The fate of short-term rentals in Walworth County took an interesting turn this spring when a judge ruled a Lake Como homeowner could continue renting out his lake home. However, his approval was limited to just that particular case.
Short-term renter gets victory in court County plans to appeal decision

A Walworth County Circuit Court judge ruled in April that a Chicago man can continue renting out his home near Lake Como despite the county’s assertion that doing so violates county ordinance. The Walworth County Land Use and Resource Management Department cited Brendan J. Hehir in September with violating the county’s ordinance that prohibits lodges in unincorporated areas. Hehir pleaded not guilty to the citation
and took the matter before Judge Phil Koss, who ruled in Hehir’s favor. Koss dismissed the citation against Hehir and ruled that Hehir is grandfathered under the county’s ordinance before 2014, therefore allowed to continue renting out his home. However, the county’s Land Use and Resource Management Department argues grandfathering is not possible since the county’s ordinance never allowed short-term rentals. The county updated its ordinance in December 2014 to better define what constitutes

Sea-Doo suggests keeping these safety tips in your watercraft or boat at all times and make sure that you and everyone aboard understands them all prior to leaving dock and observes them once out on the water. • Know and understand all operational features of the craft you are riding – read and follow your operator’s guide. • Ensure your watercraft is Coast Guardcompliant and has all required equipment. Securely attach engine cutoff lanyard to your wrist or Personal Flotation Device. Keep attached at all times. • All watercraft riders must wear a properly fitted, U.S. Coast Guard-approved PFD. The operator and passenger(s) of watercraft must wear protective clothing, including: • A wet suit bottom or thick, tightly
woven, snug-fitting clothing that provides equivalent protection. Thin bike shorts for example would not be appropriate. Severe internal injuries can occur if water is forced into body cavities as a result of falling into water or being near jet thrust nozzle. • Normal swimwear does not adequately protect against forceful water entry into the lower body opening(s) of males or females. • Footwear, gloves and goggles/glasses are also recommended. Some type of lightweight, flexible foot protection is recommended. This will help reduce possible injury, should you step on sharp underwater objects. • Know your vessel’s capacity – don’t overload. • Stay alert and be aware of your surroundings. Constantly look in all
directions for skiers, divers, swimmers and other boats or watercraft. • Keep a safe distance! Avoid wake jumping, splashing and passing close to any other vessels. • Know the waters you will be operating in and observe all applicable federal, state and local boating laws. • Know the weather conditions – tune into your local forecast. • Stay clear of all restricted areas. • Obey ALL posted signs, such as “No Wake,” “Right of Way,” “Idle” and other navigation signs. • Never consume alcohol or drugs before or while operating a watercraft or boat. • All operators must be of legal age to operate the craft you will be riding. • BRP recommends a minimum operator
of 16 years of age to ride. • Always operate at a safe speed and be prepared to stop or alter course in emergencies. Ride within your limits, and allow sufficient distance to stop. • Whether you’re heading in or out, always maintain a slow speed until you’re in a clear area, away from shore. • Know and understand right-of-way rules. • Remember you need throttle power to steer. • Stay in sight of shore, but avoid operating too close to residential and congested areas. WATERCRAFT RENTALS PROVE POPULAR IN AREA By Ryan Spoehr STAFF WRITER
As temperatures have risen in the Southern Lakes area people naturally flock to the shoreline. While some own marine vehicles, many people get left behind at the dock. Which begs the question, are there still opportunities for people to get out on the water? The answer is yes. Actually, there are several businesses in the area that serve consumers who may be looking to get out on the water for some recreation. Among those providers is Gordy’s Marine, based in Fontana. “We cater to a large demographic, including families, corporate outings and children wanting to learn watersports,” said Kelley Lynne of Gordy’s Marine. “We do have a large following from the Lake Geneva area and Walworth County, but we also draw from Chicago, Rockford, Milwaukee and Madison.” The newest trend that representatives at Gordy’s have seen, according to Lynne, is wakesurfing, which is a sport that has rider surfing the wake behind a boat without a tow rope. “Wakesurfing programs and camps are trending,” Lynne said. Another new trend is paddleboards, which Gordy’s also rents. “Stand-up paddleboarding is a great way to enjoy beautiful Lake Geneva in a quiet and
peaceful way, while at the same time getting a great workout that improves your balance and core strength,” according to Gordy’s website. Paddleboards are available for 2 hours at $40. For a half-day, the rate is $50. For a full day, the rate is $60. Safety and use instructions are available upon rental. Gordy’s offers rentals of 20-foot and 22-foot Cobalt bowrider boats by the hour, half-day or full day. The 20-foot boat has six seats. The 22-foot vehicle has eight seats. “We proudly and exclusively rent Cobalt boats,” according to Gordy’s website. The 20-foot Bowrider is available for $139 per hour. The half-day rate, which is four hours, for the 20-foot Bowrider is $439. The daily rate for the 20-foot Bowrider is $699. The 22-foot Bowrider is available for $179 per hour. The half-day rate is $599 and the full-day rate is $899. Renters must be 21 years of age or older. There is a mandatory damage waiver purchase with each rental. No pets are allowed. Fishing is not allowed either. A boater’s license is required for those who were born after 1988. To request a reservation for a boat, go to gordysboats.com. Haydin said. However, some lodge proprietors maintained they were grandfathered in – they were operating their homes as lodges before the county clarified its ordinance in 2014. Twenty-three homeowners appealed to the county’s Board of Adjustment in July 2016, and the quasi-judicial board sided with county staff, saying the homeowners must stop renting or they are in violation of county ordinance. Fifteen of those property owners are now appealing the Board of Adjustment’s decision in Walworth County Circuit Court. Only two allowed to rent Haydin said the county’s concern is whether Koss’ decision in the Hehir case will affect the outcome of those 15 homeowners’ appeal to reverse the Board of Adjustment’s decision. Judge David Reddy heard two hours of oral arguments in that case May 17, and is scheduled to hear further arguments and likely make a decision July 18, Haydin said. Haydin said the decision in the Hehir

When considering a new boat purchase, the question of new or used is one of the first things prospective boat owners ask. There are pros and cons to each decision. Buy the boat that fits your lifestyle and how you will be using it.

case immediately created the perception among homeowners who want to rent that they too are allowed to do so. That is not the case, she said. Hehir reported receiving at least three phone calls within days of the April 24 decision from people who assumed they too were now allowed to rent, Haydin said. “I also had a woman who I sent a violation letter call me back and say, ‘Hehir won, I’m grandfathered,’” she said. As of now, Haydin said, Hehir is one of two people grandfathered based on Koss’ ruling, and the county plans to appeal the decision. “We’re very likely to appeal that decision to the court of appeals,” she said. Another renter, Growth Management and Vista Pointe, is also allowed to rent two single-family homes in the Town of Delavan as a result of a decision by Koss, which was upheld by the Wisconsin Court of Appeals in 2015. In making a ruling in the Hehir case April 24, Koss reviewed the Growth Management case to make a decision. “I think the primary concern that we have with the way things happened in court
was that the judge not only dismissed the ticket but gave him a pre-existing nonconforming (use) status with very little evidence,” Haydin said. According to online court records, the hearing was in session for 13 minutes before Koss recessed to review the Growth Management case and ruled 18 minutes later. Haydin said the county’s Executive Committee must approve seeking an appeal before the Land Use and Resource Management Department pursues a decision from the appellate court. If renters win If the county exhausts its appeals, and judges rule in favor of renters in both cases, the county’s ordinance will still stand, Haydin said. “There’s not really a question as to whether or not this ordinance is valid,” she said. If residents win their appeals, the county will accept that they are grandfathered in, Haydin said. However, others can’t broadly apply the decision, she said. “An individual can’t just declare

But, things are turning around in the industry. “We’ve seen a nice rebound in the last 18 to 24 months,” Wisconsin Marine Association Chairperson Michelle Shrider said this past spring. “We’ve seen more of an upturn in brokerage sales, dealers are still struggling a bit, but the brokerage sales are up.” Dealers sell new boats from manufacturers and brokers deal in the used-boat market, Shrider said. “The used-boat market is coming back strong, we’re probably close to what we were seeing before 2008,” she said. According to a press release from the National Marine Manufacturers Association it expects unit sales of new powerboats to have increased between six and seven percent in 2016, reaching an estimated 250,000 boats sold as consumer confidence soared and manufacturers introduced products attracting younger boaters. In addition to increases in unit sales of new boats, recreational boating industry dollar sales are expected to rise between 10 to 11 percent from $8.4 billion in 2016. Wisconsin was one of the top 10 leaders in the nation in sales of new powerboat, engine, trailer and accessories in 2015, up 10 percent over 2014 with $617 million in sales. One of the few original Americanmade industries – 95 percent of boats sold in the United States are made in the United States – recreational boating is seeing some of its healthiest gains in nearly a decade, a trajectory the NMMA expects to continue through 2018, the release stated. Anyone who applies for a building permit must comply with the updated ordinance. “Once you expand, you lose your non-conforming use,” she said. “You’re grandfathered for what you have on the day you’re grandfathered. Nothing more.”
