Hoy el tema con mayor cantidad de painpoints en Estados Unidos es la migración.
La división política que genera la necesidad de tomar un partido frente a si la única forma legítima de ser americano es siendo un americano legal, marca una frontera de opinión que separa y desvanece un horizonte de conciliación.
Y vale, en realidad, plantearse esa pregunta a fondo. Somos muchos los hijos de padres que migraron ilegalmente y que con el tiempo y las amnistías lograron la ciudadanía.
Ellos nos la dieron por habernos parido aquí. En términos legales, algunos hasta fuimos ciudadanos primero que nuestros padres, una particularidad de la estirpe migratoria.
La pregunta es, ¿qué tanto prevalece en el migrante la cultura madre sobre la cultura que viene a asimilar a Estados Unidos?
Es común que los migrantes estén tan arraigados a las formas de ver el mundo de su país de origen que ignoran las propias formas americanas y operan bajo aquella ley extranjera. Pasa que no pasa nada, pero también pasa que se rompen leyes y reglas locales hasta que surgen consecuencias legales, a pesar de que nadie ande “sapeando” y todo el mundo ande “minding their own business”. Cuando en Roma, como los romanos.

Migrar no es un acto ilegal per se. Ilegal es evitar, de alguna manera, el debido proceso migratorio con el fin de entrar y permanecer en el país. Yo diría que en cualquier país. Es, por lo general, un acto llevado a cabo a conciencia, a pesar de que la decisión no esté fundamentada en un principio de legalidad, está justificada en la convicción del individuo que ha decidido entrar y permanecer, a como dé lugar: es lo mejor para sí mismo.
En Estados Unidos no hace falta ser ciudadano para poder comprar bienes raíces. Sin embargo sí surgen ciertas exigencias que un ciudadano no requiere. Igual sucede con los seguros de vida y salud: conseguirlos se hace más difícil.
Entonces, si sólo es un poco más difícil, ¿cuál es el incentivo para formalizar el estatus legal migratorio, si al final del día, legal o ilegal se puede conseguir lo que se desee en este país?
La ilegalidad está instaurada en nuestra sociedad al punto en que existen debidos procesos para poder permanecer ilegal. La asignación de un ITIN es uno de los métodos más comunes para comenzar un proceso de formalización del ingreso y comenzar a pagar los impuestos, uno de los documentos iniciales para salir de la ilegalidad.
Y es que las formas de ilegalidad más comunes son las de aquel que se ha sobre pasado el tiempo permitido por su visa, y las de aquel que decidió entrar sin permiso al país.
Hay algo que ambos comparten, y es que ambos tipos de migrantes podrían acercarse a una oficina migratoria con
el fin de modificar su estatus, lo que pasa es que así mismo comparten la ausencia de convicción interna de que legalizarse es su mejor opción, tanto por seguridad de permanencia, como por aspectos de libertad.

Si lo pensamos a fondo, un ilegal se encuentra en el peldaño más bajo del escalafón social. Y no es porque no tenga dinero ni capacidad productiva, sino porque su estatus como civil es inexistente y su presencia prospera en la medida que es como un fantasma. En teoría, los pagos bajo la mesa nunca sucedieron y el vacío fiscal no lo encuentra ni el más perito del IRS.
Entonces, ¿se puede frenar la migración ilegal hacia Estados Unidos? ¿O es este tipo de migración una característica fundamental del telar social estadounidense? Es difícil juzgar, sino imposible, cuando se parte de un lente donde la propia sangre migró ilegal y se legalizó. Que fue gente buena y legal. Además, lo particular del fenómeno de deportados es que resultan retornando. De modo que, ¿es posible siquiera controlar el estatus migratorio de todo quien está presente en el país?
Mientras tanto, ICE seguirá jugando al gato y al ratón con los indocumentados. Americano es quien busca lo mejor para sí mismo en la oportunidad que ofrece el país. ¡Qué viva América!
