Raw milk regulations under scrutiny Legal Defense Fund says the FDA is driving the proposal for the IDPH By TOM KOCAL Prairie Advocate TKocal@prairieadvocate.com SPRINGFIELD – In July, the Illinois Department of Public Health introduced proposed regulations on the production and sale of raw milk in the state – regulations that a number of Illinois raw milk producers believe could put them out of business. Many raw milk producers and consumers, and the Farm-to-Consumer Legal Defense Fund, want to stop IDPH from adopting any raw milk regulations, stating that for more than 30 years, the unlicensed on-farm sale of raw milk has been legal by policy in Illinois. It’s a policy the group says has worked well with no reports of food-borne illness attributed to Illinois raw milk producers going at least as far back as 1998. But the IDPH is taking the position that if there are no applicable state rules or regulations on the books, the policy is illegal. To date, the IDPH has received hundreds of public comments about the regulations it is considering throughout a 45-day comment period in which supporters of raw milk and freedom of choice have the opportunity to make their views known to the department. After the initial 45-day comment period, which ends Monday, the Joint Committee on Administrative Regulations will have the proposed rules presented for review in a second 45-day comment period. JCAR is a legislative committee responsible for reviewing and implementing state regulations. “Now is an opportunity to let the committee know in advance why it should reject the rules if IDPH does not withdraw them,” said Pete Kennedy, an attorney with the Farmto-Consumer Legal Defense Fund.

State regulators want to create a two-tier system of permits and inspections that would apply to milk from cows, goats, sheep, water buffalo and other hoofed animals, The State Journal-Register reported. They must assess the risk of illness posed by consuming raw milk compared to citizen consumers that say raw milk is healthier than pasteurized milk.

The dairy work group is a subcommittee of the Food Safety Advisory Committee, of which Lamb serves as chairwoman. FSAC, which, among other things, provides advice on food safety matters to IDPH, is not mandated by statute, but is supported through an FDA Food Safety Task Force Grant. “In other words, money from a federal agency – that has banned raw milk in interstate commerce and would like to see it banned in intrastate commerce – funded a work group to draft regulations for raw milk production and sales,” Kennedy said. “Aside from funding the work group, FDA also has one of its own employees, Larry Trandel, on the work group.” The PrairieAdvocate, in a series of articles (April 16 to May 7, 2013) on the dairy work group, including coverage of a work group meeting on May 1, 2013 that was open to the public, quoted Lamb as saying that since IDPH had
adopted the federal government Food Safety Modernization Act the IDPH must now create rules for raw milk simply because the act says it must. “Lamb’s statement is not true,” Kennedy said. “There is nothing in FSMA that requires a state to issue regulations governing raw milk. For Lamb to even make that claim shows

All raw milk is considered potentially adulterated.’ “Illinois law and policy on raw milk production and sales should be made in Illinois, not in Washington,” Kennedy said. “FDA has no business meddling in raw milk sales within the state of Illinois.”

Burnham grew up in the outdoors and traveled extensively, visiting various conservation and research projects throughout the third world with his father, William Burnham., former president of The Peregrine Fund. A bad sign Well, the thieves are at it again in Carroll County, stealing Democratic candidates’ signs. These signs are an expression of free speech. Evidently they are afraid that their candidates are not worthy of competition. I would encourage anyone who sees someone stealing our Democratic signs, if possible, take a picture or get their license plate number. Judge judges at the ballot box On Tuesday, Nov. 4, Illinois voters will have a chance to cast their ballots in the general election. In addition to voting for candidates for national and statewide offices, they will have a chance to vote for judges. Learning about the judicial candidates can be difficult, and all too frequently, voters choose to skip voting for these candidates rather than take the time to learn about them. That’s unfortunate, because judges have a huge impact on our lives. They strive to ensure that the law is fairly imposed, deciding for example who will have custody of your children or whether to punish someone who is convicted of a crime. The best judges are impartial, committed to public service, nonpartisan, empathetic, fair and extremely
knowledgeable about the law. Thankfully, there are ways to learn about judges running for election and retention. Bar association evaluations and newspaper endorsements are reliable, independent and relevant sources of information about the candidates’ qualifications. All candidates for Illinois judicial offices who won in the March 18 primary election have been rated by Illinois State Bar Association evaluations committees, or in a poll of lawyers conducted by the ISBA. Results are available at www.isba.org/ judicialevaluations. In counties outside Cook, the advisory poll is conducted by mail and is sent to all ISBA members in the circuit or district from which a
candidate seeks election. Licensed attorneys who are not members of ISBA, or any attorney outside the circuit or district, may request a ballot. Supports 1 percent sales tax in Carroll What would motivate a sane and fairly reasonable businessperson to say the new 1 percent sales tax is a good thing? I have one thought that might resonate with your cerebral cortex, and that is the fact that all the rascally politicians hanging out cannot – I repeat, cannot – touch one red cent of the money generated by the tax. Fact: 100 percent of the money generated by the new 1percent sales tax will go directly to the schools that children from our communities attend. Ya, ya, I know nobody likes taxes, but wouldn’t it be fantastic if a tax we pay for didn’t allow politi-

Public weighs in on bypass options Northwest by north, or south? BY CHRISTI WARREN Shaw News Service MORRISON – More than 300 people showed up to the Odell Public Library in Morrison on Thursday night to talk to engineers and review plans for the proposed U.S. Route 30 bypass project. The two proposed options, which have taken a number of different forms since the plan was introduced, are routes that would bypass Morrison to the north and south. Many residents are concerned that the proposal, which will expand Route 30 into a four-lane highway, will take away business from Morrison. Phil Renkes, who was at the open house Thursday night, lives in Morrison and is part of the Morrison Area Development Corp. He has folproposed years ago, and sees that it could be a good thing for the town. Renkes said that he sees that, in the short term, it might look like a bad thing, but residents should be thinking long-term. “You see towns our size or a little larger maybe that have added a lot of industry, and why? Because they’re on the interstate,” he said. “Take DeWitt, Iowa. DeWitt was a small town with very little industry. Now you drive by on a four-lane; they’ve had a lot of growth.” And, for the record, he prefers the southern route. Project leaders, though, don’t have a preference, which is why they’re asking for the public’s input on the matter. Becky Marruffo, a project engineer with the Illinois Department of Transportation, said that the next step in the project will be to take into consideration the public’s comments, and hopefully reach a decision in the next 6 months on which bypass route is the best option – or, if no construction is the best option. She said roadwork likely wouldn’t begin for years, though. Illinois ranks 48th

Illinois ranks 48th in the nation in “Economic Outlook,” according to the latest edition of “Rich States, Poor States,” an annual analysis of the relative economic outlook of the states, published by theAmerican Legislative Exchange Council. That’s the same ranking Illinois received the past 2 years. It’s based on 15 variables, including business tax rates, legal climate, workers’compensation costs, debt service payments and sales and property tax burden. The state’s high marginal business income tax rate of 9.5 percent was ranked 44th in the nation. Its 11.1 percent debt service as a share of tax revenue ranked it 43rd in that category. A $2.83 per $100 of payroll cost for workers’ compensation ranked 47th. Illinois did receive a relatively high score for its low percentage of public employees per 10,000 people, ranking 11th in that category. It also ranked 11th for its sales tax burden of $16.36 per $1,000 of income.

As the hearings got under way, emails surfaced that cast doubt on Quinn’s longstanding claim that the troubled violence prevention program was not linked to his campaign. Instead, the emails revealed that the program was a regular topic of discussion between the governor’s taxpayer-paid chief of staff and his campaign manager, including discussions of how the program could be used to boost support for the governor in African-American neighborhoods. The emails also showed that one Jerry Stermer, raised questions as to the effectiveness of the program, including one in which Stermer wrote, “. . . I am not at all persuaded that any of the ideas in neighborhood recovery have any solid evidence to show they achieve their goals.”

Illinois employers and the state’s costs continue to outpace neighboring states. Indiana’s $1.16 per $100 of payroll is the second lowest in the nation and less than half that of Illinois. Neighboring Iowa, Kentucky, Wisconsin and Missouri all have lower workers’ compensation rates than Illinois, with only Wisconsin breaking the $2 per $100 of wages mark and even that state’s rates are more than 75 cents per $100 of wages lower than Illinois. Illinois also ranked 48th for domestic migration – a measure of the number of people moving into the state versus the number moving out.According to the study, more than 600,000 similar measure looked at the number of new taxpayers as a percentage of total taxpayers in each state and again found Illinois 48th in the nation. This was the seventh edition of “Rich States, Poor States.” Its authors are Arthur B. Laffer, who served as a member of President Ronald Reagan’s Economic PolicyAdvisory Board and is best known for popularizing the “Laffer Curve” showing that tax revenues decline if tax rates exceed an optimal percentage; Stephen Moore, chief economist for the Heritage Foundation and a former member of the Wall Street Journal’s editorial board; and Jonathan Williams, senior task force director of

The people of Illinois must approve any changes to the Constitution before they become effective.
PROPOSED AMENDMENT TO SECTION 8.1 OF ARTICLE I OF THE ILLINOIS CONSTITUTION ARTICLE I – BILL OF RIGHTS SECTION 8.1. CRIME VICTIMS’ VICTIM’S RIGHTS. (a) Crime victims, as defined by law, shall have the following rights as provided by law: (1) The right to be treated with fairness and respect for their dignity and privacy and to be free from harassment, intimidation, and abuse throughout the criminal justice process. (2) The right to notice and to a hearing before a court ruling on a request for access to any of the victim’s records, information, or communications which are privileged or confidential by law. (3) (2) The right to timely notification of all court proceedings. (4) (3) The right to communicate with the prosecution. (5) (4) The right to be heard at any post-arraignment court proceeding in which a right of the victim is at issue and any court proceeding involving a post-arraignment release decision, plea, or sentencing. make a statement to the court at sentencing. (6) (5) The right to be notified of information about the conviction, the sentence, the imprisonment, and the release of the accused. (11) (9) The right to have present at all court proceedings, subject to the rules of evidence, an advocate and or other support person of the victim’s choice. (12) (10) The right to restitution. (b) The victim has standing to assert the rights enumerated in subsection (a) in any court exercising jurisdiction over the case. The court shall promptly rule on a victim’s request. The victim does not have party status. The accused does not have standing to assert the rights of a victim. The court shall not appoint an attorney for the victim under this Section. Nothing in this Section shall be construed to alter the powers, duties, and responsibilities of the prosecuting attorney The General Assembly may provide by law for the enforcement of this Section. (c) The General Assembly may provide for an assessment against convicted defendants to pay for crime victims’ rights. (d) Nothing in this Section or any law enacted under this Section creates a cause of action in equity or at law for compensation, attorney’s fees, or damages against the State, a political subdivision of the State, an officer, employee, or agent of the State or of any political subdivision of the State, or an officer or employee of the court. or in any law enacted under (e) Nothing in this Section or any law enacted under this Section shall be construed as creating (1) a basis for vacating a conviction or (2) a ground for any relief requested by the defendant appellate relief in any criminal case.
EXPLANATION The Constitution sets forth substantial rights for crime victims. The proposed amendment expands certain current rights: 1) Victims are currently entitled to fairness and respect throughout the criminal justice process. The amendment would also provide that they shall be protected from harassment, intimidation and abuse. 2) Victims currently can make a statement to the court when a criminal defendant is sentenced to punishment. The amendment would allow a victim to be heard at any proceeding that involves the victim’s rights, and any proceeding involving a plea agreement, release of the defendant or convicted individual, or sentencing. 3) Victims may obtain information about conviction, sentencing, imprisonment or release. The amendment would require prosecutors and the court to notify victims of those events before they happen. The amendment would also grant additional rights to crime victims: 1) A victim would have a right to formal notice and a hearing before the court rules on any request for access to the victim’s information which is privileged or confidential information. 2) A victim would have the right to have the judge consider the victim’s safety and the safety of his or her family before deciding whether to release a criminal defendant, setting the amount of bail to be paid before release, or setting conditions of release after arrest or conviction. 3) The victim would have the right to assert his or her rights in any court with jurisdiction over the criminal case, but would not have the same rights as the prosecutor or the criminal defendant and the court could not appoint an attorney for the victim at taxpayer expense. The proposed amendment would not alter the powers, duties or responsibilities of the prosecutor. Further, a criminal defendant would not be able to challenge his or her conviction on the basis of a failure to follow these provisions.

Organists featured in dedication concert MORRISON – Local church organists will present a recital at 2 p.m. Oct. 26 Morrison United Methodist Church. The Methodist organ, recently reworked and updated, will be the featured instrument. “This is a wonderful opportunity to hear the talented organists with which Morrison is blessed,” said Anne Frame on behalf of the Morrison UMC. “This occasion will celebrate the installation of the upgraded and enriched Methodist organ.” The organists are Pat Cassens from United Methodist Church, Marguerite Clark from Ebenezer Reformed, Rich Criss from Emmanuel Reformed, and Cynthia Perrizo from First Presbyterian Church. Each will play 12 to 15 minutes. Cellist Samuel Sykes, son of Philip and Carrie Sykes, also will perform. At the end of May, the organ was removed from the church to be modernized by the Levsen Organ Co. of Buffalo, Iowa. It was rewired and returned in mid-August. A 32-foot pedal was created and other stops were moved. A Midi computer was added that would allow, if needed, 99 different organists to program individually. Reservations due for LHS 40th reunion LANARK – Lanark High School Class of 1974 will celebrate its 40th class reunion Oct. 25. Starting at 3 p.m., the group will tour Eastland High School. “Classmates and guests should meet where the steps were 40 years ago – at the flag pole,” said Jeannine Kaylor, one of the organizers. “After the tour, we will continue on to Henry’s Double K in Mount Carroll with a casual gathering beginning at 5 p.m.” Dinner will follow with a “show and tell” program. “Some very ‘special guests’ may attend,” Kaylor added. The event ends at 8:30 p.m., followed by The Funnies band at Henry’s at 9 p.m., and weather permitting, a trip to Grumpy Derrer’s Farm for a campfire and s’mores, Kaylor said.
