EDITORIAL ¡Feliz año! Lo bonito del nuevo año -o quizá lo terrorífico- es ese espíritu de deseo de renovación que invade los hogares y corazones de la gente. Bonito, es obvio. Esa expresión de lo que se anhela lograr es en esencia la manifestación de la capacidad de visión humana, esa capacidad de proyección que resulta en la creación de un camino a seguir, de unas metas a alcanzar, de unos sueños por cumplir, y que en esencia expresa aquello que se aspira alcanzar. Es bello oír los sueños de los niños, sus padres y los abuelos. Es inspirador escuchar cuando la gente se quita los velos de fortaleza y revela su lado más vulnerable. Aquel gesto estrecha las relaciones, intimiza a los presentes y establece un llamado a ayudar a quien esxpresa esos sueños a responsabilizarse por cumplirlos. Y es quizá allí donde la actividad se comienza a tornar terrorífica, pues así mismo como se expresan los anhelos, también toca confrontarse con todo aquello que se planteó hace un año y revisar lo que se logró y lo que no se logró. Lo que se cumplió y lo que no. Es en esa visita al recordatorio de los anhelos lo que puede resultar
frustrante y catapultar hacia el derrotismo a las personas. Unos dirían que por eso es importante enfocarse en lo positivo en vez de lo negativo, pero a mí parecer, eso no basta. Ayuda pero no es suficiente. Sobre todo cuando lo no alcanzado es sustancialmente mayor a lo alcanzado. Lo bueno es que existen tradiciones fenomenales para "dejar lo malo del año atrás". La quema del año viejo en Colombia es común para quemar lo malo y darle bienvenida a lo bueno. En Chile queman al "mono" y en Nicaragua al "viejo". Y en la quema de los muñecos se van los papeles escritos con los anhelos para el nuevo año y con todo eso que se quiere dejar atrás. El acto simbólico, por lo menos a mí, me ayuda a reflexionar sobre el año, sobre lo que hice y lo que no. Y me ayuda a llegar a una paz personal a nivel emocional. El nuevo año, con su llegada y su apertura a lo desconocido que la vida traerá, es similar a cuando uno se monta en un avión hacia un nuevo destino, o como cuando se rompe con las cadenas del sometimiento a la violencia y se comienza a caminar hacia La Bestia para llegar a la frontera de la oportunidad. Una vez más un nuevo año. Cada año igual. Pero el paso del tiempo hace de cada año algo especial. Ya a nuestros padres los conocen mejor como abuelos, ya somos ahora
nosotros los padres y las nuevas madres. Pero quizá el anhelo es siempre el mismo: darles a ellos, los niños, siempre lo mejor. Y así se renuevan los años, los anhelos y las generaciones. Mientras unos nacen, otros crecen y otros mueren. El año viejo es el crematorio de las frustraciones, y el crematorio es un año viejo que deja risas y llanto. Quizá el mejor aliado para evitar el lado terrorífico del nuevo año es además de compartir los anhelos con los demás, también es vital compartir las angustias y las frustraciones, así se descarga el peso del sentimiento de fracaso e insatisfacción, además que se abre la oportunidad para generar perspectiva, o por lo menos para sentir que no se está solo. Desde América les deseamos un feliz año, que se les cumplan todos los sueños, que bajen esos kilos de más, que consigan su diploma, que su membresía al gimnasio no quede sólo en papel, que vea a sus seres queridos, que monte su negocio o consiga el empleo soñado, que nade con delfines o se lance de un avión, lo que sea que sueñe o quiera hacer, ¡le deseamos que lo haga! A nuestros queridos anunciantes, gracias totales, feliz año y prosperidad, sin ustedes este sueño y anhelo no sería posible: ¡Viva América!

AN OPPORTUNITY FOR CONGRESS TO INCLUDE PUERTO RICO The ruling of the controversial case between Vaello-Madero vs. The united States reveals a second-class citizenship treatment silently affecting Puerto Ricans. Is statehood the solution or a deeper policy inclusion? However, it is a major opportunity for Congress to make things right.

I was inspired to write about this topic after my time as an Undergraduate Fellow at Equally American, an advocacy group focused on bringing the territories into parity. I am a Junior at the University of Central, with a joint concentration in History and Political Science.
INTRO: US Supreme Court May End Over a Hundred Years of Unequal Citizenship in Puerto Rico n a term that has been filled with high-profile cases concerning abortion and criminal law, an equally important case, United States v. Vaello-Madero, has received little coverage. Last November, Puerto Rico vicariously appeared before the Court through José Luis Vaello-Madero to determine whether Congress could exclude Puerto Rico from receiving Supplemental Security Income (SSI) benefits. Superficially, this case deals with an economic policy. At its core, however, the case concerns the treatment of American citizens from Puerto Rico as second-class citizens. Congress’s abil-

ity to treat Puerto Rico unequally, moreover, has its underpinnings in case law known as “the Insular Cases,” which belong with the discriminatory decisions in Dred Scott v. Sandford and Plessy v. Ferguson. Insular Cases deal with the application of the Constitution in the territories. In short, the Supreme Court has said that Congress is justified in treating Puerto Rico differently based on the Territory Clause of the Constitution. Yet the Court has turned its back on the people and precedent, deciding not to apply commanding case law about the Constitution’s applicability to Puerto Rico. Such concepts may seem abstract and impersonal, yet the final part of this article high-

But the Insular Cases have remained intact through the annals of American legal history, even when subsequent cases have repudiated the central tenets of that jurisprudence. Specifically, the tenet that the Constitution’s applicability is not dependent on the citizenry in the territory, that is, that they are American citizens, but

instead that it is based on “locality.” Balzac v. Porto Rico (1922). Based on this ruling, the Court has upheld the disparate treatment of Puerto Rico as a rational exercise of Congress’s power to administer territories. In so doing, the Court has refused to apply its decision in Boumediene v. Bush (2008). Boumediene v. Bush came during the United States’ lengthy War on Terror. The case concerned enemy combatants detained in Guantanamo Bay in Cuba. The enemy detainees in Guantanamo petitioned for habeas relief in federal courts. Ultimately, the Court held that Congress, controlled by the Constitution, could not “switch the Constitution on or off.” Therefore, the enemy detainees were entitled to Continues on page 15

El domingo 9 de enero se celebró el día de Reyes en la Lechonera El Jibarito. Margie Lacen, la directora del Museo Comunitario Casa Cultural Afro-Caribeña, Centro Yuíza, organizó el evento que contó con siete estaciones para entretener a los niños. Margie narró la historia de los Reyes Magos. Luego los niños pasaron a pintarse la cara con Pinta Jaryann. Fun Balloons proporcionó las bombas y los niños y niñas de 5 a 12 años todos recibieron su regalo. Entre los beneficiados están
los niños del Proyecto Vida, una fundación sin ánimo de lucro que ayuda a familias monoparentales a sobrellevar el reto de criar hijos. Además, la fundación brinda clasés de Inglés gratuitas, talleres de emprendimiento, computación, finanzas y crecimiento personal para las madres, mientras que los niños se pueden beneficiar de tutorías virtuales. Bendita Música - por Marisol Medina El 18 de diciembre se llevó a cabo el concierto “Bendita Música”, una colaboración entre el cantautor argentino Guillermo Roude y el tenor peruano Rafael Cavero en la galería de arte Mills en el downtown de Orlando. El concierto tenía como propósito alegrar las festividades de fin de año y proveer una velada celebratoria entre amigos y familia después de haber pasado por la pandemia. Roude lleva más tres décadas de carrera artística en los cuales ha grabado 12 discos y representado a Argentina en el festival Viña del Mar en Chile en el 2008 con su tema “Festejar.” Los artistas están trabajando actualmente en un disco en el que se
presentarán los temas más “crossover” y de mayor perfil internacional de Roude interpretados por Cavero. Esta sería la primera vez en 35 años de carrera de Roude que presta sus temas para ser interpretados por otro artista. A la velada asistieron los enviados especiales de América Magazine, el arquitecto Alfredo Medina y la artista de maquillaje permanente Carmen Galindo. Además, estuvo presente la periodista y organizadora del evento, Gheidy de la Cruz, la presentadora Jackie Álvarez, la empresaria Matty Frías, la locutora y editora Marieangie Rosario, la asesora de imagen Penélope Ventura, entre otros.

The Education of Latinos: A Moment in History Part 6 Antonia Pantoja's Heritage by Manuel Hernández
“E
ducation is the single most powerful weapon in the world” (Nelson Mandela). The Hispanic population growth in the United States is not a trend, and the educational system in America has met its growth with keen resistance. During the 1960’s, Dr. Antonia Pantoja observed and tackled the resistance by organizing ASPIRA and opened its doors to all those who were interested in loading the weapon and targeting the hundreds of thousands of Latinos who were migrating to New York City and other metropolitan cities during the time. Her leadership, community work and ability to communicate with others paved the way for a landmark case which gave birth to the Bilingual Education Act of 1968. As an English as a Second Language (ESL) teacher in New York City in the 1980’s, I had many recently arrived students from all over the world. Determined to bridge that gap, I discovered the power of authentic literature, which constructed bridges of appreciation to teach students to learn English, stay in school and pass citywide exams at the same time. Fast-forward 2014, purpose called me to come to Central Florida and use
my teaching experience to facilitate language learning to get immigrant teens college and career ready. The grassroots efforts I have developed today were constructed upon the foundation built by Antonia Pantoja’s work with Bilingual Education. As a lifetime educator, I discovered the “unity of ideas” in her work. When I relocated to Florida, I experienced the resistance. While there are hundreds of grassroots organizations flourishing in the area, the common goals and “unity of ideas” move in different directions. Some will say political, civic, and social movements in different directions are a mirror of the growth of diversity and the power of equity. Although such is true, it was Abraham Lincoln who warned that “a house divided against itself cannot stand.” If we are to continue the work of our beloved Pantoja, we must dig deep into our gut and extract the bullet out of our “weaponized” values and work together as “one macro non-profit”. Even with his assassination, Lincoln’s ideas prevailed because they found common ground in the American heart and soul of his time. When President Bill Clinton put the medal of freedom around her neck,

he validated Antonia Pantoja’s lifetime work. There have been mercenaries on the attack to destroy and eliminate bilingual education. As a result, there are only a handful of states that recognize bilingual education as a statewide educational strategy. As we walk into more crossroads in the clear and present future, the idea of working together for a common goal must be relevant in the education of Latinos. History will judge us as a numerical minority nation in a country with so much potential but with the unwillingness to “cut the veil” from the curtain of its immobility. Numbers matter, but the “unity of ideas” we save may be our own.

habeas relief. But Puerto Rico was explicitly excluded from this broad affirmation of Constitutional applicability. The Court underscored Puerto Rico’s unique situation—and the permissibility of Insular Case precedent—because of Puerto Rico’s civil law traditions in contrast to Anglo-American common law. Most bizarrely, however, the Court wrote that the Constitution need not apply “always and everywhere.” With Boumediene, the Court blocked Puerto Rico’s most significant chance at overcoming precedents set by the Insular Cases and advancing in national parity. II. The Curious Case of Vaello-Madero In Vaello-Madero, the Court will determine whether the exclusion of Puerto Rico from the SSI benefits violates the Equal Protection Clause of the Constitution. When Mr. Vaello-Madero moved from the mainland to Puerto Rico to care for his wife, he unknowingly became ineligible for SSI benefits. But the Federal Government did not notify him. It sued. Mr. Vaello-Madero agreed to pay the Federal Government back, but the federal trial court judge refused the payment plan, assigned counsel to Mr. Vaello-Madero, and litigation ensued. The district court held that the Territory Clause, while expansive, “is not carte blanche for Congress to switch on and off at its convenience the fundamental constitutional rights to Due Process and Equal Protection enjoyed by a birthright United States citizen.” Thus, the exclusion of Puerto Rico from the financial benefits scheme of SSI was unconstitutional. When the Supreme Court heard oral arguments on 9 November 2021, an air of uncertainty surrounded the Justices.
the Insular Cases. Here are some cases I collected through my work as an Undergraduate Fellow at Equally American, an organization dedicated to advocating for the territories: FIRST CASE: Mr. Yunque [pseudonym for privacy]. Mr. Yunque served in the U.S. Navy for twelve years. He saw the Navy as the gateway to the American Dream, and his quick rise in the service confirmed those hopes. However, those hopes plundered after his time in the service when federal taxes followed him in his new role, although full rights, like the right to vote, did not catch up. Mr. Yunque said his lack of rights was like second-class citizenship. What is more, he noted, such a lack of rights for American citizens is an anachronism. Puerto Rico must “be brought to the 21st century.” SECOND CASE: Mr. Coquí [pseudonym for privacy]. Mr. Coqui’s entire family, starting with his father, served in the US Armed Forces. He aimed his disdain at the Insular Cases: they were an insult to his family’s sacrifices. He, too, felt that lack of rights relegated American citizens to an inferior status. At the same time, however, he stated he had hope for the younger generations to ride the wave of other social justice programs to bring parity to the territories. “I hope my grandchildren get to enjoy those rights I fought for without having to move to the mainland.” We can only hope the Court embodies those equal protection principles exhibited in Brown v. Board of Education and strikes down the discriminatory treatment against Puerto Rico enshrined in the Insular Cases. Vaello-Madero could be the Court’s last opportunity to repudiate the anachronistic and vile decisions of the Insular Cases. If it refuses to do so, the already ample authority Congress has over the territories may turn into a creeping colonialism.
III. Fighting for President and Country, But Left without Rights Constitutional law can seem lofty, but its on-the-ground effects remind us that it impacts real lives.
