenities, including a pedestrian underpass and paved walkways. Last month, MCDOT was awarded an Illinois Engineering Excellence Honor Award from the American Council of Engineering Companies of Illinois for the first phase of the Randall Road project. Construction on the second phase is scheduled to begin

in 2024. Brad Ball has an extensive history in leadership roles at chambers of commerce, having served as the Executive Director of the neighboring Cary-Grove Area Chamber of Commerce and the Associate Director of the Northcenter Chamber of Commerce in Chicago. Village of Richmond to receive funding to improve aging water infrastructure towers, which serve the residents of the Village of Richmond. Recent inspections of the towers revealed blight and decaying conditions that potentially pose a threat to public health and safety; therefore, restoration is critical and an appropriate use of taxpayer funds. Further delay in the water tower restoration could result in water quality violations and service disruptions, which may impact emergency fire department water supply.

Forest Preserves filling positions for the summer Looking to spend the summer outdoors in a beautiful, natural setting? The Lake county Forest Preserves is in the process of hiring an array of temporary positions. “We offer a wide variety of seasonal employment opportunities with openings available this spring,” said Laurel Diver, manager of human resources and risk. “Temporary positions are available at our three golf courses, ThunderHawk Golf Club in Beach Park, Countryside Golf Club in Mundelein and Brae Loch Golf Club in Grayslake,” Diver said. “We are looking for guest service attendants, coordinators, and food and beverage attendants.” Golf positions emphasize customer services while maintaining the appearance of the clubhouse and course facilities. people. “At Independence Grove Forest Preserve in Libertyville, we are seeking food and beverage attendants for the Beer Garden at Independence Grove that opened last summer,” Diver said. Attendants would serve as cashiers and operate, maintain and stock food and beverage supplies. Applicants must be legally able to serve alcohol. There are also openings at Independence Grove for a variety of other attendants. These positions assist preserve visitors at the entrance gate, marina and visitors center. Assistant manager positions designed to support Independence Grove operations are also available. The Youth Conservation Corps is looking to fill a variety of crew leader positions this summer. The program,

which includes environmental education and outdoor recreation components, involves developing trails, planting native wildflowers, installing fences and other similar outdoor tasks. Several temporary positions in the grounds maintenance division are also available. Candidates for these jobs must be 18 years of age. Assisting in keeping buildings and grounds in clean and orderly condition is the main goal of these positions. Those hired for these positions will be expected to work weekends and holidays. On March 16, the Village of Richmond announced it will be receiving $560,800 in federal funding to improve two aging water towers. This funding was secured by Congresswoman Lauren Underwood (IL-14) through a new federal Community Project Funding initiative for Fiscal Year 2022 that allowed Underwood to request direct funding for projects that address some of the most pressing needs throughout northern Illinois. This project was included among nine others to support the community. “The funding secured by Representative Underwood will allow the Village of Richmond to complete an essential rehabilitation project for our water utility system without needing to put the burden on our residents during a period of uncertainty, job insecurity and change,” said Village President Toni Wardanian. “We are so grateful for the communication, guidance and care that both Rep. Underwood and her office provided us during this process. Opportunities like this do not usually come to small towns of 2,000 residents likes our. And the consideration of the Congresswoman during this process shows that we truly have a representative for the people in IL-14.” “Infrastructure in Illinois has suffered a systemic lack of investment. Man attempting theft in used car lot apprehended by canine team

On March 15 at approximately 12:15 a.m., Lake County Sheriff’s Deputies responded to a used car dealership in the 36500 block of North Green Bay Road, Beach Park, for a report of a suspicious person. Sheriff’s deputies arrived and a deputy saw a man hiding Oscar Ponce underneath a vehicle in the parking lot. As the sheriff’s deputy approached the man who was under the vehicle, the man ignored directions from the deputy, and fled on foot. Sheriff’s Canine Duke arrived at the scene and was deployed to apprehend the fleeing man. Canine Duke bit the man and was able to subdue him until sheriff’s deputies took the man into custody. The man, Oscar Ponce, 23, of the 0-100 block of West Tall Oak Drive, Hainesville, was evaluated by paramedics for a dog bite to the hand. He was then transported to the Lake County Jail. Sheriff’s deputies located multiple car jacks and a saw, consistent with being used in the thefts of catalytic converters. It is believed Ponce had accomplices with him during the catalytic converter theft attempt, who were able to flee while sheriff’s deputies pursued Ponce. Ponce was subsequently charged with possession of burglary tools (class 4 felony), theft, criminal damage to property, and resisting ar-

rest. He remains held in the Lake County Jail pending an initial court hearing this morning. Sheriff’s detectives are investigating and working to determine the identity of the others involved. All defendants are presumed innocent unless proven guilty in a court of law.

Preliminary investigation shows a 2013 Chevrolet Cruz, driven by a 24-year-old woman of Waukegan, was traveling northbound on Route 53. The driver crossed into the southbound lanes of traffic and struck a southbound 2009 Honda Accord, driven by a 34-year-old woman of Hanover Park, head-on. It is possible the driver of the Chevrolet swerved to avoid a different vehicle turning left onto Schaeffer Road. The driver of the Chevrolet was transported to Advocate Condell Medical Center in Libertyville, with critical, life-threatening injuries. She currently remains in the hospital with serious injuries that are no longer believed to be life-threatening. Two passengers in the Chevrolet, a 3-year-old girl and 22-year-

On March 17, at approximately 10:15 a.m., Lake County Sheriff’s deputies responded to the area of Route 173 and Venn Road, Unincorporated Antioch, for a domestic dispute. The caller, a 30-year-old woman of Racine, Wisconsin, called 911 to report she was being followed on foot by an ex-boyfriend. Sheriff’s deputies arrived in the area but were unable to find her. Lake County Sheriff’s Telecommunicators repeatedly attempted to call the 911 caller back, but she was not answering her phone. Due to the unknown circumstances, Sheriff’s Deputy Craig Somerville and his canine partner, Ryker responded to the scene. K9 Ryker was deployed to conduct a track to search for her. K9 Ryker tracked for approximately one mile to a channel near Lake Marie. As Canine Ryker and sheriff’s deputies got closer to

Canine Ryker and the sheriff’s deputies waded through heavy marsh conditions and saw the woman near a duck blind approximately 75 yards from the shore, in a channel of Lake Marie. The woman was hypothermic due to being in the water and soaking wet for approximately one to two hours. Sheriff’s deputies requested the assistance of the Antioch Fire Protection District, due to the watery and marshy conditions. Firefighters arrived and utilized dry-suits to wade to the woman and rescue her. She was subsequently transported to St. Catherine’s Hospital in Kenosha, Wisconsin, due to her exposure. She is expected to be okay. Sheriff’s deputies spoke to both the woman and the ex-boyfriend. It was determined the argument between the victim and her ex-boyfriend was regarding personal property that she allegedly took from him. It is likely the woman fell into the water during the incident and was unable to free herself due to the conditions. There are no indications she was pushed or forced into the water. Sheriff John D. Idleburg added, “Our deputies and our canines are truly second to none. This is another example of how our staff works diligently to protect the community. I am excited we are adding two additional canine teams to our Canine Unit, to make a total of seven sheriff’s canine teams.”

Sheriff’s Office seeks two shooters who fired into vehicle

Lake County Sheriff’s Detectives obtained arrest warrants for two offenders involved in a shooting. The shooting occurred during the early morning hours of March 6, in the 41400 block of North Green Bay Road, Wadsworth. During the shooting, Charles Brooks, III, 41, of the 3600 block of 16th Street, Zion, and Carnell D. Taylor, 47, of the 2000 block of Joanna Avenue, Zion, both shot firearms at an occupied vehicle, in the parking lot of a gas station. Fortunately, nobody was struck or injured in the shooting. Brooks III Charles Brooks, III fled eastbound on Route 173 in a white Chevrolet Impala following the shooting and Taylor fled northbound on Green Bay Road in a blue Monte Carlo. The Monte Carlo has doors which open vertically. During their investigation, Lake County Sheriff’s Detectives positively identified Brooks III and Taylor. On March 14, Lake County Sheriff’s Detectives obtained an arrest warrant Carnell D. for: Charles Brooks III: Aggravated Taylor Discharge of a Firearm (Class 1 Felony), and Unlawful Possession of a Firearm by a Felon (Class 2 Felony). A Lake County Judge set bond on the warrant for Brooks III at $350,000.00. Carnell D. Taylor: Armed Habitual Criminal (Class X Felony), Aggravated Discharge of a Firearm (Class 1 Felony), and Unlawful Possession of a Firearm by a Felon (Class 2 Felony). A Lake County Judge set bond on the warrant for Taylor at $500,000.00. Taylor is 6’04,” approximately 250 pounds, with black hair and brown eyes. Brooks III is 5’07,” approximately 180 pounds, with black hair and brown eyes. Taylor and Brooks III are considered armed and extremely dangerous. If you see either, please dial 911. Fatal crash under investigation On March 19, at 3:12 p.m., the McHenry County Sheriff’s Office and Nunda Rural Fire Department responded to the 2000 block of Rt. 176, west of Bayview Beach Rd., in the Village of Prairie Grove, for a two-vehicle traffic crash. Preliminary investigation indicates that a 2002 Toyota Highlander, driven by Tyler King, 27 years of age, of Crystal Lake, was traveling westbound on Rt. 176. A 2001 Ford E350 Cargo truck, driven by Eduardo Lopez-Peredo, of Wauconda was traveling eastbound on Rt. 176. For

unknown reasons, the Toyota Highlander crossed the center line, striking the eastbound Ford. The Ford then left the roadway, overturned, and spilled the cargo. Seat belts were used by both drivers. The driver of the Toyota was pronounced deceased at the scene. The driver of the Ford was airlifted to Condell Hospital, Libertyville. The investigation is ongoing by the McHenry County Sheriff’s Office Major Crash Investigation Unit and the McHenry County Coroner’s Office.

LCSO Special Investigations Group has another record setting year The Lake County Sheriff’s Office Special Investigations Group (SIG), a High Intensity Drug Trafficking Area (HIDTA) funded task force, continued its record setting trend in 2021, seizing nearly $5 million worth of illegal drugs in Lake County. Additionally, last year SIG seized 54 illegally possessed firearms, dismantled a Lake County street gang, and proactively prevented bloodshed by stopping two drive-by shootings that had been ordered by a gang. Beyond just enforcement, SIG offers presentations to school educators, students, community organizations, and neighborhood groups to keep the community closely informed of drug trends, warning signs, and resources available. SIG is the only HIDTA funded group in Lake County. With this funding, they are able to allocate substantial resources toward drug trafficking organizations, money laundering organizations, and criminal enterprises.
