Key holder would send someone down to reset the alarm. 10:46 p.m. – traffic stop made for motorcycle with no taillight or brake light on West Walworth Street. Driver was revoked and registration expired. Driver cited. May 21 3:24 a.m. – sounds like someone is possibly trying to break into store on North Wisconsin Street. Officer observed a truck the male stated he had issues with the ramp and had to make deliveries. Was able to get the ramp fixed. 4:15 a.m. – observed a vehicle parked during no parking hours on South Wisconsin Street. Parking ticket was issued and placed on vehicle.

9:45 a.m. – business owner believes server may have been breached on O’Connor Drive. IT person will be in to inspect the server. Will call back if any information is found that could lead to who is responsible. 9:40 a.m. – observed unattached trailer in the roadway on East Pinecrest Lane. Owner was told to put it in driveway or leave a vehicle attached to it. 11:19 a.m. – observed parking violation vehicle had been parked since early morning hours and requested dispatcher contact owner on South Wisconsin Street. 1:19 p.m. – gravel in the roadway that needs to be swept up on South Franklin Street. Street department notified. 3:09 p.m. – officer observed a vehicle fail to yield on East Centralia Street. The vehicle was stopped and driver cited for operating after suspension verbally warned to correct plates and failing to yield. 3:55 p.m. – observed a vehicle driving recklessly on East Geneva Street. Vehicle stopped and driver found to be suspended. Citation issued. 5:31 p.m. – report of a vehicle in the ditch near the off ramp of Highway 12 to Highway 67, traveling westbound approaching the interchange. Made contact and driver stated another vehicle with a boat trailer abruptly stopped and he had no choice but to go in the ditch. He went to get a truck and a tow strap to get his vehicle out but when he got back it had already been towed. Subject was advised the vehicle was at Elkhorn Collision. 5:32 p.m. – vehicle sitting in parking lot for over 20 minutes on North Wisconsin Street. Officer made contact subject. Was on phone all was fine. Officer gave directions to get back on the interstate. 11:25 p.m. – officer observed a vehicle in the lot of a closed business on North Wisconsin Street. Vehicle was secure along with the building.

Man to appear in court in 2018 overdose death

A status conference is scheduled for July 8 for a Lake Geneva man charged with homicide in the overdose death of a man in September 2018. Andrew C. Hayes, 35, pleaded not guilty April 18, 2019, in Walworth County Circuit Court to first-degree reckless homicide as a party to a crime. According to the criminal complaint, Hayes is suspected of taking Kyle Baar, 36, of Delavan, to Milwaukee to buy heroin on Sept. 21, 2018. Baar died after injecting the heroin, which was laced with fentanyl, according to the complaint. Emergency responders were called to Baar’s Vine Street home at about 5:30 p.m. Sept. 22, 2018, where Baar was pronounced dead at the scene from an apparent drug overdose, according to the complaint. A friend told police he had last seen Baar between 8 and 8:30 p.m. Sept. 21, 2018, and family members said Baar had prior substance abuse issues but believed he had been clean for the past couple of years, the complaint states. An anonymous source told police he had spoken to Baar, who said he had “broken down and bought some (drugs),” which the source identified as heroin. The source said Baar told him he had been talking to Hayes who was going to the Milwaukee area to get heroin and Baar was going to take $50 in quarters to buy heroin, according to the complaint. The source said Baar told him Hayes offered to give Baar money for the quarters and take him to Milwaukee to buy heroin, the complaint states. Police examined Baar’s cell phone and found messages between Baar and Hayes on Sept. 21, 2018, that discussed buying and selling drugs, according to the complaint. Police spoke to Hayes on Dec. 7, 2018, and Hayes admitted Baar contacted him Sept. 21, 2018, about buying heroin. Hayes said he picked Baar up on Sept. 21, 2018, and they went to Milwaukee to buy heroin from a person known as “Wheez,” according to the complaint. After buying a half-gram of heroin, Hayes and Baar injected some of the heroin in Milwaukee then returned to Delavan, the complaint states. Hayes said he and Baar each had some of their own heroin to use after injecting heroin in Milwaukee, according to the complaint. Hayes said after he heard Baar died, he called “Wheez” to tell him to throw his stuff away because it was laced with fentanyl, the complaint states. Hayes said as a daily heroin user, he could tell when heroin was laced with fentanyl, and he and “Wheez” determined they would “stomp on the stuff” so it wouldn’t be so strong, the complaint states. An autopsy determined Baar died as a result of opioid intoxication from fentanyl or acetyl fentanyl.

Area man gets six months jail for fires A Delavan man was sentenced to six months in jail and five years probation for setting fires in three houses and setting a lawnmower and a jet ski on fire in the Town of Delavan. Daniel J. Zitella, 30, pleaded guilty Dec. 18 to one counts of arson of a building and felony bail jumping. In exchange, five additional counts of arson and a charge of resisting or obstructing an officer against him were dismissed. He was sentenced Feb. 21 to six months in jail with work-release privileges on the arson conviction and five years probation for felony bail jumping. According to the criminal complaint, Zitella is suspected of setting fires in three homes in his neighborhood and of setting a lawnmower and a Jet Ski in the same neighborhood on fire. An Aug. 3, 2018, a push mower at a home on Mabie Street that Zitella had borrowed from a neighbor and last used was set on fire outside the home, causing some of the siding on the home to melt, according to the complaint. The next day, a personal watercraft at the same home that had not been burned when firefighters investigated the lawnmower fire the previous day was set on fire, according to the complaint.

On Dec. 9, 2016, a fire started in the bedroom of a home on Wallis Avenue in the Town of Delavan that Zitella had been asked to check on while the owner was away, the complaint states. On Dec. 10, 2018, a fire burned the kitchen a Sutter Avenue home to the studs and destroyed part of the ceiling, according to the complaint. A neighbor to the home said Zitella had stopped by his house that morning to borrow money and casually said, “Hey, did you know your neighbor’s house is on fire?” according to the complaint. Two days later, a fire broke out in that neighbor’s home, the complaint contends. The home showed evidence of forced entry, and three witnesses said they saw Zitella at the home moments before the fire. Zitella admitted setting the fire at the Wallis Avenue home in 2016 and the fires on Sutter Avenue in August 2018, according to the complaint. He also admitted setting the lawnmower on fire because he was mad at the owner who owed him money but denied setting the Jet Ski on fire, the complaint states. Zitella was convicted in the 2016 fire at the Wallis Avenue home.
