By JEFF HELFRICH jhelfrich@shawmedia.com Ogle County Sheriff Brian VanVickle, along with other sheriffs in the state, released a statement Thursday, Dec. 4, expressing desire to work with Gov. JB Pritzker and the state legislature on revising the criminal justice reform SAFE-T Act that took effect in September 2023. The statement was made in response to Pritzker saying the state government is “open to listening to what changes might need to be made” after a woman was set on fire Nov. 17 in Chicago. A Chicago man who has more than 70 prior arrests, including eight felony convictions, has been accused in the case.
The SAFE-T Act’s history
The SAFE-T Act eliminated cash bail. Judges still can order someone to be detained as they await trial, but the new system is instead based on an offender’s level of risk of reoffending or fleeing prosecution. The SAFE-T Act also reformed police training, certification and use-of-force standards, expanded detainee rights and gave the attorney general’s office authority to investigate alleged civil rights violations by law enforcement. It also required body cameras at all police departments by 2025. VanVickle was president of the Illinois Sheriff’s Association when the SAFE-T Act was written and passed. His desire is to see judicial discretion restored, accountability strengthened, and ensuring that victims’ rights remain at the forefront in a potential revision, the statement said. He hopes the governor and legislators will engage directly with frontline law enforcement as they evaluate next steps. “I welcome an honest, expert-led conversation about what is – and is not – working for public safety in Illinois,” VanVickle wrote. “Law enforcement across the state has raised consistent concerns about provisions that restrict our ability to detain violent and repeat offenders. We all want fairness in the justice system, but fairness cannot come at the expense of victims or our communities. When individuals accused of the most serious crimes are released after a single hearing, victims lose confidence and families feel less safe. That must change.” The main change VanVickle would like to see in a revision to the SAFE-T

Ogle County Sheriff Brian VanVickle, along with other sheriffs, released a statement Dec. 4 expressing the desire to work with Gov. JB Pritzker. Act is judges having more control over the detention or release of defendants. The Ogle County sheriff said the legislation has yielded different results in each of Illinois’ 102 counties. Some counties have seen jail populations cut in half, while others have seen them rise significantly, VanVickle said. That is due to counties’ operations differing and lawyers interpreting the law differently in each county, he said. After the SAFE-T Act, defendants are being released almost immediately, or serving longer than they would have before 2023, he said. “We’ve seen people that get arrested on a no bond failure to appear warrant on Thursday now sit in jail potentially until Monday,” VanVickle said. “Whereas pre-SAFE-T Act, they would have been out the next morning. Those are issues we see when they take away that judicial oversight. For me, that’s the biggest issue at hand, not allowing the judges to make those decisions.” VanVickle cited the case of a woman who was arrested, transported to the Ogle County Jail for a detainable offense and kept in jail due to being “an issue with society” and was in a “true mental health situation.” She remained in jail for almost five months with no avenue, such as bond, to be released to seek care, he said. The sheriff also cited cases of failure to appear arrest warrants issued if someone doesn’t show up to multiple
court dates. A policy has been instituted by the sheriff’s office to only service those warrants north of Interstate 80 due to the likely quick release of those arrestees, he said. “Because we know they’re going to get out of jail, so it makes no sense to go all the way across the state to pick up somebody to just be released immediately,” VanVickle said. “Those are the unintended consequences of taking judicial discretion away.”
VanVickle: Act has had negative effects on safety, taxpayers
Daily population numbers in the Ogle County Jail taken at the end of the day are typically low-to-mid 40s since the SAFE-T Act took effect. Prior to 2023, numbers were typically in the upper 60s. VanVickle said overall numbers of inmates processed into jail since 2023 are actually slightly higher, due to multiple arrests and quick releases under the new system. The abolition of cash bail has created more processing and release work for Ogle County Jail personnel. “Our corrections staff is three deputies on the day shift,” VanVickle said. “They still have to do rounds and take care of the jail population and get them to court, all while doing the processing for new inmates that are all basically in and then right back out. It has definitely created a strain on staff that really is a concern and, at some point, will need to
be addressed through more staffing.” Ogle County’s jail was constructed in recent years and opened in early 2021, and was designed to be operated pre-SAFE-T Act. Now-nonexistent bail money was planned for the county’s debt service. “The jail is now essentially funded 100% by taxpayers,” VanVickle said. “The vast majority of our taxpayers don’t go to jail, but they have to fund the facility. It has not been that way in the past. Previously fines, fees and bond money contributed to that. Now it’s all on the backs of the taxpayers. It was previously never that way. That wasn’t our plan when we built the jail.” The Ogle County sheriff believes bond has a place in the criminal justice reform structure, namely as a way to ensure that people attend court appearances. He said that process has become “more cumbersome” since the SAFE-T Act. Ogle County Sheriff’s Office deputies are paid for their time in court on cases, and VanVickle said defendants not appearing in court due to less consequences is causing additional cost. “It’s an unfunded mandate, spending more overtime dollars to have people in court and defendants don’t show up,” VanVickle said. “I remember one day being at the courthouse and over 30 different defendants didn’t show up for one court call. It definitely is an issue.” VanVickle still is involved with the ISA’s executive board as its treasurer and as a past president. He will be part of an ISA legislative call in coming weeks on the topic of the SAFE-T Act. It is the Ogle County sheriff’s hope that discussions on criminal justice legislation are had by the legislature in coming months. VanVickle estimates that “probably 90 percent” of sheriffs in the state would support a revision to the SAFE-T Act. As ISA president at the time of the legislation, he was the lone sheriff to testify in front of the legislature. “I was asked one question: ‘Will you stop referring to offenders as criminals?’ That’s pretty much how the supermajority of the state legislature has worked with law enforcement since I’ve been in law enforcement,” VanVickle said. “That’s the frustrating part, the safety of our communities. While they came up with a catchy little title for the act, it hasn’t made our communities safer. It’s made it safer for the criminals.”

Judge orders Rochelle teen to provide passcode for cellphone Defense says teen can’t remember it By EARLEEN HINTON ehinton@shawmedia.com An Ogle County judge agreed Wednesday, Dec. 24, that a Rochelle teenager charged with shooting at a vehicle in October should give prosecutors his passcode to access his cellphone. Associate Circuit Judge Anthony Peska entered an order to “compel” Camren Hastings, 18, to provide access to his iPhone despite arguments from Hastings’ attorney that he did not remember the passcode. “My client does not remember the passcode,” Assistant Ogle County Public Defender Eric Morrow told Peska. “The defendant should be held in contempt of court if he refuses,” Assistant State’s Attorney Matthew Leisten countered. “We don’t believe he is being truthful. Our position is he should be
held in contempt of court until he provides it.” Leisten said Hastings had complied with a search warrant for another phone recovered by police. Camren Hastings Morrow said he did not believe the court could compel Hastings to provide the code if he can’t remember it. Hastings is charged with aggravated discharge of a firearm, a Class 1 felony, and aggravated use of a firearm as a person under the age of 21, a Class 4 felony. Both charges were filed in connection with an Oct. 4 incident in which Hastings is accused of firing a gun in the direction of a vehicle that was occupied by another person. Hastings has pleaded not guilty to all of the charges and has been held in the Ogle County Jail since his arrest in late October.
Leisten filed a motion Dec. 2 asking the court to compel Hastings to provide access to the iPhone, telling Peska that the phone was recovered from a shelf where Hastings was sleeping when police searched his home in the 400 block of Lake Lida Lane on Oct. 28. Police said the October search warrant stemmed from an Oct. 4 evening incident in which “a vehicle had been shot approximately 13 times in the 100 block of Willis Avenue.” At an Oct. 29 detention hearing, Leisten said Hastings was one of a group of 10 individuals walking on the street shooting guns about 11:10 p.m. Another juvenile has been charged in connection with the incident, but juvenile charges and hearings are not open to the public. Leisten said a passcode is needed to gain access to the iPhone, which had been recovered during a previous residential search. A Nov. 25 search warrant authorized law enforcement officers to press the fingers of Hastings to any ‘Touch ID sensor’ of any Apple brand device for the
purpose of unlocking it. Leisten said he was not sure the iPhone could be accessed through biometrics. Morrow did not object to Leisten’s motion to compel Hastings to provide the passcode, but requested Peska grant a continuance for another hearing for him to argue the defense’s position. Peska agreed and remanded Hastings to the Ogle County Jail, setting the next court date for 1 p.m. Jan. 28. Leisten said if witnesses are being summoned to that hearing their names likely will be redacted because they are juveniles. “The defendant knows who they are,” Liesten said. During an Oct. 29 hearing, Leisten said video footage obtained by officers showed four males and two females – some appearing to be juveniles – running into a nearby cornfield. He said it appeared that between 13 to 14 shots were fired at the vehicle during the incident and that police collected 12 bullet casings and two firearms near the scene.
Oregon man pleads not guilty to sexual abuse charges involving teen By EARLEEN HINTON ehinton@shawmedia.com An Oregon man charged with sexually abusing a teenage girl pleaded not guilty Wednesday, Dec. 24, and has asked for a jury trial. Brett A. Barnes, 42, entered his not guilty pleas on five counts of aggravated criminal sexual abuse, one count of attempted aggravated criminal sexual abuse and grooming when he appeared in Ogle County Circuit Court with his attorney Assistant Public Defender Eric Morrow. Barnes was remanded to the Ogle
County Jail and is scheduled to appear in court again at 1:30 p.m. Feb. 5. According to court documents, the incidents happened between May and July and Brett A. Barnes involved a 16-yearold girl. The grooming charge accuses Barnes of using a cellphone to “seduce, solicit, lure or entice” the girl to engage in unlawful sexual conduct with him. During a Dec. 17 hearing, Assistant
Ogle County State’s Attorney Matthew Leisten told Associate Circuit Judge Anthony Peska that Barnes and the girl were coworkers at an Oregon business when the alleged incidents occurred at Barnes’ residence. Leisten said Barnes admitted to buying alcohol for the girl and allowed her to stay at his home on at least one occasion, arguing that he should remain in jail to ensure the safety of the alleged victim and the surrounding community. Morrow argued that Barnes should be released to continue needed medical treatments in regard to his 2008 kidney transplant. Morrow also argued that Barnes had
no criminal record and would not be a flight risk since he had spent his entire life in Oregon or Mt. Morris. Peska denied Morrow’s request for release, noting that the girl was “obviously too young to consent” and that Barnes had a history of “collusion.” The Oregon Police Department took Barnes into custody Tuesday, Dec. 16. All of the charges filed against Barnes are Class 2 felonies punishable by three to seven years in the Illinois Department of Corrections upon conviction, followed by two years of mandatory supervised release. Convictions also require registration as a sex offender.

ehinton@shawmedia.com An Ogle County judge denied a Leaf River man’s request to be released from jail Wednesday, Dec. 24, as he faces two felony and three misdemeanor offenses stemming from a police chase between Byron and Leaf River. Zachary J. Popp, 31, is charged with the felony offenses of aggravated fleeing or attempting to elude a peace officer and possession of cocaine and the misdemeanor offenses of violating a condition of pretrial release, unlawful possession of hypodermic syringes or needles, and unlawful possession of drug paraphernalia. All the charges stem from a Dec. 20 incident in which police say Popp refused to stop for deputies and drove over a curb and sidewalk in Byron before his vehicle was disabled east of Leaf River. According to the Ogle County Sheriff’s Office, deputies attempted to check on a Ford Edge parked at a closed business in the 100 block of South Union Street in Byron at 10:53 p.m. Dec. 20. “The Ford immediately fled the location, driving over the curb and sidewalk, and diagonally entered the intersection of East Blackhawk Drive and South Union Street,” according to an Ogle County Sheriff’s Office news release. “The Ford fled westbound on West Blackhawk Drive, disregarding the stop light at North Colfax Street ... continued to flee westbound on Illinois Route 72, and was eventually disabled just east of Leaf River.” The felony charges accuse Popp of refusing to obey a deputy, driving away at a “rate of speed at least 21 mph over the legal speed limit” and possessing

less than 15 grams of a substance containing cocaine. Two of the misdemeanor charges accuse Popp of possessing hypodermic needles and Zachary J. Popp syringes and possessing a “crack pipe.” The other misdemeanor charge accuses Popp of violating a pretrial release condition from a domestic violence case in which he was ordered not to have any contact with Samantha Norup, 30, who was a passenger in his vehicle. During Popp’s Wednesday court appearance, Assistant State’s Attorney Matthew Leisten said Popp should not be released from custody because he had violated a pretrial release condition in the pending domestic violence case and has a previous criminal record that includes burglaries and other offenses. “Moreover he fled from police ... using excessive speed and he had cocaine,” Leisten said. “He is a flight risk.” Popp’s attorney, Assistant Public Defender Eric Morrow, argued for his client’s release, telling Associate Circuit Judge Anthony Peska that Popp could live with relatives in Oregon, be confined to that home, and walk to his court hearings. Morrow said information he had gathered indicates that Popp has a “severe drug addiction” and wants to seek treatment. Peska denied Morrow’s request.

Holiday celebrations are in full swing POLO HISTORY Betty Obendorf The eggnog is flowing, the majority of my toffee is made, and Christmas gatherings have started. Our family is about to have Christmas here in Polo and the house will be full. My eggnog is all made and when the bowl starts to empty, I pour in eggnog from the store. There still will be a lot of luscious whipped cream left in the bowl and at that point I use eggnog from the store. No one really knows the difference. I do cook mine and bring it up to a certain temperature. People will ask since a few years ago eggnog
made at home was not even cooked. Now one needs to watch all of that and be very careful. I think the family likes mine because of all the whipped cream floating around in the bowl. This year at Christmas the family will be honoring our veteran, my sister, Ruby Jean Isley. She served during the Korean War, and one day at the museum Kevin found her duffel bag with her name on it. Linda then found information of when she started to work at the Pentagon. Before that, she was in the Women’s Army Corps Band marching in parades and taking part in a movie. Then they wanted her at the Pentagon, where she served several years. Linda also found her letter to Santa in 1936 from the Toluca Star. We did not come to Polo until 1938. In

the letter, Ruby Jean asked Santa to bring her little sister, which was me, a Shirley Temple doll. I did not get the doll, which was first produced in 1930 by the Ideal Toy Company. It was popular until Shirley Temple headed into her pre-teen years and then it went away. They brought it back during the 1950s. At Aplington House, we have a Shirley Temple dress for a small child but no doll. Today if one wanted to buy an original Shirley Temple doll, you would pay more than $500. I do not think I am interested today. I did go shopping recently for myself at our new antiques shop in Polo, the Easy Street Emporium, by the restaurant. I loved the place and bought two Santas and a glass-blown house ornament from Germany. I could have spent the rest of the day
just looking and reminiscing. How I love all the things from past years. It was then time to go to the museum and drop off toffee for everyone. Also to see what Kevin has done in the past week while it had been so cold. Mike and Kevin had moved in a new cabinet for the veterans part and it is lovely with glass doors. We have many new ideas, so keep stopping by. We will be moving things around and changing areas. Also adding screens in places so the air can move a little better. As Christmas gatherings take place, enjoy being with your friends and family. This is what the holiday season is all about.

10 County releases Christmas tree recycling info SHAW LOCAL NEWS NETWORK contact@shawmedia.com The Ogle County Solid Waste Management Department once again is coordinating Christmas tree recycling in Ogle County. Trees will be ground up into usable mulch instead of going to a landfill. Mulch will be available at no cost for pickup at most locations. Please remove all decorations, lights, garland and the water stand. If using a tree bag for transport, remove the tree from the bag and keep the bag for use next year. Only trees are accepted at these dropoff points. Wreaths or other designs with metal frames are unable to be mulched and are not accepted. OBITUARIES Born: July 8, 1938 Died: December 25, 2025 Surrounded by her loving family, Donna Smith passed away on Thursday, December 25, 2025, at Froedtert Hospital in Milwaukee, WI, after a brief illness. She will forever be remembered for her service and love for her community. Donna was the first woman to be elected to the German Valley Village Board, becoming a trustee in 1983 and retiring after 40 years of service. A member of the German Valley Lions Club, she was also editor of its monthly newsletter, “The Lions Tale.” Among her many accomplishments are being named a Lions of Illinois Foundation Fellow and a Melvin Jones Fellow. She was the co-founder of the German Valley Historical Society & Museum. She was an active member of Silver Creek Reformed
Church, where she was previously employed as editor of the church’s monthly newsletter, Silver Creek Connection, and fill-in secretary. She served on the Board of Directors and on various committees at Malcolm Eaton Enterprises. Donna received the Freeport YWCA’s Woman of Excellence Award in 2004. For over 30 years, Donna was on the German Valley Days planning committee. Her love for and dedication to German Valley was apparent to all who knew her, being named German Valley Area’s Most Valuable Person in 1995. Donna Muzette (Greenfield) Smith was born on July 8, 1938, in Freeport, IL, to parents Henry and Toria (Sanders) Greenfield. She was a 1956 graduate of Pleasant Prairie Academy in German Valley. She attended the University of Dubuque, and graduated from Northwestern University School of Dental Hygiene, Chicago, in 1959. She married Harm Smith on August 22, 1959, at Silver Creek Reformed Church in German Valley. Her husband passed away on December 10, 1992. After graduating, Donna was employed as a dental hygienist in the office of
Dr. Daniel H. Griffiths in Freeport. She enjoyed working with words and expressed herself best in writing, leading her to a second career in journalism. She was employed by North Central Associated Publishers in Durand, IL. She was German Valley’s correspondent to the Stephenson County Scope, later becoming the publication’s editor. She wrote a weekly column entitled “Donna’s Data.” Raising five children along with her husband was her proudest achievement. The times she cherished most were those spent with her family, enjoying involvement in the lives of her children, grandchildren, and great-grandchildren. She enjoyed visiting historical points of interest in the United States and trips to Branson, Missouri. Survivors include her sons, Todd (LaWanda) Smith and Trent Smith, both of Freeport; daughters,: Starr (Joel) Flemming of Freeport and Heather (Bryan) Politsch of Forreston; grandchildren, Aaron (Becky) Rogers, Kyle Rogers, Jeremy (Kayla) Rogers, Jadie Smith, Gavin Smith, Courtney (Bryson) Reyes, Bailey Flemming, Austin Flemming, Braden Politsch,
Lacey Politsch, and Connor Politsch; and several great-grandchildren. She is also survived by her son-in-law, Toby Rogers; sister-in-law, Pat Smith; and special friends: Bill & Ruth Jewell, Norman & Eunice Miller, and Leslie Phillips. She is preceded in death by her husband, Harm; father and mother; brother, Henry Jr. who died in infancy; and daughter, Dawn (Toby) Rogers. VIEWS Andy Colbert Good to be back after some extensive traveling in December. No matter where I go, nothing compares to living in Ogle County. The big news coming out of the IHSA was an expansion of the football playoffs from 256 qualifying teams to 384. That decision was made by a vote from its member schools, (377 yes, 252 no, 96 abstentions). What this means is that most teams with losing records will get in. Anyone at 3-6 will make it and several 2-7 teams also will get in. “Too often throughout the years, football decisions have negatively impacted other sports at IHSA schools,” IHSA Executive Director Craig Anderson said. “We are hopeful that this football playoff expansion will provide intended relief to our schools by stabilizing conference movement and eliminating the difficulty of scheduling football games that many of our schools face each year. It may create some short-term complications for some schools, conferences and coaches, but we remain optimistic it will create long-term stability in football and beyond.”
Some might argue that is diluting the field, but consider teams from strong conferences such as the NUIC and Chicago Catholic League. Fulton and Morrison were 2-7 this season and likely would win a game or two in 1A. The top 16 teams in each classification will get a bye, which is good and bad. The good is that the 2-7 and 3-6 teams won’t see them right off the bat, thus balancing the level of play a bit. The bad is that teams don’t necessarily want a bye. Everybody would rather play each week and certainly 17 year olds don’t need an extra week of rest. Frankly, I see it as a detriment for the recipients of byes. You get out of sync while your next opponent stays in a regular routine. The first regular-season game will be Aug. 21, and by 2029, it will be Aug. 16. Many coaches have complained about how much of summer is being taken up by an earlier schedule. When the playoffs began in 1974, the first regular-season game was Sept. 6, with the championships wrapped up the weekend before Thanksgiving. Only 16 teams qualified per class compared with 48 now and the first two rounds were played in one week (Wednesday and Saturday). Also back then, a lingering school of thought was the farm kids had chores such as baling hay to do and the games
shouldn’t begin until after Labor Day. With rare exception, that’s no longer the case. Opening and ending dates for football vary greatly from state to state. Texas, where it is king, doesn’t end its playoffs until the week before Christmas. Here in Illinois, Thanksgiving is the ideal time. After that, weather can be a factor, as the postponed 5-8A championships experienced. Besides, December is the time to be on the basketball courts. With that being said, the Byron girls are off and running again. After a come-from-behind win over 3A-ranked Dixon in which Macy Groharing scored 13 points in the fourth quarter, the 12-0 Tigers made the finals of the 47th annual Dixon Holiday Tournament. The win streak came to an end with a 43-26 loss to Sterling. After falling behind 11-2, Byron came back to make it 11-11, but Sterling’s defense proved too stifling the rest of the way, wearing down the Tigers and a lessthan-100% Groharing. Holiday tourneys have a way of taking a toll on teams. In the semis, Sterling beat last year’s champ, Stillman Valley (12-3). Both Byron and Stillman finished with 32 wins last season and tied Dixon (29-6) for the Big Northern Conference crown in one of the best years ever for BNC roundball.
Add Winnebago (12-1) to the mix as top contenders in the conference, and 20-year coaching veteran Joni Carlson has a long tradition of winning at Lutheran. For a team such as Oregon, which has seen improvement, it will be a tall task breaking into the upper echelon of the league. An assist goes out to my next-door neighbor Josh Messenger for getting the last three columns in the paper. Before leaving town, I had thought they had been sent to editor Jeff Helfrich. Not so and unfortunately they remained on my home computer, which I did not have access to. About ready to tell Jeff to forget about them as it was close to deadline and I was 1,000 miles away, a last-ditch call went out to Josh. Fortunately he was home and I was able to walk him through gaining access to the computer and finding the documents to send to the newspaper. A tough task, but he passed with flying colors. As I said before, nothing beats living in Ogle County, where one can still feel comfortable letting a neighbor into your house. Doubt if that could have been pulled off if I lived in the big city somewhere.

Comparatively, hunters harvested 82,496 deer during the 2024 firearm season. The preliminary harvest for the second weekend of the firearm season, from Dec. 4 to 7, was 29,816 compared with 27,835 deer harvested during the same period in 2024. The preliminary harvest for the first weekend of this year’s firearm season, from Nov. 21 to 23, was 51,409 deer.
