City to recoup $40M City settles out of court with bank, auditors BY DEREK BARICHELLO
DIXON – Mayor Jim Burke said the amount of the settlement speaks for itself. The city of Dixon reached a $40 million out-of-court
settlement with its former auditors and Fifth Third Bank, who the city said were to blame for former Comptroller Rita Crundwell’s theft of nearly $54 million in the past 2 decades. The agreement was reached Saturday following a 17-hour session in Chicago, Burke said. The mayor was speaking about vindication for a City Council that has taken its fair share of blame for the theft, when he said the amount speaks for itself. Of the $40 million, $35.15 million was paid by
CliftonLarsonAllen, the city’s auditor until 2005, $3.85 million by Fifth Third Bank, which handled the city’s checking accounts, and $1 million by Janis Card and Associates of Sterling, which took over the city’s audits in 2005 from Clifton until Crundwell’s arrest. The money is expected to be handed over to the city by the end of the year, Burke said. $40 MILLION

With $10 million more expected back from the federal government from the sale of Crundwell’s assets, Dixon will have recouped $50 million – nearly $4 million shy of Crundwell’s theft total. “I was really hoping from the very beginning to get at least half of it back,� Commissioner Jeff Kuhn said in a phone interview Wednesday. “When I first heard that number, I was like ‘Wow.’� About $10.3 million of the settlement will go toward legal fees, Burke said. Commissioners and the mayor said the caliber of its lawyer led to the strong settlement. “I hope nobody goes after us for the expenses to gain this recovery,� Commissioner Dennis Considine said. “We hired a very talented law firm, and because of their skills, we were able to fight tooth and nail for [the settlement.]� A total of 37 participants attended Friday’s negotiations, including the defendants, insurance companies and Lloyd’s of London and their attorneys, Burke said. The mayor and the city’s attorney Devon Bruce, of Power, Rogers & Smith in Chicago, represented Dixon. The meetings started at 8 a.m. Friday and concluded at about 1:30 a.m. Saturday, without anyone leaving. “Their first offer was $12 million,� Burke said. “Devon stayed the course on it. There was no real exact figure we went into negotiations looking to have. My only sugges-
tion was not to leave any money on the table.� The mayor and Bruce met with Clifton and Fifth Third Bank’s attorneys in San Francisco in October 2012, in an early effort to reach an out-of-court settlement, but the parties were too far apart for an agreement, Burke said. Since that meeting, Bruce went to work putting together a case against the city’s former auditors and Fifth Third Bank. Deposition statements from Megan Shank and Ashley Peach, who both worked on Dixon’s account for Clifton, said the auditing firm did not verify projects Crundwell created using fake Illinois Department of Transportation invoices, according to court documents from the lawsuit. These invoices were used to siphon money from Dixon’s funds to a secret bank account. A number of other undetected red flags were pointed out as well, including a missing emblem on invoices or the omission of proper contact information. For Fifth Third Bank’s part, they showed bad faith when they allowed Crundwell to withdraw more than $48,000 directly from the city’s capital development fund and did not account for the secret bank account when auditors asked for all city accounts, according to documents filed by Bruce. The bank was in the process of making a motion to dismiss the case before a settlement was reached. The settlement comes without an admission of liability, said Larry Magnesen, a spokesman for

Reaching a fair settlement for taxpayers is important to CliftonLarsonAllen.� The firm’s services to city governments are now led by personnel with specialized knowledge and experience in serving public bodies, increasing the likelihood that fraud will be detected more promptly, according to Clifton’s statement. As part of the agreement, the city will file no further lawsuits against the defendants or their representatives. The suit, filed in June and amended a number of times, named CliftonLarsonAllen LLP, Janis Card Company, Samuel S. Card, CPA, Fifth Third Bank, Todd Etheridge

Gordon Viere, CliftonLarsonAllen CEO, released a statement Wednesday, calling for a shared responsibility for Crundwell’s theft. “The allegations of fraud committed by [Crundwell], some of which she pled guilty to, are extremely serious and present an opportunity for all affected parties to evaluate how they occurred,� Viere said. “We believe there was a shared responsibility that resulted in Ms. Crundwell’s fraud continuing undetected, and the right thing to do is reduce the harm experienced by the taxpayers of Dixon and put

and Ron Blaine as defendants for their negligence in detecting Crundwell’s theft. The suit asked for $53 million in damages. “It was a complete win for the city,� Bruce said. It’s been difficult watching from the sideline during the lawsuit, Kuhn said. City officials were instructed to say as little as possible when it came to anything Crundwell. “We’ve known this all along, but couldn’t say anything for fear of jeopardizing the case,� Kuhn said. “More or less, we
had to sit back and take it. Hopefully it’s obvious to citizens now. ‘Yes, Rita was the person who did it,’ and other people were asleep at the switch and should have caught it, too.� Crundwell was sentenced to 19 years, 7 months in prison Feb. 14 for federal wire fraud. She is serving her sentence at a correctional facility in Waseca, Minn., and has since appealed her sentence. That appeal is ongoing.

DIXON – A referendum might be needed to fix deteriorating roads at Lowell Park. There’s not enough money in the Dixon Park District budget for the estimated $200,000 resurfacing project, park board members said Wednesday, nor will there be in the near future. Park board members are eyeing a referendum in 2016 or 2017 and looking at resurfacing the roads over a 5-year period. Roads at Lowell Park were last resurfaced in 1997, according to Deb Carey, park district executive director. That project included tar and chipping the road surface and fixing culverts. The culverts would not need to be redone, but the plan calls for at least a tar-and-chip job on the park roads. Board members said they would like to

blacktop the roads, but Carey said it could cost close to $750,000. “I don’t see a possibility to get $200,000 for repairs under [our tax caps],� Carey told the board Wednesday. “We’re going to have to get creative.� Looking at the referendum 3 to 4 years down the road was considered, because the park board did not want to get in the way of any efforts by Veterans Memorial Pool supporters to pass any sort of referendum. “It’s worth a shot,� said park board member Shane Miller. In order for the road projects to be put on a referendum, the park board would have to file a detailed engineering report of the project’s cost and allocate the funds specifically for it, Carey said. The roads could hold up for another few years, until the referendum, Carey said.

Pass the pigskin pulled pork world. Is it time for kickoff yet?

he thermostat may still read summer, but when it’s September, it’s football season. Which means putting out a game-day spread that’s easy to make ahead of time so you get to the more serious business of the day – face painting, coordinating matching outfits in team colors with your mate and, in Texas, placing bets on how many times Jerry Jones will say “Super Bowlâ€? in his preand post-game interviews. Admittedly, I never watched much football in America or paid much attention to the football games when I lived in France, either – and by football, of course, I mean soccer, a game that has always seemed more interesting to me simply because of the outfits – so I’m a little in the dark on the game particulars no matter where I am. In France, as far as I know, le foot never included any sort of pregame tailgate party, or even a gathering of friends for an all-afternoon soiree. In fact, when I went to the movies in Paris, I hardly ever witnessed anyone eating while watching the film. Which is typical. In France, food – and dining together – is an occasion in itself. The only thing I saw people eating on the street was the end of a baguette. I don’t claim to know much about football, but I love the idea of a party, no matter what the occasion. Melty cheese dip and tortilla chips are fine – and I’ve certainly eaten plenty – but to celebrate this year’s football season, I wanted to come up with a menu that was a bit more meaty, yet as simple to prepare as a microwavable dip. Or just about. So I thought: pulled-pork sliders, little barbecue-ish sandwiches with sweet jalapeĂąo-spiked pickles, and a bacon-potato salad that’s a lot like one my mom used to make. Food that’s as filling as you want it to be, because those games can go on (and on). Plus a dessert that’s fun and not fussy: ice cream sandwiches – easy to make and even easier to eat. With a spread like this, I could surely become a football fan. Anywhere in the

Pulled-Pork Sliders Makes 15 to 20 sliders A super-easy and inexpensive recipe that you put together the day before the big game. For the sliders: 1 heaping teaspoon ground mustard 1 heaping teaspoon smoked paprika 2 teaspoons sea salt 1 teaspoon black pepper 2 tablespoons brown sugar 3 ½ pounds pork shoulder 15 to 20 small buns or rolls Sweet jalapeùo-spiked pickles (recipe follows) For the sauce: 1 cup ketchup Ÿ cup apple cider vinegar 1 teaspoon mustard powder 1 heaping tablespoon brown sugar 1 teaspoon sea salt ½ teaspoon black pepper 1 large clove garlic, minced A few dashes Worcestershire sauce A big pinch cayenne 1. Mix ground mustard, smoked paprika, salt, pepper and brown sugar in a bowl, then press all over the pork shoulder and place in a glass bakingdish. Cover and refrigerate for an hour or two, or overnight. 2. Heat oven to 300 degrees. Cook pork for 4 to 5 hours, or until the pork is tender and pulls apart easily. While the pork is still warm, shred it with a fork. 3. Make the barbecue sauce: Put all ingredients in a saucepan and let cook for 10 minutes, stirring until all of the sugar has dissolved. Pour some of the sauce over the shredded pork and toss until well covered. To serve, fill the slider buns with pork and top with sweet jalapeùo-spiked pickles. Serve the rest of the sauce on the side. Note: If you’ve made this in advance, to reheat the meat, simply place in a glass dish, cover with foil and warm
through in a 200-degree oven for 30 minutes or so. Nutritional analysis per slider, based on 15: 351 calories, 18 grams fat, 21 grams carbohydrates, 24 grams protein, 59 milligrams cholesterol, 617 milligrams sodium, 1 gram dietary fiber, 48 percent of calories from fat. Sweet Jalapeùo-spiked Pickles Makes about 18 ounces 1 (16-ounce) jar dill pickle slices, drained 2 heaping tablespoons pickled and chopped jalapeùos, with about 1 cup of the juice from the jar 1 cup sugar Mix together pickles, jalapeùos and sugar. Refrigerate overnight. Serve with pulledpork sliders. Nutritional information per 1-ounce serving: 49 calories, trace fat, 12 grams carbohydrates, trace protein, no cholesterol, 337 milligrams sodium, trace dietary fiber, 1 percent of calories from fat. Bacon-Potato Salad Makes 4 to 6 servings 1 ½ pounds potatoes, such as Yukon Gold, cut into 3-inch chunks 2 eggs 3 pieces bacon, cooked till crispy and crumbled 2 green onions, chopped 1/3 cup Greek yogurt 2 tablespoons good mayonnaise, such as Hellmann’s 1 teaspoon Dijon mustard Sea salt and pepper 1. Heat potatoes in a large pot with salted water. When it reaches a boil, turn down heat and let simmer 15 to 20 minutes or just until tender. Roughly smash them, with a hand masher or fork, making sure to leave large pieces. 2. While the potatoes are cooking, make hard-boiled eggs. Place in saucepan, cover with water and heat. When water reaches a boil, set timer for 10 minutes. When done, rinse eggs in cold water, then peel and chop. 3. Add chopped egg, bacon and green onions to potatoes. 4. Whisk together Greek yogurt, mayo and mustard,

Nutritional program returns to Sauk Valley Report: Bad conditions Jump with Jill set at Dixon Elks Club BY DEREK BARICHELLO
DIXON – Families will get an opportunity to Jump with Jill. The multimedia nutritional rock show is returning Oct. 2 for a free family night at Dixon Elks Club, 1279 Franklin Grove Road. Doors open at 6 p.m. Jump with Jill, which teaches children about nutrition through song and activities, was a hit last year at area schools, so much so that the physical education
teachers at Jefferson Elementary School still use her fitness CD in class, said Christine Scheffler, Community Wellness coordinator at KSB Hospital. “The basis of many diseases comes from obesity, heart disease, diabetes,� Scheffler said. “If we can get control of childhood and adult obesity, we’ll see a decrease in the diseases that corresponds with it.� The live Jump with Jill show has been performed more than 1,000 times for 250,000 kids and has been featured in national media outlets
including Nickelodeon, Sprout PBS, NPR and The Washington Post. What makes her shows so unique is her ability to get children involved and excited, Scheffler said. “She markets her message for a nutritious and healthy lifestyle the same way a fast-food restaurant might market to kids,� Scheffler said. “She makes it inviting and colorful, and she has tons of energy. “This is an important part of our mission to education children on nutrition.� The program will kick off Breast Cancer Aware-
ness Month for the wellness program, because Scheffler said prevention is predicated on nutrition. Jump with Jill is expected to have new songs and activities. Also, the program will make stops at Amboy and AFC schools, as well as St. Mary’s and Jefferson elementary schools in Dixon. KSB Hospital is partnering with agencies, such as the Lee County Health Department, Home of Hope, the Northern Illinois Cancer Treatment Center, and the American Cancer Society to put on the program.
linger at youth homes SPRINGFIELD (AP) – A year after Illinois was sued and reached a settlement over inadequate conditions in its juvenile detention centers, two new reports have documented a number of conditions that show the situation is not improving. In a report ordered by a federal court, a panel of juvenile justice and adolescent psychiatric experts detailed their 8-month investigation of the state’s six juvenile detention centers. The group found incarcerated teens mowing lawns during the school day, being improperly medicated and subjected to more solitary confinement than neces-
sary. A second report by the John Howard Association, a prison watchdog group, found that conditions at a specialized mental health facility in Kewanee have been complicated by an influx of maximum-security inmates following the closure of a Joliet facility. The Joliet Youth Center closed in February as part of Gov. Pat Quinn’s decision to shutter several Illinois prisons to save money. The report says Kewanee is a facility with “extremely limited resources� to deal with its population of juvenile sex offenders and youths with acute mental illness.
