Ask The Broker

Question:

May I, as a licensed real estate sales associate, purchase a property in my personal name as my primary residence without acting as an agent or receiving any commission, provided that the appropriate licensee disclosure has been included in the contract?

Answer:

This question troubles me in many ways. First off, the disclosure under Florida law should be made at the time of the first offer, which would result in being included in the contract, but PLEASE make sure it is in the original offer, not added to the final contract after the negotiations have ended. Further, the NAR Code of ethics Standard of Practice 16-10 have an even stricter requirement, that the disclosure be made to the seller/landlord’s representative or broker AT FIRST CONTACT. This can be a verbal or informal disclosure but matches the Florida statute that the disclosure be confirmed in writing “not later than execution of a purchase contract.”

It is clear from statute and code that when dealing with the public you are ALWAYs acting as an agent, REGARDLESS of if you are receiving commission or not.

And speaking of commission, please remember the commission belongs to the BROKER not the AGENT. There are 2 types of licenses in Florida, an Associate license and a Broker license. As an Associate your license is under a Broker’s supervision and that relationship is usually governed by your independence contract agreement. I am saying this because what happened here that prompted this question was the agent was trying to beat his broker out of his split by claiming he was not acting as an agent. The rules apply for all agents on every deal, it does not matter that it is in your “personal name” or for a “primary residence.” These are not

exclusions under the Law or Code.
